While at first such a comparison may be startling, Whelan argues convincingly that Hume's writing, commonly regarded as moderate and amiable, is indeed a locus of realist liberal political theory.

ABSTRACT:I here advance a critical research agenda for the political perspective of corporate social responsibility (Political CSR). I argue that whilst the ‘Political’ CSR literature is notable for both its conceptual novelty and practical importance, its development has been hamstrung by four ambiguities, conflations and/or oversights. More positively, I argue that ‘Political’ CSR should be conceived as one potentialformof globalization, and not as aconsequenceof ‘globalization’; that contemporary Western MNCs should be presumed to engage in CSR for instrumental reasons; that ‘Political’ (...) CSR should be associated with a corresponding ‘political’ model of corporate governance; and that both a ‘Rawlsian’ and ‘Habermasian’ perspective of Political CSR are different from ‘Political’ CSR. In concluding, I use these four critiques to identify a number of areas within which increasingly robust and sophisticated positive and normative theories of Political CSR are required. (shrink)

This book investigates what actually happens when Pierre Bayle writes about the past and challenges the still prevalent view that he is dispassionate in the way he treats the subjects of the more than two thousand articles in his biographical Dictionnaire historique et critique. It opens with two case studies of the way he uses the sources available to him, which reveal a committed writer at work. Subsequent chapters explore the theory that shapes his erudition; the method that he devised (...) to discern falsehood from truth; his critical approach to Scripture; his conceptual reconstruction of the past. Bayle emerges from this as a writer whose interest in the past is more than antiquarian. The ideal of impartiality, which he drew from Renaissance conceptions of history, is not neutral but always situated. For all their apparent objectivity, the articles in the Dictionnaire are actually shaped by the debates, conflicts, and politics of Bayle's own time and place. In 1989, when this book was first published, its intertextual and contextualised reading of Bayle was innovative. Although many similar studies followed, this book led the way by developing an approach that allows us to gain access to the deeper strata of Bayle's thought. (shrink)

I wear them throughout the day. Often, I don't notice them. If I'm walking on a flat surface, they often fade into the background of my consciousness. I make allowances without thinking about how they structure my gait and the space they take up. Rarely, I misjudge this, and (...) occasionally fall. In those moments, their presence is apparent, coming to the foreground of my experience as a problem, something I need to accommodate as I collapse. When they need to be repaired, I notice them all of the time. As a user of assistive technology, the way in which I experience the technology can swing from regarding them as part of my body, to an external tool, to an object in my environment. This experience is fluid, weaving moments where a sense of my embodiment includes the devices with moments where they are alien to me. Even when they are alien to me, I use them successfully (most of the time). Reading reports of the experiences of other users of assistive equipment, especially prosthetics, I do not seem to be alone in experiencing this fluidity with respect to these devices. These experiences raise questions for me. Is "successful use" sufficient as a goal as I learn and re-learn how to walk with them? Often, I prefer the experience of braces as part of myself: How might that be cultivated? Perhaps the fluidity of encountering them at times as tools and at times as part of myself is a strength, one that I might reasonably seek to develop. How might education or therapy accommodate and prepare for this feature of experience with assistive technology?Phenomenological analyses of symptoms of "phantom limbs," use of prosthetics, and even of physical impairment more generally, highlight the fluidity of disability experience, emphasizing the experience of having to continually revise ways of navigating our environments. For many disabled people, this precarious character of experience might demand that we learn to use new [End Page 60] assistive technologies. This education often takes place in the context of occupational therapy (hereafter OT), a form of therapeutic intervention using "occupations," or purposive tasks, to facilitate independence. In this process, persons might not just learn to make use of a technology or perform a task, but also to experience the technology in a variety of ways—for instance, as an obstacle, as a tool, or as a part of their bodies. Thus, OT becomes not only a locus for developing new modes of coping and performing daily tasks, but a site at which relationships to assistive technologies come to the foreground.Those relationships, in various theoretical models underlying OT, are often analyzed in terms of task performance, and different elements modified in order to complete a given occupation. A person might make changes in their own habits of moving (for instance, learning to move their legs a certain way to facilitate walking), the environment (e.g., modify furniture or a configuration of a room), or some combination thereof. However, some experiences of disability call into question features of popular models underlying OT, like the person-environment-occupation model. In particular, features of the situation, like the equipment, can occupy multiple roles, or even change roles, from person to environment or vice versa, within the context of performing daily tasks. I suggest that John Dewey's work on education and analysis of habits with relationship to a creature's broader environment provide a useful framework for articulating models of experiencing assistive technologies that appreciate their fluidity within experiences of disability. Legal frameworks are in place to protect those who lack the capacity to consent to research, such as the Mental Capacity Act in the UK. Assent is sought instead from a proxy, usually a relative. However, the same legislation may, perversely, affect the welfare of those who lack capacity and of others by hindering the process of recruitment into otherwise potentially beneficial research. In addition, the onus of responsibility is moved from those who know most about the study (ie, the (...) scientific community) to those who know less (the proxies). In this paper, we describe the characteristics of a sample at different stages of the recruitment process of an influenza vaccine-based randomised control trial in elderly care home residents (the FEVER study). 62% (602/968) of potential subjects lacked capacity but only 29% (80/277) of those actually randomised. Older age, being female and living in an Elderly Mentally Ill care home were the only variables associated with lacking capacity. Considering this was a study based in a care home setting where the prevalence of dementia approximates 80%, the trial, like many others, was thus significantly biased. We believe that difficulties seeking proxy assent contributed significantly to this problem. Further thought should be given to how assent to enter research for those who lack capacity should be provided, and we suggest avenues for further discussion such as independent risk/benefit expert panels. This makes it likely that the requirement to give to charity is based not on the requirement to rescue but instead on the moral requirement to marginally improve the ability of charitable organisations to do their important work. The leading arguments of Anquetil-Duperron's Legislation Orientale (1778) are analysed as a sustained attempt by this early Indologist to refute Montesquieu's influential theory of oriental despotism with respect to the Muslim regimes of Turkey, Persia and India (the Mogul empire). Anquetil adduces literary evidence and his own observations to refute the claim that Asian governments are invariably arbitrary, lawless and without property rights. Rather, similarities in these basic respects between European and Asian societies underline the common humanity of their inhabitants, (...) in keeping with the convictions of Enlightenment humanism and contrary to some eighteenth-century justifications for European empires. After the cessation of conflict the majority of those involved in violations of international law will not be held criminally accountable. Rather, it is frequently the case that the bulk of perpetrators receive amnesty. Often, consequentialist considerations weigh heavily on the decision to grant amnesty. For instance, amnesties may be offered in order to generate aggregate security benefits in volatile post-conflict settings. My contention is that states cannot morally justify amnesties by appealing solely to the aggregate benefits they are expected (...) to deliver. The moral objection concerns the distribution of associated costs, where such costs include the risk of re-offense that amnesty generates. Importantly, these costs may be unevenly imposed onto the society. This means that certain citizens will expect to bear individual losses greater than any gains the amnesty can deliver to them. Those placed at a net-disadvantage can object that amnesties are morally unjustifiable: they impose unreasonable burdens on them in order to secure benefits for others. However, as amnesties are often vital to achieve peace there remain strong pragmatic reasons to favour limited prosecutions. Given these concerns it is necessary to justify the differential imposition of cost associated with amnesties. I argue that ex ante contractualism, as a theory of moral justification, is well-suited to this task. According to this framework amnesties are justified only if no individual could reasonably reject the associated burdens. By developing a non-aggregative justification of amnesty this account offers a novel approach to the design and implementation of post-conflict prosecutorial strategies. (shrink)

E-mapping technologies are a recent technological intervention promising to promote accessibility for disabled city residents. As part of their promise, they seem to position disabled people as agents, rather than as merely passive users of a city. Using Quill Kukla’s analysis of cities as “containers for agency,” I suggest that disabled people’s agency as city dwellers is often constrained in unnoticed ways that this technological intervention does not necessarily address. In particular, city life involves movement between different “stances,” or embodied (...) modes of interaction with the environment. I discuss these constraints on spatial agency as enforcing “stances of justification,” pressures to explain or justify our presence, arising out of features of urban life. This analysis motivates new considerations in assessing whether technologies like e-mapping support accessibility and agency, framing our investigation in terms of whether an intervention allows users to take a wider range of stances. The sharing economy has transformed economic transactions, created new organizational forms, and contributed to changes in consumer culture. Started as a movement with promises of a more sustainable, democratic, and inclusive economy, the sharing economy, and its impact on issues such as privacy, discrimination, worker rights, and regulation, is now the subject of heated debate. Many of these issues root in the changes that digital technologies have brought and the unresolved moral and ethical questions emerging therefrom. This special issue contributes (...) to this ongoing debate with five articles that develop theoretical frameworks and conduct empirical investigations, providing fine-grained analyses of urgent issues in the sharing economy. This article contextualises current debates over human rights and transnational corporations. More specifically, we begin by first providing the background to John Ruggie's appointment as 'Special Representative of the Secretary-General on the issue of human rights and transnational corporations and other business enterprises'. Second, we provide a brief discussion of the rise of transnational corporations, and of their growing importance in terms of global governance. Third, we introduce the notion of human rights, and note some difficulties associated therewith. Fourth, we (...) refer to Ruggie's scholarly work on 'embedded liberalism', the 'global public domain' and 'social constructivism'. Following this, we refer to the other five papers contained in this "Journal of Business Ethics" special issue, 'Spheres of Influence/Spheres of Responsibility: Multinational Corporations and Human Rights', and consider some of the potential obstacles to Ruggie's recent suggestion that a 'new consensus' has formed, or is forming, around his 'Protect, Respect and Remedy' framework. We conclude by raising questions regarding the processes of consensus-building around, and the operationalisation of, Ruggie's 'Protect, Respect and Remedy' framework. (shrink)

I attempt to describe and defend an alternative definition of insanity. I claim that my definition follows from an adequate general understanding of legal excuse and that it describes correctly the question that jurors in the recent Andrea Yates case and others like it ought to be faced with. My essay has three parts. In the first, I briefly criticize M'Naghten- and Durham-inspired insanity statutes. In the second, I sketch and defend a general understanding of legal excuse and try to (...) show how an adequate insanity statute follows from it. Finally, in the third section, I describe and defend a rough version of the statute itself. In the course of doing so, I try to explain why I believe that statute is superior to the American Law Institute's various model insanity statutes. (shrink)

There are increasing calls internationally for the development of regulation and policies related to the rapidly growing nanotechnologies sector. As part of the process of policy formation, it is widely accepted that deliberative community engagement processes should be included, enabling publics to have a say about nanotechnologies, expressing their hopes and fears, issues and concerns, and that these will be considered as part of the policy process. The Australian Federal and State governments have demonstrated a commitment to these ideals, undertaking (...) a number of public engagement activities in recent years. However, despite promises that these community engagement activities will enable policy makers to identify complex and contested community attitudes, and that these will be included as part of the policy making process, a closer look at Australia’s engagement activities reveals something quite different. Through an analysis of a number of Australia’s nano-engagement activities, this paper demonstrates the limits of public engagement related to the development of nanotechnology related policies and regulation in Australia. Our analysis reveals the extent to which industry interests have captured policy makers and regulators, dissenting voices have been excluded from engagement processes, and engagement processes have not connected with actual policy making activities. Reflecting on these limits, this paper concludes with recommendations for improving public engagement processes related to nanotechnologies in Australia. (shrink)

The growing global prominence of Chinese state-owned enterprises brings new dimensions to our understanding of multi-national corporations and human rights issues. This article constructs a three-level framework that enables the mapping of transnational, national, and intra-organizational human rights pressures, and uses this framework to identify and analyze the human rights that Chinese SOEs report concern with. The analysis provided suggests that while China’s most global SOEs are subject to transnational pressures to respect all human rights, such pressures appear outweighed by (...) those encouraging them to concentrate on only some human rights within their national and intra-organizational environment. The article concludes by identifying a number of ways in which our conceptual framework and empirical findings can inform future research. (shrink)
