In the decade since Al-Qaeda, led by the late Osama Bin Laden, attacked America, there has been a resurgence in the debate about the relationship between religion and politics. The global Islamic terrorist networks and their successful operations against various targets around the globe increasingly draw attention to what constitutes the core values of Islamic extremism: the logic of evangelistic strategy, the import and relevance of its spiritual message and consideration of the composite view of life that does not distinguish (...) between sacred and temporal mandates. Suspicions have been fuelled that Islam is incompatible with modern democratic systems and pluralist outlooks. The real cause of Islamic militancy is at once universal and particular. The Nigerian experience of this radical Islamism-Boko Haram-brings home the once “distant” threat to global peaceful co-existence. While there exist arguments regarding the raison d’etre and means or methods of the operations of Boko Haram, the end has been normative; to achieve a purely religious nationalistic system on the basis of the sharia code of ethics. This paper, therefore, critically analyses the historical and philosophical interpretations of Islamic history constructed as an infallible corpus, and how it has been impacted by the democratic vision in Nigeria. Studies on terrorism with bias towards Boko Haram have mainly been carried out from non-linguistic fields. The few linguistics-related studies that have examined the media reportage of the BH activities, with emphasis on the discourse and linguistic strategies deployed in the representations, have not been sufficient. This study, therefore, identifies the linguistic and discourse strategies deployed by selected newspapers in representing the BH and other social actors. For data, headline and overline stories are purposively sampled from four newspapers, (...) published from 2011 to 2014, from the northern and southern parts of Nigeria. The analysis is guided by a combination of critical discourse analysis and systemic functional linguistics. In all the reports subjected to analysis, 13 representational strategies were identified, while at least 15 tools from Van Leeuwen’s categorisations were used in representing social actors. The newspapers also deployed discourse strategies to manage the voices of social actors, identify and specify the social actors and action, label, condemn BH activities, among others. This paper examines self-legitimation in selected speeches of Abubakar Shekau, the longest-serving leader of Boko Haram terrorists (BHT). The article analyses seven of the speeches Shekau delivered during his reign as the BHT leader between 2009 and 2021, using f4analyse as a coding tool and Theo van Leeuwen’s (2008. Discourse and practice: New tools for critical discourse analysis) Discourse Legitimation approach to discourse analysis. The analysis discloses that Shekau uses three legitimation strategies: authorisation, moralisation and rationalisation to justify (...) the actions and practices of BHT. The three legitimation strategies are linguistically realised through positive self-presentation strategy by engaging in self-glorification, personalising and collectivising victory, and claiming and announcing success to legitimate the mission of the group in carrying out the struggle. Violent conflicts in emerging democracies or societies in transition threaten the stability of state governance institutions, which brings about insecurity of lives, property and deepens the vicious cycle of poverty and criminality in Africa. The first responsibility of any government is to provide security of lives and property. At no time since Nigeria’s civil war has the country witnessed the resurgence of violence and insecurity that claims hundreds of lives weekly. It is a sectarian insurgence of multiple dimensions. This article (...) makes the case that Boko Haram is not just a religious phenomenon but a reflection of a so- cio-political, economic and ethnic problem caused by bad governance. As a result, Boko Haram has witnessed a cross-border influence and impact which has expanded its frontiers beyondNigeriato neighboring countries in the West African region. The theoretical framework employed in this article posits that Boko Haram has its roots fundamentally in poverty caused by bad governance in the Northern Moslem bend, in Nigeria and the West African Region where corruption, human rights violations, marginalization of cultural, political and religious groups have created the situation whereby weak state structures have abysmally failed to deliver on the development promises made during elections. So the emergence of Nigeria’s Boko Haram violence, as a result of the street poverty and the rise of unemployed street beggars, popularly known as Almajiris, and their use for electoral and party violence, was encouraged by the neglect and abandonment of the masses by the governors and other elected leaders. The expansion and consolidation of the Boko Haram insurgence to other parts of the country and neighboring West African nations was made possible by the already existing failed state institutions, bad governance and corruption and the existing band of small criminal sectarian groups that depend upon their survival on aids from Al Quaeda, drug gangs and sea piracy. The religious dimension is a marginal factor fueled by fundamental socio-economic and political variables which have been thrown up in the first place by bad governance and leadership in Nigeria. The challenge of orphans and vulnerable children has become central to the response of many organisations today. The number of OVC throughout northern Nigeria is growing as a result of the Boko Haram pandemic. Mostly, this is caused by the death of parents who have been killed by the insurgents. It has been estimated that by 2015, 200 000 children under the age of 18 had been orphaned by the Boko Haram insurgents. As the number of (...) OVC is growing, it is becoming more and more difficult for their communities to address all their needs, including their need for positive role models and mentors. This article discusses the role that mentoring can play in the development of OVC affected by violence in northern Nigeria, specifically those in internally displaced person camps. This article argued that one approach to improve the holistic care of OVC in IDP camps in northern Nigeria is through the use of mentors. (shrink)

Historical analysis confirms the home-grown character of Nigeria’s conflicts and the complexity of their peaceful resolution. Religious leaders have traditionally contested political space with other actors and continue to do so. But the religiosity of popular culture is such that Nigerian religious leaders can make a substantive contribution to peace building and countering religious extremism if given the time, space and tools to do so. Elections have been critical moments in the evolution of religious tensions and conflicts owing to the (...) country’s geographical demographic and history, and the popular hope of correcting injustice that they evoke. There is a need to distinguish between genuine religious conflicts and conflicts that are essentially socio-economic or about competition for political power which become “religionised.” The evolution of the terrorist organisation, Boko Haram, can be traced back to intra-Muslim conflicts and anti-Sufi movements. But it reflects no less the underdevelopment and poverty of the Northeast and the impact of corruption on the perception of state and national government. The crude and violent narrative of Abubakar Shekau, its leader, shows a deterioration beyond that of its founder Malam Yusuf, who was able to offer financial and economic inducements over and above a rejection of most aspects of modernity and Western education. Increasingly, efforts are being made by religious leaders at both national, and local levels through formal, and grassroots networks to build better understanding and awareness between faiths to change and challenge narratives. With the appropriate support, these networks have great potential for improving communal relations and overcoming Boko Haram’s narratives of hate. (shrink)

The afterlife has been imagined in a diversity of ways, one of which is as a vehicle for vengeance. Upon outlining, via the figures of Tertullian and Sayyid Qutb, a vengeful formulation of afterlife belief, this essay examines Friedrich Nietzsche’s critique of such a belief. The belief is framed as an expression of impotence insofar as believers imagine in the beyond what they cannot achieve in the present, namely, taking vengeance upon their enemies. Nietzsche’s critique leads to the essay’s central (...) question. Is a vengeance-based formulation of afterlife belief an expression of impotence? To respond, this essay will analyze the practices and rhetoric of the Islamic fundamentalist group Boko Haram, while also briefly mentioning Al Qaeda and ISIS. As a result of the analysis, a simplistic and unqualified form of the impotence critique is to be rejected. Nonetheless, the critique remains relevant. Boko Haram’s lack of emphasis on afterlife belief in general and its omission of a vengeance-based formulation in particular highlights the possibility that a radical religious group’s approach to the afterlife is related to the group’s relative strength or weakness. Such a possibility carries practical ramifications when assessing the scope of that group’s aims and its willingness to act. (shrink)

BackgroundEthics in biomedical research is still a fairly new concept in Africa. This work aims to assess the knowledge, attitude and experiences of Beninese researchers with regard to the national ethical regulatory framework of biomedical research in Benin.MethodsThis was a cross-sectional and descriptive study, involving all the researchers fulfilling the inclusion criteria. Data were collected through a face-to-face interview using a questionnaire and analysed. Proportions and means were calculated with their confidence intervals and standard deviations, respectively.ResultsOf the 110 participants included (...) in the study, 40.9% were medical lecturers and 71.1% had been involved in more than 10 biomedical research as researcher. Less than three quarters were able to correctly quote the basic principles from Belmont report. The quarter of them knew the attributions of the National Ethics Committee for Health Research and 38.2%, the content of the legislation on health research ethics in Benin. The common ethical rules were known by 69.1% of the participants. A quarter of participants said they always present the study’s briefing note to their study participants and 62.7% said they systematically request informed consent. For those who do not present the briefing note to participants, the main reasons provided were the researchers’ difficulties in writing the note in plain language and the participants’ limitation in understanding it.ConclusionsThe foundations of a good ethical framework for health research exist in Benin. This article examines John Locke’s theory of subjectivity to challenge the recent critical tendency to associate biopolitics and empiricism. Michel Foucault, most notably among modern theorists of biopolitics, proposes that the Lockean man, or an interest-seeking animal, constitutes the paradigm of a person that remains subject to biopower. Such understanding of empiricism by biopolitical theorists is, however, reductive because Locke’s view of human subjectivity is fundamentally equivocal. As I demonstrate by analyzing his discussion of freedom, action, and desire in An (...) Essay Concerning Human Understanding and other writings, Locke admits the possibility for a human being to think and to act freely, although in the process of restricting the capacity for free action. Hence, the theorists’ simplistic view of Locke rather reflects the limits of their own conception of subjectivity, especially their behavioristic premises. As they consider a person as a mere machine of survival without agency and initiative, they preclude the possibility of overcoming biopower at the fundamental level. In demonstrating contradictions and tensions within Locke’s empiricism, this article then proposes the ways in which Locke can show a way beyond the critical impasse in political theory in elucidating the power of acting against the chain of causality. This article examines Dipesh Chakrabarty’s ecological theory to explore inherent tensions, ambiguities, and contradictions concerning human agency in Anthropocene discourse. Contra most commentators, I argue that Chakrabarty’s account of the Anthropocene remains neither modernistic nor posthumanistic per se because his view of the human turns out to be consistently inconsistent. Chakrabarty apparently advances an anti-anthropocentric and posthumanist explanation of the climate crisis by shifting his focus from the ‘species’ to the ‘planet’. However, his account of the planet remains within the (...) modernistic paradigm that privileges progress, rationality, and human agency because he tacitly embraces the narrative of enlightenment, or transition from ignorance to knowledge, when describing a passage from the global to the planetary. Chakrabarty’s narrative of enlightenment thus epitomizes the remains of anthropocentrism in Anthropocene discourse, registering the extent to which it retains beliefs in human agency, rationality, and singularity. Nowadays, some of the things that are ḥarāmto be consumed, such as lard, its derivatives and alcohol are used as additives or additional nutrients in products, namely food and cosmetics that people use widely in daily life. The provision of these products, which are accepted as najis(impure), stands in front of us as one of the actual fiqh problems. In order to produce an accurate solution in this regard, the reaction condition and the level of dissolution in the product must (...) be determined. In this article, the level of mutanajjis (contamination) of the products that najisthings transforms through istihlāk(physical change) and the provision (hukm) of benefits from such things are examined. The research covers the discussions in the classical period regarding the provision of things, which included najāsah(impurity) and underwent physical change as well as the evaluations of contemporary Islamic jurists. The aim of this study is to contribute to the researches, which will be carried out to determine the provision of products containing ḥarāmelements. As the production is carried out on an industrial scale, such studies are important today in terms of the establishment of “ḥalāl” sensitivity and meeting the needs of people who have this sensitivity to learn the provision of such products.SummaryNowadays, in various sectors, especially food, feed, cosmetics, health and clothing industries, for the purposes of reducing the cost of the product, extending the shelf life, making the product more attractive in terms of color, consistency and aroma, many substances are added to the main material. The fact that some of the substances added are ḥarām(forbidden) such as blood, lard, pest, and ethyl alcohol require the subject to be considered in terms of fiqh. It is important to clarify two issues in order to reach a healthy result in the studies aiming to determine the provision (ḥukm) of the products that are mixed with najis(impure) substance. One of them is the determination of the level of istihlāk(physical change) in the mutanajjis(contamination) things. The second is the determination of the basic principles to be used in determining the provision of the things which najāsahhas undergone the physical change in. In this study conducted within the scope of this purpose and method, the hadīthsrelated to two different issues that are directly related to the subject have been evaluated as the basic textual basis. These are narrations about the cleanliness and pollution status of the contaminated water, and about the availability of fats and oils, which the dead mouse is seen in. It is stated in the narrations about the condition of the water that najāsah involved in, the water will not be najisunless its smell, taste or color changes because of the falling najāsahin it. According to this hadith, which shows the change of description as a measure, the fuqahāʾ(jurists) came to a consensus on the fact that water, which one of its characteristics changed because of najāsahwould be considered mutanajjis. When thishadithis evaluated together with the narrations that indicate the small amount of water is contaminated because of najāsah, in fact, it is seen that while the water is considered to be clean-najis, the situation of the water being affected from najāsahis taken as the basis and aimed to protect human health against the dirty water. At the time when there were not any one of today's microbiological analysis laboratories, the way to understand the pollution status of water was to see if the smell, color and taste of the water changed while taking the amount of the water into account. Since the rate of foreign matter in the water, the level of pollution and the health status of the water can be determined correctly in the laboratory today, operating the modern techniques as well as the measure of qualification change will be appropriate for the purpose of the hadīthsmentioned.In the narrations about the state of the fat, which the dead mouse is found in, it is seen that different operations are requested depending on the fat being solid or liquid. If the fat is liquid, different instructions have been made such as its being poured or used in lighting. Mālikīs, Shāfiʿīs, and Ḥanbalīfaqīhs (jurists) of the first period have ruled that liquids such as vinegar, milk and honey are mutanajjis, whether they are in little quantity or not, and whether their descriptions are changed or not, claiming that the amount of oil and the degree of impact on the dirt is not declared in the hadīths. The Ḥanafīs adopted the provision in the narrations mentioned pointing to a small amount of liquid oil and considered the measure of description change for a large amount of liquid valid. Ẓāhirīs, Ibn Taymiyyah and some of the faqīhsargued that the liquids which one cannot feel the color, taste or smell of the najāsahin are clean, regardless of the amount.These three approaches are open to criticism because the first is limited only to the literal meaning in the narrations and neglects the aims, and the second ignored the non-water fluids’ ability to hide the descriptions of the substance added to them, and the third evaluates the mustahlak substance (that has undergone a physical change) as if it had been istiḥālah(chemically changed). When the narrations related to the subject are examined, it is understood that while the usage of the liquid fat which the dead mouse was seen in as the food was prohibited, in fact, it was based on the foresight that all of the fat is affected by the mouse. It appears to have been ruled out that only the part polluted is the part affected by thenajāsahfor the fact that after the removal of the mouse and the environment from the solid oil exposed to the same contamination, the rest is allowed to be eaten. According to this, it is possible to say that the measure of mutanajjisin the things that affected by najāsahis in the degree of spreading of najāsah.Nowadays it is possible to determine the presence of najisthings in the main material, which is used as additive or addition, by the level of effect of these substances in the product, as well as by the assays. If the najissubstances used for purposes such as brightness, taste, consistency and extending shelf life, perform the expected functions, it means that they protect their presence in the product effectively. In fact, it should be acknowledged that these substances continue to exist effectively in the product, if they perform the targeted function without any chemical change, even the ratio in the product is low or the color, taste and odor are eliminated during the mixture.The faqīhswhile differed in opinion about the mutanajjisof things that the najāsahhad undergone physical changes in, they, in concert, considered the substances, which were not cleaned or could not be cleansed from which that they accept as mutanajjisby their own measurements, khabīs(disgusting), and have accepted the people’s eating of them as ḥarām. Likewise, they did not allow such things to be used in any way touching the body, clothing and containers. They have evaluated the narrations, which requires the spilth the fat that the dead mouse was seen in, as the main basis in this issue. On the other hand, about the use of the mutanajjisthings outside the human consumption area and in such a way that the clothes and body would not be contaminated; the majority of thefaqīhs preferred the mubāḥ provision. They have put forth the narrations as the basis that recommends the usage of the liquid oil in which the mouse was fallen in lighting. These approaches of the fuqahāʾabout the effect of the istihlākon the provision of making use of the things that affected by najāsahare of worth as the basic principles on the subject. It is possible to say that it is not permissible to consume food products containing lard or pork gelatin, and the chicken that has been torn apart while being left in hot water in order to pluck its feathers, and the egg which becomes mutanajjisfor it is boiled up with thenajāsahon, and the using of cosmetic products containing lard when today’s industrial products are evaluated in accordance with these principles. If taken the general opinion that defends that the ethyl alcohol is najis as the basis, the carbonated soft drinks, which are added to alcohol, can also be evaluated in this context. (shrink)

Ṣadr al-Dīn Shīrāzī, Muḥammad ibn Ibrāhīm; -1641; Islamic philosophy.

One of the most important issues in Islamic law is that either partially or completely, or temporary or permanently, a rule can be changed for a particular group of people or everyone. Since the concept of necessity can lead to a change of an important rule like ḥarām/prohibition, this concept should be examined meticulously both in theory and in practice. The thşs study aims to analyze how and why necessities make some ḥarāms permissible and to reveal the ultimate cause for (...) this ibāḥa (permission) from the point of view of Islamic legal theory and philosophy. To achieve this aim, first, the nature of the relationship between the prohibition and the act is examined. To understand how and why necessity gives permission to some ḥarāms, it is necessary to determine the changing and unchanging elements in the case at issue. In the case of necessity, there is no change in the nature of the act and the evil, which is considered as the reason of banning. Indeed, there is a change in the conditions surrounding the act and in the state of the obligated person. However, the main factor that enables the change in ḥarām is the change in the addressing of Shāri‘, who takes into account the changes mentioned. It is seen that the changes stemming from necessity do not lead to the same results as in all permitted ḥarāms. This observation requires a thourgh examination and elaboration on what the scholars of legal theory mean by abolition of prohibition and turning it into permissible. As a result, it has been observed that permitted ḥarāms do not equally function in terms of turning into permissible and that they do not have an equal effect on other acts in the field of mubāḥ. In that case, it is possible to evaluate the permitted ḥarām acts as al-maʻfuw ʻanh/forgiven acts. Although the act could be considered part of the category of mubāḥ, it would be more correct to place them close to the line of makrūh. From the point of view of the servant, the reason why necessity makes a ḥarām act permissible is the priority of avoiding greater evil. However, to reveal His sincere servants, Allah's command to them to avoid all ḥarāms even if they die, does not contradict with His wisdom. For this reason, the ultimate cause why Allah considers the case of necessity in passing judgment is His endless mercy. All these points helped reaching some broader conclusions about legal theory, as well as some conclusions specific to the case of necessity. It turns out that to understand how necessity makes some ḥarāms permissible, one needs to comprehend the relation between the act, the obligated person, the conditions surrounding them and the Shari‘ correctly. Understanding this relationship well is also extremely important to understand the theory of ruling and the Islamic legal theory. This research has substantiated once again that the issues addressed by the Islamic legal theory and practice are linked to the theological doctrines, more than, it is commonly perceived or considered. It turns out that it is important to know the deep or subtle differences between the terms such as ḥarām-ḥalāl, maḥẓūr-ḥarām, mubāḥ-ḥalāl, fundamental mubāḥ-ma‘fuw ‘anh, etc. as well as grasping each of the rule categories. Comprehending all these concepts constitutes an important step in acquiring a true understanding of religion and the maqāṣid al-sharī‘a. In this research, it has been proven once again that each category of the rule includes different levels of ruling in itself. The reason why the acts are categorized in different levels even if they are in the same rule category is the concepts of worldly and otherworldly; evil or good arising from the the ḥarām act. This study also confirmed that the obligated person is at the center of the law. This fact reveals how difficult it is to argue that the rules of Allah are based on divine will that is independent of and disregards the act, obligated person, and conditions. On the contrary, it is understood that the interests of the servant are considered both in the rules of necessity and in the whole of the divine legislation (and even the genesis). On the other hand, this indicates a legal system that is not inflexible and dull, but rather dynamic and parallel to life. Both the fact that the real and absolute source of the rule is Shāri‘ Almighty,and that a very large area of legislative was left to the mujtahid should be considered together. This truth has been observed once again in the matter of making prohibitions permissible on the basis of necessity, and the task of determining which evil is greater was often left to the mujtahid’s consideration. As in every religious issue, the two main resources of Islām which are the Qur’ān and the Sunnah/ḥadīths are the first reference sources for deciding the things that are forbidden by Islam. There is no evidence in the Qur’ān that suggests specific types of animals are forbidden to eat except pork. Other than pork, only the animals which are slaughtered without the name of Allah, their blood and their carcass are forbidden to consume. Except these restricted ill-gotten meats, in the (...) Qur’ānic verses there are no other limitations referring to different animals. However, in Ḥadīth sources there are some narratives referring to the Prophet Muḥammad, implying that He named some other forbidden animals beside the ones specified in the Qur’ān. Collecting the narratives and evaluating them as a whole will contribute for a better understanding of the rules and principles of prohibitions that the Prophet Muḥammad imposed on this issue. Moreover, it will help to identify whether those rulings on some animals are unconditional and world-wide or cause-related and thus changeable according to the conditions. Furthermore, in this matter, although some animals‘ meat are not mentioned as forbidden in the Qur’ān, they are banned by the Prophet Muḥammad. This brings the need to highlight the importance of the capacity of the Prophet Muḥammad on deciding what is permissible (ḥalāl) and forbidden (ḥarām) in the religion.SummaryWhile the authority for determining what is ḥalāl (lawful) and what is ḥarām(forbidden) belongs essentially to Allah, the Prophet Muḥammad is also authorized to appoint what is ḥalāl-ḥarām by Allah.Authority of the Prophet Muḥammadrelated to the issue is not absolute and stems from the Qur’ān. It is understood that the Prophet Muḥammadgrounded his commands in the concept of hkabāis.Prohibitions related to animal meats in the Qur’ānare limited to four: carcass, blood, pork and animals, which are not slaughtered in the name of Allah. However, in the Ḥadīth resources there are some narratives about the Prophet’s prohibition on consuming some types of animals other than the forbidden animals specified in the verses. These narratives can be classified in three titles:1. Animals, which are prohibited to be eaten 2. Animals, which are prohibited because of the way they are fed and slaughtered3. The matter of prohibition of the animals, which are commanded or forbidden to be slaughtered by the Prophet Muḥammad.At the end of the studies conducted based upon ḥadīth resources, in particular Kutūb al-Sittah (the well-known six ḥadīth books), it has been discovered that the animals, which are mentioned as not being permissible in the narratives, they are limited to domesticated donkey and the species of “predatory animals, predatory birds”, namely wolf, fox and cat. Even though the narratives about hyena imply as eatable, hyena is included in this article as it’s a predatory animal.The narratives regarding the prohibition of meat of domesticated donkey were transferred by approximately twenty Companions in respect to the time of the Battle of Khyber. This prohibition is generally stated in the ḥadīthresources as: “We were having dire hunger at the nights of Khyber. When the day for Khyber came, we encountered domesticated donkeys. We immediately slaughtered them. When we put the meat in the pot and started to boil it, crier of the Prophet Muḥammadcalled “Knock over the pots and don’t eat any of the donkey meat”. Regarding the issue there are such statements of some Companions like “we were banned from eating domesticated donkey”, “The Prophet banned the meat of domesticated donkey” among the narratives about the ban. In addition to a large number of narratives about the prohibition of domesticated donkey meat, there are two narratives related to permission of the Prophet for eating domesticated donkey and a narrative that Ibn ‘Abbās did not accept the ban. One of the said narratives is not among the narratives in the Kutūb al-Sittah while the other one is stated solely in the Sunanof Abū Dāwūd and thought to be acceptable by the traditionists. Even though this narrative’s authenticity is accepted, it is understood that there is an implication for the permission based on a necessity. According to the narrative, Ibn ʿAbbās referred to 145thverse of the surah al-An’am as a proof to his view saying “What ḥalālis what Allah allowed, what ḥaramis what Allah forbidden and the things about which there is no judgement of Allah are mubāḥ (permissible)”. As for us, the fact that Ibn ʿAbbās did not accepted the prohibition implies that he did not recognize the Prophet’s command related to the prohibition as an absolute prohibition. The conveyances of many Companions, which are consistent with each other, about the Prophet’s prohibition on eating domesticated donkey during the Battle of Khyber, proved that the prohibition was applied. Even though there is no dispute about prohibiting domesticated donkey, it is controversial whether the prohibition is absolute, constant or provisional based on certain reasons. It is more reasonable to accept that this prohibition was provisional and it was based on certain reasons. Because there are many narratives bearing information that this prohibition was due to several reasons and this is a situation which needs to be considered. Accordingly, there are three reasons, nearly all of which are attributed to judgement of the Companions. These were the facts that domesticated donkey was used in transportation; it used to eat filth and it was slaughtered/consumed without distributing booty/paying taxes. The seeking of the Companions for any reason for this prohibition indicates that they needed to comprehend this prohibition and that the prohibition is not absolute and constant.There is no explanation neither in the resources where the narratives are included nor in the annotation about when, where, why and in which context the prohibition regarding the predatory animals was realized. It is highly possible to assume that the Prophet prohibited these animal as they eat carcass. Another interesting issue within this regard is the fact that there are narratives and views indicating permissibility of eating hyena, which is a predatory, while predatory animals are forbidden in the narratives. Statements of the Prophet related to permissibility of eating hyena, which are considered authentic by traditionists and information about the Arabs who used to eat hyena and some of the Companions who praised eating hyena indicate that urf (custom) has a primary and decisive role about permissibility of eating meats. Regarding this matter about the hyenas, the narratives pointing out some Companions like ʿĀʾisha bint Abī Bakr and Ibn ‘Abbās who viewed prohibition of animals other than the prohibited animals in the Qur’an as inapplicable and other issues referring to the dispute indicate that prohibition of the Prophet Muḥammadfor predators can not be accepted as an absolute and unquestionable prohibition. Some of the prohibitions mentioned in ḥadīth narratives, except these animals, stem from the way of feeding and slaughtering of some animals. It is understood that consuming meat and milk of the animals that eat filth is prohibited in order to abstain from the things harming human health and mujassam (killing an animal with an arrow, etc. by fastening it as a target) is prohibited as carcass is banned and it is not permissible to torture and harm animals. Some of the prohibitions are related to the some animals, which were allowed and banned to slaughter by the Prophet. As the Prophet commanded some animals to be slaughtered and some animals not, meat of these animals was considered as forbidden. There is a dispute among the scholars, whilst there is not any statement of the Prophet about whether the animals included in this group can be eaten or not. It is seen that the Prophet ordered to slaughter some of the animals and prohibited to slaughter some other animals based on several reasons. (shrink)

O objetivo do artigo é analisar as obras de Ibn Taymiyyah e identificar seus conceitos mais importantes para a comunidade muçulmana. Os métodos de análise das fatwas escritas por Ibn Taymiyyah e os métodos de interpretação e comparação dos conceitos de proibido e permitido, no (...) Islã, foram usados para atingir o objetivo do estudo. A principal conclusão da pesquisa é que Ibn Taymiyyah era conhecido por suas pesquisas em lei islâmica, teologia e moralidade. Ele tinha visões conservadoras e, devido às suas próprias ideias reformistas, foi repetidamente condenado. Apesar disso, ele criticou os ensinamentos tradicionais sobre o Islã e apoiou a necessidade de reformar alguns aspectos da prática islâmica. In the Hanafī madhab (school law), al-hukm al-taklifī have been determined in different categories, taking into account that the relevant evidence is conjecture-conclusive in terms of certitude-dalāla and whether the request is binding or not. In general terms, it is stated in the usūlworks that the orders and prohibitions that are fixed with definite evidence are fard and haram, and the binding provisions in which there is suspicion and doubt in their evidence are wājib and tahrīman makrūh. However, some (...) “fards” have been identified, which have stronger effects than “wājib” in the Hanafi fiqh doctrine, and which are subject to suspicion and doubt in their evidence, and therefore there is disagreement about their ruling among fiqh scholars. The Hanafī jurists of the later period adopted the concept of “al-fard al-amalī (al-zannī)” for such judgments. In addition, while examining the propositional provisions in the Hanafī Usūl literature, the wājib is generally compared with the fard. However, in some of the later usūl works and in many other issues in fiqh, wājib is compared with sunnah, and its connection with sunnah or its distinction from sunnah is considered as an important issue. In this article, it is aimed to clarify the nature of the “al-fard al-amalī”, which expresses an intermediate category in the classification of propositional provisions in the Hanafī school, and similarly, attention is drawn to the existence of some “haram” in the Hanafī school of which there is doubt. Some of the evaluations made by Hanafi jurists regarding the distinction between wajib and sunnah, taking into account the quality of the evidence, have been discussed and it has been tried to determine what is the ruling of abandoning the muakkad sunnah, which is often not explicitly included in the proposed judgment classifications made depending on the nature of the relevant evidence. In Saudi Arabia in 2000 the world's first human uterus transplant was attempted with some success. In 2011 the second successful human uterus transplant took place in Turkey. Doctors in the United Kingdom have recently announced that uterus transplants will be carried out in the UK if doctors can raise enough funds to complete their research. As scientists continue to make progress in this domain this is anticipated to be the next breakthrough in the arena of assisted reproductive technologies. The (...) procedure is designed to restore fertility in women unable to gestate due to an abnormal, damaged, or absent uterus. At present, the only other option for such women to achieve genetic motherhood is via surrogacy, which in Islam is widely regarded as haram or forbidden. This article examines the benefits of this technology so as to facilitate discourse between Islam and the West. It argues for Islamic scholars to consider these advances so as to ensure Muslims living as minorities in Western countries, such as the United Kingdom, are able to utilize such technology (if indeed regarded as permissible) should the government move to enact legislation to permit this procedure. The first half of this Editorial examines the implications of the close link between morality and religion in Islamic thinking. There is no separate discipline of ethics in Islam, and the comparative importance of reason and revelation in determining moral values is open to debate. For most Muslims, what is considered halāl (permitted) and harām (forbidden) in Islam is understood in terms of what God defines as right and good. There are three main kinds of values: (a) akhlāq, which refers (...) to the duties and responsibilities set out in the shari‘ah and in Islamic teaching generally; (b) adab, which refers to the manners associated with good breeding; and (c) the qualities of character possessed by a good Muslim, following the example of the Prophet Muhammad. Among the main differences between Islamic and western morality are the emphasis on timeless religious principles, the role of the law in enforcing morality, the different understanding of rights, the rejection of moral autonomy as a goal of moral education and the stress on reward in the Hereafter as a motivator of moral behaviour. The remainder of the Editorial is concerned with the two main aspects of moral education in Islam: disseminating knowledge of what people should and should not do, and motivating them to act in accordance with that knowledge. Ultimately, moral education is about inner change, which is a spiritual matter and comes about through the internalisation of universal Islamic values. (shrink)

This study aims to explain the form of a traditional house made of bamboo in Makassar culture; the components of the traditional houses made of bamboo and their respective functions; and socio-cultural dimensions of the shape and structure traditional house constructed of bamboo in Makassar culture. To discuss these problems, we used the Saussure’s Structural Linguistics approach and Levi Strauss’ Structural Anthropology. Both are elaborated into cultural semiotics. The data collection methods used were field surveys accompanied by technical documentation, interviews, (...) and records. Data were analyzed qualitatively. Results of the research indicate that the traditional house form made of bamboo in Makassar culture is generally divided into three parts, either vertically or horizontally. Vertically, the upper part is called pammakkang ‘attic’; the middle part is called kale ballak ‘house body’; and the bottom is called siring ‘underneath.’ Horizontally, the front is called paddaserang ri dallekang ‘vestibule’; the middle section is called paddaserang ri tangnga ‘living room’; the backside is called paddaserang ri boko ‘back room.’ The components of the upper, middle, and lower houses show opposition to each other. However, these components are logically related and related to one another so as to form a meaningful social and cultural construction. The shape and structure of traditional houses in Makassar culture is influenced by socioeconomic and socio-cultural factors. (shrink)

Bu makalede, müşriklerle sosyal ilişkinin mahiyetine dair Müslüman düşünce geleneğinde ortaya konulan literatür genel hatlarıyla ele alınmaktadır. Söz konusu literatür, “müşrikler bu yıldan sonra Mescid-i Harâm’a yaklaşmasınlar” (Tevbe 9/28) ayeti temelinde şekillenmiştir. Bu bağlamda âlimler şirkin mahiyeti, Mescid-i Harâm bölgesinin sınırları ile bu bölgeye yaklaşmamayı ifade eden fiilin içeriği ve özellikle de ayetteki uyarının Hac ibadeti ile sınırlı/kayıtlı olup olmadığı gibi hususları tartışma konusu yapmışlardır. Bu ayet çerçevesinde ortaya konulan literatürde iki görüşün ön plana çıktığı görülmektedir. Bunlardan ilki, Mescid-i Harâm (...) ifadesiyle kastedilen mananın tüm mescitleri kapsayacağı düşüncesinden hareketle “yaklaşmama” yasağın sınırlarını genişletirken diğer görüş, maslahatçı bir yaklaşımla söz konusu bölgenin Kâbe ve çevresiyle sınırlı olduğu iddiasına dayanmaktadır. Bu bağlamda ilk görüşte, harem bölgesine müşriklerin hiçbir surette giremeyeceği savunulurken ikinci görüşte, müşriklerin cahiliye döneminde yaptıkları tarzda hac ve umre ibadeti yapmak amacıyla söz konusu bölgeye giremeyecekleri ancak ticaret, seyahat vb. farklı maksatlarla gelebilecekleri vurgulamaktadır. Makalede konu H. VII. yüzyıla kadar kaleme alınan rivayet, dirayet, ahkâm ve Şiî tefsirler temelinde irdelenmiştir. Bu bağlamda Mukātil b. Süleymân, İmâm Şâfiî, Cassâs, Ebû Bekir İbnü’l-Arabî ve Kurtubî’nin kaleme aldığı ahkâm tefsirleri; Taberî, İbn Ebî Hâtim, Ebû İshak es-Sa‘lebî ve İbn Kesîr’in yazdığı rivayet tefsirleri; Mâtürîdî, Zemahşerî, Fahreddin er-Râzî, Beyzâvî ve Ebu’l- Berakât en-Nesefî’nin dirayet tefsirleri ile Şiî müfessirler Kummî, Ayyâşî, Ebû Ca‘fer et-Tûsîve Tabersî’nin tefsirleri incelenmiştir. Konunun bahsi geçen tefsirler temelinde ele alınmasındaki amaç ayetin anlaşılmasına bağlı olarak ortaya konulan fıkhî hükümleri ve gerekçelerini tespit ederek mukayese yapmaktır. Zira Tevbe suresi 28. ayetin anlaşılmasında, dini anlama tarzları bakımından Ashâbu’l-Hadis ve Ashâbu’r-Rey olarak nitelenen âlimlerin görüşlerinin belirleyici olduğu görülmektedir. Konu bağlamında Şiî tefsirlerin incelenmesindeki amaç ise söz konusu literatürde Tevbe suresi 28. ayetin ele alınmasına ilişkin bakış açısının Ashabu’l Hâdis’e mi Ashabu’r-Rey’e mi yakın olduğunu tespite yöneliktir. İncelenen tefsirlerde ilk görüşün İmâm Mâlik ve İmam Şâfiî’ye ait olduğu belirtilirken ikinci görüş Ebû Hanîfe’ye nispet edilmiştir. İmâm Mâlik ve İmam Şâfiî’ye ait olan görüş genel kabul görürken Ebû Hanîfe ve Mâtürîdî’nin benimsediği, Hanefî-Mâtürîdî âlimler tarafından kabul gören ikinci görüş, tarihsel süreçte şaz olarak nitelendirilmiş ve dikkate alınmamıştır. Makalede, H.7. yüzyıl’a kadar yazılan rivayet, dirayet, ahkâm ve Şiî tefsirleri özelinde bu görüşlerin temel mantığı, ortaya çıkış süreçleri ve bu çerçevede üretilen fıkhî hükümler analitik bir bakış açısıyla irdelenmeye çalışılmıştır. Makalede sonuç olarak Ashabu’l-Hadis’e mensup âlimlerden İmâm Mâlik ve İmâm Şâfiî’nin konuyu sadece müşrikleri değil tüm gayr-i müslimleri içerecek şekilde ele aldıkları ve bu gruplarla kurulacak sosyal, ekonomik ve siyasi ilişkinin mahiyeti hakkında fıhkî hükümler koydukları görülmektedir. Bu hükümlerle, Müslüman düşünce geleneğinde gayr-i Müslimlerin özellikle sosyo-kültürel açıdan ötekileştirilmeleri meşrulaştırılmıştır. Bu bakış açısı Müslümanların birlikte yaşama kültürüne katkı sağlamalarını engellediği gibi insana saygıyı temel alan Kur’an’ın bakış açısı ile de çelişmektedir. Bu bağlamda Ashabu’r-Rey’in önemli temsilcilerinden biri olan Ebu Hanîfe’nin yasaklama emrini cahiliye döneminde yapılan hac fiili ile sınırlaması konuya ilişkin bakış açısında ciddi farklılıklara imkân tanımaktadır. Ebû Hanîfe’nin bu anlama biçimi, gayr-ı Müslimlere ilişkin olumsuz bir uygulamaya imkân vermediği gibi takipçisi Mâtürîdî tarafından geliştirilerek ahlakî bir boyutta ela alınmıştır. Süreç içerisinde söz konusu anlama biçimi, aynı düşünce geleneğine mensup olan Cassâs ve Ebû’l-Berekât en-Nesefî tarafından devam ettirilerek geliştirilmiştir. (shrink)

The Abrahamic tradition that the Arabs value most was ḥajj. The ḥajj, which means to visit Kaʿba was the greatest means of getting closer to Allāh. The Kaʿba was the house of Allāh. And the visitors of the Kaʿba were Allāh’s guests. For this reason, the Arabs used to great respect to the visitors and they never used to attack a man in the ḥarem (the area around the Kaʿba). The same respect included visitors’ travels to the Kaʿba. There were (...) two Abrahamic traditions that ensured the safety of visitors and sacrifices: Ḥaram months and qalāid. Ḥaram months were Dhū l-Qaʿdah, Dhū l-Ḥijjah, Muḥarram and Rajab. And the Arabs did not used to attack anyone in those months. For visits outside the ḥaram months, the visitors used to use the qalāid as a primitive visa. Qalāid is the plural of the word qilāda, meaning necklace. The Arab, who saw the qilādas, used to understand that the person who wore the qilāda wanted to go to the Kaʿba or had returned home from the Kaʿba. Qilādas used to be knitted from wool ropes and they used to be hung on animals’ neck or humps. Sometimes horseshoes used to hang on these qilādas. On the way back from Kaʿba, the barks of the ḥarem trees used to hang on the qilādas instead of the horseshoes. The Qurʾān orders Muslims not to disrespect the qilādas. This order also reveals that the Qurʾān recognizes the qilāda tradition. Allāh’s Apostle (sallallaahu ‘alayhi wa sallam) and Ṣaḥāba are also known to continue this tradition.Summary: Ḥajj was the most important worship of the Arabs in the pre-Islamic period. Human and commodity mobility in the ḥajj had an important place in the life of the Meccans who lived in land unfit for agriculture. This fact is expressed as follows in Abraham’s (Ibrāhīm al-Khalīl) prayer: “Our Lord! Lo! I have settled some of my posterity in an uncultivable valley near unto Thy holy House, our Lord! That they may establish proper worship; so incline some hearts of men that they may yearn toward them, and provide Thou them with fruits in order that they may be thankful.” (Ibrahim 14:37) The Arabs who lived in various parts of the Arabian Peninsula used to come to Mecca during the ḥajj season and present their sacrifices. They also used to buy their needs from nearby markets. These markets were also places where traders had the opportunity to sell their products.Because the Arabian Peninsula is unfavorable in terms of climate and soil, many Arab tribes used to raid and attack other tribes to sustain their existence. It is even known that some Arabs proud of their raids. The attacks only used to stop in the ḥaram months (Dhū l-Qaʿdah, Dhū l-Ḥijjah, Muḥarram and Rajab). Because of the prohibition of fighting in the ḥaram months, the visitors used to visit the Kaʿba with confidence. Thanks to this truce, the trade goods carried by visitors used to reach to Mecca with confidence.It was possible that the visits outside of the ḥaram months were safe. However, it was necessary to follow some traditions in order to achieve this confidence. Visitors to the Kaʿba used to use some signs that they were visitors to the Kaʿba. One of these signs was qilāda (necklace) hanging on the neck or hump of the animal. The person wearing qilāda was Allāh’s guest, and his sacrifice was the property of Allāh. For this reason, no Arab would to dare to attack these visitors and property. Because of the Arab reverence for the Kaʿba, visitors wearing qilādas used to come to the Kaʿba and present their sacrifices throughout the year. The sacrifices had an important place in the livelihood of the poor.Qilādas were mostly used for visits outside the ḥaram months. The qilādas used to hang on the necks of the animals shipped to the Kaʿba as sacrifice. However, it is also known that qilādas are sometimes hung on hump. People who did not deliver sacrifices (animals) to the Kaʿba used to hang the qilāda his neck to show that he was a visitor to the Kaʿba. Similarly, it is known that people who sacrificed their animals on the Kaʿba hang the qilāda their neck on the way back. The qilādas fitted on the way to the Kaʿba were made of ropes spun from wool or hair. Sometimes horseshoes used to hang on these qilādas. Ḥarem plants (grass, tree bark) used to use in the qilādas on the way back.The Qurʾān orders Muslims not to disrespect the qilādas. This order also reveals that the Qurʾān recognizes the qilāda tradition. The word qalāid is mentioned twice in the Qurʾān: “O ye who believe violate not the sanctity of the symbols of Allāh, nor of the sacred month, nor of the animals brought for sacrifice, nor the qalāid, nor the people resorting to the sacred house, seeking of the Bounty and good pleasure of their Lord.” (Al Māʼidah 5:2), “Allāh made the Kaʿba, the sacred house, an asylum of security of men as also the sacred months, the animals for offerings, and the qalāid.” (Al Māʼidah 5:97) Considering the practices of the qilāda, it is understood that qilādas are a kind of visa. It is understood that all practices related to the visit to the Kaʿba, especially the ḥajj, have an aim to satisfy the material-spiritual needs of those who come there for the purpose of visiting and trading, as well as those who reside in the Kaʿba. Therefore, it will not be far away to say that qilādas can be used today for the same purpose. For example, labels, banderols, visas and passports can be used instead of ropes, horseshoes and plants. On the other hand, the meaning of the āyāt (verse) in which the word qalāid is mentioned is not limited to the Arabs. The same āyāt declare that qilādas are a development (qiyām) instrument for people. Therefore, the qilāda has a meaning potential beyond the 7th century and the inhabitants of this century. (shrink)

According to the consencus of Muslim world, al-Aqsā Mosque is located in the land of al-Quds (Jerusalem). In this matter, especially the old Sunnite sources are in agreement with each other. However, there are recently some different views regarding the location of al-Aqsā Mosque. It has been argued that al-Aqsā Mosque most likley was built in a location differnet from Jerusalem. One of the defenders of this opinion is Muhammad Hamīdullah, who is a prominent scholar of Islamic studies and considered (...) to be a reliable authority among contemporary Islāmic historians. He claims that al-Aqsā Mosque, which was also mentioned in the Qur’ān, cannot be the Mosque that is present in Jerusalem. Rather, it must be searched in heavens. If this claim is accepted, then numerous reports informing that the mosque is located in Jerusalem and many interpretations based on these reports, will become problematic and controversial. Therefore, it is necessary to examine those claims and the relevant evidence in detail. Following this pueporse, we aim to examine and evaluate those views with a critical approach in this study. In this regard, we will argue that the comments and approaches that have been argued so far, are not consistent. Rather, relevant claims do not rely on strong evidence but only unsatisfactory interpretations. Summary: Muhammad Hamīdullah who is a prominent researcher and well-known for his studies on History of Islām, has individual opinions on some issues, different from classical scholars of Ahlu’s-Sunnah (branch of Islām that accepts the first four caliphs as rightful successors to Muhammad). One of his distinctive views is the original place of Masjid al-Aqsā (al-Aqsā Mosque). He claims that al-Aqsā Mosque was likely located, not in al-Quds (Jerusalem), but in heavens. In this article, our purpose is to examine this matter by evaluating his arguments regarding the place of al-Aqsā Mosque. Hamīdullah’s argument is based on several reasons which are as follows:Miʻrāc (The Ascension) is a journey from the earth to beyond the heavens. According to Hamīdullah, it is illogical to say that, in relation to such a magnificient occurrence, the Holy Qur’ān only mentions the journey from Mecca to Bayt al-Maqdis/al-Quds.Hamīdullah maintains that the expression “al-Masjid al-Aqsā” in the first verse of Sūrah al-Isrā means “the remotest Mosque.” However, the Palestinian lands are described as “Adna’l-Arḍ/Nearest Country” in the third verse of Sūrah ar-Rūm. Thus, “the remotest Mosque” should not be “the nearest country”; rather it should be a Mosque in heavens.He also argues that in some Hadith texts, the mosque in question is mentioned as “Masjid al-Aqsā”, but there is a grammatical difference between the phrases of “al-Masjid al-Aqsā” and “Masjid al-Aqsā”, which means that the mosque mentioned as “al-Masjid al-Aqsā” in the Qur’ānic verse does not have a connection with al-Quds (Jerusalem). In his opinion, the expression of “Masjid al-Aqsā” which appears in some Hadith texts is in the form of a noun clause, while the quranic expression “al-Masjid al-Aqsā” is in the form of an adjective clause. Accordingly, “Masjid al-Aqsā” and “al-Masjid al-Aqsā” refer to different places. The noun clause -as in the Hadith texts- of “Masjid al-Aqsā” must be in al-Quds, whereas the Qur’ānic expression in the form of an adjective clause of “al-Masjid al-Aqsā” must be a mosque in the heavens.According to his other claim, Abu’l-Yemān, the teacher of the teacher of Bukhārī, when narrating the hadith about mosques, he mentions this mosque, not as “al-Masjid al-Aqsā”, but as Īliyā’. That is, according to him, early sources of hadith do not mention the phrase of “al-Masjid al-Aqsā”, but instead, the phrase of Īliyā’ was used. Hamīdullah also states “... while narrating this hadith, Muslim does not use the phrases “Masjid al-Aqsā” or “al-Masjid al-Aqsā.” Instead, he uses the phrase Īliyā’.”He also states that the term al-masjid (the mosque) which appears in the seventh verse of Sūrah al-Isrā, was used to refer to that Īliyā’, not to refer to “al-Masjid al-Aqsā”. Likewise, the Umayyad Caliph Abdulmelik (26-86 h.c./646-705 g.c.) built the Dome of the Rock (Masjid al-Saḥra) in al-Quds and named it “Masjid al-Aqsā”. This name became so widespread at the times of Imam al-Bukhārī (194-256 h.c./810/870 g.c.) so that the old name Īliyā’ had been totally forgotten. Because of this reason, some hadith narrators were using this more common name “Masjid al-Aqsā” to express and describe this forgotten name.When we critically evaluate the information and approaches explained above, we come to the conclusion that they are not consistent. First of all, the claim that Masjid al-Aqsā is in the heavens, is in disagreement with the Qur’ānic verses implying that “Masjid al-Aqsā” is in al-Quds, and with many authentic hadith texts that indicate its existence on those lands. Also, the sources of Qur’ānic interpretations (exegeses) and historical narrations refute this claim. On the other hand, there is no Qur’ānic verse or tradition (hadith) that state that Masjid al-Aqsā is in the heavens.We argue that Hamīdullah’s claim “...It is illogical to say that, in relation to such a magnificient occurrence, the Holy Qur’ān only mentions the journey from Mecca to al-Aqsā Mosque in al-Quds” is not very appropriate. Because, it is beyond the human judgment to decide which part of this magnificient journey is more important or which part of it should take place in the Holy Qur’ān. Only Allah has the authority to decide for this. Moreover, we should remember that-as mentioned in the conveyed knowledge- the incident mentioned in the first verse of Sūrah al-Isrā is merely the magnificient journey from Mecca to Masjid al-Aqsā, which was clearly stated in the authentic hadith sources. As for the third verse of Sūrah al-Rūm, it is not correct to claim that Masjid al-Aqsā is not in al-Quds but in the heavens, by reading the text of the verse. Because, the phrase al-arḍ (the earth) has several meanings. Moreover, the phrase al-aqsā (the remotest) in the first verse of Sūrah al-Isrā, refers to distance between the two mosques, not between two countries.In some hadith texts, Masjid al-Aqsā was mentioned as “al-Masjid al-Aqsā” in the form of a noun clause, but this does not require that the masjid in question should be in the heavens. Because, many hadith texts mention it in the form of an adjective clause. Besides, some hadith texts mention Masjid al-Harām (Great Mosque of Mecca) in the form of a noun clause (Masjid al-Harām), not in the form of an adjective clause (al-Masjid al-Harām). If we consider Hamīdullah’s claim, we should look for the Masjid al-Harām in the heavens, but not on earth. So far, neither he nor anybody else made such a claim.Hamīdullah argues that Abu’l Yemān mentioned this mosque as Īliyā’, but not as al-Masjid al-Aqsā, and claimed that early religious sources do not use the term al-Masjid al-Aqsā. However, this is not a sound argument. Because, the authorities of hadith and history, who lived both before Abu’l Yemān and also at the same era, used the term “al-Masjid al-Aqsā” in their works and narrated that this term refers to al-Quds or Bayt al-Maqdis (Masjid al-Aqsā). Moreover, Hamīdullah’s claim that Muslim (a senior hadith scholar) did not use the terms “al-Masjid al-Aqsā” or “Masjid al-Aqsā” but instead he used the name “Īliyā’” is incorrect. Because, while narrating this hadith, the hadith scholar (Muslim) used all three names. As for the term “al-Masjid (the Mosque)” mentioned in Q 17.7, it is a groundless comment to claim that it does not refer to “al-Masjid al-Aqsā” in Q 17.1. Because the context of the verses and grammatical rules of Arabic language explicitly prove that the mosque mentioned in the seventh verse refers to “al-Masjid al-Aqsā” which is also mentioned in the first verse.His claim that “the Umayyads named the temple that they built in Jerusalem as “Masjid al-Aqsā” and following the era of Umayyads, in the period of Bukhārī, this naming became widespread” is highly vulnerable and disputable. Because in those times, the temple used to be named as “al-Masjid al-Jami (the Gathering Mosque)”, not as “al-Masjid al-Aqsā”. Nearly three centuries after the Umayyads reign, the naming of the said temple was first introduced to be as “al-Masjid al-Aqsā”. As for the expression of “al-Masjid al-Aqsā” appearing in the early sources of hadith, it was not used for the mosque built by the Umayyads, but was used to mean the entire haram (sacred, respected) region taking place in the south east corner of Jerusalem. In the light of arguments and explanations critically analysed above, we are in a position to argue that Muhammad Hamīdullah’s argument that “Masjid al-Aqsā is in the heavens”, does not rely on sound evidence, but rather, they are only some unsatisfactory interpretations. The objective of this study is twofold: to examine the patterns that govern social reporting with reference to an Islamic framework and to identify the moral legitimacy factors that influence them. We select 146 publicly listed Sharia‐compliant companies and classify the disclosures in their annual reports according to an Islamic framework that categorises items as either Required, Expected or Desired to indicate the degree of importance each item carries from an Islamic perspective. Based on this framework, we then analyse moral (...) legitimacy factors, specifically the type of Sharia screening body and the proportion of Muslims in the population, that may influence the prioritisation of the different categories of social reporting. We find that disclosures that fall into the Required category of our framework—especially those that relate to companies’ involvement in “haram” activities (activities not permissible in Islam)—are still few among the companies studied. Our research also reveals that both moral legitimacy factors under investigation influence the three categories of social reporting, although in different ways. This research contributes to the existing literature by empirically examining how organisations prioritise their disclosure of virtues and the moral legitimacy factors that influence that prioritisation. A juventude evangélica brasileira se viu, durante os anos 1970, bombardeada por uma carga considerável de versões fundamentalistas da escatologia e, com isso, essa questão veio a ocupar um lugar secundário dentre os temas teológicos dos evangélicos brasileiros. A introdução de uma perspectiva não disjuntada da escatologia, como a do teólogo George Eldon Ladd, foi o que possibilitou a difusão da Teologia da Missão Integral, indicando o quanto a missiologia é inseparável de escatologia. Posteriormente, as versões fundamentalistas mantiveram um espaço (...) menos popular, mas constante, nas igrejas. O quadro foi acrescido da Teologia da Prosperidade, que trouxe a noção de uma escatologia individualista. Portanto, de um lado temos uma escatologia construída numa perspectiva não disjuntada do tempo, e do outro uma visão escatológica fundamentalista e privatizada. O enfrentamento dessas duas tendências expressa a contínua tensão entre o dualismo e a integralidade na história do cristianismo. No Novo Testamento, as imagens da barraca (João 1.14, Atos 18.1-3) e da cortina (Mateus 27.45-52) servem para compreender a dinâmica do “habitar entre” em contraste com a do fechamento do sagrado no espaço do haram . Esses dois modos de habitar, na linha de pensamento do filósofo Peter Sloterdijk, ilustram essas duas tendências. Palavras-chave: Juventude Evangélica. Escatologia. Fundamentalismo. Teologia da Missão Integral.: Brazilian evangelical youth was, in 1970’s overflowed with a big variety of fundamentalistic versions of eschatology. That’s why this theme came to occupy a secondary place between the others theological themes in Brazilian evangelical Theology. The introduction of a non disjointed version of eschatology, as Georg Eldon Ladd’s, for instance, make possible the diffusion of IMT (Integral Mission Theology), demonstrating how Missiology is inseparable from eschatology. After that, fundamentalistic versions lost their popularity, but kept their presence in churches. Prosperity Theology brought a complete individualistic notion of eschatology. So, we have in one side a eschatology built on a non disjointed notion of time and reality, and in another, the fundamentalistic and privatized version. The clash of these two tendencies expresses the continuous tension between dualism and integrality in the History of Christianity. In the New Testament, the images of the tent (John 1.14, Acts 18.1-3) and of the curtain (Mathews 27.45-52) are useful to understand the logic of “live-between” in opposition with the closeness of the sacred in the haram . Budaya massa, dalam pengertian sederhana adalah “karya kreatif yang dimassalkan, yang diproduksi secara masif, yang ditunjang teknologi dan industri tinggi [...] termasuk model pakaian, fashion, film, televisi, musik pop, lifestyle atau gaya hidup” (hlm. xiii-xiv). Agama, atau lebih tepatnya “tafsir atas agama, atau tafsir atas ajaran agama” (hlm. xiv) dapat menjadi tema karya kreatif itu. Contohnya, terutama, sinetron-sinetron religi bernuansa Islami yang sekarang ini semakin banyak tampil pada layar televisi, tanpa menunggu bulan istimewa Ramadhan. Selain itu, agama juga dapat menjadi (...) sensor untuk menentukan karya kreatif yang pantas dimassalkan lewat media elektronik maupun media cetak. sense yang digunakan oleh para penyensor adalah moral dan ajaran agama, yang dalam keyakinan mereka harus dijaga. Para penyensor ini bukan hanya lembaga sensor, melainkan juga kelompok- kelompok yang menyebut diri pembela agama tertentu. Lembaga sensor menyampaikan larangan; kelompok-kelompok ini menyerukan protes. Mengemban misi menjaga moral dan ajaran agama, para penyensor dan pemrotes lebih sering mengajukan argumen sensor yang tidak masuk akal (doesn’t make sense) alias “ajaib” (hlm. 163) dan konyol. Lebih ajaib dan konyol, mereka, yang mengaku menjunjung agama dan moral, tidak punya sense mengenai ketidakadilan, khususnya yang dialami wanita. Produk budaya massa yang menciptakan image negatif wanita dibiarkan menjejali benak masyarakat. Wanita harus dikendalikan sebab ia binal, nakal—dengan cara diambil hak atas tubuhnya, dibung- kam suaranya, dipermalukan di hadapan publik, dan kalau perlu dira- jam oleh massa, yang adalah laki-laki dan (sama-sama) wanita. Ketidakadilan terhadap wanita, yang dipublikasikan oleh budaya massa dan ajaran agama menjadi sorotan utama Veven Sp. Wardhana di dalam buku ini. Dipublikasikan di sini berarti ditampilkan di ruang publik supaya diterima sebagai sesuatu yang wajar dan sewajarnya oleh masyarakat. Dengan demikian, kedelapan belas judul pada buku tidak merepresentasikan sebuah rangkaian pemikiran yang sistematik. Na- mun, hal ini tidak mengurangi nilai karya Wardhana, tidak pula menum- pulkan kritiknya terhadap keempat penguasa ruang publik: budaya massa, agama, kapitalisme, dan politik. Akhirnya, menyajikan karyanya kepada masyarakat, Wardhana mengajak setiap warga negara ini untuk bersikap kritis terhadap karya- karya kreatif yang dipublikasikan lewat media cetak dan media elek- tronik. Masyarakat tidak perlu menunggu pemerintah dan para kreator budaya massa mengubah haluan dari pembodohan ke pencerdasan. Understanding and interpreting religious texts correctly is an important problem in every period and culture. Taking advantage of the ezperience of our ancient culture in solving this problem will greatly alleviate our burden. Because, despite the historical distance between us, it is possible to come across traces in the works of the predecessor ulama which will enlighten modern methods of today. In addition, the scientific and cultural heritage of the sects other than Ahl-Sunnah has rich content in this sense. To (...) benefit from this accumulation will give us different perspectives. In this article the principles that Zaydī mohaddith who lived in Hijri 6th centuryin Yemen, used in understanding and interpreting the hadiths of judgment are discussed around two main titles as internal and external factors and nineteen sub-titles under these titles. These principles were evaluated within the scope of his work called Uṣūl al-aḥkām al-jāmi' li-adillat al-ḥalāl wa-al-ḥarām. The principles that followed by an important figure of Zaydī thought, Ahmad b. Suleiman (d. 566/1171), in understanding and interpreting the hadiths of judgment include notable examples in this sense. Because he is more interested in the text and notion of hadiths rather than criticism of the sanad within framework of Zaydiyya of which he is a member. He also makes his comments from this perspective. In this aspect, this article will make a small contribution to the interpretation of the hadiths of ahkām. (shrink)

Sosyal varlıklar olan insanlar, tarih boyunca birbirleri ile alışveriş yapma ihtiyacı hissetmişlerdir. Bu alışverişler, genellikle satış akdi yoluyla gerçekleştirilmiştir. Satış akitlerinin kurulmasında en yaygın görülen yöntem ise pazarlık usulü ile gerçekleştirilen müsâveme yöntemidir. İnsanlar satış akdini kurarken, akdin unsurları üzerinde pazarlık yaparak bir anlaşmaya varmışlardır. İslâm hukuku bu yöntemin sınırlarını belirlemiştir. İnsanların birbirlerinin haklarını ihlal etmeden pazarlık yapabilmelerini sağlayacak düzenlemeler getirmiştir. Ayrıntıları başta örf olmak üzere farklı delillerle düzenlense de, insanların satış akdini kurarken bu sınırlara dikkat etmesi gerektiği, doğrudan doğruya (...) naslar ile emredilmiştir. Bu durum hem şahsi zararların hem de toplumsal zararların önüne geçilmesi açısından büyük önem arz etmiştir. Bu kapsamda getirilen bazı sınırlamalar şu şekildedir: Satılmış olan bir malın devredilmeden bir başkasına satılmaması, fiyat yükseltmek amacıyla üçüncü kişinin pazarlığına dahil olunmaması gerektiği ve tarafların pazarlık aşamasının sonu geldiği, anlaşma meyillerinin oluştuğu durumda üçüncü kişinin pazarlığa dahil olmaması gerektiği belirtilmiştir. Bu sınırlamalardan, tarafların anlaşma meyillerinin ortaya çıkmış olduğu durumda üçüncü kişinin taraflardan birinin aleyhine pazarlığa dahil olması konusu çalışmamızda ele alınmıştır. Bu husus İslâm hukuk literatüründe sevm ale’s-sevm olarak nitelendirilmiştir. Türkçe literatürde genellikle pazarlık üzerine pazarlık olarak çevrilmiştir. Çalışmada sevm ale’s-sevm kavramına genellikle yer verilmiş olmakla birlikte, Türkçe olarak ifade edilmesi gerektiğinde pazarlık üzerine pazarlık kavramı kullanılmıştır. Taraflar pazarlığa yönelik ifadelerini akdin kurucu unsuru olan irade beyanı ile birbirlerine iletmektedirler. Dolayısıyla bu çalışmada öncelikle irade beyanına yönelik açıklamalar yapılmıştır. Pazarlığa yönelik bu irade beyanlarının icâb niteliğinde mi yoksa icâba davet niteliğinde mi olduğu hususunda açıklamalara yer verilmiştir. Bu açıklamaların ardından müsâveme yöntemi tanımlanmış ve genel olarak bu yönteme ilişkin bilgi verilmiştir. Müsâveme yöntemi ile oluşturulan akitler ile bu yönteme benzer yöntemlerin farkları hususunda açıklamalar yapılmıştır. Pazarlık yapılırken dikkat edilmesi gereken hususlara değinilmiş ve pazarlık üzerine pazarlık yapmanın yasak olduğu ifade edilmiştir. Akit kurulurken hangi aşamada pazarlığa dahil olmanın bu yasak kapsamında sayılacağı ve hangi aşamadaki müdahalenin yasak kapsamına dahil olmayacağı belirtilmiştir. Bu yasağın neden gerekli olduğu konusunda yapılmış olan açıklamalara yer verilmiştir. Sevm ale’s-sevmin söz konusu olduğu akitlerin genel olarak diyaneten haram kabul edildiği bununla birlikte kazaen bu akitlerin geçerli olduğu ifade edilmiştir. Bu yasağın kapsamına sadece müslümanların değil aynı zamanda müslüman olmayan vatandaşların ve müste’menlerin de dahil olduğu ifade edilmiştir. Buna göre müslüman olmayan bir vatandaş veya müste’men aleyhine böyle bir pazarlığa dahil olmanın hukuka uygun kabul edilmeyeceği açıklanmıştır. Sevm ale’s-sevmin yalnızca satış akdi açısından değil, aynı zamanda kıyas yoluyla diğer akitler bakımından da geçerli olacağı belirtilmiştir. Bu açıklamalarda Hanefî mezhebinin görüşü esas alınmış olmakla birlikte diğer mezheplerin görüşlerine de yer verilmiştir. Makale genel itibariyle Hanefî mezhebi odağında diğer mezheplerin görüşlerine de yer verilen bir yöntemle oluşturulmuştur. Tüm bu görüşlerin ardından mer’î hukukta bu yasağın uygulanıp uygulanmadığı hususunda açıklamalar yapılmıştır. (shrink)

This article looks at the inadequacy of space available to women in the two most holy sites for all Muslims: Masjid al-Haram in Makkah and Masjid an-Nabawi in Madinah, Saudi Arabia. I argue that religious discourse, shaped by geopolitical factors, has framed piety for women primarily in terms of modesty, such that a woman is often considered a good Muslim if she is visible only within her female community but invisible to the larger society. Furthermore, I argue that the (...) allocation of meager space affects not only the perception of women's religious standing in society, but also women's own perception about their moral selves. The article claims that by being relegated to small sections within religious spaces, women's collective worship is evident neither to the community at large nor can it be fully experienced by individual women, thus placing obstacles in women's path to seek to closeness to God. In Islamic theological writings, under the heading of sustenance, the focus is generally on issues such as who is the provider of sustenance, whether haram is considered sustenance, and whether Allah’s consent exists for haram sustenance. Another issue that can be found between the lines of the subject of sustenance is whether it is haram for a person to work for sustenance or not. In fact, the pursuit of means of livelihood in order to sustain one’s life (...) is, according to the general and predominant acceptance of Muslim scholars, permissible and, in cases of necessity, wajib. According to a record in Uṣūl al-niḥal, during the formative period of itizālī thought, there were Mu‘tazilite sufis (ṣūfiyyat al-Muʿtazila) such as Bishr b. al-Mu‘tamir’s disciple Abū Imrān Mūsā b. al-Raqqāshī, al-Naẓẓām’s apostate disciple Fadl al-Hadathī, and Husayn al-Kūfī, about whom no information is available. These names, who seem to have earned their livelihood through almsgiving, defended the forbiddenness (taḥrīm al-makāsib) of all kinds of endeavour for sustenance, contrary to the acceptance of Muslim thinkers. However, it should be noted that for them, the forbiddenness in making an effort for sustenance does not cover the definition of sustenance, which is ‘all the benefits’, but only the effort in obtaining sustenance through means such as trade and agriculture. It is interesting to find such an extreme tendency among the Mu‘tazilites, who came to the fore with their rationalist discourses. “How could a Mu‘tazilite defend tahrīm al-makāsib?”, the issue of abandonment of striving for sustenance (tark al-makāsib), from which the idea of tahrīm al-makāsib is thought to have evolved, is mentioned, and then the Mu‘tazilite sufis views on tahrīm al-makāsib are tried to be based mainly on Mu‘tazilite sources and the criticisms of Mu‘tazilite authors against them are included. It has been determined that Mu‘tazilite sufis justifications for defending tahrīm al-makāsib concentrate on three points: (i) the absence of a just order due to the absence of a just imam and the possibility of supporting the oppressors (rulers) intentionally or unintentionally, and as a result of this, some of them describe the land of Islam as dār al-kufr, (ii) again in relation to the issue of imamate, in an environment where there is no justice, i.e. legal/moral order, the halāl and harām are so intertwined that they cannot be separated from each other, and in order to protect oneself from harām, the things that are subject to sustenance can only be purified through charity and become halāl, and (iii) the fact that trust in Allah is obligatory and any effort to pursue sustenance is contrary to tawakkul. The Mu‘tazilite authors criticised the proponents of tahrīm al-makāsib on the grounds that it is permissible to trade while maintaining a rational and ethical attitude, that one’s intention and interest in trade are important, and that tawakkul cannot be built on the right ground. As a result, the proponents of tahrīm al-makāsib disappeared because they could not gain a foothold in the Mu‘tazilite intellectual climate due to their erroneous reasoning. (shrink)

As one of the tools used to express feelings and thoughts, music has been utilised by people in many fields throughout history. Music is seen as a means of expressing religious feelings, being used as an educational tool, as a way for military bands to invoke heroic feelings in soldiers, and as way of expressing emotions in joyful and melancholic days. Music was especially born and shaped by rituals of religious origin. With the spread of the religion of Islam, music (...) became an issue that paved the way for many religious discussions. It should be clearly noted that while many verses in the Qur'an are cited as a source for these discussions, it is very difficult to deduce from these verses whether music is halal (permissible) or haram (prohibited). Additionally, many permissible matters in Islam become prohibited when used maliciously or out of their intended purpose, however, if everything that has a possibility of being used maliciously or outside of its intended purpose is considered haram, this will lead to a path of denying many blessings that Allah has bestowed upon people in this world. Restricting issues out of the possibility of their wrongful misuse and depriving others of this blessings cannot be just. Nevertheless, although the discussion of music as permissible or prohibited has largely existed within the religion of Islam, those involved with Tasawwuf (Islamic Mysticism), also known as Sufis, have generally perceived music as nutrient for the soul. Consequently, Sufis have incorporated music into their worship in order to invoke religious feelings over the centuries. Religious music is divided into two; the first is Mosque Recitations, and the second is Tekke music (also known as Tasawwuf Music). Mosque Recitation is that which is performed without instrumentals using only vocals and an improvised approach. On the other hand, Tekke music is performed with an instrument and a composed written piece. Within the Mosque Recitation is the Qur’an recitation, which when read in accordance with its rules has a natural phonetic style, meaning that when the Qur’an is recited according to the Maqam (Melodic modes of recitation) requirements, it evokes spiritual feelings to the listeners. Accordingly, there is a connection between the recitation of the Qur'an and the scientific understanding of music. When a connection between the Qur’an and disciplined recitation is established, this causes an artistic sensation to the listener, which experts in the field have name “Fem-i Muhsin”.Hafız (a title used for a person who has memorised the Qur’an in its entirety) Bekir Sıdkı Sezgin is one of the important musicians to have left his mark on Turkish music, where a discipline was formed after him. He has a very high status due to the value he gave to Turkish music as he became one of the leading names in Turkish music, especially considering the large yet unknown number of students that he personally trained. Hafız Bekir states in interviews that he especially owed his success in the science of music to the Qur'an education he received at a young age, and he emphasises that those who are on the way to becoming good musicians must receive a Qur'an education; additionally, because classical Turkish music lyrics are Arabic and Persian, he argues that the way to correctly pronounce these lyrics is to also know Ottoman Turkish to a high degree. Hafız Bekir was also able to recite the Qur'an to a degree of perfection and was proud of being a Hafız, where he believed that the Qur'an harmonised between his memory and excellent musical knowledge. Hafız Bekir recited the Qur’an according to the suitable Istanbul Maqam of reading, and by using the Maqam befitting the Qur’an recitation, Hafız Bekir was able to take the listeners on a spiritual journey.A survey of the works produced about Hafız Bekir shows that although there have been many theses, articles, and interviews published about him, there is no specific study on his Qur’an recitation according to the Istanbul Maqam style. In this study, Hafız Bekir’s dual identity as both a musician and Qur’an Hafız is underlined as a way to contribute to the field by revealing this side of Hafız Bekir, and also examining the Qur'an education that he recommends to his students. The recitation of verses 189-194 of the chapter Âli İmrân, which Hafız Bekir recited in the Istanbul Maqam style, is notated with the Mus notation system, and analysed according to the Maqam reading style. The notation is formed based on a sensory evaluation with assistance from experts in the field. This study, as a musical analysis, was produced to reveal the importance of this subject to interested parties. (shrink)

Ribā/interest is one of the prominent regulations in Islam regarding commercial life. The commercial lives of Muslims and laws related to commerce were regulated in accordance with the prohibition of ribā, and by this a society that avoided ribā with sensitivity was created in practice. This sensitivity about ribā manifested in the principle that the suspicion of ribā is evaluated as ribā, and it is ruled as haram like riba. In fiqh sources, besides issues regarding ribā, issues involving suspicion (...) of ribā were also mentioned, and some rulings were justified with the presence of suspicion of riba. However, the logic of using the concept of ribā suspicion in fiqh sources may vary from case to case: the reasoning behind the use of riba suspicion in one case may not fit into another case, and thus a completely different reasoning of ribā suspicion may appear in another case. To clarify the framework of the concept of ribā suspicion, it would be noteworthy to study these each of the uses in the classical fiqh sources. The purpose of this article is to examine the use of the concept of ribā suspicion based on the cases in the Ḥanafī sources. Methodologically, first, the cases in which the concept of ribā suspicion is used are determined. Secondly, the reasoning made for each example is examined by considering the contextual framework of the case. Lastly, these uses are classified and presented to the reader with examples. The principle of evaluating “the suspicion of ribā like ribā” in Islamic law is indeed related to the rule of considering “any suspicion as certainty when it comes to harams or in matters where precaution is substantial”. Since ribā is a haram that Muslims should meticulously avoid, and therefore requires caution, its suspicion is subject to the same rulings as ribā itself. In the Hanafi fiqh books, the concept of suspicion of ribā is mostly referred in the following cases: - Not knowing whether there is equality between the subject matters in barter transactions where equality is stipulated. For example, when exchanging two batches of the same kind of ribawi goods, though quantities are unknown. - It is not known whether tariq al-itibār has taken place in changes that may be permissible through tariq al-itibār. For example, in the exchange of a silver-embroidered sword with silver, if the amount of silver in the ornamented part is not known, the suspicion of ribā arises. - The emergence of a situation similar to ribā because of a transaction that is normally permissible: While there are two legitimate sales in Bay' al-inah, the conclusion of being the same as an interest bearing loan is considered as ribā suspicion. - When the case has two different sides; from one side the act is ribā, but from other side it is not. For example, in the case of salam contract of ribawi goods, if goods of different quality are brought during delivery and the quality difference is requested from the customer; suspicion of ribā arises. Apart from these uses in the Hanafi fiqh books, it is seen that the concept of ribā suspicion is employed to prove an opinion disputed between schools of Islamic law. For example, to argue that ribā rules are also valid for goods sold by piece (adadiyyāt) or by length measures (zirāiyyāt), the Hanafis say that one of the two causes (illah) of ribā is found in the exchange of these goods by type, and the suspicion of ribā arises with just a single cause (illah). On the other hand, the Shafiis use the concept of suspicion of ribā to argue that determining the subjects (ta’yin) in the exchange of ribavi goods other than gold and silver is not sufficient. Another use of the term emerges because of the authors' preference for a cautious language. Some authors acted cautiously on some cases that were normally ribā and were described by other authors in this manner, and used the term "ribā suspicion" instead of ribā; probably as they both require the same ruling (harām). Another wrongly used (in our opinion) is the use of “suspicion of ribā” in some cases that are actually considered only as disliked acts (makruh). (shrink)

Mescidler, Mescid-i Haram gibi güven, huzur, istikrar veren özgün yapılardır. Mescidler; terbiye, eğitim, irşâd, tefekkür, birlik ve beraberlik, dayanışma, yardımlaşma vurguları ile toplumun sosyal açıdan gelişmesini sağlar. İslâm tarihinde camilerin ifa ettiği vazifeler, İslâm dininin diğer muharref dinler gibi dinle dünya işlerinin arasını ayırmadığını, dini kalbe hapsetmediğini göstermektedir. Hz. Peygamber ve sahabeler döneminde mescidler çok amaçlı mekânlar olarak kullanılmaktaydı. Mescidlerin (...) Hz. Peygamber dönemindeki fonksiyonelliğini kaybetmesi toplum üzerindeki etkinliğini zayıflatmıştır. Mescidler günümüzde sosyal etkinliklerle canlı duruma getirilmeli ve öyle ki mescidler/camiler hayat olmalıdır. Makalemizde mescid kavramın Kur’ân ve hadislerdeki yeri, önemi, işlevi incelenecek ve mescidlerin tarihsel serüveni ve fonksiyonları hakkında bilgi verilecektir. Çalışmamız, ülkemizde camilerin asli fonksiyonlarına dönmesi ve toplumsal alanda etkinliğinin arttırılması hedeflemektedir. One solution to prevent the spread of coronavirus disease 2019 (COVID-19) is getting vaccinated. The promotion of vaccines through religion helps to control the pandemic. One of the causes of doubts about vaccination in society is religious understanding. Vaccination has an important correlation with Islamic law or Islamic jurisprudence. This research aims to analyse the effect of understanding Islamic law on doubts about vaccination. This research used quantitative pre-experimental designs. The research sample consisted of 160 people who were not vaccinated. (...) The sampling technique involved a non-random sampling method. The data analysis is descriptive and inferential. The results of this research showed the following: (1) the understanding of Islamic law related to the status of halal and haram has a positive influence on the Muslim community's willingness to vaccinate, (2) the understanding of the emergency concept can increase confidence in vaccines and (3) the education related to understanding Islamic law can effectively reduce doubts about vaccination. CONTRIBUTION: This research provides knowledge about the COVID-19 vaccine from the perspective of Islamic law. This research provides a new strategy to reduce public doubts about vaccination. Cet article commence par examiner tous les témoignages textuels permettant de situer des églises dans la Cordoue des VIIIe-Xe siècles et ses environs. La conclusion est que si l�on rencontre bien des lieux de culte chrétiens dans la campagne et dans la montagne (notamment les monastères de la sierra), ainsi que dans les « faubourgs » (arrabales) de la ville, il est impossible d�en situer avec certitude à l�intérieur de la madi-na, la vieille ville entourée de murailles. La seconde partie (...) du travail cherche à expliquer cette situation par l�examen des textes juridiques de l�époque, et notamment une fatwa- de début du Xe siècle, qui déclare qu�on ne peut construire, ou restaurer, des églises, qu�hors de la vue des musulmans, et à l�écart de leur « sanctuaire » (haram). La conclusion est que s�il y avait bien des églises, et des chrétiens pour les fréquenter, dans la Cordoue des VIIIe-Xe siècles, elles étaient situées dans la périphérie urbaine, leur intégration dans la ville résultant seulement de la croissance de l�agglomération à la fin du IXe et au Xe siècle, en même temps que du mouvement de conversion massive, qui ont réintroduit une mixité religieuse que les autorités islamiques prétendaient éviter. Ibn al-Qāṣṣ (d. 335/946), one of the representatives of the Shāfiʿī school of law in the 4th/10th century, compiled a short treatise of extraordinary nature: Fawāʾid Ḥadīth Abī ʿUmeyr. In this work, he deduces sixty different wajhs (verdicts, comments) from a ḥadīth reporting the Prophet’s interest and affection to a child known as Abū ʿUmayr and his family during a visit he paid after Abū ʿUmayr’s birdie died by jokingly telling him in rhyme, “yā Abā ʿUmayr, mā faʿala al-nughayr” (O (...) Abū ʿUmayr, what happened to the nughayr?) This study deals with the primary goal of the composition of the Fawāʾid, its content, and structural qualities as well as the author’s approach in deducing verdicts. As one of the aṣḥāb al-wujūh, the author’s legal/madhhab notion and the literalist and external perspective he developed regarding the interpretation of texts, seems to have directly affected his deductive reasoning and determined his approach. This concise work not only sheds light over certain aspects of the relationship between ḥadīth and fiqh at the time of Ibn al-Qāṣṣ, but also exemplifies to what extent methodological tendencies and personal factors might affect the process of deriving verdicts from ḥadīth and could push the limits in that regard. The report of Abū ʿUmayr, which is in the focus of the work, is, in essence, reflects a singular and special aspect of the close relationship between the Prophet and Anas b. Malik’s family. Nevertheless, it is surprising that many ḥadīth scholars from the early times, not only Ibn al-Qāṣṣ, have chosen this ḥadīth as an example in which they can demonstrate their skill in the field of fiqh al- ḥadīth. Fawāʾid seems to be a work in which the juridical point of view centered and resembles the classical fiqh commentaries in a sense. In the work, different variants of the Abū ʿUmayr report were brought together and evaluated within the framework of the text and textual possibilities as possible. The author also analyzed some words in the narrative text for being a base for a verdict, referred to Qurʾānic verses, prophetic ḥadīths, reports, and legal opinions, tried to solve the disputes and the conflicts among legal evidences in various ways, and stated occasionally his personal opinions. Fawāʾid reflects the author’s rich accumulation of legal knowledge, while at the same time gives an idea about his knowledge of ḥadīth and his approach to the ḥadīth. Considering what the author did and wanted to do, it is understood that he deals with ḥadīth as well as fiqh, and he has a certain level of relationship not only with fuqahāʾ (muslim jurisprudents), but also with ḥadīth scholars. Ibn al-Qāṣṣ’s interest in fiqh and ḥadīth must have lead him to take initiative to eliminate the tension between the ahl al-ḥadīth of Shāfiʿī school of law who focused on transmitting ḥadīths and the fuqahāʾ of Shāfiʿī school of law who care about the fiqh perspective, in that period of time. It can also be said that he tried to establish a reconciliation between the ahl al-ḥadīth (the traditionists) and the ahl al-raʾy (the rationalists) and bring the parties together in the middle way. The work seems to have been written as a result of such considerations. As Ibn al-Qāṣṣ was considered as one of the aṣḥāb al-wujūh, that is, as a jurist who was bound of a madhhab Imām for legal reasoning, he seems to have followed the methodology of Shāfiʿī school of law for deriving legal solutions from the sources. Legal notion of the author and his literalist and textualist perspective with regards to the interpretation of texts, seems to have directly affected his way of reasoning from the ḥadīth and determined his approach. This approach, as mentioned in many contemporary studies, is not sufficient and appropriate for the evaluation of ḥadīth texts, which were transmitted by meaning, not word-by-word, and shaped by the transmitter’s dispositions. It is also difficult to say that Ibn al-Qāṣṣ sufficiently considered the physical, historical, social, and cultural context surrounding the text as well as other extra-textual elements, which complete the meaning. This situation implies that some of the wajhs recorded in the work are the author’s attempt to find a base and evidence for his ideas, which he already had, rather than deductions drawn from the ḥadīth. It makes the scientific quality and accuracy of his efforts controversial. The verdicts presented in the work, as wajh and fāʾida are predominantly jurisprudential and compatible with the opinions of the Shāfiʿī School of law, however, there are also controversial ones, and the author pointed to them without revealing his own tendency. It does not seem that these wajhs in the work are systematically ranked. In this vein, similar wajhs are sometimes in succession, sometimes scattered, and some wajhs are repetitive. The degree of accuracy, clarity and quality of some wajhs also seem arguable. Zayn al-Dīn al-ʿIrāqī (d. 806/1404), who made a general evaluation of these wajhs, said that: “Some of the (meanings of the) wajhs in the work are apparent, some of them are hidden and some are strained.” The work’s editor drew attention in the footnotes to the wajhs, which might be subject to objection. The early ḥadīth scholars, who reported this ḥadīth in their compilations, deduced six or seven judgments from the ḥadīth under the headings (bāb) specified for this ḥadīth. This appears quite modest in comparison to the treatise of Ibn al-Qāṣṣ. The given ḥadīth has also taken its place in the fiqh literature, and it has been questioned in the context of the issue of Madīna’s being of ḥarām region (holy land) and hunting ban in this region. In conclusion, Ibn al-Qāṣṣ’s treatise of Fawāʾid Ḥadīth Abī ʿUmayr, is a short but worthy example of the ḥadīth literature in terms of its purpose and interesting content. This work can be considered as a study that exemplifies how the purpose of writing can be determinative on the structure of a work, and in particular to what extent methodological tendencies and personal factors might affect the process of deriving verdicts from ḥadīth and could push the limits in that regard. The author’s universe of meaning, which focused on the apparent meaning and to draw as many judgments as possible from the text, should be related to his personal intention and purpose as well as to the fiqh perspective of his time. Due to the textual approach and the method for drawing inferences, which are observed in the work, the tool-purpose relationship between the text and the judgment sometimes remains obscure and sometimes becomes unimportant. In some respects, this work is a striking example of the consequences of ignoring the context and historical reality surrounding texts for specific purposes. (shrink)

In lieu of an abstract, here is a brief excerpt of the content:preface The essays in this special issue on Indigenous Feminisms in Settler Contexts engage feminist politics from multiple Indigenous geographies, histories, and standpoints. What emerges is a panoramic view of Indigenous feminist scholarship’s conceptual, linguistic, and artistic activism at this moment in time. We learn of praxis aimed at reclaiming Indigenous languages and ecological perspectives and the varied modes of resistance, survivance, and persistence. We also unpack the complex (...) racial/gender politics of colonial encounters in contexts where white women cared intimately for Indigenous children, or where they helped to recover Indigenous oral traditions, and we note how modes of help can also reproduce imperial power relations. Some essays, art works, and poems extend the geographic ambit of critiques of settler colonialism beyond American contexts: they deploy feminist rubrics to critique the continuing violent settlement of Palestine and Kashmir to demonstrate that the occupation of “marginal” places is constitutive of state-​ society relations; others describe how Australian Aboriginal and Sámi artists engage the question of Indigenous visibility. In different ways, they each show how staying in place, against all odds, can be radical. Our first two articles examine the politics of praxis. Michelle M. Jacob, Virginia R. Beavert, Regan Anderson, Leilani Sabzalian, and Joana Jansen analyze Indigenous feminist praxis surrounding Ichishkíin Indigenous language education. The “artivism” of Sámi artists Maxida 284Preface and Timimie Märak, which expresses concern for land and water rights, gender and sexuality, and Indigenous rights in Northern Europe takes center stage in Kyle Bladow’s essay. The next three articles interrogate historical records shaping Indigenous lives in northern Canada, southwest Pacific, and southwestern United States and Mexico. Val Marie Johnson examines how white women staff members’ intimate care relations at residential schools for Inuvialuit, Inuinnait, and Iñupiat peoples in Canada were bound up with the latter’s dispossession. Carolyn J. Eichner recounts the encounter between the Indigenous Kanak people and Louise Michel, a feminist and participant in the revolutionary Paris Commune of 1871 who was banished to New Caledonia for seven years; Eichner argues that although Michel was staunchly anti-imperialist, her liberatory political project bore the temporal logics of colonization. Drawing on examples of Nahua reconfigurations of Christian scripture, Kenna Neitch proposes the language of “persistence” as a heuristic for avoiding the reactive, relational connotations that can pervade scholarly usages of “resistance” rhetoric. Next, our review essay by Jennifer McLerran describes recent Indigenous feminist scholarship that recasts the concept of sovereignty. Our News and Views piece focuses on modalities of occupation in the context of Kashmir: Nosheen Ali, Mona Bhan, Sahana Ghosh, Hafsa Kanjwal, Zunaira Komal, Deepti Misri, Shruti Mukherjee, Nishant Upadhyay, Saiba Varma, and Ather Zia argue that occupation is foundational to the making and reproduction of nationstates, and not exceptional to state power. The varied forms of resistance to occupation are examined by Sara Ihmoud in her article about how a group of Palestinian women, the Murabitat al-Haram, agitate for religious freedom simply by “staying in place.” Rabab Abdulhadi comments on shifts in contemporary settler colonial discourse in Israel, noting the increasingly overt and unapologetic deployment of highly sexualized and gendered images. Marina Tyquiengco examines the art of Australian Aboriginal artist Fiona Foley, specifically her Black Velvet series. Art and myth are also fused in Shantell Powell’s textual and visual rendering of Inuit memory. This issue features a range of poetry on topics such as language loss, human-land relationships, and sexual violence, written by Katherine Agyemaa Agard, Kei Kaimana, and Kai Minosh Pyle, and curated by our creative writing editor, Alexis Pauline Gumbs. In “Átaw Iwá Ichishkíin Sínwit: The Importance of Ichishkíin Language in Advancing Indigenous Feminist Education,” Michelle M. Jacob, Preface 285 Virginia R. Beavert, Regan Anderson, Leilani Sabzalian, and Joana Jansen examine Indigenous feminist praxis surrounding Ichishkíin-language education. Makalede İlâhî vahyin insanın ontolojik gerçekliğini göz ardı etmediğini, ontolojik gerçekliği üzerinden insanlara mesaj verdiği konusu ele alınmıştır. Bu durum, rüya ve şeriatlerin farklılığıyla ispat edilmeye, bu fikre temayül gösteren ancak Kur’ân hakkında olumsuz bir argüman olarak kullanan Montgomery Watt gibi müsteşriklere de cevap verilmeye çalışılmıştır. Bu yapılırken ilk önce bilinçaltının anlaşılması hususunda bazı örnekler verilmiş sonra rüya sembollerinde baskın olan kültürel unsurlara temas edilmiştir. Rüyalardaki sembollerin şekillenmesinde mantıksal bağı irdeleyen İslam ulemasının açıklamalarına ve rüya tevillerine de yer verilmiştir. Bu (...) yorum ve tevillerden anlaşıldığı kadarıyla insanlarda ortak görülen sembollerin Jung’un arketip, İslam ulemasının ise zihinsel kalıp ve manaların elbisesi dediği bir nevi kültürün kodlarından oluşan bilinçaltı alfabesi tarafından formlaştığı anlaşılmaktadır. Daha sonra şeriat-ontolojik gerçeklik ilişkisi irdelenmiş, dinde bütün insanların ortak fıtratının esas alındığı ve bundan dolayı dinin bütün insanlar için değişmeyen bir olgu, şeriatlerin ise kültürün baskın olduğu ve dolayısıyla bir yönüyle ilişki içinde olduğu toplumsal bilinçaltı olduğu vurgulanmıştır. Kur’ân’da, dinin temel prensipleri ve resullerin üzerine birleştikleri kapsamlı şeriat kanunları dile getirilmiştir. Genel hatlarıyla din, Allah’ın varlıkları üzerine yarattığı (insanın tabiatının kolektif değişmezliğine dayalı) ve bütün mahlûkata sevimli geleni, marufu emretmeyi, münkerden nehyi, temiz şeyleri helal eden, zararlı olan şeyleri haramı eden emirleri içermektedir. İslam ulemasına göre bütün semavi dinlerde esas olan Allah’a, meleklerine, resullerine, kitaplarına ve ahiret gününe iman etmek, insanın yaptığı takdirde Müslüman olacağı fiilleri işlemektir. Bu iman da doğal olarak dünyadan yüz çevirmeyi, ahirete yönelmeyi, güzel ahlakı edinmeyi ve kötü ahlaktan da kaçınmayı gerektirir. Ancak şeriatlar ise birbirinden farklılık gösterebilir. Çünkü şeriatlar dinin indiği toplumun hallerini ve maslahatlarını esas aldığından değişiklik arz eder. Şeriatların farklılaşmasında toplumsal bilinçaltının göz ardı edilmediğini göstermek bağlamında Kur’ân’dan örnekler verilmek suretiyle savunulan tez ispat edilmeye çalışılmıştır. Bunlardan birisi, Kur’ân’da Arapların ortak duygularının esas alınması, kültürel bazı unsurların kullanılması, bir diğeri de yabancı isimlerin Arapların ifade ettiği şekliyle, ümmi anlayışa uygun kullanılmasıdır. Ayrıca bu konuda bazı helal yiyeceklerin Yahudilere haram kılınması ve diğer şeriatlerde yer alan bazı farklılıklar üzerinde durulmuştur. Helal yiyeceklerin haram kılınması konusunda Hz. Yakub’un yakalandığı ağır hastalıktan iyileştiği takdirde sevdiği yiyecekleri yememeyi nezretmesi, buna bağlı olarak iyileşince deve eti ve sütünü yiyip içmemesi, daha sonra çocukları ve ümmetinin de bu yiyeceklerden uzak durması sonucunda Tevrat’ta bunların haram kılınması örneği üzerinde durulmuştur. Bu örnek, şeriatlerin farklılaşmasının nedeninin bir şeye karşı tavrın toplumsal bir alışkanlık halini almasının sonucu olduğu ifade edilmiştir. Nitekim teravih namazının Müslümanlarca toplu kılınması ve buna devam edilmesi durumunda farz kılınır endişesiyle evlerinde kılmalarını tavsiye eden Allah Resulünün endişesinin de bunu pekiştirdiği dile getirilmiştir. Diğer şeriatlerde bazı farklılıklar konusunda ise orucun öncekilere farz kılınmasına rağmen keyfiyetinin farklı olması üzerinde durulmuştur. Aynı şekilde namaz, zekât ve haccın semavî dinlerinin hepsinde olmasına rağmen keyfiyetinin değiştiği örneklerle izah edilmiştir. Bu doğrultuda milletlerin yaşam tarzlarının ve kültürünün dolayısıyla toplumsal bilinçaltı şeriatlerin farklılığında gözönüne alındığı ifade edilmiştir. Nitekim İsâ peygambere tabi olanların kendilerine emredilmemekle birlikte Allah’ın rızasını elde etmek için ruhbanlığı kendilerine farz kılmaları ve buna devam etmeleri karşısında Allah’ın buna itibar ederek, ruhbanlıkta bulunanlara ücretlerini verdiğini ifade etmesi de bu durumu pekiştirmektedir. Sonuç olarak din ve dine taalluk eden her şeyin insanlığın ortak fıtratını esas aldığını, şeriatten şeriate değişiklik gösteren unsurların da kültürel ve bir yönüyle toplumsal bilinçaltıyla ilgili olan hususlar olduğu ortaya konulmaya çalışılmıştır. The normativity in understanding the hadiths of male physical appearances, such as lengthening the beard, isbal prohibition, and wearing a robe, was still debated by Muslims. This issue was evident, especially in Islamic communities with strong progressive and conservative characters at the same time, like Muhammadiyah. This paper aimed to elucidate the existence of contestation among Muhammadiyah members in understanding and practicing traditions regarding physical appearance. This paper discussed three subjects: first, contestation in the hadith of maintaining a beard; second, (...) the hadith of isbal prohibition; and third, contestation of understanding the hadith of a robe. By using a qualitative descriptive method, it was found that: first, four views of Muhammadiyah members regarding the hadith of keeping a beard: mandatory, Sunnah, ittibâ' to the Prophet, and permissible; second, four views of Muhammadiyah members regarding the hadith of isbal prohibition: haram, makruh, permissible and haram only when worshiping; third, two views of Muhammadiyah members about wearing a robe, having virtue and no virtue. This polarization was influenced by the environmental situation, recitation circles, and book readings. The contestation among Muhammadiyah occurred between progressive groups driven by Muhammadiyah activists and conservative groups driven by Salafists. The infiltration of conservative Salafist forces in Muhammadiyah needs more serious attention from its leaders to immediately address this issue to maintain a moderate Islamic character of Muhammadiyah.
