In Experiment, Right or Wrong, Allan Franklin continues his investigation of the history and philosophy of experiment presented in his previous book, The Neglect of Experiment. Using a combination of case studies and philosophical readings of those studies, Franklin again addresses two important questions: (1) What role does and should experiment play in the choice between competing theories and in the confirmation or refutation of theories and hypotheses? This book provides the reader with a detailed and captivating account of the story where, for the first time, physicists ventured into proposing a new force of nature beyond the four known ones - the electromagnetic, weak and strong forces, and gravitation - based entirely on the reanalysis of existing experimental data. Back in 1986, Ephraim Fischbach, Sam Aronson, Carrick Talmadge and their collaborators proposed a modification of Newton’s Law of universal gravitation. Underlying this proposal were three tantalizing pieces of (...) evidence: 1) an energy dependence of the CP (particle-antiparticle and reflection symmetry) parameters, 2) differences between the measurements of G, the universal gravitational constant, in laboratories and in mineshafts, and 3) a reanalysis of the Eötvos experiment, which had previously been used to show that the gravitational mass of an object and its inertia mass were equal to approximately one part in a billion. The reanalysis revealed that, contrary to Galileo’s position, the force of gravity was in fact very slightly different for different substances. The resulting Fifth Force hypothesis included this composition dependence and also added a small distance dependence to the inverse-square gravitational force. Over the next four years numerous experiments were performed to test the hypothesis. By 1990 there was overwhelming evidence that the Fifth Force, as initially proposed, did not exist. This book discusses how the Fifth Force hypothesis came to be proposed and how it went on to become a showcase of discovery, pursuit and justification in modern physics, prior to its demise. In this new and significantly expanded edition, the material from the first edition is complemented by two essays, one containing Fischbach’s personal reminiscences of the proposal, and a second on the ongoing history and impact of the Fifth Force hypothesis from 1990 to the present. HE FIRST SHOWS WHY THERE IS A PROBLEM OF CONSISTENCY WITH THIS DOCTRINE, GIVEN ORTHODOX CHRISTIAN BELIEFS. HE THEN CLAIMS THAT AQUINAS HAS TWO SOLUTIONS, AND THAT BOTH FAIL: THE FIRST SOLUTION, AS SCOTUS ALSO OBSERVES, DOES NOT RESOLVE THE APPARENT INCONSISTENCY, AND THE OTHER DEPENDS ON MAKING HUMANITY ACCIDENTAL TO CHRIST, AND HENCE ON ABANDONING THE ORTHODOX POSITION.

Hume argued that passions, unlike judgments of the understanding, cannot be reasonable or unreasonable. Crucial for his argument was the premise that passions cannot be correct or incorrect. As he put it: “[a] passion is an original existence … and contains not any representative quality” and “passions are not susceptible of any … agreement or disagreement either to the real relations of ideas, or to real existence and matter of fact … being original facts and realities, compleat in themselves.” In (...) this paper I will argue that desires, like beliefs, can be correct or incorrect. In Film and Phenomenology, Allan Casebier develops a theory of representation first indicated in the writings of the father of phenomenology, Edmund Husserl, and then applies it to the case of cinematic representation. This work provides one of the clearest expositions of Husserl's highly influential but often obscure thought. It also demonstrates the power of phenomenology to illuminate the experience of the art form unique to the twentieth-century cinema. Film and Phenomenology is intended as an antidote to all hitherto (...) existing theories about the nature of cinematic representation, whether issuing from classic sources such as the film theory of Andre Bazin or the post-structuralist synthesis of Lacanian psychoanalysis, Barthesian textual analysis and Metzean cine-semiotics. Casebier shows how a phenomenological account of representation will further the aims of any film theory. Developing a viable feminist film theory, legitimizing the documentary, answering the challenge of Derridean deconstruction, properly theorizing narrativity, Film and Phenomenology argues that theory of film must be Realist both with respect to epistemology and ontological issues. Modern aesthetics is divided into two branches – the Anglo-American and the Continental. A major cause of this division is their divergent views about the place of history in aesthetics, the first tending to minimize historical considerations, while the second readily embraces them. This article explores the place of history in André Malraux's theory of art and argues that his thinking quickly resolves this long-standing disagreement. There is a philosophical puzzle about blaming people for their attitudes that arises because we lack direct voluntary control over our attitudes. The fact that we lack direct voluntary control over our attitudes suggests that we are not responsible for them. Defenders of blaming people for their beliefs have appealed to various senses in which we are responsible for our beliefs, despite our lacking direct voluntary control over them. In this paper, I pursue a different strategy. I argue that it (...) is something fitting to be ashamed of your beliefs, or, to put this another way, that it is sometimes fitting to feel shame for believing something. I articulate an account of shamefulness, on which the shameful is a species of legitimate expectation violation. By contrast with blameworthiness, shamefulness does not entail responsibility. For this reason, the fittingness of shame for beliefs (i.e. doxastic shame), unlike the fittingness of blame for beliefs (i.e. doxastic blame), is orthogonal to questions of responsibility. Independent of whether we are responsible for our beliefs, doxastic shame can be fitting. (shrink)

Governing boards utilize executive compensation contracts in an attempt to align executive actions with corporate goals. The objective is to ensure that executive performance provides value to the organization in terms of successful outcomes. A key performance criteria typically specified in CEO compensation contracts is earnings targets. However, using earnings as a performance evaluation may be problematic because some firms exhibit robust and sustained earnings over time (high earnings persistence), and other firms, such as high growth oriented firms, exhibit weak (...) or sometimes negative earnings over time (low earnings persistence). Our study reveals that the effect of high earnings persistence results in firms that focus more heavily on cash compensation (salary and bonus) rather than on equity compensation (stock options, etc.) to compensate executive performance. Additionally, for firms characterized by low earnings persistence, our study indicates that cash flows from operations act as a supplementary performance measure to accounting earnings, and become increasingly important as a means to justify executive cash compensation. The idea that the Leviathan frontispiece offers a visual summary of the contents of the work is widespread. However, the analysis of the frontispiece often under-explores Leviathan's text or leaves certain iconographic elements aside. In discussions of the Scholastics ‘Dilemma’ emblem, for instance, the image is commonly reduced to a representation of ‘logic’ or ‘scholasticism’, leaving aside the intricate interrelationship between the objects present in the image and their connection with the content of the book. This paper argues that this (...) image helps understanding Hobbes’ critique of Scholastic doctrines and their political effects in Leviathan. For Hobbes, these supposedly pure philosophical concepts either in logic (trident of the ‘Syllogism’) or metaphysics (‘Real/Intentional’ bident) hide a central part of Scholastic thought: a ‘seditious’ political conception claiming that the Pope has an indirect right to temporal power in affairs concerning spiritual matters theory (‘Spiritual/Temporal’ and ‘Direct/Indirect’ bidents). The Scholastic model made the common people believe that the Pope would have at least as much authority as the Sovereign. When faced with the choice between obeying either the Pope or their Civil Sovereign the subjects would find themselves in a dangerous ‘Dilemma’. (shrink)

This chapter discusses a pair of interrelated theses that are hallmarks of Objectivism: the benevolent universe premise and the heroic view of man. These theses are dramatic consequences of the defining essentials of the philosophy, and they are central to the sense of life conveyed by Ayn Rand's novels. The benevolent universe premise permeates all her novels, and much of her non‐fiction, but it seems that she first conceptualized this view under this name sometime in the 1940s. The benevolent universe (...) premise is what Rand calls a metaphysical value‐judgment. It is metaphysical in that it answers a question about the nature of the universe. The chapter briefly describes the heroic view of man, looking not at the content of Rand's view of heroism, but at how this view of heroism colored her view of humanity and of specific human beings. Ronald Dworkin's theory of law forges a close connection between questions about the truth of propositions of law and the question of political obligation: law as integrity is a theory of legal practice that purports to explain, not only how the content of law is determined, but also why the law—in ordinary cases—imposes an obligation of obedience. The theory (as presented) is ultimately incoherent. If we accept Dworkin's theory of the grounds of law we are obliged to reject his claims (...) about its force; alternatively, if we accept his view of the force of law, we must reject his theory about its grounds: he cannot be correct about both force and grounds. Dworkin supposes that, in extraordinary cases, the force of law is cancelled or overridden; but the relevant considerations of justice are wholly internal to our identification of the content of law. Consistently elaborated, integrity denies the offending requirements legal status: lex injusta non est lex. (shrink)

The behavior of some nightlife-setting patrons would be unacceptable in workplaces or public settings and could cause distress to other patrons. This quantitative study determined 381 young Australian’s descriptive and personal norms regarding four types of sexual behavior. Participants’ personal norms were that these behaviors are wrong, but they reported that the behaviors are common in a nightlife setting. Behaviors such as these could theoretically be prevented by modifying patrons’ descriptive norms with evidence that their beliefs are contrary to individuals’ (...) personal norms of acceptable behavior in nightlife settings. A successful lexicographic semantic description characterizes the concepts that occur in establishing the meaning of a listeme by modelling what the competent native-like speaker of the language knows. Because concepts can only be identified to another human through the medium of a natural language, the metalanguage used in the semantic definition of a natural language expression in the object language will always be equivalent to the natural language expression through which that metalanguage is interpreted. The metalanguage of a semantic theory (...) is a demonstrably rational abstract model developed by applying the analyst’s experience and intuitions to inferences drawn from occurrences of actual speech events. Each sense of a listeme is characterized by a description of the salient properties of its typical denotatum. To most effectively implement this project in conceptual engineering is to capture every possible sense of the listeme using metalanguage that is at the same time precise, comprehensive, and succinct. A review of several proposed lexicon/dictionary entries for the listeme cup reveals lacunae that are rectified in a decision procedure whose output characterizes the relevant sense of the input listeme using natural language and the procedural constructs/commands &, XOR, IF, ELSE, ELIF, GOTO, OUTPUT, TENABLE, NEXT ITEM. The resulting lexicographic semantic description satisfies the specified success condition. As one possibility, contagious sickness and forms of bondage characterize the culture of home, whereas the sailor's condition and less civilized sites offer health, romance, and freedom. But an opposite possibility is that (...) the ship resembles an unhealthy prison and the foreign settings are spoiled, and so hope resides in the curative power still emanating from the civilization of home. The two possibilities may relate to the Goethean-Carlylean pattern of Bildung, whereby the protagonist initially rebels and escapes from home but later repents and returns, recognizing that his America must be "here or nowhere" (Carlyle 1899, 156),1 in Massachusetts rather than in California. Dana indeed desires first to become entirely the sailor but then in terror before that eventuality desires to return to his identity as a Harvard scholar. With respect to the motif of literacy, the initial effort to live fully amid the bracing energies of winds and sea gives way to an appreciation of the curative force of reading and writing books. Yet the two phases are not after all so neatly opposed and divided between two halves of the story. They coexist in a tension that is sometimes also resolved.In 1842, two years after publishing Two Years before the Mast, Dana began to compose "An Autobiographical Sketch, 1815–1841." This "Sketch" (1968) creates a context for the previously published work that justifies the first of the two interpretations. His early life has already featured, in the "Sketch," many incidents of wandering away from home and of rebellion against the restrictions and injustices of society. The turbulent young protagonist especially resents the tyranny of the schoolmasters who administer floggings and later the tyranny of the authorities at Harvard College who unfairly punish a classmate. How often our actions go awry because our perceptions are at odds with reality! This book examines the legal issues that arise when we seek to avoid the untoward consequences of an action by claiming that our perception was flawed. We all make mistakes. Some have unfortunate consequences: we might overpay a debt or make an unfavourable contract, or we might be sued or accused of a crime as a result of our mistake. Claims to alleviation on the grounds of (...) mistake are likely to arise wherever the law prescribes a state of mind as a prerequisite for the application of a legal rule. This book asks when the fact that a person made a mistake should entitle them to alleviation. This may involve the intention to enter into a contract or a payment, in which case a person could seek its reversal, or it might involve the intent to commit a tort or crime, in which case they could seek forgiveness for the offence. Farnsworth defines 'alleviating' mistakes as those which entitle a person to relief from untoward consequences of their mistake.There is no general 'law of mistake', and despite their similarities, few discussions of mistake in one setting pause to consider mistakes in other contexts. The goals of fields as disparate as contracts and criminal law are very different: how do these differences affect the treatment of mistakes? Farnsworth sets out a new taxonomy of mistakes. His analysis reveals that over the past century, there has been a remarkable increase in the receptivity of courts and scholars to claims for both reversal and forgiveness- a waxing of alleviating mistakes. Terminally ill people might want to discuss the options they have of hastening their deaths with their psychologists who should therefore know the law that regulates euthanasia in the jurisdictions where they practice. The legal, and therefore ethical, situation that influences psychologists’ position and terminally ill people’s options, however, differs notably across jurisdictions. Our aim is to provide a brief moral-legal historical context that explains how the law reform processes in different jurisdictions created these different legal contexts and options that, (...) in turn, influence psychologists’ ethical position. Feminist scholars have long been concerned with privileged women’s activism and engagement with feminist politics and how acts of resistance from privileged subjects might best be understood. In the current moment, we are seeing a reinvigoration of interest in feminist activism particularly from young women, but not necessarily focusing on young women who are positioned as privileged. Simultaneously, there is attention in the sociology of elite schooling to the question of social justice politics in privileged spaces. In this article, we (...) contribute to both of these scholarly conversations by reporting on the feminist activism of three young women attending an elite school in Australia. We argue that these young women’s activism/feminist politics need to be understood as a complex entanglement of resistance and reproduction with regard to gender, race and class, and that drawing on recent theorisations influenced by post-humanism in feminist educational research produces fresh insights into researching gender/race/class reproduction by young women in elite educational settings.
