Artificial intelligence systems advising healthcare professionals will be widely introduced into healthcare settings within the next 5–10 years. This paper considers how this will sit with tort/negligence based legal approaches to compensation for medical error. It argues that the introduction of AI systems will provide an additional argument pointing towards no-fault compensation as the better legal solution to compensation for medical error in modern health care systems. The paper falls into four parts. The first part rehearses the main arguments for (...) and against no-fault compensation. The second explains why it is likely that AI systems will be widely introduced. The third part analyses why it is difficult to fit AI systems into fault-based compensation systems while the final part suggests how no-fault compensation could provide a possible solution to such challenges. Psychiatry is rapidly adopting digital phenotyping and artificial intelligence/machine learning tools to study mental illness based on tracking participants’ locations, online activity, phone and text message usage, heart rate, sleep, physical activity, and more. Existing ethical frameworks for return of individual research results (IRRs) are inadequate to guide researchers for when, if, and how to return this unprecedented number of potentially sensitive results about each participant’s real-world behavior. To address this gap, we convened an interdisciplinary expert working group, supported by (...) a National Institute of Mental Health grant. Building on established guidelines and the emerging norm of returning results in participant-centered research, we present a novel framework specific to the ethical, legal, and social implications of returning IRRs in digital phenotyping research. Our framework offers researchers, clinicians, and Institutional Review Boards (IRBs) urgently needed guidance, and the principles developed here in the context of psychiatry will be readily adaptable to other therapeutic areas. Background: The factors influencing parents’ willingness to enroll their children in biobanks are poorly understood. This study sought to assess parents’ willingness to enroll their children, and their perceived benefits, concerns, and information needs under different consent and data-sharing scenarios, and to identify factors associated with willingness. Methods: This large, experimental survey of patients at the 11 eMERGE Network sites used a disproportionate stratified sampling scheme to enrich the sample with historically underrepresented groups. Participants were randomized to receive one of (...) three consent and data-sharing scenarios. Results: In total, 90,000 surveys were mailed and 13,000 individuals responded (15.8% response rate). 5737 respondents were parents of minor children. Overall, 55% (95% confidence interval 50–59%) of parents were willing to enroll their youngest minor child in a hypothetical biobank; willingness did not differ between consent and data-sharing scenarios. Lower educational attainment, higher religiosity, lower trust, worries about privacy, and attitudes about benefits, concerns, and information needs were independently associated with less willingness to allow their child to participate. Of parents who were willing to participate themselves, 25% were not willing to allow their child to participate. Being willing to participate but not willing to allow one’s child to participate was independently associated with multiple factors, including race, lower educational attainment, lower annual household income, public health care insurance, and higher religiosity. Conclusions: Fifty-five percent of parents were willing to allow their youngest minor child to participate in a hypothetical biobank. Building trust, protecting privacy, and addressing attitudes may increase enrollment and diversity in pediatric biobanks. (shrink)

An emerging approach to complement randomised controlled trial (RCT) data in the development of radiotherapy treatments is to use routinely collected ‘real-world’ data (RWD). RWD is the data collected as standard-of-care about all patients during their usual cancer care pathway. Given the nature of this data, important questions remain about the permissibility and acceptability of using RWD in routine practice. We involved and engaged with patients, carers and the public in a two-day citizens’ jury to understand their views and obtain (...) decisions regarding two key issues: (1) preferred approaches to consent for the use of RWD within the context of patients receiving radiotherapy for lung cancer in RAPID-RT and (2) how RWD use should be best communicated to patients. Individual views were polled using questionnaires at various stages of the jury, whilst group discussion activities prompted further dialogue about the rationale behind choices of consent. Key decisions obtained from the jury include: (1) an opt-out approach to consent for the use of RWD; (2) the opt-out approach to consent should be informed. Furthermore, it was advised that information and communication regarding the consent process and use of RWD should be accessible, clear and available in a variety of formats. It is important that the consent process for patient data use is underpinned by principles of autonomy and transparency with clear channels of communication between those asking for and giving consent. Moreover, the process of seeking consent from patients should be proportionate to the risks presented from their participation. (shrink)

Si prenderà in esame l’accezione di narrativa correntemente utilizzata nel mondo storiografico facendola dialogare con il paradigma dei _global middle ages_, espressione coniata nel 2018 dalle storiche Catherine Holmes e Naomi Standen. Per meglio mettere in risalto tali dinamiche un caso di studio sarà offerto dalla vicenda di Federico II, con particolare enfasi alla costruzione biografica e dei miti nel rapporto con le culture altre. Il fine sarà di superare le due tradizionali macro interpretazioni dell’idea di Medioevo, analizzate da Tommaso di Carpegna Falconieri e David Matthews: Medioevo arretrato regno di oscurità e Medioevo vagheggiato come luce del mattino, all’origine di molte identità politiche contemporanee – non ultima quella dell’Unione Europea. _The topic we intend to develop in this essay is the relationship between narration and historical construction. We will examine the meaning behind the current concept of narrative in historiography, with a dialectical approach towards the paradigm of _global Middle Ages_, an expression firstly used by historians Catherine Holmes and Naomi Standen in 2018. To perform an in depth analysis of the abovementioned relationship, we will use as a case study the figure of Frederick II. A significant emphasis will be put on the biographical construction and myths, especially in the relationship with other cultures. The aim of our essay is to provide a framework within it would be easier to overcome the two traditional macro interpretations of Middle Ages, studied by Tommaso di Carpegna Falconieri and David Matthews: Middle Ages as a backward reign of darkness and Middle Ages as the morning light, at the origin of many contemporary political identities – not least that of the European Union_. This article examines verbal humour in routine interactions within professional workplaces, using material recorded in four New Zealand government departments. The problem of defining humour is discussed, followed by a brief outline of the theoretical models which underpin the analysis of the various functions which humour serves in professional organizations. Humour can express positive affect in interaction. It can also facilitate or `licence' more negative interpersonal communicative intent. While politeness theory can account for the former, as a means of expressing (...) collegiality at work, or de-emphasizing power imbalances, in its standard form politeness theory does not explain barbed, competitive or confrontational humour. For this it is necessary to look to `the dark side of politeness'. An alternative perspective thus examines the extent to which humour functions, especially in unequal encounters, as an acceptable strategy to help superiors maintain a position of power but also as a strategy used by subordinates to licence challenges to the power structures within which they operate, and as a legitimizing strategy in attempts at subverting the repressive or coercive discourse of superiors. With the increasing use of algorithms in high-stakes areas such as criminal justice and health has come a significant concern about the fairness of prediction-based decision procedures. In this article I argue that a prominent class of mathematically incompatible performance parity criteria can all be understood as applications of John Broome’s account of fairness as the proportional satisfaction of claims. On this interpretation these criteria do not disagree on what it means for an algorithm to be _fair_. Rather they express (...) different understandings of what grounds a claim to a good being allocated by an algorithmic decision procedure. I then argue that an important implication of the Broomean interpretation is that it strengthens the case for outcome-based criteria. Finally, I consider how a version of the levelling-down objection to performance parity criteria arises within the Broomean account. (shrink)

Accumulating evidence suggests that different magnitudes (e.g., number, size, and duration) are spatialized in the mind according to a common left–right metric, consistent with a generalized system for representing magnitude. A previous study conducted by two of us (Holmes & Lourenco, ) provided evidence that this metric extends to the processing of emotional magnitude, or the intensity of emotion expressed in faces. Recently, however, Pitt and Casasanto () showed that the earlier effects may have been driven by a left–right (...) mapping of mouth size rather than emotional magnitude, and they found no evidence for an emotional magnitude mapping when using words as stimuli. Here, we report two new experiments that further examine these conclusions. In Experiment 1, using face stimuli with mouths occluded, we replicate the original finding: Less emotional faces were associated with the left and more emotional faces with the right. However, we also find that people can reliably infer the sizes of the occluded mouths, and that these inferred mouth sizes can explain the observed left–right mapping. In Experiment 2, we show that comparative judgments of emotional words yield a left–right mapping of emotional magnitude not attributable to stimulus confounds. Based on these findings, we concur with Pitt and Casasanto that faces pose challenges for isolating the forces driving spatialization, but we suggest that emotional magnitude, when assessed using unconfounded stimuli in a sufficiently sensitive task, may indeed be spatialized as originally proposed. Suggestions for further research on the spatialization of emotional magnitude are discussed. (shrink)

When is it justified to use opaque artificial intelligence (AI) output in medical decision-making? Consideration of this question is of central importance for the responsible use of opaque machine learning (ML) models, which have been shown to produce accurate and reliable diagnoses, prognoses, and treatment suggestions in medicine. In this article, I discuss the merits of two answers to the question. According to the Explanation View, clinicians must have access to an explanation of why an output was produced. According to (...) the Validation View, it is sufficient that the AI system has been validated using established standards for safety and reliability. I defend the Explanation View against two lines of criticism, and I argue that within the framework of evidence-based medicine mere validation seems insufficient for the use of AI output. I end by characterizing the epistemic responsibility of clinicians and point out how a mere AI output cannot in itself ground a practical conclusion about what to do. (shrink)

The threat to the survival of humankind posed by nuclear weapons has been a frightening and essential focus of public debate for the last four decades and must continue to be so if we are to avoid destroying ourselves and the natural world around us. One unfortunate result of preoccupation with the nuclear threat, however, has been a new kind of "respectability" accorded to conventional war. In this radical and cogent argument for pacifism, Robert Holmes asserts that all war--not (...) just nuclear war--has become morally impermissible in the modern world.
