Polish medical law does not explicitly regulate the possibility of off-label use of medicines. Such procedures therefore raise doubts in medical practice, where medicines are often prescribed beyond the Characteristic of Medicinal Product. This phenomenon particularly affects the treatment of children, as there is a lack of registered medicines in this age group, but they are registered for use in adults. Since such treatment goes beyond the scope of registration, a dilemma arises as to whether it is permissible and, if (...) so, under what conditions and whether sanctions are imposed on the medical professional using the off-label medicine. These issues are addressed in an article by Dr Maria Gutowska-Ibbs, entitled 'Off label - practical consequences of unclear legislation". The present study complements these considerations and is in part an ad vocem statement. The article attempts to differentiate between the use of off-label medicines and medical experiments, following the criterion of the purpose for which a given medical action is performed. The limits of admissibility of such actions under criminal law are also discussed in more detail. Off-label treatment is considered through the prism of the required precautionary rules, compliance with which is the antithesis of inadvertence. It is assumed that if the drug was administered in accordance with current medical knowledge and the treatment is adequate to the patient's condition, there is no violation of these rules, which excludes the imputation of inadvertence. An extensive section of the study is devoted to the issue of the patient's consent to treatment outside the indications. Above all, it emphasises the need to explain in detail to the patient the circumstances of prescribing such a drug and, on this basis, to obtain informed consent. It also stresses the importance of the written form of consent, which can have a significant evidentiary impact in potential litigation. (shrink)

Artykuł dotyczy instytucji pozarejestracyjnego stosowania produktów leczniczych oraz problemów w rozgraniczeniu sytuacji, w których taka forma leczenia ma charakter terapii innowacyjnej od normalnej praktyki leczniczej. Poruszona została kwestia istotnego ryzyka kwalifikacji rutynowej terapii przy użyciu produktów leczniczych jako eksperymentu medycznego oraz relacja pomiędzy pojęciem aktualnej wiedzy medycznej a Charakterystyką Produktu Leczniczego. Omówione zostały trudności w ustaleniu, czy proponowany sposób leczenia jest metodą nową lub częściowo wypróbowaną oraz przedstawiono postulat zwiększenia aktywności lekarskich towarzystw naukowych w tym zakresie. Przedstawiono implikacje kwalifikacji (...) leczenia off-label jako eksperymentu leczniczego w zakresie konieczności uzyskania opinii komisji bioetycznej oraz zawarcia ubezpieczenia odpowiedzialności cywilnej podmiotu przeprowadzającego eksperyment medyczny oraz ich wpływ na bezpieczeństwo pacjenta, bezpieczeństwo prawne lekarza oraz dostępność do świadczeń medycznych. Artykuł przedstawia rozważania oparte na regulacji prawa unijnego oraz polskiego dotyczące wytwarzania oraz stosowania produktów leczniczych terapii zaawansowanej – wyjątków szpitalnych. Autorka omawia unijne źródło regulacji ATMP-HE, jej funkcję oraz cel wprowadzenia do prawa unijnego, a następnie relację tej regulacji do polskiego uregulowania dotyczącego eksperymentu leczniczego. W ocenie autorki na gruncie obowiązującego stanu prawnego nie jest zasadne stanowisko, zgodnie z którym produkt leczniczy terapii zaawansowanej – wyjątek szpitalny jest na tyle legalnie odrębnym pojęciem, a wręcz instytucją prawną, że (...) nie stosuje się do niego regulacji krajowej. Jest to bowiem stanowisko nie tylko niespójne z regulacją unijną oraz krajową, ale również skutkujące przerzuceniem ciężaru ryzyka zastosowania tego produktu bez jakiejkolwiek kontroli oraz odpowiedzialności na pacjenta. Autorka wyraziła stanowisko, zgodnie z którym de lege lata zastosowanie produktu leczniczego terapii zaawansowanej – wyjątku szpitalnego należy kwalifikować jako eksperyment leczniczy, do którego stosuje się także granice dopuszczalności jego przeprowadzenia. Autorka przedstawia skutki uznania zastosowania ATMP-HE za eksperyment leczniczy oraz skutki przyjęcia stanowiska odmiennego. Ponadto w artykule zawarte zostały rozważania na temat niezasadności utożsamiania stosowania ATMP-HE z off-label use oraz compassionate use. Autorka sformułowała również postulaty de lege ferenda. The paper assumes that the attitude of action precedes historically the attitude of observer. The latter has been born in ancient Greece of classical period due to the Platonic philosophy and the overcoming of magic-mythical thought. Since then, although they have changed and developed, both perspectives have been widely present in European culture and therefore should be considered to be a part of European cultural heritage. It is said that European modernism guarantees a coexistence of both attitudes. A modern European, thus, is able to act intentionally as well as to observe his own action from a distance. Modernism implies also an axiological priority of theoretical perspective (identified with the Kantian ‘universal reason’) over the perspective of action which is not free from prejudice. In comparison with earlier periods of European culture, the theoretical-contemplative perspective of Modernism is defined in terms of perception and sensual experience and their further reinterpretations. The subject of this paper is to analyse the reconstruction of the pension system resulting from legislative changes introduced in 2011, the most important being the transfer of part of pension contributions from the open pension fund (OFE) to a newly set up special subaccount managed by the Social Insurance Institution, modifications in administrative regulation of open pension funds investment policy and introduction of tax incentives for making additional savings for retirement purposes. These transformations result from assumed financial goals such (...) as reduction of public debt growth by reducing the cost of introducing the second capital pillar in 1999. However, given the social importance of pension insurance the changes should be assessed against assumptions of the pension reform of 1999 and constitutional principles. Key words. (shrink)

Celem artykułu jest scharakteryzowanie współczesnej publicznej debaty bioetycznej w Polsce na przykładzie dyskusji na temat kwestii reprodukcyjnych. Autorki podkreślają polaryzację i radykalizację przeciwstawnych stanowisk i pomijanie zagadnień istotnych dla dyskusji filozoficznych na ten temat. Debata społeczna ma charakter sporu światopoglądowego o charakterze pragmatycznym, a jej celem jest oddziaływanie na zmianę bądź ugruntowanie już przyjmowanych przekonań moralnych umożliwiające przyjęcie i akceptację społeczną proponowanego rozwiązania legislacyjnego. Do radykalizacji sporu przyczynia się silny wpływ instytucji Kościoła, rozwój ruchu społecznego na rzecz obrony praw kobiet (...) i praw reprodukcyjnych oraz brak należytej uwagi dla tej debaty i jej wszystkich uczestników ze strony władz publicznych. Der Aufsatz gewinnt aus einer Analyse der Passage EN VI 2, 1139a35-b4 drei Kriterien zur Unterscheidung von Produktion und Praxis: Erstens ist das charakteristische Ziel einer Produktion einem weiteren Ziel des Tätigen untergeordnet, das praktische Ziel dagegen nicht. Zweitens ist das produktive Ziel für den Tätigen nicht zwingend wertvoll, das praktische Ziel dagegen schon. Drittens ist jede Produktion als Teil einer Praxis motiviert. Zwei weitere Thesen sind: Die Unterscheidung zwischen Produktion und Praxis ist nicht identisch mit der Differenz zwischen Tätigkeiten (...) mit und solchen ohne dauerhaftes Resultat. Aristoteles macht nicht klar, ob die Unterscheidung intensional oder extensional ist, und muss das für die Zwecke der Ethik auch nicht tun. (shrink)

In seiner WL nova methodo charakterisiert Fichte die Aufgabe der Transzendentalphilosophie wie folgt: »die Bedingungen des Bewußtseins nach den schon bekannten Regeln zusammen zu setzen, und das Bewußtsein vor unseren Augen zu construieren«. Dieses Zitat bringt das Herzstück der frühen Fichteschen WL zum Vorschein und vermag auch das Grundanliegen der GWL präzise zu charakterisieren. Die WL strebt nach der genetischen Einsicht des wirklichen Bewußtseins und kann daher nicht vom Bewußtsein ausgehen; sie muß hinter das Bewußtsein zurückgehen, um es vor unseren (...) Augen konstruieren zu können. Fichtes Konzeption der produktiven Vernunft hat, wie im folgenden gezeigt werden soll, das Programm einer genetischen bzw. konstruktiven Deduktion des Bewußtseins erst möglich gemacht. Denn die von Fichte gedachten produktiven bzw. schlechthin setzenden Handlungen der Vernunft stellen ein systematisches Gefüge dar, aus dem eine vollständige Totalität von Produkten hervorgeht. Für die Genese des wirklichen Bewußtseins und Selbstbewußtseins erweist sich jener Wendepunkt als entscheidend, an dem die Produktion selbst den Charakter der Reflexion annimmt, nämlich der Reflexion auf ihre eigenen Produkte. Und weil die ursprüngliche Reflexion einer noch ursprünglicheren Produktion entspringt, hat sie selbst produktiven Charakter, ist sie re-produktiv; sie setzt gleichsam noch einmal, was bereits gesetzt ist. Die Reflexion bringt auf diese Weise neue Produkte mit sich, die das produzierend-reflektierende Ich zunächst ebenfalls nicht als seine eigenen Produkte erkennt, weshalb die Reflexion, wie gezeigt werden soll, eine ebenso ursprüngliche Projektion ist. Das systematische Wechselspiel von Reflexion und Projektion macht, ab einem gewissen Reflexionspunkte, Gegenstands- und Selbstbewußtsein für das Ich unterscheidbar und damit als solche erst möglich. The following article proposes a change of perspective in the capital-theory debate of political economy. Instead of insisting upon the differences between a Marxian labour theory of value and a Ricardo-Sraffaian theory of prices of production (Marx versus Sraffa) the common basis of the two approaches is stressed. The common basis consists in the paradigm of duality between physical quantities and evaluation standards. The last part of the paper collects sceptical arguments concerning the question of whether the duality paradigm can (...) provide an adequate approach to an analysis of modern technical change. Mit diesem Buch geht die analytische Handlungstheorie neue Wege. Statt den von Davidson vorgezeichneten Mustern zu folgen, knüpft der Autor an die aristotelische Unterscheidung von poiesis und praxis an, um die komplexen teleologischen Strukturen menschlichen Handelns zu untersuchen. Als überraschend ergiebiger Leitfaden erweist sich dabei der Begriff der Erziehung. Eine Fülle detaillierter Analysen zeitigt nicht nur anthropologisch und moralphilosophisch bedeutsame Resultate, sondern auch zeitkritische Folgerungen. 'Wie im Bereich der Erziehung, so gewöhnen wir uns auch sonst daran, die Wirklichkeit unseres Handelns (...) mit Kategorien des Hervorbringens zu überziehen und auch da nach Produkten zu suchen, wo es eigentlich um die Qualität des Lebens geht. Angesichts solcher Verirrungen fundamentale Strukturen und Ansprüche praktischer Vernunft erneut zu bedenken, ist heute vielleicht die vornehmste Aufgabe der Handlungsphilosophie.'. (shrink)

On the basis of the finding that perfectibility for Pufendorf had a cultural as well as an anti-essentialist meaning, the perfectibility debate of the early German Enlightenment will be discussed. Central to this debate is the principle of “generative absence”, one that has heretofore received little attention, but proves to be constitutive of both Pufendorf′s and Pietism′s argumentation in opposition to mechanical materialism and religious orthodoxy. My account of this context will go over the positions of Christian Thomasius′s empirical eclecticism (...) and Christian Wolff′s rationalist metaphysics and end with Georg Forster′s and Immanuel Kant′s reception of the Rousseauian concept of perfectibility. In so doing, I will advance the thesis that, much more extensively than most have assumed, the German Enlightenment prepared German Idealism′s dialectical constitution of the modern concept of progress.
