We present a formal, mathematical model of argument structure and evaluation, taking seriously the procedural and dialogical aspects of argumentation. The model applies proof standards to determine the acceptability of statements on an issue-by-issue basis. The model uses different types of premises (ordinary premises, assumptions and exceptions) and information about the dialectical status of statements (stated, questioned, accepted or rejected) to allow the burden of proof to be allocated to the proponent or the respondent, as appropriate, for (...) each premise separately. Our approach allows the burden of proof for a premise to be assigned to a different party than the one who has the burden of proving the conclusion of the argument, and also to change the burden of proof or applicable proof standard as the dialogue progresses from stage to stage. Useful for modeling legal dialogues, the burden of production and burden of persuasion can be handled separately, with a different responsible party and applicable proof standard for each. Carneades enables critical questions of argumentation schemes to be modeled as additional premises, using premise types to capture the varying effect on the burden of proof of different kinds of questions. Argument invention is a method that can be used to help an arguer find arguments that could be used to prove a claim he needs to defend. The aim of this paper is to show how argumentation systems recently developed in artificial intelligence can be applied to the task of argument invention. One such system called Carneades is featured. Carneades can be used to analyze arguments, evaluate arguments, to make an argument diagram, and to construct arguments from a (...) database. The centrepiece of Cicero's De re publica is a discussion of justice. This discussion, which evokes the theme of the Platonic dialogue after which it was named, consists of a set of three speeches. It begins with a speech opposing justice, placed in the mouth of L. Furius Philus and alleged by him to be modelled on the second of a pair of speeches for and against justice delivered in Rome in 155 B.C. by the Greek Academic philosopher Carneades. (...) Philus' speech lays the dialectical foundation for the two subsequent speeches, a defence of justice as the prerequisite for government by C. An ancient argument attributed to the philosopher Carneades is presented that raises critical questions about the concept of an all-virtuous Divine being. The argument is based on the premises that virtue involves overcoming pains and dangers, and that only a being that can suffer or be destroyed is one for whom there are pains and dangers. The conclusion is that an all-virtuous Divine (perfect) being cannot exist. After presenting this argument, reconstructed from sources in Sextus Empiricus and Cicero, this (...) paper goes on to model it as a deductively valid sequence of reasoning. The paper also discusses whet her the premises are true. Questions about the possibility and value of proving and disproving the existence of God by logical reasoning are raised, as well as ethical questions about how the cardinal ethical virtues should be defined. In this paper, a case study is conducted to test the capability of the Carneades Argumentation System to model the argumentation in a case where forensic evidence was collected in an investigation triggered by a conflict among art experts on the attribution of a painting to Leonardo da Vinci. A claim that a portrait of a young woman in a Renaissance dress could be attributed to da Vinci was initially dismissed by art experts. Forensic investigations were carried out, (...) and evidence was collected by art history experts and scientific experts. The expert opinions were initially in conflict, but new evidence shifted the burden of proof onto the side of the skeptics. This paper has three dimensions, historical, theoretical and social. The historical dimension is to show how the Ciceronian system of dialectical argumentation served as a precursor to computational models of argumentation schemes such as Araucaria and Carneades. The theoretical dimension is to show concretely how these argumentation schemes reveal the interdependency of rhetoric and logic, and so the interdependency of the normative with the empirical. It does this by identifying points of disagreement in a dialectical format through using argumentation (...) schemes and critical questions. The social dimension is to show how the Ciceronian dialectical viewpoint integrates with the use of computational tools that can be used to support the principle of reason-based deliberation and facilitate deliberative democracy. In this paper a theoretical definition that helps to explain how the logical structure of legal presumptions is constructed by applying the Carneades model of argumentation developed in artificial intelligence. Using this model, it is shown how presumptions work as devices used in evidentiary reasoning in law in the event of a lack of evidence to assist a chain of reasoning to move forward to prove or disprove a claim. Plausible (eikotic) reasoning known from ancient Greek (late Academic) skeptical philosophy is shown to be a clear notion that can be analyzed by argumentation methods, and that is important for argumentation studies. It is shown how there is a continuous thread running from the Sophists to the skeptical philosopher Carneades, through remarks of Locke and Bentham on the subject, to recent research in artificial intelligence. Eleven characteristics of plausible reasoning are specified by analyzing key examples of it recognized as (...) important in ancient Greek skeptical philosophy using an artificial intelligence model called the Carneades Argumentation System (CAS). By applying CAS to ancient examples it is shown how plausible reasoning is especially useful for gaining a better understanding of evidential reasoning in law, and argued that it can also be applied to everyday argumentation. Our analysis of the snake and rope example of Carneades is also used to point out some ways CAS needs to be extended if it is to more fully model the views of this ancient philosopher on argumentation. It can be said that the roots of the studies on the argumentation theory go back to rhetorical and dialectical studies. One of the sub-fields of the argumentation theory is argument schemes, used in everyday language and various fields within certain rules. Today, with the studies in the field of informal logic, argumentation schemes have aslo become an important field to study. The argumentation schemes approach also plays an important role in the study of artificial language at the intersection of (...) the computer science area. In this article, we discussed Douglas Walton’s argumentation schemes approach. Douglas Walton's aim is to determine the natural language arguments used in various fields and make as a list of them and propose a classification for argumentation schemes. Douglas Walton, presents a model for the argumentation schemes. This model also emphasized the structure suitable for use in computer systems. Determination, analysis and evaluation of arguments are important topics for the arguments applying to computer systems. In this article, we discuss one of these systems, Thomas Gordon’s project, the Carneades Argumentation System. The Carneades Argumentation System is a system which can handle Douglas Walton's argumentation schemes. With the Carneades Argumentation System, it is possible to visualize arguments as an argument map. The visualization of an argumentation provides a concrete basis for philosophical discussions. It makes it easy for the user to determine the scheme of the current argument when applying the argument formats to mapping and evaluation systems such as Carneades Argumentation Systems. Determining the argument scheme allows the argument to be handled within a particular model. The aim of this article is to discuss the argumentation schemes which is one of the topics of study at the intersection of philosophical logic and computer sciences in which informal logic studies are developing today. In this paper, the Carneades argumentation system is extended to represent a procedural view of inquiry in which evidence is marshalled to support or defeat claims to knowledge. The model is a sequence of moves in a collaborative group inquiry in which parties take turns making assertions about what is known or not known, putting forward evidence to support them, and subjecting these moves to criticisms. It is shown how this model of evaluating evidence in an inquiry (...) is based on a defeasible logic using forms of argument that admit exceptions. It is contended that reasoning from absence of knowledge is as important to inquiry as positive reasoning from evidence to knowledge. The philosophical conflict between this view of reasoning about knowledge and the true-belief-plus view is explored by airing objections and replies on both sides. (shrink)

This paper proposes an argumentation-based procedure for legal interpretation, by reinterpreting the traditional canons of textual interpretation in terms of argumentation schemes, which are then classified, formalized, and represented through argument visualization and evaluation tools. The problem of statutory interpretation is framed as one of weighing contested interpretations as pro and con arguments. The paper builds an interpretation procedure by formulating a set of argumentation schemes that can be used to comparatively evaluate the types of arguments used in cases of (...) contested statutory interpretation in law. A simplified version of the Carneades Argumentation System is applied in a case analysis showing how the procedure works. A logical model for statutory interpretation is finally presented, covering pro-tanto and all-things-considered interpretive conclusions. (shrink)

Tribunals have come to depend increasingly on expertise for determining the facts in cases. However, current legal methods have proved problematic to work with. This paper argues that, as a special model of public understanding of science, assessing expertise should consider source credibility of expertise from internal aspects, including scientific validity and reliability, and external aspects involving the credibility of experts. Using the Carneades Argumentation System we show that the internal and the external aspects are mediated by the (...) structure of the argument from expert opinion with its matching set of critical questions. I argue that comparisons of Stoic virtue to stochastic skills — now standard in the secondary literature on Stoicism — are based on a misreading of the sources and distort the Stoic position in two respects. In paradigmatic stochastic skills such as archery, medicine, or navigation the value of the skill’s external end justifies the existence and practice of the skill and constitutes an appropriate focus of rational motivation. Neither claim applies to virtue as the Stoics understand it. The stochastic (...) model of virtue almost certainly originated with Carneades and should be distinguished clearly from the Stoic account. Doing so clarifies the Stoic position and shows that it anticipates what Thomas Hurka calls a modern view of value. (shrink)

Schutz to general epistemological questions, starting from his view of the scientific theories and concepts formation, of type and model, of relevance, of proof and degree of belief. Great attention is paid to the resumption of Carneades’ mechanism, in which each operation of confirmation is linked to a level of credibility. In his numerous philosophical writings Cicero mostly adapted contemporary Greek sources, but occasionally he took up certain positions of his own. His propensity to scepticism in epistemology and dogmatism in ethics and political philosophy appears to be a further development of the model set forth by Carneades. Though Cicero was influenced by both Antiochus of Ascalon and Philo of Larissa—both of them claimed the heritage of the Platonic Academy—he owed a life-long allegiance to the Academic tradition of (...) class='Hi'>Carneades. Very often we are faced with a poor state of his own argument. But it seems to me very likely that in main questions his position was consistent throughout his life, and I consider his own philosophy as the beginning of the rising Middle Platonism. (shrink)

This paper applies recent work on scripts and stories developed as tools of evidential reasoning in artificial intelligence to model the use of argument from analogy as a rhetorical device of persuasion. The example studied is Gerry Spence’s closing argument in the case of Silkwood v. Kerr-McGee Corporation, said to be the most persuasive closing argument ever used in an American trial. It is shown using this example how argument from analogy is based on a similarity premise where similarity (...) between two cases is modeled using the device of a story scheme from the hybrid theory of legal evidential reasoning (Bex in Arguments, stories and criminal evidence: a formal hybrid theory. Abstract.Since the gene splicing debates of the 1980s, the public has been exposed to an ongoing sequence of genetic and reproductive technologies. Many issue areas have outcomes that lose track of people's inner values or engender opposing religious viewpoints defying final resolution. This essay relocates the discussion of what is an acceptable application from the individual to the societal level, examining technologies that stand to address large numbers of people and thus call for policy resolution, rather than individual fiat, in (...) their application. A major source of guidance is the “Genetic Frontiers” series of professional dialogues and conferences held by the National Conference for Community and Justice from 2002 to 2004. Genetic testing, human gene therapy, genetic engineering of plants and animals, and stem cell technology are examined. While differences in perspective on the beginning of life persist, a stepwise approach to the examination of genetic testing reveals areas of general agreement. Stewardship of life, human co‐creativity with the divine, and social justice help define the bounds of application of genetic engineering and therapy; compassionate care plays a major role in establishing stem cell policy. Active, sustained dialogue is a useful resource for enabling sharing of religious values and crystallization of policies. (shrink)

The estrangement between genetic scientists and theologians originating in the 1960s is reflected in novel combinations of human thought (subject) and genes (investigational object), paralleling each other through the universal process known in chaos theory as self-similarity. The clash and recombination of genes and knowledge captures what Philip Hefner refers to as irony, one of four voices he suggests transmit the knowledge and arguments of the religion-and-science debate. When viewed along a tangent connecting irony to leadership, journal dissemination, and the (...) activities of the "public intellectual" and the public at large, the sequence of voices is shown to resemble the passage of genetic information from DNA to mRNA, tRNA, and protein, and from cell nucleus to surrounding environment. This book brings together several directions of work in model theory between the late 1950s and early 1980s.

Arguments are provided for the reality of the quantum vacuum fields. A polarization correlation experiment with two maximally entangled photons created by spontaneous parametric down-conversion is studied in the Weyl–Wigner formalism, that reproduces the quantum predictions. An interpretation is proposed in terms of stochastic processes assuming that the quantum vacuum fields are real. This proves that local realism is compatible with a violation of Bell inequalities, thus rebutting the claim that it has been refuted by experiments. This paper introduces and defends an account of model-based science that I dub model pluralism. I argue that despite a growing awareness in the philosophy of science literature of the multiplicity, diversity, and richness of models and modeling practices, more radical conclusions follow from this recognition than have previously been inferred. Going against the tendency within the literature to generalize from single models, I explicate and defend the following two core theses: any successful analysis of models must target (...) sets of models, their multiplicity of functions within science, and their scientific context and history and for almost any aspect x of phenomenon y, scientists require multiple models to achieve scientific goal z. The grey system model with time power, which is often called the GM, appeals considerable interest of research due to its effectiveness in time series forecasting. Aimed to improve further the GM model, this paper introduces a new whitening equation with variable coefficient into the original whitening equation which extends applicable scope; as a result, an improved grey model with time power, namely, OGM, is proposed. Firstly, the time response function of the novel model and the (...) restored values of original series are deduced through grey modelling techniques. Secondly, the variable coefficient in the whitening equation and the time power are determined by particle swarm optimization algorithm. Two empirical examples are then used to verify the validity of the novel model. Finally, the novel model is applied to predict the oil consumption of China from 2004 to 2018. Results show the novel model outperforms other commonly-used competitive models, which can well serve a benchmark model for scholars and decision-makers. (shrink)
