In this article the main features and development trends of mediation as an alternative dispute resolution method are analyzed in the legal environment of the Republic of Lithuania. Mediation is analyzed as one of the primary informal alternative dispute resolution processes during which the third neutral, which is not authorized to take a decision during negotiations, helps the parties solve their dispute and the main aim of this process is the peaceful resolution of the dispute and the renewal of social (...) peace between parties. In order to create favourable legal environment for the implementation of mediation process, it is necessary to consolidate the main requirements for the mediation process: requirements for confidentiality, responsibility of mediators, legal power of conciliatory agreements, etc. In this article the legal regulation of mediation in the Republic of Lithuania is described as well. The debate about the nature of modernity and postmodernity has become central to intellectual culture today. In this work, two distinguished social theorists make a distinctive contribution to this continuing discussion.

Freud, Psychoanalysis and Symbolism offers an innovative general theory of symbolism, derived from Freud's psychoanalytic theory and relocated within mainstream scientific psychology. It is the first systematic investigation of the development of Freud's treatment of symbolism throughout his published works, and discovers in those writings a broad theory which is far superior to the widely accepted, narrow, 'official' view. Agnes Petocz argues that the treatment of symbolism must begin with the identification and clarification of a set of logical constraints and (...) psychological requirements which any general theory of symbolism must respect, and that these requirements have been neglected by existing accounts across a number of disciplines. Her newly proposed 'Freudian broad' theory of symbolism, by contrast, does meet these requirements, but only after it has been rehabilitated within a revised psychoanalytic context, encompassing major changes to our understanding of the concepts of unconscious and repression and the role of language. Aspiration by Agnes Callard locates standing assumptions in the theory of rationality, moral psychology and autonomy that preclude the possibility of working to acquire new values. The book also explains what changes need to be made if we are to make room for this form of agency, which I call aspiration.

This radical analysis of the role and importance of historiography interprets the philosophy and theory of history on the basis of historicity as a human condition. The book examins the norms and methods of historiography from a philosophical point of view, but rejects generalisations tht the philosophy of history can provide all the answers to contemporary problems. Instead it outlines a feasible theory of history which is still radical enough to apply to all social structures.

The issues touched on in my work range between individual creation and social consciousness. We have entered an age of alienation brought on by specialization, a by-product of the Information Age. This is an age of complexity, when knowledge and ideas are coming in faster than can be assimilated, while disciplines become progressively alienated from each other through specialization. The hard-won knowledge that accumulates undigested, blocking meaningful communication. Clearly defined direction for mankind is lacking. The turn of the century and (...) the next millennium will usher in a troubled environment and a troubled psyche.Making art today is synonymous with assuming responsibility for our fellow man. I am concerned with the fact that we have taken evolution into our own hands. We are the first species that has the ability to consciously alter its evolution, modify itself at will, even put an end to its existence. We have gotten hold of our destiny and our impact on earth is astounding. Because of our tremendous success we are overrunning the planet, squandering its resources. We are young as a species, even younger as a civilization, and like reckless children initiate processes we cannot control. We tend to overproduce, overuse, and quickly tire of things. We also overreact, panic, and self-correct in hindsight. The pluralistic nature of things creates too many variables, confusing the goals to be achieved. Sustained interest and effective action are diminished with the alienation of the individual who feels little potential to interact or identify effectively with society as a whole. Overview for mankind is lacking and as the momentum increases human values tend to decline. Agnes Denes has had over 250 solo and group exhibitions on four continents since 1965. She has participated in such major international exhibitions as Project ’74, Cologne; the 1976 Biennale of Sydney, Australia; Documenta 6 in Kassel, Germany; and the Venice Biennales of 1978 and 1980. In 1989, she received her fourth National Endowment Individual Artist Fellowship. She has published four books, including The Book of Dust—The Beginning and the End of Time and Thereafter. (shrink)

We consider arrow logics (i.e., propositional multi-modal logics having three -- a dyadic, a monadic, and a constant -- modal operators) augmented with various kinds of infinite counting modalities, such as 'much more', 'of good quantity', 'many times'. It is shown that the addition of these modal operators to weakly associative arrow logic results in finitely axiomatizable and decidable logics, which fail to have the finite base property.

This paper seeks to determine the extent to which individuals with borderline personality disorders can be held morally responsible for a particular subset of their actions: disproportionate anger, aggressions and displays of temper. The rationale for focusing on these aspects lies in their widespread acknowledgment in the literature and their plausible primary association with blame directed at BPD patients. BPD individuals are indeed typically perceived as “difficult patients” (Sulzer 2015, Bodner et al. 2011), significantly more so than schizophrenic or depressive (...) patients (Markam 2003). The “responsibility question” for patients with BPD has already been raised (Martin 2010, Zachar & Potter 2009, Bray 2003), but this paper tackles it from a novel perspective. First, I narrow down the category of things for which the responsibility question is specific to individual with BPD. After that, I argue that some of the diagnosis criteria of BPD such as emotional instability or impulsivity might serve as excusing factors targeting the “control condition” on moral responsibility. Second, this paper also considers another widely accepted condition on moral responsibility: the epistemic condition. The view defended in the paper is that the answer to the responsibility question for individuals with BPD, concerning both the control condition and the epistemic condition, hinges on an understanding of their epistemic profile. Ayahuasca has become a subject of great interest in recent years. Academics, spiritual seekers, communities, and curious individuals have all been intrigued by this topic through either writing about it or direct participation in the contemporary spiritual phenomenon that is ayahuasca, which holds promises of bestowing upon its users profound wisdom or healing. However, what anthropological (but also popular) writings barely comment on are the deviant perceptions that arise out of experiences seeking amelioration or transcendence, and the subjective ways in (...) which those experiences are interpreted. Consequently, I wish to supplement this scope of representation. In this text, I present fieldwork conducted in the Peruvian Amazon amid the Shipibo, focusing on the experiences of the spiritual seekers who came to them in search of healing or self-discovery. I discovered a unique contradiction—participation in Shipibo ayahuasca practices while simultaneously having or developing a negative perception or attitude towards it. These aberrances are held, as I argue herein, (incognizantly) in the expressed attitudes of the Westerners (especially North American and European) as a result of the positivist notions that emerged from the Age of Enlightenment (but are not limited to it). My priority in this article is to present and expound on these atypical associations and place them against a historical (Western) background to elucidate the origin of the thus found and experienced perceptions. This paper critically engages with how life not worth living (LNWL) and cognate concepts are used in the field of beginning-of-life bioethics as the basis of arguments for morally requiring the application of preimplantation genetic diagnosis (PGD) and/or germline genome editing (GGE). It is argued that an objective conceptualization of LNWL is largely too unreliable in beginning-of-life cases for deriving decisive normative reasons that would constitute a moral duty on the part of intending parents. Subjective frameworks are found to be (...) more suitable to determine LNWL, but they are not accessible in beginning-of-life cases because there is no subject yet. Conceptual and sociopolitical problems are additionally pointed out regarding the common usage of clear case exemplars. The paper concludes that a moral requirement for the usage of PGD and GGE cannot be derived from the conceptual base of LNWL, as strong reasons that can be reliably determined are required to limit reproductive freedom on moral grounds. Educated predictions on prospective well-being might still be useful regarding the determination of moral permissibility of PGD and/or GGE. It is suggested that due to the high significance of subjective experience in the normativity of beginning-of-life bioethics, the discipline is called to more actively realize the inclusion of people with disabilities. This regards for instance research design, citation practices, and language choices to increase the accessibility of societal debates on the reproductive ethics of genetic technologies. (shrink)

Is Europe's continuing crisis merely a financial one? Tackling issues ranging from Europe's legal, institutional and cultural identity to its border, citizenship and integration policies, and looking forward to its legacy for the future, the contributors to this volume interrogate the various dimensions and contours of the European crisis. By revisiting Derrida's diagnosis of the crisis of European identity, they simultaneously propose a new direction for Europe, and an alternative response to today's crisis.

This paper attempts to examine the symbols being used by the protagonists in the war in Iraq relative to traditional Christian theology, the myths on which it was built and ensuing praxis. In particular I wish to consider the value allotted to ‘the feminine’ in the cultural and religious symbolic realm that underpins societal understanding of the relational climate necessary for liberty and justice to be effective.

Standard dual-process models in the action domain postulate that stimulus-driven processes are responsible for suboptimal behavior because they take them to be rigid and automatic and therefore the default. We propose an alternative dual-process model in which goal-directed processes are the default instead. We then transfer the dual- process logic from the action domain to the emotion domain. This reveals that emotional behavior is often attributed to stimulus-driven processes. Our alternative model submits that goal-directed processes could be the primary determinant (...) of emotional behavior instead. We evaluate the type of empirical evidence required for validating our model and we consider implications of our model for behavior change, encouraging strategies focused on the expectancies and values of action outcomes. BackgroundInformed consent as stipulated in regulatory human research guidelines requires that a volunteer is well-informed about what will happen to them in a trial. However researchers are faced with a challenge of how to ensure that a volunteer agreeing to take part in a clinical trial is truly informed. We conducted a qualitative study among volunteers taking part in two HIV clinical trials in Uganda to find out how they defined informed consent and their perceptions of the trial procedures, study (...) information and interactions with the research team.MethodsBetween January and December 2012, 23 volunteers who had been in the two trials for over 6 months, consented to be interviewed about their experience in the trial three times over a period of nine months. They also took part in focus group discussions. Themes informed by study research questions and emerging findings were used for content analysis.ResultsVolunteers defined the informed consent process in terms of their individual welfare. Only two of the volunteers reported having referred during the trial to the participant information sheets given at the start of the trial. Volunteers remembered the information they had been given at the start of the trial on procedures that involved drawing blood and urine samples but not information about study design and randomisation. Volunteers said that they had understood the purpose of the trial. They said that signing a consent form showed that they had consented to take part in the trial but they also described it as being done to protect the researcher in case a volunteer later experienced side effects.ConclusionVolunteers pay more attention during the consent process to procedures requiring biological tests than to study design issues. Trust built between volunteers and the research team could enhance the successful conduct of clinical trials by allowing for informal discussions to identify and review volunteers’ perceptions. These results point to the need for researchers to view informed consent as a process rather than an event. (shrink)

I present an overview of emotion theories, organised around the question of emotion causation. I argue that theories of emotion causation should ideally address the problems of elicitation, intensity, and differentiation. Each of these problems can be divided into a subquestion that asks about the relation between stimuli and emotions (i.e., the functional level of process description, cf. Marr, 1982) and a subquestion that asks about the mechanism and representations that intervene (i.e., the algorithmic level of process description). The overview (...) reveals that theories of emotion causation sometimes differ with regard to the kind of process that they hold responsible for emotion causation. More precisely, they hold different assumptions regarding the conditions under which the process is supposed to operate (optimal versus suboptimal), the format of the representations involved (propositional versus perceptual), and the object or input of the central process (stimulus versus responses/experience). Further, the overview reveals that theories of emotion causation sometimes differ with regard to the level of process description that they focus on. Finally, the overview brings to light several similarities among the theories discussed. (shrink)

Adaptors are proteins of multi‐modular structure without enzymatic activity. Their capacity to organise large, temporary protein complexes by linking proteins together in a regulated and selective fashion makes them of outstanding importance in the establishment and maintenance of specificity and efficiency in all known signal transduction pathways. This review focuses on the structural and functional characterisation of adaptors involved in tyrosine kinase (TK) signalling. TK‐linked adaptors can be distinguished by their domain composition and binding specificities. However, such structural classifications have (...) proven inadequate as indicators of functional roles. A better way to understand the logic of signalling networks might be to look at functional aspects of adaptor proteins such as signalling specificity, negative versus positive contribution to signal propagation, or their position in the signalling hierarchy. All of these functions are dynamic, suggesting that adaptors have important regulatory roles rather than acting only as stable linkers in signal transduction. Feminist science criticism has mostly focused on the theories of the life sciences, while the few studies about gender and the physical sciences locate gender in the practice, and not in the theories, of these fields. Arguably, the reason for this asymmetry is that the conceptual and methodological tools developed by (feminist) science studies are not suited to analyze the hard sciences for gender-related values in their content. My central claim is that a conceptual, rather than an empirical, analysis is (...) needed; one should be looking for general metaphysical principles which serve as the conceptual foundation for the scientific theory, and which, in other contexts, constitute the philosophical foundations of a worldview that legitimates social inequalities. This position is not being advocated anywhere in the philosophy of science, but its elements are to be found in Helen Longino's theory of science, and in the social epistemology and ontology of Georg Lukács.
