On principle, there are no language classifications which are right or wrong, but only classifications which are more or less useful or useless. This statement at the beginning of my paper is intended to indicate the teleological perspective in which I want to view the more general problems involved in the classification of African languages. IT IS CERTAINLY THE CASE that twelfth- and thirteenth-century treatises on logic represent in great part attempts to represent the Organon, Aristotle’s books on logic, by rearranging the material, adding clarifications, and sometimes breaking new ground as in the case of the treatise on the property of terms. Thus when Roger Bacon is writing his Summulae dialectices around 1252, he is confronted by the problem of what to do with the material on the classification of statements into single (...) or multiple, and simple or composed in chapter 5 of Aristotle’s On Interpretation. In this essay several challenges are raised to the project of classifying Śāntideva’s ethical reasoning given in his Bodhicaryāvatāra, or Guide to the Way of the Bodhisattva, as a species of ethical theory such as consequentialism or virtue ethics. One set of difficulties highlighted here arises because Śāntideva wrote this text to act as a manual of psychological transformation, and it is therefore often difficult to determine when his statements indicate his own ethical views. Further, even assuming we can (...) identify a set of statements that accurately portray the moral position of Śāntideva, it is argued that these statements underdetermine which foundational normative theory should be ascribed to him. Delusions are usually defined as false beliefs about the state of affairs in the public world. Taking this premise as unquestionable, the debate in cognitive science tends to oscillate between the so-called 'rationalist approach'- proposing some breakdown in the central intellective modules embodying human rationality - and the 'empiricist approach' - proposing a primary peripheral deficit , followed by explanatory efforts in the form of delusions. In this article the foundational assumption about delusion is questioned. Especially in the case of (...) schizophrenia, delusions are not epistemic statements about external world but metaphorical reports of altered structure of experiencing . Delusions as epistemic statements or beliefs occur paradigmatically in delusional disorder . These two types of delusions are compared from a primarily phenomenological stance. (shrink)

Plurality of beliefs and theories in different knowledge domains calls for modelling multi-viewpoint ontologies and knowledge organization systems. A generic theoretical approach recently proposed for heterogeneity representation in KOS was linking each ontological statement to a specific validity scope to determine a set of conditions under which the statement is valid. However, the practical applicability of this approach has yet to be empirically assessed. In addition, there is still a need to investigate the types of inconsistencies that might arise in (...) multi-viewpoint ontologies as well as their possible causes. This study proposes a new framework for systematic analysis and classification of inconsistencies in multi-viewpoint ontologies. The framework is based on eight generic logical structures of ontological statements. To test the validity of the proposed framework, two ontologies from different knowledge domains were examined. We found that only three of the eight structures led to inconsistencies in both ontologies, while the other two structures were always present in logically consistent statements. The study has practical implications for building diversified and personalized knowledge systems. (shrink)

The concepts of issue and status are more different than is currently assumed. Apart from differences between the classifications of statements they are related to, there are differences between their definitions. The respective functions of pleadings and of inventio account for most of these differences.

A puzzle for identity statements using massnouns, central to the expression of chemicaltypes, arises if one accepts that both `Wateris H2O' and `Ice is H2O' are identitystatements, since they jointly entail that`Water is ice'. The increasing use of cluster randomised trials in low-resource settings raises unique ethical issues. TheOttawa Statement on the Ethical Design and Conduct of Cluster Randomised Trialsis the first international ethical guidance document specific to cluster trials, but it is unknown if it adequately addresses issues in low-resource settings. In this paper, we seek to identify any gaps in theOttawa Statementrelevant to cluster trials conducted in low-resource settings. Our method is (1) to analyse a prototypical cluster trial conducted in a low-resource (...) setting (PURE Malawi trial) with theOttawa Statement; (2) to identify ethical issues in the design or conduct of the trial not captured adequately and (3) to make recommendations for issues needing attention in forthcoming revisions to theOttawa Statement. Our analysis identified six ethical aspects of cluster randomised trials in low-resource settings that require further guidance. The forthcoming revision of theOttawa Statementshould provide additional guidance on these issues: (1) streamlining research ethics committee review for collaborating investigators who are affiliated with other institutions; (2) the classification of lay health workers who deliver study interventions as health providers or research participants; (3) the dilemma experienced by investigators when national standards seem to prohibit waivers of consent; (4) the timing of gatekeeper engagement, particularly when researchers face funding constraints; (5) providing ancillary care in health services or implementation trials when a routine care control arm is known to fall below national standards and (6) defining vulnerable participants needing protection in low-resource settings. The objective of this paper is twofold. First, I present a framework called historical coherentism (Chang, 2004; Tal, 2016; Van fraassen 2008) and argue that it is the best epistemological framework available to tackle the problem of coordination, an epistemic conundrum that arises with every attempt to provide empirical content to scientific theories, models or statements. Second, I argue that the problem of coordination, which has so far been theorized only in the context of measurement practices (Reichenbach, 1927; Chang, (...) 2001; Tal, 2012; Van fraassen 2008), can be generalized beyond the philosophy of measurement. Specifically, it will be shown that the problem is embodied in classificatory practices and that, consequently, historical coherentism is well suited to analyze these practices as well as metrological ones. As a case study, I look at a contemporary debate in phylogenetics, regarding the evolutionary origin of a newly identified archaeal phylum called Methanonatronarchaeia. Exploring this debate through the lens of historical coherentism provides a detailed understanding of the dynamics of the field and a foothold for critical analyses of the standard rationale used by practitioners. Ottoman Turkish or Ottoman –as a mumpsimus – is basically Turkish language, over time it has been substantially influenced by Arabic and Persian. Its alphabet is based on Arabic letters. It has borrowed letters from Persian as well. Its vocabulary is essentially Turkish; however, it has borrowed words from Arabic and Persian at a substantial level. Arabic language attracted attention in mosques because it was the language of the religion, and in madrasahs because it was the language of science. As (...) for Persian, it spread in Turkish states as the literary language and this lifted its effectiveness especially in Seljukian palaces. Arabic writing, which is the common writing form for both languages, became the writing form for virtually the entire Islamic world, and thus, Turks employed Arabic writing form to be able to write in their own languages. According to resources, the first written Turkish language grammar book is Muyassiratu’l-ulum by Bergamalı Kadri. Apart from this book, the earliest sources on Ottoman Turkish grammar and principles were started to be written after 1840. While writing activities about Ottoman Turkish grammar increased in late 19th and early 20th centuries, they have gained further acceleration nowadays. In fact, the statement about a generation who cannot read the grave stones of their ancestors has been influential. After providing education on Ottoman Turkish as a compulsory or elective course as part of high school syllabus by the Ministry of National Education, and due to the natural increase in the numbers of students in Theology and Literature Faculties of universities which are, nowadays, almost in every city, writing activities about Ottoman Turkish have become desirable and a sector has been formed in this field. Many researchers who teach this course started to write an Ottoman Turkish grammar book to use in their own lessons, and this caused the number of Ottoman Turkish publications to increase in the market. According to our findings, grammar books of Turkey Turkish were also written in foreign languages, in late 19th and early 20th centuries. Through writing Turkey Turkish grammar work in German, French, English, Italian, Latin, Hungarian, Russian and Greek, foreign authors aimed to teach Turkish to their own nations. Although all of these works were produced in order to contribute teaching of Ottoman Turkish, efforts to generate solutions for certain problematic issues became a lot more complicated. To illustrate, when case about kaaf (ك) letter, which is the subject of this study, is examined either in grammar books written after 1840s, or in the books written by contemporary researchers, two aspects are noteworthy. One of these is the change in the number of letters forming the alphabet, the other one is the classification and nomenclature regarding kaaf (ك) letter, which effects this number. That Ottoman Turkish consists of three languages and uses Arabic alphabet and vocabulary from three different languages resulted in problems like difference in the number of letters in the alphabet and problems in the articulation of certain letters. It has been determined that one of the reasons why the number of letters in the alphabet is different is directly letter kaaf and that there are problems in both articulation and classification of the letter kaaf used in Arabic, Persian and Turkish words. When the books written on Ottoman Turkish grammar starting from the 19th century until today are analysed, no studies have ever been done either about the changes in the numbers forming the alphabet, or about the classification and articulation problems of letter kaaf (ك) and about the solution offersed to these. In this article, by attracting attention to both the number of letters in the alphabet, and to the classification and articulation problems of letter kaaf (ك), findings regarding the solutions of these problems are presented. The study consists of three main chapters. In the first chapter, the function of various letters is presented and especially the effect of kaaf on the number of letters in Ottoman Turkish alphabet is elaborated and after the analyses, the number of letters is determined. In the second chapter, triplet, quartet and quintet classifications of letter kaaf are examined and its nomenclature and articulations are analysed. In the last chapter, problems about classification and articulation of kaaf are evaluated and a new classification is suggested. Yet, it is obvious that either this classification or the previous ones do not contribute to the question of which sound to use while pronouncing kaaf. Therefore, at the end of the study, some determinations have been made for solving the problem of kaaf’s articulation. (shrink)

The epistemology of śabda is one of the main themes in Bhaṭṭa Jayanta’s Nyāyamañjarī, and, in the hypotheses explored in this paper, also the conceptual basis of Jayanta’s textual re-use. The sixth chapter of the Nyāyamañjarī contains a debate between Vaiyākaraṇas and Mīmāṃsakas who, respectively, advocated an holistic or atomistic theory of language. Selected Jayanta’s re-uses from Vyākaraṇa, Mīmāṃsā, and Nyāya sources are here surveyed and analyzed, with a focus on their meaning and on the context. The method of analysis (...) is partially following Moravcsik’s scheme for a classification of citations, as well as Small’s classification by symbolic functions. By re-using texts Jayanta not only imparted authority to his own arguments, but also reassessed the relation of his tradition with other ones. Re-used ideas and words stand for symbols of those authors’ tenets, and those authors represent symbols of their respective traditions. Moreover, by quoting a certain author Jayanta often anointed him with a symbolic status of trustworthy authority, and his statement with a status of śabdapramāṇa. (shrink)

While classifications of mental disorders have existed for over one hundred years, it still remains unspecified what terms such as 'mental disorder', 'disease' and 'illness' might actually denote. While ontologies have been called in aid to address this shortfall since the GALEN project of the early 1990s, most attempts thus far have sought to provide a formal description of the structure of some pre-existing terminology or classification, rather than of the corresponding structures and processes on the side of the (...) patient. We here present a view of mental disease that is based on ontological realism and which follows the principles embodied in Basic Formal Ontology and in the application of BFO in the Ontology of General Medical Science. We analyzed statements about what counts as a mental disease provided in the research agenda for the DSM-V, and in Pies' model. The results were used to assess whether the representational units of BFO and OGMS were adequate as foundations for a formal representation of the entities in reality that these statements attempt to describe. We then analyzed the representational units specific to mental disease and provided corresponding definitions. Our key contributions lie in the identification of confusions and conflations in the existing terminology of mental disease and in providing what we believe is a framework for the sort of clear and unambiguous reference to entities on the side of the patient that is needed in order to avoid these confusions in the future. By "epistemic qualifiers" I mean concepts expressed by 'I know', 'I think', 'probably', 'possibly', etc., which form parts of things we say. The paper deals with the classification and strength ordering of EQs. A certain type of statement about what makes sense is discussed. The notion of the "contents" qualified is explained and this notion used to define that of an EQ. Schemata of the statements dealt with in are used to classify EQs into three large groups, those (...) resembling the ones expressed by 'I know', 'I think', and 'possibly', respectively. Such schemata are used to define a relation of strength among EQs and it is suggested that this relation partially orders the EQs expressible in English. (shrink)

Definitions can be classified from two different points of view. We can ask what sort of statements definitions are, how they are to be justified, and what purpose they serve in the process of acquiring scientific knowledge. For lack of a simpler word, let us call a classification of definitions from this point of view epistemological. We can also distinguish different forms of definition; and a classification from this point of view is naturally called formal.

Sports organizations face various ethical challenges. To tackle these, ethical codes are becoming increasingly popular instruments. However, a lot of questions remain concerning their effectiveness. There is a particular lack of knowledge when it comes to their form and content, and on the influence of these features on the effectiveness of these codes of ethics. Therefore, we developed a framework to analyze ethical codes and used this to assess codes of ethics in sports clubs from six disciplines. The form and (...) content characteristics of the codes were tested for their impact on the ethical climate of sports clubs. Our results show that most codes focus on the themes of integrity, and on solidarity among the members of sports clubs. Deontological phrasing is dominant in ethical codes in sports clubs. The occurrence of comprehension aids, such as examples, and procedural content, such as the mentioning of sanctions, is low. When it comes to code effectiveness, i.e., the influence on the ethical climate, we see a positive significant effect of the use of consequentialist oriented statements, and of the combination of regulatory and inspirational phrasing. Also the presence of explicit guidelines for the members of the board had a positive significant affect. This shows that codes should be a source of inspiration and stimulate moral awareness, rather than merely guide behavior by simple rules. Other content elements do not influence code effectiveness, suggesting that ethical codes merely have a function of raising ethical awareness in sports clubs. These results help to shed light on what it takes for a code of ethics to become a useful and effective instrument to tackle unethical behavior in sports clubs. (shrink)

Despite the hadiths and narratives that warn about the interpretation of the Qur’ān by opinion, the question of how Qur’ānic verses can be understood is about the nature of Qur’ānic exegesis. These narratives, which limit the interpretation to the exact field and indicate the invalidity of the specification of the intention with the imprecise information, bring with it the question of how to understand the Qur’ān in each period and society. The issue that has been questioned in the frame of (...) the commentary from the earliest periods is based on the possibility of commenting besides the narration and defining the area that the thought belongs to the commentator. In this context, it is seen that the distinction between the conceptualization of tafsīr-taʾwīl words in classical commentary literature deals with the subject of the tafsīr, their belongings, epistemological values and contexts. Mainly, this study will question whether authors who do not distinguish between tafsīr-taʾwīl categorize the information about commentary in a different context, then it will analyze two basic approaches on tafsīr and taʾwīl. In the paper, it will be suggested that these classifications in the classical literature should be evaluated together within the framework of the search for methodology in exegesis. Summary: The Prophet, who was the first glossator of the Qur’ān, forbade people to talk about the Qur’ān with their own judgments. The prominent people of the companions refused to comment on some words that were closed in meaning (garīb). The words quoted from Abū Bakr and ʿUmar on this subject are quite famous. However, the Qur’ān is a universal book revealed to be understood in all ages and geographies till the doomsday. The fact that all the verses were not interpreted by the Prophet, and the expansions of meaning observed in the Qur’ān wording necessitate the interpretation of the Qur’ān. The fact that the Prophet forbade people to talk with their own judgments about the Qur’ān and the necessity of understanding the Qur’ān in every era constitutes a dilemma that must be explained. The resolution of this issue will both determine the legitimacy of tafsīr (interpretation) and reveal the difference between the Prophet's tafsīr and the tafsīrs by other people. In this context, a distinction was made between the interpretations of the Prophet and of the companions who witnessed the revelation period from the Tabarī (d. 310/923) in the classical tafsīr literature and the interpretations by glossators in terms of their bindingness and information values. Thus, before even starting the interpretation, glossators questioned the possibility of interpretation of the Qur’ān without the tafsīr of the Prophet and the narratives from the companions that have the force of hadith marfūʿ.It is seen in classical tafsīr literature that distinctions between the tafsīr of the Prophet and the interpretations of the glossator are usually constructed on the terms of tafsīr and ta'wil, to which terminological meanings are attributed. In this regard, the methodology of Māturīdī (d. 333/944) is quite specific and clear. According to Māturīdī, tafsīr is an exact field. Only the tafsīr of the Prophet and the narratives of the companions that have the force of marfūʿ can be included in this field. Taʾwīl, on the other hand, is an area based on supposing. Preferences to be made from possible meanings are supposition and related to taʾwīl. The fact that Māturīdī included the explanations of the Prophet and his companions in the tafsīr field and stated that they expressed exact information shows that he regarded this information in the value of the statement of mutakallim. The data included in the field of taʾwīl are not as the data included in the field of tafsīr in terms of their bindingness and information value. The interpretations made in the field of taʾwīl include supposition; so they cannot be attributed to the desire of God. The field that the Prophet forbade people from declaring their own views is the field of tafsīr in the methodology of Māturīdī. The exactness of this field is an indication that the tafsīr is related to God's desire. It is not right to declare an opinion with supposition in the field that is exact and definite. Even though the interpretation in the field of tafsīr is in accordance with the truth, this cannot eliminate the responsibility of the interpreter that make determinations based on supposition in the exact and definite field. Some scholars, such as Qushayrī (d. 465/1072), also classify the narrative-sagacity areas by means of tafsīr-taʾwīl concepts. This classification deals with the data that is the subject of tafsīr in terms of their belongingness. Indeed, tafsīr science includes both the data that are linked with transmission and non-transmittable elements that can be achieved by following a methodology. Non-transmittable elements included in the taʾwīl field by those who make a distinction between tafsīr and taʾwīl based on narrative-sagacity are the meanings reached through linguistic efforts. Language is an element that holds possibilities in itself. Considering closeness of meaning, multi-meanings, metaphors and allusions in the wording, it can be thought that the meanings reached by linguistic methods include supposition. In the methodology of Māturīdī, the field of tafsīr is composed of the explanations of the Prophet and the narratives of the companions who witnessed the revelations while in the classifications of those who make a distinction between tafsīr and taʾwīl based on narrative-sagacity, tafsīr generally includes narratives. When the issue is handled within the framework of the desire of God and the statements of the mutakallim, it seems that the classification of Māturīdī is more punctual. However, it is understood that this approach does not give a satisfactory answer to the subsequent situations and bindingness of the mentioned data. In the classifications based on narrative-sagacity, the narratives in the field of tafsīr are taken as a whole without analyzing their health grades and their signification. However, some of these narrations are not authentic; so, in this respect it is a problematic issue that they are the subjects of the field of tafsīr. Besides, sometimes there can be different narrations about the tafsīr of verses from the companions. The evaluation these narratives in a field attributed to the desire of God may also pose a problem. The linguistic data that both Māturīdī and those who make a distinction between tafsīr and taʾwīl based on narrative-sagacity include in the field of taʾwīl does not appear to have a homogeneous structure -as is the case with the narratives-. Indeed, among this data, there are elements whose meanings are quite hard to determine as well as firm ones that possibly have only one meaning. It is controversial that these expressions, which have only one meaning and to the validity of whose meaning other evidence point out are included in the field of taʾwīl.The distinction between meaning and interpretation fields in tafsīr is very important in terms of tafsīr methodology. This field designation is in a way a description of nature of the science of tafsīr. Thus, in matters where the human intelligence remains insufficient with the tafsīr narratives from the Prophet, the bindingness of the narratives from the companions are clarified; furthermore, beyond the narrative, the validity and the information values of interpretations of the glossator are determined. In this regard, the tafsīr-taʾwīl distinctions made in the classical tafsīr literature provide us with a rich content and a multifaceted point of view. However, when addressed separately, these distinctions present a number of problems in terms of scope and applicability. Our study proposes the evaluation of tafsīr-taʾwīl distinctions in classical literature together while the meaning-interpretation fields are specified in the framework of the search for methodology in tafsīr. Thus, the incomplete aspects of the classification will be eliminated and a much more comprehensive and functional classification will be achieved. At this point, the methodologies of some figures as Tabarī, who is known to have used the terms of tafsīr and taʾwīl in the same meaning, must also be evaluated separately. Indeed, when the works of these names are analyzed, it is seen that these names also distinguish the meaning-interpretation fields in tafsīr, but they do not do this through the tafsīr-taʾwīl concepts. During the last hundred years medical language has been influenced by scientific and technological progress. As a result uncertainty in medical communication is increasing. This may have serious consequences not only for health care delivery but also for medical science. Disease classification, assessment of the validity of epidemiological investigations and comparison of the results of various investigations are examples of what will become less secure. The purpose of the article is to emphasise a main source of uncertainty — the (...) problem of interpreting definitions. Two issues of interpretation are explored. One concerns the logical status of a statement and the other the function of a statement. It is concluded that the security of medical language can be increased through the elucidation of the logical status and functions of statements making up medical concepts. (shrink)

Dār al-Funūn Theology founded in 1924 was a modern educational institution which adopted both traditional and modern approach to Islamic Sciences. The changes in the field of hadīth during the process of transition to the university caused a change in the definitions and the titles of the courses such as from hadīth al-sharīf and usul al-hadīth to hadīth and the history of hadīth and the time allocated to each course was gradually reduced. The preparation of the texts by the teachers (...) in the hadith history courses and their content will answer the question of whether there is a transformation in the field of hadīth in the early years of the Republic of Turkey. As a matter of fact, Izmirli İsmāʿīl Ḥaqqī’s History of Ḥadīth and Ḥuseyin ʿAvnīʿ Arapkīrli’s al-Buġya al-Hasîs fī Tārīh al-Hadīth which were written in this period, pioneered the studies based on the field of the history of hadīth in Turkish hadīth literature. In addition, these works are the main source in understanding the period. In this study, the mentioned works will be textually analysed through the induction method. Therefore, the subjects that would reflect the ideas of the teachers will be discussed. Thus, it will be tried to determine whether the courses of the history of hadīth are closer to tradition or modern ideas and, how the education of hadīth is practised.Summary: After the foundation of the Turkish Republic in 1923, the Faculty of Theology was opened at Istanbul University as a result of the abolition of madrasas issuing a law regarding to the Unification of Education announced in 1924. With the opening of this faculty, the education in the field of Religious Sciences continued its presence on a new foundation, which can be considered modern, until 1933. In this study, it was attempted to trace the courses of Ḥadīth and the History of Ḥadīth given in the Faculty of Theology at Istanbul University between 1924 and 1933. Firstly, a brief history of the courses will be given, and then it is among the purposes of this study to perform a textual analysis of the works written by the teachers of these courses. While doing this, Izmirli Ismail Hakkı's History of Ḥadīth, which was written as course notes and Huseyin Avni Arapkirli's al-Buġya al-Hasîs fī Tārīh al-Hadīth, which has not been known until discussed it this article for the first time, were focused on. These works are very important in terms of initiating the History of Ḥadīth literature. Furthermore, these are the first works in the field of hadīth in the Turkish Republic, and they are very important sources for revealing the ideological infrastructure of the period. To begin with, it is necessary to attract attention to the change in the course names and duration if there is a need to briefly mention the history of hadīth courses in University. In the universities founded before the opening of the Faculty of Theology, the courses were named as Ḥadīth al-sharīf and usul al-hadīth. Besides, these courses were included in the curriculum for four years, which constituted the duration of the education. In the university founded in 1924 after the proclamation of the Republic, the name was changed as Ḥadīth and the History of Ḥadīth. It is seen that the courses of Hadīth and the History of Hadīth were taught three hours a week for two years from the opening of the Faculty of Theology until 1931. From 1931 until 1933, when the faculty was closed, the courses continued to be given two hours a week. When the content of the works is viewed, it can be seen that Izmirli İsmāʿīl Ḥaqqī followed a historical system in his work History of Ḥadīth. Beginning the subject with the classification of sciences, Izmirli touches upon the topics such as the writing and codification of hadīths. Afterwards, he also deals with the methodology of in detail. He then mentions about the history of hadīth by Shiʿā and draws a general map of the history of hadīth as of the third century of the Islamic calendar. This work differs from the previous tradition of the education of hadīth in terms of including the Shiʿā’s the history of hadīth and especially of ahl al-raʾy’s understanding of the hadīth. In addition, the detailed discussion of hadīth practice in the work is significant in terms of showing that the content of the course did not only cover the history of hadīth.Moreover, it is observed that Izmirli touched upon controversial topics in his work such as the writing of hadīth, Bukhari's criticism and hadīth-history relation. However, Izmirli does not express his approach to these topics so clearly. In doing so, he hides his views between lines, using ambiguous statements related to the topics while trying to base the views on authority. For instance, he says that the hadīths were written on the special pages of the companions in the early periods when it comes to writing hadīths, which was one of the most important topics of the history of hadīth. Even though this gives an impression that the hadīths were written in the companion period, it is stated in the following explanations that the hadīths had not been gathered and written down in one place. Izmirli also says that they refer to the hadīths in the hearts of the companion. In another example, he mentions that there is no doubt about the accuracy of the narrations in Bukhārī's work. However, in the following pages, he states that there are narrators, who are not trustworthy, in Bukhārī's work and says Dāraqutnī's criticisms related to Bukhārī. When the aforementioned two examples are examined, it can be stated that Izmirli acted a bit more cautiously especially in controversial topics. When it comes to Ḥuseyin ʿAvnīʿ Arapkīrli, who starts his work with the classification of sciences as Izmirli does, it is seen that he discusses the part of practice much more briefly. Additionally, he gives more attention to Prophet Muhammad and companion period of the hadīth history. In his work, he also provides detailed information about the formation of the hadīth literature in the third century of the Islamic calendar and afterwards. When the issue is reviewed within the scope of the topics discussed by Ḥuseyin ʿAvnīʿ in his work, it is necessary to mention that the topics related to the history of hadīth were more dominant in the work. Unlike Izmir, he does not allocate much space to controversial topics in his work. However, it should also be noted that he partly touched upon some controversial topics such as hadīth -history relation and writing of hadīths. Ḥuseyin ʿAvnīʿ considers the history of hadīth as a sub-heading of history. Regarding the writing of hadīths, he states openly that the hadīths generally were not written down because of the possibility for them to be mixed up with the Qur’ān in the early periods, and this continued until the time of caliphate ʿÖmer bin ʿAbd al-ʿAzīz. Thus, it can be said that both writers, who applied different methods in their works, looked for a new method. However, it should be remembered that these names were a part of the Ottoman educational system and included in a new system together with their background. In this monograph Nicholas Georgalis further develops his important work on minimal content, recasting and providing novel solutions to several of the fundamental problems faced by philosophers of language. His theory defends and explicates the importance of ‘thought-tokens’ and minimal content and their many-to-one relation to linguistic meaning, challenging both ‘externalist’ accounts of thought and the solutions to philosophical problems of language they inspire. The concepts of idiolect, use, and statement made are critically discussed, and a classification of kinds (...) of utterances is developed to facilitate the latter. This study aimed to examine the thoughts and expectations of patients receiving healthcare from their physicians and evaluate the ethical aspects of these thoughts and expectations. To determine the ethical aspects of the thoughts and expectations of patients, an open-ended question was asked on the web page of the Turkish Armed Forces (TAF) Health Care Command, which is accessible to the users of the TAF intranet system (the internet system used within TAF institutions). The participants were asked to express their (...) thoughts in their own words. A total of 804 participants answered the question by providing their input. The statements of the participants were classified separately by two public health specialists. The classification was made in accordance with the basic principles of patient rights, and they were collected under various headings including expectations about respect and care, good communication, informed consent, and fair and non-privileged distribution of healthcare services. The results show that patients tend to consider the physicians they see as solely responsible for all the negative issues that they encounter during their healthcare. This indicates that there is a need for extensive research on the underlying factors involved in the negative thoughts and feelings toward healthcare professionals in both TAF and Turkey in general. Sports organizations face various ethical challenges. To tackle these, ethical codes are becoming increasingly popular instruments. However, a lot of questions remain concerning their effectiveness. There is a particular lack of knowledge when it comes to their form and content, and on the influence of these features on the effectiveness of these codes of ethics. Therefore, we developed a framework to analyze ethical codes and used this to assess codes of ethics in sports clubs from six disciplines. The form and (...) content characteristics of the codes were tested for their impact on the ethical climate of sports clubs. Our results show that most codes focus on the themes of integrity, and on solidarity among the members of sports clubs. Deontological phrasing is dominant in ethical codes in sports clubs. The occurrence of comprehension aids, such as examples, and procedural content, such as the mentioning of sanctions, is low. When it comes to code effectiveness, i.e., the influence on the ethical climate, we see a positive significant effect of the use of consequentialist oriented statements, and of the combination of regulatory and inspirational phrasing. Also the presence of explicit guidelines for the members of the board had a positive significant affect. This shows that codes should be a source of inspiration and stimulate moral awareness, rather than merely guide behavior by simple rules. Other content elements do not influence code effectiveness, suggesting that ethical codes merely have a function of raising ethical awareness in sports clubs. These results help to shed light on what it takes for a code of ethics to become a useful and effective instrument to tackle unethical behavior in sports clubs. (shrink)

In 2018, three journalists accused one of the Members of the Russian Parliament of harassment at workplace. Many influential persons of the Russian elite engaged themselves in the public discussion of the conflict. We studied that high-profiled discussion using a hybrid method merging human- and logic-oriented approaches in argumentation studies. The method develops ideas of the new dialectics, the argumentation logic and the logical-cognitive approach to argumentation, on which is based the algorithm for determining of dispute resolution by aggregating formal (...) and informal tools of analysis. We have reconstructed the discussion as two disputes about questions A and B. A: Did the MP violate the code of conduct by making statements or actions against the journalists? B: Are actions like the behavior of the MP harassment? The opinions of the discussion participants were grouped into the four points of view: A1 – the MP did not violate the code of conduct, A2 – the MP violated the code of conduct, B3 – the actions are not harassment, B4 – the actions are harassment. We mapped arguments in support or against each of them using OVA software, evaluated the arguments with the help of the critical questions, a tool proposed in the new dialectics, and determined the ultimate A + B resolution by applying of the algorithm that combines elements of gradual and labelling semantics from the argumentation logic and the classification of disputes from the dialectical approaches. The resolution was a subset of four arguments that ensured the victory of A1+B4. However, the substantial incompatibility of those arguments highlighted a deep disagreement, an unresolvable difference of opinion, between the parties about the permissibility of courtship. The deep disagreement, a bonus result yielded by the application of the hybrid method, excluded the interpretation of the determined resolution as convincing for the parties, but pointed out a way to smooth the difference of opinions by elaborating of legal, social and moral aspects of the problem of harassment at workplace. In the article, referring to the method of rational reconstruction described by R. Rorty, an analysis of some works of J. Locke has been made in order to identify new prospects in John Locke's philosophy researches. As a result, it’s been demonstrated the presence of silence as an argument and a manifestation of respect J. Locke’s research of realms of cognition, political philosophy and philosophy of education. This is not covered in modern John Locke's philosophy researches. The authors emphasize that (...) J. Locke, although not directly exploring silence as an argument, however, describes the argument ad ignorantiam, the wording of which in the work «An Essay Concerning Human Understanding» and his understanding of tacit consent in the work «Two Treatises of Government» are related to silence as an argument and a manifestation of respect. The position that silence as an argument is present in all four arguments (argumentum ad verecundiam, argumentum ad ignorantiam, argumentum ad hominem, argumentum ad judicium) described by J. Locke is substantiated. Additionally, the argument ad ignorantiam can be considered both as an argument from silence (ex silentio argument) and as a kind of argument to silence. Considered arguments can serve as an argument to silence for the proponent and/or the third party, that is, anyone who is not directly involved in the dispute. Basing on J. Locke's explanation of the characteristic feature of tacit consent, that is, the absence of the expressed consent/disagreement, the possibility of distinguishing the indirect connection between tacit consent and the argument ad ignorantiam is demonstrated, since both tacit consent and the argument ad ignorantiam in J. Locke's works rely on the absence of expressed statements on the consent or disagreement of the opponent. It is established that the ideas of the education of children described by J. Locke also correlate with silence as an argument and a manifestation of respect. Applying the classification of the types of respect proposed by S. Hudson and complemented by R. Dillon to the use of the term «respect» to the various texts of J. Locke, it is substantiated that described by him respect covered almost all kinds of this classification. (shrink)

Around the turn of the 20th century, Keynes and Johnson extended the well-known square of opposition to an octagon of opposition, in order to account for subject negation (e.g., statements like ‘all non-S are P’). The main goal of this paper is to study the logical properties of the Keynes-Johnson (KJ) octagons of opposition. In particular, we will discuss three concrete examples of KJ octagons: the original one for subject-negation, a contemporary one from knowledge representation, and a third one (...) (hitherto not yet studied) from deontic logic. We show that these three KJ octagons are all Aristotelian isomorphic, but not all Boolean isomorphic to each other (the first two are representable by bitstrings of length 7, whereas the third one is representable by bitstrings of length 6). These results nicely fit within our ongoing research efforts toward setting up a systematic classification of squares, octagons, and other diagrams of opposition. Finally, obtaining a better theoretical understanding of the KJ octagons allows us to answer some open questions that have arisen in recent applications of these diagrams. (shrink)

Lee and Baskerville (2003) attempted to clarify the concept of generalization and classify it into four types. In Tsang and Williams (2012) we objected to their account of generalization as well as their classification and offered repairs. Then we proposed a classification of induction, within which we distinguished five types of generalization. In their (2012) rejoinder, they argue that their classification is compatible with ours, claiming that theirs offers a ‘new language.’ Insofar as we resist this ‘new (...) language’ and insofar as they think that our position commits us to positivism and the rejection of interpretivism, they conclude both that our classification is more restrictive than theirs and also that we embrace ‘paradigmatic domination.’ Lee and Baskerville’s classification of generalization is based on a distinction between theoretical and empirical statements. Accordingly we will first clarify the terms ‘theoretical statement’ and ‘empirical statement.’ We note that they find no fault with our classification of induction, we re-state our main objections to their classification that remain unanswered and we show that their classification of generalizing is in fact incompatible with ours. We argue that their account of generalization retains fatal flaws, which means it should not be relied upon. We demonstrate that our classification is not committed to any paradigm and so we do not embrace ‘paradigmatic domination.’. (shrink)

This system or collection of ideas covers Peirce's writings from 1867 to 1905.1 During this period of his long philosophical career from 1857 to 1914, Peirce wrote his (...) most important papers on the logic of science and probability. ~ These papers, though only a minor portion of Peirce's philosophical works, constitute a self-explanatory unit of study, simply because they deal with one single subject: the validity of synthetic inference. In the year 1867, Peirce wrote his paper "On the Natural Classification of Arguments," which provides a natural introduction to his treatment of inference and its validity in syllogistic terms and to his trichotomy of inference into deduction, induction, and hypothesis. Through the year 1877 to 1878, Peirce wrote a series of papers on "Illustrations of the Logic of Science." Beside the well-known "The Fixation of Belief" and "How to Make our Ideas Clear," there are four other important but comparatively little discussed papers which are essentially concerned with the logic of science and probability. They are in the following order: "Doctrine of Chances" (with corrections, 1893 and notes, 1910), "The Probability of Induction" (with corrections, 1893), "Deduction, Induction, and Hypothesis" (with corrections, 1893), and "The Order of Nature." In these papers, Peirce laid out his rationale for the validity of ampliative or synthetic inference and indicated a justification of induction in terms of probability. But very often his ideas concerning the validity of synthetic inference appear disconnected and do not fit into a consistent, not to say wellorganized, whole. It was not until 1883 that Peirce wrote a comparatively systematic treatise on his general theory concerning the validity of ampliative or synthetic inference. This is his "A Theory of Probable inference," in which we find Peirce's statement of what a probable inference is and his argument that inductive inference is valid on account of its being a probable inference. The reality of spirits? A historiography of the Akan concept of 'mind' (La réalité des esprits: Vers une historiographie de la conception akan de l'esprit). In this article the following thesis is considered: the classifications used to define African Indigenous Religions are 'inventions' of Western scholars of religion who employ categories that are entirely "non-indigenous". The author investigates the presumptions of this statement and discusses the work of scholars of religion studying the Akan and in particular the Akan concept of (...) mind. In the analytic philosophical tradition the precise meaning of Akan concepts of mind such as okra and sunsum, described by various scholars of religion in different eras, are reviewed. The pre-colonial, colonial and the postcolonial era all have had specific influence on the conceptualisation of the mind. On the basis of an historiography of the Akan mind the author concludes that, contrary to the originally thesis under review, 'cultural background' and 'academic discipline' are relatively unimportant in the classification of 'indigenous religions'. The 'paradigm' prevailing within a discipline , 'personal belief' and the spatio-temporal context in which conceptualisations are created, turn out to be far more significant. (shrink)

Traditional classifications of the main schools in the philosophy of mathematics are based upon two questionable presuppositions. First, it is assumed that a realist, who wishes to defend objective truth values of mathematical statements, has to be either a Platonist or a physicalist. Secondly, a constructivist, who regards mathematical entities as human constructs rather than pre-existing objects, has to be either a subjective mentalist or an objective idealist. In contrast to these alternatives and their many variants, this paper argues (...) that it is possible to be a constructivist and a realist at the same time. Mathematical entities are public creations in the human-made domain of abstract artifacts; this domain Karl Popper called World 3. They are not completely transparent to their makers, so that mathematical constructs are full of open problems for us to study. The applicability of mathematics to physical, mental, and social reality can be explained by the Theory of Measurement, which also helps to show what is wrong and what is right with the empiricist approaches to mathematical knowledge. This paper argues that early modern experimental philosophy emerged as the dominant member of a pair of methods in natural philosophy, the speculative versus the experimental, and that this pairing derives from an overarching distinction between speculative and operative philosophy that can be ultimately traced back to Aristotle. The paper examines the traditional classification of natural philosophy as a speculative discipline from the Stagirite to the seventeenth century; medieval and early modern attempts to articulate a scientia experimentalis; and the (...) tensions in the classification of natural magic and mechanics that led to the introduction of an operative part of natural philosophy in the writings of Francis Bacon and John Johnston. The paper concludes with a summary of the salient discontinuities between the experimental/speculative distinction of the mid-seventeenth century and its predecessors and a statement of the developments that led to the ascendance of experimental philosophy from the 1660s. The principal authors are Herbert Simon, N. Rescher, Donald Davidson, and G. H. von Wright. Commentators are R. Ackermann, A. R. Anderson, N. D. Belnap, R. Binkley, H. N. Castañeda, R. Chisholm, J. Robison, and the late E. J. Lemmon. As appendices, there are articles by A. R. Anderson (...) "The Formal Analysis of Normative Systems," and Rescher's very brief scheme for the classifications of "actions" according to five key generic elements. Problems of decision and action are important for all philosophical critique of norms; in ethics, philosophy of science, of the social sciences, and so forth. The task of a comprehensive logic of action is to describe or prescribe the rules that govern reasoning about the occasions for action, the discovery of action alternatives, and the choice of action. In "The Logic of Heuristic Decision Making," Herbert Simon continues to support the view presented in his earlier work, that "ordinary mathematical reasoning, hence the ordinary logic of declarative statements, is all that is required," as relevant imperatives can be brought into normative systems via correspondence rules for conversion of existential statements. In "Semantic Foundations for the Logic of Preference," Rescher starts from the familiar semantical notion of a "possible world," offering the valuation-measure for such worlds as a determinant of preferabilities, and hoping to show that divergent approaches to problems of preference may be reconciled in this way. Davidson's article, "The Logical Form of Action Sentences" analyzes concepts of agency and intentionality. G. H. von Wright sees a logic of change to be necessary in order to formulate a logic of action. We can only offer some preliminary comments, and in spite of anything we have to say, the mere fact that the book contains such a wealth of information justifies for it a permanent place on a bookshelf of a student of medieval thought.The title of (...) PJDS deserves special attention. While we have books on Scotus's theology or particular topics of his thought, there has been no comprehensive study of his "philosophy," seemingly for a good reason: Scotus is clearly a "fundamental" and systematic theologian who simply uses some classic tools of ancient philosophers and some of their texts and ideas as material for his own discussions. So first of all one needs to determine what constitutes "philosophy" in such a case. V. devotes considerable attention to this question, but unfortunately only at the very end of the study, in Part III, which constitutes almost a separate monograph on the historiography of the debate about "medieval philosophy" and Scotus's role in it. Dichotomizing medieval thought into "philosophy" and theology in recent debates comes from the post-Enlightenment habit of seeing "philosophy" , as opposed to "theology," as something positive in itself. In Chapter 14 V. makes a good observation that "philosophy" and "theology" in ancient and medieval thought are simply two systems that can be coherent in themselves but differ fundamentally as far as their premises are concerned. Using the terminology of contemporary hermeneutical-postcritical analysis, one could say that both disciplines are intratextual systems, with their own internal logic but with different "starting points," opened to a conversation ad extra to various degrees. The classification "intratextual system" based on a solid theoretical foundation in the hermeneutical-postcritical tradition would eliminate the unnecessary dichotomy in ancient and medieval thought. Indeed, it is difficult to see why some of Plato's, Aristotle's or Stoic texts should be classified as "philosophy," not to mention those of Plotinus and Proclus that are often clearly "theology." As a whole, V.'s verdict is that Scotus has his own coherent system of thought based on contingency, as opposed to the "necessitarianism" of ancient philosophers. As for the role of "philosophy," V.'s analysis of recent scholarship shows that "medieval philosophy" is often understood as the logical tools in the service of theology: the interpretation that explains the recent interest in the fourteenth-century thought where those tools were best developed.The book in general is quite readable, despite occasional infelicities in the English and some typos. V. employs a variety of styles, from purely scholarly, which includes a straightforward exposition of relevant texts, with some analysis of the diachronic development of issues, to more literary, ornate and emotional. Similarly varied is his presentation of issues: from dry exposition to creating prolonged "mystery plots" that lead to "discoveries." Unfortunately there is also some unevenness in the text flow: from very smooth to abrupt transitions from one statement to another .Although the book will definitely benefit a variety of readers, the exact readership is difficult to pinpoint. Some sections, such as the extended discussion of distinctions and relations in the section on logic, presuppose a very basic audience; often much of the material from previous sections is repeated . Yet other sections presuppose a rather sophisticated reader who is familiar with the context of the discussion and is able not only to follow but also anticipate the author's train of thought.PJDS provides an excellent coverage of Scotus's work, with one notable exception: the Reportatio tradition. The study of film adaptations, particularly those coming from literature, has been growing at a rapid rate during the last years due to the amount of adaptations coming from both mainstream and independent film industries. The focus of these studies though is generally addressed to best sellers where the literary style is clearly adaptable to the screen; however, there are cases where the adaptive process has resulted in an entirely different outcome. Naked Lunch, written by William Burroughs and adapted to (...) screen by David Cronenberg, represents a bold change if compared with other novels turned into films. The purpose of this article is to descriptively analyse the literary style in order to understand how it has been represented and adapted into Cronenberg’s film. The analysis will be performed helped with computer-based tools to support statements, using the novel itself as corpus and adding theoretical ideas from Leech and Short’s perspectives. The results suggest that the author’s corrosive, sexually-fuelled claustrophobic style has been translated following three patterns in terms of adaptation theory, although Burroughs, in the hands of Cronenberg, becomes an almost new classification of adaptation, not only adding literary features to the film, but also distinguishable core moments of the writer’s life to the final product. The analysis conducted encourages the study of other uncommon adaptations from literary authors in order to understand the adaptive process followed by filmmakers. (shrink)

I found persuasive Gaete’s claim that the concept of ‘mental disorder’ is best understood as nontheoretical and nontechnical. I also find compelling his argument that a previous contribution of my own—which relied in (...) part on specifying different senses of ‘disorder’ in psychological, physiological, and social cases—was misguided. Further, his suggestion that we ought at least to attempt analysis in terms of necessary and sufficient conditions before we seek out less definitive characterizations (in terms of family resemblances) also persuades me, although I find myself less sanguine than he about the general possibility of achieving such analyses.One of Gaete’s principal claims is that mental disorder is helpfully understood in terms of an absence of a capacity—that is, as a disability. There are two related objections—or two aspects of the same objection—that I would like to offer the author with respect to this claim. These may well not be conclusive, but will I hope at least function as foils against which the author can usefully sharpen his argument. One objection suggests that there is a viable distinction between the concepts of mental disorder and mental disability, as commonly used in clinical contexts, which the account offered seems unable to respect. The second suggests that the account may not be able to theorize what is argued to be the essential contribution of the concepts of order and disorder (as opposed to ability and disability) to the everyday concept of mental disorder. Accordingly, it questions the power of a disability approach such as Gaete’s to capture the essential nature of mental disorder.In his paper, Gaete classifies mental retardation and developmental, or (what in the United Kingdom are known as) learning, disabilities (autism, etc.) as cases of mental disorder. I found this surprising because it is not common linguistic practice in the psychological circles in which I operate. It would also seem to make a nonsense of commonly accepted ideas like: “Mental disorders are more likely to occur in patients with developmental disabilities (e.g., in autism, Asperger, or Down syndrome) than in the general population.” (For an example, see Campbell and Malone [1991]). On Gaete’s classification, it would appear that people with autism eo ipso have a mental disorder, and [End Page 341] hence the commonly accepted idea would need to be interpreted as merely a statement about comorbidities of different disorders of the same general (i.e., mental) type. But that is not, I believe, how the term is commonly used, and Gaete’s suggestion must therefore be treated as revisionary rather than descriptively analytical.One way of reconstructing a rationale underlying the distinction between mental disabilities and mental disorders is as follows. A developmental disability involves a failure of (certain aspects of) the mind to grow and reach an expected level or type of organization. A mental disorder by contrast involves a disturbance or disorganization (not simply an impoverishment) within the mind at whichever level of organization it has reached. As the mind develops, and reaches new levels or types of organization, the forms which mental disorders may take accordingly change.Autism and schizophrenia provide helpful illustrations of this distinction. The subject of this paper is the issue of human speech in Aristotle, especially in his work Categories. Its primary goal is to elaborate an interpretation of Aristotle’s statements about human speech as a quantity (Cat. 4b20–b39, 5a15–b2) that would allow them to fit reasonably into the whole of Aristotle’s theory of language. The structure of the paper is as follows. In the first part a certain approach to the question of the reconstruction of Aristotle’s theory of language is (...) proposed. The second part, by means of the introduction of the criteria of separability and ontological priority of the first substance, creates a framework for the subsequent analysis of the two basic classifications, which constitute the main theme of Categories. The third part supplies its own interpretation of the ontological status of human speech in the context of the classification schemes in Categories, and this, in the fourth part, is inserted into the greater whole of Aristotle’s theory of language. The paper explicates the stages of the author’s philosophical evolution in the light of Kopnin’s ideas and heritage. Starting from Kopnin’s understanding of dialectical materialism, the author has stated that category transformations of physics has opened from conceptualization of immutability to mutability and then to interaction, evolvement and emergence. He has connected the problem of physical cognition universals with an elaboration of the specific system of tools and methods of identifying, individuating and distinguishing objects from a scientific theory domain. The (...) role of vacuum conception and the idea of existence (actual and potential, observable and nonobservable, virtual and hidden) types were analyzed. In collaboration with S.Crymski heuristic and regulative functions of categories of substance, world as a whole as well as postulates of relativity and absoluteness, and anthropic and self-development principles were singled out. Elaborating Kopnin’s view of scientific theories as a practically effective and relatively true mapping of their domains, the author in collaboration with M. Burgin have originated the unified structure-nominative reconstruction (model) of scientific theory as a knowledge system. According to it, every scientific knowledge system includes hierarchically organized and complex subsystems that partially and separately have been studied by standard, structuralist, operationalist, problem-solving, axiological and other directions of the current philosophy of science. 1) The logico-linguistic subsystem represents and normalizes by means of different, including mathematical, languages and normalizes and logical calculi the knowledge available on objects under study. 2) The model-representing subsystem comprises peculiar to the knowledge system ways of their modeling and understanding. 3) The pragmatic-procedural subsystem contains general and unique to the knowledge system operations, methods, procedures, algorithms and programs. 4) From the viewpoint of the problem-heuristic subsystem, the knowledge system is a unique way of setting and resolving questions, problems, puzzles and tasks of cognition of objects into question. It also includes various heuristics and estimations (truth, consistency, beauty, efficacy, adequacy, heuristicity etc) of components and structures of the knowledge system. 5) The subsystem of links fixes interrelations between above-mentioned components, structures and subsystems of the knowledge system. The structure-nominative reconstruction has been used in the philosophical and comparative case-studies of mathematical, physical, economic, legal, political, pedagogical, social, and sociological theories. It has enlarged the collection of knowledge structures, connected, for instance, with a multitude of theoreticity levels and with an application of numerous mathematical languages. It has deepened the comprehension of relations between the main directions of current philosophy of science. They are interpreted as dealing mainly with isolated subsystems of scientific theory. This reconstruction has disclosed a variety of undetected knowledge structures, associated also, for instance, with principles of symmetry and supersymmetry and with laws of various levels and degrees. In cooperation with the physicist Olexander Gabovich the modified structure-nominative reconstruction is in the processes of development and justification. Ideas and concepts were also in the center of Kopnin’s cognitive activity. The author has suggested and elaborated the triplet model of concepts. According to it, any scientific concept is a dependent on cognitive situation, dynamical, multifunctional state of scientist’s thinking, and available knowledge system. A concept is modeled as being consisted from three interrelated structures. 1) The concept base characterizes objects falling under a concept as well as their properties and relations. In terms of volume and content the logical modeling reveals partially only the concept base. 2) The concept representing part includes structures and means (names, statements, abstract properties, quantitative values of object properties and relations, mathematical equations and their systems, theoretical models etc.) of object representation in the appropriate knowledge system. 3) The linkage unites a structures and procedures that connect components from the abovementioned structures. The partial cases of the triplet model are logical, information, two-tired, standard, exemplar, prototype, knowledge-dependent and other concept models. It has introduced the triplet classification that comprises several hundreds of concept types. Different kinds of fuzziness are distinguished. Even the most precise and exact concepts are fuzzy in some triplet aspect. The notions of relations between real scientific concepts are essentially extended. For example, the definition and strict analysis of such relations between concepts as formalization, quantification, mathematization, generalization, fuzzification, and various kinds of identity are proposed. The concepts «PLANET» and «ELEMENTARY PARTICLE» and some of their metamorphoses were analyzed in triplet terms. The Kopnin’s methodology and epistemology of cognition was being used for creating conception of the philosophy of law as elaborating of understanding, justification, estimating and criticizing legal system. The basic information on the major directions in current Western philosophy of law (legal realism, feminism, criticism, postmodernism, economical analysis of law etc.) is firstly introduced to the Ukrainian audience. The classification of more than fifty directions in modern legal philosophy is suggested. Some results of historical, linguistic, scientometric and philosophic-legal studies of the present state of Ukrainian academic science are given. (shrink)

Problem’s statement. This article is the result of a study of the historical context in which Isidore of Seville is inserted as an author, as the creator of a unique method, which became the result of his hard work. But in order to describe the method of Isidore of Seville, it is necessary to outline the range of problems that arise before us. Due to serious political and social upheavals in the Western Roman Empire, the preservation of education comes to (...) the fore. The need for “Christianization,” on the contrary, fades into the background. The authors of this period perceived the works of the church fathers and apologists as a legacy, as part of tradition. On the other hand, representatives of the intellectual culture of the era under consideration were part of the aristocracy of Roman (in the broad sense) origin and in this sense, like their predecessors, were bearers of ancient education and culture.The purpose of the study. Analyze the historical context in which the method of Isidore of Seville developed and to consider the influence of the method of Isidore of Seville on the development of knowledge and ideas in the dark ages.Methods. To achieve the goal of the study, a number of general and specific methods were used that contributed to the study of the creative heritage of Isidore of Seville: the etymological method used in the practice of Isidore for the classification and origin of sciences and arts; togoria method for understanding the symbolism of medieval language and judgments; historical-retrospective, contributing to the study of the contribution of Isidore of Seville to European education from the first monastic schools to the formation of universities; terminological selection – for the purpose of selecting, clarifying and modernizing the system of individual terms used in the educated circles of Visigothic Spain; reconstruction – to reproduce the events of the cultural and historical process on the Iberian Peninsula during the Visigothic Kingdom.Results. The reception of the ancient heritage in the works of the authors of this era – and these are primarily Boethius, Cassiodorus and Isidore of Seville – occurs in a different vein than that of the church fathers (Ambrose, Jerome and Augustine) and the German kings of the Carolingian revival. This question concerns a narrower issue that is discussed in the article, and it is connected with Isidore as the author. Isidore of Seville (560-636) is known primarily as an encyclopedist, indicating the wide coverage of topics in his works, on the other hand, in a certain way characterizes the level of these works.However, Isidore was not only and not so much an antiquarian – a collector of ancient knowledge. If we use the “intellectuals and power” scheme, then Isidore was, so to speak, an intellectual in power. He occupied the position of bishop of Seville (the episcopal rank was considered the best conclusion for the cursus honorum even in the 5th century, his authority significantly exceeded the authority of the constantly changing Visigothic kings of Spain. Isidore presided over the IV Council of Toledo (633), whose priests formulated an order with its significant the influence of the episcopate on public affairs.We can say that Isidore, through his works, in a certain sense constructed an ideology. (or what might be called ideology) and the educational program inextricably linked to it.Discussion. First, the era of the “Dark Ages” is a period of permanent military-political struggle between the local nobility and kings, the German kingdoms and Byzantium, which occurred as a result of the height of the Western Roman Empire. The second question is religion, since there were several religions in the territory of the Visigothic kingdom; Christianization of culture and education and, as a consequence, a contradiction with ancient philosophy. Hence the problem of preserving and transmitting knowledge. It was these reasons that complicated the creation of a high-quality educational system. Thirdly, Isidore was not a methodologist, but created a unique method, he was not a scientist, but wrote an encyclopedic work, was not a philosopher, but wrote about philosophy, distinguished it from dialectics, constructed a certain type of knowledge of the real world known to him, was not even a philologist, but he knew Visigothic, Latin, Greek, and Hebrew.How did Bishop Isidore create an effective method? Fourth, after the authors of the “Golden Age” of patristics in the 6th–7th centuries. A new generation is emerging, which is faced with slightly different tasks. How does Isidore “construct” knowledge and what impact has his work had on society? Another important problem is the question of the scale and nature of Isidore’s influence on the intellectual culture of the Middle Ages. At the same time, special attention was paid to “etymologies, or principles,” its distribution, influence on the presentation of the seven liberal arts, etc. On the significance of Isidore’s method for medieval education.Conclusions. The method of Isidore of Seville was an important contribution to the preservation and transmission of knowledge in the Middle Ages and influenced the further development of encyclopedic knowledge. Necessity can be ascribed not only to propositions, but also to feelings. In the Critique of Judgment (KdU), Immanuel Kant argues that a feeling of beauty is the necessary satisfaction instantiated by the ‘free play’ of the cognitive faculties, which provides the grounds for a judgment of taste (KdU 5:196, 217-19). In contradistinction to the theoretical necessity of the Critique of Pure Reason and the moral necessity of the Critique of Practical Reason, the necessity assigned to a judgment of taste (...) is exemplary necessity (KdU 5:237). Necessity can also be assigned by employing the de re/de dicto distinction, namely, by ascribing entailments of what must necessarily hold to either a thing (de re) or to a proposition (de dicto). Although Kant does not use the distinction in any of the three Critiques, this omission has not prevented Kant scholars from applying the distinction in their analyses of the first two Critiques. In this paper, I examine the role that modality plays in Kant’s third Critique and I attempt to bring the de re/de dicto distinction to bear on Kant’s famous aesthetic theory. Ultimately, I perform a retrospective classification of the modality of taste by arguing that because a judgment of taste is not a statement about an objective fact, a judgment of ‘x is beautiful’ can only be read as de dicto necessary. The constantly accelerating progress of contemporary natural science is indissolubly associated with the development and use of mathematics and with the processes of mathematical modeling of the phenomena of nature. The essence of this diverse and highly fertile interaction of mathematics and natural science and the dialectics of this interaction can only be disclosed through analysis of the nature of theoretical notions in general. Today, above all in the ranks of materialistically minded researchers, it is generally accepted that theory possesses (...) a value of its own. Contrary to positivist concepts of the nature of our knowledge, the meaning and significance of theory do not consist merely of the recording of experimental data, their classification and notation in abbreviated form. The meaning of theory is considerably more significant and is revealed, above all, in its explanatory and predictive functions. Contemporary theoretical knowledge is quite advanced and comprises a highly complex system, relatively self-contained and capable of internal development. Mathematics is the most interesting and distinctive phenomenon in the system of theoretical knowledge, in the system of science in general. It is in its dialectical development that the internal force and dynamics of the development of theory, in the very broadest sense of that word, find expression. Paul Lafargue tells us that Karl Marx held that "science only attains perfection when it succeeds in making use of mathematics" . In many fields of research the formulation of new ideas and concepts rests upon mathematics, its concepts and notions, and "is suggested" by the latter. "Mathematics," writes F. Dyson, "is the main source of the notions and principles out of which new theories are created" . The basic significance of mathematics to theory has been noted by outstanding thinkers over the course of the entire history of development of science. Today the expressive phrase, "the mathematization of knowledge," has come into general currency as a description of the principal direction of growth of theoretical notions in natural science. However, with respect to the growth of modern theoretical physics in general, the statement that it develops primarily by the method of the mathematical hypothesis has general validity. For example, the principal findings and discoveries of quantum theory and particle physics, starting from the corpuscularwave dualism and terminating with the omega minus hyperon and hypothetical quarks, were obtained or made "at the tip of a mathematician's pen.". This paper argues that the metaphysics of financial performance in the conceptual framework employed by accounting standard-setters is incoherent: income and expenses cannot, as the framework holds, both be independent elements of financial statements, identified from underlying events, tested for recognition and measured by discrete acts, separately from the identification, testing and measurement of other elements and satisfy the analytical relationship between performance and position embraced by the framework. An alternative conceptualisation is proposed, under which income and expenses are (...) part of a wider system of classifying all changes in assets and liabilities, measured indirectly. This approach improves the metaphysical coherence, and thus the intellectual strength, of the framework project; while it leaves the measurement of financial performance unchanged, by emphasising the importance of classification, it invites further attention to the presentation of financial performance, with the potential for improving the usefulness of disclosures. Explore the major ideological patterns of development of a socially philosophies of education in the context of the problems of institutionalization of knowledge about human and social development. To analyse system-integration aspect of social philosophy and education management in interaction of concepts of an instrumentalism of a pragmatism and a neopragmatism with model of «new humanism» in formation of socially valuable orientations. Methodology. Classification existing in the western philosophy of education and education of directions is spent, proceeding (...) from basic principles of philosophical school or a current, first of all considering those the purpose and means which are really involved by them in process of education, social development and socially-moral education and being based on the basic installations, the purpose expressed by that or other direction, how its supporters imagine the person, its requirement, a social role, модус behaviour which the education system and education urged to form. Scientific novelty. In conditions when against crisis of an education system of the government of the USA and the leading countries of Europe are compelled to begin its long-term reform, its theorists substantially pay attention to democratic workings out of concepts of an instrumentalism of a pragmatism/neopragmatism in modern social philosophy of education, in particular on their aspiration to introduce in process of social development, education and education idea and practical model both educational, and a social equality. Considering growing requirement of a practical embodiment of ideas of freedom, justice, aspiration to realization of the human rights proclaimed a society, supporters of the concept of «new humanism» see the main objective in blocking a way to conformism, to a manipulation behaviour of the person and to create conditions for its free self-expression, for realization by the person of a fundamental choice of acts in a concrete situation and by that to warn danger of formation of the unified form of behaviour. In it principles of «new humanism» approach with a position of «new humanism» instrumentalism and neopragmatism. Conclusions. Before social philosophy of education/education it is necessary to define a problem factors which cause achievement of its main objective, to state an estimation to moral principles and personal qualities with which actually the education/education theory connects realization of the problems, to show, why these, instead of any other principles and qualities open to the person possibility to choose in a concrete situation socially powerful both morally defensible and comprehensible line of conduct in public the relation. Statement of a question on necessity of the philosophical analysis of problems of education and education in a social context serves as an indicator of understanding philosophers, teachers of an increasing role of the human and moral factor in society development. And, at last, the aspiration to develop socially-philosophical bases of pedagogics in general and education in particular, testifies that the western and domestic philosophers, teachers, representatives of social and psychological sciences, at least, the majority of them, have realized the public importance of an education system and education, its global character. In his theory of criticism, D. N. Walton presupposes that an opponent either critically questions an argument, without supplementing this questioning with any reasoning of her own, or that she puts forward a critical question and supplements it with a counterargument, that is, with reasoning in defense of an opposite position of her own. In this paper, I show that there is a kind of in-between critical option for the opponent that needs to be taken into account in any (...) class='Hi'>classification of types of criticism, and that should not be overlooked in a system of dialogue norms, nor in a procedure for developing a strategically expedient critique. In this third option, an opponent questions and overtly doubts a statement of the proponent and supplements her doubts with a counterconsideration that explains and motivates her position of critical doubt, yet without supporting any opposite thesis, thereby assisting, as it were, the proponent in his attempt to develop a responsive argumentation, tailor-made to convince this particular opponent. First, I elaborate on the notion of an explanatory counterconsideration. Second, I discuss Walton’s distinction between premises that can be challenged by mere questioning and premises that must be challenged by incurring the obligation to offer counter-argumentation. I contend that the latter type of premises, that I would label “normality premises,” can be attacked without incurring a genuine burden of proof. Instead, it can be attacked by means of incurring a burden of criticism that amounts to the obligation to offer an explanatory counterconsideration, rather than a convincing ex concessis argument. Of course, providing the opponent with the right to discharge her burden of criticism with explanatory counterconsiderations brings a clear strategic ad- vantage to her. It is much less demanding to motivate one’s doubts regarding proposition P, than to convince the proponent of not-P. If we want to encourage opponents to act critically, and proponents to develop responsive arguments, the importance of the notions of an explanatory counterconsideration and of a motivated doubt should be emphasized in the theory of criticism. A natural approach to representing and reasoning about temporal propositions (i.e., statements with time-dependent truth-values) is to associate them with time elements. In the literature, there are three choices regarding the primitive for the ontology of time: (1) instantaneous points, (2) durative intervals and (3) both points and intervals. Problems may arise when one conflates different views of temporal structure and questions whether some certain types of temporal propositions can be validly and meaningfully associated with different time elements. In (...) this paper, we shall summarize an ontological glossary with respect to time elements, and diversify a wider range of meta-predicates for ascribing temporal propositions to time elements. Based on these, we shall also devise a versatile categorization of temporal propositions, which can subsume those representative categories proposed in the literature, including that of Vendler, of McDermott, of Allen, of Shoham, of Galton and of Terenziani and Torasso. It is demonstrated that the new categorization of propositions, together with the proposed range of meta-predicates, provides the expressive power for modeling some typical temporal terms/phenomena, such as starting-instant, stopping-instant, dividing-instant, instigation, termination and intermingling etc. (shrink)

The essay "Physique de croyant" is an important statement of Pierre Duhem's position on the relation between his science and his religion. Duhem trod a difficult path, some might say an impossible one, in Republican France because he was both a physicist and a devout Catholic. In this essay, using "Physique de croyant" as a touchstone, I explore the way in which he tried to reconcile his conflicting allegiances. There are several strands in Duhem's strategy that need to be teased (...) out. First, Duhem sought to defend his science against the charge that it was materialist and atheist. He did this with his claim, usually called the autonomy thesis, that physics and metaphysics are fundamentally different enterprises—that physics, properly conducted, has no metaphysical implications and requires no metaphysical support. This did not deny metaphysics its rightful territory. Second, Duhem used his segregationist position to defend the Roman Catholic Church against the assaults of the positivist scientism then in favor with the Republicans. Third, he also sought to protect his science against fellow Catholics who wanted to use it for polemical purposes. I develop and evaluate these lines of defense. (shrink)

The subject of general utterances (al-lafdh al-āmm) being certain or presumptive in their usage as an indication to all their members is controversial amongst the methodists. Ḥanafī methodists suggest that the indication of general utterances to all of their members as certain and unless they are specified with a certain evidence, they can’t be specified with a presumptive evidence. Like the ḥanafī methodists, the ẓāhirī methodists also suggest that the general utterance is certain indicant for all of its members and (...) can be specified only with another evidence in the same rank. The main difference between the two groups focuses on whether al-khabar al-wāhid (single prophetic narration) is a certain or a presumptive evidence in terms of certitude. According to ḥanafīs, al-khabar al-wāhid is a presumptive evidence and unless the general utterances in Qur’ān are specified initially with another certain evidence, they can’t be specified with al-khabar al-wāhid. However, al-khabar al-wāhid is a certain evidence according to ẓāhirīs and it can specify general utterances in Qur’ān. In this study, the comparison of the views of the methodists of two schools regarding the indication of general utterances in Quran and their specification (takhsīs) with al-akhbar al-wāhid is made and their influence on Islamic Law regulations is studied afterwards. In this study, the two sect’s approaches are compared over the provision of reading al-Fatehah during prayer, the number of milk sucking to establish the kinship, the rights of women divorced with bain talaq and the execution of the death penalty in the Harem region.Summary: The purpose of this study is to try to demonstrate that an assertion in the Ph.D. thesis, The History and Doctrine of Ẓāhirī Madhhab, completed by Amr Osman in 2010 is incorrect. It can be summarized that in his study, Amr Osman claims that the affiliation of the schools to ahl-al-hadith and ahl-al-ra’y in conventional classification is wrong. According to him, contrary to what is known, the School of Ẓāhiriyya is closer to School of Ḥanafiyya rather than schools coming out of ahl-al-hadith. In this study, one of the arguments that he relied on to support his claim is studied in order to prove that his claim was inaccurate. Osman claims that ẓāhirīs are closer to ḥanifīs, based on the view that in both schools the general utterances embrace all of their members in their usage and they are a certain indicant to all of their members. At this stage, although the views of both schools are common, the ḥanifīs don’t accept the idea that the general statements of Qur’ān can be established with al-khabar-al-wāhid, those which they acknowledge as presumptive as of certitude. However, according to the ẓāhirīs, the certitude of al-khabar al-wāhid is as precise as the narrated report, so it can specify the general statements of Qur’ān which are in equal power. The related dispute between the schools has been reflected on many Islamic law regulations. Some of them are:1. Ḥanafīs state that the correct Quranic prayer may be performed by reading any or a few verses of the Qur’ān in prayer, which is a practice based on the verse “Read what you can read from the Qur’ān now”. On the other hand, the ẓāhirīs have established the related order based on the report “There is no prayer without reading Umm Al-Quran (Surah al-Fatehah)” and it is obligatory (fardh) to read Surah al-Fatehah in prayers.2. Because that the terms milk-mother and milk sister are in general form in the verse “It is forbidden to you to marry these people...Your milk-mothers who nursed you, your milk-sisters who nursed you” the ḥanafīs clarify that it is sufficient for a child to breastfeed only one time in order to form a milk-kinship. They do not act in accordance with the solitary report (al-khabar-al-wāhids) which indicate that the milk kinship specifying the verse shall only be formed with at least three or five breastfeeding. However, one of the ẓāhirīs, Dāwūd al-Ẓāhirī, has specified the verse with the report indicating that the kinship shall not be formed with less than three breastfeeding by the child, and Ibn Ḥazm has specified it with Salim hadith which indicates that the kinship shall be formed with five breastfeeding.3. According to ḥanafīs, there is an alimony and inhabiting right of the widow woman to be procured by the husband within the period of delay who divorced her either with irreversible divorce (talāq al-bāin) or reversible divorce (talāq al-ric‘ī) according to the generalization of the verse “Give shelter to them (the women you have divorced) in some part of your household within your capacity.” They did not act with the report of Fātima binti Qays, who specified the generalization of the verse. On the other hand, the ẓāhirīs recognize the abovementioned rights only for the women who got divorced with irreversible divorce or the ones who are pregnant, specifying the verse with the report indicating that His Holiness the Prophet does not grant alimony and inhabiting to the woman who was divorced with reversible divorce.4. According to ḥanafīs, the criminal who committed a crime that would require a death penalty and took refuge in the Harem region could not be executed while in Ḥarem, according to the common statement of the verse, “Whoever enters there, will be safe.” Dāwūd al-Ẓāhirī, one of the ẓāhirīs has specified the verse with the report indicating that His Holiness the Prophet has authorized the execution of the sentence to Ibn Khattal in Ḥarem on the day of the conquering of Mecca and he states that the death sentence can be executed wherever the criminal is caught, even if it is inside the Harem. Ibn Ḥazm shares the same view with ḥanafīs regarding the provision of this issue. However, the reason for his opinion stems from the fact that the report about Ibn Khattal was an event specific to that day. As it is seen, even though the ḥanefīs and ẓāhirīs share the same opinion about the general utterances being a certain indicant to all their members, they have disagreements upon the argument about the general utterances of Quran being specified by al-khabar al-wāhid and many Islamic Law regulations have been issued by these schools based on such disagreements. According to us, in the final analysis, Amr Osman’s claim must be met with caution. (shrink)

The subject of research in this article is some aspects of the life path of a prominent figure of the Reformation in Germany, Philip Melanchthon, which influenced the evolution of his worldview. Special attention is paid to the facts of his biography, the characteristics of his early works, as well as his assessments of the confessional struggle and calls for the active involvement of administrative resources to crack down on dissidents. The methodological basis of this article is the dialectical approach, (...) in particular, the principle of the relationship between the general and the singular, as well as the principle of the unity of the logical and historical. These principles allow us to identify the ethical nuances of the evolution of F. Melanchthon's views as a Reformation figure based on his statements and assessments. Philip Melanchthon is often evaluated in the scientific literature as one of the founders of the new faith, the second most important after Martin Luther, whose merit was the attempt to reconcile humanistic views and new confessional interests. However, based on a detailed analysis of the material presented in the article, the authors come to the conclusion that Philip Melanchthon, having devoted himself entirely to the Reformation, renounced the German humanistic tradition of the XV century, the values of humanism represented in the works of Jacob Wimplefing, Johann Reichlin, Erasmus of Rotterdam, Thomas More, John Colet. The foundations of systematics lie in ontology, not in subjective epistemology. Systems and their elements should be distinguished from classes; only the latter are constructed from similarities. The term classification should be restricted to ordering into classes; ordering according to systematic relations may be called systematization.The theory of organization levels portrays the real world as a hierarchy of open systems, from energy quanta to ecosystems; followingHartmann these systems as extended in time are considered the primary units of reality. Organization (...) levels should be distinguished from levels of differentiation within each organization level.Certain biological systems, such as species, continue to be misinterpreted as classes, particularly by logicians unfamiliar with modern biological theory. Replacement of Aristotelian definitions of species by “polytypic” definitions achieves nothing, because species are individual systems which can be defined from an ontological viewpoint only as wholes. The dispute whether classes are real per se or only in individuals is of no scientific importance; irrespective of which view is taken, any ordering of physical objects into classes constitutes an hypothesis about the structure of the real world.The distinction between essential and contingent characters is relevant only to classification. There are no universal rules for evaluating characters for purposes of systematization. Character statements do not form separate linear sequences. The search for “unit characters” in an absolute sense is futile. Classification into evolutionary grades remains an imprecise endeavour, since no general measure of evolutionary differentiation has been devised.The spatial and temporal extent of ecosystems, the postulated basic units of ecosystematics, remains unclarified. Nevertheless there are grounds for expecting progress in this field as the energetic relations between organisms become better understood. Biotic communities are not “abstract” classes, but systematic units. None of Peirce's most recent interpreters fall clearly into only one of these classes. All are expositors, critics, and innovators. Yet their emphases differ, and the classification serves to highlight them. W. B. Gallie, for instance, is mainly interested in introducing the general reader to the broadest line of Peirce's thought on pragmatism. He does this appreciatively, with skillful fluency. Yet he also advances a critical thesis about the meanings Peirce gave to "pragmatism," and he tests the compatibility of (...) Peirce's metaphysical and logical writings with suggestive results. Manley Thompson's book has, on the other hand, a more formal cast throughout. It is "offered as an essential propaedeutic to the determination of Peirce's place in the history of ideas". With closest care it traces the development of Peirce's pragmatic philosophy, setting out an ordered, definitive statement of what Peirce said, driving finally to a brief evaluation of the whole philosophy in which the pragmatic maxim is a principle. Lastly, the Studies in the Philosophy of Charles Sanders Peirce contains essays of all three emphases: there are biographical, historical, and elucidating essays; there are critical ones that quibble to distraction and critical ones that excite to construction; and finally, there are a few that go through Peirce to continue inquiry on topics in ethics, logic, and metaphysics. This paper aims at considering the conceptual status of feeding and eating disorders (FEDs). Now that the Diagnostic and Statistical Manual of Mental Disorders (DSM-5) has changed the classification and some relevant criteria of FEDs, it is particularly relevant to evaluate their psychiatric framework and their status as mental disorders. I focus my efforts on addressing only one specific question: Do FEDs fit the DSM-5 general definition of mental disorder? In DSM-5 a mental disorder is defined as a syndrome (...) that reflects adysfunctionand is usually associated with significantdistress or disability. More importantly, there is an explicit statement saying thatallmental disorders listed in the manual must meet the requirements highlighted by the general definition. Thus, I evaluate whether or not FEDs are really meant to reflect a dysfunction and are usually associated with significant distress or disability. (shrink)
