In this paper I expose and criticise the distinction between pure indexicals and demonstratives, held by David Kaplan and John Perry. I oppose the context of material production of the utterance to the “intended context” (the context of interpretation, i.e. the context the speaker indicates as semantically relevant): this opposition introduces an intentional feature into the interpretation of pure indexicals. As far as the indexical I is concerned, I maintain that we must distinguish between the material producer of the utterance (...) containing I and the “intended agent of the context” - i.e. the individual designated by the material producer as the responsible for the utterance. Esto podría dar lugar a pensar que, en esta obra, se opera una transformación del modo en que el autor concibe la causalidad general, ya que, en las primeras dos Críticas, existe una tendencia a identificar el principio mecanicista con el principio de la segunda analogía de la experiencia. En este trabajo, intentaré mostrar que la presentación del principio que Kant hace en la (...) tercera Crítica es totalmente coherente con las tesis que desarrolla en sus otras obras, y que no supone otra modificación de su teoría más que aquella que surge de dirigir la atención sobre el operar de la facultad de juzgar reflexionante y sobre los problemas con los que este operar se relaciona. Music performance anxiety is a commonly present topic among musicians. Most studies on MPA investigated effects of a more general occurrence of MPA on performances. Less is known about individual variations of MPA within a performance, more specifically at the times before, during, and after the performance. This study used a questionnaire to investigate these performance times in order to find out if there occur different types in the variation of the perceived MPA across the performance. The study was performed (...) with 532 musicians; 27% of them being professional orchestra musicians, 45% non-professional orchestra musicians, and 28% non-professional choir singers. The musicians were asked to fill in the Performance-specific Questionnaire for Musicians immediately after a performance. The questionnaire contains three scales regarding symptoms of MPA, functional coping with MPA and performance-related self-efficacy. A cluster analysis was performed on the PQM scales to identify systematic variations. Findings indicate that there are three different types of MPA in the sample studied. Type 1 describes musicians who have few symptoms of MPA throughout the performance, show functional coping with MPA, and have a stable and well-developed self-efficacy. Type 2 describes musicians who begin their performance with rather high symptoms of MPA but can positively reduce these by the end of the performance and show high values in self-efficacy and in functional coping. Type 3 contains musicians who begin their performance with some symptoms of MPA, which increase to the end of the performance. The values of self-efficacy and functional coping in this type are rather low. Of the total sample, half of the musicians were assigned to Type 1 and approximately a quarter each to Type 2 and Type 3. In accordance with the literature, the results confirm the importance of self-efficacy and functional coping for a positive performance experience. (shrink)

The importance of economic freedom for economic development can no longer be denied. What is often denied, however, is respect for individuals’ rights and personal choices. The role of individual choice is often dismissed or set aside by the development community. In this essay, I argue that inherent to economic freedom’s economic success is the promotion and acceptance of individual choice. Development theory should include recognition of and respect for personal choices, a theory I call “Catfish Man of the Woods” (...) theory of development. (shrink)

This work is devoted to the relations between Lambek’s Syntactic Calculus and noncommutative variants of Girard’s Linear Logic; in particular the paper will consider: the geometrical representation of the laws of LC by means of proof-nets; the discovery - due to such a geometrical representation - of some laws of LC not yet considered; the discussion of possible linguistic uses of these new laws.

Heterogenous flows across system boundaries continue to pose significant problems for efficient resource allocation especially with respect to long term strategic planning and immediate problems about allocation to address particular resource shortages. The approach taken here to modelling such flows is an engineering change prediction one. This enables margin modelling by producing system models in dependency matrices with different linkage types. Change prediction approaches from engineering design can analyse where these bottlenecks in integrated systems would be so that resources can (...) be deployed flexibility to avoid them and address them when they occur. Current state of the art of margin research can be furthered by identifying margins on multiple levels of system composition. It can usefully be complemented by a category theory based approach which allows representation of variable and constant properties of models under changing conditions, and the identification of flows within models. Category theory is useful for formalising such explanatory frameworks as it can both structure systems and permit analysis of their applications in a complementary way. (shrink)

Aristotle's discussion of friendship provides an inclusive analysis that, along with common everyday understanding, tries to take into account approaches as different as that of the sophists and Plato's meditation on this theme. The present essay examines the complexity of the phenomenon of friendship —especially the difficult intersection of friendship as loving intimacy between excellent individuals and friendship as a genuinely political bond. Above all, it attempts to cast light on the political relevance of perfect friendship. Thus understood, friendship is (...) disclosed as the end or destination of politics and may even presage the self-overcoming of politics as mere legality. This opens the way for an understanding of political finality as no mere expediency and for thinking the political on the basis of pathos and singularity. (shrink)

Rengifo y Ramón Vásquez, entre otros. Algunas de ellas carecían de la firma del autor o de un dato que comprobara la autoría, y estaban deterioradas, más que por el tiempo, por el (...) improvisado bodegaje: don Mario las había guardado durante cuarenta años en su hermosa casa de Maracaibo, en el centro de la ciudad. Because of the rushed statement that writing is a testament that concentrates the intention of someone who is absent, the idea of the immutability of text has been generalized. The latter is associated with a criterion of coherence in which the realization of the idea flows with no obstacles. Regarding this issue, which limits the dialectic nature of language, this article offers a conceptual alternative that aims at questioning the criterion of linguistic objectivation because it separates the word of its (...) reflective nature, which is in tune with the reference to the entity that drives its meanings. The dynamic reach of writing makes possible for reading to become an appendix of observation, which not only prepares cognitively for the analysis of the set of graphemes, but that also must appropriate sensorially the image that expresses its attributes and alterations as a necessary link in every act of enunciation. Thus, the Marxist conceptual route is linked to a critical philosophical standpoint in which the dialogical relation between text and reader takes effect within a movement of looking towards the heart of the purpose. The latter is done with the aim of making more pedagogical the meeting with the text through a critical hermeneutical approach. To sum up, the resignification of writing implies considering it as a permeable and dynamic texture due to the questions that foster new and surprising findings in the endeavor of knowing. This also means that word, both oral and written, should be linked to new challenges for questioning, which makes of knowing an experience in constant change. (shrink)

The paper discusses the current medical practice of "gender verification" in sports from an ethical point of view. It takes the recent public discussion about 800-meter runner Caster Semenya as a starting point. At the World Championships in Athletics 2009 in Berlin, Germany, Semenya was challenged by competitors as being a so called "sex impostor". A medical examination to verify her sex ensued. The author analyses whether athletes like Semenya could claim a right not to know that is generally acknowledged (...) in human genetics and enforced by international and national genetic privacy laws. The relevance of this right for genetic diagnosis in sports is discussed. To this end, the interests of the athlete concerned and of third parties are balanced according to the expected benefits and harms. Harm is documented in a number of cases and includes unjustified disqualification, severe sex and gender identity crisis, demeaning reactions, social isolation, depression and suicide. Benefits are dubious as most cases of intersex are considered irrelevant for sports competition. It has to be concluded that the benefits to be gained from "gender verification" in sports via genetic testing do not outweigh the grave individual disadvantages. The current practice of athletic associations to largely ignore the right of competitors not to know does not comply with prevailing ethical provisions on the protection of sensitive personal data. Therefore, genetic "gender verification" in sports should be abolished. (shrink)

Cette contribution réfléchit aux conditions d’une approche déformalisée de l’intersubjectivité, susceptible de nourrir le projet d’une anthropologie phénoménologique d’inspiration husserlienne. Nous interrogeons d’abord la place architectonique qui revient au problème de la différence sexuelle au sein de la phénoménologie de Husserl, pour montrer qu’il relève du champ thématique de la « générativité ». C’est ensuite la signification de la phénoménologie générative qui est discutée, en dialogue avec les commentateurs qui lui ont accordé une attention particulière (Steinbock, Perreau). Enfin, nous nous (...) penchons sur l’intérêt de Husserl pour la genèse du lien intersubjectif, en privilégiant la référence à la maternité qui est étonnamment présente sous sa plume. L’examen conjoint de ces trois questions vise à faire apparaître l’une des directions que pourrait suivre une entreprise de déformalisation de l’intersubjectivité, et donc une approche plus concrète de celle-ci, sur la base même du traitement qu’en a proposé Husserl. En este trabajo me centraré en la visión que cada uno de ellos tiene sobre el Marxismo, sus apropiaciones, así como las derivaciones a las que llegan. Intentaré mostrar que, mientras en Arendt sobresale una crítica al (...) marxismo como parte de la tradición de pensamiento Occidental, en Benjamin derivará en un giro al idealismo y la teología que pasará a ser redención. O principal objectivo do artigo é pensar a educação como um valor intemporal. Apresentar-se-á um duplo sentido que esta intemporalidade pode assumir: A educação surge como um valor essencial, quer ao longo da história, quer ao longo da nossa vida. Tendo em consideração o primeiro sentido proposto, procurar-se-á realçar a sua intemporalidade, nomeadamente em terreno filosófico. Destacar-se-ão, neste sentido, as seguintes obras: A República, de Platão; O Mestre, de Santo Agostinho; Emílio, de Rousseau, e Pedagogia, de Kant. Relativamente ao segundo (...) sentido, quanto à intemporalidade da educação ao longo da vida, destacar-se-ão os quatro pilares fundamentais desta mesma educação, como apresentados no pertinente Relatório para a UNESCO da Comissão Internacional sobre Educação para o século XXI: aprender a conhecer; aprender a fazer; aprender a viver juntos; aprender a ser. One popular description of current society is that it is a depressed society and medical evidence about depression’s prevalence may well make such an estimation plausible. However, such normative-critical assessments surrounding depression have to date usually operated with a one-sided understanding of depression. This understanding widely neglects the various ways depression manifests as well as its comorbidities. This becomes evident at the latest when considering one of depression’s most prominent and well-known comorbidities: chronic pain. Against this background, we aim in (...) this article to substantiate our leading claim that the phenomenal interconnection between depression and chronic pain must be acknowledged in the global diagnosis of a depressive society. Thus, we argue here for a complementation of the dominant interpretation of a depressed society. This would support the overcoming of oversimplified images and estimations about depression in current society and further, help to recognize chronic pain properly on the larger scale of assessments that address society as a whole. Emphasis in business ethics texts and courses has generally focused on corporate and other relatively high-level ethical issues. However, business school graduates in early career stages report ethical dilemmas involving individual-level decisions, often including influence attempts from one or more members of their work role sets. This paper proposes the use of role set analysis as a pedagogical technique for helping individuals to anticipate and deal with early-career ethical issues.

This paper develops a critic on International Human Rights departing from the criticism directed to utopian discourses of political organization of society, as both of them share an evolutionist and ethnocentric foundation, namely, the universal and unconditionally valid reason. The idea is to undertake a serious criticism on reason, always potentially dystopian, in order to unravel the colonialist ethos and the civilizing character of current Public International Law leading discourse of Human Rights.

A partir da análise do fundamento do Político proposto em algumas obras do Barão de HOLBACH, este artigo visa a examinar a possibilidade de o modo como o materialismo ateu do século XVIII compreende o fundamento da Lei e do Político pode apontar para uma organização social de caráter político ou teológico-político, conforme a chave de leitura fornecida por C. LEFORT. Após a exposição da diferença entre o Político e o Teológico-Político e da breve análise da concepção de Política Natural (...) do Barão de HOLBACH, é possível constatar a persistência do teológico-político também na concepção materialista do século XVIII. Essa condição deriva da singela substituição de Deus pela Natureza no exercício da função simbólica de preencher intemporalmente o lugar do Poder político. (shrink)

This article contributes to the analysis of refusal to license cases as abuse of a dominant position pursuant Article 82 EC from an economic perspective. In the Microsoft case, the European Commission introduced an "Incentives Balance Test" to assess whether the refusal to give access to interface information can be justified by arguing that this information is protected by Intellectual Property Rights (IPRs): The Commission argued that if the overall innovative effects evoked by a compulsory license are significantly higher than (...) without this access, the IPR owner is obliged to license. This should be assessed through balancing the different incentives to innovate between the dominant firm and its competitors. In the paper we pursue two objectives: Firstly, we analyze to what extent the decision of the Court of First Instance, which confirmed the decision of the Commission, helps to clarify the criteria in refusal to license cases; in fact, it is disappointing in this regard. Secondly, we demonstrate that the basic idea of the Incentives Balance Test can be interpreted as a test whether the specific IPRs of the dominant firm can be defended from the perspective of the economics of IPRs. This implies that Article 82 allows competition law to correct economically not optimal IPRs through a specific economic analysis. This is followed by a broad overview on theoretical and empirical insights from economics of IPRs, innovation economics and competition and network economics that can help to develop a more general and sophisticated Innovation Effects Test that can be applied in Article 82 refusal to license cases. En este artículo examino este argumento en el contexto de otros pasajes de Sexto y propongo una interpretación que muestra que el escepticismo que uno puede trazar desde este argumento es tan radical como el de Descartes, pero nunca podrá considerarse como un argumento relativista. Muestro que Sexto comete un error crucial al describir la posición (...) de Protágoras y la suya, un error que podría llevarle a uno a concluir falsamente que Sexto es un relativista protagórico. The coordinated expression of the Hox gene family encoding transcription factors is critical for proper embryonic development and patterning. Major efforts have thus been dedicated to understanding mechanisms controlling Hox expression. In addition to the temporal and spatial sequential activation of Hox genes, proper embryonic development requires that Hox genes get differentially silenced in a cell‐type specific manner as development proceeds. Factors contributing to Hox silencing include the polycomb repressive complexes (PRCs), which control gene expression through epigenetic modifications. This review (...) focuses on PRC‐dependent regulation of the Hox genes and is aimed at integrating the growing complexity of PRC functional properties in the context of Hox regulation. In particular, mechanisms underlying PRC binding dynamics as well as a series of studies that have revealed the impact of PRC on the 3D organization of the genome is discussed, which has a significant role on Hox regulation during development. For music students, the COVID-19 pandemic has had a great impact, forcing them to adapt to certain coronavirus regulations laid down by the state. In this study, the experiences of music students in three consecutive semesters under different coronavirus-related conditions are investigated. At the end of three semesters, the lockdown semester [SS 2020: April – July], a partially opened semester [WS 2020/21: October – February] and a mostly opened semester, a total of 152 music students at the University of Music (...) Freiburg were asked to fill in an online survey. A mixed-methods approach was used, with results showing that the qualitative statements of the students support the quantitative data. The results of the cross-sectional study demonstrate that self-regulated learning improved during the lockdown semester, through new time management and focused practice with regular breaks. During the partially opened semester, the use of blended learning formats led to organizational problems, such as travel time and change of locations. Furthermore, music students were challenged by the social distancing, which improved during the partially opened, and mostly opened semester. New technologies regarding digital communication formats were emerged, which have evolved over the course of the three semesters. Concerning the overall experience, students stated that the partially-opened semester was most challenging, since distances and change of locations had to be combined with quickly changing public COVID-19-regulations. These findings during different stages of the COVID-19 pandemic provide constructive starting points for future teaching. (shrink)

Digitality is increasingly central to individuals’ existence, which has political implications. The article maps the political implications of digitalisation, focusing on African political thought. The latter is marked by Afro-communitarianism ideas, which foster solidarity, relationality, and communalism as foundational values of the polity. However, African communitarianism has granted little attention to contemporary phenomena such as digitalisation. Also, political theory discussions on digitality have looked mainly at (neo)liberal contexts. How the digital age is reshaping the tenets of communitarian political theories represents (...) an underdiscussed issue. This article outlines a research agenda on digitality and African political thought. New digitality-enabled relational modes change human and political interactions. The issue at stake is how these new modes challenge or strengthen the Afro-communitarian political outlook. This article recognises digital-humanism, political community, relations of power as central matters of inquiry. The analysis relies on bibliographic sources from African philosophy and comparative political theory. (shrink)
