Recently, bioethicists and the UNCRPD have advocated for supported medical decision-making on behalf of patients with intellectual disabilities. But what does supported decision-making really entail? One compelling framework is Anita Silvers and Leslie Francis’ mental prosthesis account, which envisions supported decision-making as a process in which trustees act as mere appendages for the patient’s will; the trustee provides the cognitive tools the patient requires to realize her conception of her own good. We argue that supported decision-making would be better understood (...) as a collaborative process, giving patients with intellectual disabilities the opportunity to make decisions in a respectful relationship with trusted others. We offer an alternative account of supported decision-making where the primary constraint is to protect the patient from domination by the trustee. This is advantageous in its preservation of the prospects for genuine collaboration, for the mental prosthesis approach ultimately reinforces a problematic ideal of isolated patient self-determination. We give two social aggregation theorems under conditions of risk, one for constant population cases, the other an extension to variable populations. Intra and interpersonal welfare comparisons are encoded in a single ‘individual preorder’. The theorems give axioms that uniquely determine a social preorder in terms of this individual preorder. The social preorders described by these theorems have features that may be considered characteristic of Harsanyi-style utilitarianism, such as indifference to ex ante and ex post equality. However, the theorems are (...) also consistent with the rejection of all of the expected utility axioms, completeness, continuity, and independence, at both the individual and social levels. In that sense, expected utility is inessential to Harsanyi-style utilitarianism. In fact, the variable population theorem imposes only a mild constraint on the individual preorder, while the constant population theorem imposes no constraint at all. We then derive further results under the assumption of our basic axioms. First, the individual preorder satisfies the main expected utility axiom of strong independence if and only if the social preorder has a vector-valued expected total utility representation, covering Harsanyi’s utilitarian theorem as a special case. Second, stronger utilitarian-friendly assumptions, like Pareto or strong separability, are essentially equivalent to strong independence. Third, if the individual preorder satisfies a ‘local expected utility’ condition popular in non-expected utility theory, then the social preorder has a ‘local expected total utility’ representation. Fourth, a wide range of non-expected utility theories nevertheless lead to social preorders of outcomes that have been seen as canonically egalitarian, such as rank-dependent social preorders. Although our aggregation theorems are stated under conditions of risk, they are valid in more general frameworks for representing uncertainty or ambiguity. (shrink)

This book proposes a new theory of the origins of human language ability and presents an original account of the early evolution of language. It explains why humans are the only language-using animals, challenges the assumption that language is a consequence of intelligence, and offers a new perspective on human uniqueness. The author draws on evidence from archaeology, linguistics, cognitive science, and evolutionary biology. Making no assumptions about the reader's prior knowledge he first provides an introductory but critical survey of (...) all sources of evidence for language evolution. He then considers what language itself reveals about its own and human origins and evolution. Ascribing mental qualities like beliefs, intentions and wants to a machine is sometimes correct if done conservatively and is sometimes necessary to express what is known about its state. We propose some new definitional tools for this: definitions relative to an approximate theory and second order structural definitions.

This paper makes the case for a pluralist, contextualist view of nursing ethics. In defending this view, I briefly outline two current perspectives of nursing ethics – the Traditional View and the Theory View. I argue that the Traditional View, which casts nursing ethics as a subcategory of healthcare ethics, is problematic because it (1) fails to sufficiently acknowledge the unique nature of nursing practice; and (2) applies standard ethical frameworks such as principlism to moral problems which tend to alienate (...) or undermine nursing ethical concerns. Alternatively, the Theory View, which aims to build an independent and comprehensive theory of nursing ethics, is also found wanting because it (1) fails to sufficiently acknowledge the heterogeneous nature of nursing practices; (2) overemphasizes the differences and undervalues the similarities between nurses and other health professionals; and (3) assumes that one ethical framework can be meaningfully applied across diverse moral problems and contexts.My alternative, is to argue that nursing ethics inquiry should take a pluralist and critical stance towards available ethical frameworks and the negotiation of the ethical realm. On this view, the search for moral consensus or a unique ethical framework for nursing is replaced by the task of working strategically with multiple frameworks in order to expand the moral agency of nurses and empower them to positively engage with moral uncertainty as an inevitable feature of living a moral life. I conclude by indicating some of the implications that this has for the teaching of nursing ethics. (shrink)

In AI, consciousness of self consists in a program having certain kinds of facts about its own mental processes and state of mind. We discuss what consciousness of its own mental structures a robot will need in order to operate in the common sense world and accomplish the tasks humans will give it. It's quite a lot. Many features of human consciousness will be wanted, some will not, and some abilities not possessed by humans have already been found feasible and (...) useful in limited contexts. We give preliminary fragments of a logical language a robot can use to represent information about its own state of mind. A robot will often have to conclude that it cannot decide a question on the basis of the information in memory and therefore must seek information externally. Gödel's idea of relative consistency is used to formalize non-knowledge. Programs with the kind of consciousness discussed in this article do not yet exist, although programs with some components of it exist. Thinking about consciousness with a view to designing it provides a new approach to some of the problems of consciousness studied by philosophers. One advantage is that it focusses on the aspects of consciousness important for intelligent behavior. (shrink)

Egalitarians think that equality in the distribution of goods somehow matters. But what exactly is egalitarianism? This article argues for a characterization based on novel principles essentially involving risk. The characterization is then used to resolve disputed questions about egalitarianism. These include: the way egalitarianism is concerned with patterns, in particular its relationship to strong separability; the relationship between egalitarianism and other distributive views, such as concerns with fairness and with giving priority to the worse off; and the relationship between (...) egalitarianism and evaluative measurement. But egalitarianism is subject to a particularly severe form of the levelling-down objection, and is claimed to be false. (shrink)

Reliable medically assisted sex selection which does not involve abortion or infanticide has recently become available, and has been used for non-medical reasons. This raises questions about the morality of sex selection for non-medical reasons. But reasonable people continue to disagree about the answers to these questions. So another set of questions is about what the law should be on medically assisted sex selection for non-medical reasons in the face of reasonable disagreement about the morality of sex selection. This paper (...) sketches a way of thinking about what the law should be, and concludes, contrary to what the law is in many places, that medically assisted sex selection for non-medical reasons ought to be legal. We present an abstract social aggregation theorem. Society, and each individual, has a preorder that may be interpreted as expressing values or beliefs. The preorders are allowed to violate both completeness and continuity, and the population is allowed to be infinite. The preorders are only assumed to be represented by functions with values in partially ordered vector spaces, and whose product has convex range. This includes all preorders that satisfy strong independence. Any Pareto indifferent social preorder is then shown to (...) be represented by a linear transformation of the representations of the individual preorders. Further Pareto conditions on the social preorder correspond to positivity conditions on the transformation. When all the Pareto conditions hold and the population is finite, the social preorder is represented by a sum of individual preorder representations. We provide two applications. The first yields an extremely general version of Harsanyi's social aggregation theorem. The second generalizes a classic result about linear opinion pooling. (shrink)

Unpaid care work, including child care, elder care, and housework, is unremunerated work essential to human survival and flourishing. Worldwide, women disproportionally carry out this work, impacting upon their ability to engage in other activities, such as education, employment, or leisure. Despite a growing number of businesses engaging in “gendered CSR,” in the form of women's empowerment projects, attention to unpaid care work remains little discussed in the literature, despite its importance to sustainable development. Applying Diane Elson's feminist economic framework (...) for alleviating unpaid care work inequality to a case study of gendered CSR in Ghana, I find that at present unpaid care work is (a) unrecognised in business’ CSR, (b) may be both reduced or exacerbated by CSR efforts, and (c) remains conceptualised as relevant only to the private sphere, therefore, missing a unique opportunity for business to contribute to gender equality and sustainable development. Connecting unpaid care work and business responsibility contributes to a more expansive understanding of what CSR may be. (shrink)

In the 1960s, before the promulgation of Humanae Vitae, the Catholic philosophers Elizabeth Anscombe and Herbert McCabe OP debated whether there are convincing natural law arguments for the claim that contraception violates an exceptionless moral norm. This article revisits those arguments and critiques McCabe’s approach to natural law, concerned primarily with ‘social sin’ and not simply violations of ‘right reason,’ as one particularly ill-suited to addressing questions in sexual ethics and unable both to distinguish properly between certain forms of sexual (...) wrongdoing and more obviously social sins such as theft, and also to distinguish between ‘natural’ and ‘unnatural’ sexual acts. Anscombe’s views, I argue, are closer to those of Thomas Aquinas and provide reasons for making the distinctions McCabe does not. An argument concerning the nature of the institution of marriage and the effects of non-marital acts on that institution is proposed as a way of strengthening Anscombe’s argument that contraception violates an exceptionless moral norm. Philosophical controversies within contemporary critical theory arise largely from questions about the nature, scope and limits of human reason. As the linguistic turn in twentieth-century philosophy has increasingly given way to a sociocritical turn, traditional ideas of 'pure' reason have been left further and further behind. There is however considerable disagreement about what that shift entails for enlightenment ideals of self-consciousness, self-determination, and self-realization. At first sight, Aeneas’ dalliance at Carthage is forgotten when he gets down to the serious business of establishing the Trojans in Italy. But the poem's last mention of Dido (at 11.74, when Aeneas places a tunic made by her on the dead Pallas) is enmeshed in a network of parallel passages elsewhere in theAeneidrelating to tunics and adoption. In the light of similarities between Aeneas and the superficially unimportant Trojan warrior (...) Nisus, these passages bear crucially (I suggest) on the contrast between Aeneas’ public and privatepietas: his obedience to imposed (or public) commitments and to chosen (or private) ones.
