David Gray Carlson and Peter Goodrich argue that the postmodern legal mind can be characterized as having shifted the focus of legal analysis away from the modernist understanding of law as a system that is unitary and separate from other aspects of culture and society. In exploring the various "other dimensions" of law, scholars have developed alternative species of legal analysis and recognized the existence of different forms of law. Carlson and Goodrich assert that the postmodern legal mind introduced a (...) series of "minor jurisprudences" or partial forms of legal knowledge, which both compete with and subvert the modernist conception of a unitary system of law. In doing so scholars from a variety of disciplines pursue the implications of applying the insights of their disciplines to law. Carlson and Goodrich have assembled in this volume essays from some of our leading thinkers that address what is arguably one of the most fundamental of interdisciplinary encounters, that of psychoanalysis and law. While psychoanalytic interpretations of law are by no means a novelty within common law jurisprudence, the extent and possibilities of the terrain opened up by psychoanalysis have yet to be extensively addressed. The intentional subject and "reasonable man" of law are disassembled in psychoanalysis to reveal a chaotic and irrational libidinal subject, a sexual being, a body and its drives. The focus of the present collection of essays is upon desire as an inner law, upon love as an interior idiom of legality, and represents a signficant and at times surprising development of the psychoanalytic analysis of legality. These essays should appeal to scholars in law and in psychology. In this paper we are going to show that error coping strategies play an essential role in linguistic pragmatics. We study the effect of noisy speaker strategies within a framework of signalling games with feedback loop. We distinguish between cases in which errors occur in message selection and cases in which they occur in signal selection. The first type of errors affects the content of an utterance, and the second type its linguistic expression. The general communication model is inspired by (...) the Shannon–Weaver communication model. We test the model by a number of benchmark examples, including examples of relevance implicatures, quantity implicatures, and presupposition accommodation. (shrink)

The conclusion of practical reasoning is commonly said to rest upon a diverse pair of representations—a “major” and a “minor” premise—the first of which concerns the end and the second, the means. Modern and contemporary philosophers writing on action and practical reasoning tend to portray the minor premise as a “means-end belief”—a belief about, as Michael Smith puts it, “the ways in which one thing leads to another,” or, as John McDowell puts it, “what can be relied on to bring (...) about what.” On this point there is little difference between followers of Davidson and followers of Anscombe, or between those who invoke Hume’s legacy and those who invoke Aristotle’s. But Aristotle himself held a very different position. According to him, the minor premise concerns particulars, a sphere controlled by perception. The perception of particulars—that is, of the really-existing people and things confronted in the field of action—plays no essential role in the modern account of rational agency. Because it does not, the modern account fails to explain how one could act for a reason, or how practical reasoning could deliver any conclusion. (shrink)

To determine what the speaker in a cooperative dialog meant with his assertion, on top of what he explicitly said, it is crucial that we assume that the assertion he gave was optimal. In determining optimal assertions we assume that dialogs are embedded in decision problems (van Rooij 2003) and use backwards induction for calculating them (Benz 2006). In this paper, we show that in terms of our framework we can account for several types of implicatures in a uniform way, (...) suggesting that there is no need for an independent linguistic theory of generalized implicatures. In the final section, we show how we can embed our theory in the framework of signaling games, and how it relates with other game theoretic analyses of implicatures. (shrink)

Dans cette contribution, la Comédie Ancienne est associée de manière surprenante au complexe chamanistique, ou respectivement, au schéma du goës ou magos qui existait dans la Grèce archaïque et dans les premiers temps de la Grèce classique. Après un bref aperçu de l’histoire de la recherche concernant le ‘chamanisme’ grec dans les études classiques, l’auteur écarte explicitement les spéculations essentialistes sur l’origine, mais utilise le phénomène religieux au sens d’un procédé de fantaisie mental et théâtral. Le potentiel performatif du goës (...) est à même de traduire la chute soudaine, constitutive du genre, dans des espaces et des modes de jeu grotesques et ataviques, sur la scène comique. En particulier, les thèmes de la guérison et des voyages dans l’Hadès ou au ciel, thèmes qui jusqu’à présent n’ont pas vraiment été traités comme il l’aurait fallu, comme le héros comique ambigu et excessif, et la poétique alogique et non naturaliste de la Comédie Ancienne, peuvent s’expliquer comme repoussoirs d’un goës chamanique. Dans les pièces populaires de la place de marché, un tel théâtre de bouffons et de médecins charlatans perdure à travers l’histoire. À la fin, l’approche théorique est mise en pratique en prenant comme exemple la Paix d’Aristophane. L’intrigue relativement simple, où le héros chevauche jusqu’au ciel pour trouver une sorte de thérapie pour la cité, est enrichie d’une nouvelle signification totalement englobante, au-delà du politique strict. The recent introduction of the concepts of tenderness, vulnerability, and parental care in the field of moral emotions has brought us closer to an understanding of the underlying mechanisms, but has not yet resulted in a systematic evolutionary and proximate analysis. Applying such an analysis, the present article proposes a hypothetical care mechanism that produces different motivational states or moral emotions (e.g., tenderness, sympathy, guilt, moral anger) in response to individuals perceived as vulnerable. The mechanism consists of a care system (...) automatically triggered by vulnerability cues, a system for defense and aggression, and a process of causally attributing changes in the vulnerable object’s well-being. The mechanism may also be useful in explaining moral responses in domains other than harm prevention. (shrink)

Hyperpolitics and Political Commitment in the Twenty-First Century What do the January 6th invasion of the Capitol and the anti-racist demonstrations of mid-2020 have in common? Both birthed some of the largest protest movements in American history, but also diminished rapidly after their initial, pre-revolutionary peak. This article reads the recent political sequence through the concept of ‘hyperpolitics’. In contrast to previous types of post-politics or mass politics, ‘hyperpolitics’ stands for a distinctly novel mode of political commitment characteristic of the (...) 2010s, in which a formerly apolitical public sphere finds itself intensely repoliticized, imposing itself on other domains such as the private, cultural, or economic. The return in question yet also runs across parameters that are more low-cost, low-entry, and low-duration than previous twentieth-century types, in stark contrast Max Weber’s typology of politics as the ‘slow boring of hard boards.’. This paper takes a stand on Hamblin semantics and its relation to the semantics-to-pragmatics interface. Biased questions, where the speaker finds one of the options more likely and expects the confirmation that p is true, raise a concern about the limits of Hamblin semantics. I argue that biased questions have modified Hamblin semantics, while unbiased questions have unconstrained Hamblin semantics. The optional bias feature explains compositionally. It is triggered by likelihood presuppositions ranging Hamblin sets and highlighting the preferred alternative(s). Biased (...) effects are exceptionally possible in alternative and wh-questions, but only in polar questions, they can be encoded lexically and grammatically. I argue that Hamblin semantics covers all core types of questions, while some of its applications for non-questions are problematic. (shrink)

I discuss the foundations of predicate ontologies based on two model notions – elementary states of affairs and eventualities, i.e. ordered pairs of initial and end states of affairs. Vendlerian classifications are oriented towards elementary states and tense logic, while Davidsonian classifications deal with eventualities and event logic. There are two kinds of atemporal predicates - fact and properties. Facts are propositional arguments of second-order predicates which add a special meaning that the embedded proposition was verified. Properties are atemporal first-order (...) predicates that lack eventive interpretation and are not associated with factive frames. Davidsonian states are homogeneous durable spatiotemporal things distinct both from atemporal properties and spatiotemporal dynamic predicates. Davidsonian states are causally independent, while resultatives are causally determined as they reconstruct a preceding event that has caused the end state p. I discuss the contrast between external and internal Davidsonian states. The former lack a priority argument and can be quantified extensionally. The latter have a priority experiential argument and can only be quantified intensionally. External states can be observed, while internal states cannot. (shrink)

This paper introduces and discusses three models of future: a determinist model, a stochastic model, and the model of True Prophetic Knowledge. All three models coexist in natural languages and are represented both in their grammatical systems and in the text-building discourse strategies speakers and authors apply to.

Perú es un caso claro de conflicto interno violento. Este conflicto, dominado por las acciones del grupo guerrillero Sendero Luminoso tuvo sus años más duros durante las décadas de los años 80 y 90. Sin embrago, es peculiar la poca producción académica que existe analizando los aspectos de paz y conflicto del país. Este trabajo busca repasar los trabajos realizados en el país sobre la violencia y analizar la existencia de contribuciones académicas que traten el conflicto peruano desde la perspectiva (...) de los estudios de paz y conflicto. Para ello se presentan los conceptos de construcción de paz y reconciliación según los autores seminales de los estudios de paz y se contrastan esos conceptos con las contribuciones académicas más destacadas. Este artículo concluye que existe un cuerpo limitado de trabajo al respecto, generado en dos épocas diferenciadas. Durante los años de la violencia serán trabajos que cuestionan las acciones de Sendero Luminoso y después de la creación de la Comisión de la Verdad aparecerán trabajos más alineados con los estudios de paz, sobre todo con los conceptos de memoria y reconciliación. L'objet de l'article est de considérer le document du magistère «Ordinatio sacerdotalis» dans le cadre de la gnoséologie théologique. Vatican II a légué, au sujet de l'objet et de l'étendue du magistère pontifical ordinaire trois critères-clé que l'ecclésiologiste doit appliquer pour l'interprétation des textes du magistère. a) La nature du document ; b) La proposition fréquente du thème en d'autres documents du magistère et sa transmission dans la tradition vivante de l'Eglise; c) Les formules employées pour déterminer le caractère de (...) l'acte magistériel et l'étendue de l'adhésion requise des destinataires. Il est de la compétence de l'ecclésiologiste, en accueillant en principe le document en la forme requise par sa présentation, d'approfondir la connexion véritable de la doctrine proposée avec le dépôt révélé et l'analogie de cette doctrine avec les autres vérités du message chrétien. Ainsi seulement pourra-t-on situer le document en raison de son contenu et de l'acte formel du magistère qui s'y exprime, dans le contexte qui lui correspond par rapport à l'entièreté du dépôt de la foi. Gregory Bateson’s work on play led him to conclude that paradox is the ground of propositions and denotation. Working through the concepts of analog and digital communication, logical typing problems, and various dimensions of “framing” and meta-discourse, I broadly illustrate how what Bateson came to call “the paradoxes of abstraction” inevitably arise within denotative utterances. In addressing the root paradoxes of framing and denotation which Bateson’s work on play identified and sought to elucidate, this manuscript outlines and advances some of (...)
