El artículo ofrece un panorama del precedente en el Civil Law con el objetivo de distinguir los problemas que pueden presentarse en los sistemas jurídicos que tienen una práctica formal o institucionalizada de precedente, de aquellos en los que no la hay. Se identificó que se introdujo el precedente como una forma de responder a las crecientes demandas de administración de justicia en la materia y delimitar la discrecionalidad del operador jurídico. Por tanto, la tesis de fondo de este trabajo (...) es que, en la operación regular de los sistemas jurídicos del Civil Law, tanto los tribunales constitucionales y la jurisdicción en general identificaron la necesidad práctica de dotar de contornos a los derechos humanos —en tanto disposiciones jurídicas a concretar jurisdiccionalmente—. It filled me with pleasure to be asked by Problema editor-in-chief Sandra Gómora Juárez to lead a discussion on the theories and doctrine on precedent in our context alongside Prof. Marina Gascón Abellán. Besides the undeniable and recognized prestige of the Problema journal, there was also the possibility of working with Prof. Marina Gascón again and with Sandra Gómora for the first time. It was also an opportunity to discuss issues regarding precedent with old friends (...) like Flavia Carbonell, Fabio Pulido and Silvia Zorzetto, and exchange opinions with new ones like Rodrigo Camarena. On this occasion, I would like to comment specifically on the works of Prof. Fabio Pulido Ortiz and Prof. Silvia Zorzetto, both of which are of unquestionable quality. The article by Prof. Pulido Ortiz of the Universidad de la Sabana in Colombia is a work of analytical finesse and subtlety that discusses some fundamental problems of legal theory from the standpoint of the theory of precedent. Prof. Silvia Zorzetto from Università Statale di Milano has conducted an analytical and metalinguistic survey of the use of precedents in Italy, particularly at the Italian Sezioni Unite Civili della Corte di Cassazione. This work is priceless not only in terms of its value as a study of (internal) Italian legal culture, but also because the analysis can be generalized, at least in part, to explain how precedents are used in civil law systems. Cuando la profesora y directora de la revista Problema, Sandra Gómora Juárez, nos propuso a la profesora Marina Gascón Abellán y a mí llevar a cabo una discusión acerca de las teorías y doctrinas del precedente en nuestro contexto, no me pude sentir más contento. Al indudable y reconocido prestigio de la revista Problema se sumó la posibilidad de volver a trabajar con la profesora Marina Gascón y hacerlo por primera vez con Sandra Gómora. Además, (...) surgió la oportunidad de volver a discutir con viejos amigos —como Flavia Carbonell, Fabio Pulido, Silvia Zorzetto— sobre cuestiones relativas al precedente, y poder contrastar opiniones con otros nuevos, como Rodrigo Camarena. En esta ocasión, me corresponde comentar, en particular, los trabajos del profesor Fabio Pulido Ortiz y de la profesora Silvia Zorzetto. Ambos trabajos son de una indudable calidad. El del profesor Pulido Ortiz, de la Universidad de La Sabana de Colombia, es un trabajo de finura y sutileza analítica que entra a discutir, al calor de la teoría del precedente, algunos problemas fundamentales de la teoría del derecho. La profesora Silvia Zorzetto, de la Università Statale di Milano, ha llevado a cabo un reconocimiento analítico y metalingüístico de la práctica de los precedentes en Italia, con especial atención a le Sezioni Unite Civili della Corte di Cassazione italiana, de incalculable valor. Ello no sólo por el valor que pueda tener para el estudio de la cultura jurídica (interna) italiana, sino porque su análisis puede ser, al menos en parte, generalizado para dar cuenta de cómo son usados los precedentes en los ordenamientos de civil law. Beatty, Brandon, and Sober agree that biological generalizations, when contingent, do not qualify as laws. Their conclusion follows from a normative definition of law inherited from the Logical Empiricists. I suggest two additional approaches: paradigmatic and pragmatic. Only the pragmatic represents varying kinds and degrees of contingency and exposes the multiple relationships found among scientific generalizations. It emphasizes the function of laws in grounding expectation and promotes the evaluation of generalizations along continua of ontological and representational parameters. Stability of conditions (...) and strength of determination in nature govern projectibility. Accuracy, ontological level, simplicity, and manageability provide additional measures of usefulness. This paper examines the relationship between CEO incentives and strong and weak corporate social performance. Using the KLD database we find that incentives have no significant relationship with strong social performance. Salary and long-term incentives have a positive association with weak social performance.

Background Requirements for organ donation after cardiac or imminent death have been introduced to address the transplantable organs shortage in the United States. Organ procurement organizations (OPOs) increasingly use the Internet for organ donation consent. Methods An analysis of OPO Web sites available to the public for enrollment and consent for organ donation. The Web sites and consent forms were examined for the minimal information recommended by the United States Department of Health and Human Services for informed consent. Content scores (...) were calculated as percentages of data elements in four information categories: donor knowledge, donor consent reinforcement, donation promotion, and informed consent. Results There were 60 Web sites for organ donation enrollment serving the 52 states. The median percent (10 percentile-90 percentile) content scores of the Web sites for donor knowledge, donor consent reinforcement, and donation promotion were 33% (20–47), 79% (57–86), and 75% (50–100), respectively. The informed consent score was 0% (0–33). The content scores for donor knowledge and informed consent were significantly lower than donor consent reinforcement and donation promotion for all Web sites (P < .05). The content scores for the four categories were similar among the 11 regions of the United Network for Organ Sharing. Conclusion The Web sites and consent forms for public enrollment in organ donation do not fulfill the necessary requirements for informed consent. The Web sites predominantly provide positive reinforcement and promotional information rather than the transparent disclosure of organ donation process. Independent regulatory oversight is essential to ensure that Internet enrollment for organ donation complies with legal and ethical standards for informed consent. (shrink)

ZusammenfassungEntscheidungen der Therapiebegrenzung und in der Betreuung am Lebensende sind häufig komplex und von ethischen Problemen begleitet. Im Mittelpunkt der Untersuchung steht die entscheidende Frage, wie hilfreich existierende „Ethik-Richtlinien“, die eine ethische Orientierung bei solchen Entscheidungen geben sollen, in der klinischen Praxis tatsächlich sind. Die Frage, welchen Nutzen „Ethik-Richtlinien“ bei der Entscheidungsfindung haben oder haben können, wird hier exemplarisch an einem klinischen Fallbeispiel aus einer Ethik-Kooperationsstudie in der Intensivmedizin analysiert. Vergleichend werden hierzu „Ethik-Richtlinien“ aus Deutschland, der Schweiz und aus Großbritannien (...) herangezogen, die Gegenstand eines internationalen Projekts zur Analyse von Richtlinien waren. Die Möglichkeiten und Grenzen einer ethischen Orientierung an „Ethik-Richtlinien“ bei Entscheidungsproblemen der Therapiebegrenzung und in der Betreuung am Lebensende werden anhand der Fallstudie diskutiert und illustriert. Abschließend werden Schlussfolgerungen für die Entwicklung ethischer Richtlinien für die klinische Praxis formuliert. (shrink)

The place of man in Darwin's development of a theory of transmutation has been obscured by his manner of disclosure. Comparing the 1837–1839 period to his entire career as a theorist suggests that it was Darwin's practice to present himself and his work only before the most select scientific audiences, and then in accordance with their expectations. The negative implications of this rule for his publication on man are clear enough: finding no general invitation in science to publish as a (...) theorist and no contemporary scientific audience for the sorts of inquiries he was making on man, he was silent, at least until such time as he could publish on the strength of reputation alone. Now, with the availability of manuscripts from the early period, what was once hidden stands revealed. It is clear from Darwin's notebooks that man played a dual role in the formation of his theory: as a zoological species to be incorporated into the theory and as the primary vehicle for the study of behavior. On the first score, integrating man into the theory provoked Darwin to break with the traditional view of man's place in nature and to reject a major element in the scientific notion of progressive development. On the second score, the study of behavior led Darwin outside natural history and thence, unexpectedly, to Malthus and natural selection.One is left with the certainty that the subject of man was a central element in Darwin's formulation of his species theory. To an extent, then, the public judgment of Darwin was right all along, for the public had always sensed that Darwin spoke to a larger audience than that formed around science. On the basis of new evidence, we can add that Darwin drew from that larger audience as well. There are of course ironies to this conclusion: that Darwin the professional drew so heavily from fields where he was the amateur, that as a transparent man his inner life should prove so at odds with the manner in which he presented himself, and that his arrival at a strong sense of himself—the revolutionary “I” of his notebooks—should occur just as he stepped beyond science to engage the general culture. But when one considers the inherent difficulties of Darwin's subject and the magnitude of his claims respecting man, these ironies are perhaps not surprising at all but those of a kind which might be anticipated. Western feminists, physicians, and ethicists condemn the traditional genital surgeries performed on women in some non‐Western cultures. But coming to moral judgment is not the end of the story; we must also decide what to do about our judgments. We must learn to work respectfully with, not independently of, local resources for cultural self‐examination and change.

Idealism became the dominant philosphical school of thought in late nineteenth-century Britain. In this original and stimulating study, Sandra den Otter examines its roots in Greek and German thinking and locates it among the prevalent methodologies and theories of the period: empiricism and positivism, naturalism, evolution, and utilitarianism. In particular, she sets it in the context of the late nineteenth- and early twentieth-century debate about a science of society and the contemporary preoccupation with `community'.

Environmental crises, which are consequences of resource-intensive lifestyles and are characterized to a large extent by both a changing climate and a loss of biodiversity, stress the urgent need for a global social-ecological transformation of the agro-food system. In this regard, the bioeconomy and bioeconomic innovations have frequently been seen as instrumental in addressing these grand challenges and contributing to more sustainable land use. To date, the question of how much bioeconomic innovations contribute to sustainability objectives remains unanswered. Against this (...) background, we study four bioeconomic innovations using the case study of animal production and manure utilization in relation to their potential contributions to a social-ecological transformation. The analysis is based on the application of analytical categories derived from the literature that assess the normativity of these innovations and their implicit cultural changes. The results show that the innovations examined manifest existing thought styles and the incumbent socio-technical regime rather than contribute to a more fundamental transition. In this respect, we stress the importance of evolving alterative ideas in innovation design, applying more integrative approaches, such as embedding innovation processes into transdisciplinary processes, and developing adaptive and reflective governance approaches. In return, bioeconomic innovations should adjust towards the design mission of a social-ecological transformation and include a multitude of actors to discuss and harmonize contesting imaginaries and ethical concerns. On Friday afternoon, 29 October, an extremely well-attended and in many ways inspiring session titled "The Scholarly Contributions of Rita M. Gross" was presented. The second panel, titled (...) "Can/Should Buddhists and Christians Do Theology/ Buddhology Together?" was presented on Saturday morning, 30 October. It also drew a considerable crowd.Each of the six members of Friday's panel addressed a different aspect of the work of Rita Gross, longtime SBCS leader and now professor emerita of comparative studies in religion, University of Wisconsin-Eau Claire. She is also a senior teacher (lopon) in Jetsun Khandro Rinpoche's U.S. Lotus Garden center. The session was organized and moderated by current SBCS president Miriam M. Levering, professor of religious studies and Asian studies at University of Tennessee, Knoxville, and an international advisor at Rissho Ko-Sekei in Tokyo. I will give highlights from the panelists' presentations in the order in which they spoke.Kathleen Erndl, associate professor of religion at Florida State University, focused on Gross's work as teacher and mentor. Although she taught primarily undergraduates, Gross, in her writing, speaking, and generous conversation with rising scholars, not only moved the field toward taking religious practices and women's religious experience more seriously but also had a huge influence on how "women in religion" is taught. Gross was one of the first scholars to use the term "androcentric." Nancy Auer Falk, professor emerita of comparative religion at Western Michigan University, coedited Unspoken Worlds: Women's Religious Lives (1981) with Gross. Now in its third edition, this groundbreaking collection of case studies watered the flowering of cross-cultural studies in the lived religion of women. Falk reminded us of Gross's role in the election of the first female member of the AAR's board and the establishment of its working group on women and religion. Judith Simmer-Brown, professor of religious [End Page 221] studies at Naropa University, focused on Gross's work in Tibetan Buddhist studies, especially her pointing out the discrepancy between the prophetic voices about women's roles in early Buddhist texts and Tibetan monasticism's institutionalized androcentrism. Simmer-Brown emphasized the importance of Gross's work in Buddhist theology—for example, her deconstructing "Theravada/Mahayana/Vajrayana put-downs" and "incipient fundamentalisms" in Western Buddhism.The fourth panelist, Paul F. Knitter, professor of theology, world religions, and culture at Union Theological Seminary, described Gross's contributions to Buddhist-Christian dialogue, recounting that they met at the Society's founding conference in 1980. He said, "Rita is the Christian theologians' friendly gadfly, always asking questions that make us very uncomfortable." Particularly provocative has been her insistence that claims on the part of religious communities to religious superiority or exclusive truth are incompatible with support of religious diversity. SBCS vice president Terry Muck, dean of the E. Stanley Jones School of World Mission and Evangelism at Asbury Theological Seminary, spoke about Gross's contributions to the society, noting that she has held every office except treasurer. He and Gross coedited Buddhist-Christian Studies from 1995-2005, in part because the society had decided— after founding editor David Chappell retired—that the ideal would be one male and one female editor and one Buddhist and one Christian editor. He usually handled the work with the publisher while she usually worked with article selection along with the reviewers. Rosemary Radford Ruether, professor emerita at the Pacific School of Religion, reviewed Gross's contributions to feminist scholarship. She reminded us that while still a student at the University of Chicago, Gross crafted a fundamental methodology for studying women and religion and insisted that turning a blind eye to 80 percent of the religious practice in various cultures is simply bad empiricism. Gross has consistently pointed out that colonialism is connected with privileging males and texts, Reuther claimed, and that no one studies religion with "objectivity."Gross's response to these presentations focused on... Children’s sociocultural experiences in their day-to-day lives markedly play a key role in learning about the world. This study investigated parent–child teaching during early childhood as it naturally occurs in the home setting. Thirty-nine families’ naturalistic interactions in the home setting were observed; 1033 teaching sequences were identified based on detailed transcriptions of verbal and non-verbal behavior. Within these sequences, three domains of learning (knowledge, skills, and dispositions) and subtopics were identified and analyzed in relation to gender, child birth order, (...) context, teaching strategies, and learner response. Findings show knowledge, skills, and dispositions were taught equally, marked by the most prominent subtopics taught within each domain, including cognitive (skill), game rule (knowledge), and social rule (disposition). Further, mothers and fathers were found to teach their children equally, however, fathers taught knowledge more than mothers, whereas mothers taught dispositions more than fathers. Differences between domains of learning and subtopics also existed between mother’s and father’s teaching based on child birth order and gender. This study also assessed the contrast between teaching knowledge, skills, and dispositions by context, parent teaching strategies, and child learner response. Results support the notion that family interactions in the home setting set a stage for children’s rich informal learning experiences. Vygotskian sociocultural conceptions underpin this research and findings are discussed using this central theoretical lens. (shrink)

Este artículo ofrece una lectura comparada y complementaria de los diversos sentidos que adopta el término de «transposición» en ambos autores, así como sus implicaciones filosóficas de fondo.

In this essay Sandra Vanderbilt explores philosophies of peace and protest through a dialectical reading of the works of Martin Luther King Jr., Daisaku Ikeda, and Paulo Freire, and considers these philosophies in relation to her own activism, specifically in the context of dealing with White postracial myths and more overt acts of racism. This essay outlines what she learned from her dialectical reading across several works by King, Ikeda, and Freire, and how these philosophies of peace and protest (...) informed the ways in which she has been able to initiate and sustain conversations across the chasm that separates her antiracist positioning from the stance of friends and family members who deny and enact racism and White supremacy. The three theorists Vanderbilt focuses on here all point to ongoing engagement among individuals as necessary to sustaining the collective. Drawing on their work, Vanderbilt suggests that we have to begin with a critical understanding of Whiteness in our efforts to engage someone, in radically loving acts, in confrontation with their own words and behavior. Opportunities for this sort of confrontation have the potential to bridge the conversational chasm and to open discussions wherein one can practice the virtue of justice, and importantly racial justice. Ce trait joue certainement un rôle dans la constitution de l'idée contemporaine d'un sens perceptuel, commune à la phénoménologie et aux théories de la perception. L'auteur tente ici, en se fondant notamment sur la philosophie du langage (...) ordinaire d' Austin, de renverser l'idée de sens perceptuel, ou de la perception comme donation ou constitution de sens, et de redéfinir l'idée austinienne d'une « phénoménologie linguistique ». The author takes as a starting point a central articulation of the Husserl -Frege relation, that is, the notion of Sinn, specifically, some uses of the notion within the analytical tradition, which may show the ambiguity and plasticity of the term. This feature, probably due in part to the translation of : Sinn into English, is responsible for the constitution of the contemporary idea of a perceptual sense, an idea shared by phenomenology and some theories of perception. The author aims here to criticize the idea of a sense as being given or discovered or constituted in perception, with the help of J.L. Austin 's ordinary language philosophy, and thus to revive Austin s intriguing idea of a « linguistic phenomenology ». (shrink)
