I defend, to a certain extent, the traditional view that perceptual indiscriminability is non-transitive. The argument proceeds by considering important recent work by Benj Hellie: Hellie argues that colour perception represents ‘inexactly’, and that this results in violations of the transitivity of colour indiscriminability. I show that Hellie’s argument remains inconclusive, since he does not demonstrate conclusively that colour perception really does represent inexactly. My own argument for the non-transitivity of perceptual indiscriminability uses inexactness instead as one horn of a (...) dilemma: the key idea is that there is a class of perceptual experiences which might plausibly be supposed either to represent inexactly or to represent exactly—but which demonstrate the non-transitivity of perceptual indiscriminability either way. According to the conceptualist view in the philosophy of perception, we must possess concepts for all the objects, properties and relations which feature in our perceptual experiences. In this paper, I investigate the possibility of developing an argument against the conceptualist view by appealing to the notion of attention. In Part One, I begin by setting out an apparently promising version of such an argument, a version which appeals to a link between attention and perceptual demonstrative concept possession. In Part (...) Two, however, I show how the conceptualist can challenge what appears to be the key premise of the argument, and I go on to describe, in Part Three, an important further difficulty which we face if we attempt to overcome this challenge in a particular way. My conclusion will be that the conceptualist's challenge to the argument is convincing and hence that the argument remains inconclusive. (shrink)

Despite increased efforts to ensure diversity in genomic research, the exclusion of minority groups from data analyses and publications remains a critical issue. This paper addresses the ethical implications of these exclusions and proposes accountability for reasonableness (A4R) as a framework to promote fairness and equity in research. Originally conceived by Norman Daniels and James Sabin to guide resource allocation in the context of health policy, A4R emphasizes publicity, relevance of reasons, enforcement, and revision as essential for legitimacy and trust (...) in the decision‐making process. The authors argue that A4R is also relevant to resource allocation in research and that, if adequately informed and incentivized by funding agencies, institutional review boards, and scientific journals, researchers are well‐positioned to assess data‐selection justifications. The A4R framework provides a promising foundation for fostering accountability in genomics and other fields, including artificial intelligence, where lack of diversity and pervasive biases threaten equitable benefit sharing. In [2] Hempel and Oppenheim give a definition of “explanation” for a certain formal language. In [1] Eberle, Kaplan, and Montague prove five theorems demonstrating that the Hempel and Oppenheim definition is not restrictive enough. In [3] Kim proposes two further conditions to supplement the Hempel and Oppenheim definition in order to avoid the objections posed in [1]. In this paper it is shown that the definition of Hempel and Oppenheim supplemented by Kim's conditions is open to a trivialization very (...) analogous to that given in [1]. (shrink)

Despite the tremendous growth of interest in both emotion and character in recent years, little has been said about the relation between the two. I argue that emotions have a proximal and fundamental role in determining character. The proximal role consists in the effects of emotion on the way that a person perceives and ensuingly cognizes the object of emotion. This plays a significant part in determining character-relevant actions. The fundamental role consists in the function that emotions have in sustaining (...) values on which character traits are based. Emotions enable character traits to persist by maintaining the importance of these values and thus countering “axiological entropy,” which is the diminution over time of the tacit sense of importance of such values. Emotions are thus essential to the possession of character traits, and character development involves developing an appropriate emotional repertoire. (shrink)

Because the Gaukrogerian project is (deliberately?) ambiguous when it comes to choosing between the safe neutrality of the study of science, and the more committed versions of a ‘political epistemology’ in which, to paraphrase Shapin and Schaffer, questions of knowledge and questions of social order turn out (...) to be one and the same. Patient outcome after serious brain injury is highly variable. Following a period of coma, some patients recover while others progress into a vegetative state (unresponsive wakefulness syndrome) or minimally conscious state. In both cases, assessment is difficult and misdiagnosis may be as high as 43%. Recent advances in neuroimaging suggest a solution. Both functional magnetic resonance imaging and electroencephalography have been used to detect residual cognitive function in vegetative and minimally conscious patients. Neuroimaging may improve diagnosis and prognostication. These techniques (...) are beginning to be applied to comatose patients soon after injury. Evidence of preserved cognitive function may predict recovery, and this information would help families and health providers. Complex ethical issues arise due to the vulnerability of patients and families, difficulties interpreting negative results, restriction of communication to “yes” or “no” answers, and cost. We seek to investigate ethical issues in the use of neuroimaging in behaviorally nonresponsive patients who have suffered serious brain injury. The objectives of this research are to: (1) create an approach to capacity assessment using neuroimaging; (2) develop an ethics of welfare framework to guide considerations of quality of life; (3) explore the impact of neuroimaging on families; and, (4) analyze the ethics of the use of neuroimaging in comatose patients. Much current theorizing about literature involves efforts to renew our sense of aesthetic values in reading. Such is the case with new formalism as well as recent appeals to the notion of “surface reading.” While sympathetic to these efforts, Charles Altieri believes they ultimately fall short because too often they fail to account for the values that engage literary texts in the social world. In Reckoning with the Imagination, Altieri argues for a reconsideration of the Kantian tradition of Idealist (...) ethics, which he believes can restore much of the power of the arguments for the role of aesthetics in art. Altieri finds a perspective for that restoration in a reading of Wittgenstein’s later work that stresses Wittgenstein’s parallel criticisms of the spirit of empiricism. Altieri begins by offering a phenomenology of imagination, because we cannot fully honor art if we do not link it to a distinctive, socially productive force. That force emerges in two quite different but equally powerful realizations in his reading of John Ashbery’s “Instruction Manual,” which explicitly establishes a model for a postromantic view of imagination, and William Butler Yeats’s “Leda and the Swan.” He then turns to Wittgenstein with chapters on the role of display as critique of Enlightenment thinking, the honoring of qualities like sensitivity and the ability to attune to the actions of others, the role of expression in the building of models, and the contrast between ethical and confessional modes of judgment. Finally, Altieri produces his own model of aesthetic experience as participatory valuation and makes an extended argument for the social significance of appreciation as a way to escape the patterns of resentment fundamental to our current mode of politics. A masterful work by one of our foremost literary and philosophical theorists, Reckoning with the Imagination will breathe new life into ongoing debates over the value of aesthetic experience. Le poids de l'analyse portera essentiellement sur un dépl(o)iement du dispositif bachelardien d'induction et de construction. L'appareillage « inductif » doit (...) être pensé sur le modèle électromagnétique, et la position «constructiviste» est toujours liée au travail de synthèse. ALTHOUGH I shall be attempting to examine the function of judgment, or what Aristotle called φρόνησις, in moral deliberation, I shall begin by discussing some previous opinions about what kind of importance examples have in moral experience. This strategy is only apparently circuitous. The role which one assigns to examples is symptomatic of the conception one has of judgment in moral decision-making, because the use of examples forms one way in which judgment is exercised. Indirectly, then, I shall be trying (...) to rehabilitate the significance of examples in moral deliberation. But the chief aim of this paper will be to determine both what is the function of judgment in moral deliberation and how we are to understand the activity of exercising it. (shrink)

Compiled by a leading scholar of Chinese poetry, _Clouds Thick, Whereabouts Unknown_ is the first collection of Chan poems to be situated within Chan thought and practice. Combined with exquisite paintings by Charles Chu, the anthology compellingly captures the ideological and literary nuances of works that were composed, paradoxically, to "say more by saying less," and creates an unparalleled experience for readers of all backgrounds. _Clouds Thick, Whereabouts Unknown_ includes verse composed by monk-poets of the eighth to the seventeenth (...) centuries. Their style ranges from the direct vernacular to the evocative and imagistic. Egan's faithful and elegant translations of poems by Han Shan, Guanxiu, and Qiji, among many others, do justice to their perceptions and insights, and his detailed notes and analyses unravel centuries of Chan metaphor and allusion. In these gems, monk-poets join mainstream ideas on poetic function to religious reflection and proselytizing, carving out a distinct genre that came to influence generations of poets, critics, and writers. The simplicity of Chan poetry belies its complex ideology and sophisticated language, elements Egan vividly explicates in his religious and literary critique. Rorty's "philosophical life" as a public intellectual was aimed at dispelling the belief that there is a transcendent source of information about what is true and real that humans are obliged to bow down to. From a historical standpoint, his thought can be seen as the culmination of a development of ideas leading to the view that humans determine what counts as real and right. Yang returns to the problem of referential ambiguity, addressed in the opening paper by Gleitman and Trueswell. Using a computational approach, he argues that “big data” approaches to resolving referential ambiguity are destined to fail, because of the inevitable computational explosion needed to keep track of contextual associations present when a word is uttered. Yang tests several computational models, two of which depend on one‐trial learning, as described in Gleitman and Trueswell’s paper. He concludes that such models outperform cross‐situational learning (...) models, thereby formalizing, reinforcing, and advancing the conclusions offered by Gleitman and Trueswell. (shrink)

In this essay, we defend the design of the Salk polio vaccine trial and try to put some limits on the role schemata should play in designing clinical research studies. Our presentation is structured as a response to de Freitas and Pietrobon who identified the CONSORT statement as a schema that would have, had it existed at the time, ruled out the design of the Salk polio vaccine trial of 1954 in favor of a completely randomized controlled clinical trial. We (...) argue that large-scale public health interventions often require evidence beyond simple efficacy, the limit of what an RCT can provide, and that the design actually adopted for the Salk trial represented a reasonable—albeit imperfect—compromise. This is of more than historical interest in that many contemporary studies are of the scale and scope to require a more pragmatic, rather than explanatory, approach to study design. (shrink)

Issues associated with consent to clinical trials have attracted considerable attention recently, spurred in part by controversies over alleged inadequacies in the consent process. Professor Jansen's interesting essay is unusual in two ways. First, it raises issues about the conceptualization of one set of problems in informed consent (which Jansen subsumes under the term “therapeutic error”) and, more critically, about the methods and the data used to assess them. Second, she is unique in using the findings of academic experimental psychology (...) to critique the empirical findings. This produces a thoughtful and original critique of the process of informed consent to research that, nonetheless, we believe, yields a model that does not reflect the reality of clinical research.
