Normative economics and a hermeneutic approach to interpretation of legal norms are only compatible if - and this is the exception - such legal norms have the goal of accomplishing economic efficiency. But economic analysis of law as a positive approach may be used in the legal interpretation process in order to evaluate different options of norm interpretations. In fields of law where economic issues are at stake such a methodological evaluation of interpretative variants are superior to common sense analysis (...) and should be applied. But even in fields where non-economic issues play a major role an economic analysis is a helpful tool in order to get aware of the opportunity costs of economically sub-optimal solutions. Economic analysis of law thus becomes an integral part of the norm interpretation process without colliding with the autonomy of the legal decision enhancing the rationality of the endeavour. Statements’ rated truth increases when people encounter them repeatedly. Processing fluency is a central variable to explain this truth effect. However, people experience processing fluency positively, and these positive experiences might cause the truth effect. Three studies investigated positivity and fluency influences on the truth effect. Study 1 found correlations between elicited positive feelings and rated truth. Study 2 replicated the repetition-based truth effect, but positivity did not influence the effect. Study 3 conveyed positive and negative correlations between positivity and (...) truth in a learning phase. We again replicated the truth effect, but positivity only influenced judgments for easy statements in the learning phase. Thus, across three studies, we found positivity effects on rated truth, but not on the repetition-based truth effect: We conclude that positivity does not explain the standard truth effect, but the role of positive experiences for truth judgments deserves further investigation. People judge positive information to be more alike than negative information. This good-bad asymmetry in similarity was argued to constitute a true property of the information ecology (Alves, H., Koch, A., & Unkelbach, C. (2017). Why good is more alike than bad: Processing implications. Trends in Cognitive Sciences, 21, 69–79). Alternatively, the asymmetry may constitute a processing outcome itself, namely an influence of phasic affect on information processing. Because no research has yet tested whether phasic affect influences perceived similarity (...) among stimuli, we conducted 5 Experiments that also tested whether phasic affect can account for the higher judged similarity among positive compared to negative stimuli. In three experiments, we affectively charged pictures of different Pokemon by pairing them with monetary gains and losses (Exp. 1a, 1b) as well as positive and negative trait words (Exp. 2); yet, the evaluative charge did not differentially influence perceived similarity among the Pokemon. Experiment 3 replicated the basic similarity asymmetry among positive and negative words, and found that it was unaffected by externally induced phasic affect. Experiment 4 showed that phasic affect had no influence on perceived similarity of non-evaluative words either. We conclude that albeit a weak influence of phasic affect on perceived similarity of stimuli cannot be ruled out entirely, it can most likely not account for the typically medium to large sized asymmetry in similarity among positive and negative stimuli. The article surveys German-language ayurvedic cooking and nutrition books from 1990 until today. The semantic analysis reveals a market diversification that corresponds to the following categories: health, diet, spirituality, and individualism. These are main attractors of Ayurveda along with its promises of holistic balance and cosmological integration. Because this development can be interpreted as a reaction to the Western scientific formation of "Ayurveda" within popular life advice literature, this essay uses the concept of reflexive nutrition as derived from M. Stausberg's (...) reflexive ritualization. Furthermore, the success of these books indicates an absence of Christian dietetics in Germany's religion landscape. (shrink)

Transhumanism advances an ideology promising a positive human advance through the application of new and as yet unrealized technologies. Underlying the whole is a libertarian ethos married to a very Christian eschatology promising a miraculous transformation that will answer human needs and redress human failings. In this paper, the supposedly scientific basis on which transhumanist promises are built is critiqued as futurist imaginings with little likelihood of actualization. Transhumanists themselves are likened to the affable con man Professor Harold Hill (...) who, in The Music Man, describes as dire social problems whose solution is a youth band he seeks to sell but has no intention of building. Even were some of the transhumanist imaginings to be realized, I argue, the result would be a dystopia in which the few received benefits denied to the many. In advancing imaginary technologies as a solution to human needs, transhumanists and their bioethical fellow travelers handily avoid discussion of or advocacy for the kind of pedestrian social actions that demonstrably could achieve many of their purported goals. So their enthusiasms, I conclude, are not merely fanciful but damaging to the humanist goals they pretend to advance. (shrink)

As in other European countries, in Denmark philosophy was an important factor in the cultural life of the nineteenth century. Kierkegaard lived and wrote in Copenhagen, where Hegelianism both flourished and met with serious criticism, and both of these elements can be found in his authorship. This chapter explores possible sources of inspiration for Kierkegaard's rejection of Danish Hegelianism and its follower, speculative theology, and discusses his influence on the fashionable Danish philosopher of the day, Rasmus Nielsen. By way of (...) conclusion, it is emphasized that Kierkegaard's understanding of Christianity and his struggle over it were decisive for a shift in Danish intellectual life around 1870. (shrink)

In the debate on peace ethics in Germany, it is constantly argued that the ‘doctrine of just war’ must be replaced by a ‘doctrine of just peace’. The criteriology of just war can at best be preserved within a doctrine of just peace. However, it is often overlooked that—although the word ‘peace’ may sound nicer than ‘war’—a doctrine of just peace is also fraught with great difficulties in terms of content. The concept of peace can be interpreted in different ways; (...) the concept of justice must even be differentiated if it is to have meaning at all. Ultimately, the two concepts point to a different understanding of tradition and historicity: while the doctrine of just war takes its criteria from the tradition, the idea of just peace attempts to draw conclusions for the present from drafts or blueprints of the future. However, since the drafts can turn out differently, new conflicts will arise precisely for this reason. Talk of ‘just peace’ might be more pleasing to the public, but does not necessarily have to be more restrictive in terms of violence. (shrink)

The Christian contribution to peace contains the strong will to make peace through the believing in God as the permanently inspiring spirit of reconciliation. Catholic opponents of abortion and embryonic stem cell research usually base their position on a hylomorphic account of ensoulment at fertilization. They maintain that we each started out as one-cell ensouled organisms. Critics of this position argue that it is plagued by a number of intractable problems due to fission (twinning) and fusion. We're unconvinced that such objections to early ensoulment provide any reason to doubt the coherence of the hylomorphic account. Jackson and Fulford suggest that the distinction between their two categories, spiritual experience and mental illness, is conventional, yet their emphasis on issues of correct practice from the medical perspective threatens to return both into distinct ontological categories, albeit with a shared phenomenology. I do not understand why any single (...) instance must either be pathological or spiritual, except through clinical and clerical demands for clarity and order.Mental illness and spirituality are not two distinct natural phenomena “out there,” existing independently of human volition. They are both social—cultural if one prefers—ascriptions. Neither has some substantive core whose elucidation through psychophysiological, phenomenological or ultrahuman procedures could enable us to define its essence and thus differentiate it from the other. Neither experience is a self-evident datum. Both are easily susceptible to critiques, either that they do not exist as natural categories, or else that they should more properly be described as something else—as the workings out of social exclusion in the case of mental illness, as cosmological understanding or mass hysteria in the case of spirituality. The Humean theory of motivation remains the default position in much of the contemporary literature in meta-ethics, moral psychology, and action theory. Yet despite its widespread support, the theory is implausible as a view about what motivates agents to act. More specifically, my reasons for dissatisfaction with the Humean theory stem from its incompatibility with what I take to be a compelling model of the role of motivating reasons in first-person practical deliberation and third-person action explanations. So after first introducing (...) some assumptions about the nature of agency in section one, I will turn to articulating and defending this account of motivating reasons in sections two through four of the paper. Section five then provides some background on the Humean theory before I argue directly against it in section six and critically examine the leading arguments for the view in section seven. Based on a reconstruction of the development of Rudolf Carnap’s views from the Aufbau until the 1960s, this paper provides an account of the philosopher’s understanding of non-cognitivism, which is here seen as in line with the so-called scientific world-conception of left-wing logical empiricism. The starting point of Carnap’s conception is the claim that every human decision depends on certain attitudes that cannot be justified at a cognitive level, that are neither based on empirical facts nor logical reasoning. The (...) key features of Carnap’s non-cognitivism, however, go beyond this general basis and involve several fundamentally moral commitments, such as a commitment toward science, and the embracing of moral attitudes as the result of a long-term process of rational discourse. I argue that these commitments contained in Carnap’s non-cognitivism/scientific world-conception establish a genuinely political worldview that is characteristic of left-wing logical empiricism and converges with socialism and democracy. When someone is poised to fail to fulfil a moral duty, we can respond in a variety of ways. We might remind them of their duty, or seek to persuade them through argument. Or we might intervene forcibly to ensure that they act in accordance with their duty. Some duties appear to be such that the duty-bearer can be liable to forcible interference when this is necessary to ensure that they comply with them. We’ll call duties that carry such liabilities (...) enforcement-apt. Not all duties seem to be enforcement-apt. Some, for example, accept that a person in a monogamous marriage has a moral duty to refrain from infidelity, but deny that a spouse can be compelled to comply with their duty to be faithful without transgressing her rights. More controversially, some think that our duties to assist others in severe need are not enforcement-apt. What could explain the contrast between duties that are enforcement-apt while and those that are not? We’ll call this the puzzle of enforceability and our paper considers three broad strategies for responding to it. The first strategy takes the form of identifying some substantive feature or features that are necessary and/or sufficient for a duty to possess some enforcement status. We consider a range of candidate explanations of this sort but find that none are plausible. The second strategy rejects the idea that there are genuinely enforcement-inapt duties and instead seeks to explain why there can nonetheless be marked differences amongst duties concerning how they can be enforced and who can enforce them. We find that this strategy too is largely unsuccessful. The third strategy offered seeks an explanation of differences in enforcement status by appeal to the broader social costs of enforcing certain kinds of duties. We find that this approach holds some promise but note that it requires adopting a controversial set of moral commitments. We conclude by considering our options in the absence of a solution to our puzzle. (shrink)

In this paper I propose a naturalist account of the Buddhist epistemological discussion of svasaṃvitti ('self-awareness', 'self-cognition') following similar attempts in the domains of phenomenology and analytic epistemology. First, I examine the extent to which work in naturalized epistemology and phenomenology, particularly in the areas of perception and intentionality, could be profitably used in unpacking the implications of the Buddhist epistemological project. Second, I argue against a foundationalist reading of the causal account of perception offered by Dignāga and Dharmakīrti. Finally, (...) I argue that it is possible to read Dignāga's (and following him Dharmakīrti's) treatment of svasaṃvitti_ as offering something like a phenomenological account of embodied self-awareness. (shrink)

Many philosophers and psychologists hold that intuitions are, or reduce to, beliefs. The argument from intuition without beliefs threatens to undercut any such doxastic account: since there are clear cases of intuition without belief, intuitions cannot be beliefs. Advocates of the intellectual seeming account conclude that intuitions belong to the basic mental kind of intellectual seeming. I argue that rightly understood, apparent cases of intuition without belief are cases of someone having the inclination to believe that p whilst believing that (...) not-p. These can be accommodated by a disjunctive doxastic account holding that to have an intuition is to either have a belief, or to have an inclination to believe. I conclude that intuitions reduce to beliefs, and that there is no need to acknowledge intellectual seemings as basic states in our mental taxonomy. (shrink)

Cette étude formule l'hypothèse critique d'une opération de remythologisation par une réactualisation théologico-politique de la tragédie chez Heidegger. Cette opération ne saurait simplement coïncider avec une revalorisation " irrationnelle " du mythe, car elle procède d'abord d'une mise en question, non moins problématique, de la dualité supposée entre muthos et logos pour culminer dans ce qu'une note des années 1950 appellera la " mytho-logie de l'événement ". La réélaboration de la notion de mythe s'accomplit à partir du poème de Hölderlin (...) qui doit préfigurer les dieux de l'" autre commencement " post-judéo-chrétien, selon le projet spéculatif d'une " religion " censée relier le peuple à ses dieux nouveaux via l'être comme événement. L'hypothèse d'une remythologisation théologico-politique doit ainsi permettre d'éclairer non seulement le rôle matriciel de Hölderlin pour la pensée de l'être, mais aussi le surinvestissement illusoire du national-socialisme censé donner lieu au " peuple de Hölderlin ". Pour interroger cette réactualisation théologico-politique du mythe, l'étude se concentre sur les cours que Heidegger consacra à Hölderlin, tout en sollicitant l'intégralité du corpus des années 1933-1945, c'est-à-dire les cours fribourgeois, les traités inédits rédigés dans le sillage des Contributions (Beiträge) et les Cahiers noirs (Schwarze Hefte). Animals and plants are metaorganisms and associate with microbes that affect their physiology, stress tolerance, and fitness. Here the hypothesis that alteration of the microbiome may constitute a fast‐response mechanism to environmental change is examined. This is supported by recent reciprocal transplant experiments with reef corals, which have shown that their microbiome adapts to thermally variable habitats and changes over time when transplanted into different environments. Further, inoculation of corals with beneficial bacteria increases their stress tolerance. But corals differ in (...) their ability to flexibly associate with different bacteria. How scales of microbiome flexibility may reflect different metaorganism adaptation mechanisms is discussed and future directions for research are pinpointed. It is posited that microbiome flexibility is a broad phenomenon that contributes to the ability of organisms to respond to environmental change. Importantly, adapting with microbial help may provide an alternate route to organismal adaptation that facilitates rapid responses. (shrink)
