One of the most attractive, but nevertheless highly controversial proposals to alleviate the negative effects of today’s international patent regime is the Health Impact Fund (HIF). Although the HIF has been drafted to facilitate access to medicines and boost pharmaceutical research, we have analysed the burdens for the global poor a similar proposal designed to promote the use and development of climate-friendly technologies would have. Drawing parallels from the access to medicines debate, we suspect that an analogous “Climate Impact Fund” (...) will increase the already very high scientific and technological supremacy of the developed world over the Global South. We advocate countering this dominance on the ground that countries with scarce research and development capacities will be in a difficult position to reject technologies and will not have a say on how such technologies should look like. Further, addressing global hazards should be an inclusive endeavour and not only a privilege reserved for the developed world. Incentivizing grassroots innovation would be a major step to promote scientific and technological inclusion. (shrink)

Any system for the protection of intellectual property rights (IPRs) has three main kinds of distributive effects. It will determine or influence: (a) the types of objects that will be developed and for which IPRs will be sought; (b) the differential access various people will have to these objects; and (c) the distribution of the IPRs themselves among various actors. What this means to the area of pharmaceutical research is that many urgently needed medicines will not be developed at all, (...) that the existing medicines will not be suitable for countries with a precarious health infrastructure or not target the disease variety that is prevalent in poorer regions. Such effects are commonly captured under the rubric of the “10/90 gap” in biomedical research. High prices will also restrict access to medicines as well endanger compliance to treatment schemes. IPRs are mainly held by multinational corporations situated in the developed world, which not only raises egalitarian concerns, but also severely limits the possibilities of companies in poorer countries to realize improvements on existing inventions, as they cannot financially afford to secure freedom to operate, which systematically shrinks the number of potential innovators. Those inequities lead to an enormous burden for the global poor and since no institution is willing to assume the responsibility to fulfil the right to health and the corresponding right of access to essential medicines, we have to analyse alternatives or additions to the actual intellectual property regimes in order to create new incentives to fill this gap. Although these organizationsexplicitly denied having unassailable evidence on theharmful effects of pesticides, they claimed that bynow there are sufficient indications that pesticidesmay indeed lead to such health hazards. They used anappeal to the so-called precautionary principle tounderpin their claims. The committee officially incharge of deciding on the admission of pesticidesaccused the organizations (...) of scaremongering. Afterdistinguishing three possible versions of theprecautionary principle, we then show that the fourorganizations used in their campaign an improperversion of the precautionary principle to convince thegeneral public. A central question in constructivist studies of science is how the analyst should deal with the material objects handled by scientific practitioners in laboratories. Representatives of ‘radical constructivism’ such as Knorr-Cetina and Latour have gone furthest in exploring the role of these ‘non-humans’ but have also maneuvered themselves in untenable positions due to a fatal conflation of different meanings of the term ‘construction’. The epistemological and ontological commitments of ‘moderate constructivism’ especially of the Strong Program defended by Barnes and Bloor, (...) are more suitable for dealing with the task at hand. While radical constructivists treat the domains of nature and human society as largely coterminous, an alternative ontology stresses that natural reality is never fully absorbed into the world of culture but only interacts with the latter at localizable interfaces such as practices and artifacts. This perspective promises a more relaxed relationship with current forms of scientific realism. (shrink)

International negotiations on anthropogenic climate change are far from running smoothly. Opinions are deeply divided on what are the respective responsibilities of developed and developing countries with regard to the reduction of greenhouse gas emissions and the alleviation of the negative effects of global warming. A major bone of contention concerns the role of intellectual property rights (especially patents) in the development and diffusion of climate-friendly technologies. While developing countries consider IPRs as a formidable barrier to the rapid transfer and (...) the widest possible diffusion of such technologies, developed countries, by contrast, see IPRs as a vital prerequisite for the development and transfer of these same technologies. This debate shows some similarity with the earlier debate on patents and access to lifesaving medicines, although there are also important differences. In our contribution we will explore both the analogies and the differences with this earlier debate. To provide a focus for our discussion, we will examine whether something similar to the Health Impact Fund (HIF), which has been proposed by philosopher Thomas Pogge as a reasonable solution to the ethical dilemmas of protection and accessibility in the field of pharmaceuticals, can also be elaborated for the development and diffusion of climate-friendly technologies. Thus the central question is how an analogous ‘Climate Impact Fund’ would look like and how it would work. This whole exercise will also yield a normative yardstick for assessing the various designs for a Green Climate Fund or a Technology Mechanism that are currently on the table of the international climate negotiations. De kern van dit proces was de privatisering van de meent of commons, de traditioneel voor gemeenschappelijk gebruik bestemde grond.

The emergent new science of synthetic biology is challenging entrenched distinctions between, amongst others, life and non-life, the natural and the artificial, the evolved and the designed, and even the material and the informational. Whenever such culturally sanctioned boundaries are breached, researchers are inevitably accused of playing God or treading in Frankenstein’s footsteps. Bioethicists, theologians and editors of scientific journals feel obliged to provide an authoritative answer to the ambiguous question of the ‘meaning’ of life, both as a scientific definition (...) and as an explication with wider existential connotations. This article analyses the arguments mooted in the emerging societal debates on synthetic biology and the way its practitioners respond to criticism, mostly by assuming a defiant posture or professing humility. It explores the relationship between the ‘playing God’ theme and the Frankenstein motif and examines the doctrinal status of the ‘playing God’ argument. One particularly interesting finding is that liberal theologians generally deny the religious character of the ‘playing God’ argument—a response which fits in with the curious fact that this argument is used mainly by secular organizations. Synthetic biology, it is therefore maintained, does not offend so much the God of the Bible as a deified Nature. While syntheses of artificial life forms cause some vague uneasiness that life may lose its special meaning, most concerns turn out to be narrowly anthropocentric. As long as synthetic biology creates only new microbial life and does not directly affect human life, it will in all likelihood be considered acceptable. (shrink)

In 1905 two different microbes were proposed to fill the vacant role of etiologic agent for syphilis, one, the Cytorrhyctes luis, by John Siegel, the other, Spirochaeta pallida, by Fritz Schaudinn. After gathering and reviewing the evidence the majority of medical scientists decided in favor of Schaudinn’s candidate. In a previous issue Jean Lindenmann challenged Ludwik Fleck’s suggestion that under suitable social conditions Siegel’s candidate could just as well have won acceptance by the scientific community . To refute this counterfactual (...) thesis, Lindenmann presented an asymmetric account of the dispute over the etiology of syphilis. He adopted the view of the proponents that Schaudinn’s spirochete had already been there in syphilitic lesions for centuries, only awaiting the discovery of an appropriate staining technique to be revealed. Here a more symmetric analysis of the episode will be attempted, paying serious attention to the arguments put forward by the spirochete’s opponents, who expatiated on the many possibilities of inadvertently creating artifacts through microscopic preparation and staining. The symmetric account that is presented in this rejoinder thus aims to trace the simultaneous construction of facts and artifacts. It will not, however, resurrect Fleck’s counterfactual thesis. So-called climate-ready GM crops can be of great help in adapting to a changing climate. Climate change, caused in great part by anthropogenic greenhouse gases released in the atmosphere since the industrial revolution by the developed world, is felt much stronger in the developing world, causing unexpected droughts and floods that will cause large harvest loss, leading to more hunger and malnutrition, rising death tolls and disease vulnerability. The current intellectual property regime (IPR) strikes an unfair balance between profit oriented (...) seed industry giants and low-acreage farmers. The biotechnology industry, mainly headquartered in the developed world, has started to patent new seed varieties, taking biomaterials from developing countries, with the claim, that they will be more tolerant to flood, drought, heat, and cold. Special sales contracts prohibit saving seeds from the harvest for the next season, thus forcing the farmers to buy them every season anew, which goes against traditional farming. Using a widely accepted concept of global justice, that tackles the fact that around 10% of the world's population profits from 90% of the earth's resources, and by taking into account the feasibility of a fair IPR, we will discuss three issues. First, an ethically acceptable IPR should prevent unjust and unfair assignments of property rights (e.g. patents) that completely ignore small-scale farmers inventiveness and efforts to save agrobiodiversity. As a second task, this regime should encourage globally a just distribution of the objects of innovation that are covered by patents. Third, such a regime should encourage innovations at a rate that is effective to cope with climate change. (shrink)

Ludwik Fleck is widely recognized as a precursor of Science and Technology Studies, but his case study on the development of the Wassermann reaction as a test for detecting syphilis has never been subjected to detailed empirical scrutiny. The fact that Fleck?s monograph is based on a limited set of documentary sources makes his work vulnerable to uncharitable critics. The problematic relation between thought collective and individual scientists in Fleck?s theoretical approach is another reason for a systematic re-examination of his (...) case study, using materials on the early period in the history of the Wassermann reaction (1906?1912). My re-examination highlights several problems in Fleck?s account: a misinterpretation of the switch from antigen detection to antibody detection; a neglect of the ?clinical connection?; an overemphasis on the importance of collective experience leading to implausible views on gross retrospective distortions supposedly inflicted by this experience upon the memories of individual participants; and, finally, a misjudgement of the significance of the acrimonious dispute over the intellectual ownership of the Wassermann reaction. What remains unscathed is Fleck?s picture of a zig-zag course of development from false initial assumptions via detours and cul-de-sacs to a clinically usable test in the end. (shrink)

With the turning of wilderness areas into wildlife parks and the returning of developed areas of land to the forces of nature, intermediate hybrid realms surface in which wild and managed nature become increasingly entangled. A partitioning of environmental philosophy into ecoethics and animal welfare ethics leaves these mixed territories relatively uncharted—the first dealing with wild (animals), the second with the welfare of captive or domestic animals. In this article, we explore an environmental philosophy that considers explicitly these mixed situations. (...) We examine a recent Dutch policy of introducing domesticated and semi-wild large herbivores in newly developed nature areas. Larger issues are at stake, such as the intertwinement of nature and culture, the dynamic character of de-domestication processes, and the relation between concepts of authenticity and the wild. We sketch a pluralistic, dynamic, and pragmatic environmental philosophy that is capable of dealing with the complicated ethicalproblems concerning creatures and land caught between domestication and the wild. Opponents of biotechnology ofteninvoke the Precautionary Principle to advancetheir cause, whereas biotech enthusiasts preferto appeal to ``sound science.'' Publicauthorities are still groping for a usefuldefinition. A crucial issue in this debate isthe distribution of the burden of proof amongthe parties favoring and opposing certaintechnological developments. Indeed, the debateon the significance and scope of thePrecautionary Principle can be fruitfullyre-framed as a debate on the proper division ofburdens of proof. In this article, we attemptto arrive at a more refined way of thinkingabout (...) this problem in order to escape from theexisting polarization of views between ``guiltyuntil proven innocent'' and ``innocent untilproven guilty.'' This way of thinking alsoenables a critical review of currentdemarcations between risk assessment and riskmanagement, or science and politics, and of themorally laden controversy on the relativeimportance of type-I and type-II errors instatistical testing. Due to the rise of functional foods,the distinction between foods and medicines hasbecome increasingly blurred. A new EUregulation covering health claims and otherclaims on food and drink products is on thedocks. A basic motive of legal regulation oflabeling and advertising is to inform andprotect the consumer. Promotion of informedchoice and consumer protection may, however, beconflicting objectives. A further problemsprings from the fact that choice, likeconsent, is a propositional attitude andtherefore opaque. Thus it is extremelydifficult for regulators to fasten onparticular formulations (...) of claims. Despite theprofessed respect for the autonomy of theconsumer, paternalism is never far away andeasily enters in various guises. (shrink)

Van den Belt recently examined the notion that synthetic biology and the creation of ‘artificial’ organisms are examples of scientists ‘playing God’. Here I respond to some of the issues he raises, including some of his comments on my previous discussions of the value of the term ‘life’ as a scientific concept.

There is a long-standing tradition of questioning the viability and scientificity of first-person methods. Husserlian reflective methodology, in particular, has been challenged on the basis of its perceived inability to meet the standards of objectivity and reliability, leading to what has been called “phenomenological skepticism” ( Roy, 2007 ). In this article, I reassess this line of objection by outlining Daniel C. Dennett’s empirically driven skepticism and reconstructing his methodological arguments against Husserlian phenomenology. His ensuing phenomenological skepticism is divided into (...) strong skepticism and categorical and gradual versions of weak skepticism. Both strands of Dennett’s criticism are then countered by analyzing the key components of Husserl’s method of phenomenological reflection: epoché and transcendental reduction, intentional analysis, eidetic variation, and intersubjective validation. Laying out the basic features of phenomenological reflection serves two purposes. First, it undermines Dennett’s methodological arguments, which are based on the unfounded assumptions that Husserl is committed to introspection, methodological solipsism, the first-person-plural presumption, and the lone-wolf approach. Second, it shows how Husserl’s own methodology can alleviate the more justified empirical worries concerning overinterpretation, underdescription, and disagreement. Finally, I argue that gradual weak skepticism is the only plausible form of phenomenological skepticism and conclude that Husserlian methodology is well-equipped to combat it. (shrink)

The articles by Henk Bodewitz collected in this volume, published between 1969 and 2013, deal with Vedic cosmology and ethics on basis of a systematic philological study of early Vedic texts, from the Ṛgveda to various Brāhmaṇas, Āraṇyakas and Upaniṣads.

Three experiments examined whether the mere priming of potential action effects enhances people’s feeling of causing these effects when they occur. In a computer task, participants and the computer independently moved a rapidly moving square on a display. Participants had to press a key, thereby stopping the movement. However, the participant or the computer could have caused the square to stop on the observed position, and accordingly, the stopped position of the square could be conceived of as the potential effect (...) resulting from participants’ action of pressing the stop key. The location of this position was primed or not just before participants had to stop the movement. Results showed that priming of the position enhanced experienced authorship of stopping the square. Additional experimentation demonstrated that this priming of agency was not mediated by the goal or intention to produce the effect. (shrink)

In November 2010, the Library of the Peace Palace in The Hague acquired a copy of Hugo Grotius’s seminal study on the law of war, De iure belli ac pacis (Paris: Nicolas Buon, 1625). The purchase represents the very rare first state (issue or printing) of the first edition, item no. 565-I in the well-known bibliography of Grotius’s works by Jacob Ter Meulen and P.J.J. Diermanse. This article is an adapted version of a speech held in the Peace Palace on (...) 21 February 2011, when the copy of De iure belli ac pacis was presented to the public. After a short survey of the genesis, printing history and early reception, the article goes into the differences between the three states of the first edition and their significance for the interpretation of Grotius’s work. A provisional checklist of copies in public libraries is added in an appendix. (shrink)

The sixteenth-century Dutch spiritualist and controversialist, Dirck Volckertszoon Coornhert (1522-1590), is increasingly recognized as a pivotal figure in the cultural and political life of the early Dutch Republic. With the appearance of Henk Bonger's widely acclaimed biography (1978), the first complete account of Coornhert's life became available in the Dutch language. Today this biography is still the starting point of any serious research on Coornhert and his circle. This translation now makes this standard biography available in English for the (...) first time. The translator profited from Henk Bonger's comments on the translated chapters, and the author approved of adaptations and changes where these were deemed necessary. The structure and most of the chapters of the book are as they were in the original. The chief changes are: the abridgment and combination into one chapter of the two original chapters on Coornhert's creative work and his translations. The ample quotes from Coornhert contained in the text enable the reader to attain a first hand acquaintance with Coornhert's profound thought and inimitable style. References have been updated and some explanatory remarks intended for a non-Dutch readership were added. The translation is complemented with a full bibliography of Coornhert's writings, as well as an up-to-date bibliography of the secondary literature; with 25 illustrations. (shrink)

When viewing a circular coin rotated in depth, it fills an elliptical region of the distal scene. For some, this appears to generate a two-fold experience, in which one sees the coin as simultaneously circular (in light of its 3D shape) and elliptical (in light of its 2D ‘perspectival shape’ or ‘p-shape’). An energetic philosophical debate asks whether the latter p-shapes are genuinely presented in perceptual experience (as ‘perspectivalists’ argue) or if, instead, this appearance is somehow derived or inferred from (...) experience (as ‘anti-perspectivalists’ argue). This debate, however, has largely turned on introspection. In a recent study, Morales, Bax, and Firestone (2020) aim to provide the first empirical test of this question. They asked subjects to find an elliptical coin seen face-on from a search array that also included a circular coin seen either face-on or at an angle. They found that subjects reacted more slowly when the distracting circle was seen at an angle, such that it’s p-shape matched that of the target ellipse. From this, they concluded that the similar p-shape between the ellipse and circle constituted a phenomenal similarity between the two, and thus that perspectivalism is true. We show that these results can also be explained by pre-attentive guidance by unconscious representations (in what follows, just “unconscious pre-attentive guidance”) and that this explanation is at least as plausible as one from phenomenal similarity. Thus, we conclude that the experiment does not support perspectivalism over anti-perspectivalism. (shrink)

In his contribution to this special issue, Michael Northcott argues that there is a historic association between Protestant cultures and the origins of environmentalism. It seems to me, however, that the connection between Protestantism and environmentalism is more complicated and ambivalent than the positive relation he highlights. In this paper, I will problematize that relation on the basis of various theoretical and empirical contributions in the literature on religion and environmentalism. Different positions in this regard within Protestantism will be identified (...) and related to theological positions and the historic impact of Protestantism on culture. In the final section, the impact of environmental degradation on the (global) poor will be highlighted, which leads to the identification of a tension between an orthodox/evangelical Protestant stance towards the poor and towards the environment. Global society is facing formidable current and future problems that threaten the prospects for justice and peace, sustainability, and the well-being of humanity both now and in the future. Many of these problems are related to science and technology and to how they function in the world. If the social responsibility of scientists and engineers implies a duty to safeguard or promote a peaceful, just and sustainable world society, then science and engineering education should empower students to fulfil this responsibility. (...) The contributions to this special issue present European examples of teaching social responsibility to students in science and engineering, and provide examples and discussion of how this teaching can be promoted, and of obstacles that are encountered. Speaking generally, education aimed at preparing future scientists and engineers for social responsibility is presently very limited and seemingly insufficient in view of the enormous ethical and social problems that are associated with current science and technology. Although many social, political and professional organisations have expressed the need for the provision of teaching for social responsibility, important and persistent barriers stand in the way of its sustained development. What is needed are both bottom-up teaching initiatives from individuals or groups of academic teachers, and top-down support to secure appropriate embedding in the university. Often the latter is lacking or inadequate. Educational policies at the national or international level, such as the Bologna agreements in Europe, can be an opportunity for introducing teaching for social responsibility. However, frequently no or only limited positive effect of such policies can be discerned. Existing accreditation and evaluation mechanisms do not guarantee appropriate attention to teaching for social responsibility, because, in their current form, they provide no guarantee that the curricula pay sufficient attention to teaching goals that are desirable for society as a whole. In this paper we have two aims: first, to draw attention to the close connexion between interpretation and scientific understanding; second, to give a detailed account of how theories without a spacetime can be interpreted, and so of how they can be understood. In order to do so, we of course need an account of what is meant by a theory ‘without a spacetime’: which we also provide in this paper. We describe three tools, used by physicists, aimed at constructing (...) interpretations which are adequate for the goal of understanding. We analyse examples from high-energy physics illustrating how physicists use these tools to construct interpretations and thereby attain understanding. The examples are: the ’t Hooft approximation of gauge theories, random matrix models, causal sets, loop quantum gravity, and group field theory. (shrink)

In the context of his theory of numberings, Ershov showed that Kleene's recursion theorem holds for any precomplete numbering. We discuss various generalizations of this result. Among other things, we show that Arslanov's completeness criterion also holds for every precomplete numbering, and we discuss the relation with Visser's ADN theorem, as well as the uniformity or nonuniformity of the various fixed point theorems. Finally, we base numberings on partial combinatory algebras and prove a generalization of Ershov's theorem in this context.

Analyse van het denken van de Franse filosoof (1926-1984).

Žižek’s intellectual endeavor aims at relocating political subjectivity as the foundation of communal life. As a Leninist he anchors the possibility of a revolution in Heidegger’s ‘decisionism’ and in the practice of St Paul,whose conversion is the bottom line of a revolutionary attitude. Current consumerism avoids this subject and in that sense a-voids or empties subjectivity. The revolutionary subject is the very act of affirmatively a-voiding one's current ethical system in order to radically change the coordinates of the system.

In this paper I present my reflections on the ethics of science as described by Merton and as actually practiced by scientists and technologists. This ethics was the subject of Kuipers' paper "'Default norms' in Research Ethics" (Kuipers 2001). There is an implicit assumption in this ethics, notably in Merton's norm of communism, that knowledge is always, or unconditionally good, and hence that scientific research, and the dissemination of its results, is unconditionally good. I will give here reasons why scientists (...) are not permitted to proceed, as they actually do, on the basis of this assumption. There is no factual or other binding justification for this assumption, and the activities it gives rise to frequently conflict with the broadly accepted ethical principle of restricted liberty. A recent discussion on the risks and hazards of science and on the issue of relinquishment is presented. What is shown in this paper is that the scientists and technologists participating in this discussion frequently violate core values of science relating to logical and empirical scrutiny and systematic criticism, as mentioned in Merton's norms of universalism, organized skepticism, and disinterestedness. It is concluded that, in order to live up to these values and in order to operate in agreement with broader ethical principles, science should stimulate open and critical discussion on the hazards and negative effects of science and technology, and on the present failure on the part of law and politics to control those hazards and negative effects. Science should also take the possibility of relinquishing certain themes of research seriously as long as such flaws in the systems of law and political decision-making persist. (shrink)

We present the genesis of this theory and its two major areas of application: the representation of computations and the resulting functional programming languages on the one hand and the representation of reasoning and the resulting systems of computer mathematics on the other hand.

One of the career options Ede Christian University for higher professional education offers is nursing. As a Christian professional school, the ECU provides learning environments for nursing students to become professionals who are to exhibit a Christian life style, values and professional ethics. Nursing graduates of our school in general may have a Christian disposition regarding major issues in health care like displaying respect for patients, having a correct attitude, practising informed consent, displaying confidentiality, and avoiding euthanasia etc. A worrying (...) development for educators, though, is that often within a year after their graduation these young nursing professionals may adopt the secularized behaviour predominant in their workplace, even when that behaviour in some respects contrasts with the values they internalized during their nursing education. . Apparently, the shaping force of the social context of a professional practice can be stronger than the personal beliefs young professionals adopt before their graduation. (shrink)
