On the 16th of May 2002, the Belgian House of Representatives approved of a Bill on euthanasia. Belgium is now the second country in the world, next to the Netherlands, that has legislation which under certain conditions legitimizes euthanasia. In this article the Belgian legislative procedure on euthanasia is looked upon from a political point of view. To be able do so first of all the legal context on euthanasia before the new bill was approved of has to be discussed. (...) Then the political history of the process of legal change with regard to euthanasia is analysed from 1980 onwards. And finally the Belgian process of legal change on this subject is compared with the process of legal change in the Netherlands. (shrink)

A journey from cultural memory through recall to transformation of historical grievances is elucidated with the aid of phenomenological thought. The context for this study is a conflict resolution project undertaken by the Center for the Study of Mind and Human Interaction of the University of Virginia. Russians and Estonians of Klooga participated in a group meeting aimed at resolving ethnonational conflict. This meeting is described, and the potential of phenomenology in an interdisciplinary approach to conflict resolution is explored.

There are non-governmental organizations that operate transnationally and there are those that operate within the boundaries of a nation. A third use of non-governmental organizations is articulated. We may call this third category an instrumental use of non-governmental organizations to facilitate the transfer of the work of third-party conflict resolution practitioners to the two previously feuding parties. Representative accounts are provided in Part I of this paper. In Part II, the instrumental use of the NGO to transfer knowledge from practitioners (...) to the indigenous and previously feuding parties is depicted as a means to fill a practice gap in the field of conflict resolution, where many praxes do not examine the transfer of knowledge in an experiential and discovery-oriented way. An alternative is presented where the process of appropriation is suggested as an object of study. In Part III, a conceptualization of how one may determine the phenomenology of a sense of ownership of the project by the previously feuding parties is provided. A phenomenological account of the journey from constituting subjectivity to a constituted objectivity is articulated to the point where we see a division of labour between Husserl’s transcendental project, that seeks universal and broader essences, and psychology, which is highly contextualized. Part IV constitutes the implementation of the praxis to answer the specific question, “What is the sense of ownership of the parties in conflict?” - and, derivatively, “What is the fate of the hitherto agonistic relation?” A conflict resolution model is consolidated or reconfigured using the lessons drawn from the results of the study and from a second look at the literature to see where changes in practice and reconceptualization may be required. Technology and its interfaces with nursing care, patients and carers, and the home are many and varied. To date, healthcare services research has generally focussed on pragmatic issues such access to and the optimization of technology, while philosophical inquiry has tended to focus on the ethics of how technology makes the home more hospital like. However, the ethical implications of the ways in which technology shapes the subjectivities of patients and carers have not been explored. In order to explore this, (...) poststructural theory, in particular the work of Butler, Foucault, and Deleuze, is used to theorize the relationship between subjectivity and materiality as ethically mandated on producing rather than precluding the development of subjectivities in novel ways. This theoretical understanding is then utilized through a process of ‘plugged in’ as described by Jackson and Massie that aims to link empirical data, research, and philosophical inquiry. Through this process, it is suggested that power, which the empirical data demonstrate, is frequently exercised through medical discourses and restricts patients' and carers' ability to shape the material environment of the home as a place to live and be cared for in palliative stages of illness. Alternative discourses are suggested both from the empirical data as well as other research, which may offer patients and carers the possibility of reclaiming power over the home and their subjectivities. Finally, the dichotomy between the home and hospital, mediated via technology, is posited as being problematic. It is argued the dichotomy is false and should be moved away from in order to allow an ethical embrace of technology in palliative care. (shrink)

Galileo's Dialogue (1632) can be read from the viewpoints of methodological judgment and critical reasoning; methodological judgment means the avoidance of onesidedness and extremes; and critical reasoning means reasoning aimed at the analysis and evaluation of arguments. Classic sources for these readings are Thomas Salusbury (1661) and the Port-Royal logicians (1662). This focus does not deny the book's scientific, historical, rhetorical, and aesthetic dimensions; it is critical of excessively rhetorical readings; and it suggests solutions to the problems of hermeneutical pluralism, (...) interpretation versus evaluation, and theory versus practice. The book's methodological judgment and critical reasoning can be shown to correspond to Galileo's self-reflections. (shrink)

Reprenant les principales dimensions psychopathologiques participant à la compréhension des conduites addictives alimentaires, et les articulant avec les mécanismes neurobiologiques générant et entretenant une véritable addiction, nous privilégions une approche psychosomatique qui permette d’éclairer certaines données cliniques, d’affiner nos attitudes thérapeutiques et d’ouvrir notre réflexion à des perspectives de recherche nouvelle. Dans une approche étiopathogénique, transnosographique, intégrant l’impact de l’environnement socioculturel et des dimensions transgénérationnelles, nous avons évoqué, dans le dysfonctionnement des interrelations précoces et ses conséquences sur le développement de (...) l’enfant et le processus d’adolescence, une hypothèse centrale dans les conduites addictives alimentaires : la défaillance du maternel chez les mères des patientes, en particulier dans l’investissement du corps autonome, vivant et érotique de l’enfant. Cette défaillance ne favoriserait pas une bonne intégration du féminin chez le sujet et participerait à l’avènement d’une organisation sadomasochiste qui le fixe à ses objets infantiles. Sur la base de ces modalités de construction identitaire, nous avons abordé la génèse de ces conduites en soulignant successivement le développement, du fait du défaut de contenant maternel (pare-excitant, organisateur et liant des motions pulsionnelles de l’enfant), d’une organisation dépressiveantidépressive (dépressivité), témoin d’une rupture du développement; celui d’une inactivation partielle, et dans certains domaines, des processus de mentalisation défensive du rapproché relationnel vécu comme emprise (alexithymie). L’organisation symptomatique évolue, selon nous, vers une modalité corporelle et comportementale de régulation de l’équilibre du sujet afin de parer à un risque dépressif ou de désorganisation. Ce processus de régulation touche le système plaisir-déplaisir avec la génèse d’un autosadisme et d’un masochisme moral, source d’une jouissance endogène « à défaut ». Ces dimensions ouvrent la voie à un frayage psychosomatique d’autant que les « solutions » névrotiques et perverses sont en échec, et qu’une pathologie organique secondaire à la conduite constitue un point d’appel de substitution d’une invalidité physique à une invalidité psychique.
