”Wrongful birth” und ”wrongful life”. Probleme der rechtlichen Bewältigung ärztlicher Pflichtverletzung bei der menschlichen Reproduktion.Bernhard Losch & Wiltrud Christine Radau - 2000 - Ethik in der Medizin 12 (1):30-43.
Definition of the problem: The medical progress made in human reproduction and prenatal diagnosis is having an increasing effect on the responsibility of doctors concerning reproduction and birth. A faulty diagnosis or professional error is causing lawyers to be confronted with difficulties in which ethical views are involved. It is becoming clear that there will be difficulties if the courts have to rule on the question whether the doctor is under an obligation to pay maintenance following the birth of an (...)

The subject of “We intend”.Hans Bernhard Schmid - 2018 - Phenomenology and the Cognitive Sciences 17 (2):231-243.
This paper examines and compares the ways in which intentions of the singular kind and the plural kind are subjective. Are intentions of the plural kind ours in the same way intentions of the singular kind are mine? Starting with the singular case, it is argued that “I intend” is subjective in virtue of self-knowledge. Self-knowledge is special in that it is self-identifying, self-validating, self-committing, and self-authorizing. Moving to the plural form, it is argued that in spite of apparent differences, (...)

From the Alien to the Other: Steps toward a Phenomenological Theory of Spirit Possession.Bernhard Leistle - 2014 - Anthropology of Consciousness 25 (1):53-90.
In this article, I apply a structural-phenomenological conception of experience and self to the anthropological theorizing of spirit possession. In particular, I argue that a phenomenology of the alien, as elaborated by the philosopher Bernhard Waldenfels, allows for a more differentiated understanding of possession phenomena. Following a characterization of alienness—in conceptual distinction from the more common term “otherness”—as a dimension that necessarily eludes experience, I describe spirit possession as a cultural technology to appropriate the experiential alien by transforming it (...)

Beyond self-goal choice: Amartya Sen's analysis of the structure of commitment and the role of shared desires.Hans Bernhard Schmid - 2005 - Economics and Philosophy 21 (1):51-63.
In the current debate on economic rationality, Amartya Sen's analysis of the structure of commitment plays a uniquely important role . However, Sen is not alone in pitting committed action against the standard model of rational behavior. Before turning to Sen's analysis in section 2 of this paper, I shall start with an observation concerning some of the other relevant accounts.

Belief Revision Normalized.Jeremy Goodman & Bernhard Salow - forthcoming - Journal of Philosophical Logic:1-49.
We use the normality framework of Goodman and Salow (2018, 2021, 2023b) to investigate of dynamics of rational belief. The guiding idea is that people are entitled to believe that their circumstances aren’t especially abnormal. More precisely, a rational agent’s beliefs rule out all and only those possibilities that are either (i) ruled out by their evidence or (ii) sufficiently less normal than some other possibility not ruled out by their evidence. Working within this framework, we argue that the logic (...)

  14. The Equating of the Unequal.Bernhard Waldenfels & John Krummel - 2015 - Social Imaginaries 1 (2):92-102.
This is an English translation of Waldenfels' German essay: Equality and inequality are basic elements of law, justice and politics. Equality integrates each of us into a common sphere by distributing rights, duties and chances among us. Equality turns into mere indifference as far as we get overintegrated into social orders. When differences are fading away experience loses its relief and individuals lose their face. Our critical reflections start from the inevitable paradox of making equal what is not equal. In (...)

  41. Philosophical egoism: Its nature and limitations.Hans Bernhard Schmid - 2010 - Economics and Philosophy 26 (2):217-240.
Egoism and altruism are unequal contenders in the explanation of human behaviour. While egoism tends to be viewed as natural and unproblematic, altruism has always been treated with suspicion, and it has often been argued that apparent cases of altruistic behaviour might really just be some special form of egoism. The reason for this is that egoism fits into our usual theoretical views of human behaviour in a way that altruism does not. This is true on the biological level, where (...)

Das Böse an Augustinus’ Birnendiebstahl.Hans Bernhard Schmid - 2019 - Deutsche Zeitschrift für Philosophie 67 (4):517-538.
In the second book of theConfessions, Augustine flabbergasts his interpreters by exaggerating an adolescent escapade (a pear theft) and making it a monstrosity. He conjectures that the pear thieves might have commited the theft purely for the sake of thieving, and thus, that they displayed a kind of evil that is not even presented by the arch-villain of Ciceronian antiquity, the conspirer Catilina. Following Aquinas’ interpretation this comparison has been considered a reductio in most of the relevant literature up to (...)
