Dans les cinquante dernières années, les progrès de l’informatisation ont renforcé l’accessibilité de la jurisprudence via des bases de données juridiques, maintenant concurrencées par des plates-formes de diffusion du droit sur internet. La loi pour une République numérique du 7 octobre 2016 a prévu la généralisation de la diffusion des décisions des juges du fond au titre du processus d’ open data. Toutefois les obstacles sont nombreux : conceptuels, techniques, matériels. D’abord, un glissement s’est opéré d’une problématique d’anonymisation des décisions (...) juridictionnelles vers celle de leur pseudonymisation. Ensuite, la pseudonymisation pourrait constituer un frein au mouvement d’ open data judiciaire, du fait de la lourdeur technique nécessaire pour la réaliser. Juridiquement, sa mise en œuvre s’avère de surcroît délicate. Le renvoi législatif à la protection de la vie privée doit se combiner avec l’application du droit des données personnelles, au titre duquel il faut limiter le risque de réidentification des justiciables. Enfin, matériellement le curseur de la pseudonymisation est malaisé à placer. Quelles indications convient-il de masquer : celles relatives aux parties, ou plus largement aux personnes citées et professionnels du droit impliqués? (shrink)

The pioneering moral philosopher Annette Baier presents a series of new and recent essays in ethics, broadly conceived to include both engagements with other philosophers and personal meditations on life. Baier's unique voice and insight illuminate topics ranging from patriotism and future generations to honesty, trust, hope, and friendship.

_Postures of the Mind _was first published in 1985. Minnesota Archive Editions uses digital technology to make long-unavailable books once again accessible, and are published unaltered from the original University of Minnesota Press editions. Annette Baier develops, in these essays, a posture in philosophy of mind and in ethics that grows out of her reading of Hume and the later Wittgenstein, and that challenges several Kantian or analytic articles of faith. She questions the assumption that intellect has authority over (...) all human feelings and traditions; that to recognize order we must recognize universal laws—descriptive or prescriptive; that the essential mental activity is representing; and that mental acts can be analyzed into discrete basic elements, combined according to statable rules of synthesis. In the first group of essays—"Varieties of Mental Postures"—Baier evaluates the positions taken by philosophers ranging from Descartes to Dennett and Davidson. Among her topics are remembering, intending, realizing, caring, representing, changing one's mind, justifying one's actions and feelings, and having conflicting reasons for them. The second group of essays—"Varieties of Moral Postures" - explores the sort of morality we get when all of these capacities become reflective and self-corrective. Some deal with particular moral issues—our treatment of animals, our policies regarding risk to human life, our contractual obligations; others, with more general questions on the role of moral philosophers and the place of moral theory. These essays respond to the theories of Hobbes, Kant, Rawls, and MacIntyre, but Baier's most positive reaction is to David Hume; _Postures of the Mind _ affirms and cultivates his version of a moral reflection that employs feeling and tradition as well as reason. We discuss the variety of sorts of sympathy Hume recognizes, the extent to which he thinks our sympathy with others’ feelings depends on inferences from the other’s expression, and from her perceived situation, and consider also whether he later changed his views about the nature and role of sympathy, in particular its role in morals.

Résumé L’article propose une étude de la conception hégélienne du fondement ( Grund ) telle que la présentent les textes de Hegel sur la logique. Son objectif est double : il s’agit de proposer une caractérisation du concept hégélien de fondement, et d’étudier, sur un cas précis, la manière dont la logique hégélienne produit une critique en acte de la métaphysique et de sa critique kantienne. Pour ce faire, l’analyse s’appuie non seulement sur les textes publiés par Hegel ( Science (...) de la logique et Encyclopédie ), mais aussi sur des cahiers d’auditeurs des Leçons sur la logique, récemment publiés et encore peu exploités. Cet article prend acte de l’existence d’une pensée écologique chez Marx, consignée principalement dans les cahiers de notes consacrés à l’agriculture. Il propose de s’interroger sur les raisons pour lesquelles Marx en est venu, à partir de 1865, à prêter attention à la destruction des ressources naturelles entraînée par leur gestion capitaliste, alors qu’il ne s’était pas, jusqu’alors, montré sensible à cette question. L’hypothèse proposée, à partir d’une lecture attentive des extraits de Liebig recopiés dans le cahier de 1865-1866 consacré (...) à l’agriculture et récemment publié dans le tome IV/18 de la MEGA 2, est la suivante : la manière dont Liebig décrit l’exploitation des ressources naturelles par l’agriculture capitaliste offre un parallèle frappant avec la manière dont Marx analyse l’exploitation de la force de travail dans le procès de production capitaliste au fil des différentes rédactions de ce qui deviendra le livre I du Capital. L’article présente plusieurs preuves textuelles de ce parallèle, et soutient qu’il offre une explication plausible du soudain intérêt de Marx pour la question écologique. (shrink)

In this paper, I identify a theoretical and political role for ‘white ignorance’, present three alternative accounts of white ignorance, and assess how well each fulfils this role. On the Willful Ignorance View, white ignorance refers to white individuals’ willful ignorance about racial injustice. On the Cognitivist View, white ignorance refers to ignorance resulting from social practices that distribute faulty cognitive resources. On the Structuralist View, white ignorance refers to ignorance that (1) results as part of a social process that (...) systematically gives rise to racial injustice, and (2) is an active player in the process. I argue that, because of its greater power and flexibility, the Structuralist View better explains the patterns of ignorance that we observe, better illuminates the connection to white racial domination, and is overall better suited to the project of ameliorating racial injustice. As such, the Structuralist View should be preferred. (shrink)

Reading Morgan's eloquent explanation of himself as a "feminist," self-taught and now wholly enthused at the prospect of teaching a Women Writers course, one comes away sharing Morgan's concern that he not be left out in the cold. It is, after all, exciting and revitalizing to be part of a "revolution"—especially if, like Morgan, one can so generously and wholeheartedly espouse its goals; and, at the same time, it is surely comforting and ego-affirming to experience oneself as a legitimate son (...) of that sacred brotherhood, The Community of Scholars. What clearly disturbs Morgan is any suggestion that the two may not yet be compatible and that, further, if forced to choose, Morgan might find himself without viable options on either hand. For, if the larger academic "community" continues to close its professional ranks to women in general and feminists in particular , then Morgan, as a self-styled "feminist" will be forced to seek shelter among the female feminists, many of whom have closed their ranks to men. . . . Beverly Voloshin's Note restores to print some factual information which, for the sake of brevity, I cut from my original article, directing the reader, instead, to James D. Hart's concise summary of the original context of Hawthorne’s letter to Ticknor . While she and Hart make much the same point, her longer explication is, of course, welcome. Additionally, her fine explanation of "what was so daring about Ruth Hall" further reinforces my argument that there are fascinating texts to be discovered in the "feminine fifties" - even if only one or two; certainly, that's better than condemning all the women writers of that decade to obscurity. Moreover, since we teach a number of male texts simply on the grounds of their historical or "sociological" interest, why not also include women's texts on these grounds as well?—especially if, as Voloshin suggests, they reveal "numerous covert rebellions against male authority." How fascinating! One looks forward to her doing more than this. Finally, my main point was not the "feminine fifties" per se, but a plea for the careful reconsideration "of texts by women which have, for one reason or another, been either lost or ignored" . Stretching the "feminine fifties" by only two years, for example, one discovers Rebecca Harding Davis' Life in the Iron Mills , recently reissued by the Feminist Press . Annette Kolodny, assistant professor of English at the University of New Hampshire, has been awarded a Ford Foundation Fellowship for the study of women in society. She has written articles on American literature and culture and a feminist analysis of American pastoral, The Lay of the Land: Metaphor as Experience and History in American Life and Letters. David Hume has been invoked by those who want to found morality on human nature as well as by their critics. He is credited with showing us the fallacy of moving from premises about what is the case to conclusions about what ought to be the case; and yet, just a few pages after the famous is-ought remarks in A Treatise of Human Nature, he embarks on his equally famous derivation of the obligations of justice from facts about the cooperative (...) schemes accepted in human communities. Is he ambivalent on the relationship between facts about human nature and human evaluations? Does he contradict himself – and, if so, which part of his whole position is most valuable? Between the famous is-ought passage and the famous account of convention and the obligations arising from established cooperative schemes once they are morally endorsed, Hume discusses the various meanings of the term “natural.” “Shou'd it be ask'd, Whether we ought to search for these principles [upon which all our notions of morals are founded] in nature or whether we must look for them in some other origin? I wou'd reply, that our answer to this question depends upon the definition of the word, Nature, than which there is none more ambiguous and equivocal.” The natural can be opposed to the miraculous, the unusual, or the artificial. It is the last contrast that Hume wants, for his contrast between the “artificial” culturally variant, convention-dependent obligations of justice and the more invariant “natural virtues,” and what he says about that contrast in this preparation for his account of the “artificial” virtues, makes it clear why he can later refer to justice as “natural” and to the general content of the rules of justice – that is, of basic human conventions of cooperation – as “Laws of Nature”. The Pacific Islands are estimated to have among the highest global burdens of hearing loss, however, hearing health services are limited throughout this region. The provision of hearing aid is desirable, but should be delivered in accordance with WHO recommendations of appropriate and locally sustainable services. Large-scale hearing aid donation programmes to the Pacific Islands raise ethical questions that challenge these recommendations.The aim of this paper is to consider the ethical implications of large-scale hearing aid donation programmes to Samoa, a (...) nation of the Pacific Islands. Evaluation of both ‘Western’ and ‘Pacific Island’ perspectives reveals important cross-cultural differences regarding attitudes to donation programmes. We attempt to offer possible solutions that satisfy both ethical frameworks, and which should enable us to deliver an effective hearing health service for Samoa. These solutions may be translational and benefit other Pacific Island nations in a similar context. (shrink)

The influence of liberal political ideology on nursing sciencePrevious notions of science as impartial and value-neutral have been refuted by contemporary views of science as influenced by social, political and ideological values. By locating nursing science in the dominant political ideology of liberalism, the author examines how nursing knowledge is influenced by liberal philosophical assumptions. The central tenets of liberal political philosophy — individualism, egalitarianism, freedom, tolerance, neutrality, and a free-market economy — are primarily manifested in relation to: (i) the (...) individualistic focus of our science; (ii) our view of society as essentially egalitarian and equitable; (iii) our preference for politically neutral knowledge development, and (iv) an economy of knowledge development that supports rather than challenges the status quo. I argue that exposing, rather than ignoring, the liberal ideological values inherent in nursing science will render these assumptions open to debate, stimulate ongoing development of critically oriented knowledge, and increase our capacity to influence the social, political and economic determinants of health. Annette Baier's aim is to make sense of David Hume's Treatise as a whole. Hume's family motto, which appears on his bookplate, was True to the End. Baier argues that it is not until the end of the Treatise that we get his full story about truth and falsehood, reason and folly. By the end, we can see the cause to which Hume has been true throughout the work. Baier finds Hume's Treatise of Human Nature to be a carefully (...) crafted literary and philosophical work which itself displays a philosophical progress of sentiments. His starting place is an overly abstract intellectualism that deliberately thrusts passions and social concerns into the background. In the three interrelated books of the Treatise, his self-understander proceeds through partial successes and dramatic failures to emerge with new-found optimism, expecting that the exact knowledge the morally self-conscious anatomist of human nature can acquire will itself improve and correct our vision of morality. Baier describes how, by turning philosophy toward human nature instead of toward God and the universe, Hume initiated a new philosophy, a broader discipline of reflection that can embrace Charles Darwin and Michel Foucault as well as William James and Sigmund Freud. Nowadays there are many spaces of fascination in visual art. Of course, installative space and contextual space have been on the art scene for awhile. However, they are now accompanied by other spaces such as urban space, architectural space, cyberspace, hyperspace, and screen-based space. In this volume, architects, artists, theorists, three symposia and four exhibitions attempt to find answers to questions such as: Could the architectonic study and/or deconstruction of space play a decisive role in the shift of attention to (...) space? Which theoretical factors structure the current experience and meaning of space? What is the role of the aesthetization of the environment on our concept of space? Smooth Space - VCC de Brakke Grond, Amsterdam - is a project at the heart of this publication. L’article propose une manière d’éclaircir le rapport de « disciple critique » que Marx déclare entretenir à l’égard de Hegel à l’époque où il rédige le Capital, en faisant porter l’attention sur le problème du statut des concepts et du discours théorique. En utilisant librement, à des fins herméneutiques, les trois modèles critiques élaborés par Marx au fil de la critique de la spéculation hégélienne qu’il déploie dans son manuscrit de 1843 sur la philosophie du droit, l’article tente d’éclairer le (...) contenu du « renversement » de la dialectique hégélienne revendiqué par Marx. Sur la base de la destitution de la philosophie entreprise dans les brouillons de 1845-1846, on montre que Marx identifie, au cœur même du discours philosophique hégélien, un rapport aliéné au concept, que l’on propose, à partir d’un parallèle avec l’analyse du fétichisme de la marchandise, de nommer « fétichisme du concept ». On analyse ensuite les stratégies mises en œuvre par Marx dans le Capital pour mettre au travail la « méthode » dialectique élaborée par Hegel sans retomber dans ce fétichisme du concept. De ce point de vue, Marx apparaît au terme de notre analyse comme un disciple de Hegel en ce qu’il reprend certaines de ses innovations conceptuelles et argumentatives, mais comme un critique de ce dernier au sens où il s’en sépare pour ce qui concerne le statut du discours théorique et des concepts au moyen desquels le théoricien tente de reconstruire et de rendre intelligible le concret qu’il s’attache à penser. Dans un texte relativement peu connu, intitulé Kant, Georg Simmel développe des réflexions critiques à propos de la notion kantienne du bonheur. En comparant celles-ci avec son analyse de la société moderne, telle qu’il la propose dans la Philosophie de l’argent, on s’aperçoit qu’il existe, entre les concepts philosophiques qui y sont mis en œuvre, une relation de correspondance parfaite. La conclusion s’impose que, pour Simmel, la notion kantienne du bonheur trouve comme son incarnation historique dans la culture monétaire. La (...) modernité, que Simmel caractérise par le fait qu’elle offre aux individus la possibilité d’accéder aux objets et aux positions de leur choix, matérialise en effet une aporie inhérente au concept du bonheur chez Kant, dans la mesure où ce dernier souligne l’indétermination totale des choix, d’un côté, et de l’autre, l’idée que c’est hors de la volonté elle-même que la recherche du bonheur puise ses mobiles. The scarcity of donor organs for transplantation purposes is now a widely known fact. The number of people on transplant waiting lists regularly far exceeds the number of available organs. This situation has led to decades of recurring discussions about how this shortage could be addressed. The undersupply results in situations within the Eurotransplant network as well as on national levels where patients often wait for years, enduring significant losses in quality of life, or never receive an organ allocation at (...) all. On a global scale, the shortage also contributes significantly to illegal organ trafficking, exposing vulnerable populations in poorer countries to considerable and often opaque risks. ----- Die Knappheit an Spenderorganen für Transplantationszwecke ist mittlerweile ein allgemein bekanntes Faktum. Auf der Warteliste für Transplantationen stehen regelmäßig sehr viel mehr Menschen als Organe verfügbar werden. Dieser Umstand führt seit Jahrzehnten immer wieder zu Diskussionen darüber, auf welche Weise dem Mangel entgegengetreten werden könnte. Die Unterversorgung führt sowohl im Eurotransplant-Verbund als auch auf jeweils nationaler Ebene zu Situationen, in denen Patienten teils jahrelang unter beträchtlichen Verlusten von Lebensqualität auf ein Organ warten oder eine Zuteilung erst gar nicht mehr erleben. Auf globaler Ebene führt der Mangel darüber hinaus in signifikantem Umfang zu illegalem Organhandel und setzt vulnerable Bevölkerungsgruppen in ärmeren Ländern teils beträchtlichen und intransparenten Risiken aus. Before the Semitic fragments of 4QTobit were found at Qumran, the 4th-century Greek GI version of Tobit was thought to be original and was regarded as ‘a lesson on almsgiving and its redeeming powers’. In his presentation of the 4Q196–4Q199 (Aramaic) and 4Q200 (Hebrew) fragments of Tobit, Fitzmyer, in 1995, reconstructed and rendered the Semitic lexeme צדקה (literally, ‘righteousness’) as ‘almsgiving’, as in Mishnaic Hebrew. He referred mainly to the 4th-century Common Era Greek and Old Latin versions. The hypothesis of (...) this article is that the Aramaic lexeme צדק may not yet have had the meaning of ‘almsgiving’ in the original composition; thus, the original authorial intention may be masked in Fitzmyer’s presentation. Therefore, the emphasis on almsgiving for ultimate personal gain found in the later copies of Tobit may be a secondary, reductionist application by subsequent scribes of the lexeme צדקה. To test this hypothesis, the relevant reconstructions and English translations as ‘almsgiving’ of the Semitic copies of Tobit found at Qumran are examined and reconsidered. In the beginning of the narrative, in 4Q196 (and in GI and GII) the rather self-righteous Tobit is ‘accidentally’ blinded while performing an act of charity to his own kin, which he believed was the way to gain righteousness and thus be rewarded by God. In the end, when he has recovered his sight, Tobit redefines the way to achieve true righteousness: to bless God and extol his majesty to all nations with truthfulness in heart and soul.Contribution: The comparison of the Semitic fragments from Qumran with the Septuagint versions suggests that the first reconstructions and translations of 4QTobit may have been overly influenced by the long-standing Greek versions. Whereas the Greek versions tend to emphasise almsgiving as a means to gain righteousness, the older Aramaic versions tend to highlight righteousness and truthfulness as the primary value. (shrink)

The present article deals with a kind of parapsychology called metapsychics ( metapsíquica) as conceived and practised in Spain between 1923 and 1925. First we focus on the reception of a treatise by Richet that evoked both support (Ferrán) and criticism (Mira). Then we examine some experiments on clairvoyance performed at the Marquis of Santa Cara’s home, dealing chiefly with the rise and fall of a case of prodigious vision. The analysis gives special attention to the question of how metapsychics (...) was understood and to which discussions it gave rise. The authors argue that the project of metapsychics must be understood within a frame of two tendencies, namely, the increasing popularization and the demarcation of science that were under way in modern society. Although semioticians routinely examine the use of signs and symbols in everyday life, they rarely explore symbols embedded within handwriting. Graphology, , is an academic discipline that has practitioners analyzing graphic features of handwriting in order to discern the personality of the writer. Graphologists perform a “semiotic read” of signatures, often demonstrating how writers inadvertently express their interests, affiliations or emotional issues by embedding symbols within handwritten script. Handwriting samples are reproduced in order to demonstrate this phenomenon and to introduce (...) the relevance of handwriting to semioticians. (shrink)
