L’étude de ce qui constitue la perfection première du mariage, c’est-à-dire son essence ou son constitutif formel, qui est l’union indissoluble des esprits et des cœurs des conjoints, porte une lumière nouvelle sur les fins du mariage. Cette union indissoluble, en tant qu’elle est la fin propre et prochaine du mariage, en constitue l’objet, qui spécifie formellement l’acte du mariage. La génération et l’éducation des enfants, qui n’est pas une partie intégrante de l’essence du mariage, est sa fin éloignée et (...) appartient à la perfection seconde du mariage, à savoir l’agir des époux. Cette doctrine thomiste des fins du mariage apparaît à différentes époques de l’histoire de la théologie et est adoptée par le Catéchisme du Concile de Trente. Avec le Code de droit canonique de 1917, elle disparaît totalement de l’enseignement catholique. Réapparue en 1930 dans l’encyclique Casti connubii, elle ne retrouve toute sa place dans l’enseignement du Magistère qu’à partir de Vatican II. La doctrine thomiste des sacrements, et du mariage en particulier, permet d’interpréter la position du Magistère actuel sur l’accès à la communion de divorcés remariés, en régime de dérogation à la séparation, et de conclure à la nécessité de manifester publiquement leur réconciliation avec Dieu et avec l’Église. Comprise comme vertu de l’amour universel, amor generalis, naturellement éprouvé envers le genre humain, la vertu d’affabilité est intégrée par Thomas à l’exercice de la vertu de charité, grâce à la réflexion d’Augustin.

After a brief biography of Thomas Aquinas, the article follows up the work of Leonard Boyle to show how the Summa serves to meet the requirements of a pedagogical project in the Dominican Order and more generally in the medieval Church. Intended for the initial and continuing formation of Dominican friars and students of conventual schools, the Summa is composed in a literary genre perfectly suited to this purpose, which governs its structure. The detailed presentation of the notion of sacra (...) doctrina elaborated in q. 1 provides the occasion to show how this notion itself determines the organization of the material. Finally, the presentation of the contents of the Summa’s three parts brings out the internal organization of the work and stimulates the reading of it. (shrink)

Le Glossaire du latin philosophique est un fichier d'environ 230.000 à 260.000 fiches consacré au vocabulaire philosophique du moyen âge. Une équipe du CNRS, au départ sous la direction de Pierre Michaud-Quantin, y a travaillé durant de nombreuses années. Récemment, il a été transporté de la Sorbonne à l'Institut de Recherche et d'Histoire des Textes, où il est désormais consultable à la Section latine. ISBN: 978-2-204-10679-5.This book, written by a Dominican priest who is president of the Leonine Commission, has generated public controversy primarily on account of its treatment of homosexuality. For instance, the French news magazine (...) Le Point published an article on it called “How Saint Thomas Justifies Homosexuality.” This perception is bolstered by the cover artwork of Saints Sergius and Bacchus, who are considered in some circles to be patron saints of homosexual love. In fact, the book has two distinct parts. The first part is entirely on marriage between persons of the opposite sex. Oliva argues that Thomas Aquinas’s teaching on marriage was obscured in the nineteenth century, reappropriated by the Second Vatican Council, and now can be used to justify the reception of Communion and sacramental penance by Catholics who divorce and remarry while their spouse is still living and their marriage is not annulled. Only in the second part of the book does Oliva argue for the civil and ecclesiastical recognition of homosexual unions that are not marriages.The book is addressed to a general audience, although it refers to scholarship when needed. Oliva’s purpose is to use Thomas to contribute to contemporary theology and pastoral care. He does not entirely reject magisterial teaching on sexual ethics. For instance, he sympathetically discusses the treatment of heterosexual sex in Humanae vitae, and is generally opposed to simultaneous sexual relationships that are between more than two persons.In the first part of the book, Oliva notes that for Thomas marriage has a twofold perfection. The first perfection consists in the union of the spouses (which need not involve sexual acts), and the second in the generation and education of children. According to Oliva, only the first perfection is essential to marriage, which is shown by the fact that a marriage is valid even if the spouses voluntarily choose to abstain from the sexual act. Oliva eventually argues that recognition of this point should lead to the acceptance of second marriages (i.e., marriages after divorce) and the recognition that circumstances might prevent sexual acts in such marriages from being sinful.According to Oliva, Thomas’s understanding of the essence of marriage was used by the Fathers of the Council of Trent in what he describes as a decision to avoid the condemnation of divorce and remarriage for those in the Christian East. This interpretation of Trent is highly questionable and seems to rely partly on Giancarlo Pani’s recent popularization of Piet Fransen’s controversial scholarship (147 n. 41). In fact, Oliva does not show how Thomas’s understanding of marriage was supposedly used against those who wished to condemn divorce and remarriage. In general, he ignores the Council of Florence and various medieval and late Scholastic discussions of marriage, and generally passes over theologians from outside the Dominican Order. [End Page 137]Oliva correctly notes that the Catechism of the Council of Trent follows Thomas in distinguishing between three motives or ends of marriage, namely, society and mutual support, procreation, and the remedy for concupiscence. He passes over the other motives discussed in the Catechism, such as beauty, wealth, and the desire for heirs. Moreover, he does not mention the Catechism’s discussion of the three goods of marriage, namely, union, children, and fidelity, and how these might be related to marriage’s motives and essence. This oversight is odd because the Catechism’s treatment resembles Thomas’s discussion in the Summa contra Gentiles, book IV, chapter 78, in which Thomas explains how marriage is ordered to procreation. In general, Oliva neglects texts that might not fit well with his interpretation of Thomas, such as this chapter and the unedited IV Sentences, d. 33, q. 1, a. 2c.Oliva argues that Thomas’s teaching on the essence of marriage was neglected by the Magisterium and rejected by the 1917 Code, although it was revived to some extent... The Heythrop Journal, EarlyView. -/- For the longest time, it has been generally held and widely acknowledged that Thomas Aquinas thought homosexual activity to be morally wrong. In recent years, this common interpretation has come under challenge by none other than the President of the Leonine Commission, the Dominican Adriano Oliva. In a recent book, Loves: The Church, the Remarried Divorced, and Homosexual Couples (in French Amours: L’Église, les divorcés remariés, les couples homosexuels), Oliva argues that Thomas (...) Aquinas would have supported homosexual practices for homosexual persons, or at least that an accurate application of Thomistic principles entails that homosexual acts are morally good. Is this just wishful thinking on Oliva’s part or does his argument have some merit? In order to answer that question, I will proceed in three parts: first, I will reveal numerous texts Oliva failed to take into account; second, I will explicate Oliva’s hermeneutic and the principal textual support he gives for his position; third, I will examine whether Aquinas would have changed his views on the morality of homosexual activity in light of modern advances in our understanding of the etiology and unchangeability of homosexuality. The Perfection of the Universe gives an account of the idea of the universe and its perfection in Aquinas's philosophy, but at the same time it provides an example of how a cosmology can be developed in a teleological framework. Although this is the cosmology of one who was first and foremost a theologian, the book tries to show how it was articulated philosophically and in relation to a particular model of the universe. As a contribution to the history of (...) philosophy, and Thomistic studies in particular, it seeks to draw more attention to Aquinas's view of the world, which has been relatively neglected in favor of emphasis on his theory of knowledge and theory of being, and at the same time to show how it is integral to his very understanding of being. The book thereby brings out a dimension of rationality in Aquinas's philosophy that is often ignored, especially as it concerns creation as a whole and what Aquinas refers to as convenientia in this whole. The systematic nature of Aquinas's conception of the universe is highlighted by the author's attempt to reconstruct the movement of his thought. Thus Oliva Blanchette focuses not just on the universe or on perfection but on the perfection of the universe as a unified idea that recurs frequently in both the philosophy and the theology of Aquinas and that has its own philosophical dynamic both as a logic and as an actuality. In doing so, he endeavors to correct misconceptions about Aquinas's idea of the universe, such as that found in Lovejoy's Great Chain of Being, and to show how the idea stands up philosophically even while being connected with a scientific model of the universe now viewed as obsolete. It focuses on the challenges of the new environments we now find ourselves in thanks to these technologies, and the issues arising from the newly established relationship between the virtual sphere and the real world. Each aspect is analysed by starting from a very specific example or a case study presenting a dilemma that can only be resolved by making a reasoned (...) ethical choice. Rather than thematically addressing only one of the many aspects mentioned above, the book presents a comprehensive introduction to, and a co-ordinated overview of, the various deontological and ethical issues regarding the spread of the most common information and communication technologies. Moral subjectivism is commonly associated with out-of-favour theories like, e.g., Alfred Ayer’s emotivism or John Mackie’s error theory. This paper approaches the field against the background of the attitudinal character of morality and religion. The possibility of a brand of moral subjectivism is established which is common to Ayer’s and Mackie’s theories in name only yet still has significant merits. The perspective from action theory and the philosophy of mind suggests that the problem of moral obligation, central to moral philosophy, (...) is more convincingly dealt with by subjectivism than by its rivals: In contrast to realism or even relativism (with which subjectivism is often confused), subjectivism can help to explain the peculiarities of obligation without forcing us to disregard the parallel problem in the field of religion. This finding calls into question the rationale for, as well as the success of, central assumptions in ontology and semantics which the realist so freely hands out in order to make his point: If religious facts and the truth-aptness of religious judgements will not explain religious obligation, moral facts and the truth-aptness of moral judgements will not help the moral realist either. So unless we do not wish to simply cast the problem of moral obligation aside, in future, moral subjectivism must be seriously considered as a worthwhile position in its own right. Die handlungstheoretische Betrachtung von Moral und Religion mit Hilfe der Philosophie des Geistes legt nahe, dass dieser moralische Subjektivismus mit dem für die Moralphilosophie zentralen Problem des moralischen Sollens besser umgehen kann als seine Rivalen: Anders als der Realismus oder gar der Relativismus (mit dem der Subjektivismus oft verwechselt wird), kann der hier ausgeleuchtete Subjektivismus mit der besonderen Verbindlichkeit moralischer Forderungen umgehen, ohne die Parallele zur besonderen Verbindlichkeit religiöser Forderungen in Abrede stellen zu müssen. Die Rolle und Durchschlagkraft der vom Realisten so freigiebig gespendeten ontologischen oder semantischen Zusatzannahmen er- scheint vor diesem Hintergrund fragwürdig. This article presents a parametrized functional interpretation. Depending on the choice of two parameters one obtains well-known functional interpretations such as Gödel's Dialectica interpretation, Diller-Nahm's variant of the Dialectica interpretation, Kohlenbach's monotone interpretations, Kreisel's modified realizability, and Stein's family of functional interpretations. A functional interpretation consists of a formula interpretation and a soundness proof. I show that all these interpretations differ only on two design choices: first, on the number of counterexamples for A which became witnesses for ¬A when defining (...) the formula interpretation and, second, the inductive information about the witnesses of A which is considered in the proof of soundness. Sufficient conditions on the parameters are also given which ensure the soundness of the resulting functional interpretation. The relation between the parametrized interpretation and the recent bounded functional interpretation is also discussed. (shrink)

In this survey of Roberto Esposito's thought, Bonito Oliva reflects upon the stakes of reading biopolitics in an immunitary key. After sketching the features of a "fundamental crisis in the sense of coexistence," the author, moving from ancient to modern philosophy, emphasizes the centrality of fear in Esposito's understanding of the origins of community. The importance of fear explains in part the intrinsic relation community has to immunity for Esposito, in which immunity is figured primarily as a negative form (...) of community. In the essay's closing pages, the author shows how deeply immunity informs Esposito's understanding of contemporary biopolitics. She goes on to note Esposito's indebtedness to Hegel, especially with regard to the negative, and echoes Esposito's and Deleuze's own calls for the construction of "an immanent norm of life.". Schwichtenberg showed that the System T definable functionals are closed under a rule-like version Spector’s bar recursion of lowest type levels 0 and 1. More precisely, if the functional Y which controls the stopping condition of Spector’s bar recursor is T-definable, then the corresponding bar recursion of type levels 0 and 1 is already T-definable. Schwichtenberg’s original proof, however, relies on a detour through Tait’s infinitary terms and the correspondence between ordinal recursion for α < ε₀ and primitive recursion over (...) finite types. This detour makes it hard to calculate on given concrete system T input, what the corresponding system T output would look like. In this paper we present an alternative (more direct) proof based on an explicit construction which we prove correct via a suitably defined logical relation. We show through an example how this gives a straightforward mechanism for converting bar recursive definitions into T-definitions under the conditions of Schwichtenberg’s theorem. Finally, with the explicit construction we can also easily state a sharper result: if Y is in the fragment Tᵢ then terms built from BR^ℕ,σ for this particular Y are definable in the fragment T_i+max{1,level(σ)}+2. This article presents an analysis of Gödel's dialectica interpretation via a refinement of intuitionistic logic known as linear logic. Linear logic comes naturally into the picture once one observes that the structural rule of contraction is the main cause of the lack of symmetry in Gödel's interpretation. We use the fact that the dialectica interpretation of intuitionistic logic can be viewed as a composition of Girard's embedding of intuitionistic logic into linear logic followed by de Paiva's dialectica interpretation of linear (...) logic. We then investigate the various properties of the dialectica interpretation, such as the characterisation theorem, and variants of Gödel's interpretation within the linear logic context. The role of contraction in extensions to classical logic, arithmetic and analysis is also discussed. (shrink)

What is discrimination and what makes wrongful discrimination wrong? Even after an ever-rising tide of research over the course of the past twenty-five or so years these questions still remain hard to answer. Exercising candid and self-critical hindsight, Larry Alexander, who contributed his fair share to this tide, thus remarked: “All cases of discrimination, if wrongful, are wrongful either because of their quite contingent consequences or perhaps because they are breaches of promises or fiduciary duties.” If this is true it (...) raises serious doubts as to how wrongful discrimination can be a moral wrong in itself. Also, the question comes up as to who it is who breaches a promise or a fiduciary duty. This paper defends the view that the substance of these remarks is better understood by couching them in a political approach towards discrimination. Against this background, they give rise to real and pressing concerns. Once we conceptualise the realm political along Hobbesian lines as the battleground comprising both the private sphere of the individual and the public sphere of the commonwealth it emerges that discrimination has different significance with regard to these respective spheres. In order to illustrate this, I adopt Kasper Lippert-Rasmussen’s descriptive account of discrimination as „differential treatment on the basis of membership of a socially salient group“ and the common view that wrongful discrimination is wrong because it is harmful, disrespectful, or both. In the private sphere the case can be made for morally permissible cases of discrimination. Sexual discrimination due to sexual self-determination with consequently freely choosing your sexual or romantic partner is the central case in point. Where somebody feels unfairly rejected and consequently hurt neither the charge of harm inflicted nor that of disrespect endured need be justified. No “breach of promises or fiduciary duties” is involved. The case is different, however, when it comes to the fiduciary of power. In discriminating, he who exercises the power of the commonwealth necessarily breaches a promise and a fiduciary duty. Discrimination thus appears to be more of a problem of political philosophy than one of applied ethics. We show that Spector's “restricted” form of bar recursion is sufficient (over system T) to define Spector's search functional. This new result is then used to show that Spector's restricted form of bar recursion is in fact as general as the supposedly more general form of bar recursion. Given that these two forms of bar recursion correspond to the (explicitly controlled) iterated products of selection function and quantifiers, it follows that this iterated product of selection functions is T‐equivalent to the (...) corresponding iterated product of quantifiers. Hermeneutics approaches the meaning of life quite uniquely: it grasps the intrinsic intelligibility of life by employing a universal concept of meaning, applicable to all phenomena. While other conceptions identify the meaning of life with values or scopes, hermeneutics starts from a grass-roots work on the meanings that are embedded at every level of reality. In this paper, I analyze this approach, especially focusing on Husserl, Heidegger, and Gadamer. First, I outline Husserl’s philosophy of meaning as developed in response to (...) the crisis of meaning. Second, I discuss Heidegger’s concept of meaning and his understanding of life as self-movement. Third, I analyze Gadamer’s concept of common sense and his idea of hermeneutic mediation that conveys the meaning of life itself. (shrink)

Metaphysics is not often spoken of as a venue for dialogue about anything, let alone culture or religion, which are more readily associated with phenomenology or hermeneutics in contemporary thinking. This collection of essays, however, by the late Boston College philosopher Oliva Blanchette, maintains the absolute necessity of metaphysics as a prerequisite for examining any particular 'realm of being,' in all areas of human inquiry, from the particular sciences to historical cultures and religions. Blanchette proposes metaphysics as a fundamental (...) and necessary level of intelligence presupposed in any exercise of judgment, discourse, or dialogue, among rational beings. At the same time, he defends the idea that dialogue is the first and most fundamental form in which such reasoning takes place in human experience, on a radically intersubjective level through language. Language does not fossilize but this does not mean that the language's evolutionary timeline is lost forever. Great apes provide a window back in time on our last prelinguistic ancestor's communication and cognition. Phylogeny and cladistics implicitly conjure Pan (chimpanzees, bonobos) as a superior (often the only) model for language evolution compared with earlier diverging lineages, Gorilla and Pongo (orangutans). Here, in reviewing the literature, it is shown that Pan do not surpass other great apes along genetic, cognitive, ecologic, or (...) vocal traits that are putatively paramount for language onset and evolution. Instead, revived herein is the idea that only by abandoning single‐species models and learning about the variation among great apes, there might be a chance to retrieve lost fragments of the evolutionary timeline of language. This work aims to reopen the fundamental question of being. It raises the question of being after the natural sciences and phenomenology have run their course and pursues it according to a method that is properly metaphysical as well as critical.

The term ‘gesture’ is often used for an action capable of conveying a meaning and, in this sense, it is related to the question of the origin of language. In this paper I rather focus on a concept of ‘gesture’ intended as the «supplement of an act», produced by an historical and cultural process and representative of a «pure mediality». Such a different notion of gesture should not to be confused with a form of expression considered as an end in (...) itself. In this perspective, I will try to think the artistic gesture not as bearer of meaning but as what is ‘beared’, i.e., as the non-communicative rest of previous acts of communication. (shrink)

We study a modal language for negative operators—an intuitionistic-like negation and its paraconsistent dual—added to (bounded) distributive lattices. For each non-classical negation an extra operator is hereby adjoined in order to allow for standard logical inferences to be opportunely restored. We present abstract characterizations and exhibit the main properties of each kind of negative modality, as well as of the associated connectives that express consistency and determinedness at the object-language level. Este artigo pretende examinar os primeiros parágrafos do capítulo 4 do _ Tratado teológico-político _ de Espinosa para compreender o conceito espinosano de Lei, com especial interesse nas noções de lei divina e lei humana. A análise parte do sentido absoluto de lei, como determinação necessária, que se divide em leis dependentes da necessidade da natureza da coisa e leis dependentes da decisão humana, e mostrará como o segundo tipo de lei é ontologicamente absorvido pelo primeiro, ao mesmo tempo em (...) que guarda sua importância do ponto de vista imaginário.
