In today’s competitive business market, firms that collaborate on a coopetition basis face obstacles in the form of decision-making, dependency, and trust in their competitor partners. This current study is the only one that has examined the relationship between coopetition and firm performance; yet, this relationship appears to be unclear due to the impact of trust and dependency on coopetition. This study investigates the impact of coopetition on firm performance by examining the mediating effects of decision-making and open innovation on (...) firm performance. There are 230 sets of data that were collected from the employees of Chinese small- and medium-sized enterprises through the survey method, and the data were analyzed using Partial Least Square-Structural Equation Modeling. The findings of this study indicated that open innovation has a significant mediation effect between coopetition and firm performance, and that decision-making is also an important mediating effect in bridging the relationship between coopetition and firm performance. By considering these mediators, the findings revealed that the coopetition has a significant impact on firm performance through decision-making and has a significant effect on firm performance through increasing open innovation. What does it mean to have a distinctively religious orientation toward reality? Martin J. De Nys offers a philosophy of religion grounded within the phenomenological tradition as a way to understand religious life. Focusing on the key concepts of sacred transcendence, religious discourse, and radical self-transcendence, De Nys contends that a phenomenological view of religion allows considerable diversity in regard to the possibility of religious truth. Phenomenology also helps to account for the dizzying variety of religious expressions and religious lifeways. (...) One of the most pervasive criticisms of nudges has been the claim that they violate, undermine or decrease people’s autonomy. This claim, however, is seldom backed up by an explicit and detailed conception of autonomy. In this paper, we aim to do three things. First, we want to clear up some conceptual confusion by distinguishing the different conceptions used by Cass Sunstein and his critics in order to get clear on how they conceive of autonomy. Second, we want to add (...) to the existing discussion by distinguishing between ‘autonomy’ as the ability to set your own ends and ‘autocracy’ as the ability to actually realize those ends. This will allow for a more careful ethical evaluation of specific nudge interventions. Third, we will introduce the idea of ‘perimeters of autonomy’ in an attempt to provide a realistic account of personal autonomy and we will argue that it can alleviate most of the worries about nudging being autonomy-undermining. The combination of the issue of return of individual genetic results/incidental findings and paediatric biobanks is not much discussed in ethical literature. The traditional arguments pro and con return of such findings focus on principles such as respect for persons, autonomy and solidarity. Two dimensions have been distilled from the discussion on return of individual results in a genetic research context: the respect for a participant’s autonomy and the duty of the researcher. Concepts such as autonomy and solidarity do not (...) fit easily in the discussion when paediatric biobanks are concerned. Although parents may be allowed to enrol children in minimal risk genetic research on stored tissue samples, they should not be given the option to opt out of receiving important health information. Also, children have a right to an open future: parents do not have the right to access any genetic data that a biobank holds on their children. In this respect, the guidelines on genetic testing of minors are applicable. With regard to the duty of the researcher the question of whether researchers have a more stringent duty to return important health information when their research subjects are children is more difficult to answer. A researcher’s primary duty is to perform useful research, a policy to return individual results must not hamper this task. The fact that vulnerable children are concerned, is an additional factor that should be considered when a policy of returning results is laid down for a specific collection or research project. This article seeks to explore and analyze the relationship between autonomy and trust, and to show how these findings could be relevant to medical ethics. First, I will argue that the way in which so-called “relational autonomy theories” tie the notions of autonomy and trust together is not entirely satisfying Then, I will introduce the so-called Encapsulated Interest Account as developed by Russell Hardin. This will bring out the importance of the reasons for trust. What good reasons do we have (...) for trusting someone? I will criticize Hardin’s business model as insufficiently robust, especially in the context of health care, and then turn to another source of trust, namely, love. It may seem that trust-through-love is much better suited for the vulnerability that is often involved in health care, but I will also show that it has its own deficiencies. Good health care should therefore pay attention to both models of trust, and I will offer some tentative remarks on how to do this. (shrink)

In Belgium the legal conditions to practise euthanasia are governed by the act on euthanasia of 28 May, 2002 that entered into force on 23 September, 2002. There is no relevant jurisprudence and no guidance is offered by self-regulation made up by the medical profession itself before or after the enactment of the act. Thoughtful comments on the act are, understandably, lacking up to now while the discussions in parliament have been often unclear, contradictory and sometimes even misleading. In other (...) words, the law on euthanasia in Belgium almost coincides with the act on euthanasia.In this respect the situation in the Netherlands is totally different. The law on euthanasia is first of all governed by the "Termination of life on request and assisted suicide act" of 10 April, 2001 that entered into force on 1 April, 2002. This act is generally considered as the codification of the norms and procedures that have governed the practice of euthanasia in the Netherlands for almost three decades. These norms and procedures have largely emerged from within the medical profession itself and were later adopted by the courts in the context of criminal prosecutions. There also exists a very important legal doctrine that offers guidance in understanding this act. In other words, studying the law on euthanasia in the Netherlands is more than merely studying the act on euthanasia. The act is only the ‘tip of the iceberg’.While the Dutch act aims to codify existing practices, the Belgian act mainly aims to modify the behaviour of physicians when ending the life of their patients. It is hoped that a law that pretends to offer legal security to physicians and patients will stimulate patients to express a voluntary and explicit request and that physicians will abandon their practice of ending the lives of patients without their request. Research indeed had pointed out that Belgian physicians frequently 'forget' to obtain the patient’s request before ending his life.Is should be made clear from the outset that a comparison of the Belgian and the Dutch law regulating the practice of euthanasia is a hazardous undertaking. Just comparing both acts — at first sight the Belgian act, although much more detailed, could be considered a 'clone' of the Dutch act — will lead to misleading and even incorrect results. Not only the acts, but also medical practice and legal practice have to be considered when we try to compare the law on euthanasia in both countries. The secret ballot is considered a central feature of free and fair elections all over the world. While the reasons to uphold it seem to be overwhelming, we argue that the secret ballot is only second-best at best and that a modified version of open voting might prove to be more democratic. Instead of denying the various problems and difficulties that an open system might encounter, we want to offer a genuine proposal that can avoid these numerous pitfalls. After rehearsing (...) the various arguments pro and contra open voting, we draw attention to the role of shame, which has been neglected by both sides in the debate. While shame plays a pivotal role in the democratic argument pro open voting, it also brings out new problems that tell against opening up the vote. This means that, if we want to draw on the democratic potential of open voting, we will have to find a system that minimizes the undesirable effects of shame. In the third and final section, we will formulate a concrete proposal of open voting that we believe is more democratic than the current secret ballot and is able to avoid potential worries. Even if this proves to be highly speculative, it serves as an invitation for further empirical research. (shrink)

After arguing that the appeal of such games actually presupposes an awareness of moral transgression, it considers the desensitization thesis, the argument from catharsis, and the relevance of human flourishing.Although this brief analysis does not provide any clear-cut answer to the question of whether or not such games ought to be frowned upon, it does reveal some possible sources (...) of discomfort. Are causal explanations (e.g., “she switched careers because of the COVID pandemic”) treated differently from the corresponding claims that one factor caused another (e.g., “the COVID pandemic caused her to switch careers”)? We examined whether explanatory and causal claims diverge in their responsiveness to two different types of information: covariation strength and mechanism information. We report five experiments with 1,730 participants total, showing that compared to judgments of causal strength, explanatory judgments tend to bemoresensitive to mechanism andlesssensitive to covariation – (...) even though explanatory judgments respond to both types of information. We also report exploratory comparisons to judgments of understanding, and discuss implications of our findings for theories of explanation, understanding, and causal attribution. The participation of minors in clinical trials is essential to provide safe and effective medical care to children. Because few drugs have been tested in children, pediatricians are forced to prescribe medications off-label with uncertain efficacy and safety. In this article, we analyze how the enrollment of minors in clinical trials is negotiated within relationships of mutual trust between clinicians, minors, and their parents. After a brief description of the problems associated with involving minors in clinical research, we consider how (...) existing “relationships of trust” can be used as a place where the concerns of research subjects can be more fully discussed and addressed. Building on the tacit recognition of trust found in The European Clinical Trials Directive we make policy recommendations that allow for clearer, more ethically informed guidelines for enrolling minors in clinical research. In response to Ruud ter Meulen’s contribution, it is argued that, although the relationship between these concepts is both tight and complex, solidarity should be carefully distinguished from justice. Although ter Meulen wants to defend a normative conception of solidarity, the relation to its descriptive component is not always very clear. As a normative concept it should not collapse into that of justice; and as a descriptive notion it is obviously defective. In order to successfully navigate between these unhappy alternatives, (...) ter Meulen rightfully turns to critical theory. The Belgian health care system has a few features that may havecontributed to the rising costs of health care: patients' freechoice of physicians, large clinical freedom of physicians, essentiallya fee-for-service remuneration for medical specialists in which the feesare agreed between insurance funds and physicians. The increased medicalconsumption and costs have prompted the state and insurance companies totake measures that limit the professional autonomy of the physicians.Access to medical education, free until 1997, is now restricted. Themedical profession is organized in the (...) Order of Physicians that hasestablished a code of professional ethics that has moral but not legalforce. So far, there is no special legislation for thepatient–physician relationship, though laws on specific issueslike organ transplantation contain duties for physicians. In recentyears a debate is taking place on patients' rights, of which informedconsent is central and gaining importance in medico-legal publications.An analysis of (ethical and legal) regulations concerning thewithholding or withdrawal of treatment by physicians demonstrate thatthe profession still enjoys a large clinical autonomy, though duediscussion with the patient has become more explicitly required. This article focuses on the difficult issue of what exactly goes on when an individual tolerates something. It focuses on the problem of why an individual would ever choose to allow for some practice that he deerns unacceptable while having the power to do something about it. After distinguishing between different attitudes (tolerant as well as intolerant), this article argues that individuals can have various reasons for deciding to tolerate what they deern wrong. As such, we defend a broad conception (...) of tolerance, which goes against the grain of recent literature in which tolerance is generally understood as a virtue. (shrink)

The notion of superhigh computably enumerable (c.e.) degrees was first introduced by (Mohrherr in Z Math Logik Grundlag Math 32: 5–12, 1986) where she proved the existence of incomplete superhigh c.e. degrees, and high, but not superhigh, c.e. degrees. Recent research shows that the notion of superhighness is closely related to algorithmic randomness and effective measure theory. Jockusch and Mohrherr proved in (Proc Amer Math Soc 94:123–128, 1985) that the diamond lattice can be embedded into the c.e. tt-degrees preserving 0 (...) and 1 and that the two atoms can be low. In this paper, we prove that the two atoms in such embeddings can also be superhigh. (shrink)

The ethical theory discoverable in Hegel’s writings assigns, on Dean Moyar’s reading, an important role to the idea of conscience. Hegel’s discussion of conscience presents a theory of practical reasoning which requires that one be able to nest the particular purposes that motivate one’s actions in the objective purposes that have normative status insofar as they prevail in the institutions of modern ethical life. Those norms are legitimized by the fact that the institutions in question, most especially the state, predicate (...) themselves on their recognition of the rights of the particular individual. Individuals are not simply passive in relation to ethical, institutional norms. Individual moral deliberation plays a key role in the ethical development of society. Nonetheless, the norms that the state requires the individual to recognize do seem to be, in the last analysis, beyond appeal. Hegel makes, and Moyar presents, a powerful case for this position. Nonetheless, pacifist arguments present this position with a serious challenge. (shrink)

Can the conception of God in Hegel’s philosophy of religion provide a resource for current philosophical theology? The argument in William Desmond’sHegel’s God: A Counterfeit Double? entails a strongly negative response. Desmond argues that the basic commitments of Hegel’s speculative philosophyentail a systematic inability adequately to conceive of divine transcendence. In this article, I address this claim by examining Hegel’s conception of God inrelation to the issues of (i) the religious representation and the philosophical concept, (ii) the nature of speculative (...) thinking and the conception of God, (iii) the idea of creation, and (iv) affirming the truth about divine transcendence. In each case I argue that Desmond’s critique is unwarranted. A more appropriate attitude towards Hegel on the question of God combines critique with an effort at discovering and appropriating philosophical principles that are productive for current philosophical theology. Hegel and Lonergan both make important contributions to the contemporary task of developing philosophical considerations of God within the context of a philosophy of religion. Hegel maintains that philosophy must both present knowledge of God as God is in godself, and present an account of God’s involvement with the human community. One accomplishes this two-sided task, Hegel believes, through the philosophical appropriation of the religious representation. If this appropriation is rightly understood, there is little in it to which Longern should (...) object, and a great deal that he might endorse, given his own views about the relation between philosophy of religion and philosophy of God. At the same time, Lonergan would rightly object to what at times seems at least to be Hegel’s annulment of religious mystery, and the claim Hegel sometimes seems to make that the cognitive achievements of philosophy result in a sublation of the existential concerns of religion. Lonergan argues for positions that make possible important corrections of these problems. (shrink)
