Many believe that the ethical problems of donation after cardiocirculatory death (DCD) have been "worked out" and that it is unclear why DCD should be resisted. In this paper we will argue that DCD donors may not yet be dead, and therefore that organ donation during DCD may violate the dead donor rule. We first present a description of the process of DCD and the standard ethical rationale for the practice. We then present our concerns with DCD, including the following: (...) irreversibility of absent circulation has not occurred and the many attempts to claim it has have all failed; conflicts of interest at all steps in the DCD process, including the decision to withdraw life support before DCD, are simply unavoidable; potentially harmful premortem interventions to preserve organ utility are not justifiable, even with the help of the principle of double effect; claims that DCD conforms with the intent of the law and current accepted medical standards are misleading and inaccurate; and consensus statements by respected medical groups do not change these arguments due to their low quality including being plagued by conflict of interest. Moreover, some arguments in favor of DCD, while likely true, are "straw-man arguments," such as the great benefit of organ donation. The truth is that honesty and trustworthiness require that we face these problems instead of avoiding them. We believe that DCD is not ethically allowable because it abandons the dead donor rule, has unavoidable conflicts of interests, and implements premortem interventions which can hasten death. These important points have not been, but need to be fully disclosed to the public and incorporated into fully informed consent. These are tall orders, and require open public debate. Until this debate occurs, we call for a moratorium on the practice of DCD. (shrink)

This article explores Gerardus van der Leeuw’s view of phenomenology of religion. The phenomenological method he defended is basically a hermeneutical approach in which an observer relates personally and even existentially to the “phenomena” (s)he studies in order to determine their essence (Wesensschau). In his anthropology (that reflects on the basic structure of human beings) a similar way of relating to the world is discussed: the “primitive mentality” that is characterized by the “need to participate” (besoin de participation). Both phenomenology (...) and mentalité primitive imply a critique of modern scholarship. This fundamental criticism of the prevailing (historical) approach in the humanities including religious studies explains the growing distance between van der Leeuw and the majority of scholars of religion in the decades after his death in 1950. Este artigo faz parte de uma investigação em andamento, na qual exploramos a leitura de arendtiana do Agostinho de Hipona, partindo da obra inicial, El concepto de amor en San Agustín (2001). Consideramos que a investigação da dissertação doutoral, obra tão pouco explorada pelos seus mais relevantes interpretes, pode brindarmos novas chaves de leitura da teoria política de Hannah Arendt, tornando mais complexo nossa abordagem na sua leitura heterodoxa da tradição do pensamento (...) filosófico. Segundo nossa hipótese é a tese doutoral de 1929, onde a dimensão política do problema num sentido amplo começa a emergir, a partir da questão do que é especificamente humano, sempre sujeito à constante tensão entre um “não mais” e um “ainda não” (Arendt, 2001: 311; Agustín, 2005: XI, 21,27). Somente em posteriores trabalhos a leitura da fonte agostiniana –focada cada vez mais nas Confesiones (2005) y na Ciudad de Dios (1958) fica articulada explicitamente com a elaboração da trama mais conhecida da fenomenologia da ação política; na qual numerosos e importantes interpretes tenham situado o giro embora da política da aluna do Heidegger e Jaspers (Young Bruehl, 2006; Canovan, 2002; Benhabib, 2000; Forti, 2001). Embora essas autoras reconheçam a formação inicial e sua influencia sobre a filósofa Arendt, em geral, todas elas acentuam a ruptura com todo o seu escopo de formação universitária em filosofia e teologia. Ariès traces Western man's attitudes toward mortality from the early medieval conception of death as the familiar collective destiny of the human race to the modern tendency, so pronounced in industrial societies, to hide death as if it were an embarrassing family secret.

The Vatican recently published directives regarding “beginning of life” issues that explain the Catholic Church's position regarding new technologies in this area. We think that it is important to develop a response that presents the traditional Orthodox Jewish position on these same issues in order to present an alternative, parallel system. There are many points of commonality between the Vatican document and traditional Jewish thought as well as several important issues where there is a divergence of opinion. The latter include (...) the status of the zygote as produced during in vitro fertilization, the acceptable of procreation in a method other than through the conjugal act, and the permissibility of deriving benefit from the products of an illicit act. These points of agreement and disagreement are discussed in detail in this article. (shrink)

Eye tracking is used to investigate human choice procedures. We infer from eye movement patterns in choice problems where the deliberation process is clear to deliberations in problems of choice between two lotteries. The results indicate that participants tend to compare prizes and probabilities separately. The data provide little support for the hypothesis that decision makers use an expected utility type of calculation exclusively. This is particularly true when the calculations involved in comparing the lotteries are complicated.

The aim of this paper is (i) to defend Frege's view that the referents of predicates are certain kinds of functions, or "concepts", i.e. incomplete entities, and not their extensions (i.e. sets of objects described by those predicates); and (ii) to justify, by a natural augmentation of Frege's semantic theory with modal ingredients, Frege's position that the sameness between concepts, or property-sharing, turns only on the sameness of extensions. Several problems with the doctrine that a predicate's extension is its referent (...) are presented, including the regress argument and an argument from the modern philosophy of language related to natural kind terms. The article focuses on the implementation of the contemporary neo-Hegelianism of the Pittsburgh-school (Robert B. Brandom, John McDowell) to the philosophy of education. Neo-Hegelianism has recently initiated a highly complex discussion about the notion of Bildung and its use in the post metaphysical and naturalized sense. Based on the critique of what is called a priori intersubjectivism, discussed by the main proponents of the Heidelberg School (Dieter Henrich and Manfred Frank), this article aims to address some theoretical and conceptual problems (...) inherent in the educationist reading of neo-Hegelianism. The basic problem of an educationist reading of neo-Hegelianism is that, based on its own premises, it is not capable of comprehending the emergence of self-consciousness and individuality. It would therefore be inadvisable for educationists to (over-)eagerly adopt contemporary neo-Hegelianism, or we should at least be slightly cautious about its potential for the further development of a theory or philosophy of Bildung. This study offers a fresh reappraisal of the philosopher, political thinker, and historian of ideas Sir Isaiah Berlin (1909-1997) from childhood to the height of his intellectual career. It provides the first historically contextualized study of Berlin's formative years and identifies different stages in his intellectual development, allowing a reappraisal of his theory of liberalism. Applying a 'double perspective' that examines Berlin both as an East European Jewish émigré; as well as a British Liberal intellectual, author Arie Dubnov stresses (...) the very ambivalent relation between Berlin's liberal philosophy and his pro-Zionist sentiments. This article calls into question the charge that frequentist testing is susceptible to the base-rate fallacy. It is argued that the apparent similarity between examples like the Harvard Medical School test and frequentist testing is highly misleading. A closer scrutiny reveals that such examples have none of the basic features of a proper frequentist test, such as legitimate data, hypotheses, test statistics, and sampling distributions. Indeed, the relevant error probabilities are replaced with the false positive/negative rates that constitute deductive calculations (...) based on known probabilities among events. Constructions of Intersubjectivity shows that the meaning of grammatical constructions often has more to do with the human cognitive capacity for taking other peoples' points of view than with describing the world. Treating pragmatics, semantics, and syntax in parallel and integrating insights from linguistics, psychology, and animal communication, Arie Verhagen develops a new understanding of linguistic communication. In doing so he shows the continuity between language and animal communication and reveals the nature of human linguistic specialization. Professor Verhagen uses (...) Dutch and English data from a wide variety of sources and considers the contributions of grammar to the coherence of discourse. He argues that important problems in semantics and syntax may be resolved if language is understood as an instrument for exerting influence and coordinating different perspectives. The grammatical phenomena he discusses include negative expressions, the let alone construction, complementation constructions, and discourse connectives.This powerfully argued and original explanation of the nature and operation of communication will interest a wide range of scholars and advanced students in linguistics, cognitive science, and human evolution. This remarkable book--the fruit of almost two decades of study--traces in compelling fashion the changes in Western attitudes toward death and dying from the earliest Christian times to the present day. A truly landmark study, The Hour of Our Death reveals a pattern of gradually developing evolutionary stages in our perceptions of life in relation to death, each stage representing a virtual redefinition of human nature. Starting at the very foundations of Western culture, the eminent historian Phillipe Aries shows how, (...) from Graeco-Roman times through the first ten centuries of the Common Era, death was too common to be frightening; each life was quietly subordinated to the community, which paid its respects and then moved on. Aries identifies the first major shift in attitude with the turn of the eleventh century when a sense of individuality began to rise and with it, profound consequences: death no longer meant merely the weakening of community, but rather the destruction of self. Hence the growing fear of the afterlife, new conceptions of the Last Judgment, and the first attempts (by Masses and other rituals) to guarantee a better life in the next world. In the 1500s attention shifted from the demise of the self to that of the loved one (as family supplants community), and by the nineteenth century death comes to be viewed as simply a staging post toward reunion in the hereafter. Finally, Aries shows why death has become such an unendurable truth in our own century--how it has been nearly banished from our daily lives--and points out what may be done to "re-tame" this secret terror. The richness of Aries's source material and investigative work is breathtaking. While exploring everything from churches, religious rituals, and graveyards (with their often macabre headstones and monuments), to wills and testaments, love letters, literature, paintings, diaries, town plans, crime and sanitation reports, and grave robbing complaints, Aries ranges across Europe to Russia on the one hand and to England and America on the other. As he sorts out the tangled mysteries of our accumulated terrors and beliefs, we come to understand the history--indeed the pathology--of our intellectual and psychological tensions in the face of death. An ℵ1-Souslin tree is a complicated combinatorial object whose existence cannot be decided on the grounds of ZFC alone. But fifteen years after Tennenbaum and Jech independently devised notions of forcing for introducing such a tree, Shelah proved that already the simplest forcing notion—Cohen forcing—adds an ℵ1-Souslin tree. In this article, we identify a rather large class of notions of forcing that, assuming a GCH-type hypothesis, add a λ+-Souslin tree. This class includes Prikry, Magidor, and Radin forcing.

Reasoning with the maximally consistent subsets of the premises is a well-known approach for handling contradictory information. In this paper we consider several variations of this kind of reasoning, for each one we introduce two complementary computational methods that are based on logical argumentation theory. The difference between the two approaches is in their ways of making consequences: one approach is of a declarative nature and is related to Dung-style semantics for abstract argumentation, while the other approach has a more (...) proof-theoretical flavor, extending Gentzen-style sequent calculi. The outcome of this work is a new perspective on reasoning with MCS, which shows a strong link between the latter and argumentation systems, and which can be generalized to some related formalisms. As a by-product of this we obtain soundness and completeness results for the dynamic proof systems with respect to several of Dung’s semantics. In a broader context, we believe that this work helps to better understand and evaluate the role of logic-based instantiations of argumentation frameworks. (shrink)

This paper aims to give a substantive account of how Feynman used diagrams in the first lectures in which he explained his new approach to quantum electrodynamics. By critically examining unpublished lecture notes, Feynman’s use and interpretation of both "Feynman diagrams" and other visual representations will be illuminated. This paper discusses how the morphology of Feynman’s early diagrams were determined by both highly contextual issues, which molded his images to local needs and particular physical characterizations, and an overarching common diagrammatic (...) style, which facilitated Feynman’s movement between different diagrams despite their divergent forms and significance. This discussion note offers a preliminary analysis of what recent developments in human germline gene editing tell us about the effectiveness of speculative and anticipatory modes of techno-ethics. It argues that the benefits of speculative discussions are difficult to detect thus far, and that pushing the focal point of ethical discourse well ahead of the current state of technology may prematurely undermine existing norms long before a broad consensus would justify moving beyond them.

The notion of bilattice was introduced by Ginsberg, and further examined by Fitting, as a general framework for many applications. In the present paper we develop proof systems, which correspond to bilattices in an essential way. For this goal we introduce the notion of logical bilattices. We also show how they can be used for efficient inferences from possibly inconsistent data. For this we incorporate certain ideas of Kifer and Lozinskii, which happen to suit well the context of our work. (...) The outcome are paraconsistent logics with a lot of desirable properties.1. Brain death is accepted in most countries as death. The rationales to explain why brain death is death are surprisingly problematic. The standard rationale that in brain death there has been loss of integrative unity of the organism has been shown to be false, and a better rationale has not been clearly articulated. Recent expert defences of the brain death concept are examined in this paper, and are suggested to be inadequate. I argue that, ironically, these defences demonstrate the lack (...) of a defensible rationale for why brain death should be accepted as death itself. If brain death is death, a conceptual rationale for brain death being equivalent to death should be clarified, and this should be done urgently. (shrink)

This essay examines Isaiah Berlin's ambivalent relationship with the ideas and practices of Jewish nationalism and the ways in which this ambivalence shaped some of the key premises of his political thought. Drawing upon extensive archival research in his unpublished letters from the mid-1930s to the late 1950s, this essay reconstructs Berlin's attempt to reconcile himself with the national idea. This attempt forced him to enrich his liberalism, and pushed him to develop and adopt the Jewish normalization discourse. In the (...) course of those intra-Jewish debates Berlin also began to conceptualize freedom as an opportunity concept, an idea that would later become central both in Berlin's famous negative concept of freedom and in his pluralism. Adopting a dual perspective, which considers Berlin as both a British liberal and a Russian-Jewish émigré intellectual, I therefore offer to see the Jewish Zionist writings as complementary rather than secondary to Berlin's enterprise. Georg Wilhelm Friedrich Hegel developed the concept of institutionalized education, which reflected public schooling and its legitimacy in the context of rapid transformation of European feudal societies to modern societies. The concept of school reflects the Hegelian theory of Bildung and the concept of modern society. What makes Hegel’s philosophy interesting is his conviction that the processes of Bildung can take place only in the context of social institutions and in the highly organized forms of human interaction regulated by those (...) institutions. Hence the development of an individual, according to Hegel, depends exclusively on institutionalized forms of interaction. In modern society, pedagogical institutions have a specific function: on the one hand, schooling is essentially an institutional form of initiating the process of Bildung in which an individual acquires culture and applies it to life—a life which consequently becomes consciously led by an individual self; on the other, schooling is essentially a way for modern society to ensure its self-preservation by preparing the individual to respond to the demands of civic society so that she or he can take part in the economic production and reproduction of modern society. Sociolinguistic research shows that listeners' expectations of speakers influence their interpretation of the speech, yet this is often ignored in cognitive models of language comprehension. Here, we focus on the case of interactions between native and non-native speakers. Previous literature shows that listeners process the language of non-native speakers in less detail, because they expect them to have lower linguistic competence. We show that processing the language of non-native speakers increases lexical competition and access in general, not only of the (...) non-native speaker's speech, and that this leads to poorer memory of one's own speech during the interaction. We further find that the degree to which people adjust their processing to non-native speakers is related to the degree to which they adjust their speech to them. We discuss implications for cognitive models of language processing and sociolinguistic research on attitudes. (shrink)

A recent commentary defends 1) the concept of 'brain arrest' to explain what brain death is, and 2) the concept that death occurs at 2–5 minutes after absent circulation. I suggest that both these claims are flawed. Brain arrest is said to threaten life, and lead to death by causing a secondary respiratory then cardiac arrest. It is further claimed that ventilation only interrupts this way that brain arrest leads to death. These statements imply that brain arrest is not death (...) itself. Brain death is a devastating state that leads to death when intensive care, which replaces some of the brain's vital functions such as breathing, is withdrawn and circulation stops resulting in irreversible loss of integration of the organism. Circulatory death is said to occur at 2–5 minutes after absent circulation because, in the context of DCD, the intent is to not attempt reversal of the absent circulation. No defense of this weak construal of irreversible loss of circulation is given. This means that paents in identical physiologic states are dead (in the DCD context) or alive (in the resuscitation context); the current state of death (at 2–5 minutes) is contingent on a future event (whether there will be resuscitation) suggesting backward causation; and the commonly used meaning of irreversible as 'not capable of being reversed' is abandoned. The literature supporting the claim that autoresuscitation does not occur in the context of no cardiopulmonary resuscitation is shown to be very limited. Several cases of autoresuscitation are summarized, suggesting that the claim that these cases are not applicable to the current debate may be premature. I suggest that brain dead and DCD donors are not dead; whether organs can be harvested before death from these patients whose prognosis is death should be debated urgently. (shrink)
