The primary objective was to review pediatric ethics consultations at a large academic health center over a nine year period, assessing demographics, ethical issues, and consultant intervention. The secondary objective was to describe the evolution of PECs at our institution. This was a retrospective review of Consultation Summary Sheets compiled for PECs at our Academic Health Center between January 2008 and April 2017. There were 165 PECs reviewed during the study period. Most consult requests came from the inpatient setting, with (...) the Pediatric and Neonatal Intensive Care Units being the highest utilizers. Consultation utilization increased over the study period. The most common patient age was less than one year. Physicians were most likely to request consultation. Patient Best Interest, Withholding/Withdrawing of Life Sustaining Therapy, and Provider Moral Distress were ethical issues most commonly identified by the consultants. Making recommendations was the most common consultant intervention. The ethics consultation process evolved over time from informal provider discussions, to a hospital infant care review committee, to a pediatric only consultation service, to a combined adult/pediatric consultation service, with variable levels of salary support for consultants. Ethics consultation requests are growing at our institution. Similarities in identified ethical issues exist between our findings and existing literature, however meaningful comparisons remains elusive secondary to variability in approaches to investigation and reporting. A combined paid/volunteer/trainee ethics consultation service model appears sustainable and real time ethics consultation is feasible using this approach. (shrink)

This book argues that, despite recent calls to arms to seek out and remove "corporate psychopaths" from the business world, efforts to eliminate the corporate psychopath presence would be illegal as well as unethical.

In cases in which many causes together bring about an effect, it is common to select some as particularly important. Philosophers since Mill have been pessimistic about analyzing this reasoning because of its variability and the multifarious causal and pragmatic details of how it works. I argue Mill was right to think these details matter but wrong that they preclude philosophical analysis of causal selection. I show that analyzing the pragmatic details of scientific debates about the important causes of the (...) Bhopal Gas Tragedy can illuminate causal reasoning about disasters and shed new light on causality and causal selection. (shrink)

This article examines genealogical investigations in an attempt to explain what they are, how they work, and what purpose they serve. It is a critique of Robert Brandom’s view of genealogists as naïve semanticists who believe that normative thinking, as it relates to all forms of epistemic inquiry and language use, is reducible to naturalistic causes. This reduction, Brandom claims, is hopelessly misguided and semantically incoherent since genealogies are not epistemically neutral in that “they count no more and no less,” (...) as Habermas put it, than the traditional accounts of moral phenomena that they seek to replace. Nietzsche’s “story” of the origin of guilt in On the Genealogy of Morals is thus not even a useful fiction but merely meaningless. My analysis shows that Brandom’s understanding of genealogy is rather simplistic. While genealogists are naturalists insofar as they attempt to discover the specific historical causes that gave rise to current normative practices, they are neither reductive empiricists nor first-stage semanticists, as Brandom calls them, but multidimensional power-pragmatists. This study develops a Heideggerian thesis on the significance of Dasein's bodiliness. In Grundbegriffe der aristotelischen Philosophie , Heidegger claims that bodiliness secures the ground for the full being of the human. I situate this thesis squarely within die Sache selbst for Heidegger. Die Sache selbst concerns the issue of how being itself is engendered in human understanding . From as early as 1921, Heidegger explicitly understands his central topic in terms of ki&d12;nh siv . That is, the emergence of (...) being in conjunction with the ontological structure of the human being is ultimately intelligible as a kind of movement. The 1924 thesis makes sense ultimately insofar as bodiliness itself is understood as the ontological movement---the original being-moved or pa&d12;qov ---that allows entities to appear within the domain of human concerns. After examining Heidegger's retrieval of several key Aristotelian concepts , I interpret bodiliness as the always already operative being-pulled-out-ahead-of-itself by its own essential lack. Entities are first able to be present to Dasein because Dasein is opened in this way. Thus, bodiliness on my reading is die Sache selbst. My interpretation of Heidegger's thesis also forms the interpretive starting point for a rereading of Geworfenheit and Gewesenheit as concepts of bodiliness. As Dasein's original pa&d12;qov , bodiliness in Sein und Zeit would go by the name die gewesene Geworfenheit: the a priori or always already operative thrown-open-ness that first allows being to emerge to human understanding. Fictionalists believe that scientific models are about model systems that are imaginary. Michael Weisberg has claimed that fictionalism is indefensible because many scientific models are about model systems that are unimaginable. According to a certain account of imagination, what Weisberg says is plausible. According to another, more defensible account of imagination, it is not. I discuss these issues within the context of an allegedly unimaginable model system in ecology, but the conclusions I draw are more general. I then describe how (...) fictionalism should be recast in order to deal with Weisberg’s critique. (shrink)

Ernest Adams has claimed that a probabilistic account of validity gives the best account of our intuitive judgements about the validity of arguments. In particular, he claims, it has the best hope of accounting for our judgements about many arguments involving conditionals. Most of the examples in the literature on this topic have been arguments framed in the language of propositional logic. I show that once we consider arguments involving predicates and involving identity, Adams’s strategy is less successful.

Barrett and Artzenius posed a problem concerning infinite sequences of decisions. It appeared that the strategy of making the rational choice at each stage of the game was, in some circumstances, guaranteed to lead to lower returns than the strategy of making the irrational choice at each stage. This paper shows that there is only the appearance of paradox. The choices that Barrett and Artzenius were calling ‘rational’ cannot be economically justified, and so it is not surprising that someone who (...) makes them ends up with sub-optimal returns. A solution to the more general problem they pose is also advanced. (shrink)

Our primary interest this week will be in two objections Jackson mentions which seem to threaten his program. Each of them is avoided by appeal to the two-dimensional framework we sketched last week. Before we go over that framework again, we will start by looking at the objections. For reasons that may become apparent shortly, we will look at them in reverse order. Abstract.In the debates about legal determinacy, an important but often neglected issue is what is meant in the legal context by saying that a question has a right answer. By way of a critique of A. D. Woozley's discussion of “right answers,” I try to show how this issue is connected with issues of legal truth, legal mistake, and precedent.

If the desire to see God in Himself belongs to human nature, but the attainment of that vision can be affected only by supernatural grace, how is it that this desire remaining unfulfilled is not a frustration of the nature? How is it that nature is aiming at a good in vain, at an object that it cannot achieve? Even though the elicited natural desire to see God is not fulfilled in this life, and even though there is no demonstrative (...) proof that can be provided by natural reason alone of its being fulfilled after death, the natural human desire is nevertheless not frustrated by a natural deficiency. Rather than being contrary to human nature, this lack of fulfillment exists because of that nature, inasmuch as every human is by nature a limited intellector of being. (shrink)

The Seminary of the Good Shepherd commenced at Homebush in 1996, following the closure of St Patrick's College at the end of 1995. In his quinquennial report for the years 1993-98, Cardinal Clancy made some comments on the move. He explained that the transition from one site to another provided a unique opportunity to examine past traditions. In his lengthy survey of the cosmic devastation wrought by Phaethon's disastrous chariot ride, Ovid includes two catalogues detailing the scorching of the world's mountains and rivers. Ovid enlivens these lists through his usual play with sound patterns and revels in the opportunity to adapt so many Greek names to Latin prosody; for instance the opening line of the catalogue of mountains masterfully illustrates both of these features. The lists are also brimming with playful erudition. To take but a few (...) examples: a dried-up Ida belies its standard epithet πολυπῖδαξ, ‘many-fountained’ ; the sun's heat doubles the flames of volcanic Etna ; burning Xanthus is destined to burn again ; and the famous gold-bearing sands of the Tagus are melting. These features not only ‘relieve monotony’; they warrant the catalogues’ inclusion in the category of Ovid's most entertaining. (shrink)
