Political corruption imposes substantial costs on shareholders in the U.S. Yet, we understand little about the basic factors that exacerbate or mitigate the value consequences of political corruption. Using federal corruption convictions data, we find that firm-level economic rents and monitoring mechanisms moderate the negative relation between corruption and firm value. The value consequences of political corruption are exacerbated for firms operating in low-rent product markets and mitigated for firms subject to external monitoring by state governments or monitoring induced by (...) disclosure transparency. Our results should inform managers and policymakers of the tradeoffs imposed on firms operating in politically corrupt districts. (shrink)

We review the dynamical approach to spacetime theories---in particular, its origins in the development of special relativity, its opposition to the contemporary `geometrical' approach, and the manner in which it plays out in general relativity. In addition, we demonstrate that the approach is compatible with the `angle bracket school'.

The idea that science is or should be value-free, and that values are or should be formed independently of science, has been under fire by philosophers of science for decades. Science and Moral Imagination directly challenges the idea that science and values cannot and should not influence each other. Matthew J. Brown argues that science and values mutually influence and implicate one another, that the influence of values on science is pervasive and must be responsibly managed, and that science (...) can and should have an influence on our values. This interplay, he explains, must be guided by accounts of scientific inquiry and value judgment that are sensitive to the complexities of their interactions. Brown presents scientific inquiry and value judgment as types of problem-solving practices and provides a new framework for thinking about how we might ethically evaluate episodes and decisions in science, while offering guidance for scientific practitioners and institutions about how they can incorporate value judgments into their work. His framework, dubbed "the ideal of moral imagination," emphasizes the role of imagination in value judgment and the positive role that value judgment plays in science. (shrink)

It is unclear whether someone’s responsibility for developing a disease or maintaining his or her health should affect what healthcare he or she receives. While this dispute continues, we suggest that, if responsibility is to play a role in healthcare, the concept must be rethought in order to reflect the sense in which many health-related behaviours occur repeatedly over time and are the product of more than one agent. Most philosophical accounts of responsibility are synchronic and individualistic; we indicate here (...) what paying more attention to the diachronic and dyadic aspects of responsibility might involve and what implications this could have for assessments of responsibility for health-related behaviour. Susan Okin criticizes John Rawls’s ‘political liberalism’ because it does not apply principles of justice directly to gender relations within households. We explain how one can be a ‘political liberal feminist’ by distinguishing between two kinds of justice: the first we call ‘legitimacy justice’, conceptions of which apply to the ‘legally coercive structure’ of society; the second we call ‘ethos justice’, conceptions of which apply to citizens’ ‘non-coercive’ relations. We agree with Okin that a society in which most persons act (...) in accordance with ‘gender equal’ ethos justice is morally superior to one in which most persons do not. A shared commitment to a particular conception of ethos justice, however, cannot be required by a conception of legitimacy justice. A political liberal feminist is committed to promoting gender equality with respect to both legitimacy justice and ethos justice, but recognizes that different means are necessary to do so. (shrink)

Ronald Dworkin's work on equality has shaped debates in the field of distributive justice for nearly three decades. In this book Alexander Brown attempts to provide a critique but also a defence of that work, and to extend equality of resources globally.

Contextualism is motivated by cases in which the intuitive correctness of a range of phenomena, including knowledge attributions, assertions and reasoning, depends on the attributor's context. Contextualists offer a charitable understanding of these intuitions, interpreting them as reflecting the truth value of the knowledge attributions and the appropriateness of the relevant assertions and reasoning. Here, I investigate a range of different invariantist accounts and examine the extent to which they too can offer a charitable account of the contextualist data.

This paper addresses the political constraints on science through a pragmatist critique of Philip Kitcher’s account of “well-ordered science.” A central part of Kitcher’s account is his analysis of the significance of items of scientific research: contextual and purpose-relative scientific significance replaces mere truth as the aim of inquiry. I raise problems for Kitcher’s account and argue for an alternative, drawing on Peirce’s and Dewey’s theories of problem-solving inquiry. I conclude by suggesting some consequences for understanding the proper conduct of (...) science in a democracy. (shrink)

Health promotion efforts are commonly directed towards encouraging people to discard ‘unhealthy’ and adopt ‘healthy’ behaviours in order to tackle chronic disease. Typical targets for behaviour change interventions include diet, physical activity, smoking and alcohol consumption, sometimes described as ‘lifestyle behaviours.’ In this paper, I discuss how efforts to raise awareness of the impact of lifestyles on health, in seeking to communicate the need for people to change their behaviour, can contribute to a climate of ‘healthism’ and promote the moralisation (...) of people’s lifestyles. I begin by summarising recent trends in health promotion and introducing the notion of healthism, as described by Robert Crawford in the 1980s. One aspect of healthism is moralisation, which I outline and suggest is facilitated by efforts to promote health via information provision and educational strategies. I propose that perceived responsibility plays a role in mediating the tendency to moralise about health and behaviour. Since I argue that states ought to avoid direct and indirect moralisation of people’s health-related behaviour, this suggests states must be cautious with regard to the use of responsibility-indicating interventions to promote health. In this paper, I focus on the most important form of argument for anti-intellectualism, one that exploits alleged connections between knowledge and practical reasoning. I first focus on a form of this argument which exploits a universal principle, Sufficiency, connecting knowledge and practical reasoning. In the face of putative counterexamples to Sufficiency, a number of authors have attempted to reformulate the argument with a weaker principle. However, I argue that the weaker principles suggested are also problematic. While he was in the employ of the Elector of Mainz, between 1668 and 1671, Leibniz produced a series of important studies in natural law. One of these, dated between 1670 and 1671, is especially noteworthy since it contains Leibniz's earliest sustained attempt to develop an account of justice. Central to this account is the notion of what Leibniz would later come to call `disinterested love', a notion that remained essentially unchanged in Leibniz's work from this period to the end (...) of his life. Through his notion of disinterested love, Leibniz sought to resolve the supposed conflict between self- and other-regarding motives. For a variety of reasons, many commentators have failed to understand the basis of Leibniz's proposed resolution. My purpose in the present paper is to clarify the terms in which Leibniz effected this resolution, as well as to point out important developments in his later thought concerning the relation between pleasure, good, and happiness. It is the encounter between Thomas Merton in the last year of his life with my Tibetan Buddhist teacher, Chogyam Trungpa, Rinpoche, early in his teaching career in (...) the West. This encounter has deeply influenced my life of dialogue, for they initiated what I came to understand as a new kind of interreligious dialogue—the dialogue of contemplative practice. It is the kind of dialogue Trungpa introduced to Naropa University in the late 1970s in Merton’s honor, and it has influenced our university ever since.Thomas Merton, Father Louis, was fifty-three years old when stepped off the plane in India for his much-anticipated Asian journey. Excited and jet-lagged, he met the twenty-eight-year-old Tibetan monk Chogyam Trungpa, who had returned to India and Bhutan for a retreat after five years of study at Oxford University and a new venture of teaching dharma to Westerners. Trungpa’s English would have been accented but comprehensible, and his curiosity about Christian monasticism was at its peak. Merton was “coming home” to a place he had never been, visiting Asia to look for true spiritual masters about whom he had read for so many decades. He was later to admit to a special attraction to the Tibetans.On Merton’s first day in India, he and Trungpa found each other over many gin and tonics at the Central Hotel in Calcutta, talking about the contemplative life and its challenges in the twentieth century. It was the first of a number of conversations over the next few months. In his journals Merton commented:the important thing is that we are people who have been waiting to meet for a long time. Chogyam Trungpa is a completely marvelous person. Young, natural, without front or artifice, deep, awake, wise. In the 1971 edition of his autobiography, he wrote, “Father Merton himself was an open, unguarded, and deep person. He proposed that we should collaborate on a book bringing together sacred writings of the Catholic and Vajrayana Buddhist traditions.”2 In another reflection, Trungpa commented, “Meeting Thomas Merton was wonderful; he was like a child, and at the same time, he was full of energy and life.”3 Still later, Trungpa was to conclude, “I had the feeling that I was meeting an old friend, a genuine friend … [Father Merton] was the first genuine person I met from the West.”4Later, Trungpa was deeply saddened by Merton’s premature death, feeling he had lost a heart friend, a genuine dialogue partner. Thirteen years later, Trungpa launched a series of seven landmark dialogue conferences at the fledgling university that he had founded, Naropa Institute in Boulder, Colorado. From the beginning, Trungpa dedicated these gatherings to “Fr. Merton” and said that he sought to cultivate the kind of conversations between genuine contemplatives that he had discovered with Merton. How wrong is it to deceive a person into having sex with you? The common view seems to be that this depends on the nature of the deception. If it involves something very important, such as your identity, then the wrong done is very serious. But if it involves something more trivial, such as your natural hair colour, then the wrong seems less great. Tom Dougherty rejects this view. He argues that sexual deception is always seriously wrong. In this paper, (...) I present a response to Doughterty’s argument. I propose an analysis of the wrongness in deception according to which acts of deception, in sexual relations and elsewhere, may differ in their degree of wrongness, and some may not be seriously wrong. Ethics has been identified as an important factor that potentially affects auditors’ professional skepticism. For example, prior research finds that auditors who are more concerned with professional ethics exhibit greater professional skepticism. Further, the literature suggests that professional skepticism may lead the auditor to more vigilantly resist the client’s position in financial reporting disputes. These reporting disputes are generally resolved through negotiations between the auditor and client to arrive at the final reported amounts. To date, the role that professional skepticism (...) potentially plays in the negotiation process has been relatively unexplored. The literature prior to the enactment of Sarbanes–Oxley (SOX) suggests that auditors are more likely to approve a client position when the matter in dispute is relatively ambiguous and when changing the client’s position will result in the client failing to meet analysts’ expectations. However, changes resulting from SOX have led auditors to be more vigilant and therefore results found in the pre-SOX environment may not hold in the current environment where auditors are held more accountable for their actions. Results from an experiment with experienced audit managers and partners suggest that in the post-SOX climate, auditors’ negotiations do not appear to be substantively influenced by management being able to meet or beat forecasts. Moreover, we find that when auditors exhibit heightened professional skepticism, they are more ethical by being conservative and they stand more resolute than when auditors do not exhibit heightened professional skepticism. Finally, although we do not find a main effect for the influence of earnings forecast, we do find a significant interaction between earnings forecast and heightened professional skepticism. The present study examined nonprofessionals' perceptions of culturally based and noncultural ethical violations. One hundred seventy-four undergraduates students read 12 vignettes depicting situations in which a clinician committed either a culturally based violation (e.g., sexist or ageist behavior) or a noncultural violation (e.g., breeching confidentiality or multiple relationship). Results indicated that participants were more likely to have unfavorable views of clinicians who had committed culturally based violations. In addition, results suggested that participants would be more likely to report a clinician (...) who had committed a culturally based violation to a supervisor or ethics board. (shrink)

At the time of writing the COVID-19 pandemic was entering its ninth month, with nearly 800 000 recorded fatalities and 22 million infections in 188 countries and territories.1 In previous ethics briefings2 we raised concerns about the possibility that demand for life-sustaining treatment would overwhelm supply, with a consequent requirement for health professionals to make challenging triage decisions. Fortunately, to date, these have largely not been realised, although there is a possibility that countries in which containment measures have been less-successful, (...) such as South Africa, may still be required to triage.3 Despite the successful ‘flattening of the curve’ in many countries, there is a wide consensus that we remain firmly within the pandemic. Enormous practical challenges remain. It is unclear whether the pandemic will ultimately take the form of two or more successive waves, or whether the patchwork of global responses will lead to a sustained slow ‘burn’ with sporadic flare-ups.4 Areas of uncertainty include whether infection confers some immunity, how long any such immunity might last, whether effective vaccines can be developed and if seasonal temperature fluctuations alter the spread of the virus. The pandemic will also be fundamentally shaped by the decisions that governments make and the extent to which their diktats are complied with by citizens. With the – possibly temporary – retreat of urgent clinical ethics issues, such as triage, opportunities have arisen to reflect on some of the ethical questions that underlie and structure the demanding policy decisions that governments are wrestling with. In a recent judgment1 the Court of Protection was highly critical of health professionals for continuing to provide clinically-assisted nutrition and hydration in the face of disagreement about the patient’s best interests, without seeking to resolve the issue. This hearing had been set up specifically to consider whether GU’s dignity had been properly protected, and if not why not, given concerns raised by the Official Solicitor about what she considered to be “a complete abrogation of responsibility to consider properly or (...) at all, and to determine whether it was in GU’s best interests and therefore lawful to continue to give him an invasive medical treatment, CANH.” In April 2014, at 63 years old and living in Thailand, GU sustained severe injuries after suffering from an electrocution accident. He sustained a cardiorespiratory arrest with a significant delay before cardiopulmonary resuscitation was started and was unconscious and unresponsive. In September 2014 he was transferred to the UK. In August 2018, GU’s brother made a request for a best interests decision concerning the continuation of CANH. The family met to discuss this and all except GU’s son, agreed that continuing CANH was not in GU’s best interests. In view of the fact that there was not unanimity among the family, a decision was made that CANH should continue. Commenting on this decision, Mr Justice Hayden said ‘the apparent assumption that in the face of family disagreement ‘ therefore will continue to be cared for by nursing staff ” is a troubling non sequitur’ and stressed that ‘family dissent to a medical consensus should never stand in the way of an incapacitated patients’ best interests being properly identified’. People with disabilities suffer from pervasive inequalities in employment, education, transportation, housing, and health care compared to those who are not disabled. Moreover, people with disabilities are often subject to unjustified stigma and pity. In this paper, I will explain why these disadvantages violate relational egalitarian principles of justice. As I will show, my argument can account for both kinds of inequality that disabled people face.

Let's begin with an old example. In De Rerum Naturua , Lucretius presented a thought experiment to show that space is infinite. We imagine ourselves near the alleged edge of space; we throw a spear; we see it either sail through the ‘edge’ or we see it bounce back. In the former case the ‘edge’ isn't the edge, after all. In the latter case, there must be something beyond the ‘edge’ that repelled the spear. Either way, the ‘edge’ isn't really (...) an edge of space, after all. So space is infinite. (shrink)

Although Peano arithmetic is necessarily incomplete, Isaacson argued that it is in a sense conceptually complete: proving a statement of the language of PA that is independent of PA will require conceptual resources beyond those needed to understand PA. This paper gives a test of Isaacon’s thesis. Understanding PA requires understanding the functions of addition and multiplication. It is argued that grasping these primitive recursive functions involves grasping the double ancestral, a generalized version of the ancestral operator. Thus, we can (...) test Isaacon’s thesis by seeing whether when we phrase arithmetic in a context with the double ancestral operator, the result is conservative over PA. This is a stronger version of the test given by Smith, who argued that understanding the predicate “natural number” requires understanding the ancestral operator, but did not investigate what is required to understand the arithmetic functions. Feynman diagrams have fascinated physicists and philosophers since they were introduced to the world about 70 years ago. Clearly, they help in calculation; they have allowed nearly impossible problems to be solved with relative ease. This is agreed by all, but that is probably where the consensus ends. Are they pictures of physical processes? Are they just devices for keeping track of mathematical formulae, that do the real work? Are they some sort of mix of both?They are almost as famous (...) as representations of the Bohr atom, even though most people could not give even a sketchy account of what they do.
