According to the Supreme Court of Canada, Aboriginal title is a property right, albeit of a distinctive kind. Most significantly, the right is subject to an inherent limit: title lands cannot be used in a way that deprives present and future generations of the right to use the land. Aboriginal title is also encumbered by a restraint on alienation, and has its source in Aboriginal legal systems that predate and survive the assertion of Crown sovereignty. In this paper, we argue (...) that these features of Aboriginal title are not burdensome judicial innovations on a property right, but are instead the essential contours of a sovereign right. That is, the Court’s own description of Aboriginal title does not comport with sound theoretical understandings of a property right. Aboriginal title is much more akin to a right of sovereignty—the right to make laws about the use of a territory. Aboriginal title is the right of law-making jurisdiction over the title lands. The existing literature, while edging towards the view that Aboriginal title is a sovereign right, has lacked the unifying theoretical basis needed to decisively dispatch the Court’s property paradigm. In particular, all extant accounts find the inherent limit inexplicable. The account in this article theorizes and explains the inherent limit, as well as all of the sui generis elements of Aboriginal title, and shows their interconnectedness. Our view additionally answers a number of questions that the Court’s property paradigm does not, including: (1) what laws primarily govern title lands; (2) who has standing to question whether any particular use of title land violates the inherent limit; (3) what is the status of private land interests that overlap with Aboriginal title lands; and (4) how should the doctrine of Aboriginal title be updated in light of jurisprudential developments emphasizing that Indigenous peoples never ceded their sovereignty? The annual production of hazardous wastes which was less than 10 million metric tonnes in the 1940s is now in excess of 320 million metric tonnes. These wastes are, in the main, by-products of industrial processes that have contributed significantly to the economic development of many countries which, in turn, has led to lifestyles that also generate hazardous wastes. The phenomenal increase in the generation of hazardous wastes coupled with various barriers to local disposal has led to the thriving international (...) trade in these environmentally hazardous substances. Filial piety is a Confucian concept derived from Chinese culture, which advocates a set of moral norms, values, and practices of respect and caring for one’s parents. According to the dual-factor model of filial piety, reciprocal and authoritarian filial piety are two dimensions of filial piety. Reciprocal filial piety is concerned with sincere affection toward one’s parent and a longstanding positive parent-child relationship, while authoritarian filial piety is about obedience to social obligations to one’s parent, often by suppressing one’s own (...) wishes to conform the demands of the parent. The primary aim of this study is to investigate the moderating effect of culture on the relationships between filial piety and palliative care knowledge. The secondary aim is to investigate whether filial piety is a universal construct across Singaporean and Australian cultures. A total of 508 participants living in Singapore and Australia were surveyed between May and October 2020. The final sample comprised of 406 participants, with 224 Singaporeans and 182 Australians. There were 289 females, 115 males, and two unspecified gender in the sample, with an average age of 27.27 years. Results indicated a significant effect of culture on authoritarian filial piety and palliative care knowledge. Singaporeans showed higher authoritarian filial piety and higher palliative care knowledge than Australians. However, no effect of culture was found on reciprocal filial piety. Overall, no significant correlation existed between palliative care knowledge and reciprocal filial piety and authoritarian filial piety. For Singaporeans, a weak negative correlation was found between palliative care knowledge and authoritarian filial piety. In contrast, Australians and Singaporeans indicated a positive, moderate correlation between reciprocal and authoritarian filial piety. Further, culture moderated the relationship between authoritarian filial piety and palliative care knowledge. High authoritarian filial piety was associated with increased palliative care knowledge among Australians, while high authoritarian filial piety was associated with decreased palliative care knowledge among Singaporeans. The results support the conceptualization of filial piety as a possible psychological universal construct. In addition, the results point out an important implication that public health programs should target the appropriate filial piety types to enhance palliative care knowledge among Singaporeans and Australians. Psychiatric genetic research investigates the genetic basis of psychiatric disorders with the aim of more effectively understanding, treating, or, ultimately, preventing such disorders. Given the challenges of recruiting research participants into such studies, the potential for long‐term benefits of such research, and seemingly minimal risk, a strong claim could be made that all non‐acute psychiatric inpatients, including forensic and involuntary patients, should be included in such research, provided they have capacity to consent. There are tensions, however, regarding the ethics of (...) recruiting psychiatric inpatients into such studies. In this paper our intention is to elucidate the source of these tensions from the perspective of research ethics committee interests and decision‐making. We begin by defining inpatient status and outline some of the assumptions surrounding the structures of inpatient care. We then introduce contemporary conceptions of vulnerability, including Florencia Luna’s account of vulnerability which we use as a framework for our analysis. While psychiatric inpatients could be subject to consent‐related vulnerabilities, we suggest that a particular kind of exploitation‐related vulnerability comes to the fore in the context of our case study. Moreover, a subset of these ethical concerns takes on particular weight in the context of genetic research in low‐ and middle‐income countries. At the same time, the automatic exclusion of inpatients from research elicits justice‐related vulnerabilities. (shrink)

Pancreatitis is a complex, progressively destructive inflammatory disorder. Alcohol was long thought to be the primary causative agent, but genetic contributions have been of interest since the discovery that rare PRSS1, CFTR and SPINK1 variants were associated with pancreatitis risk. We now report two associations at genome-wide significance identified and replicated at PRSS1-PRSS2 and X-linked CLDN2 through a two-stage genome-wide study. The PRSS1 variant likely affects disease susceptibility by altering expression of the primary trypsinogen gene. The CLDN2 risk allele is (...) associated with atypical localization of claudin-2 in pancreatic acinar cells. The homozygous CLDN2 genotype confers the greatest risk, and its alleles interact with alcohol consumption to amplify risk. Multicultural environments require learning multiple number notations wherein some are encountered more frequently than others. This leads to differences in exposure and consequently differences in usage between notations. We find that differential notational usage imposes a significant neurocognitive load on number processing. Despite simultaneous acquisition, forty-two adult binumerate populations, familiar with two positional writing systems namely Hindu Nagari digits and Hindu Arabic digits, reported significantly lower preference and usage for Nagari as compared to Arabic. Twenty-four participants showed significantly increased reaction (...) times and reduced accuracy while performing magnitude comparison tasks in Nagari with respect to Arabic. Functional magnetic resonance imaging revealed that processing Nagari elicited significantly greater activity in number processing and attention networks. A direct subtraction of networks for Nagari and Arabic notations revealed a neural circuit comprising of bilateral intra-parietal sulcus, inferior and mid frontal gyri, fusiform gyrus and the anterior cingulate cortex (FDR p<0.005). Additionally, whole brain correlation analysis showed that activity in the left inferior parietal region was modulated by task performance in Nagari. We attribute the increased activation in Ng to increased task difficulty due to infrequent exposure and usage. Our results reiterate the role of the left intra-parietal sulcus in modulating performance in numeric tasks and highlight that of the attention network for monitoring symbolic notation mode in binumerates. Summary Liberals, from Mill to Rawls see personal autonomy as paramount in civil society. They see human dignity to consist essentially in personal autonomy, that is, ?in the ability of each person to determine for himself or herself a view of the good life? (Taylor, C. (1992) p. 27). Multiculturalism and ?The Politics of Recognition? p. 57 (Princeton, Princeton University Press). This emphasis on personal autonomy underlies much of liberal emphasis on freedom of conscience, justice, rights and fairness. Its core (...) thesis is that a just society seeks not to promote any particular view of the good life, but enables its citizens to pursue their own ends consistent with a similar liberty for all others. Yet, when some citizens in America attempted to pursue their own view of the good life, they came up against head?on conflict with the liberal state. These groups saw civic education with its emphasis on individual choice, on reflecting and weighing of alternative viewpoints and on personal autonomy, as threatening to their way of life and to their fundamental religious beliefs, and consequently they challenged the state in the courts. What ensued raised profound educational problems for educating children, parental rights, and the right of the State in a liberal democratic society, which are discussed in this paper. (shrink)

In this discussion note on Michal Pruski and Richard C. Playford’s “Artificial Wombs, Thomson and Abortion – What Might Change?,” I consider whether the prospect of ectogenesis technology would make abortion impermissible. I argue that a Thomson-style defense may not become inapplicable due to the right to life being conceived as a negative right. Further, if Thomson-style defenses do become inapplicable, those who claim that ectogenesis would be an obligatory alternative to abortion cannot do so without first showing that fetuses (...) have a right to life, something that Thomson assumed rather than argued for. I also include a discussion on ethical problems concerning what to do about children born from artificial wombs put there by those who looked to terminate their pregnancies because they sought to avoid parenthood. Along with political, economic, ethical, rehabilitative and military dimensions, psychopathological sequelae of war and terrorism also deserve our attention. The terrorist attack on the World Trade Centre ( W.T.C.) in 2001 and the Gulf War of 1990-91 gave rise to a number of psychiatric disturbances in the population, both adult and children, mainly in the form of Post-traumatic Stress disorder (PTSD). Nearly 75,000 people suffered psychological problems in South Manhattan alone due to that one terrorist attack on the WTC in (...) New York and the Pentagon in Washington. In Gulf War I, more that 1,00,000 US veterans reported a number of health problems on returning from war, whose claims the concerned government has denied in more than 90% cases. Extensive and comprehensive neurological damage to the brain of Gulf War I veterans has been reported by one study, as has damage to the basal ganglia in another, and Amyotrophic Lateral Sclerosis (ALS) in a third, possibly due to genetic mutations induced by exposure to biological and chemical agents, fumes from burning oil wells, landfills, mustard or other nerve gases. The recent Gulf War will no doubt give rise its own crop of PTSD and related disorders. In a cost-benefit analysis of the post Gulf War II scenario, the psychopathological effects of war and terrorism should become part of the social audit any civilized society engages in. Enlightened public opinion must become aware of the wider ramifications of war and terrorism so that appropriate action plans can be worked out. (shrink)

There is emerging evidence to demonstrate the efficacy of music based interventions for improving social functioning in children with Autism Spectrum Disorders (ASD). While this evidence lends some support in favour of using song over spoken directives in facilitating engagement and receptive intervention in ASD, there has been little research that has investigated the efficacy of such stimuli on socio-communicative responsiveness measures. Here, we present preliminary results from a pilot study which tested whether sung instruction, as compared to spoken directives, (...) could elicit greater number of socio-communicative behaviours in young children with ASD. Using an adapted single-subject design, three children between the ages of 3 and 4 years, participated in a programme consisting of 18 sessions, of which 9 were delivered with spoken directives and 9 with sung. Sessions were counterbalanced and randomized for three play activities - block matching, picture matching and clay play. All sessions were video-recorded for post-hoc observational coding of three behavioural metrics which included performance, frequency of social gesture and eye contact. Analysis of the videos by two independent raters indicated increased socio-communicative responsiveness in terms of frequency of social gesture as well as eye contact during sung compared to spoken conditions across all participants. Our findings suggest that sung directives may play a useful role in engaging children with ASD and also serve as an effective interventional medium to enhance socio-communicative responsiveness. Research suggests that sedentary behavior is negatively associated with cognitive outcomes. Interrupting prolonged sitting has been shown to improve cognitive functions, including executive functioning, which is important for academic performance. No research has been conducted on the effect of standing on EF in VET students, who make up a large proportion of the adolescent population and who are known to sit more than other students of this age. In this study, we investigated the acute effects of reducing SB by short (...) time standing on EF in vocational education and training students. In a randomized crossover study, 165 VET students were first taught for 15 min in seated position. After this, they performed while seated the Letter Memory Test for updating, and the Color Shape Test for shifting and inhibition. Students were randomly assigned to a sitting or standing condition. All students were taught again for 15 min and then took the same tests in the condition they were allocated to, respectively, standing or seated. After 1 week, the test procedure was repeated, in which students switched conditions. Mixed model analyses showed no significant effect of sitting or standing on updating, shifting, or inhibition. Also, no significant differences were found for the order of condition on updating, shifting, or inhibition. Our results suggest that 40 min of standing does not significantly influence EF among VET students. (shrink)

This article deals with detection and accommodation of sensor faults in longitudinal dynamics of an F8 aircraft model. Both the detection of the fault and reconfiguration of the failed sensor are done with the help of neural network-based models. Detection of a sensor fault is done with the help of knowledge-based neural network fault detection. Apart from KBNNFD, another neural network model is developed in this article for the reconfiguration of the failed sensor. A model-based approach of the neural network (...) is developed, which uses the radial basis function of the neural network. MBNN successfully does the task of providing analytical redundancy for the aircraft sensor. In this work, both detection and reconfiguration of a fault is done using neural networks. Hence, the control system becomes robust for handling sensor failures near steady state and reconfiguration is also faster. A generalized regression neural network, which is a type of radial basis network, is used for MBNN, which gives very efficient results for function approximation. An F8 aircraft model and C-Star controller, which improves its handling quality, are used for validation of the method involved. Models of F8 aircraft, C-Star controller, KBNNFD, and MBNN were developed using MATLAB/simulink. Successful implementation and simulation results are shown and discussed using Simulink. (shrink)

Trust is a natural mechanism by which an autonomous party, an agent, can deal with the inherent uncertainty regarding the behaviours of other parties and the uncertainty in the information it shares with those parties. Trust is thus crucial in any decentralised system. This paper builds on recent efforts to use argumentation to reason about trust. Specifically, a set of schemes is provided, and abstract patterns of reasoning that apply in multiple situations geared towards trust. Schemes are described in which (...) one agent, A, can establish arguments for trusting another agent, B, directly, as well as schemes that A can use to construct arguments for trusting C, where C is trusted by B. For both sets of schemes, a set of critical questions is offered that identify the situations in which these schemes can fail. (shrink)

Over recent years, the research community has been increasingly using preprint servers to share manuscripts that are not yet peer-reviewed. Even if it enables quick dissemination of research findings, this practice raises several challenges in publication ethics and integrity. In particular, preprints have become an important source of information for stakeholders interested in COVID19 research developments, including traditional media, social media, and policy makers. Despite caveats about their nature, many users can still confuse pre-prints with peer-reviewed manuscripts. If unconfirmed but (...) already widely shared first-draft results later prove wrong or misinterpreted, it can be very difficult to “unlearn” what we thought was true. Complexity further increases if unconfirmed findings have been used to inform guidelines. To help achieve a balance between early access to research findings and its negative consequences, we formulated five recommendations: (a) consensus should be sought on a term clearer than ‘pre-print’, such as ‘Unrefereed manuscript’, “Manuscript awaiting peer review” or ‘’Non-reviewed manuscript”; (b) Caveats about unrefereed manuscripts should be prominent on their first page, and each page should include a red watermark stating ‘Caution—Not Peer Reviewed’; (c) pre-print authors should certify that their manuscript will be submitted to a peer-review journal, and should regularly update the manuscript status; (d) high level consultations should be convened, to formulate clear principles and policies for the publication and dissemination of non-peer reviewed research results; (e) in the longer term, an international initiative to certify servers that comply with good practices could be envisaged. The guiding inspiration of this book is the attraction and distance that mark the relation between anthropology and philosophy. This theme is explored through encounters between individual anthropologists and particular regions of philosophy. Several of the most basic concepts of the discipline—including notions of ethics, politics, temporality, self and other, and the nature of human life—are products of a dialogue, both implicit and explicit, between anthropology and philosophy. This is the diary of an observant mathematician who documented the drama of the resolution of Fermat's Last Theorem as it unfolded around him from 1993 to 1995. Pierre Fermat claimed around 1637, in the most famous marginalia in the history of mathematics, to have a proof of the theorem that xn + yn = zn has no whole number solutions for n greater than 2. The other principal figure is the British mathematician Andrew Wiles, who emigrated to Princeton University (...) in the 1980s and who in 1993, at what for mathematicians is the relatively advanced age of forty, announced a proof of FLT. In the course of Wiles's initial exposition to mathematicians, before a full‐fledged proof could be published, a gap was discovered. This was too late to forestall announcements in the world press of an imminent proof. What had been an almost secretive devotion to the task by Wiles now became a rather more public and pressurized effort over the course of nearly a year. Wiles wondered at times if success could be achieved, but with the help of other mathematicians the gap was filled in and the full formal proof published in 1995.The statement of the theorem is likely to be the only part of the 1990s story that a nonspecialist can immediately appreciate, and the author has not especially addressed his book to the nonspecialist. Rather, this account is analogous to a well‐illustrated exhibition guidebook that serves as a memento and record to those who visited in person but that is not intended fully to inform those who did not experience it. For a broader account of the historical and mathematical background a reader can consult the three principal books published previously on the same topic by Amir Aczel, Simon Singh, and Alfred J. van der Poorten. The author knew many of the main players, attended most of the key talks, took notes, made recordings, and photographed. A major part of the book is a selection of sixty‐two photographs from the total of three thousand made by the author. He asked questions of Wiles and others and recorded both formal and informal reactions that he observed around him during the many public and nonpublic presentations that were made. Also, in keeping with the journal nature of his work, he has recorded his own reactions. Appendixes include an excerpt from Wiles's 1995 Annals of Mathematics publication and a synopsis by Ram Murty of the key results by Gerhard Frey, Jean‐Pierre Serre, and Kenneth Ribet that formed a basis for Wiles's work.It may interest historians and archivists to learn of the extent to which the primary sources for this story include e‐mail, web pages, photographs, and newspaper and television interviews. Though we recognize this reality of contemporary science, a diary account probably brings the issue home more directly than would studies by professional historians, who might feel obligated to do more of their own interviews, for example, rather than rely on the media. Mathematics has rarely had such a public spotlight turned on it—the proof of the four‐color theorem in 1976 is the only comparable event that comes to mind. We revisit a typological puzzle due to Horn (Doctoral Dissertation, UCLA, 1972) regarding the lexicalization of logical operators: in instantiations of the traditional square of opposition across categories and languages, the O corner, corresponding to ‘nand’ (= not and), ‘nevery’ (= not every), etc., is never lexicalized. We discuss Horn’s proposal, which involves the interaction of two economy conditions, one that relies on scalar implicatures and one that relies on markedness. We observe that in order to express markedness and to (...) account for a bigger typological puzzle, namely the absence of lexicalizations of ‘XOR’ (= exclusive or), ‘all-or-none’, and many other imaginable logical operators, one must restrict the basic lexicalizable elements to a small set of primitives. We suggest that an ordering based perspective, following Keenan and Faltz (Boolean semantics for natural language, 1985), makes the stipulated primitives that we arrive at more natural. We also propose a modification to Horn’s proposal, based on recent work on implicatures, in which only the implicature condition is operative and in which markedness is part of the definition of the alternatives for scalar implicatures rather than an independent condition. Early intervention aims to identify children or families at risk of poor health, and take preventative measures at an early stage, when intervention is more likely to succeed. EI is concerned with the just distribution of “life chances,” so that all children are given fair opportunity to realize their potential and lead a good life; EI policy design, therefore, invokes ethical questions about the balance of responsibilities between the state, society, and individuals in addressing inequalities. We analyze a corpus of (...) EI policy guidance to investigate explicit and implicit ethical arguments about who should be held morally responsible for safeguarding child health and well-being. We examine the implications of these claims and explore what it would mean to put the proposed policies into practice. We conclude with some remarks about the useful role that philosophical analysis can play in EI policy development. (shrink)

In a number of recent articles, Nancy Fraser attempts to understand the World Social Forum within the framework of critical democratic theory. In this article, we examine the descriptive and normative aspects of Fraser’s theoretical framework, and explore the effects of projecting it upon the World Social Forum. We argue that while this theory may elucidate some features of the Forum, many of the Forum’s most challenging and innovative aspects are obscured and limited by Fraser’s framework. Not only, then, does (...) the World Social Forum elude Fraser’s conceptualization of it, but we suggest that the praxis of the Forum poses a number of serious challenges to Fraser’s critical theory of democracy and social justice. Using a novel enumeration task, we examined the encoding of spatial information during subitizing. Observers were shown masked presentations of randomly-placed discs on a screen and were required to mark the perceived locations of these discs on a subsequent blank screen. This provided a measure of recall for object locations and an indirect measure of display numerosity. Observers were tested on three stimulus durations and eight numerosities. Enumeration performance was high for displays containing up to six discs—a higher subitizing range (...) than reported in previous studies. Error in the location data was measured as the distance between corresponding stimulus and response discs. Overall, location errors increased in magnitude with larger numerosities and shorter display durations. When errors were computed as disc distance from display centroid, results suggest a compressed representation by observers. Additionally, enumeration and localization accuracy increased with display regularity. (shrink)

Qualitative studies are an important component of business ethics research. This large amount of research covers a wide array of factors and influences on ethical decision making published between 2004 and 2014. Following the methodology of past critical reviews, this work provides a synopsis of the diverse array of qualitative studies in ethical decision making within the business ethics literature. We highlight the distinct and investigative nature of qualitative research, synthesize and summarize findings, and suggest opportunities for future research.
