Aristoteles, zamanı harekette açığa çıkan öncelik ile sonralıktan ve ânın birimler hâlinde düşünülmesinden dolayı sayı olarak betimlemiştir. Bu bağlamda Peripatetik doğa felsefesinde zaman, hareketin sayılması çerçevesinde tartışılmıştır. Halbuki bu sistemde zaman sürekli, sayı süreksiz niceliktir. Dolayısıyla tanım cümlesindeki sayı kavramı; zamanın sayı olmasının nasıl anlaşılacağı, sayının bir sayanı gerektirmesi ve çokluklarla ilişkili olması gibi hususlarda süreksizlik sorununu meydana getirmiştir. Nitekim Aristoteles, sürekli olması dolayısıyla zamanı, sayılan anlamında sayı kabul eder. Helenistik şârihler de zamanın sayı formunda betimlenmesinde, nicelikler arasında süreklilik ve (...) süreksizlik geçişkenliğini çözmeye çalışmıştır. A salient tradition in contemporary affect theory heavily relies on distinguishing between emotions and affects. The former refers to structured categories of socially coded affective states, while the latter denotes the pre-social libidinal flow underlying emotions. This distinction is commonly attributed to Spinoza and is thought to have been further developed by Deleuze. In this article, I argue that this overall historical picture is misleading and inaccurate. Deleuze radically transforms Spinoza’s theory of affect for the ends of his own ethical-political (...) philosophy. Moreover, I argue that Deleuzian and similar conceptualizations of affect fail to fulfill their political and ethical promises due to two critical problems. In the last section, I show that a unified notion of emotion inspired by Spinoza, which does not create a sharp rift between emotions and affect, can perform the same explanatory function intended by the emotion-affect distinction while allowing us to circumvent these problems. The challenges facing the life-worlds of political societies in the Islamic world require a radical shift of perspective that can improve our understanding of the contemporary situation of human rights politics. Not only the classical formulation of secularism, which aims at liberating the public sphere from domination of ‘the sacred’, but also the political-theological approach, which addresses the problems of modernity within the context of a disguised and refurbished dominance of ‘the transcendence’, suffer from and share a basic insufficiency in (...) handling human rights issues. According to these approaches, the basic issue stems from a realignment in relations between logics of the sovereign and the sacred or a redefinition of the position of state against religion. In this article, my object is shifting the scope of discussion concerning the rights beyond this logic of sovereignty by adopting an approach which provides a political ground for discussing the intermingling of religion in the life-world. From my point of view, the first step that should be taken to deepen our understanding of the argument of freedom is to unveil the nature of the sacred within the framework of a power network that longs for control over the whole lives of individuals constituting the society. In this regard, by going beyond the concepts such as fanaticism, fundamentalism or terrorism provided by ‘state mentality’, the significance of lifestyle politics for ‘rights talk’ will become more evident. From this point of view, the detection and critique of a zone of ‘weak citizenship’ constructed through restrictions stemming from the values and norms arising from the perceptions of particular communities organized through family, tradition and justice are essential. Such a critique will pave the way for a radical politicization of lifestyles by way of criteria of the demands for equal respect and dignity. (shrink)

Comprehending the messages of Qurʾān in terms of the relationship between occasions (sīra) and revelation has a profound influence on determining the contextual purpose and shades of meanings. Establishing such relationship necessitates dating sūras and verses. Although there are some oral transmissions (riwāya) that verses 12, 45, 47 and 77 were revealed in Madīnah, and some weak transmissions date this sūra as Medinan, this sūra is unanimously regarded as Meccan. Like many Meccan verses, not only the order of revelation and (...) causality of verses but also the content of the script do not provide concrete evidence about whether the whole sūra was sent down at once or revealed piece by piece or the date of the revelation. In this regard, in studies carried out on the dating of Sūrat Yāsīn, the dating of this sūra is established on the basis of the dates of the sūras coming before or after Yāsīn since they apparently have more definite datings. In recent studies done on the nuzūl order, Sūrat Yāsīn is dated on the basis of a time frame before the emigration to Abyssinia (615-616) in terms of Sūrat Maryam and Ṭāhā, or Muhammed’s return from Ṭāif and his Ascension (Isrāʾ) (620) in terms of Sūrat al-Jinn. The dating of the sūra covers a time span of 4 to 5 years and points out two discrete occasions of revelation. With this reason, there is a need for further studies to be carried out on dating Qurʾānic sūras, especially within the specific context of Sūrat Yāsīn. Traditional Islamic studies dispute the chronological order of the sūra, offering various chronological orderings for the sūra: 31, 36, 37, 39, 40 and 41. In the first part of this study, such variations and their causes are tentatively established and determining the precise chronology and listing of the sūra was attempted. Based on the analysis of the variations in the disputed ordering of the sūra, it has been found to be caused by five different reasons. When such discrepancies are accounted for and conflicts are resolved, the conclusion was reached that in almost all riwāyas, sūrat Yāsīn can be dated as the 41st chapter (sūra). In the second part of the study, on the basis of the discourse analysis of the sūra, new arguments to date the chronology of the sūra were put forward. These are; a- Because of their obstinacy, unbelievers will not heed the warnings directed at them (36/11), b- The speeches of unbelievers should not grieve Prophet Muhammad (36/76), c- The use of the word Rahmān the Most Gracious (36/11, 15, 23, 52), d- In return for conveying the message of Allah, prophets do not ask people for any wage (36/21), e- Regarding Qurʾān as book of poetry and calling Muhammad a poet (36/69), f- The possibility of recreation and reviving bones (36/78). Such arguments presented in a – f usually refer to events happening in Mecca and in particular the second part or the end of Meccan period, yet there is no exact date. g- Based on the phrase “al-Fulq al-Mashhūn”, the fact that sūrat Yāsīn should be dated after the emigration to Abyssinia (615-616) presents strong evidence that it was revealed after sūrat Maryam, though this is still not enough to give an exact date. h- In sūrat Yāsīn, in phenomenon of (a man coming from the farthest part of the City) (36/20), two names (Hazrat Abū Bakr and el-Hāris b. Abī Hāla) and two dates (month of Dhu al-Qiʿdah/April 5 – May 4, 615 and three days after Shawwal 15/February 27, 617) are mentioned in Sīra for the purpose of consolation and encouragement. In the third part of the study, in the chronological ordering of sūrat Yāsīn, information regarding the dating of sūras coming before and after Yāsīn are evaluated based on their similarity with Yāsīn in terms of discourse and diction. In nuzūl orderings, when riwāyas regarding dating sūrat al-Qamar, Ṣād and al-Jinn coming before Maryam and Ṭāhā are analysed, events happening during 7th or 10th year after emigration were observed. In addition, there were close connections between the discourse and diction of Yāsīn with those of Ḥavāmīm sūras. This brings to the mind the possibility that some sūras might be listed in the wrong place because of the vagueness of the piecemeal character of the Qurʾānic revelation and its effects on riwāyas. Based upon the findings and inferences in the first three sections of this study, sūrat Yāsīn was determined to be the 41st chapter (sūra) of Qurʾān. The dating of sūrat Yāsīn presented some difficulties especially while trying to date it according to the interrupted revelation order approach, and considering it together with Sūrat Maryam and Ṭāhā. However, listing sūrat Yāsīn on the basis of uninterrupted revelation order along with Sūrat al-Jinn, the previous sūra and Ḥāmīm sūras is found to be a more coherent strategy since it gives priority to the succession of two sūras. : The corpus of fatwa named as Bostānu Shaqā’iq al-Nuʿmān, recorded in the Veliyuddin Efendi section under the number 1414 at Beyazıd State Library. It has been ignored so far. Because of its name, it may be thought that it is a part of Tashkoprulüzāde’s book Shaḳā’iḳ-i Nuʿmāniyya, but it is a nuqullu fatwa collection of Babakūshī ʿAbdurrahmān Efendi. In the famous Shaqā’iq appendix Atā’ī, which gives information about the biography of Abdurrahmān Efendi does not mention the book with this (...) name. Abdurrahman Efendi who was from a family in Plovdiv region worked in different positions in Istanbul and Edirne. Then, he was appointed as a mufti to Kefe, Crimea. He died in 983/1576. There is no information about his scholarly identity in ‛Aṭā‛ī except being the intern of Abū l-Suʿūd Efendi. In this essay, first of all, the place of Babakūshī in Ottoman Islamic Law tradition will be determined, and the features of the manuscripts and some notes on the postscript will be studied. In assessment section, especially because of the notes on the manuscripts, it has to be studied in terms of Islamic Law literature and its place should be figured out in fatwa literature. Summary: Nuqullu Fatwa collections that included citations were the books that were created for people to have access to the ruling on legal issues of scholars who were appointed as Muslim judges or muftis together with their sources and background. Although there are several studies in the literature about fatwa collections with citations Babakūshī ʿAbd al-Raḥmān Efendi's book titled Bostânu Shaqā'iḳ al-Nuʿmān was not included in the literature. ‛Aṭā‛ī provides information about the life of Babakūshī Abdurrahman Efendi. Atâ'î explains that he climbed the stairs with the help of Baba Efendi and joined the special group of people with aptitude at the level of apprenticeship. Then he raised also to the level of being the intern of Abū l-Suʿūd Efendi. Later, Babakūshī ʿAbd al-Raḥmān started to teach. He taught as a teacher for three years in Istanbul and then became the Mufti of Kefe replacing Molla Akmal al-Dīn. Molla Ekmeleddin, who was better known as Ekmel Efendi, just like ʿAbd al-Raḥmān Efendi, was an apprentice of Abū l-Suʿūd Efendi and would later be transferred to Cyprus after the island was conquered. According to Aṭā‛ī, ʿAbd al-Raḥmān Efendi remained in that position which he was appointed as Ṣahn teacher until his death and died in Zilqāda 983/February 1576. The highest position that Babakūshī took among the religious scholars organization in the Ottoman Empire was being the Mufti of Kefe. As stated by ‛Aṭā‛ī, he was appointed as the Mufti of Kefe with the title of Ṣahn teacher. Instead of giving information about his teachers, ‛Aṭā‛ī mostly concentrated on Baba Efendi who was one of his relatives. Therefore we do not have information about his mentors/teachers. We can say that he belonged to the Ottoman school of scholars since he was an apprentice of Abū l-Suʿūd Efendi. The copy which is the subject matter of this study is registered as Veliyüddin Efendi with number 1414 at Bāyezıd State Library. According to our research, the copy which has 237 sheets is the only copy of the book. From the expressions of Babakūshī in the preface, it is concluded that the book was written close to his death. There are several notes written with different pens as footnotes of the book. Here, four of them which are considered to be more important will be identified.First: Notes written with the same pen as the main text. These are generally citations from books such as Tatarkhāniyye, Hidāya, ‛İnâya, Kashf al-Asrâr Sharḥu Manār.Second: are 'maṭlabs' i.e. important matters. Third: are relatively inelaborate notes. These were written by someone who we thought was not a copyist/calligrapher when compared with the general style of the book. Fourth: Warning notes which included some questions. These are generally in Turkish. The preface of the book, provides sufficient information about who the author was and the nature of the book. ʿAbd al-Raḥmān Efendi, with the intention of writing a collection, started to research taking into account imams' and shaykhs' nāsikh and mensūkh and he also considered sheikhs' explanations about what was definite and what needed caution and taqwa in practice. He recorded that this search lasted for 3 years and he referred especially to Fatāwa-yi Qādikhān and Fatāwa-yı Tatarkhāniyya within this period and additionally reviewed and studied Islamic Law books that he found in the Ottoman Empire. He described that he divided these into chapters and inserted subject matters in the footnotes. Then he described how he gave the title, Bostānu Shaqā'iḳ al-Nuʿmān to the book emphasizing especially bostan.This could be seen in the expression, Masīratan li'l-Qudāt. No reference was made to Shaqā'iḳ al-Nuʿmān in the title of the book. Probably he had his intentions due to the famous book titled Şeḳ' āiḳ-i Nuʿmaniye and his pupils). In the chapter which started with Fasl right after the preface the author said that fatwa would be issued based on the opinions of three imams, namely Abū Ḥanīfa, Abu Yūsuf and Imām Muhammed that their madhap was followed and their good morals were observed. Then, it was stated that the Mufti could issue fatwas according to the opinions of first, Abū Ḥanīfa, then Abu Yūsuf and finally Imam Muḥammed. It was also stated that if he could not find their opinions and had himself muctehid, he could give his ictihad. The Fatwa collection, Bostān, is an important work among the 16th century Ottoman books since it is an important scholar's book who had witnessed Islamic knowledge in the central Ottoman Empire and Crimean region. Concepts, such as death, life and spirit cannot be known in their quintessential nature, but can be defined in accordance with their effects. In fact, those who think within the mode of pragmatism and Cartesian logic have ignored the metaphysical aspects of these terms. According to Islam, the entity that moves the body is named the soul. And the aliment of the soul is air. Cessation of breathing means leaving of the soul from the body. Those who agree on the (...) diagnosis of brain death may not able to agree unanimously on the rules that lay down such diagnosis. That is to say, there are a heap of suspicions regarding the diagnosis of brain death, and these suspicions are on the increase. In fact, Islamic jurisprudence does not put provisions, decisions on suspicious grounds. By virtue of these facts, it can be asserted that brain death is not absolute death according to Islamic sources; for in the patients diagnosed with brain death the soul still has not abandoned the body. In the dictionary, kināya, which means “to say a word and to mean a second meaning with that word”, means “to use a word both in its true meaning and in a second meaning other than this meaning“ as the Arabic rhetoric term. The conceptualization process of kināya as a sub-title of the ilm al-bayān started in the second century hijrī and took its present form in the seventh century hijrī with Abū Yaʿqūb al-Sakkākī (d. 626/1229) and in the eighth (...) century with Khaṭīb al-Qazwīnī (d. 739/1338). The authors of modern Arabic rhetoric, based on the methodological approaches of these two authors in their definitions and classifications of kināya, sometimes adopted the same approach as they were, and sometimes made some additions and criticisms by making original evaluations. For example, Qazvinî's لفظ أريد به لازم معناه مع جواز إرادة معناه حينئذ “(Original) meaning can be meant, but the necessary meaning is the word that is meant by it.” While some contemporary authors have taken the definition of kināya with the same words, some have added the phenomenon of clue to this definition. There is a similar situation in the classification of kināya, and while some authors have taken the categorization made by Sakkākī without making any changes, some authors have made various additions to this division. In the modern period covering the last century, many books have been written on Arabic rhetoric, and some of these books have come to the fore in Arab countries and our country. In this study, in the context of the subject of kināya, twelve of the Arabic rhetoric books written in the modern period were selected and the definitions and classifications of kināya in these books were examined. The aim of this study is to bring together and compare various perspectives on kināya in contemporary Arabic rhetoric books and to identify different approaches to the subject. (shrink)

Turkey and many countries, the school has closed, or partially or completely due to covid 19 pandemic. Schools remained closed until a certain time in Turkey. Afterwards, its opening has been postponed until certain dates. In the second half of 2019-2020 and in the first and second half of 2020-2021, students were mostly deprived of face-to-face education. This study, which aims to describe the problems experienced by RE teachers in the learning-teaching process during the epidemic period, was designed according to (...) a case study, one of the qualitative research methods. The study group consists of 8 RE teachers, four of them male and four female. The data collection tool is a semi-structured interview form. The data were subjected to content analysis, and NVIVO 12 program was used. RE teachers experienced problems regarding technique, absenteeism, pre-lesson preparation, learning environment, teaching methods, motivation, communication, time and measurement-evaluation. Although these negative situations have occurred, it can be said that teachers are willing to use the gains in distance education with normalization and aim to take learning out of the classroom in this way. It can be suggested to researchers to study the concepts of classroom privacy and digital world ethics within the framework of education. Improving the technology use competencies of RE teachers can also be suggested to the relevant institutions. (shrink)

It is essential to run a continuous improvement system for the Plan-Do- Check-Action cycle to be achieved and sustained. It is inevitable to consult stakeholder opinions to determine the improvable aspects of the activities carried out in the quality process. Student opinions, the main subject of educational activities, are one of the most critical data sources for continuous improvement. It is recommended to consult students’ views in all processes from the planning to the output of courses, which are the cornerstones (...) of education programs. When the field is examined, it is seen that the number of studies in which students’ opinions are sought to evaluate the quality of the courses is quite limited. This study, built around the main problem “How to design a lesson effectively in all processes, from planning to assessment and evaluation?” is a scale development study. It is thought that a lesson plan designed with the data obtained based on student opinions will increase the quality of the lesson. It is known that the programs which carry out the quality and accreditation process use different questionnaires in the continuous improvement mechanism to measure the quality of courses. 636 students from Hitit University participated in this study in 2022. The scale's validity was evaluated using exploratory factor analysis and confirmatory factor analysis. The scale has a four-component structure with 24 items, according to the results of the exploratory factor analysis. Confirmatory factor analysis revealed that the fit indices were within a reasonable range. The reliability coefficients the factors were 0.93, 0.91, 0.86, and 0.93, respectively, with a Cronbach’s Alpha coefficient for the full scale of 0.94. This finding indicated that the scale items had a high degree of internal consistency and that the scale was made up of objects with a strong tie. According to the correlation study, all of the scale’s variables had a tangible link. It can be said that the “Course Evaluation Scale (CES),” which was developed as a result of all these analyses, is a valid and reliable measurement tool consisting of 24 items that can be used to measure the effectiveness of a course taught in higher education, according to student opinions. This article aims at examining the limits of change in the field of worship through a study on the origins of the ḥukm[religious ruling] of Shawwāl fasting that is widely practiced in the different parts of Muslim world. The study, firstly, deals with the evolution of the ḥukm of Shawwāl fasting chronologically among four sunnī schools of law, then analyzes the solitary reports on the topic. It concludes that in Mālikīand Ḥanefīschools, the ḥukm of this specific worship changed within the (...) limits of karāha [reprehensibility], ibāha [permissibility], and nadb [recommendation]. This ḥukm was constructed based on solitary reports which later became a paradigmatic source of religious legitimacy in the Ḥanbalīschool beginning with the eponymous Imām and in the Shāfiʿīlong after the founding authorities. It also claims that it is strongly probable that the solitary reports on the topic go back to a deduced opinion in the age of companions, but then reached to a form of prophetic solitary report in the corpus of hadīth reports. Ultimately, this specific worship that has restricted number of fasting was established with the paradigmatic effect of the approach to solitary reports as the only authentic way of transmitting the sunna, even though it is at odds with the fact that this worship had not been implemented in the first two centuries after hijra, i.e. contrary to the established practice [ʿamal]. Summary: The issue of change of rulings in Islamic law comes up frequently on various occasions, and an increasing number of academic studies are trying to determine the characteristics and limits of this change in numerous books, articles and papers. These studies mostly seem to focus on bringing together the arguments that can be compiled under the title of ‘the flexibility of Islamic law in response to the challenges of modernity’. Although the change of rulings in Islamic law is an undeniable fact, reading it only from the lens of the change in Islamic law depending on the requirements of time is an inadequate reading. The change of rulings in Islamic law has different motives; and the change of time, more precisely the change of custom, is only one of them.On the other hand, another issue that comes up in relation to the change of rulings is the claim that this change can only take place in terms of the rulings regulating the interpersonal relations, i.e. muʿāmalāt. In fact, this claim relies on the abovementioned approach that limits the change in Islamic law with the change of custom. Hence, because other two main areas of Islamic law, worships (ʿibādāt) and punishments (ʿuqūbāt) are not open to change through custom, their rulings will not change at all. This article will try to reveal that the change in rulings might reside in a sort of another change emerged in relation to the sources of these rulings, which is a neglected point. Thus, by exposing that the field of worships which is mostly considered as a closed area for change in rulings is actually open to it, this article will examine the limits of this change.For this analysis, the article deals with the fasting of six days in the month of Shawwāl as an example, which is widely practiced in various parts of the Islamic world. The main evidence on which this fasting is based on is a report transmitted in the considerably authentic hadith sources of Ahl al-Sunnah, which reads as follows “Whoever fasts the Ramaḍān and adds six days from Shawwāl, will get reward of the entire year”. This fasting, which is the subject of a great agreement on its ruling as recommended (mustaḥāb) practice today, was actually regarded as reprehensible (makrūh) by the two great eponymous jurists of the first two schools of law in the second Hijrī century, namely Mālik b. Anas and Abū Ḥanīfa. In his al-Muwaṭṭaʾ,Mālik clearly expresses that he did not recognize any scholar who keeps this fast, and that no [authentic] report has reached him on this. The fact that both Mālik b. Anas and Abū Ḥanīfa declared an opinion on the subject shows that this practice started to appear in the first half of the second ḥijrī century as a practice or as a solitary report (khabar al-wāḥid). However, both imāms have stated that such a specific worship would be makrūh. In spite of these very sharp expressions, the schools of law, which were founded by the followers of these two eponymous scholars, abandoned their views and widely accepted Shawwāl fasting as mustaḥāb. This article examines why this sharp change occurred in a worship in the schools of law and in which way it took place.Accordingly, the fundamental motive in this change is a paradigmatic transformation in understanding and identifying the sunna as a source of normativity. Although an agreement was formed on the validity of solitary reports as a source of knowledge in the second ḥijrī century, it was not yet accepted that these narrations are identical to sunna as a source of normativity. For that reason, both Abū Ḥanīfa and Mālik did not hesitate to reject any solitary report that contradicted a stronger evidence. However, as a result of the extraordinary efforts of Ahl al-Ḥadīth, the epistemic value of solitary reports has reached to an authority equating them to the sunna with a very rapid acceleration as of the end of the second century and throughout the third century. This situation led later scholars of schools to abandon the views of the eponymous scholars of these schools on certain topics in favor of certain solitary reports. This was also the process for the change in Shawwāl fasting.This thesis will be put under two headings, a section that tries to determine the periods and processes for the Sunnī schools of law in considering this fasting as mustaḥāb; and another section that provides an evaluation of transmitted reports in relation to the Shawwāl fasting. Accordingly, in the Mālikī and Ḥanafī schools, due to the effect of the reports, the ruling of Shawwāl fasting has been transformed from makrūh into the mustaḥāb as a result of the interpretational activities that started in the fourth ḥijrī century. Shawwāl fasting was accepted as mustaḥāb in the Shāfiʿī school, although there was no transmitted opinion on the subject from the founding imāms, in the fifth ḥijrī century; and in the Ḥanbalī school directly by the founding imām Aḥmad b. Ḥanbal, whose main aim was to follow a concept of religion that puts the transmitted reports at the center. When the reports on the subject are examined, it demonstrates that the mustaḥāb ruling is mainly rooted in a report by Saʿd b. Saʿīd transmitted in the famous hadīth compilations including Muslim’s Ṣaḥīḥ.Yet, this report was criticized in its both chain and text. Combining the facts that the same report with the same chain was also transmitted as the words of the companion in some sources and the verse that declares good deed will be rewarded ten times higher than what it deserves will make the following explanation a valid one: As Mālik put it such a fasting practice was commonly unknown to the Muslim society in the first two centuries after the ḥijra. Sometime after the death of the Prophet, an inference was made probably by a companion(s) as that it would be a good deed if someone who fasted an entire month already and got used to the fasting to fast six more days in order to get a reward of fasting for the entire year according to the verse that rewards good deeds with ten times higher. Since it is a recommended practice in essence, i.e. fasting for the sake of Allah, this inference transformed into a report and easily passed through the filters of hadīth scholars who are linked to a sort of piety promoting worships among people. After the solitary reports gained an authority to the extent that they can rarely be challenged, the followers of later schools of law preferred to get in a process of re-interpreting the opinions of their imāms in order either to reconcile them with the content of report, or at least to show why these imāms actually spoke against this fasting. Eventually, the later scholars of madhhab decided for the standard opinion of the madhhab depending on the reports in favor of the Shawwāl fasting rather than following their eponymous imāms. The words used in the languages generally have an original/basic meaning. However, these words gain new and special meanings over time apart from their basic meaning. These emerging meanings are not completely independent of the basic meaning. Because new and special meanings emerge on the axis of basic meaning. In the Qurʾān, naturally, many words are used in connotations other than their original meaning. Therefore, it is not possible to give a correct meaning to the verse without determining the meaning (...) of the words in the verses. In this study, it was investigated whether the conjunction ev in the verses was translated into Turkish correctly. For this purpose, firstly, the most accurate meanings of the conjunction ev in the verses discussed were tried to be determined from the vucūh and nezāir and tafsīr books, then these meanings were compared according to meāls and translation errors were pointed out. Accurate translations are emphasized; alternative translations are also presented when necessary. The conjunction ev in its basic meaning in Arabic indicates that the speaker is in doubt and hesitation in sentences expressing proposition and judgment In sentences such as orders and demands, it indicates that the addressee can choose between the options. However, this conjunction is sometimes used instead of conjunctions/prepositions such as and, even, to, until and except. In the vucūh and nezāir books, which are accepted as the Qurʾānic dictionary, it is agreed that the conjunction ev is used instead of and and even in the Qurʾān. In many tafsīrs much more meanings are given to the conjunction ev and it is stated that this conjunction is used instead of conjunctions such as until, to, except. In addition, it is stated in the some tafsīrs that conjunction ev adds various meanings to the expression such as elaboration, diversity, division and concealment. Where the conjunction ev is used in its basic meaning, translation errors were not made in the majority of the translations, except in very rare cases. Translation errors related to the conjunction ev mostly occurred when this conjunction was used out of its own meaning. Most of these errors are related to the words attributed to Almighty Allah by stating propositions and judgments. Because the conjunction ev used in these sentences indicates that the speaker is in doubt. However, this cannot be the case for Almighty Allah. Because Almighty Allah never doubts the matters He informs. Therefore, it is clear and certain that the conjunction ev is not used in the basic sense in such verses. It is determined that in the meāls we examined, this detail was generally not paid attention to. Although it is certain that the conjunction ev in these expressions attributed to Allah is not in the basic sense, it cannot always be clearly understood from the context in what sense it is used. Therefore, different opinions have been asserted in the sources on this issue. As a result, a scholar has taken the conjunction ev in any verse that comes in such a form to mean and, one to even, and another to except. The author of meāl usually prefers one of these meanings and tries to transfer it to the target language. However, it may not be possible to transfer every preferred meaning to meāl. For example, while it is possible to translate the meaning of and and even of the conjunction ev into Turkish, it doesn’t seem possible to transfer the meaning of ibhām/hide from the interlocutor. Therefore, a meāl writer who prefers the meaning of ibhām should translate this verse adhering to the words, and explain the meaning in the additional explanation section. Because in such a case, it is not possible to transfer the meaning to Turkish only through translation. Another reason why some verses in which the conjunction ev is used are translated incorrectly into Turkish is the attempt to convey the forms of expression particular to Arabic through literal translation. In such cases, the correct meaning should be determined first, and then the translation should be made without depending on the words. Because the purpose of translation is to convey the meaning, not the words. This study has confirmed that the author of the translation should have knowledge of the subtleties of the source and target language, and that he should make maximum use of the works written on vucūh and nezāir and the sources of tafsīr. However, it is also emphasized that every information contained in these works should not be accepted as essential without being subject to criticism. (shrink)

Tolerance is an ambivalent attitude. It allows living in plurality but not in equality. The tolerant tradition of the Ottoman Empire, for example, is based on a very clear political and social hierarchy between different religions. Dominants boast of their tolerant tradition. Tolerance is also about imposing limits on the other in a unilateral way. In Republican Turkey where theoretically all citizens are equal, the majority of Turkish-speaking Sunnis tolerate non-Muslim minorities, Alevis, Kurds. It is the ‘liberal’ currents of this (...) ethno-religious majority that pronounce themselves tolerant of others. However, minorities do not demand tolerance but equality because the history of Turkey for more than a century with the genocide of Armenians, pogroms, massacres, deportations have shown those who say they are tolerant can switch to each moment in extreme violence against those whom they now consider intolerable. We can find the origins of the notion of void in the Kalām tradition’s recognition of atomism. However, the main debates on the subject appeared after the Greek philosophical heritage transitioned to the Islamic world in the 3 rd century of Hijra. The literature of Kalām, just as in the metaphysical tradition, has two main types for this void being discussed. The first one is the external void (extracosmic) in which the cosmos floats. In the sources of Kalām, the question (...) of whether such a type of void exists is debated around the questions of whether anyone who might look beyond the cosmos can see anything or whether someone who stretches their hand outside the cosmos can move it. The second type of void, which occupies more of the mutakallimūn (Muslim theologians) agenda, is the internal void (intercosmic), assumed to be within the cosmos and between the body-forming atoms. This kind of void is discussed around the question of “Whether separating the two atoms is possible so that a third one can be inserted between them?” An ongoing discussion on the intercosmic void is found between the Baṣran and Baghdād Schools of Mu’tazila. Ibn Mattawayh and al-Nīsābūrī narrated the evidence presented in these discussions in their original form. The current essay discusses the debates between the two Schools and assesses the theoretical and experimental arguments both Schools present to justify their viewpoints, considering their philosophical origins. Media news can be regarded as an important teaching material to be used in lessons in terms of being interesting, containing up-to-date information, reinforcing what has been learned in the course, and combining it with many methods and techniques. In addition, the fact that media news provides a more concrete learning, helps the subject in the lesson to be connected with real life and helps students to develop their empathy skills. Therefore, the use of media news in religious education can (...) increase curiosity and interest in the lesson and enable students to actively participate in learning processes. This article, which focuses on how to benefit from media news in religious education, has been prepared to raise awareness about the use of media news for teachers who attend religious education classes, and thus to guide them in using media news in their lessons. In the study, the use of media news in religious education was first addressed in a conceptual framework, and then the extent to which media news was used in the textbooks of the religious education courses was investigated. Within the scope of the research, 42 books on Religious Culture and Moral Knowledge (RCMK) and Imam Hatip High School Vocational Lessons were examined and four examples were found as a result of this examination. It was observed that the media news used in the textbooks led the students to research, share and discuss. However, the fact that only four examples could be found in 42 textbooks reveals that media news are not used sufficiently in religious education, and teachers are not provided with sufficient material on the use of media news in teaching processes. In the third part of the study, the issues to be considered in the use of media news in religious education are examined in three groups as before, during and after the lesson. According to this media news can be evaluated as lecture, interpretation, concept definition, question-answer and application of discussion techniques during the lesson. Discussion, scientific research and case study methods are methods that can be used effectively in media news activities. In the last part of the study, six activity examples are given for the use of media news in religious education classes. These activities are the activities of the lessons of RCMK (4-7th grade), The Life of the Prophet (7th grade), Basic Religious Knowledge (9th grade), Fiqh (10th grade) and Islamic Culture and Civilization (12th grade). These exemplary activities, prepared at five different lessons and five different class levels, reveal that media news can be used quite effectively in religious education, and all media news from sports to economy, from health to daily life can be associated with the course subjects. In the context of the results of this research, it is suggested that the course books should be updated and media news should be included more. Through a platform to be established by the General Directorate of Religious Education, news in the media can be archived and a guide can be prepared on what subjects and how these news can be used. Additional research can be conducted with focus on a single lecture or a single media tool. In addition, quantitative and qualitative studies can be conducted to asses the contribution of the use of media news in religious education classes to students’ learning. (shrink)

How can we understand the phenomena of loss and mourning in the Heideggerian framework? There is no established interpretation of Heidegger that gives an elaborate account of the phenomena of loss and mourning, let alone gauges its importance for our understanding and assessment of authentic existence in Heidegger. This paper attempts to do both. First, I give a detailed exposition of Heidegger’s analysis of the phenomena of mourning and loss and show that Heidegger’s analysis of mourning in his early and (...) late work is strikingly in line with his collectivist understanding of Being-with. This demonstrates, contrary to what some of his proponents argue, that Heidegger does not follow the kind of dynamic understanding of Being-with that places the other within fine-grained spaces of possibility. Second, with reference to Heidegger’s existential philosophy, I construct a phenomenology of mourning and grief. Though Heidegger himself fails to explain the relationships in which one mourns after a close other, we can develop a unique phenomenology of mourning with reference to Heidegger, which shows that each loss is singular and can be equiprimordial with one’s own death in opening one to the possibility of an authentic existence. In this new understanding of authenticity, loss is regarded as a powerful force, akin to death, in leading one toward their self-owned existence. (shrink)

There are some radical practices of asceticism, such as wearing ṣūf (wool clothes), traveling without provisions, choosing to be single, and avoiding earning a living by working, which were generally seen in the 2nd century A.H. and were subject to criticism with the formation of classical Ṣūfism. Criticisms of these practices have started to appear in the literature since the 3rd century A.H. Early Ṣūfī writers such as Al-Ḥakīm al-Tirmidhī, Muḥāsibī, Abū Saʿīd al-Kharrāz, al-Sarrāj focused on this issue and criticized (...) these practices. How are these practices of ascetics viewed in the sects that were formed and spread in the 6th and 7th centuries? Our research seeks the answer to this question, but limits it to the example of Abū l-Ḥasan al-Shādhilī, the founder of Shādhiliyya. This question is important in two respects: First of all, it is investigated whether the determination of some researchers that al-Shādhilī taught comfort in the face of worldly blessings is also correct. Because, among contemporary researchers, there are those who believe that al-Shādhilī wears ostentatious clothes, rides horses, encourages economic competitiveness, and is therefore open to benefiting from worldly blessings to the fullest. Secondly, it includes an investigation of the validity of the belief that these practices belong to an early period in the history of Sûfism and have been completely abandoned over time. Although al-Shādhilī seems to have completed his spiritual education in Morocco with his sheikh, he later went to Tunisia with the latent command of his master. We see that in his first years in Tunisia, he went into seclusion in a cave and was completely isolated from the society and engaged in worship in a way that reminds us of the practices of the early ascetics. But in the second phase of his life in Tunisia, he went to the city on a spiritual sign, socialized, started to give sermons to people, and started to behave more flexible about eating and drinking. al-Shādhilī specifically states that he did not prefer socialization at this stage, but with a spiritual sign. Later, he went to Egypt again with a spiritual sign and got married there, started to deal with agriculture, and continued to socialize by establishing relations with the rulers. Therefore, it can be said that this new social period is a break both from the radical practices of the early ascetics and from the early period in Tunisia itself. It is also seen that in this new period of al-Shādhilī, he did not wear the clothes of ascetics like sūf (wool clothes) and did not want his followers to wear them. He also encouraged to have a profession and was generally against traveling without provisions. But there are two points to be noted here: First, these milder and more comfortable practices should not lead to a search for comfort and luxury. He continued to keep his distance from worldly blessings and to advise asceticism. Secondly, he had some of his distinguished disciples make some practices of the ascetics. The reason for the existence of these seemingly contradictory practices is that while he recommends moderate and sustainable practices to the general public and his followers, he can make the specialized sūfis more strict and difficult practices. While he was encouraging work and earning in general, not ignoring experience, including avoiding work; not ignoring seclusion while leading to sociality in general; while generally suggesting to resort to occasions, he also follows a path of implementing and enforcing radical practices such as traveling without food. Thus, al-Shādhilī is able to encompass all the seemingly incompatible practices of the previous sūfi accumulation with a point of view of spiritual rank and hierarchy. (shrink)

This article drafts a phenomenology of artifice, an interpretation of Human Being and Human Practice, based on the extraordinary claim that design is not the initiator of change, creation and diversity, but it is the essential humanistic quality to compensate the irresistible precession, to regulate the inevitable transformation and divergence of the World. Inspired by the Sufism conception of Human Being, the argument here relies on the theory of a gradual disclosure from the kernel of Universal Man, the complete and (...) Perfect Man of unity and continuity, down to the local man of differences, discontinuity and diversity. Sufism presents a phenomenology of appearing, describing a process of disclosure motivated by a mystical passion ‘to be known’, where in the beginning the Being is manifested on the Universal Man, that then degraded and diversified down to the local man, its Self, his or her community and his or her instruments. The article presents the Universal Man disclosing, and the local man enclosing in three grades that are aligned in conditional priority where the former enables the later one: (1) The Proximate Potentials, (2) The Mediate Linguals and (3) The Distant Actuals. The enclosed species of those layers are introduced as the primal categories of artefacts: (a) future contemplations out of the potentials, (b) present conversations out of the linguals and (c) past constructions out of the actuals. Towards the end, the article carries the discussion on how the Ur-Disclosure brings the inevitable conditional precedence of the future over the past; the future potentials come before the linguals of now and the past actuals follow after. So, it is claimed that anything new principally deviates from the future, from something already exists potentially on the proximate grade, where the Universal Man degrades into the unitary Selves. In the conclusion, it is proposed that design processes can not disclose, create and image anything but enclose, cover and regulate the genesis. The theory of gradual disclosure from the Universal Man to the local individual mainstreams the experience of ability presenting potential ability as a universal human experience that can be actualized by proper practice. Why did philosophy and the sciences in the East lose their momentum and enthusiasm in the 12th century, leaving the West to take the most importantprogressive steps from the 17th century up to the present day? Can these two intellectual traditions be separated from each other to such an extent as to justify today's theses of conflict? If they cannot be separated, how can the historical events that place these theses on the agenda can be explained? Divine revelation, as a Qur'anic and religious concept in exegetical sources, is usually mentioned together with the institution of Prophethood. Revelation came to its end with the end of Prophethood. Therefore, although some have evaluated inspiration and true dream within the this context of revelation, according to most of Islamic scholars, it is not permissible to refer to the recevings of the divinely saints as revelation. Revelation, for which the holy Qur'an designates three pattern of descension, is discussed also in (...) three categories throughout the history of Islamic intellectual thought. Scholars of tafsir and theologians, philosophers, and mystics, all hold and bolster different views on the nature of revelation. Claims in Sufi literature that inspiration can descend to divinely saints -beyond immediate delivery to the heart- through direct or indirect divine communication from behind a veil and through angles can be evaluated as an effort to create a conception of revelation that corresponds to the three modes of revelation, adressed in Qur’an, peculiar to prophets. With regard to the issue of continuity of divine revelation, a thorough examination of the Sufi literature leads to the conclusion that revelation continues to decsend in its verbal form as inspiration but also, according to some Sufi authorities, in its noun forms unaniously considered as peculiar to the prophets. Therefore, especially since the period of Sufism’s intermingling with philosophy, the issues of accommdating sainthood within the framework of general prophethood, the distinction between revelation and inspiration and its continuity appear as a very complex, unframed and unlimited field. The purpose of this study is to develop a religion-science relationship attitude scale prepared to determine the approaches of the students studying at the faculties of theology/Islamic sciences towards the religion-science relationship. The relationship between religion and science constitutes one of the most important intersection points of religion, science and philosophy. In the modern period, the debates on the questioning of this relationship have reached quite advanced dimensions with the influence of different elements. In recent years, one of the environments (...) in which this situation has intensified in our country is theology/Islamic sciences faculties. Especially for the students of these faculties, it is important to deal with the issue from different dimensions. However, the studies are mainly carried out in the theoretical dimension and it can be said that the quantitative dimensions are inadequate. In this respect, the article is the first example in the field. Ian G. Barbour's quartet typology, which is one of the most comprehensive studies on the religion-science relationship was used as a basis in the formation of the scale questions. Especially conflict, separation and reconciliation approaches in this typology have been decisive. Three different study groups were formed and a total of 594 students studying at Atatürk University Faculty of Theology were studied. In the development of the scale, exploratory sequential pattern model from mixed method research was used and there are four steps. In the first step, the items were written by the researchers and corrections were made by taking the opinions of the field experts. In the second step, an application was made for item analysis; in the third step, an application was made for exploratory factor analysis (EFA), and in the fourth and final step, confirmatory factor analysis (CFA) was performed. According to the findings obtained from the study, a scale consisting of two sub-dimensions called conflict/separation and dialogue/consensus was developed. The reliability of the scale was analyzed with the internal consistency (cronbach alpha) method, and the cronbach alpha values for each sub-dimension were calculated as.90 for the conflict sub-dimension and.77 for the dialogue consensus sub-dimension. These results indicate that each sub-dimension of the scale is reliable. (shrink)

The main problem of this text is as follows: While identifying the status of education systems related to moral education with the title of industrial education, the situation is identified through the problems of the morality of education or moral education. Then, a proposal on the education of morality is made through the system evaluation. This point is for the text. These problems are dealt with by using an in-depth and holistic evaluation method together with description and identification. The text (...) primarily focuses on the founding meaning through which time manifests. Because education is both built by this meaning and fulfills a task that perpetuates it. As a part of an entirety/ground reflecting the spirit of the time, education carries/overflows its nuclei and aims. The expression “industrial education” is crucial in that it expresses both its roots, the entirety to which it belongs, and the network of values it has. Here, the term industrial refers to the ground in question, and industrial education refers to the educational understanding of that ground. It is unthinkable that the network of values it possesses is contrary to the whole in question. In the text, the identification of this situation is described through the “ethics of education”. This process that humanity has experienced is new. Therefore, industrial education should be interpreted with its conceptual network. Thus, concepts such as "environment", "context", "transformation", "change" have been redefined. This is essential to make sense of the situation. It identifies that the final solutions sought can be possible not with the “morals of education” but with the "education of morals". This means proposing a reinstallation of the system/environment. : Muḥammad ibn Yūsuf al-Sanūsī, who was one of the theologian of later Muslim Asʿharī theologians, is one of the scholar came to the fore in Maghrib. Although al-Sanūsī shapes his thoughts within the Asʿharī’s kalam system, he presents new contributions to this system with his own unique perspective. In particular, his effort to give importance to reason in maʿrifat Allāh is remarkable. According to him, maʿrifat Allāh can only be reached with reflection. Also the reflection is waʿẓ or contexture (...) process done in the reason. When a method is followed, such an reflection leads to the maʿrifatullāh. In particular, the ruling wisdom adds a form to the functioning of the reason through its perceived and compassionate perceptions. For a believer to know the necessary, the permissible and the impossible is to use the reason. In this context al-Sanūsī imposes a central role in the concept of judgment. If the human can operates its reason in this way, necessarily will comprehend that he/she is created. In the process of acquiring the knowledge, al-Sanūsī draws attention to the heart as much as the reason and that shows that he is in the effort of combining these two. Summary: Muḥammad ibn Yūsuf al-Sanūsī is a scholar raised at the Maghreb geography. Although al-Sanūsī, living in the 9th/15th century, gave a lot of work in different fields, his theologian identity became front-line. By standing against the innovation that he had seen during his era, he wrote many beliefs works. Among these works, the relation of maʿrifat Allāh-reason attracts attention. al-Sanūsī thinks that the most important means of delivering to maʿrifat Allāh is deduciton. According to him, the deduction is “to reveal the known to reach the desired thing or to arrange two or more works”. If we evaluate this definition in terms of Asʿharī tradition, we will see that al-Sanūsī is in the effort to emending the definition of his al-Qāḍī al-Bayḍāwī’s definition who is his contemporary. al-Bayḍāwī described deduction as ‘to organize things that are not known to be known’. al-Sanūsī made a contribution to this recognition. He has adopted the arrange part completely and also add the waʿẓ expression into that. The reason why al-Sanūsī goes to such a separation is the reason for trying to explain the functioning of the reason in a logical form. In the logical sense, the thought consists of envision and confirmation. From these concepts that constitute thought, envision refers to waʿẓ, and confirmation refers to arrange. If the definition of al-Bayḍāwī is accepted as valid, the envision in reason is incomplete. This shows the importance that al-Sanūsī gives to the functioning of the reason in terms of the achievement of the maʿrifat Allāh. The confirmation made without envision can lead a person to imitation. Therefore, the deduction made by waʿẓ must be taken into account. It can be imagined groundlessly that in the definition of deduciton which al-Sanūsī made, he had an understanding of reason that doesn’t base on Allah. However, al-Sanūsī has never broken the Asʿharī tradition in this matter. According to al-Sanūsī, both the deduction and the knowledge formed as a result of this, is Allah’s creation without means. There is no influence of deduction on knowledge and also the knowledge on deduction. Also, the human has no influence neither in inference nor knowledge. It seems to be contradictory to the definition of such a discourse. However, he made his interpretations within the framework of the understanding of the omnipotence that the Asʿharites had drawn. It is unthinkable that Allah, who created everything and even man’s actions, can’t be imagine that doesn’t create thought. Intellect produces knowledge, but Allah creates both intellect and the knowledge produced by intellect. al-Sanūsī, while describing deduction, said that it could be produced with waʿẓ in the sense of envision. However, there is another very important concept that creates a conception from his point of view, which is “judgment”. According to him, judgment is “the proof or negation of something”. The phrases “the universe is created” or “Allah is not created” are the examples of a proof or negation of an issue. See, this is a judgment. In this sense, envision is a road to judgment. That is, the information obtained by envision reaches a judgment in the forms of the reason. al-Sanūsī classify the judgment in to three: lawful, ordinary, intellectual. The lawful judgment is the salutation of Allah with the demand related to the actions of the amenable, not being good deed or sin or waʿẓ. Ordinary judgment is the link between the existence or absence of a state and the existence or absence of another state. The most important of these three judgments is the intellectual judgment. As for the intellectual judgment, it is the proof or the negation of a work without waʿẓ and repetition. It is separated from lawful judgment without being waʿẓ and separated from ordinary judgment with being not repeated. In this sense, if the mind needs the examination or repetition while deciding for a work’s certainty or negation, this kind of a judgment is not lawful or ordinary but it is intellectual judgment. The reason judges either a work’s certainty or absence together, or accepts only the certainty or accepts the negation. According to al-Sanūsī, having the right to comment on belief is pertain to intellectual judgment in the first place. al-Sanūsī takes the maʿrifat Allāh to the center in matters related to the place of reason and examines the relation of the maʿrifat Allāh with these three concepts. What al-Sanūsī tends in doing so is that to show that there is an inherent meaning of reason as well as having relevance of knowing some things. As a result, according to al-Sanūsī, knowing these three parts of the intellectual judgment is the reason itself. Anybody who does not know these, is the person without reason. al-Sanūsī thinks that it is necessary for the amenable to know the intellectual judgments and its parts. This necessity is to make the amenable separate the things about Allah or his prophets related to necessity, permissible and impossible attributes; but also, the things exist within the limits of intellectual judgment or not. The amenable who know these has evidence and thereby can defeat the doubts that may have formed or may will form in him. al-Sanūsī also emphasizes the deduction of reason to reach the maʿrifat Allāh with reason. According to him, it is the best deduction method in terms of the evidence that Allah exists is that the deduction from causing agent to cause and the deduction from one correlative to another The acceptance of the possible entity has agent who wills its existence, oppose to the Fakhr al-Dīn al-Rāzī, that this proposition is whether imperative or not. According to him, these propositions are not imperative, they need deduction. In this respect, deduction is necessary for the maʿrifat Allāh. The reason which is considered in the sense of logic in al-Sanūsī is not a structure which merely functions as a analogy and a deduction. On the contrary, according to al-Sanūsī, there is a direction going towards the heart from the point of reason and it seems that the heart is used in meaning of reason. This is an example of al-Sanūsī’s attempt to combine mystical knowledge with reason and legal injunction. This is a remediation project in terms of his time. (shrink)

Ijtihad is the mujtahid's putting forward all his efforts on a fiqh issue within the framework of methodological principles. Fatwa, on the other hand, are the explanations made regarding the questions asked in fiqh issues. Therefore, although there are similarities between fatwa and ijtihad in terms of declaring a fiqh knowledge, there are also some differences that distinguish both scientific activities from each other. Because of this difference, not every ijtihad qualifies as a fatwa that a Muslim can apply in (...) his life. A jurist who does not have the qualifications for ijtihad has to pay attention to when giving a fatwa by making use of the classical period ijtihad. The most important thing to consider when benefiting from the ijtihads that have been put forward is to correctly distinguish between the ijtihads that are historical and those that will always be used. In the fiqh books, there are many issues that can be described as historical ijtihad, in the context of their own time and conditions. Since it is not possible to present all such ijtihads within the framework of an article, in this study, the subject is discussed within the framework of ijtihads selected from fiqh books. From international relations to family law, there are many historically qualified ijtihads in the fields of fiqh, especially in the field of transactions. Today, international relations are quite different. It is of great importance to redefine the world and present fiqh rules accordingly. In the changing social structure, a new perspective is needed in the determination of the muruet. In the process of women's social position and participation in social life, great changes have been experienced all over the world and women have started to take part in many areas of life. In terms of the minimum age limit for marriage, it has become natural to marry at an older age than in the past. It has become almost impossible to act with the approach that those who have the same belief will obtain citizenship without other terms and conditions. It has become necessary to consider the views of jurists regarding the rights of non-Muslim citizens from a new perspective in the globalizing world structure. The implementation of views that give authority to private property owners regarding mineral ownership may be harmful to the security of the state and the public interest. There has been a need to look again at the legal provisions regarding the treasures under the ground in terms of public interest. In the article, it is stated why the ijtihads on the aforementioned issues have a historical character and in which framework the issue should be handled today. (shrink)

Al-Mu'jam Al-muḫtaṣ of Murtadā Al-Zabīdī (d. 1205/1791) in which a scholar recorded his teachers, the books that he obtained the right to narrate during his education life and the chain of transmission from his teachers to the author, is one of the important representatives of the mu'jam genres in 12th/18th century. It can be said that the mu'jam that Zabīdī wrote to record the important people in his life, goes beyond the standard mu'jam with its compilation style, sources, diversity of (...) biographers and anecdotes about the writing activity of the period. Based on Zabīdī's teachers, students and contemporaries, their origins, specialization and profession, the dates of their deaths, the dates of his encounters with them, the extent of his friendships, the dated rihle route, the lecture places and the books he taught, a panorama about the mu'jam will be drawn. The mu’jam, which includes 635 biographies, has a wide range of written and oral sources, especially ijazat and samā sources. Zabīdī's correspondence with scholars from different regions, taqrīz/appreciation written for his famous books and poems belonging to scholars of the period are among these sources. Numerous taqrīzs on his Tāj al-ʿArūs and Sharḥ Al-Iḥyā's point to their fame at that time, while Mu’jam, which has the appearance of an independent poetry anthology due to the poems that reach tens of pages, reveals his unknown poetic side. On the other hand, some couplets recorded in Persian and Turkish show his knowledge of these languages. Zabīdī is a versatile personality who lived in different geographies such as India, Yemen and Egypt and met many scholars there. Rihles in different regions of Yemen such as Zabid, Moravıa and Mocha, as well as inside Egypt, including Damietta, Raşıt, Fuwwah and Asyut, show that Zabīdī traveled frequently for the sake of knowledge. Egypt, where he went in 1167 (1753) with the advice of his teacher al-Aydarūs and spent thirty-eight years of his life, has an important place in his scientific adventure. Recording sufis, merchants and janitors as well as famous people from different fields such as poets, jurists and muhaddis in biographies reflects Zabīdī's extensive contact reaching various segments of society through the aforementioned rihles. While Zabīdī was obtaining knowledge through both these journeys and ijazat, he also gave ratification/ijazat to the students who came to him. While he prefers ijazat of al-musalsal bil awwaliyyah and Al-Awail Ṣaḥīḥ/al-Kutub al-Sittah for those who come to him for short periods of time on the occasion of pilgrimage, but on the other hand he gaves ijazat of Ṣaḥīḥ al-Bukhari, Shamail Tirmidhi, Sharḥ Al-Iḥyā and Al-Amali for his long-term students. Lessons, both open to the public in mosques and with more private groups at home, were held in informal rather than systematic/formal style like in the madrasah. The books that Zabīdī received the right to transmit through his rihles are listed below under the "textbooks" heading. When a book is mentioned in whichever biography, it can be implicitly considered the person has the elevated chain of transmission of the book. Similarly, it can be revealed in which region and by whom tranmits the short chain of a book. This reveals the unknown aspects of regional and temporal writing style. On the other hand, it is possible to find other traces of the background of writing and representation/taqrir through the mu'jam. For instance, a book was sometimes typed as a result of the students' compilation of lecture notes of their masters, sometimes when a person obtained a book he needed and he abbreviated important parts and copied a special copy for himself or a student could only get permission for giving lectures after he had written a book. The mu’jam includes besides of Zabīdī's books, the books written by the biographers in the form of "he has many books" or by mentioning the name directly. Even the recording of details such as the reason for writing, date and content information reveals the unknown aspects of the book writing style of the period. Ultimately, the importance of mu’jam, which was written as the result of a life spent with learning, although it is not well known in terms of genre; is to mention the biographical information collected from many different secondary sources, compiled as a result of long effort, such as history and tabaqat-tarajim about the scientific life of the author together with their evidences. Therefore, these kinds of books, that are mostly written by the author himself or his close student, in which the teacher constitutes its main element, is a primary source in the determination of the biographical information of the author, as well as the book and isnad, deserve to be examined separately because of their potential to shed light on the unknown aspects of the hadith history and literature of the later period. Besides being a prophet, the Messenger of Allah (pbuh) is a servant of Allah and a human being. It is seen that there (...) were problems in the homes of the Prophet (pbuh), both between him and his wives, and among his wives. Since the creation of human beings has not changed, the Prophet's (pbuh) attitudes and solutions to these problems are important for the solution of family problems happening today. It is seen that the Messenger of Allah (pbuh) reacted to these problems and discussions far above his age and he treated his wives and solved the problems as modern researchers and scientists recommend in the recent world. The purpose of sending the Messenger of Allah (pbuh) is to convey the religion of Allah to people. For this reason, he was given orders regarding the most private matters of his private life when appropriate. Human's happiness in this world and in the hereafter can only be achieved by recognizing this perfect example. This can be achieved by learning about his personality as an individual and his family life as a family. The conflict of values among spouses in the family, life perspective, personality and priority differences are the basis of the problems. In addition, changes in personality especially after marriage, loss of love and respect for each other, and jealousy are the main situations that harm marriage. Many marriages end because of miscommunication. There are many people who try to solve problems by being cold towards their spouse and taking a stand towards him/her. If a man is married to many women, as in the example of the Prophet (pbuh), the main problem he encounters is jealousy and the resulting unrest. In a family, there are joyful and happy moments as well as unhappy moments and times. It is very natural for family members to quarrel with each other and to have disagreements among them. The Prophet's family is not far from it. The wives of the Messenger of Allah (pbuh) are not ordinary people, but women who are either at the forefront of their tribe with their ancestry, intelligence and beauty, or who are one step ahead with their conversion to Islam and their services. According to the laws of God, the same poles repel each other, while the opposite poles attract each other. They are all very precious and it is perfectly natural for a repulsion force to develop between them. It is necessary to think of the Prophet's (pbuh) houses as a school. The state of our mothers when they entered that house is not the same as the degree they reached when the Prophet (pbuh) passed away. Differences of opinion and conflicts between members of the family, deterioration of the balance in relations, and weakening of solidarity are among the events seen in every family. The Prophet (pbuh) was able to have controversies with his wives, even if it was a rarely example. However, in these discussions, it is seen that he does not allow violence and tries to solve the issues patiently and by talking to each other, and sometimes asks for help from his close circle or relatives of his spouses. ʿĀʾIs̲h̲a is the most prominent among the wives of the Messenger of Allah, except for Khadija. She himself knew this and was voicing this claim against the other wives of the Messenger of Allah (pbuh). When the Prophet (pbuh) married Umm Salama, people talked about his beauty. ʿĀʾIs̲h̲a, who heard these praises, was very upset about the new rival who came to her. With Zaynab bt. ḎJ̲aḥs̲h̲ stepping into the house of the prophet, the balances changed and a fierce rivalry began between her and ʿĀʾIs̲h̲a. Just as ʿĀʾIs̲h̲a was proud of her superiority, Zaynab began to brag about her superiority. ʿĀʾIs̲h̲a had a special place among the wives of the Prophet. This was evident from the fact that the Messenger of Allah (pbuh) said at every opportunity that he loved him very much. The Messenger of Allah (pbuh) did not hesitate to express this either. When the Prophet (pbuh) went on an expedition, he would treat his wives fairly and draw lots so that he would not cause hatred or envy among them. When the lottery went out to another wife besides ʿĀʾIs̲h̲a, the dissatisfaction on his face could be felt. Among his other wives, the Prophet tried to protect and watch over his wife, Safiyya, at every opportunity, which he felt was strange because he was later included among them and was of Jewish origin. Although Mariye was a slave, she became one of the envied women among the wives of the Prophet after she gave birth to her son Ibrahim to the Messenger of Allah (pbuh). Divine revelation (waḥy), as a Qur'anic and religious concept in exegetical sources, isusually mentioned together with the institution of Prophethood (nubuwwa). Revelation came to itsend with the end of Prophethood. Therefore, although some have evaluated inspiration (ilhām) andtrue dream (ruʾyā sādiqa) within the this context of revelation, according to most of Islamic scholars,it is not permissible to refer to the recevings of the divinely saints as revelation. Revelation, for whichthe holy Qur'an designates three pattern of descension, is discussed also in (...) three categoriesthroughout the history of Islamic intellectual thought. Scholars of tafsir and theologians,philosophers, and mystics, all hold and bolster different views on the nature of revelation. Claims inSufi literature that inspiration can descend to divinely saints -beyond immediate delivery to theheart- through direct or indirect divine communication from behind a veil and through angles can beevaluated as an effort to create a conception of revelation that corresponds to the three modes ofrevelation, adressed in Qur’an, peculiar to prophets. With regard to the issue of continuity of divine revelation, a thorough examination of the Sufiliterature leads to the conclusion that revelation continues to decsend in its verbal form asinspiration but also, according to some Sufi authorities, in its noun forms unaniously considered aspeculiar to the prophets. Therefore, especially since the period of Sufism’s intermingling withphilosophy, the issues of accommdating sainthood (walāya) within the framework of generalprophethood (nubuwwa ʿāmme), the distinction between revelation and inspiration and itscontinuity appear as a very complex, unframed and unlimited field. Parents in Arab society did not take any responsibility for their children in the pre-Islamic era. The husband, as the head of the family, used to treat family members as his servants and forced them in the direction of his interests. No matter the rationale behind it, the burial of daughters in the pre-Islamic era is an outrageous and ill-treated tradition. In this study, it is possible to see which tribes in the Arab society started this repellent custom and which (...) ones were more common. In the society, it is possible to find that there were conscientious and virtuous people trying to prevent these events which can be called as a shame of this humanity, which does not approach the events with the value judgments of that day. Before shedding light on the motivations behind this tradition in the Jahiliyyah Arab society, the examination of the treatment towards daughters in other parts of the World in the same era, would be meaningful in terms of enlightening the phenomenon. This study aims to crystallize the causes, extent, and responses by wise people towards the burial of daughters in the pre-Islamic and Prophetic era.Summary: The burial of daughters or their slaughter in a variety of ways was not unique to the Arabs. At that time people and animals in many parts of the world were sacrificed to give thanks to the gods and to ease their anger. When the killings of girls are considered, Arab society comes to mind. In that time, other countries and nations in the world were not different from the Arabs. During this period, daughters were killed in different ways, not through the burial of living alive.During the Jahiliyya period, among the Arabs who murdered the children of the boys, the girls, and children who were considered to be the weakest members of the family were conducted with this treatment. Men who were the head of the family could tolerate having one or a maximum of two girls. When the number of girls increased, they regarded it as a matter of honour so that when a new daughter was born, the inevitable attempt was to murder her.In the Arabian peninsula - rich merchant families exceptional - families were trying to survive with scarce opportunities. The food and clothing materials used were usually exported and extremely expensive. Therefore, there was a necessity for male members of the family who would provide for the family. From this perspective, so many sons meant dignity. The economy of the day was based on looting and pillaging except for the trade of the elite. Therefore, one had to be strong. The birth of a daughter meant shame, sadness and grief instead of joy and happiness for them. The man would wait excitedly for good news. If the baby was a boy the family rejoiced. However, if it was a daughter the father would be upset. When a person said, “She was a daughter” she could not know what to do with her shame and how to hide from people.When the Arab tribes were examined in general, the burial of daughters was not extended to the whole population. The question of murdering the girl by burying her child was common among Bedouin Arabs who lived in the desert rather than the city. It was extremely difficult to see this tradition in the tribe of Quraish, which were regarded as the masters of the Arabs. When we look at the sources of Jahiliyya and Islamic history, it is observed that the examples of this outrages customs were generally realized in the near term. It is understood that the memory of society is not rich enough to comment. The main reason for this is that Arab society has not a written culture.For the Jahiliyya Arabs, her daughters were ashamed. If they married their daughters even before they had married their daughters into adultery, seeing it as lighter than their children. One of the main reasons was jealousy. The data show that this style was applied more intensely among the Bedouin tribes and especially the tribes of Temim, which is considered to have started the process of burying girls. It is also said that the most jealous tribe of the Arabs is the Rebia tribe. Because of this feature, it is accepted that the first burial of the girl was started in this tribe.Although the Arab society before Islam was known by the atrocities of ignorance and weakness, there were people who were not completely dead and consciously dead. Even though they buried girls alive in society, some people who were disturbed by this rite that destroyed human dignity were trying to prevent ignorant and cruel fathers. The most well-known of the these was the famous poet Ferezdak, grandfather Sasaa b. Naciye.One of the main reasons for the behavior of burying girls alive before Islam was the fear of poverty. Most of them were living in the midst of starvation, and they were considering their daughters as burdens for the family. So they were burying their daughters because of poverty and hunger.One of the reasons for the murder of girls was the sense of honour. In Jahiliyya when a man marries a woman does not come to mind this sense, while marrying his own daughter to someone else sees this as a matter of dishonesty and and he says “it was more sweet to me to bury my daughter with my own hands rather than to marry my daughter. The idea of honour among the Arabs was the idea that their daughters and women would one day be in the hands of the enemy and thus would become a concern for themselves.One of the attributes of the nobles of Arabs was pride and vanity. If someone become arrogant to him and he doesn’t reply, he would be considered a coward. This arrogance dominated the movements of the people of the ignorance. In their eyes, it was so bad to marry someone who was not equal, that they were more likely to die than marrying someone. They were doing this because they had a bit of compassion for them. According to them, girls could not shoulder the heavy burden of life. There were many ways to kill the girl before Islam. But the most common of these was to push him into a hole he had dug before and to throw soil over her and bury her alive. The most commonly used method of killing girls by dumping them in the pits, though, was that they were drowned in the water or strangled. (shrink)

There are two main sources of compensation liability in Islamic Law of Obligations. These; contract and tort. Harming someone else is prohibited by any means. However, in social life, we witness that people harm others. Here, too, the legal order tries to ensure that the said damage is remedied. However, it is not a legal way to harm the other party for this. Are there other obligations at the same time as the liability for compensation? In this regard, Article 86 (...) of Mecelle regulates that compensation liability and usage benefit cannot be combined in accordance with the Hanafi sect. There are some theoretical reasons for this within the sect. However, other sects have opposing views to the Hanafi sect on this issue. In particular, they approached positively to the compensation of the usage benefit of the usurped property separately. The basis of this difference is based on whether the benefit is legally accepted as property. However, in the later periods, some exceptions were made to the first view within the Hanafi sect. These; foundation, orphan and commercial property. In addition, it has been accepted that in the Majalla amendments, the benefit can be accepted as property and may be the subject of compensation. Prophethood (nubuwwah) is a divine institution that teaches the healthy progression of relations between Allah and humans, as well as between humans and the universe. However, from another perspective, it is also considered a human institution. Some opponents of religion, lacking strong evidence to challenge the existence of Allah, direct their objections towards prophethood, which is seen as a manifestation of Allah’s attribute of speech (kalām). To counter the rejection of prophethood, scholars of theology (kalām), hadith, and Prophetic biography (sīrah) (...) have compiled a body of literature known as Dalāʾil al-nubuwwah (Proofs of Prophethood). Their aim has been to collect proofs supporting prophethood as a response to these refutations and to dispel doubts regarding it. All extraordinary events occurring from before the birth until the death of Prophet Muhammad are considered evidence.During the fifth century, a notable figure in this tradition was the Shāfiʿī scholar al-Māwardī, who defended prophethood in his book Aʿlām al-nubuwwah (The Signs of Prophethood). Aʿlām al-nubuwwah has inspired subsequent works in this field due to its clarity and robust proofs. It became known by both names, Aʿlām al-nubuwwah and Dalāʾil al-nubuwwah, as it encompassed methods of narration and debate. Within his work, al-Māwardī mentions figures like Barāhimah, Dahriyyah, and certain philosophers as representatives of the idea rejecting prophethood. According to him, Barāhimah, of Indian origin is a sect that denies prophethood despite accepting the unity of Allah. Dahriyyah is a denialist sect attributing eternity to the universe and creativity to nature. Al-Māwardī considers these philosophers as infidels due to their comments on prophethood rather than outright denial. The basis of these movements' idea of denying prophethood lies in their efforts to portray reason (ʿaql) as an alternative to revelation (waḥy). Jews and Christians, on the other hand, are portrayed as groups that accept the concept of prophethood, however they reject Muḥammad’s. prophecy. Their objection stems from the fear of their religions being superseded. Al-Māwardī counters those rejecting prophethood by addressing the public interest (maṣlaḥah) of humans, the necessity of prophets, and the role of miracles. He illustrates that prophet charged with the duty of prophethood proves it through spectacular events orchestrated by Allah but carried out through his own hand. The prophet serves the public interest by conveying matters beyond human intellect and presenting them in a comprehensible manner, thereby ensuring the worldly and eternal felicity of humanity. Furthermore, he provides evidence for the Prophet Muḥammad’s prophethood through his moral character, prophetic biography, and accounts of miracles. The biography of Prophet Muhammad’s begins before his birth, and the method of proof is used to demonstrate his prophethood. In essence, al-Māwardī’s method of proving prophethood in Aʿlām al-nubuwwah can be seen as a synthesis of the approaches used by scholars of theology and hadith. One prominent figure in this tradition during the fifth century was the Shafi'i scholar al-Māwardī who defended prophethood through his book " ʿA'lām al-Nubuwwa" (The Signs of Prophethood). In his work, al-Māwardī mentions figures like Barahima, Dahriyya, and certain philosophers as representatives of the idea rejecting prophethood. While the Jews and Christians accept the concept of prophethood, they reject the prophecy of Muhammad (P.B.U.H). The one of goals that religious provisions aim to achieve is the preservation of the generation. For this reason, Islam recommends marriage and prohibits all illegitimate relationships outside of marriage. He also ordered the parties to respect each other's rights and fulfill their responsibilities in order to maintain the marriage union. He requested that all attitudes and behaviors that would disrupt the marriage union be avoided. How ever, from time to time, a word said or a behavior exhibited by one (...) or both spouses shakes the marriage union and even leads to its end. Situations that can be described as severe disagreements that occur between spouses and make the continuation of the marital union almost impossible are expressed with the concept of “shiqàq” in fiqh. Failure of the parties to observe marriage law in domestic relations is one of the main reasons that lead to “shiqàq”. Although the reasons for the “shiqàq” that leads the spouses to discord are not explained in the relevant verse, it is recommended that in case of “shiqàq”, the institution of arbitration should be applied and the arbitrators should first reconcile the relationship between the spouses and prevent the breakdown of the marital union. On the other hand, it is controversial among the sects whether arbitrators have the authority to terminate a marriage union that they do not find beneficial to continue. While the fuqaha, who argue that arbitrators are in the position of attorneys, say that referees cannot separate the spouses without the consent of the spouses, those who say that arbitrators are in the power of judges are of the opinion that arbitrators have the authority to separate husband and wife regardless of the consent of the spouses. In addition, in case of “shiqàq”, the man can directly divorce his wife, and the woman can request the judicial authorities to separate from her husband. In this study, which deals with the issue of “shiqàq” in the context of family law, first of all, the meaning of “shiqàq”, the issues that cause this situation and the legal consequences attached to this concept will be revealed. In this study, teachers' views are evaluated to determine whether there is a relationship between the humor styles of school principals and the health of an organization. The study is based on a mixed research approach with both quantitative and qualitative aspects. In the quantitative study, the teachers were asked to describe their principals' senses of humor using the “humor behavior scale” and to evaluate the organization in which they worked using the “organizational health inventory.” In the qualitative dimension, principals (...) working in primary schools were interviewed and asked to evaluate their own sense of humor and the school's health. When the quantitative findings were examined, the regression results showed that school principals with a cynical style of humor negatively predicts organizational health, and productive social and affirmative styles of humor positively predict organizational health. In the qualitative study, the content analysis results revealed that a school administrator who uses humor effectively is capable of effectively solving problems in the school. However, it has been stated that the humor style of the school principal can have negative effects as well as positive effects. School principals are advised to recognize the teachers with whom they work and to distinguish which teachers are receptive to humor. (shrink)

This book provides an alternative foundation for the measurement of the production of nations, and applies it to the US economy for the postwar period. The patterns which result are significantly different from those derived within conventional systems of national accounts. Conventional national accounts seriously distort basic economic aggregates, because they classify military, bureaucratic and financial activities as creation of new wealth, when in fact they should be classified as forms of social consumption which, like personal consumption, actually use up (...) social wealth in the performance of their functions. The difference between the two approaches has an impact not only on basic aggregate economic measures, but also on the very understanding of the observed patterns of growth and stagnation. The present study aims to determine the key antecedents that affect consumers' electric vehicle (EV) purchasing behavior. In this context, the study expanded the existing framework of TPB (attitude, subjective norms, perceived behavioral control) by incorporating four new variables (product attributes, cognitive status, monetary incentive policies, and nonmonetary incentive policies). At this point, the study is of great importance in terms of understanding consumers' perspectives on EV purchasing behavior and to help policymakers, businesses, and marketers support sustainable production and consumption (...) by creating effective strategies. In addition, this study conducted in Türkiye, which shares similar consumption behaviors with Middle Eastern, Asian, and European societies, provides valuable insights for a rapid transition to the adoption of EVs. In the study, data were collected from 390 respondents with the survey method and the collected data were analyzed using Smart PLS 4.0 and SPSS 26 statistical software. The findings showed that only attitude together with cognitive status, product attributes, and monetary incentives policy contribute to EV purchasing behavior. In light of these findings, it can be argued that there is a need to increase efforts to develop more positive consumer attitudes toward EVs, to enhance their cognitive status, and to promote product attributes to encourage the widespread adoption of EVs. At the same time, monetary incentives policies are an important element in the adoption of EVs and therefore policymakers need to make great efforts. (shrink)

Coordination of a power system with the phasor measurement devices in real time on the load and generation sides is carried out within the context of smart grid studies. Power systems equipped with information systems in a smart grid pace with external security threats. Developing a smart grid which can resist against cyber threats is considered indispensable for the uninterrupted operation. In this study, a two-way secure communication methodology underpinned by a chaos-based encryption algorithm for PMU devices is proposed. The (...) proposed system uses the IEEE-14 busbar system on which the optimum PMU placement has been installed. The proposed hyperchaotic system-based encryption method is applied as a new security methodology among PMU devices. The success of results is evaluated by the completeness of data exchange, durations, the complexity of encryption-decryption processes, and strength of cryptography using a microcomputer-based implementation. The results show that the proposed microcomputer-based encryption algorithms can be directly embedded as encryption hardware units into PMU and PDC devices which have very fast signal processing capabilities taking into considerations the acceptable delay time for power system protection and measuring applications and quality metering applications which is 2 ms and 10 ms, respectively. While proposed algorithms can be used in TCP or UDP over IP-based IEEE C37.118, IEC 61850, and IEC 61850-90-5 communication frameworks, they can also be embedded into electronic cards, smartcards, or smart tokens which are utilized for authentication among smart grid components. Developments in information and communication technologies have created change and transformation in news production and reading habits, and the use of artificial intelligence in the journalism sector has become inevitable as the process transforms society. With artificial intelligence journalism, news can be produced and edited quickly. However, this speed and automation can create problems for readers in terms of accuracy and detail in consuming the news. In this context, the roles of journalists are also changing, and they are effective in (...) checking the accuracy of news and developing public awareness. Automated news production has developed with the use of artificial intelligence-based software. In the automated news production process, which has come to the agenda through artificial intelligence, the automated creation of news through a number of algorithms and software and its rapid presentation to consumers has taken its place in the new generation journalism. Therefore, with the use of artificial intelligence in news production, public awareness should also be taken into consideration. This study investigates public awareness in the context of automated news production and news reliability, objectivity, confidentiality, employment problems of journalists and ethical rules. The independent variables of the study are the gender, age, education and occupation of newspaper consumers, while the dependent variables are the public opinion on the characteristics of the news in the face of news produced with artificial intelligence. The population of the study consists of individuals who use social media, read digital newspapers and are over the age of 18, while the sample consists of 400 people who voluntarily responded to the study. In the study, half of the participants are aware of the concept of artificial intelligence and that news is sometimes produced with artificial intelligence. Most of the participants think that weather news is produced by artificial intelligence, as well as economy, earthquake, weather and sports news are all produced automatically. The majority of the participants think that they are concerned about the reliability of the news produced by artificial intelligence, that these news are more qualified and more reliable than the news produced by the traditional news production process. Some of the participants also think that their news needs should be met through news produced by artificial intelligence today. It has been also found that there were significant differences between the gender, age and occupational groups of the participants and their attitudes towards news produced by artificial intelligence. In this paper, I analyse the issue of “hadith fatwas”, which has not studied enough in academic ground. The litera-ture of hadith fatwas is consisted of the questions asked by all Muslims, whether they have academic interest in Hadith or not, to the scholars and the answers given by the scholars. The most famous samples of this literature, which dates back to 3rd century AH, were written in the 9th and 10th century AH. One of the most distinguishing features of (...) this genre is that it addresses all Muslims. Various modern works can be included in this literature, which are similar to hadith fatwas in terms of the form and the audience addressed by them. However, the works of the pre-modern and modern eras differ in the sense of the questions and the answers. In order to introduce this genre and compare between its samples in two different eras, I examine the works of as-Sahawi, as-Suyuti, Ahmet Yücel and Yavuz Köktaş. The intra-school controversies in Hanafī school are remarkable. These controversies pose a risk for legal safety and stability and creates difficulties for muqallīd Hanafī judges and muftīs. In the historical process, different types of literature such as mukhtaṣar and fatwa (legal opinion) books, and applications such as aṣṣaḥ-ı aqvāl and maʻrūdhāt, emerged to solve this problem. One of the last example of these applications is the codification movement. The subject of this study is the relationship between the Majalla al-Aḥkām al-ʿAdliyyah, (...) which is the first product of codification based on fiqh (Islamic jurisprudence), and the intra-school preference. In order to describe this relationship, it is briefly emphasized that one of the aims of codification of Majalla is to satisfy the need for intra-school preference. The function and content of Majallaʼs necessary reasons, (asbāb al-mūjiba) was analyzed in terms of intra-school preference. The interventions on the preferences of the Majalla Commission are also emphasized. The Majalla is a text of the intra-school preference. The analysis of its content in relation to intra-school preference is very important. Therefore, in order to reveal what kind of method is used in intra-school preferences and to determine different aspects of intra-school preference in the Majalla, the chapter about ‘sale’ (Kitāb al-Buyūʿ) of the Majalla are examined.Summary: The intra-school controversies in Hanafī School, which is quite important in terms of freedom of ijtihād (independent legal judgment) and legal wealth, possible to threaten legal safety and stability. These controversies also make difficult for judges to reach a judgment or fatwa in controversial affairs. For this reason, determination of the rājiḥ (preferred opinion) in controversial issues in the school, is a need that must be eliminated.The intra-school preference can be described as "to determine the superior, preponderant of different opinion or narrations about a specific issue in the school". In the historical process different types of literature such as mukhtaṣar and fatwa books, and different applications such as asaḥḥ-ı aqvāl and maʻrūzāt, emerged to meet this need. One of the applications aimed to meet this need is the codifications in the last period of the Ottoman State.The relationship between the Majalla al-Ahkam al-Adliyyah, which is the first example of codification based on fiqh (Islamic jurisprudence), and the intra-school preference; and in this context, while preparing the Majalla how a method was followed in the intra-school preference; at what rate be obeyed the rājiḥ (preferred) opinion; articles contrary to the rājiḥ (preferred) opinion in Majalla and their reasons; whether legal arrangements have been made in all controversial issues; at what rate be met the need of determination of rājiḥ (preferred) opinion are the issues that need to be examined.One of the main reasons for the need for a law text such as Majalla al-Ahkam al-Adliyyah is the multitude of the intra-school controversies in Hanafī School. Therefore, the goal of Majalla is to prepare a code that contains rājiḥ opinion.When Majallaʼs necessary reasons, i.e. asbāb al-mūjiba, are examined in terms of the intra-school preference, it is seen that there are two basic functions of necessary reasons. The first of them is, emphasizing that the code is prepared substantially in accordance with the râjih opinion in the school. In fact, that this issue in the asbāb al-mūjiba of the first ten books of Majalla is expressly stated. The other function of the asbāb al-mūjiba is to justify that why rājiḥ opinion are not be confirmed in some article. In the necessary reasons it is stated that twelve articles are prepared in the direction of unrâcih (unpreferable) opinion. Considering that Majalla is formed of 1851 article, it will be better understood that how the rājiḥ opinions are effective in Majalla's content. Essentially, the conditions of the period also make it necessary. The preference of the non-preferred opinion of Züfer (d. 158/775) in 692nd article of Kitāb al-Ḥavala, caused the reaction of some circles mainly Şeyhülislam Hasan Fehmi Efendi (d.1298/1881) and for this reason Ahmet Cevdet Pasa (d.1895) was dismissed from the ministry of Divan al-Ahkâm al-Adliyyah and the chairman of the Majalla Commission.When the asbāb al-mūjibas of contrary articles to rājiḥ opinions are examined, it is seen that maṣlaḥa and customs are determinative in these preferences. It is also seen that the preferences of some jurists are also mentioned as a reason of preference. The most widespread preference’s reason in Hanafī sources is in congruity with the texts. On the contrary, it is noteworthy that, besides the interdiction of extravagant (safih), it is not operated as a preference’s reason in Majalla.Some preferences of the Majalla Commission were intervened by other institutions. The chapters prepared by the commission were examined both by Majlis-i Wukalā and Mashihat, and these chapters were subject to some revisions at this time. Here, two articles prepared on the basis of the non-preferred opinion were intervened by Majlis-i Wukalā. The first of these is 216th article that written in the direction of opinion of Mashāyikh Balkh, which argues that it is permissible to sell separately ḥaqq al-murūr (the right of passage) and ḥaqq al-shirb (water right), the second is the 611th article which regulates the liability to damage of ajīr al-mushtarak (joint salaried employee).When the content of Kitāb al-Buyū, the first and the most voluminous book of Majalla, is examined in terms of the intra-school preference, it is seen that the rājiḥ opinions in the school are generally taken as basis. It is stated that in the asbāb al-mūjiba of the Kitāb al-Buyūʿ the four issues are prepared basing on the non-preferred opinion and these preferences are justified with custom and maṣlaḥa. However, the contrary articles to the rājiḥ opinion in the Kitāb al-Buyūʿ are not limited to these. According to our research, in addition to these, three articles were prepared with the preference of non-preferred opinion. These are the 118th article regarding that the bayʻ bi-l-wafā is permissible in chattels, 165th article on the definition of al-ghabn al-faḥiş (lesion), and the 309th article concerning the provision of the khiyār al-sharṭ (right of cancellation). These three articles show that the regulations contrary to the rājiḥ opinion in Majalla are not just those explained in the asbāb al-mūjiba and this situation is contrary to the method that is followed when preparing the Majalla.In some controversial issues in the Hanafi School, authorized jurists to preference (asḥāb al-tarjīh) disagreed over which opinion is rājiḥ. It wasn’t explained that how a method would be followed in Majalla when the legal arrangements were made in these matters. When these issues are examined, it can be said that the preferences of the majority, the providing of convenience and the preference by some jurists are effective.Preferences in Majalla have not been occurred only among the sharʻī (related to Islamic Law) provisions. In addition, the definitions and the inscription in the definitions are also the subject of preference. In this context, the preferences related to the definition of the sales contract, the suspended contract (al-ʻaqd al-maqqūf) and the al-ghabn al-faḥiş in Kitāb al-Buyūʿ can be mentioned as an example.Some controversial issues in the Hanafi School are not regulated in Majalla. When considering the multiplicity of controversial issues and therefore the difficulty of making legal arrangements to cover all of them, this situation is natural. Moreover, some of these issues may not have been regulated in Majalla because they are not frequent and necessary. However, it is not possible to explain all the controversial issues that have not been regulated for these reasons. Because some of the controversial issues that have not been legislated are basic, relatively important issues and they are included in the mukhtaṣars. This indicates that when preparing the Majalla, instead of making preference on some controversial issues, the method of non-regulation of these matters is adopted. It can be said that this method is applied as a way of creating law text which is clear of controversy. Thus, the determining of the rājiḥ opinion in these matters has been left to the judges. This situation is not suitable to meet the need of determining the rājiḥ opinion, which is the goal of Majalla. But it is the result of the difficulty of making a law that encompasses all legal issues. (shrink)

Aḥmed Cevdet Pasha (d. 1312/1895) is one of the influential and prominent Ottoman scholars in history and law. Besides history and law, he also produced works on literature, sīra (the life of the Prophet) and tafsīr (the Qur’anic exegesis). In the last years of his life, Cevdet Pasha aimed to translate the Qurʾān including short comments on the verses, but this work was remained limited to the sūrah al-Baqara. Correspondingly to this translation named Terjeme-i Sharīfa, he prepared a glossary to (...) the Qurʾān called Lāḥiqa-i Sharīfa for expressions and terms that require detailed explanation. Hereby, this work could only include the sūrah al-Baqara. After Cevdet Pasha’s death, his books passed to his daughter Ms Fāṭima ʿAliyye (d. 1936). The director of the Library of Maʿārif, Nācī Qāsim (d. 1963) gave a deed stipulating that he would take the first part of the Lāḥiqa-i Sharīfa and Terjeme-i Sharīfa from her and return them as they are. Later on, he published only the Muqaddima (introduction) and Lāḥiqa-i Sharīfa in the work named Tercemeli Ḳurʾân-ı Kerîm (İstanbul: 1927). Placing the Muqaddima at the beginning of the book and Lāḥiqa-i Sharīfa at the end misled some people by making them to think that the translation belongs entirely to Cevdet Pasha. Sulayman Tevfīq reprinted these two works together within his translation named el-Beyān fī ʾāyāti’l-Qurʾān in 1928. Terjeme-i Sharīfa has not been published anywhere else. Emine Armağan recently found and published a notepad in which Cevdet Pasha wrote Terjeme-i Sharīfa, mentioned Muqaddima and Lāḥiqa-i Sharīfa. In her book Emine Armağan printed the pages belonging to Cevdet Pasha as thumbnails, but she did not publish them in Latin. In this article, Muḳaddime and Lâḥika-i Şerîfe are Latinized and compared to the Terceme-i Şerîfe. The relevant parts of the translation are given in the footnotes. This study is an attempt to determine to what extent the translation in the manuscript form corresponds to the glossary and the soundness of relating the text to the author. In addition, many errors in the Ottoman edition of the glossary were also corrected. In the Muqaddima, Cevdet Pasha draws attention to the necessity of God’s existence, the illiteracy and the trustworthiness of his Messenger, and that the revelation is the primary source of knowledge for people. He summarizes the process of the Qurʾān’s revelation, notification and compilation. He briefly touches on the issues related to ʿUlūm al-Qurʾān. Cevdet Pasha, who passed from here to the miracle of the Qurʾān, talks about the qadim (pre-existing) nature of the divine word and teḥaddī. Cevdet Pasha emphasizes that understanding the Qurʾān is possible only by knowing the Arabic language very well and whithout this knowldege the Qurʾān cannot adequately be translated into another language. On the other hand, he also believes that the first meanings can be externally translated in order to explain the first meanings of the verses to those who do not know Arabic. Cevdet Pasha’s preface is considerably concise in structure. He shortly pointed to the crucial issues in one sentence and passed to the other subjects. While writing Terjeme-i Sharīfa, Cevdet Pasha left the extensive explanations of the polysemous words and terms that cannot be translated literally to the tafsīr and Lāḥiqa. Cevdet Pasha’s Lāḥiqa-i Sharīfa is entirely original and not merely a translation of any Qurʾānic dictionary. He compiled the meanings of a word existing in different verses, and he was very meticulous in choosing the meanings the words. He summarized very detailed informations in the sources in a simple, concise and fluent style. The arrangement of the words was based on the abbreviated versions used in the Qurʾān. In addition to the lexical meaning of the word, he sometimes mentioned the words’ roots, form, singular and plural forms, ism al-fāʿil, ism al-mefʿūl, ism al-mekān, synonym/antonym, lexical aspects, the meaning and terminology it expresses in different recitations of the Qur’an (al-qırāat). He in particular highlighted if the word is one of the al-asmāʾ al-ḥusnā. He explained the changes in the meaning of a word when it is used for Allah or for humans. He shortly touched on the legal rulings. Cevdet Pasha clearly expressed in his work the most vital issues that the community should know without tiring the general reader of scientific disputes, philosophical discussions and literary analysises. Cevdet Pasha did not refer to any sources in his work and did not mention the transmission chain of the narrations. As a result of our research, we determined that he benefited from the commentaries of al-Zamakhshari (d. 538/1144), al-Rāzī (d. 606/1210), al-Qurṭūbī (d. 671/1273) and Beyḍāvī (d. 685/1286). We have seen that there are some similarities between the explanations of the words in the Lāḥiqa-i Sharīfa and the famous Qurʾānic dictionaries such as al-Mufredāt, Umdet al-ḥuffāẓ and Beṣāir. It is known that the relationship between word and meaning is one of the most controversial topics of ancient Greek philosophers such as Aristotle, Plato and Indian linguists. In fact, this issue has continued to be discussed with its definition and scope, and opinions about it have been expressed until today. When we review the subject in the Arabic language, we see that Arabic is a rich language with its words and meanings. Also, changes and developments in Arabic, which is (...) a deep-rooted language, has undergone in the historical process have brought changes of meaning in its words. Thus, it can be said that the Arabic language, that includes many branches of linguistics such as morphology, syntax and rhetoric, is also interrelated with semantics, what focuses on the relationship between word and meaning. Although semantics has emerged as a new branch of linguistics, many of today's semantic issues have been discussed in many classical sources and different disciplines, especially in the Arab world. In this study, semantics in general and the emergence of Arabic semantics as a science, its scope, description and its relations with other languages have been investigated. In addition, the works of Ahmed Muhtar Omar (1933-2003) who made great effort especially in the field of Arabic language and the modern Arab world, in the domain of Arabic and his contributions to this field, those include the main issue of this study, have been addressed. The general content of his book "Ilmu'd-dalâla", which includes almost all the topics related to semantics, and the important issues and views those it contains are also mentioned. Besides, presenting important issues in the work, especially Ahmed Muhtar Omar's prominent views and explanations are also mentioned. In the study, prominent works about semantics and Arabic semantics, written from the past to the present, were used. In particular, the life and scientific personality of Ahmed Muhtar has been tried to be presented on the basis of a few works written in the contemporary period. (shrink)

In this study, the rational criticism directed by Ibn Tayymiyya (d. 1338) to the philosophical evidence used to prove the unity of the necessary existent in the book Kitāb al-Is̲h̲ārāt wa al-tanbīhāt, which is accepted as a constitutive text in the history of Islamic philosophy, is examined. Author of the aforementioned book Avicenna (d. 1037) tries to prove the unity of the necessary existent from different ways in his books. Kitāb al-Is̲h̲ārāt wa al-tanbīhāt is a book that includes one of (...) these ways. The evidence that Avicenna uses in that book comprises of two preliminaries. The first preliminary is made up of specifying the relation between the thing that the different perceptible particular entities are common and are different. The second one is based on proving the existence not to be the cause of essence by centering the difference of existence and essence. Ibn Taymiyya, who criticizes philosophers in many ways, criticizes this evidence used by Avicenna in his work Mes’eletün fî tevḥîdi’l-felâsife. Rejecting the logic of Mashshaiyyun as science, Ibn Taymiyya also tried to refute the philosophical and logical rules that philosophers accept and use. In this context, Ibn Taymiyya argues that not only the preliminary presuppositions of the philosopher's argument to prove the unity of the necessary being, but also that the logical principles and rules previously accepted by the philosopher are false. One of the most important issues criticized by the thinker in relation to the subject is the reality of concepts, the existence of universals, how universals are moved to particulars, and the state of quiddity. According to him, concepts are mental and universals do not have a reality in the external world. Again, he thinks that universals like humanity are attributed to particulars as attributes, and therefore, in a way, he denies the universal being universal. Because, according to Ibn Taymiyya, a certain attribute of a being that is particular cannot be universal unlike itself. According to the thinker, the commonality in the concepts that logicians call universal consists only of a linguistic partnership. Undoubtedly, it can be said that Ibn Taymiyya's thought on the issue of concepts is close to nominalistic approach in a way. But he does not directly deny the reality of the concepts. For, according to him, the concepts that are universally formed in the minds are actually realized particularly. That is to say, the universal humanity has been realized particularly in individuals such as Ahmet and Mehmet. In other words, because the humanity in individuals is particular, Ahmet's humanity is different from Mehmet's humanity. For this reason, there can be no real partnership among the examples given. In this context, the unity distinction made by Ibn Taymiyya in understanding his thoughts is helpful. According to him, unity is of two types, real and qualitative. Real unity is the unity that exists in the essence of the individual. The qualitative unity is the unity that exists between the things under the concept of the universal. However, the qualitative unity is not considered as a unity since it does not occur in the external world. In fact, this is what distinguishes Ibn Taymiyya from nominalist thinkers. If we turn back to the evidence of Avicenna, based on the objections that Ibn Taymiyya made to the logic and philosophical principles of Mashshaiyyun in general, we can say that the thinker criticized the precedents of this argument by emphasizing the knowledge that universal concepts are intellectual entities. He emphasizes the examples that Avicenna uses to show the affiliation among the things are only made up of universal notions and alleges them not to have perceptible entity. Thus, he says that there is not a real affiliation among different particular entities that have perceptible existence. As to the second preliminary, Ibn Taymiyya says that this preliminary is also inaccurate for the reason that it is, like the first preliminary, based on the knowledge that the intellectual entities had come true in the physical world. According to him, the essence is made up of intellectual conceptualization. Therefore, it has not physical reality. After criticizing the preliminaries in this manner, Ibn Taymiyya says that the analogy that consists of these preliminaries is also erroneous. Because the analogy that is based on erroneous preliminaries does not give a correct result. (shrink)

This article aims at revealing the patriarchal pattern that has dominated Turkish political thought in the 20th century. I analyse the construction of woman's identity in the writings of three prominent thinkers of the early-republican era (1923–1945); namely, Ahmet Aǧaoǧlu, Peyami Safa and Zekeriya Sertel. The thinkers are deliberately chosen since each represents challenging political dispositions vis-à-vis the others. Ahmet Aǧaoǧlu is a liberal-nationalist, Peyami Safa is a well-known conservative thinker and Zekeriya Sertel is a leftist. However, despite (...) the differences between and/or opposing foundations of their approaches all the three thinkers agree that there is a universally valid woman nature, attested by women's reproductive function, and approach the ‘woman issue’ on the basis of this assumption. The thinkers also argue that participation of women in public sphere inevitably results in their masculinization. Moreover, they distinguish between femininity and womanhood and offer their ideal models of womanhood. Although one can trace differences among the models, all converge on the concept of ‘nation's motherhood’ as the most significant feature of ideal womanhood. The main argument of the article is that women's subordination in the Turkish context is reinforced by the wide acceptance of these assumptions, and is further reproduced by the exclusion of the construction of gender typologies in the studies on Turkish political thought for a considerably long time. Sartre’s phenomenology of the image in L’Imaginaire includes analytical distinctions between the mind’s comportments towards perceptual objects, images, and signs, which he refers to as different forms of consciousness. Sartre denies any possible convergence between imaging and sign consciousness, arguing that there are essential differences in the way they relate to the notions of resemblance, positionality, and affect. This essay argues against his phenomenological distinctions by stressing the continuity of imaging with sign consciousness: between images and words. In particular, it (...) argues that his understanding of the sign as affectless is questionable and that there is no reason to believe that images and signs cannot elicit similar affects or perform the same functions. Consequently, it is possible to interpret Sartre’s physical images or “analoga” as pictorial signs: his phenomenological descriptions of physical images may indeed be recast in the language of the sign and reformulated as acts of consciousness that involve pictorial signs. Every science examines the personal accidents of the subject, which it determines as its subject, and the sciences differ from each other in this aspect. However, sciences offer the principles that they prove themselves through the use of other sciences. Sciences take and use the principles of other sciences that they will need, but they do not have to prove these principles in themselves. On the contrary, they entrust this proof to the sciences from which they took their principles. While (...) examining the sources of fiqh and the method of making judgments from these sources, the method of fiqh uses the principles set forth in other sciences in the problems it encounters. One of the sciences in which the method of fiqh takes principles is kalām. Actually, the science of kalām provides principles to all other sciences with the conception of God and the world it reveals. One of these principles is the indeterminist understanding of the world, in other words, the theory of ʽādah (custom). The theory of custom, produced in the tradition of Ahl al-Sunnah Kalām, is a theory that cancels causality and makes all effects in the world peculiar to Allah. According to this theory, Allah operates the universe according to the laws of physics, which are named custom. However, this theory makes it possible for Allah, if He wills, to do extraordinary acts that are described as humanly extraordinary. Since the Fiqh and its Methodology, which is assisted by the science of kalām, is a science that is expected to judge according to the apparent, it seems to be contrary to his identity to make judgments by using the possibilities of the theory of custom. However, like the situation of a person who becomes a Muslim at the last moment of prayer, sometimes things get so tight that it becomes very difficult to judge according to outward appearance. Well, did the methodists look at the outward appearance and decide that this person is not responsible for the prayer of the aforementioned time, or did they come to a different conclusion by using the possibilities of the theory of custom.
