In this case, one should expect that providing hydration sufficient to maintain fluid balance would tend to prolong the dying process. In a well-known case at Johns Hopkins University, fluids (and feedings) were withheld from a newborn with anomalies, and the infant died after 15 days, compared to three weeks in the present case, in which fluids were given. In the famous Baby Doe case, fluids and nutrition were withheld and the infant lived only six days. In the case at (...) hand, prolonging the dying process risks causing suffering for the infant from various complications that can arise, and it adds to the emotional burden on the family. We learned from the Johns Hopkins case that prolonged dying is also emotionally difficult for the nurses and other health professionals caring for the infant. (shrink)

The idea of a right not to know (RNTK) emerged in the late 20th century, largely in response to the early incorporation of genetic testing into clinical care. While a few commentators took a more absolute view about the strength of the RNTK, most of the scholarship was openly sceptical of the concept, or at least was willing to acknowledge that the RNTK was defeasible.1 After two decades of relative quiet, it was surprising, then, that the RNTK reappeared with a (...) seemingly widespread consensus that it deserved to be treated as an absolute right. In response to the American College of Medical Genetics and Genomics recommendation2 to actively search for a limited set of high-value medical variants as a default (ie, without soliciting the patient’s preference to know or not know that information) many bioethics commentators came forward to endorse a strong RNTK.3 While ‘deliberate ignorance’ is a complicated moral and psychological concept,4 I was and remain sceptical of a strong RNTK in all cases, and largely support the novel arguments put forth by Ben Davies. But he makes two moves that deserve additional discussion and analysis. Averroës, the greatest Aristotelian of the Islamic philosophical tradition, composed some thirty-eight commentaries on the "First Teacher's" corpus, including three separate treatments of De Anima : the works commonly referred to as the Short, Middle, and Long Commentaries. The Middle Commentary--actually Averroës's last writing on the text-remains one of his most refined and politically discreet treatments of Aristotle, offering modern readers Averroës's final statement on the material intellect and conjunction as well as an accessible historical window on Aristotle's work (...) as it was interpreted and transmitted in the medieval period. The methodological device of or, as sometimes euphemistically labeled, does not enjoy much support among institutional review boards (IRBs) and a large portion of scholars in bioethics. The reasons for this have been documented sufficiently, beginning with the now-paradigmatic attack on the well-known study by Milgram and the unsavory study of Laud Humphries on male homosexual activities in public restrooms. But are the current attitudes interfering with some worthwhile approaches to data gathering that seem to have no other methodology of (...) equal effectiveness? (shrink)
