The problem of justifying legal punishment has been at the heart of legal and social philosophy from the very earliest recorded philosophical texts. However, despite several hundred years of debate, philosophers have not reached agreement about how legal punishment can be morally justified. That is the central issue addressed by the contributors to this volume. All of the essays collected here have been published in the highly respected journal Philosophy & Public Affairs. Taken together, they offer not only significant proposals (...) for improving established theories of punishment and compelling arguments against long-held positions, but also ori-ginal and important answers to the question, "How is punishment to be justified?"Part I of this collection, "Justifications of Punishment," examines how any practice of punishment can be morally justified. The papers in Part II, "Problems of Punishment," address more specific issues arising in established theories. The authors are Martha C. Nussbaum, Michael Davis, and A. John Simmons. The scope and importance of the present work is manifest even to a casual glance; the actual heights of scholarly penetration and disinterestedness to which it rises can only be appreciated by the detailed examination of its text. From this latter examination, it readily appears that we are confronted with no ad hoc construction, no work cut, so to say, to fit a present need, however valid and cogent; but a work reflecting a near lifetime of application and animated by (...) a relentless devotion to documentary truth. I am now sitting in La Antigua, Guatemala. It's 6:00 a.m. Ancient church bells compete with their clanging. Some with a clear ringing, others of dead metal. For centuries this tiny town of some 20 square blocks was the very center of Christianity in the "new" world. Its philosophy was brought to this place, lock, stock, and barrel. Historical dynamics around feminism, race, and rape discouraged extensive early Black involvement in anti-rape work in the United States. In Los Angeles, concern among women of color in the movement and a state initiative to fund poorly served areas converged to produce two new Black rape crisis centers in the mid-1980s. Ironically, state funding, an otherwise conservative influence on the anti-rape movement, has facilitated the progressive goal of expanding racial and ethnic diversity in the Los Angeles anti-rape movement. Racially homogeneous (...) organizations contributed more to diversifying the movement than integration within organizations. Despite differences in political perspective, women from older feminist groups and the new community-oriented centers now successfully work in coalition. (shrink)

The use of with the future indicative is admittedly rare in post-Homeric Greek. In the passages concerned many deny the usage completely and either omit the particle or resort to emendation, or dismiss the construction as a mere ana-colouthon. In an instructive article in the Classical Quarterly, xl , Moorhouse argues in favour of retaining many of the readings, and it is only his interpretation that is in question here. His main thesis is that in Homeric Greek, where the usage (...) is common enough, κ or with the future means either ‘in that case’ or ‘probably’ . The latter usage, however, he regards as sometimes assuming a tone of dogmatic certainty , and this ‘emphatic future’ came to be the regular and literal meaning of the later idiom, without any irony being involved.
