Research involving recently deceased humans that are physiologically maintained following declaration of death by neurologic criteria—or ‘research involving the recently deceased’—can fill a translational research gap while reducing harm to animals and living human subjects. It also creates new challenges for honouring the donor’s legacy, respecting the rights of donor loved ones, resource allocation and public health. As this research model gains traction, new empirical ethics questions must be answered to preserve public trust in all forms of tissue donation and (...) in the practice of medicine while respecting the legacy of the deceased and the rights of donor loved ones. This article suggests several topics for immediate investigation to understand the attitudes and experiences of researchers, clinical collaborators, donor loved ones and the public to ensure research involving the recently deceased advances ethically. Defence cases with an escalatory structure, in which the levels of violence between aggressor and defender start out as minor and then become major, even lethal, raise sharp problems for defence theory, and for our understanding of the conditions of defence: proportionality, necessity, and imminence. It is argued here that defenders are not morally required to withdraw from participation in these cases, and that defensive escalations do not offend against any of the conditions of defence, on an adequate understanding of (...) them. No plausible interpretation of proportionality or necessity excludes defensive permissions in escalatory cases. Moreover, the structure of escalatory defensive cases also sheds useful light on permissible responses to conditional deadly threats. This is because we can analyse conditional deadly threats as disguised cases of escalation. Because defensive resistance is permissible in escalatory cases, it is also permissible in cases involving conditional deadly threats. (shrink)

Hannah Arendt's approach to politics focuses on action and conduct, rather than institutions, constitutions, and states. In light of Arendtian conceptions of politics, essays in this book challenge conventional IR theories. The contributions on agency explore concepts and categories of political action that enable individuals to act politically and to re-make the world in new, unpredictable ways. The contributions on structure explore how Arendt provides new critical purchase upon often reified structures and categories.

Imagine a two-person distributive case in which Ernest's choices yield X and Bertie's choices yield X + Y, producing an income gap between them of Y. Neither Ernest nor Bertie is responsible for this gap of Y, since neither of them has any control over what the other agent chooses. This is what Susan Hurley calls the “Boring Problem” for luck egalitarianism. Contrary to Hurley's relatively dismissive treatment of it, it is contended that the Boring Problem poses a deep problem (...) for standard luck egalitarianism. To counter it, luck egalitarianism needs to be recast as a baseline-relative theory. This new version of luck egalitarianism is then put to work against some significant problems that have been encountered by luck egalitarianism: Saul Smilansky's “Paradox of the Baseline,” the “Partiality Worry,” and the “Pluralism Worry.” But baseline-relative luck egalitarianism is not without problems of its own. This essay develops a new interpretation of Moses Mendelssohn’s ontological argument in the Morning Hours: Lectures on God’s Existence. At the beginning, Immanuel Kant’s famous criticism of the ontological proof of God’s existence in the Critique of Pure Reason is presented. Then I offer an in-depth analysis of Mendelssohn’s original ontological argument in the Morning Hours. It is shown that with Mendelssohn’s new proof of God, Kant’s objections are answered. Religion can have an important influence in moral decision-making, and religious reminders may deter people from unethical behavior. Previous research indicated that religious contexts may increase prosocial behavior and reduce cheating. However, the perceptual-behavioral link between religious contexts and decision-making lacks thorough scientific understanding. This study adds to the current literature by testing the effects of purely audial religious symbols (instrumental music) on moral behavior across three different sites: Mauritius, the Czech Republic, and the USA. Participants were exposed to one (...) of three kinds of auditory stimuli (religious, secular, or white noise), and subsequently were given a chance to dishonestly report on solved mathematical equations in order to increase their monetary reward. The results showed cross-cultural differences in the effects of religious music on moral behavior, as well as a significant interaction between condition and religiosity across all sites, suggesting that religious participants were more influenced by the auditory religious stimuli than non-religious participants. We propose that religious music can function as a subtle cue associated with moral standards via cultural socialization and ritual participation. Such associative learning can charge music with specific meanings and create sacred cues that influence normative behavior. Our findings provide preliminary support for this view, which we hope further research will investigate more closely. (shrink)

Nature did not equip any of its creatures with wheels, but that means of locomotion was discovered anyway; an even swifter vehicle for the mind has been found in the atom—that irreducible unit which by virtue of its ubiquity provides reason with immediate access to alien objects, naturalizes nature, and urges an essential likeness beneath appearances so diverse that only an improbable imagination would even have placed them in a single world. The goal of atomism is to find one entity, (...) a building block which then in multiples constitutes the structures of reality and appearance. All that is needed, given this once and future One, is a set of transformational rules—and everything comes to life that has been dreamed of in the topologies of geometry, physics, history, even of metaphysics: a full representation of the world as it has been, is, will be. The ideology of atomism includes the assumption that, for structures distinguishable into parts and wholes, the parts precede the whole, temporally and logically. For the atomist, all structures can be analyzed in this way; that, in fact, turns out to be his definition of structure. This premise is already evident in the building-block universe first depicted by Democritus and Leucippus; it is no less present in the heady days of twentieth-century physics . It is slightly more pliable in latter-day atomists like Claude Lévi-Strauss and Noam Chomsky and their descendent structuralists; but here, too, atomic units of linguistic or social discourse are claimed as blind first causes of the sighted and complex structures allegedly derived from them. And if the followers of even these contemporary advocates find themselves still waiting for the promises of atomism to be kept, the imaginative turns of those promises—the binary code, the rules of an innate grammar—keep old expectations alive. In contrast to this general ideological assertion, the search for artistic atoms by poetics and aesthetic theory has lagged noticeably. We can see this disparity in the characteristic resistance to fragmentation by works of art; for many writers, the will of artistic appearance to exhibit itself as a whole, to insist on an undivided surface rather than on the elements within or beneath it, is precisely what distinguishes the structures of art from others. Even where a craftsmanlike impulse breaks into the surface of artistic unity , the pieces are usually counted teleologically: they matter as contributions to an effect, retrospectively. The artist himself, it is implied, deployed them in the first place to anticipate the unified surface; we , in turn, then understand them only in terms of that whole, not—with the atomist—by conjuring a unity from the earlier accidental joining of what then become accidental parts. In this paper, I analyze the ‘Da ti’ chapter of the Han Feizi 韓非子. This chapter is often read as one of the so-called Daoist Chapters of text. However, a deeper study of this chapter allows us to see that, while Daoist terminology is employed, it is done so in a way that is certainly not reminiscent of either the Zhuangzi 莊子 or the Laozi 老子. Neither, though, does it have quite the flavor of other chapters in the Han Feizi (...) where scholars have often read Han Fei s advocating a system of government based on laws promulgated by the ruler, the content of which is left solely to the ruler’s discretion. Throughout this paper, I hope to demonstrate that a reading of the ‘Da ti’ chapter allows us to understand that Han Fei is not simply advocating a system of government based on laws promulgated by the ruler, the content of which is left solely to the ruler’s discretion. This chapter can help us begin to understand that Han Fei has a much more nuanced system and that he advocates law that accords with the overarching pattern of the universe. In doing this, I will show that the idea of fa 法 (standard, law) that we see utilized by Han Fei, both in these chapters do not fall neatly into Western conceptions of law, and thus previous scholars who have worked based on these conceptions have missed important aspects of Han Fei’s thought. I also attempt to demonstrate that this interpretation of law is consistent with the way that it is used in the rest of the Han Feizi. (shrink)

This essay offers a liberal, neo-Millian account of free speech, which attempts to fix some familiar bugs in Mill's account of free speech by focusing primarily on the right of free association, together with the permissibility of imposing restrictions to deal with, as Mill put it, ‘violations of good manners’ and ‘offences against decency’. It also uncovers a number of more conceptual puzzles with free speech. These can be resolved, it is contended, by regarding free speech as a practice.

Based on “laws” of contagion and similarity, it is understood that people tend to believe that meanings associated with one object may be transferred onto another, and the meanings of the first may “contaminate” the second. The perceived contamination may influence the individual’s way of interacting with the object. We aimed to produce a rich description of individual differences that predict intuitive judgments in response to scenarios involving activation of contagion heuristics. Adolescents and adults in Germany completed a survey and (...) provided rated responses to hypothetical scenarios. They also gave open-ended remarks on one scenario: whether they would wear a sweater that had belonged to Adolf Hitler if they were cold. Content analysis produced a composite description of reflections with insights into historical consciousness in contemporary Germany. Also examined was the extent to which quantitative responses were related to demographics, personality characteristics, supernatural beliefs, and responses to other scenarios. (shrink)

Candrakīrti is known for his commentaries on the major works of Nāgārjuna and Āryadeva. This chapter examines how Candrakīrti uses language and logic to undermine people's confidence in cherished beliefs about a self and point them towards the Buddha's path and its goal the peace of nirvana that transcends the limitations of language and logic. Candrakīrti first sets out his view on the two truths in the Madhyamakāvatāra. He associates both truths with the soteriological goal of Nāgārjuna's path: the peaceful (...) state of nirvana. Madhyamaka teaching amounts to nihilism. Candrakīrti responds that the charge of nihilism is wrong because there is no repudiation of moral actions. Emptiness is also related to the concept of intrinsic nature, and Candrakīrti uses this term in more than one sense. (shrink)

Thucydides' account of the Athenian general Phrynichus' secret correspondence with the Spartan admiral Astyochus is both troubling and obscure. It may be summarized as follows: Phrynichus, having eloquently opposed Alcibiades' efforts to be recalled from exile and fearing that a repatriated Alcibiades would take vengeance on him, wrote to Astyochus revealing Alcibiades' pro-Athenian activities. Astyochus handed the letter to Alcibiades, who then wrote to the ranking Athenians on Samos concerning Phrynichus' ‘treason’ and demanded his execution. Phrynichus then wrote again to (...) Astyochus, now proposing to make it possible for the Spartans to destroy the whole Athenian force at Samos. (shrink)

The essays by Hans Kellner, Wulf Kansteiner, and Robert Braun in the Forum, "Representing the Holocaust" attack historical realism as a legitimate form of such representation. Like any other part of narrative, "facts" do not speak for themselves in respect to the Holocaust or any other historical "event"; they are context-dependent and thus speak only in the voice of their interpreters. The symposiasts adopt this view on the assumption that an alternative to historical realism will yet reaffirm the primary data (...) of the Holocaust: the number of deaths, identities, places, dates. But I argue to the contrary: that ontologically there is but one alternative to historical realism, and that this alternative offers no ground even in principle for acknowledging a contradiction between an assertion and a denial that, for example, "On January 20th, l942, Nazi officials at Wannsee formulated a protocol for the 'Final Solution of the Jewish Question.'" Thus, at least in respect to items of chronicle, historical realism must be granted--unless one is ready to affirm, as the symposiasts apparently are not, a radical epistemic and moral skepticism. Theories of global justice range from the utilitarian philosophy of Peter Singer to the institutional design arguments of Thomas Pogge. These works have grappled with a wide range of issues, but almost all of them have been driven by the recognition of two core problems: the huge numbers of people mired in poverty and the increasing levels of inequality. Much of this literature begins with these two problems and then proposes schemes to resolve them. This problem-solving approach to the issue (...) of global poverty and inequality has tended to avoid engagements with figures in the history of political thought. One thinker who has certainly inspired much of this literature, either explicitly or implicitly, is Immanuel Kant. With his rigorous method, systemic structure of metaphysics and morality, and celebration of Enlightenment reason over staid authority structures, Kant presents a model for how to undertake rational arguments in response to moral dilemmas. Humans have evolved various social behaviors such as interpersonal motor synchrony, play and sport or religious ritual that bolster group cohesion and facilitate cooperation. While important for small communities, the face-to-face nature of such technologies makes them infeasible in large-scale societies where risky cooperation between anonymous individuals must be enforced through moral judgment and, ultimately, altruistic punishment. However, the unbiased applicability of group norms is often jeopardized by moral hypocrisy, i.e., the application of moral norms in favor of closer subgroup (...) members such as key socioeconomic partners and kin. We investigated whether social behaviors that facilitate close ties between people also promote moral hypocrisy that may hamper large-scale group functioning. We recruited 129 student subjects that either interacted with a confederate in the high synchrony or low synchrony conditions or performed movements alone. Subsequently, participants judged a moral transgression committed by the confederate toward another anonymous student. The results showed that highly synchronized participants judged the confederate’s transgression less harshly than the participants in the other two conditions and that this effect was mediated by the perception of group unity with the confederate. We argue that for synchrony to amplify group identity in large-scale societies, it needs to be properly integrated with morally compelling group symbols that accentuate the group’s overarching identity. Without such contextualization, synchrony may create bonded subgroups that amplify local preferences rather than impartial and wide application of moral norms. (shrink)

Rapid advancements in artificial intelligence and machine learning (AI/ML) in healthcare raise pressing questions about how much users should trust AI/ML systems, particularly for high stakes clinical decision-making. Ensuring that user trust is properly calibrated to a tool’s computational capacities and limitations has both practical and ethical implications, given that overtrust or undertrust can influence over-reliance or under-reliance on algorithmic tools, with significant implications for patient safety and health outcomes. It is, thus, important to better understand how variability in trust (...) criteria across stakeholders, settings, tools and use cases may influence approaches to using AI/ML tools in real settings. As part of a 5-year, multi-institutional Agency for Health Care Research and Quality-funded study, we identify trust criteria for a survival prediction algorithm intended to support clinical decision-making for left ventricular assist device therapy, using semistructured interviews (n=40) with patients and physicians, analysed via thematic analysis. Findings suggest that physicians and patients share similar empirical considerations for trust, which were primarilyepistemicin nature, focused on accuracy and validity of AI/ML estimates. Trust evaluations considered the nature, integrity and relevance of training data rather than the computational nature of algorithms themselves, suggesting a need to distinguish ‘source’ from ‘functional’ explainability. To a lesser extent, trust criteria were also relational (endorsement from others) and sometimes based on personal beliefs and experience. We discuss implications for promoting appropriate and responsible trust calibration for clinical decision-making use AI/ML. (shrink)

The self, self-awareness and emotions are central subjects within contemporary philosophy of mind but comparatively little attention has been paid to the relationships between them. This volume brings together philosophers from different specialisms to explore these relationships from three different angles. First, whether a theory of self-awareness can contribute to a theory of emotion, including how different aspects and kinds of self-awareness are related to different emotions. Chapter 15 of the Xunzi stands as the most comprehensive account of the early Confucian analysis of warfare. Unlike a range of other early, non-Confucian discussions on warfare, particular strategies and tactics are taken to be of secondary importance. Thus, Xunzi refuses to discuss practical military strategy without framing it within a much broader ethical, social, and political context. On his account, a well-ordered, flourishing state necessarily rests upon a particular set of rituals and social norms in which people can (...) cultivate themselves morally. Such a state has nothing to fear from any enemy, no matter how tactically sophisticated or militarily skilled. -/- To many, such a view seems overly. However, given that Xunzi is anything but Pollyannaish in other parts of the text and is quite pessimistic about human nature in general, it behooves us to dig a bit more deeply into his ideas about military affairs and examine whether they can be understood in a more plausible light. This article provides a reading of Xunzi’s views on military affairs that is internally consistent and corresponds with Xunzi’s broader ethical and political views, while also showing why someone of Xunzi’s obvious intellectual acumen might hold such a view. Background: The American Medical Association, the British Medical Association and the Canadian Medical Association have guidelines that specifically discourage physicians from self-prescribing or prescribing to family members, but only the BMA addresses informal prescription requests between colleagues. Objective: To examine the practices of paediatric providers regarding self-prescribing, curbsiding colleagues, and prescribing and refusing to prescribe to friends and family. Methods: 1086 paediatricians listed from the American Academy of Paediatrics 2007 web-based directory were surveyed. Results: 44% of eligible survey respondents returned (...) usable surveys. Almost half of respondents had prescribed for themselves. An equal number had informally requested a prescription from a colleague. Three-quarters stated they had been asked to prescribe a prescription drug for a first-degree or second-degree relative, and 51% had been asked by their spouse. Eighty-six per cent stated that they had refused to write a prescription on at least one occasion for a friend or family member. The following reasons “strongly influenced” their decision to refuse a prescription request: outside of provider’s expertise ; patient’s need for his or her own physician ; not medically indicated ; need for a physical examination. Conclusion: These data confirm that most physicians have engaged in self-prescribing or curbside requests for prescriptions. It can be argued that curbsiding is more morally problematic than self-prescribing because it implicates a third party, and should be discouraged regardless of whether the requester is a colleague, family member or friend. Luck, Value, and Commitment comprises eleven new essays which engage with, or take their point of departure from, the influential work in moral and political philosophy of Bernard Williams (1929-2003).

There is a wide array of contemporary arenas toward which the ideas of Han Fei may be directed. One of these is the arenas where Han Fei may potentially be of use is that of corporate and business ethics. Even if we disagree with Han Fei’s pessimistic assumptions about human dispositions and the plausibility of moral cultivation, we may find such a framework useful for analyzing how businesses, corporations, indeed any sort of bureaucracy can and should function. Milton Friedman was (...) of course famous for his claim that “there is one and only one social responsibility of business―to use its resources and engage in activities designed to increase its profits so long as it stays within the rules of the game.” On this account, businesses not only do, but should act in a fashion which bears stark similarities to how Han Fei believes that human dispositions lead them to act at the individual level. He then draws a range of conclusions from this, and it is worth exploring the extent to which these conclusions are useful as we determine how to analyze, evaluate, organize, and limit corporate behavior. In much of pre-Qin political philosophy, including those thinkers usually labeled Confucian, Daoist, or Mohist, at least part of the justification of the political state comes from their views on morality, and the vision of the good ruler was quite closely tied to the vision of the good person. In an important sense, for these thinkers, political philosophy is an exercise in applied ethics. Han Fei, however, offers an interesting break from this tradition, arguing that, given the vastly different goals (...) of moral theory and political theory, it would be disastrous to rely upon the former to undergird the latter. He develops a distinctly amoral political philosophy that avoids many of the problems he sees as arising from a reliance on particular virtues on the part of the ruler or others within the state. In this paper, I analyze the source of normativity in Han Fei’s political philosophy, arguing that he demonstrates a keen understanding of the problems inherent in any system that relies upon moral standards to develop a strong, stable, and prosperous state. Rather, he demonstrates how an understanding of human nature, along with a recognition of facts about the natural world, allows for the development of a non-moral political philosophy that relies on a systematic bureaucracy and an inviolate system of law, one which will be much more successful, he believes, than anything his competitors can construct.
