Este livro pretende ser um convite à leitura das obras de Álvaro Vieira Pinto. Chama-se 'Esperança e democracia' porque no núcleo do pensar desse, que foi o mais consistente filósofo do nacionalismo brasileiro, estão a esperança - o ânimo de quem não teme o destino e quer projetar no mundo as marcas da sua vontade - e a democracia, o regime político dos homens comuns.

It filled me with pleasure to be asked by Problema editor-in-chief Sandra Gómora Juárez to lead a discussion on the theories and doctrine on precedent in our context alongside Prof. Marina Gascón Abellán. Besides the undeniable and recognized prestige of the Problema journal, there was also the possibility of working with Prof. Marina Gascón again and with Sandra Gómora for the first time. It was also an opportunity to discuss issues regarding precedent with old friends like Flavia Carbonell, Fabio Pulido (...) and Silvia Zorzetto, and exchange opinions with new ones like Rodrigo Camarena. On this occasion, I would like to comment specifically on the works of Prof. Fabio Pulido Ortiz and Prof. Silvia Zorzetto, both of which are of unquestionable quality. The article by Prof. Pulido Ortiz of the Universidad de la Sabana in Colombia is a work of analytical finesse and subtlety that discusses some fundamental problems of legal theory from the standpoint of the theory of precedent. Prof. Silvia Zorzetto from Università Statale di Milano has conducted an analytical and metalinguistic survey of the use of precedents in Italy, particularly at the Italian Sezioni Unite Civili della Corte di Cassazione. This work is priceless not only in terms of its value as a study of (internal) Italian legal culture, but also because the analysis can be generalized, at least in part, to explain how precedents are used in civil law systems. Cuando la profesora y directora de la revista Problema, Sandra Gómora Juárez, nos propuso a la profesora Marina Gascón Abellán y a mí llevar a cabo una discusión acerca de las teorías y doctrinas del precedente en nuestro contexto, no me pude sentir más contento. Al indudable y reconocido prestigio de la revista Problema se sumó la posibilidad de volver a trabajar con la profesora Marina Gascón y hacerlo por primera vez con Sandra Gómora. Además, surgió la oportunidad de volver (...) a discutir con viejos amigos —como Flavia Carbonell, Fabio Pulido, Silvia Zorzetto— sobre cuestiones relativas al precedente, y poder contrastar opiniones con otros nuevos, como Rodrigo Camarena. En esta ocasión, me corresponde comentar, en particular, los trabajos del profesor Fabio Pulido Ortiz y de la profesora Silvia Zorzetto. Ambos trabajos son de una indudable calidad. El del profesor Pulido Ortiz, de la Universidad de La Sabana de Colombia, es un trabajo de finura y sutileza analítica que entra a discutir, al calor de la teoría del precedente, algunos problemas fundamentales de la teoría del derecho. La profesora Silvia Zorzetto, de la Università Statale di Milano, ha llevado a cabo un reconocimiento analítico y metalingüístico de la práctica de los precedentes en Italia, con especial atención a le Sezioni Unite Civili della Corte di Cassazione italiana, de incalculable valor. Ello no sólo por el valor que pueda tener para el estudio de la cultura jurídica (interna) italiana, sino porque su análisis puede ser, al menos en parte, generalizado para dar cuenta de cómo son usados los precedentes en los ordenamientos de civil law. ObjectiveThe presence of two or more chronic diseases results in worse clinical outcomes than expected by a simple combination of diseases. This synergistic effect is expected to be higher when combined with some conditions, depending on the number and severity of diseases. Multimorbidity is a relatively new term, with the first fundamental definitions appearing in 2015. Studies usually define it as the presence of at least two chronic medical illnesses. However, little is known regarding the relationship between mental disorders and (...) other non-psychiatric chronic diseases. This review aims at investigating the association between some mental disorders and non-psychiatric diseases, and their pattern of association.MethodsWe performed a systematic approach to selecting papers that studied relationships between chronic conditions that included one mental disorder from 2015 to 2021. These were processed using Covidence, including quality assessment.ResultsThis resulted in the inclusion of 26 papers in this study. It was found that there are strong associations between depression, psychosis, and multimorbidity, but recent studies that evaluated patterns of association of diseases had heterogeneous results. Quality assessment of the papers generally revealed low quality among the included studies.ConclusionsThere is evidence of an association between depressive disorders, anxiety disorders, and psychosis with multimorbidity. In this paper, we develop an organizational account that defines biological functions as causal relations subject to closure in living systems, interpreted as the most typical example of organizationally closed and differentiated self-maintaining systems. We argue that this account adequately grounds the teleological and normative dimensions of functions in the current organization of a system, insofar as it provides an explanation for the existence of the function bearer and, at the same time, identifies in a non-arbitrary way the norms that (...) functions are supposed to obey. This study presents the application of self-organizing maps to air-quality data in order to analyze episodes of high pollution in Madrid. The goal of this work is to explore the dataset and then compare several scenarios with similar atmospheric conditions : some of them when no actions were taken and some when traffic restrictions were imposed. The levels of main pollutants, recorded at these stations for eleven days at four different times from 2015 to 2018, are analyzed in order to (...) determine the effectiveness of the anti-pollution measures. The visualization of trajectories on the self-organizing map let us clearly see the evolution of pollution levels and consequently evaluate the effectiveness of the taken measures, after and during the protocol activation time. The organizational account of biological functions interprets functions as contributions of a trait to the maintenance of the organization that, in turn, maintains the trait. As has been recently argued, however, the account seems unable to provide a unified grounding for both intra- and cross-generation functions, since the latter do not contribute to the maintenance of the same organization which produces them. To face this ‘ontological problem’, a splitting account has been proposed, according to which the two kinds of functions (...) require distinct organizational definitions. In this article, we propose a solution for the ontological problem, by arguing that intra- and cross-generation functions can be said to contribute in the same way to the maintenance of the biological organization, characterized in terms of organizational self-maintenance. This paper aims to provide a philosophical and theoretical account of biological communication grounded in the notion of organisation. The organisational approach characterises living systems as organised in such a way that they are capable to self-produce and self-maintain while in constant interaction with the environment. To apply this theoretical framework to the study of biological communication, we focus on a specific approach, based on the notion of influence, according to which communication takes place when a signal emitted by a (...) sender triggers a change in the behaviour of the receiver that is functional for the sender itself. We critically analyse the current formulations of this account, that interpret what is functional for the sender in terms of evolutionary adaptations. Specifically, the adoption of this etiological functional framework may lead to the exclusion of several phenomena usually studied as instances of communication, and possibly even of entire fields of investigation such as synthetic biology. As an alternative, we reframe the influence approach in organisational terms, characterising functions in terms of contributions to the current organisation of a biological system. We develop a theoretical account of biological communication in which communicative functions are distinguished from other types of biological functions described by the organisational account (e.g. metabolic, ecological, etc.). The resulting organisational-influence approach allows to carry out causal analyses of current instances of phenomena of communication, without the need to provide etiological explanations. In such a way it makes it possible to understand in terms of communication those phenomena which realise interactive patterns typical of signalling interactions – and are usually studied as such in scientific practice – despite not being the result of evolutionary adaptations. Moreover, this approach provides operational tools to design and study communicative interactions in experimental fields such as synthetic biology. (shrink)

Appellate Court Modifications Extraction consists of, given an Appellate Court decision, identifying the proposed modifications by the upper Court of the lower Court judge’s decision. In this work, we propose a system to extract Appellate Court Modifications for Portuguese. Information extraction for legal texts has been previously addressed using different techniques and for several languages. Our proposal differs from previous work in two ways: our corpus is composed of Brazilian Appellate Court decisions, in which we look for a set of (...) modifications provided by the Court; and to automatically extract the modifications, we use a traditional Machine Learning approach and a Deep Learning approach, both as alternative solutions and as a combined solution. We tackle the Appellate Court Modifications Extraction task, experimenting with a wide variety of methods. In order to train and evaluate the system, we have built the KauaneJunior corpus, using public data disclosed by the Appellate State Court of Rio de Janeiro jurisprudence database. Our best method, which is a Bidirectional Long Short-Term Memory network combined with Conditional Random Fields, obtained an \ score of 94.79%. (shrink)

In recent years, supported by new scientific evidence, the conceptualization of cognitive reserve has been progressively enriched and now encompasses not only cognitive stimulating activities or educational level, but also lifestyle activities, such as leisure physical activity and socialization. In this context, there is increasing interest in understanding the role of psychological factors in brain health and cognitive functioning. In a previous study, we have found that these factors mediated the relationship between CR and self-reported cognitive functioning. In this study, (...) we have confirmed an association between two important constructs included in the psychological wellbeing and salutogenic models, “purpose in life” and “sense of coherence,” CR, as assessed using a questionnaire, and cognitive functioning, as evaluated using a comprehensive neuropsychological battery. Results from 888 middle-aged healthy participants from the Barcelona Brain Health Initiative indicate that both sense of coherence and CR were positively associated with verbal memory, reasoning and attention, working memory, and global cognition. Moreover, the relation between CR and cognitive functioning in the different domains is partially mediated by SoC. When we controlled for brain integrity, introducing into the model neurofilament light chain measures, the mediator role of SoC was confirmed for reasoning and attention and global cognition. However, purpose in life was not associated with cognitive functioning. These results reveal the central role of the SoC construct, which mediates the association between classic CR estimates and cognitive functions, potentially representing a modifiable target for interventions that aim to promote brain health. Both physiological and evolutionary criteria of biological individuality are underpinned by the idea that an individual is a functionally integrated whole. However, a precise account of functional integration has not been provided so far, and current notions are not developed in the details, especially in the case of composite systems. To address this issue, this paper focuses on the organisational dimension of two representative associations of prokaryotes: biofilms and the endosymbiosis between prokaryotes. Some critical voices have been raised against the (...) thesis that biofilms are biological individuals. Nevertheless, it has not been investigated which structural and functional obstacles may prevent them from being fully integrated physiological or evolutionary units. By contrast, the endosymbiotic association of different species of prokaryotes has the potential for achieving a different type of physiological integration based on a common boundary and interlocked functions. This type of association had made it possible, under specific conditions, to evolve endosymbionts into fully integrated organelles. This paper therefore has three aims: first, to analyse the organisational conditions and the physiological mechanisms that enable integration in prokaryotic associations; second, to discuss the organisational differences between biofilms and prokaryotic endosymbiosis and the types of integration they achieve; finally, to provide a more precise account of functional integration based on these case studies. In this paper, we advocate the idea that an adequate explanation of biological systems requires appealing to organizational closure as an emergent causal regime. We first develop a theoretical justification of emergence in terms of relatedness, by arguing that configurations, because of the relatedness among their constituents, possess ontologically irreducible properties, providing them with distinctive causal powers. We then focus on those emergent causal powers exerted as constraints, and we claim that biological systems crucially differ from other natural systems in (...) that they realize a closure of constraints, i.e. a second-order emergent regime of causation such that the constituents, each of them acting as a constraint, realize a mutual dependence among them, and are collectively able to self-maintain. Lastly, we claim that closure can be justifiably taken as an emergent regime of causation, without admitting that it inherently involves whole-parts causation, which would require to commit to stronger ontological and epistemological assumptions. El propósito de la investigación es profundizar en los fundamentos filosóficos de la teoría arquitectónica de Leon Battista Alberti en el tratado _De re aedificatoria_, en particular en el Prefacio y el libro I, donde se discuten aspectos centrales del proceso de diseño entendido como creación intelectual y estética a través de los conceptos de _pulchritudo_ y _lineamenta_. El punto de partida del análisis se sitúa en la relación establecida entre los principios de _lineamenta_ y _forma_ en la teoría retórica (...) ciceroniana y en los conceptos de espacio, lugar, _forma_, cuerpo y proporción que tienen su origen en la tradición filosófica platónica y aristotélica, la geometría euclidiana y la teoría arquitectónica vitruviana. Se considera que desde la Antigüedad, la arquitectura estaba ligada a conceptos de naturaleza filosófica de los que derivaban sus principios. (shrink)

The "people of knowledge" of traditional Mazatec medicine have preserved until today the ritual use of psilocybin mushrooms as part of their health care systems. The renewed interest in the effect of psilocybin on human consciousness for both therapeutic and recreational purposes usually obviates the historical and cultural background of indigenous peoples, as well as the legitimation of their practices and knowledge. In this article, through the case study of a foreign person who attended a Mazatec ritual specialist to participate (...) in a ritual night ceremony known as velada, we show the importance of approaching research on psychoactive plants and mushrooms from a transdisciplinary and intercultural perspective, so that we can appreciate the profound complexity of the healing processes that take place in traditional indigenous contexts, as well as the limits of recreational uses or exclusively neopositivist and clinical approaches. La siguiente reseña explora el libro más reciente del historiador Tomás Pérez Vejo, el cual se adentra en un relato de nación construido a partir de los acervos pictóricos. El imaginario visual que se construye desde las exposiciones y críticas de pintura marca un ciclo crístico de nacimientos, tormentos, liberaciones y resurrecciones, cuyo interés primordial es su poderosa impronta en la historia oficial nacional y en cómo esta permea aún el presente.

La didáctica se ejecuta con estudiantes policiales de la Escuela de Suboficiales y Nivel Ejecutivo Gonzalo Jiménez de Quesada, los cuales multiplicaran a los estudiantes rurales del municipio de Sibaté.El propósito del proyecto fue diseñar una estrategia didáctico pedagógica que permita fortalecer las Habilidades Comunicativas implementando la lectoescritura, en los estudiantes policiales y a la vez a los estudiantes de las Instituciones Educativas Rurales de Sibaté Cundinamarca. Metodológicamente, el proyecto se realizó mediante el enfoque cualitativo de carácter etnográfico. Nos proponemos analizar el pensamiento de Álvaro García Linera, uno de los intelectuales más interesantes en lengua española, y que mayor difusión está teniendo en los últimos tiempos. Para ello, tomaremos como punto de referencia cuatro de las ideas centrales dentro de la filosofía del boliviano: proyecto político, estado, hegemonía y dominación (analizando las dos últimas de manera conjunta). Comenzaremos exponiendo las influencias de García Linera, así como las peculiaridades de sus planteamientos, para centrarnos posteriormente en la etapa de su (...) producción intelectual más reciente, y acabar con una conclusión que mencionará también algunas de las críticas más importantes que se han vertido hacia el antiguo vicepresidente. This research aims to monitor the current situation of confinement in Spanish society motivated by COVID-19 crisis. For this, a study of its socio-family, psychological and educational impact is conducted. The sample (N= 165 families, 89.1% nuclear families with children living in the same household and 20.5% with a relative in a risk group) comes from the Aragonese region (Spain). The instruments used are: Beck-II Depression Inventory (BDI-II); Baron-Cohen and Wheelwright’s Empathy Quotient (EQ) with its cognitive empathy subscale, as well (...) as an ad-hoc questionnaire, reviewed by a panel of experts, to learn about socio-personal, family and housing conditions, use of technology, involvement in school tasks and household, and working condition. The multiple regression analysis results show that the anxiety derived from the current situation is explained in 23.1% (p< 0.001) by the variables: gender (t = -2.31,p= 0.022), level of Internet consumption (t = 2.139,p= 0.034), increase of family conflicts (t = 2.980,p= 0.003) and help with school tasks (t = 2.980,p= 0.040). On the other hand, cognitive empathy is explained in 24.6% (p< 0.001) by the variables: gender (t = -4.690,p< 0.001) and mother’s hours of teleworking (t = 2.101,p= 0.037). All this leads us to conclusions related to preventive systems of social, psychological, and educational aspects to better serve families. These conclusions can be also be transferred to the future with an inclusive care to family settings from those three parameters. (shrink)

This book therefore illuminates the conceptual intricacy underlying the Theory of Mind. It posits that a wide scope is necessary to make a breakthrough in scientific research towards a full understanding of the nature, function, and development of our capacity to converge on biological processes of the brain towards consciousness, emotion, awareness, and cognition. Eusociality is broadly defined as: colonies consisting of overlapping generations, cooperative brood care, and a reproductive division of labour where sterile (or non-reproductive) workers help the reproductive members. Colonies of many complex eusocial insect species (e.g. ants, bees, termites) exhibit traits, at the collective level, that are more analogous to biological individuals rather than to groups. Indeed, due to this, colonies of the most complex species are typically a unit of selection, which has led many authors to once again apply (...) the concept of the superorganism to eusocial insects. However, unlike W. M. Wheeler, who originally employed the concept from a physiological and evolutionary perspective, today the superorganism is typically understood only from an evolutionary perspective, using group selection. This is because of the widely held view that eusocial colonies are self-organized systems. According to this view, even the most complex eusocial systems can be explained by appealing to a set of local interactions between parts of an initially disordered system (i.e. self-organization), without the need of any hierarchical control. In this paper we challenge the presupposition that hierarchical control and regulation is not possible in complex eusocial colonies. Using a case study of honey bees (Apis mellifera), we develop an alternative to the self-organization approach, that focuses on the hierarchical nature of the organization of complex eusocial systems—that we refer to as the hierarchical-organizational approach. In addition, we will analyse how colonies of eusocial insects show a complex set of interactions between the different organisms that bring forth a new cohesive collective organization, and how in turn the constitutive entities of this collective organization are transformed in this process. This paper argues that an inter-identity (namely the superorganism) emerges at the collective level in complex eusocial colonies, such as honey bees, due to the hierarchically-organized network of interactions within the colony. What role could have intrinsic motivation toward reading in an extraordinary situation like the recent confinement? This research examines the relationship between intrinsic reading motivation and reading habits in an adult population considering types of reading, gender, and distress generated by the coronavirus disease 2019 pandemic. Participants were 3,849 adults from Spain who were surveyed about their reading practices: before, during the first weeks, and after several weeks of confinement. Linear mixed effects models were used to analyze data. Results showed (...) a three-way interaction between reading frequency, IRM, and type of reading. Also, distress seems to pose a differential impact depending on the type of reading. The higher the IRM, the lesser the time devoted to study/work reading and the more to social and news reading. In this sense, IRM can function as a protective factor of reading behavior but only for leisure reading. Results support previous findings of the importance of consciously promoting this type of motivation in all individuals beyond educational contexts, since it seems to be positively related to well-being. O relato de experiência a que este texto se refere provém do módulo intitulado Violência no Espaço Escolar, do Curso de Extensão em Gênero, Raça e Diversidade Sexual/ODEERE. A partir de temas que envolvem raça/etnia, gênero, e sexualidades, foram promovidos debates relacionados a preconceitos e discriminações que se manifestam no espaço escolar voltados para o racismo, sexismo e à homo-lesbo-bi-transfobia. O desenvolvimento da proposta didática pautou-se na abordagem qualitativa à luz da dialética, com o intuito de problematizar incômodos prescritos pelo (...) poder hegemônico e de pensar alternativas de mudanças para a promoção de uma convivência respeitosa primando pela valorização das diferenças. El artículo ofrece un panorama del precedente en el Civil Law con el objetivo de distinguir los problemas que pueden presentarse en los sistemas jurídicos que tienen una práctica formal o institucionalizada de precedente, de aquellos en los que no la hay. Se identificó que se introdujo el precedente como una forma de responder a las crecientes demandas de administración de justicia en la materia y delimitar la discrecionalidad del operador jurídico. Tanto el vacío de reconocimiento social y estatal, como la falta de redistribución de recursos han sido elementos recurrentes. Ambas dimensiones han acentuado la estigmatización del colectivo, que oscila entre la victimización y la criminalización. A pesar de ello, también han emergido prácticas de movilidad, solidaridad y alianzas que les han permitido desestabilizar las representaciones dominantes (...) que las encasillan en patrones estereotipados. Transcranial Magnetic Stimulation (TMS) is a non-invasive neurostimulatory and neuromodulatory technique increasingly used in clinical and research practices around the world. Historically, the ethical considerations guiding the therapeutic practice of TMS were largely concerned with aspects of subject safety in clinical trials. While safety remains of paramount importance, the recent US Food and Drug Administration approval of the Neuronetics NeuroStar TMS device for the treatment of specific medication-resistant depression has raised a number of additional ethical concerns, including marketing, off-label use (...) and technician certification. This article provides an overview of the history of TMS and highlights the ethical questions that are likely arise as the therapeutic use of TMS continues to expand. (shrink)

Time series forecasting is a well-known deep learning application field in which previous data are used to predict the future behavior of the series. Recently, several deep learning approaches have been proposed in which several nonlinear functions are applied to the input to obtain the output. In this paper, we introduce a novel method to improve the performance of deep learning models in time series forecasting. This method divides the model into hierarchies or levels from simpler to more complex ones. (...) Simpler levels handle smoothed versions of the input, whereas the most complex level processes the original time series. This method follows the human learning process where general/simpler tasks are performed first, and afterward, more precise/harder ones are accomplished. Our proposed methodology has been applied to the LSTM architecture, showing remarkable performance in various time series. In addition, a comparison is reported including a standard LSTM and novel methods such as DeepAR, Temporal Fusion Transformer, NBEATS and Echo State Network. (shrink)

La presente investigación surge de abordar los comportamientos sociales y su influencia en la convivencia ciudadana. Para ello, se realizó una comprensión desde las perspectivas: cultura, norma, familia, escuela y pedagogía, transversalizado por la Ley 1801 de 2016, Código de Convivencia y Seguridad Ciudadana.El objetivo es analizar desde núcleos como la familia, la escuela y la norma, el proceso del comportamiento social y su incidencia en la convivencia ciudadana, desde la responsabilidad individual y colectiva, se utilizó la metodología de estudio (...) cualitativo documental.Obteniendo resultados poco alentadores por el aumento de los comportamientos contrarios a la convivencia de la sociedad colombiana. Se presenta un estudio cuyo propósito es analizar la pertenencia, tendencia y desafíos de los estudios generales en currículos de programas académicos de Universidades peruanas. El estudio, realizado según el diseño fenomenológico, estuvo conformada por docentes universitarios conocedores del currículo elegidos hasta lograr la saturación. Se aplicó un cuestionario de preguntas abiertas enfocado en la apreciación de los informantes en el objeto de la investigación y como resultados se encontró que los estudios generales contribuyen: al desarrollo de habilidades blandas en (...) la formación integral del estudiante, a la identificación de fortalezas e intereses sobre la profesión, a la vida ciudadana, al descubrimiento y la reafirmación de la vocación; de ahí su pertinencia curricular. The aim of this research was to delimit the predictive and mediational model of resilience between character strengths to predict flourishing, in a sample of undergraduate students. After signing their informed consent, 642 university students completed three validated scales. Using an ex post facto design, regression, structural modeling, and mediation analyses were carried out, in order to construct a multi-causal predictive model. Results indicated a consistent predictive direct effect of character strengths on resilience and flourishing and of resilience on flourishing. (...) As hypothesized, resilience also showed a mediating effect on the relationship between character strengths and flourishing. Additionally, results also revealed that the reactive and proactive factors of resilience were explained by different character strengths, reinforcing the idea that the two directions are complementary and necessary.
