Este artículo presenta una reflexión sobre el lugar y la pertinencia de la filosofía del arte en un mundo del arte en el cual cualquier cosa puede ser una obra de arte, a partir de la propuesta teórica de Arthur Danto. Si la filosofía aún tiene algo que decir sobre el arte, sería desde una posición que reconozca la centralidad de la práctica artística sin delimitarla. La apertura en el arte no puede ser un motivo de negación o juicio, sino (...) un incentivo al pensamiento. Sin embargo, según Danto, ello exige aceptar puntos de partida y consecuencias que modifican la relación entre arte y filosofía. (shrink)

This paper presents a reflection on subjectivity in the context of consumer society, discussing two alternative approaches: on the one hand, the iden- tification between subject and commodity, traceable, among others, to Bauman, and, on the other hand, Žižek’s interpretation of subjectivity as an emerging surplus of the conflict within the symbolic order. The result- ing exchange between these alternatives shows the constitutive relations of the subject of consumption in the dimension of desire, in the margin of freedom, and in (...) the role of reflexivity. Finally, the understanding of the relationship between the subject and the material world is proposed as a constructive performativity of subjectivity. (shrink)

This paper presents the results of a grounded analysis of an object organization case. The importance of clarifying the dynamics of the relationships of meaning contained in the modes of appropriation of the objects within the space of the living room is highlighted, since, as the analysis shows, a particular arrangement of objects cannot be isolated from the processes of identification of the individuals and from the construction and communication of a way of being or lifestyle. For this purpose, the (...) case study of object organization is presented in relation to contemporary culture theorists that have highlighted the importance of aesthetics in the production and reproduction of cultural practices and representations. The aim is to propose an alternative framework that enriches the analysis of the aesthetics of the object world in contemporary culture. (shrink)

The chapter provides a response to Patrick Toner, “Critical Study of Fabrizio Amerini’s Aquinas on the Beginning and End of Human Life,” Oxford Studies in Medieval Philosophy 2, 211–28. The chapter corrects two misrepresentations in Toner’s review. First, it proves that, given Aquinas’ assumptions on substantial form and human soul, Aquinas could not give up his preference for delayed hominization of the embryo even if he were acquainted with contemporary embryology. Aquinas takes as the starting point of his embryology (...) Aristotle’s characterization of the human soul as the act of an organic physical body having life potentially, and this characterization leads him to the conviction that the human soul can enter into the human body only after the principal vital organs are formed. Second, the chapter corrects Toner’s unusual interpretation of the clause “organic” in the Aristotelian characterization of the human soul, by specifying the different senses of potentiality in Aquinas’ embryology. The chapter reaffirms the core idea that establishing when the hominization of the human embryo begins is not decisive for rejecting abortion. The chapter suggests relating the question of abortion to the identity or continuity of the human embryo rather than to the beginning of hominization. (shrink)

The purpose of this paper is to provide a basis for a systematic development of signaling theory on CSR initiatives. The paper proposes signaling theory as a framework supportive of a strategic CSR approach; maps extant research on signaling through CSR initiatives; offers a comprehensive assessment of the most diffused CSR initiatives and discusses their eligibility as signaling devices; and outlines a research agenda to further develop and test signaling theory in business ethics. Specifically, the study reconsiders some key assumptions, (...) identifies key gaps in empirical validation, and proposes directions to extend multiple signal, signaling pattern, and target cases. The 14 essays collected in this volume explore the various aspects of Augustine’s philosophy and its medieval reception: by considering his education and the development of his thought as conveyed by a series of philosophical images and styles, the volume reconstructs the recurring motifs of his intellectual journey (the anti-Manichean polemic, his political vision, the role of reason, and the theory of war) and their fortune in authors such as Thomas Aquinas, Nicole Oresme, Gregory of Rimini, and Robert Grosseteste.

In this paper we describe the impact that Walton’s conception of argumentation schemes had on AI and Law research. We will discuss developments in argumentation in AI and Law before Walton’s schemes became known in that community, and the issues that were current in that work. We will then show how Walton’s schemes provided a means of addressing all of those issues, and so supplied a unifying perspective from which to view argumentation in AI and Law.

The aim of the presentation is to focus on the differences between two scientific contexts: the genetic engineering context of the 1970s, with specific attention paid to the use of the recombinant DNA technique to generate genetically modified molecules, and the current genome editing context, with specific attention paid to the use of CRISPR-Cas9 technology to modify human germ line cells genetically. In both events, scientists have been involved in discussions that have gone beyond mere professional deontology touching on specific (...) policy issues such as freedom of research, responsibility for the consequences of research, the right of the public to participate in the evaluation of the goals of research methods, the relationship between cost and benefit and possible social consequences. The comparison between these two scientific contexts suggests the need of handling such issues by defining procedures that meet the criteria of democracy and responsibility towards society. The underlying objective should be to effectively launch actions and interventions based not on a hierarchical approach but rather a reticular conception of knowledge. (shrink)

This book analyzes the uses of emotive language and redefinitions from pragmatic, dialectical, epistemic and rhetorical perspectives, investigating the relationship between emotions, persuasion and meaning, and focusing on the implicit dimension of the use of a word and its dialectical effects. It offers a method for evaluating the persuasive and manipulative uses of emotive language in ordinary and political discourse. Through the analysis of political speeches and legal arguments, the book offers a systematic study of emotive language in argumentation, rhetoric, (...) communication, political science and public speaking. The evolution of boundedly rational rules for playing normal form games is studied within stationary environments of stochastically changing games. Rules are viewed as algorithms prescribing strategies for the different normal form games that arise. It is shown that many of the “folk results” of evolutionary game theory, typically obtained with a fixed game and fixed strategies, carry over to the present environments. The results are also related to some recent experiments on rules and games.

From picture to photography and back. Tableau vivants, in their gestural synthetic dimension, represent for Diderot the apex of expression that the image can make explicit. Nothing closer to Wall’s poetics. His works show outstanding attention to detail: from scenic design to protagonists’ costumes, from light to actors’ action. And the result is exactly what Diderot saw in the eyes of people observing Chardin’s art: imagination at work.

El personaje de Hamlet ha sido un punto de referencia para gran parte de la filosofía europea del siglo XX, representando el espíritu y destino de Europa. Diversos autores, como Pavel Florenskij, Lev S. Vygotskij y Carl Schmitt, han visto en Hamlet la contradicción inherente a una transición epocal no resuelta, caracterizada por el dolor interminable de un interim. Mi artículo explora la posibilidad de interpretar el tiempo de Hamlet bajo esta luz, en relación con las ideas de Walter Benjamin (...) sobre el Trauerspiel alemán. A diferencia de Florenskij, que lee a Hamlet de manera trágica, sigo la tesis benjaminiana que sitúa a Hamlet como el fin del Trauerspiel moderno. En este marco, se revela la naturaleza de la conciencia moderna y su relación con la verdad, destacando cómo Hamlet encarna los rasgos aporéticos de la política moderna, en contraste con la visión premoderna de Carl Schmitt. Le point de départ de l’article est offert par une reprise du point de vue de l’esthétique du célèbre essai de Hilary Putnam, Fait/Valeur : la fin d’un dogme. La première étape consiste dans une analyse des propriétés esthétiques et des jugements connexes avec elles comme un cas paradigmatique du dépassement de la vieille dichotomie. La thèse ici défendue est que les jugements esthétiques sont cognitifs d’une manière non conceptuelle, et normatifs sans présupposer des normes définies. En unissant dans un (...) seul terme des niveaux de descriptivité négative avec des niveaux d’évaluation (positive), les jugements esthétiques mettent irréversiblement en crise la solidarité de physicalisme et d’émotivisme. Par conséquent, l’article poursuit l’objectif d’une déduction au sens kantien des jugements esthétiques, en unifiant, au moins du point de vue méthodologique, les deux niveaux de l’enquête que Kant maintient stratégiquement distincts, à savoir le plan d’une exposition empirique (physiologique) des jugements esthétiques et celui d’une exposition transcendantale. Le noyau théorique de la déduction est l’idée d’un « mécanisme esthétique » sous-jacent comme la base naturelle pour l’épigenèse de l’esthétique. (shrink)

Mein Aufsatz ist eine kritische Auseinandersetzung mit dem kürzlich erschienenen Buch Leibniz andArnauld von Robert Sleigh. Ich versuche zu zeigen, daß Sleigh bei seiner Argumentation gegen die Ansicht, daß Leibniz Superessentialist gewesen sei, den entscheidenden Unterschied übersieht zwischen individuellen und allgemeinen essentiellen Eigenschaften und er sich auf eine eindeutig falsche Interpretation der relevanten Texte stützt; außerdem, daß Sleighs Zuordnung der Lehre der , superintrinsicalness' zu Leibniz sowohl textlich nicht begründet als auch formal mehrdeutig ist, und daß Sleighs Analyse der Begriffe (...) Kompossibilität und Akkomodation zu wünschen läßt. Ich versuche auch -im Gegensatz zu dem, was eine Anzahl von Leibniz-Interpreten in letzter Zeit behauptet hat -zu zeigen, daß sich Leibniz auf possibilia vor allem mit der Absicht bezog, eine Interpretation von kontrafaktischen Aussagen und Kontingenz zur Verfügung zu stellen. Subjekt, Objekt und Intersubjektivitat bilden drei der wohl zentralsten Elemente im menschlichen Erkenntnisprozess. Anhand einer kritischen Rekonstruktion der Erkenntnistheorien Hegels und Adornos beleuchtet die vorliegende Arbeit die Dialektik zwischen Subjekt und Objekt der Erkenntnis aus zwei verschiedenen Perspektiven. Durch den grundsatzlichen Paradigmenwechsel Habermas' von der Bewusstseinsphilosophie zu einem kommunikationstheoretischen Paradigma wird es moglich, <I>kommunikative Intersubjektivitat als unverzichtbares Element der Erkenntnis angemessen zu thematisieren.<BR> Der Gang von Hegel uber Adorno zu Habermas wird in der vorliegenden Monographie nicht als ein stetiger Fortschritt (...) verstanden, an dessen Zielpunkt die Habermas'sche Theorie als der Weisheit letzter Schluss stehen wurde. Vielmehr erweist sich der Dreischritt selbst als ein dialektischer, der am Ende, angereichert durch Erfahrungen, wieder in seinen Ausgangspunkt mundet. So endet die Untersuchung letztlich mit dem kommunikationstheoretisch angereicherten Desiderat einer modernen Subjekttheorie.". (shrink)

In this paper my objective is two-fold. First, I will try to provide further arguments in favour of the view defended in my earlier paper¹. In particular, I will try to show (in § 1) that a plausible understanding of the notion of a complete concept, coupled with (what I take to be) a reasonable interpretation of Leibniz's intriguing talk of severa “possible Adams” (§ 2), leads quite naturally to the view that Leibniz was committed to the doctrine of world-bound (...) individuals. Second, I will try to show (in § 3) that a suggestive way of saving contingency in the framework of Leibniz's theory of complete concepts is bound to fail : and the reasons for this failure will provide further evidence in favour of the view under present discussion. The remaining sections of the paper (§§ 4-6), will be concerned with fixing and making precise some of the loose ends of the previous three sections. Thus §§ 4 and 5 will be devoted to an analysis of Leibniz's use and understanding of the notions of contingency and necessity, and essence and accident, respectively. It will be shown that Leibniz's use and understanding of those notions is perfectly consistent with his commitment to the doctrine of world-bound individuals. In § 6, finally, I will try to indicate exactly how David Lewis' Counterpart Theory can be brought to bear upon Leibniz's theory of complete concepts, and, specifically, how it ought to be interpreted in that context. Statements about the future are central in everyday conversation and reasoning. How should we understand their meaning? The received view among philosophers treats will as a tense: in ‘Cynthia will pass her exam’, will shifts the reference time forward. Linguists, however, have produced substantial evidence for the view that will is a modal, on a par with must and would. The different accounts are designed to satisfy different theoretical constraints, apparently pulling in opposite directions. We show that these constraints are (...) jointly satisfied by a novel modal account of will. On this account, will is a modal but doesn't work as a quantifier over worlds. Rather, the meaning of will involves a selection function similar to the one used by Stalnaker in his semantics for conditionals. The resulting theory yields a plausible semantics and logic for will and vindicates our intuitive views about the attitudes that rational agents should have towards future-directed contents. Moving from the pages of Cahiers and Discours sur l' esthétique , where Paul Valéry clarifies the energetic value of aesthetics that rises from pleasure, the essay aims to promote a radical reconfiguration of conceptual domain of aesthetics. The sensation, in the surprising and gratifying form of pleasure, becomes expression of the efficiency of the link between emotional device and perceptive recognition: the thick and harmonizing synthesis that's peculiar to aesthetic.

Argument from analogy is a common and formidable form of reasoning in law and in everyday conversation. Although there is substantial literature on the subject, according to a recent survey ( Juthe 2005) there is little fundamental agreement on what form the argument should take, or on how it should be evaluated. Th e lack of conformity, no doubt, stems from the complexity and multiplicity of forms taken by arguments that fall under the umbrella of analogical reasoning in argumentation, dialectical (...) studies, and law. Modeling arguments with argumentation schemes has proven useful in attempts to refine the analyst’s understanding of not only the logical structures that shape the backbone of the argument itself, but also the logical underpinning of strategies for evaluating it, strategies based on the semantic categories of genus and relevance. By clarifying the distinction between argument from example and argument from analogy, it is possible to advance a useful proposal for the treatment of argument from analogy in law. (shrink)

What is the origin and meaning of our aesthetic sense? Is it genetically encoded or is it culturally inherited? The aim of the essay is to answer to such issues by defining the emergent and meta-functional character of the aesthetic attitude. First, I propose to include the faculty of desire in the free play of the cognitive faculties at the center of Kant’s Critique of Judgment. The following step is given by a brief analysis of Darwin’s controversial remarks on the (...) pre-human birth of aesthetics and its relationship with sexual selection (§§ 1-2). The point of discontinuity between a mere animal aesthetic sense and a proto-human one is then found to become indeterminate of desire in the correlative diversification of aesthetic attractors (§§ 3-4). Successively, I deal with the supervenience character of the aesthetic and its anticipatory value. After a short genealogy of the notion of supervenience, I then develop its affinity with that of epigenesis (§§ 5-6). Afterwhich follows a review of two contemporary evolutionary perspectives on aesthetics: T. Deacon’s essay on the “aesthetic faculty” and J. Tooby and L. Cosmides thesis on the evolutionary meaning of the aesthetic-fictional activities (§§ 7-8). Conclusively, the epigenesis of an aesthetic mind is considered as the unity between the breath of aísthesis and the breath of linguistic sign (§§ 9-10). (shrink)

An important module in the Belief-Desire-Intention architecture for artificial agents (which builds on Michael Bratman’s work in the philosophy of action) focuses on the task of intention reconsideration. The theoretical task is to formulate principles governing when an agent ought to undo a prior committed intention and reopen deliberation. Extant proposals for such a principle, if sufficiently detailed, are either too task-specific or too computationally demanding. I propose that an agent ought to reconsider an intention whenever some incompatible prospect is (...) sufficiently valuable along some dimension that can be assessed at zero or near-zero computational cost. Even though, over the last two decades, the boundaryless career concept has stimulated a wide theoretical debate, scholars have recently claimed that research on the competencies that are necessary for managing a cross-boundary career is still incomplete. Similarly, the literature on emotional and social competencies has demonstrated how they predict work performance across industries and jobs but has neglected their influence in explaining the individual's mobility across boundaries and their impact on career success. This study aims to fill these gaps (...) by examining the effects of emotional and social competencies on boundaryless career and on objective career success. By analyzing a sample of 142 managers over a period of 8 years, we found evidence that emotional competencies positively influence the propensity of an individual to undertake physical career mobility and that career advancements are related to the possession of social competencies and depend on the adoption of boundaryless career paths. This study also provides a contribution in terms of the evaluation of the emotional and social competencies demonstrated by an individual and of the operationalization of the measurement of boundaryless career paths, considering three facets of the physical mobility construct (organizational, industrial, and geographical boundaries). Semantic perceptualism is the thesis that meaning experiences are forms of perceptual experiences. According to its defenders, this view is motivated not only by philosophical considerations, but also by empirical evidence. In the present article, I shall provide the first comprehensive and critical review of the empirical evidence in support of semantic perceptualism, including a detailed analysis of the relevant neuroanatomical data. The conclusions of my analysis are largely pessimistic. I believe that the relevant behavioral, cognitive, and patient data are (...) suggestive but hardly conclusive. Moreover, neuroanatomical data speak strongly against semantic perceptualism. (shrink)

This paper makes the two following claims: 1) The legal dimension of loyalty within organizations goes beyond duties. The governance design aimed at ensuring loyalty may strongly affect standards that characterize each layer of the organization. The interaction between standards of duty and the governance dimension of loyalty should, therefore, be more tailored to specific legal forms and their functional correlation with ownership and financing. 2) There is a greater divergence than has so far been acknowledged between the function of (...) loyalty in vertically integrated firms and in networks of small firms. This difference, created by the relationship between the duty and the governance dimensions, should have repercussions on the definitions of legal standards. In particular, it should reflect the different relationships between hierarchy, monitoring, and loyalty and the choice between prohibitory, authorization-based, and compensatory rules. The analysis concentrates on the key variables that may affect the choice between vertical and horizontal monitoring to ensure compliance with loyal behavior in two polar models: hierarchical firms and networks of small firms. It reveals the importance of considering the governance design when defining duties of loyalty and related standards to evaluate party-related transactions in both cases but, at the same time, the necessity of using different interpretive categories.
