The premodern history of the European university can be divided into two triads of three centuries: the medieval university and the ‘medieval’ university of the sixteenth, seventeenth and eighteenth centuries. During these last three centuries Europe’s Christian university was a ‘confessional’ university: the catholic, Lutheran, reformed and Anglican university and the dissenter university of New England. The reformed university of these centuries offered a distinctive way of systematic thought. A specific doctrine of God was connected with a distinct ontology and (...) this combination constituted the theoretical framework of its philosophy and theology. What are the main distinctive features of this scholastic way of thought and can a specific traditionhistorical background be identified ? I– The key concept of this systematic way of thought is God’s free knowledge . This free knowledgeis here understood to be God’s knowledge of future states of affairs – see section 7 for the main lines of Turrettini’s doctrine of God. This free knowledge of future states of affairs is also called definite , because future states of affairs are definite on the basis of God’s certain will. Thus God’s free knowledge is partly based on divine will, but the other pillar of God’s free knowledge is that divine knowledge which is structurally prior to an act of divine will: God’s ‘natural’ knowledge . This natural or necessary knowledge of God encompasses all possible states of affairs. This structure turning around the notion of scientia libera is vital for understanding Western thought, because Aristotelianism and latin Averroism, Thomism and nominalism do not dispose of this notion of scientia libera. Such a free knowledge doctrine of God is married to a specific type of ontology, namely a contingency ontology– see section 8. This type of ontology centres on the notion of fundamental possibility. All possible states of affairs enjoy the status of possibility . This status of possibility is constituted by logical possibility. Turrettini joins Duns Scotus in defining the logicum possibile: If a state of affairs is possible, then it is not inconsistent that it obtains. Therefore, the twin concept of fundamental possibility is logical IMpossibility: What is logically impossible, is inconsistent and self-contradictory, because it includes contradictory predicates. This approach leads to the central ontological notion of synchronic contingency. Turrettini’s key term is even almost the same as this modern invention to name this crucial device: simultas potentiae. When is an event contingent in this sense? An event e is synchronically contingent at time t, if e is the case at time t – therefore eis possible – while it is possible too that e is not the case at the same time t. Because of the simultaneity of the possibility of the opposite, reality is not necessary. It is open. Thus, the tool of implicative necessity is essential to Turrettini’s methodology. It does not only govern his doctrine of God, but also his theory of true freedom of the human will. II – In contrast to traditional descriptions of reformed scholasticism, Turrettini’s theology is a theology of will and radical contingency in general and a theology of freedom and grace in particular. I have already indicated that Turrettini followed Scotism in vital respects and Duns Scotus stood on the shoulders of Henry of Ghent and of Bonaventure . The ontological infrastructure was delivered by Duns Scotus’ way of thinking structured by synchronic contingency, but the basics of this type of doctrine of God’s knowledge are already conspicuous in the so-called Summa fratris Aleandri . Thomas Aquinas substantially borrowing from Aristotle consciously deviates from this tradition built on the legacy of Augustine and Anselm, the Victorines and Alexander of Hales by ignoring the new theory of divine knowledge put forward by John of La Rochelle. This new approach develops a new relationship between God’s notitia simplex and notitia visionis on the one hand and his potentia absoluta and potentia ordinata on the other hand. (shrink)

Context Informed consent is crucial in daily clinical practice and research in medicine and psychiatry. A recent neuroethical investigation explored the psychological factors that are crucial in determining whether or not subjects give consent. While cognitive functions have been shown to play a central role, the impact of empathy and emotions on subjects' decisions in informed consent remains unclear. Objective To evaluate the impact of empathy and emotions on subjects' decision in informed consent in an exploratory study. Design Decisional capacity (...) and informed consent to a subsequent imaging study were evaluated with the MacArthur Competence Assessment Tool for Clinical Research (MacCAT-CR). Empathy and emotion recognition were measured with the Multifaceted Empathy Test (MET) and the Florida Affect Battery (FAB). Setting Psychiatric subjects were recruited from a general psychiatric hospital and a forensic state hospital. Patients A mixed group of 98 healthy men and forensic and non-forensic psychiatric subjects were investigated. Results Both empathy (MET) and emotion recognition (FAB) correlated with MacCAT-CR scores. Higher cognitive empathy and good emotion recognition (compared with low empathy and emotion recognition) were associated with increased decisional capacity and higher rates of refusal to give informed consent. Conclusions This study shows an empirical relationship between decision-making and informed consent, on the one hand, and emotions and empathy on the other. While this study is exploratory and preliminary, the findings of a relationship between informed consent, emotions and empathy raise important neuroethical questions with regard to an emotional-social concept of informed consent and potential clinical implications for testing informed consent. This article, corresponding to a part of the restitution of a financed international research project between France, Brazil, Canada, Italy and Belgium, aims to offer a modelisation and qualitative evaluation of mediation care settings based on an original methodological tool that involves identifying the typical games at the foundations of creativity, following a multidisciplinary perspective. Therapeutic mediations are settings or devices organised around a “pliable medium”, often artistic, like painting, modeling, writing, ​and theatre, which are very widespread in institutional practices, (...) both in France and abroad. The scientific objectives of this research consist in a multi-disciplinary exploration (anthropology, criminology, neuroscience, clinical psychology) of the process of creative symbolisation understood as a process of transformation involving play. According to this orientation, play can be defined as a psychic process whereby a subjective experience can be explored with pleasure, and consequently symbolised and appropriated. Our fundamental and original hypothesis is that play is at the source of the creative process, conceived as a work of metabolisation by the psyche of playful experiences during the different stages of life. The review of the understanding of play in psychoanalysis, anthropology, criminology and neuroscience emphasises the richness of this model and the importance of reflecting on the typical games in the field of psychic care. A clinical example of treatment in a pictorial therapeutic mediation setting of a child with psychotic disorders makes it possible to identify a number of typical games as well as the modalities of interpretation of the therapists through play. These multidisciplinary studies lead to the presentation of a general table of typical games, and these first results highlight the richness of identifying typical games in clinical settings. Ultimately, the multidisciplinary approach shows the interest of the model of play in the evaluation of therapeutic mediation settings, with a convergence of the different disciplines emphasising the pertinence of this model. The scientific impact of this research overlaps with its societal impact, through the development of innovative tools for evaluating therapeutic mediations, in order to take account of the evolution of the different forms of social expression of psychic suffering. This paper presents a way in which formal logic can be understood and reformulated in terms of argumentation that can help us unify formal and informal reasoning. Classical deductive reasoning will be expressed entirely in terms of notions and concepts from argumentation so that formal logical entailment is equivalently captured via the arguments that win between those supporting concluding formulae and arguments supporting contradictory formulae. This allows us to go beyond Classical Logic and smoothly connect it with human reasoning, thus (...) providing a uniform argumentation-based view of both informal and formal logic. (shrink)

The current legal status and medical ethics of routine or religious penile circumcision of minors is a matter of ongoing controversy in many countries. We focus on the United Kingdom as an illustrative example, giving a detailed analysis of the most recent British Medical Association guidance from 2019. We argue that the guidance paints a confused and conflicting portrait of the law and ethics of the procedure in the UK context, reflecting deeper, unresolved moral and legal tensions surrounding child genital (...) cutting practices more generally. Of particular note is a lack of clarity around how to apply the “best interests” standard—ordinarily associated with time-sensitive proxy decision making regarding therapeutic options for a medically unwell patient—to a parental request for a medically unnecessary surgery to be carried out on the genitalia of a healthy child. Challenges arise in measuring and assigning weights to intended sociocultural or religious/spiritual benefits, and even to health-related prophylactic benefits, and in balancing these against potential physical, functional, and psychosexual risks or harms. Also of concern are apparently inconsistent safeguarding standards being applied to children based on their birth sex categorization or gender of rearing. We identify and discuss recent trends in British and international medical ethics and law, finding gradual movement toward a more unified standard for evaluating the permissibility of surgically modifying healthy children's genitals before they can meaningfully participate in the decision. The question "What can justify criminal punishment ?" becomes especially insistent at times, like our own, of penal crisis, when serious doubts are raised not only about the justice or efficacy of particular modes of punishment, but about the very legitimacy of the whole penal system. Recent theorizing about punishment offers a variety of answers to that question-answers that try to make plausible sense of the idea that punishment is justified as being deserved for past crimes; answers that try to (...) identify some beneficial consequences in terms of which punishment might be justified; as well as abolitionist answers telling us that we should seek to abolish, rather than to justify, criminal punishment. This book begins with a critical survey of recent trends in penal theory, but goes on to develop an original account (based on Duff's earlier Trials and Punishments) of criminal punishment as a mode of moral communication, aimed at inducing repentance, reform, and reconciliation through reparation-an account that undercuts the traditional controversies between consequentialist and retributivist penal theories, and that shows how abolitionist concerns can properly be met by a system of communicative punishments. In developing this account, Duff articulates the "liberal communitarian" conception of political society (and of the role of the criminal law) on which it depends; he discusses the meaning and role of different modes of punishment, showing how they can constitute appropriate modes of moral communication between political community and its citizens; and he identifies the essential preconditions for the justice of punishment as thus conceived-preconditions whose non-satisfaction makes our own system of criminal punishment morally problematic. Punishment, Communication, and Community offers no easy answers, but provides a rich and ambitious ideal of what criminal punishment could be-an ideal of what criminal punishment cold be-and ideal that challenges existing penal theories as well as our existing penal theories as well as our existing penal practices. In this paper, I argue that art can help us imagine what it would be like to have experiences we have never had before. I begin by surveying a few of the things we are after when we ask what an experience is like. I maintain that it is easy for art to provide some of them. For example, it can relay facts about what the experience involves or what responses the experience might engender. The tricky case is the phenomenal (...) quality of the experience or what it feels like from the inside. Thus, in the main part of the paper, I discuss how art can provide us with this as well. I conclude by situating my view in the context of the broader debate over transformative experiences. I maintain that art can solve some but not all of the problems that arise when deciding whether to undergo a transformation. (shrink)

The “systematicity argument” has been used to argue for a classical cognitive architecture (Fodor in The Language of Thought. Harvester Press, London, 1975, Why there still has to be a language of thought? In Psychosemantics, appendix. MIT Press, Cambridge, pp 135–154, 1987; Fodor and Pylyshyn in Cognition 28:3–71, 1988; Aizawa in The systematicity arguments. Kluwer Academic Press, Dordrecht, 2003). From the premises that cognition is systematic and that the best/only explanation of systematicity is compositional structure, it concludes that cognition is (...) to be explained in terms of symbols (in a language of thought) and formal rules. The debate, with connectionism, has mostly centered on the second premise-whether an explanation of systematicity requires compositional structure, which neural networks do not to exhibit (for example, Hadley and Hayward, in Minds and Machines, 7:1–37). In this paper, I will take issue with the first premise. Several arguments will be deployed that show that cognition is not systematic in general; that, in fact, systematicity seems to be related to language. I will argue that it is just verbal minds that are systematic, and they are so because of the structuring role of language in cognition. A dual-process theory of cognition will be defended as the best explanation of the facts. (shrink)

One of the most commonly referenced ethical principles when it comes to the management of dying patients is the doctrine of double effect (DDE). The DDE affirms that it is acceptable to cause side effects (e.g. respiratory depression) as a consequence of symptom‐focused treatment. Much discussion of the ethics of end of life care focuses on the question of whether actions (or omissions) would hasten (or cause) death, and whether that is permissible. However, there is a separate question about the (...) permissibility of hastening or causing unconsciousness in dying patients. Some authors have argued that the DDE would not permit end of life care that directly aims to render the patient unconscious. The claim is that consciousness is an objective human good and therefore doctors should not intentionally (and permanently) suppress it. Three types of end of life care (EOLC) practices will be explored in this article. The first is symptom‐based management (e.g. analgesia); the second is proportional terminal sedation as a means of relieving suffering (also referred to as palliative sedation or continuous deep sedation); and finally, deliberate and rapid sedation to unconsciousness until death (a practice we call terminal anaesthesia in this paper). After examining the common arguments for the various types of symptom‐based management and sedation, we apply the DDE to the latter two types of EOLC practices. We argue that aiming at unconsciousness, contrary to some claims, can be morally good or at least morally neutral in some dying patients. (shrink)

The use of expressions like ‘concepts of consciousness’, ‘kinds of consciousness’, and ‘meanings of ‘consciousness’’ interchangeably is ubiquitous within the consciousness literature. It is argued that this practice can be made sense of in only two ways. The first involves interpreting ‘concepts of consciousness’ and ‘kinds of consciousness’ metalinguistically to mean concepts expressed by ‘consciousness’ and kinds expressed by ‘consciousness’; and the second involves certain literal, though semantically deviant, interpretations of those expressions. The trouble is that researchers typically use the (...) above expressions interchangeably without satisfying either way of doing so coherently. The result is much error and confusion, which is demonstrated in the works of philosophers currently writing on consciousness. (shrink)

The roots of Newton’s mathematization of nature, this paper aims to demonstrate, are to be found in Isaac Barrow’s (1630–77) philosophy of the mathematical sciences.Barrow’s attitude (...) towards natural philosophy evolved from his earnest interest in medicine of around 1650, when a young Cambridge graduate, to natural philosophy (apparently under Henry More’s influence); from his thesis on the insufficiency of the Cartesian hypothesis to geometrical optics and the strong program of mathematization of natural philosophy of the middle 1660s; from Lucasian professor of Mathematics to Chaplain of his Majesty and eminent Restoration divine. Many decades ago Patrick Suppes argued rather convincingly that theoretical hypotheses are not confronted with the direct, raw results of an experiment, rather, they are typically compared with models of data. What exactly is a data model however? And how do the interactions of particles at the subatomic scale give rise to the huge volumes of data that are then moulded into a polished data model? The aim of this paper is to answer these questions by presenting a detailed case (...) study of the construction of data models at the LHCb for testing Lepton Flavour Universality in rare decays of B-mesons. The close examination of the scientific practice at the LHCb leads to the following four main conclusions: raw data in their pure form are practically useless for the comparison of experimental results with theory, and processed data are in some cases epistemically more reliable, real and simulated data are involved in the co-production of the final data model and cannot be easily distinguished, theory-ladenness emerges at three different levels depending on the scope and the purpose for which background theory guides the overall experimental process and the overall process of acquiring and analysing data in high energy physics is too complicated to be fully captured by a generic methodological description of the experimental practice. We agree with Walle, Reschke, and Knothe’s argument that at one level of analysis, social referencing and social appraisal are functionally equivalent: In both cases, another person’s emotional expression is observed and this expression informs the observer’s own emotional reactions and behavior. However, we also agree with Clément and Dukes’s view that, there is an important difference between social referencing and social appraisal. This article explores the connection between objective chance and the randomness of a sequence of outcomes. Discussion is focussed around the claim that something happens by chance iff it is random. This claim is subject to many objections. Attempts to save it by providing alternative theories of chance and randomness, involving indeterminism, unpredictability, and reductionism about chance, are canvassed. The article is largely expository, with particular attention being paid to the details of algorithmic randomness, a topic relatively unfamiliar to philosophers.
