This book clarifies the relation between religion and ethics, articulates principles governing religion in politics, and outlines a theory of civic virtue. It frames institutional principles to guide governmental policies toward religion and counterpart standards to guide individual citizens; and it defends an account of toleration that leavens the ethical framework both in individual nations and internationally.

Until recently, the name of Metropolitan Alexy was mentioned by researchers, mainly historians and religious scholars, mostly in the context of the problem of the split of the Orthodox Church in the Ukrainian lands during the years of the Great Patriotic War of 1941-1943 as the head of the Autonomous Church. At the same time, he remains almost unknown as a religious thinker, and meanwhile, in his numerous theological-philosophical and historical-religious studies works, the bishop raised the most devastating (...) religious and spiritual problems of society and person, many of which have not lost their relevance to this day. Since Ukraine began to realize itself as a democratic country, the process of revising the relations of our state with various social institutions, including the Church, began to find a model that would ensure the harmonious development of both the state and the Church. In this context, the study of the views of one of the prominent hierarchs of intellectuals Metropolitan Alexy on church-state relations is very important and relevant. (shrink)

In this paper inter-denominational cooperation is treated as part of the church-state relation because the propensity for inter-denominational cooperation is influenced by the legislative framework that regulates church-state relations. Although inter-denominational cooperation is hard to achieve, the author argues that some policy solutions are accessible to the government to encourage churches to cooperate at the level of church-based NGOs. The model is similar in some aspects to the faith-based and community initiatives developed in the United (...) States. The author also attempts to uncover the possible problems that arise when dealing with the potential for inter- denominational cooperation. (shrink)

Elements of the relation between religion and politics are standard themes in political theory: toleration and free exercise rights; the parameters of separation of church and state; arguments for and against constraints imposed on religious discourse by philosophic norms of public reason. But religious parties and partisanship are no part of political theory, despite contemporary interest in value pluralism and in liberal democratic theory's capacity to address multicultural, religious, and ethnic group claims. This essay argues that religious parties (...) are missing elements in discussions of identity politics. They play an important role not just in expressing but also in constructing and mobilizing religious political identity. Political activity linked to parties is a principal way of bringing diffuse, politically unorganized groups, whose leaders are self-appointed and not regularly accountable for the way they represent co-religionists in political life, into the democratic mainstream. With political organization and especially partisanship, the fact of pluralism is made concrete for democratic purposes. (shrink)

The article of N. Kulish "Improvement of legal normalization of church-state relations in Ukraine - an important condition of the implementation of freedom of conscience and religion by believers" analyzes the impact of legal normalization of issues of the religious education on modern believer.

In this paper I will deal with the question of the religious education in the public schools in Romania, from the point of view of the relationship between Church and State. My quantitative and qualitative analysis of the bills concerning religious education, the way in which law has been applied and some of the consequences of this application wants to circumscribe the meaning of some concepts such as religious liberty and the new religious forms. The basic consequence of (...) this I hope will be the redefining of the notion of public space and of the role played by religion with its characteristic aspects: the relationship between state and religious organizations. This will clearly show the essential bond between two main aspects of religious liberty: the formal aspect - legal and institutional - and the informal aspect – an aspect connected to the personal and social attitudes regarding the new forms of religious behaviour. There exists a limited pluralist model of regulating or `managing' religious diversity in contemporary Europe. This pluralist model, however, is in contrast to the limitations that appear at the state level, which reflect an increasingly illiberal, secular Europe. Such contrast stems historically from tensions that exist between the national and transnational aspects of the model itself, but it also reflects the emerging debates on religious pluralism and the democratic state. With the settlement of post-colonial migrants (with Muslims constituting (...) a large majority) a public debate on the role of religion in Europe has resurfaced as these communities exist outside the historical formation of Western church-state relations and are challenging the very underpinning of what comprises a `liberal' democratic state. In particular, it is the role of Islam in secular Europe that frames several questions in this debate: to what extent is it necessary to regulate religious freedoms in the `public sphere' in order to protect the democratic state? What restrictions on minority religions should be considered `necessary in a democratic society’ and what limitations should be placed on state interference in minority religions as protection against the undue influence of a dominant social group? Against this backdrop, this article explores the historical social formation of religious pluralism in the European context and examines the legal and political frameworks at the national and regional levels to `regulate' diversity. This is the first full-length English translation of Benjamin Constant's massive study of humanity's religious forms and development, published in five volumes between 1824 and 1831. Constant (1767-1830) regarded On Religion, worked on over the course of many years, as perhaps his most important philosophical work. He called it "the only interest, the only consolation of my life," and "the book that I was destined by nature to write." While the recent revival of interest in Constant's thought has been welcome (...) and fruitful, it has been incomplete, tending to leave out of account his writings on religion. In this connection, On Religion is essential reading and of interest for many reasons. As an analysis of humanity's religious experience, the work is notable for its methodology. Unlike previous writers with dogmatic commitments, whether theological or philosophical, Constant aimed to work with well-established facts and to relate religious forms to their historical contexts and civilizational developments. In this way, he was a precursor of the scientific study of religion. This objectivity, however, was not tantamount to moral-political neutrality. In the aftermath of the French Revolution, he wanted partisans of the new order to recognize that the religious impulse was natural to the human heart: to extirpate religion was therefore a fool's errand and worse. Likewise, he instructed religious reactionaries that history had left them behind: now the natural state of the religious sentiment was an unfettered "spirituality" left free to find new forms of expression. His counsel to contemporaries has proven prescient concerning subsequent religious developments in democratic and totalitarian societies. In his day, Constant was a consistent liberal, a life-long advocate of representative government, as well as of the central liberal arrangement concerning religion: separation of church and state. But On Religion demonstrates that principled liberalism can turn a sympathetic as well as analytic eye toward religion and, in an unbegrudging way, find an important place for it in free society. There are signs that this is a lesson that contemporary liberalism would do well to relearn. Peter Paul Seaton Jr. teaches philosophy at St. Mary's Seminary and University in Baltimore. Political philosophy has difficulties to cope with the complexity and variety of state-religions relations. ‘Strict separationism’ is still the preferred option amongst liberals, deliberative and republican democrats, socialist and feminists. In this article, I develop a complex typology based on comparative history and sociology of religions. I summarize my reasons why institutional pluralist models like plural establishment or non-constitutional pluralism are attractive not only for religious minorities but for religiously deeply diverse societies in general. Most attention is paid defending (...) associative democracy, the most flexible and open variety of institutional pluralism, against realist objections that group representation is incompatible with liberal democracy, that it leads to stigmatization and bureaucratization, that it strengthens undemocratic leaders, that it leads to an ossification of the status quo, and, most importantly, that it is inherently divisive undermining social cohesion and political unity. In my refutation of these objections I try to show that it helps to integrate minority religions into liberal democratic policies compatible with reasonable pluralism and to prevent religious and political fundamentalism. In today’s European society one can observe different forms of religious fundamentalism, especially when defending various values relating to questions of the meaning of life or when confronted with multi-religious and multicultural situations. An ethical approach attempts to avoid such extremes, given that genuine human behavior is based on moral virtues, the Aristotelian “Golden mean”. At a time when some voices in left-leaning circles are trying to enshrine in the Charter of Human Rights the right of women to terminate their (...) pregnancies, by vehemently advocating their cause in the European Parliament and in the UN Assembly, and to redefine the traditional meaning of “family,” one might want to refer to the understanding of human rights of the Catholic Social Doctrine and other long-received ethical theories. On the other hand, many in the Pro-life movement also exhibit a fundamentalist approach to society, for example when legal bioethical approaches justify murder. In the contemporary setting it is necessary to clarify the relationship firstly between human rights and human dignity from the religious point of view and subsequently between human rights and the rights of a person, understood as a being who is self-aware. The current paper tries to clarify the position of the Roman Catholic Church on the issues of human dignity and human rights with the hope that this understanding will have a positive impact on the development of a just society as a means of preventing the spread of religious fundamentalism. That hope is to be found in the church’s promotion and creation of complex social spaces “in which alternative economies and authorities flourish” (42). According to Cavanaugh, Christians ought to acknowledge that the modern nation-state is not oriented toward the pursuit of the common good. Instead, it is fueled by a desire to secure greater power and to perpetuate itself. The nation-state thrives by instilling in its citizens a religious kind of devotion to its ideals and to its continued existence. This religious devotion, animated by the state’s distinctive liturgies and methods of indoctrination, is the vehicle through which the state secures the loyalty of its citizens. Under these idolatrous conditions, Christian citizens become willing to justify and endorse the nation-state’s use of extreme violence; tempted to identify the will of God with the will of the nation-state; and stunted in their ability to imagine alternative political possibilities because they have accepted the limits on religiously informed political activity set by the nation-state. Within the Irish government there is a discussion regarding the possibility of limiting the legal protection afforded to the confessional secret. This paper addresses the question of whether this suggestion, if it were to be implemented by the legislature, would be compatible with the right to religious freedom under Article 9 of the European Convention on Human Rights (ECHR). This text will also highlight the role of the confessional secret in canon law and the protection of it under German law. (...) Catholic priests, should this plan that is currently under discussion be implemented, were obliged to disclose the knowledge gained in confession to law enforcement authorities. The canonical consequence of such a breach of the confessional secret would be excommunication. In such cases priests therefore would only have the choice between breaking the law (which would probably also be punishable under criminal law) and excommunication, with all the resulting disadvantages. In this paper, the canonical law rules regarding confession are presented before the provisions relating to the confessional secret in § 53 para. 1 No. 1 of the Code of Criminal Procedure, § 383 para. 1 No. 4 of the Code of Civil Procedure and § 139 para. 2 of the Criminal Code are discussed. Specifically, the question is raised as to whether a duty of priests to co-operate with the law enforcement authorities may be established by law. Here in particular the protection of the confessional secret under the protection of freedom of religion under Article 9 of the European Convention on Human Rights will be discussed. It has to be noted however that the protection afforded by Article 9 of the European Convention on Human Rights extends far less than the scope of § 53 para. 1 No. 1 of the Code of Criminal Procedure, § 129 para. 2 of the Criminal Code and § 383 para. 1 No. 4 of the Code of Civil Procedure, as Art. 9 ECHR only protects the confessional secret as far as it is required from a religious point of view, but not a general pastoral secret. The article then includes a discussion on the limitations of Article 9 ECHR. Limitations of Article 9(1) ECHR on religious freedom under Article 9(2) ECHR are only permitted if they are prescribed by law and necessary in a democratic society for the protection of public order, health, morals or the rights of others. This is discussed against the background of the legislative goal of more effective law enforcement. As a result, a limitation of the protection of confessional secret through normal (sub-constitutional, domestic) laws, despite the understandable goal of more effective law enforcement, is not compatible with Article 9 of the ECHR. This paper sketches a framework for the separation of church and state and, with the framework in view, indicates why a government’s maintaining such separation poses challenges for balancing two major democratic ideals: preserving equality before the law and protecting liberty, including religious liberty. The challenge is particularly complex where healthcare is either provided or regulated by government. The contemporary problem in question here is the contraception coverage requirement in the Obama Administration’s healthcare mandate. Many institutions have mounted (...) legal challenges to the mandate on grounds of religious freedom. The paper proposes a number of interconnected principles toward a resolution of the problem: for the institutional realm, specific principles for church-state separation and a principle concerning the protection of citizens’sense of identity; and for the ethics of citizenship in the conduct individuals, principles that provide an adequate place for natural (thus secular) reason in lawmaking and political decisions. This introduction is divided into two parts. First, drawing on Paul Guyer’s suggestion that we should turn to Kant to reinvestigate the foundations of religious liberty, I outline Kant’s views on the relations between the ethical and the political community, as presented in Part Three of the Religion within the Boundaries of Mere Reason, focusing in particular on his arguments for separation between religion and the state. Examining critically the idea to employ Kant in contemporary debates, I claim that (...) Kant’s account of pure moral faith and the church as its ‘vehicle’ may pose difficulties for any argument for religious liberty that appeals to his thought. For Kant is better equipped to offer resources to overcome rather than to accommodate the fact of so-called “moral pluralism,” i.e. the condition in which the principle of religious liberty can find its application. The article deals with the processes of the establishment of democratic institutions and influential role of Apostolic Church. From this point of view, the state’s official support to the Armenian Apostolic Church can question the principles of religious freedom. The historical role of the (...) Armenian Apostolic Church in maintenance of Armenian identity enables Armenian Church to legitimize its privileges and dominant position in the society. The official cooperation between the Armenian state and the Apostolic Church are towards the maintenance or establishment of state hegemony in the society. The relationship between religion and politics complicated efforts to develop a constitutional and legal framework for the post-revolution Egyptian state. During different stages of the transitional phase, this led to results that are dangerously misaligned with the principles of democracy and citizenship. During the period between 2011 and 2013, several constitutional and legal results emerged. New laws on the exercise of political rights, election procedures and political parties did not stipulate a ban on the use of religion for political, (...) electoral, or partisan purposes. This provided a legal loophole for the use of religious slogans in politics and prevented the imposition of penalties on groups exploiting religious spaces for electoral campaigning and other political purposes. This situation is contradictory to inclusive, citizenship-based politics. It also leaves society vulnerable to serious risks related to political and partisan affiliations as well as to electoral behavior based on religious identity instead of ideas and goals common to all citizens, regardless of religion. In addition to the contradictions between the constitutional and legal results of the transitional phase and the principles of democracy and citizenship resulting from the mixing of religion and politics in post-revolution Egypt, another set of political contradictions resulted from the ongoing use of religion in politics by conflicting groups. These contradictions, among other factors, prevented the success of efforts to foster democracy, citizenship and power devolution. (shrink)

The more than thirteen-year co-existence of the Ukrainian state and the Church in the qualitatively new conditions prevailing in the post-Soviet space together with the formation of an independent Ukraine, functioning during this period of state-church relations give reasonably reliable grounds for scientific analysis, a number of generalizations and conclusions regarding the results and conclusions conditions of state policy on religion, church and religious organizations, ensuring in Ukraine the right of everyone to freedom of (...) world view and religion - on the one hand, and repair and optimize -tserkovno and religious life - on the other. The author discusses several models of the relation of church and state with respect to their advantages and shortfalls to freedom of religion and equality of religions. The first model is the separation of church and state at a great distance, the second the model of equal religions and the third the rapprochement model of civil religion and constitutional ethics. None of these possible models is fully satisfying. Precisely because the minimum pre-requisites for legitimacy and liberality (...) are preserved, or should be preserved, in all three models, the advocates of all of these church-state models should learn to cherish their respective assets in order to ‘bear’ the accompanying losses. When the Church of Sweden ceased to be a state church in the year 2000, the parameters for a change in the relation between academic theology and religious studies ( religionsvetenskap ) at the state universities in Sweden was in place. My article, which is intended as a contribution to the sometimes unnecessarily agonistic discussion following the sharp critique levelled by the Swedish National Agency for Higher Education (Högskoleverket) in 2008, focuses on two basic oppositions underlying (...) the present discourse, namely the tension between the expectation of economic utility and the ideal of a free search for knowledge; and that between, on the one hand, confessional neutrality and, on the other hand, the education of priests and pastors. As a conclusion, I suggest a way forward in three points: 1. The education of priests for the Church of Sweden must change as a result of the abandonment of the state church system. 2. At the same time, the state system should nurture a more positive attitude toward theological reflections developed at nongovernmental university colleges. 3. Thirdly, the interrelationship between secular religious studies at state universities and the tradition specific theologies developed at private university colleges could be essential for the balancing of the demand of economic utility and the principle of academic freedom as it concerns religious studies. According to Corey Brettschneider, we can protect freedom of religion and promote equality, by distinguishing religious groups’ claims to freedom of expression and association from their claims to financial and verbal support from the state. I am very sympathetic to this position, which fits well with my own views of democratic rights and duties, and with the importance of recognizing the scope for political choice which democratic politics offers to governments and to citizens. This room for political choice, I (...) believe, is necessary if people are to have any chance of reconciling the conflicting moral and political obligations they are likely to face, however idealized our conception of democracy or morality. Granted that no amount of personal and political choice will ever guarantee that we do not encounter tragic choices, and painfully conflicting moral demands, it is an important feature of democracy – or so I believe – that its rights reflect the importance of mitigating these conflicts so that people are able, as a rule, to act as they ought, so that they do not experience their moral sentiments, beliefs and capacities simply as grounds for recrimination, alienation and despair. I therefore believe that democracies have good reason not to force the consciences of the undemocratic and the intolerant, where it is possible to accommodate such people without threatening the rights of others. However, the fact that I share many of Brettschneider’s intuitions and beliefs does not mean that I share them all. In particular, I find his conception of democracy unduly narrow, and unduly based on a rather idealized conception of the American constitution which is unlikely to appeal to those whose conceptions of democracy are more republican, more socialist, more pragmatic and more international than his. I have explained these worries elsewhere and drawn out some of their implications for his arguments about privacy and judicial review. There is no need to repeat them here. I will also set to one side my worries about his uninflected, overly abstract and rather reified characterization of the State, in the hope that others will discuss this and that, in the end, a more nuanced conception of the State and a more lively appreciation of the conflicting people, institutions, histories and norms which make up most states, will prove consistent with his arguments. Finally, I do not propose to enter into a detailed discussion of the difficulties of Brettschneider’s overly abstract and reified conception of State ‘speech’ and ‘expression’ which, while motivated by the language of American constitutionalism, appears to cover pretty much anything a government might do, from raising and spending taxes, to accepting judicial interpretations of contested constitutional provisions, or to affirmatively pronouncing on the goals that will animate its legislative agenda and its aspirations for citizen’s lives. Again, while I would have wished for a more nuanced and analytical discussion of so central a concept as ‘expression’ and, in particular, expression by ‘the State’, I am uncertain that anything fundamental in Brettschneider’s account of citizen rights and duties would be altered in the process. Instead, then, I want to focus on points in Brettschneider’s argument that intrigue, and sometimes puzzle, me the most and where issues of nuance and clarification might make a substantial difference to our views of equality and religious freedom. Recently there has been an upsurge in interest concerning the relationship between religion and international relations. Much of this has been expressed as if the relationship between these was entirely new. In contrast, this paper involves the argument that it is not so much a question of religion returning but rather why it is that students of international relations have neglected the connection since the Peace of Westphalia. This neglect has largely occurred because of the primacy given to changes and (...) events in the West, particularly since the formal separation of church and state and its imposition on or emulation by Eastern societies. The recent concern with globalization has provided the opportunity to undertake historical dis­cussion in new perspectives which overcome the Western “normality” of the absence of religion in the Realpolitik perspective. Moreover, it is argued that much of the neglect of religion in work on world affairs has largely been the product of the inaccurate and ideologically motivated perception of ongoing secularization. The overall discussion is framed by some objections to the limiting consequences of disciplinarity, particularly the way in which both IR and sociology were rhetorically constituted. (shrink)

The fall of the Berlin Wall in October 1989 bears a striking resonance with the biblical fracturing of the curtain in the Jerusalem temple. It presaged the death of the post-war dispensation of Church-state relations characterised by a Church that was, in the main, subservient, acquiescent and complicit to the apartheid regime in South Africa, as well as the oppressive one-party state regimes north of the Limpopo. As the Berlin Wall collapsed, the dispensation characterised by either (...) neutrality or docility and co-option of the Church to the Apartheid and Independent states gave way to the birth of a 'prophetic' Church, which would not only gain a new lease on life, but would become a robust interlocutor of the post-Cold War state. The latter is exemplified by historical signposts such as the Rustenburg Declaration, the Pastoral letter of the Zambia Catholic Bishops Conference and the Pastoral letter by the Catholic Bishops of Malawi, among others. The democratic transformations that have taken place in our country since independence have laid the foundations for new state-church relations. The relations between the state and the Church in this situation have acquired fundamentally new qualities, which, unlike the past, are characterized by a generally stable partnership, mutual respect and cooperation. Such relations are enshrined in the Constitution of Ukraine, the Law of Ukraine "On Freedom of Conscience and Religious Organizations", other legislative acts and international legal (...) agreements. There are good historical reasons for emphasis on separation of church and state in a democracy, but the separation can be carried too far. Concerning the relationship of church and state, various Chrístian denominations divide up into separatists and unificationists, and each tendency can lead into extremes which could under certain conditions be inimical to democracy. Going beyond questions of constitutional separation, one may argue for a mutual utility and complementarity of church and democratic polity. (...) The Kimbanguists, whose church is based on the healing and proclamation ministry of Simon Kimbangu in 1921 in the Belgian Congo, challenge colonially defined borders and identities in multiple ways. Anticolonialism is in the DNA of Kimbanguism, yet in a manner that contests the colonially inherited dichotomy between religion and politics. Kimbanguists draw from holistic Kongo traditions, where the spiritual and material/political are inherently interwoven. Kimbangu’s home village, Nkamba, is the centre of the world for them, and Kongo culture (...) and the ancient kingdom form the backdrop of the Kimbanguist view of the new eschatological order to come. The reunification of the kingdom from the two Congo states and Angola will mark the inauguration of the new era. This will not, however, mean a splintering of the Democratic Republic of Congo but rather a removal of the colonial borders. That hints towards a Pan-African vision of a united Africa and even a universally united Black race that will play a central role in the eschatological salvation historical drama. The Kimbanguist vision also contains global dimensions, and their view of borders and identities is like Nkamba-centred ripples in water. This vision wipes away colonial borders and relativises ethnic, national and racial identities whilst strongly subscribing to a salvation historical narrative that places Africa and Africans in the centre. Contribution: This article contributes to the study of nationalism as well as of African Instituted Churches. The analysis of how the Kimbanguists relate to (Kinshasa) Congolese nationalism, Kongo ethnic identity and Pan-Africanism as well as of their global missional views reveals layers and complex patterns of relationship between all these. What facilitates the simultaneous subscribing to all these layers is an openness of identities (Kimbanguist national, ethnic, etc.), as well as a tendency to see the world as consisting of interdependent areas and human communities with their holy city, Nkamba, in the centre. Hòa Hảo Buddhism belongs to that traditional lay and frugal buddhism encouraging practicing at home (tu tại gia) while being engaged with the world (nhập thế). It appeared in Southern Vietnam at the end of the 1930’s. Obviously, colonial contest and economic depression have played the part of a powerful catalyst in the spread by a young charismatic and reformist character of this millenarianism. Then, during three decades of postcolonial and cold wars (1945–1975), this New Religious movement hardly expressed its (...) Buddhist ethic of social statements in order to lend moral support and material protection to the local peasantry. Eventually, at the end of the war, this autonomous Buddhist community finally tried to morph again into a legal religion at a time when the Vietnamese Communist Party had to urgently impose a new sovereign socialist republic (1976). In other words, the new regime had to reunify the Nation and build a new secular state. In the southern part of the country, the replacement of a former liberal regime (Republic of Vietnam) by a socialist republic (called formerly a Democratic Republic in Northern Vietnam) completely changed the nature of the State-Church relations. Therefore, many religious groups’ agencies suffered a drastic blow as these groups were subordinated to the Patriotic Front and its mass organizations. Nevertheless, in 1991, the reorientation of the religious policy officially reaffirmed the religions’ social utility. Since then, new debates emerged to define the nature of the social actions of religious groups and then to delineate the legal sphere of their activities in this secular state. This essay intends to question how the two notions of being engaged with the world (nhập thế) and that of the secular state (nhà nước trung lập thế tục) interacted during these last decades. To tackle this pivotal issue, we focused on the specific implementation of Hòa Hảo social activism, from 1940’s until now, to underline how this activism evolved under different political regimes and how a new culture of social service has been promoted since the Hòa Hảo official church was recognized in 1999 and achieved years later. It questions more generally how religious groups can negotiate with the state for the emergence of a civil society or, at least, for the acceptance of their own tribute to the prosperity of the Nation. Strict separation of church from a presumed ‘religion-blind’and strictly ‘neutral’state still is the preferred model in liberal, democratic, feminist, and socialist political theory. Focusing on the full, reciprocal relationships between society-culture-politics-nation-state and religions, this article makes a case in favor of ‘nonconstitutional pluralism’ in general, associative democracy in particular. Associative democracy recognizes religious diversity both individually and organizationally; it stimulates legitimate religious diversity; it prevents a hidden majority bias; and it provides a legitimate role for organized religions (...) in the provision of a wide range of services, including education, on one hand, and in the political process, on the other hand. That organized religions should be informed, heard, and consulted in contested issues should be a crucial component of democratic participation. This article argues that there is much more continuity in Hobbes’s thinking on the church and religion than critics have recognized. I consider three issues which have been taken as prime illustrations of Hobbes’s alleged ‘new departure’ in the Leviathan: the nature and fate of the soul; the character of magic and revelation; and church-state relations. I show that in particular Richard Tuck’s interpretation of Hobbes’s intellecual development is mistaken. There is no ‘fundamental reversal’ or ‘new direction’ (...) in Hobbes’s position, but rather a development and an extension of a line of thinking which is already clearly visible in the earlier works. The purpose of this article is to systematize and generalize information about the political right-conservative movement in modern Poland. In the course of the study, the potential for support for right-wing parties exists in every society. It can grow due to two groups of factors. The first concerns issues related to the difficult economic situation, the modernization of societies or cultural aspects, which are called demand-related in the literature. The second large group consists of supply factors: factors of possible political (...) success (structure of political opportunities), electoral rules, inter-party competition, the role of the mass media, the structure of political divisions or the role of the winning ideology. Polish right-wing conservatism and nationalism is characterized, both in the past and in the present, by a powerful influence on the social and political life of the Republic of Poland, acting as a fundamental element of the unification of the Polish people. This movement retains its traditional features, which are reflected in the ideology of the Polish ruling party “Law and Justice”, which adheres to a national-conservative orientation with elements of clericalism, maintains close ties with the Catholic Church and organizations close to it. In the period after coming to power (2015), “PiS” slowly but steadily lost its Christian-democratic character and evolved into a conservative political force. This allowed “PiS” to win elections for a long time, and in 2023, it allows it to maintain leading positions in public opinion polls regarding support for political parties. In the field of international relations, supporters of “PiS” operated with judgments that expressed the ideas of nationalism, presenting the Poles as a strong nation that should occupy an important place among other countries. The process of creating right-wing conservative political parties and associations in Poland continues on an ongoing basis. The strengthening of nationalist movements in Poland takes place with the support of the state authorities of the Republic of Poland and is accompanied by a gradual shift of emphasis on controversial historical issues in the direction of nationalist ideology. Despite official Warsaw providing political support to Kyiv in the international arena in connection with the Russian military threat, the authorities of the Republic of Poland have no intention of blocking anti-Ukrainian activities carried out by Polish national-patriotic right-wing movements. This is due to the preparation of the ruling elite for the celebration of the 80th anniversary of the tragic events in Volyn in 2023, as well as the parliamentary election campaign. In the future, the activation of radical right-conservative formations on the territory of the Polish-Lithuanian Commonwealth may lead to protest actions in Poland, the purpose of which will be the dissemination of information unfavorable to our state in the Polish information space, which will have a negative impact on the formation of the foreign policy vector of the Polish-Lithuanian Commonwealth in the Ukrainian direction. Starting from the hypothesis that the predominant church, religion and belief in Romania (i.e. the Romanian Orthodox Church, the Orthodox religion and the Orthodox belief) are paradigms that help understand politics, we will highlight in the present article three major aspects of the political phenomenon in post-communist Romania: de-symbolizing the democratic function, institutionalizing “democratism” and manifesting integralism in the public space. Our analysis is based on a communicational approach which postulates the conceptual oppositions as a fundament of understanding. (...) The interpretation of these oppositions has lead us to discovering a series of coherent actions, behaviors, facts, etc., but also a series of incoherent, at some point irrational situations in the relation between the religious and the political spheres. The importance of this article lies in the fact that, once highlighted, these structures allow us to take into consideration the possibility of analyzing the meaning of the relation between the religious and the political spheres. The article suggests that a distinction between ‘republicans’ and ‘democrats’ more usefully describes competing constitutional and economic reformers in Restoration France than the distinction between ‘ancients’ and ‘moderns’ made famous by Benjamin Constant. It shows that Constant’s description of Rousseau as an ‘ancient’, and the blaming of his political theory for the excesses of the 1790s, is historically questionable, and masks Constant’s broader aim of bringing into disrepute contemporary strategies for the moralization of politics and commerce. Such strategies are evident (...) in the writings of Jean-Baptiste Say, and reveal the profound divide between reformers who have traditionally been described as ‘liberals’. Say and Constant disagreed about the extent to which the people could be trusted to act as political agents, about the capacity of the state to make property relations more legitimate, about religion, and the relevance of the example of Britain to French economic and political reform projects. The position of the state regarding the Church, the peculiarities of the established state-church relations greatly influence the nature of the development of church institutions and the level of religiousness of the population, as well as ensuring the right of citizens to freedom of conscience. Consequently, the development of a legal democratic Ukraine is impossible without constant attention of state bodies to the issue of guaranteeing freedom of conscience and religion, the state of (...) which is currently dependent on their constitutional and legal regulation and the existence of a holistic mechanism for guaranteeing the said freedom, as well as from the way of monitoring and responding to violations of the law. Abstract In 1995, the constitution of the Mexican state of Oaxaca was reformed to recognise indigenous usages and customs for the election of municipal governments. This recognition is problematic from a normative perspective, as women, new?comers and dwellers in municipal sub?units are disenfranchised in a good number of indigenous municipalities of the state. Nevertheless, this article argues against a summary assessment of the (presumably illiberal) consequences of this recognition policy. Following James Tully, it advocates an intercultural, dialogical (...) and inclusive procedure to tackle the perils of the politics of recognition in Oaxaca and Mexico. However, this procedure?based approach raises problems of its own related to the issues of representation and intra?communal divisions. As a result, the ultimate role of substantive commitments, in particular to individual rights, needs to be recognised. Despite these shortcomings, though, an approach based on an intercultural, dialogical and inclusive conflict?solving procedure is the best option to deliver more just answers to indigenous demands for recognition. Indigenous psychologies are informed by their cosmogonies and cosmologies, philosophies, spirituality and religions, traditions and customs, and knowledge and praxis systems. This paper reviews some conceptions of consciousness, psyche, spirit, mental and physical health, relations to all Earth Beings (human and nonhuman), ancestors, nature, and altered states of consciousness among the Nahua and Maya of Mexico. Colonization has threatened these rich legacies by imposing the conquerors' cosmologies. However, these Indigenous communities continue to use plants, mushrooms, and some animals to generate (...) altered states of consciousness, enacting sacred rituals and healing. The conclusion recommends learning from these knowledge and praxes systems and their related consciousness and spiritual states to expand the emergence of decolonial psychology that may offer alternatives to address the challenges of our time. Este artigo apresenta uma breve reflexão sobre a politização do fundamentalismo protestante norte-americano e sua possível influência no tipo de práxis sociopolítica que vem caracterizando o pentecostalismo brasileiro a partir de meados da década de 1980. Partindo de uma discussão sobre o que seria, de fato, o fundamentalismo e sobre os desenvolvimentos e reconfigurações desse movimento ao longo da história norte-americana, buscar-se-á analisar a influência e os possíveis paralelos entre o fundamentalismo e o recente engajamento político-eleitoral que vêm marcando o (...) pentecostalismo brasileiro. Observando-se a história recente do pentecostalismo brasileiro, pode-se perceber, especialmente após 1986 (ano em que as igrejas pentecostais se organizaram para eleger seus representantes na Assembléia Nacional Constituinte), tal influência do modelo fundamentalista na utilização da mídia, no conservadorismo político, na formação de grupos de pressão, na defesa dos “valores da família”, nos projetos de eleição de políticos comprometidos com os posicionamentos das igrejas, na busca do estreitamento das relações com o Estado na busca de influir em suas decisões. Starting with a discussion of what would fundamentalism be and about this movement’s developments and reconfigurations throughout American history, the text seeks to analyze the influence and the possible parallels between fundamentalism and the recent political engagement that have characterized Brazilian Pentecostalism. Observing the Brazilian Pentecostalism in recent history, we notice, especially after 1986 (the year in which the Pentecostal churches organized to elect their representatives in the National Constituent Assembly) such influence of the fundamentalistic model in several ways: in the use of media, in the political conservatism, in the formation of pressure groups to defend the "family values​​", in the projects of electing politicians committed to the churche’s positions and in the pursuit of closer relations with the state in seeking to influence their decisions. The relation between Church and state is nowadays at stake. This article concerns the relation between Church and state from an ecclesiastical and canonical point of view. It makes clear, how the ecclesiastical doctrine reacts to social developments in relation to the national state in order to safeguard the independence of the Church. The 19th century ecclesiastical doctrine on the Church as a societas perfecta reacts on doctrines on the national states, which claimed (...) absolute sovereignty and by that subordinated the Church to the civil government and civil law. With societas perfecta doctrine the Church defends its sovereignty in the domain of the spiritual good of men. In this way the Church defines and protects its divine origin and independence from the national state. In the first half of the 20th century the democratic and constitutional national states were developed, which acknowledges religious freedom on a constitutional level as a human and a civil right. Because of this progress the Second Vatican Council could formulate its doctrine on religious freedom based on the traditional ecclesiastical teaching of the freedom of the religious act. By then, the independence of the Church is founded and defended on the freedom of the Church, which is guaranteed in national states, which acknowledge religious freedom as a human and civil right. Although one can say that there is discontinuity in the ecclesiastical teaching on the Church as a societas perfecta and the ecclesiastical doctrine on religious freedom, there exists also continuity, because both ecclesiastical doctrines intend to safeguard the independence of the Church in human society. "Where to rush into such a heat"? What is the Ethics of Faith? And, most importantly, democratic or undemocratic? Is it advisable or inappropriate? After all, it would seem simpler - let everyone play (...) in their own territory: the school - gives knowledge, the family - deals with the upbringing of the child and decides whether to be religious or not, the church educates the children entrusted to them by the family, appropriate values ​​and outlook. The rethinking of the events of the Soviet past largely concerns the sphere of church-state relations. The significant losses of cultural and architectural heritage during the Soviet period make it expedient to study the mechanisms of liquidation of church buildings in the second half of the 1960s. The purpose and objectives of the article. To determine the principles of state policy in the field of religion and methods of its implementation by party-state structures concerning the (...) church network of the Russian Orthodox Church in the Ukrainian SSR. The research methodology. The research methodology is based on a set of philosophical, general scientific, and historical methods and principles. To solve the specific tasks of the study, the principles of objectivity, historicism, systematicity, and comprehensiveness were also used. Research results. The period of the second half of the 1960s was marked by the liberalization of official views on the religious sphere, the abandonment of repressive methods of fighting religion and the Church, the beginning of the latent destruction of sacred buildings, and the dominance of the Soviet state’s nihilistic attitude toward cultural heritage. The Russian Orthodox Church remained entirely subordinate to the Soviet state, which disregarded its legitimate rights and interests. Discussion. The repressions of the “Thaw“ period and the failure of building a communist society led to a loss of public confidence in the possibility of a just welfare state. It became clear that by practicing persecution, restricting the rights of priests, and banning them from studying in theological schools, the Soviet government was undermining its authority. Therefore, in the 1970s, ideologues of the CPSU Central Committee proposed a new model of churchstate relations — the adaptation to communism. There were no fundamental changes in party policy, as it was based on the Marxist doctrine of religion as the opium of the people. The anti-church orientation of state policy remained, only its forms and methods were transformed. The period of massive closure of Orthodox churches was replaced by a new long-term period, called the period of “streamlining the religious network”. Conclusions. One of the directions of the state’s policy towards religion in the mid-1960s was the targeted liquidation of religious buildings of the Russian Orthodox Church. The main reasons for it were the ideological and political priorities of the state leadership. The closure and destruction of religious buildings were systematic actions of the party-state structures in the process of implementing their policy in the field of religion in the Ukrainian SSR. The author, who for many years was the press-secretary to the Primate of the Ukrainian Orthodox Church, considers continuity UOC position on the principles of church-state relations and their genesis in accordance with the socio-political processes taking place in Ukraine, the development of media and information technology.

This paper is a critical and comparative legal historical study, which offers a global vision of the U.S. Legal System, according to the religious factor impact and its complex dimensions (e.g. religious liberty, Church-State relations, welfare state & solidarity). The principal goal is the deconstruction of the fake official History, elaborated after the Second World War (e.g. inferences, impostures, fallacies). At the same time, it shows the social development (and the kind of commitment in each period), and (...) how it happens the consolidation of the system thanks to the regulation. In this way, it is possible to pay attention to the American experimental evolution (not lineal or exceptional –as many U.S.hand-books pretend): from colonial Blue Laws (or Sunday regulation), up to the current regulation on freedom of religion and non-discrimination. Also, this paper offers a systematic set of diverse legal sources (e.g. Executive orders & rules, Legislative statutes, Judicial cases & resolutions). Another goal of this paper is the evaluation of the allegedly paradoxical policies and regulations in this field, during the last two Administrations (Clinton and W. Bush); both of them, from extreme views (linked at the end), they used incorrectly the religious factor, and they confused the institutions. TanakaIn his celebrated book Bowling Alone (2000), Robert Putnam noted the increased level in the phenomenon of "privatized religion" within the previous thirty-five years. Many of the Baby Boomer generation left churches in the late 1960s and the 1970s. Some sought out new religious movements and religious therapies, but most simply "dropped out" of (...) organized religion altogether. He cites Wade Clark Roof and William McKinney, specialists in American religion, who describe the outcome of this trend in American religious behavior: "[The consequence was a] tendency toward highly individualized religious psychology without the benefits of strong supportive attachments to believing communities. A major impetus in this direction in the post-1960s was the thrust toward greater personal fulfillment and quest for the ideal self.... In this climate of expressive individualism, religion tends to become "privatized," or anchored in the personal realms."1 Putnam observes that although privatized religion may be "morally compelling and psychologically fulfilling," it involves less social capital than environments in which individuals are connected to other individuals in shared faith commitment.Interestingly, American Buddhism may be one of the beneficiaries of this trend, for the recent growth of Buddhism in the United States is partly attributable to the climate of "privatized" religion. Nowhere is this symbolized more than by the so-called Nightstand Buddhists.2The Nightstand Buddhists derive their name from their practice of placing a Buddhist meditation book on the nightstand after reading it before they go to sleep. They get up the next morning and practice to the best of their ability the meditation they had read about the night before. Further, they may frequently attend lectures at the local university and visit a Buddhist center's web-page or participate in an online Buddhist discussion group. And if we were to visit them, we might find their homes decorated with Buddhist artifacts.But these Nightstand Buddhists do not show up in any statistics on the [End Page 115] American Buddhist population because they would not identify themselves as Buddhists. According to Thomas Tweed, who coined the term Nightstand Buddhists, "Sympathizers (= Nightstand Buddhists) are those who have some sympathy for Buddhism but do not embrace it exclusively or fully. When asked, they would not identify themselves as Buddhists. They would say they are Methodists, or Jewish, or unaffiliated."3 However, they have been an important part of the story of Buddhism in America from its beginning and continue to be so today.Among the three million Buddhists currently estimated to be in the United States, I believe there are Buddhists who exhibit many of the same characteristics as the Nightstand Buddhists. And this number is significant, particularly among those converts to Buddhism whose main practice is meditation. This group of convert Buddhists is one segment of the larger Buddhist community in the United States, which I have categorized into four groups.41. New Asian American Buddhists (those who have mostly arrived in the United States since the 1960s: Vietnamese, Thai, Korean, Cambodian, Myanmar, Laotian, and Sri Lankan).2. It makes an important contribution to continuing debates about religion and contemporary liberalism. Acknowledging that John Rawls provides the paradigmatic model for articulating modern liberal (...) ideals, the authors take [End Page 203] his work as a starting point; yet through critical engagement with his work, they move the discussion about liberal ideals forward in new directions. Although they recognize that the United States has long stood as the classical instance of a liberal polity, they widen their attention to other liberal nations that have different ways of relating to the religious sphere.The book is helpfully divided into four parts dealing with philosophical views, theological views, public policy issues, and national contexts. Each section investigates the proper role of religious voices in an increasingly global and pluralistic political environment. Bartel Farnham, Surrey, UK: Ashgate, 2009. 206 pp. $99.95.The volumes reviewed here each recognize an important thinker in Christian social ethics in America: Robert Benne, emeritus professor of religion at Roanoke College, a Lutheran social ethicist; and Paul L. Lehmann (1906–94), a Presbyterian who was an influential teacher associated with Princeton Theological Seminary, Harvard University Divinity School, and Union Theological Seminary in New York.The first volume honors Benne’s seventieth birthday. His major writings include The Ethic of Democratic Capitalism: A Moral Reassessment (1981), Ordinary Saints: An Introduction to the Christian Life (1988), The Paradoxical Vision: A Public Theology for the Twenty-First Century (1995), Quality with Soul: How Six Premier Colleges and Universities Keep Faith with Their Religious Traditions (2001), and most recently, Good and Bad Ways to Think about Religion and Politics (2010). Since Benne is known for his traditionalist moral views, some unmistakably conservative voices, including a number of prominent Lutherans and neoconservative political thinkers, are represented in this book. The broad theme is public theology, working from Benne’s definition of public theology as “the engagement of a living religious tradition with its public environment—the economic, political, and cultural spheres of our common life.”The book has three parts. The first section, “The Imperative of a Public Theology,” includes essays by editor Michael Shahan, Carl Braaten, Jean Bethke Elshtain, and Richard John Neuhaus. Shahan’s essay provides a helpful exposition of Benne’s intellectual trajectory. Braaten offers a defense of the historic, bodily resurrection of Jesus as the “crux of Christianity’s case.” Elshtain takes [End Page 206] up C. S. Lewis’s concerns in his Abolition of Man (1944) as she diagnoses the “cultural disorder” reflected in current debates about euthanasia and abortion. Neuhaus’s wistful essay looks back over his efforts in the public square, stating that he and Benne have shared a common concern: “A renewal of Christian confidence in providing a morally informed philosophy for a more just and virtuous society in the tradition of liberal democracy” (47). Taken together, these four chapters sketch the assumed intellectual and cultural landscape that sets the context for the volume as a whole.The second section, “The Lutheran Necessity in Public Theology,” begins with a largely autobiographical essay by James Nuechterlein about his journey in Lutheranism and the value of its theological distinctives, especially the famous simul. Next is Gilbert Meilaender’s account (exploring an insight from Kierkegaard) of the place for a Lutheran “corrective” within the wider normative tradition, then Mark Noll’s chapter that underscores the value of robust Lutheran social thinking against the backdrop of the more revivalist and pietist tendencies of Protestant evangelicalism.The final section, “Contested Issues in Public Theology,” includes chapters by Paul Hinlicky, Ronald Thiemann, Gerald McDermott, Donald Schmeltekopf and Michael Beaty, and Joseph Swanson. The chapters by Hinlicky on Luther’s relation to liberal political theory, and by Thiemann on the idea of the public theologian’s prophetic role as “connected critic,” are the most densely argued material in the book. These two essays will probably be of the most interest for scholars in theological ethics. The chapter by McDermott deals with Lutheran church-related colleges. A coauthored essay by Schmeltekopf and Beaty champions the vocation of Christian university education. Swanson situates Benne’s economic writings within neo-conservative thought.The book takes up some of Benne’s favorite themes and interest areas, but only rarely do the authors engage Benne’s own thought.
