This is not a random collection of essays, but a book on a single theme. Written by separate hands, mainly by literary critics at Cambridge, it was planned as a whole and executed with a common purpose: to produce the first literary study of the English moralists of the seventeenth century to the beginning of the twentieth. The authors share two convictions: they believe that the study of literature demands an understanding of whatever moral philosophy is embodied in it; and (...) they believe that philosophical writings are capable of being tested by the techniques of literary criticism. In this book, such works as Bacon's Advancement of Learning, Hobbes's Leviathan, and Hume's Enquiries are viewed as whole works, not as repositories of philosophical propositions, nor as episodes in the history of English thought. This article explores the extent to which consumers consider ethics in luxury goods consumption. In particular, it explores whether there is a significant difference between consumers’ propensity to consider ethics in luxury versus commodity purchase and whether consumers are ready to purchase ethical-luxury. Prior research in ethical consumption focuses on low value, commoditized product categories such as food, cosmetics and high street apparel. It is debatable if consumers follow similar ethical consumption patterns in luxury purchases. Findings indicate that consumers’ propensity (...) to consider ethics is significantly lower in luxury purchases when compared to commoditized purchases and explores some of the potential reasons for this reduced propensity to identify or act upon ethical issues in luxury consumption. Using a combination of semantic theory and findings from conversation analysis, this paper describes a way in which questions, which incorporate presuppositions that are false, when used in a courtroom cross-examination wherein there are certain turn-taking rules, rights and restrictions, stop a rape victim from expressing the content that she wants to express in that context. Article copyright 2002. We provide a battery of examples of delusions against which theoretical accounts can be tested. Then we identify neuropsychological anomalies that could produce the unusual experiences that may lead, in turn, to the delusions in our battery. However, we argue against Maher's view that delusions are false beliefs that arise as normal responses to anomalous experiences. We propose, instead, that a second factor is required to account for the transition from unusual experience to delusional belief. The second (...) factor in the etiology of delusions can be described superficially as a loss of the ability to reject a candidate for belief on the grounds of its implausibility and its inconsistency with everything else that the patient knows, but we point out some problems that confront any attempt to say more about the nature of this second factor. The primary purpose of the performing arts is to prepare and present 'artistic performances', performances that either are themselves the appreciative focuses of works of art or are instances of other things that are works of art. In the latter case, we have performances of what may be termed 'performed works', as is generally taken to be so with performances of classical music and traditional theatrical performances. In the former case, we have what may be termed 'performance-works', as, for example, (...) in free improvisations. Where we have performances of performed works, a number of distinctive philosophical questions arise: What kind of thing is a performed work? How is it appreciated through its performances? Is 'authenticity' an artistically relevant quality of performances of performed works, and, if so, why? How much of what goes on in the performing arts is rightly viewed as the performance of performed works? Artistic performances, whether or not they are of performed works, raise philosophical questions of their own. Can a performance itself be rightly viewed as a work of art? How do improvisation and rehearsal enter into the performing arts, and how do they bear on the appreciation of artistic performances? What role does the audience play in such performances? Does the performer's use of her own body as an artistic medium, as for example in dance performance, generate special constraints on appreciation? How, finally, does what is usually classified as 'performance art' relate to activities in the performing arts more generally construed? Stephen Davies presents a fascinating exploration of the idea that art, and our aesthetic sensibilities more generally, should be understood as an element in human evolution. He asks: Do animals have aesthetics? Do our aesthetic preferences have prehistoric roots? Is art universal? What is the biological role of aesthetic and artistic behaviour?

I offer an analysis of the role played by consideration of an item's functions when it is judged aesthetically. The account applies also to artworks, of which some serve extrinsic functions (such as the glorification of God and the communication of religious lore) and others have the function of being contemplated for their own sake alone. Along the way, I deny that aesthetic judgements fit the model of judgements either of free beauty or of dependent beauty, given how these two (...) came to be described in the early twentieth century. In the course of a wider study of stylistic development in Cicero's speeches1 an examination was conducted into the clausal and phrasal structure of a chronological cross-section of the speeches. The examination revealed some clearly distinguishable developments in the orator's maturing style. This paper is restricted to an examination of one aspect of his stylistic development, namely his use of abundantia of phrases. The term abundantia has a long history, but in Cicero's rhetorical treatises it is almost synonymous with amplitudo (...) and copia. (shrink)

In recent years, there has been a panoply of new forms of ‘social’ government, as manifest in ‘social enterprise’ and ‘social media’. This follows an era of neoliberalism in which social logics were apparently being eliminated, through the expansion of economic rationalities. To understand this, the article explores the critique of the very notion of the ‘social’, as manifest in neoliberal contributions to the socialist calculation debate from the 1920s onwards. Understood as a zone lying between market and state, the (...) social was accused by Mises and Hayek of being both unaccountable (lacking any units of measurement) and formless (lacking instruments of explication). The article then asks to what extent these critiques still retain their purchase, following recent developments in hedonic measurement and data analytics. The argument is made that new post-neoliberal forms of ‘social government’ may now be entirely plausible, though focusing on the corporation rather than the state. (shrink)

In recent years, there has been a surge in critical and historical work, dedicated to uncovering the roots of neoliberal thinking. In the process, the concept of ‘neoliberalism’ has become used in a far more nuanced way, contrary to the frequent allegation that it is merely a pejorative slogan used against capitalism generally. This bibliographic review identifies the texts that have mapped out this more sophisticated account of neoliberalism, and which distinguish between its different varieties and trajectories. In particular, the (...) recognition that neoliberalism is not simply about laissez-faire economics becomes a basis on which to interrogate neoliberalism more sociologically, learning especially from Foucault’s lectures on the topic. Berys Gaut has recently defended a cluster account of art. He proposes it as superior to other anti-essentialist positions. I argue that his defence of this claim is unconvincing. Not only is the cluster theory consistent with the current crop of disjunctive definitions, it is at its most plausible when seen in such terms.

The paper makes three points about the role of double dissociation in cognitive neuropsychology. First, arguments from double dissociation to separate modules work by inference to the best, not the only possible, explanation. Second, in the development of computational cognitive neuropsychology, the contribution of connectionist cognitive science has been to broaden the range of potential explanations of double dissociation. As a result, the competition between explanations, and the characteristic features of the assessment of theories against the criteria of probability and (...) explanatory value, are more visible. Third, cognitive neuropsychology is a division of cognitive psychology but the practice of cognitive neuropsychology proceeds on assumptions that go beyond the subject matter of cognitive psychology. Given such assumptions, neuroscientific findings about lesion location may enhance the value of double dissociation in shifting the balance of support between cognitive theories. (shrink)

In light of recent developments in argumentation theory, we begin by considering the account that Aristotle gives of what he calls sophistical refutations and of the usefulness of being able to recognise various species of them. His diagnosis of one of his examples of the grouping that he labels epomenon is then compared with a very recent account of the matter, which, like Aristotle, calls on us to attribute a mistake or confusion to anyone who uses this kind of argument. From examination of three other examples that Aristotle himself supplies of epomenon, it appears that there are cases of inferences of this kind that we need not, and perhaps cannot, avoid making. The suggestion is made that this is because the whole family of what Peirce calls abductions have important characteristics in common with epomenon. (shrink)

Legal pluralism refers to the idea that in any one geographical space defined by the conventional boundaries of a nation state, there is more than one law or legal system. This article examines several aspects of legal pluralism focusing on the relationship between the empirical facts of pluralism and its conceptual foundations. Variety of factors produce the perception of legal pluralism, which is reflected in intensified interest in the concept in contemporary scholarship. Legal philosophy and sociological approaches to law often (...) still occupy quite separate scholarly terrains. Legal pluralism has been identified as a fruitful area for constructive engagement between legal philosophy and the sociology of law. This article emphasizes the fact that with the decline of nation states as the locus of political and legal power, it seems inevitable that traditional state-centered legal philosophy must give way to a different paradigm, which recognizes the plurality of law. A persistent boast of the historical approach to functions is that functional properties are normative. The claim is that a token trait retains its functional status even when it is defective, diseased, or damaged and consequently unable to perform the relevant task. This is because historical functional categories are defined in terms of some sort of historical success -- success in natural selection, typically -- which imposes a norm upon the performance of descendent tokens. Descendents thus are supposed to perform (...) the associated task even when they cannot. The conceit, then, is that malfunctions are explicable in terms of historical success. The aim of this paper is to challenge this conceit. My thesis is that the historical approach to functions lacks the resources with which to account for the possibility of malfunctions. If functional types are defined in terms of historical success, then tokens that lack the defining property due to defect, and tokens that have lost the defining property due to disease or damage, are excluded from the functional category. Historically based malfunctions, in consequence, are impossible. The historical approach is no better than its non-historical competitors in accounting for the presumed normativity of functional properties. (shrink)

There is significant controversy over whether patients have a ‘right not to know’ information relevant to their health. Some arguments for limiting such a right appeal to potential burdens on others that a patient’s avoidable ignorance might generate. This paper develops this argument by extending it to cases where refusal of relevant information may generate greater demands on a publicly funded healthcare system. In such cases, patients may have an ‘obligation to know’. However, we cannot infer from the fact that (...) a patient has an obligation to know that she does not also have a right not to know. The right not to know is held against medical professionals at a formal institutional level. We have reason to protect patients’ control over the information that they receive, even if in individual instances patients exercise this control in ways that violate obligations. (shrink)
