This essay considers the relationship between ideal theory and non-ideal theory. It begins with Rawls’s conception of ideal theory and A. John Simmons’s articulation of non-ideal theory. Both defend the priority of ideal theory over non-ideal theory. The essay then considers three different conceptions of the social barriers standing in the way of an ideal society, taken broadly from Mill, Marx, and Foucault. Each conception of power suggests a divergent strategy for pursuing non-ideal theory. The Foucauldian conception also suggests reasons (...) to mistrust our own political and moral judgments. The essay advocates a more limited view of the relationship between ideal and non-ideal theory than is commonly described, in which ideal theory retains its logical priority but not its temporal priority. In other words, the essay argues that we will fare best when we focus first on reducing specific injustices while setting aside further speculation about the character of an ideal society. (shrink)

This volume of Burke's writings and speeches is divided into two parts. The first covers the period between the time of his retirement from the House of Commons in 1794 and his death in 1797. His main preoccupation during this period was, of course, the French Revolution and the progress of the war against France. Surveying developments with dismay and apprehension, he produced a critique of the Revolution which expressed much of his mature thinking on political and social life, (...) and issued a clarion call for a European crusade to save civilization. Part II contains Burke's writings and speeches relating to Ireland. From his entry into political life, he was intensely interested in Irish problems, religious, economic, and constitutional, and in Anglo-Irish relations. Fervently believing that Great Britain and Ireland should be partners within the Empire, in his last years he was deeply disturbed by the influence of the French Revolution on Irish politics. This article offers a novel, conservative account of material constitution, one that incorporates sortal essentialism and features a theory of dominant sortals. It avoids coinciding objects, temporal parts, relativizations of identity, mereological essentialism, anti-essentialism, denials of the reality of the objects of our ordinary ontology, and other departures from the metaphysic implicit in ordinary ways of thinking. In the opening sections of this paper, we defined ambiguity in terms of distinct sentences (for a single sentence-string) with, in particular, distinct sets of truth conditions for the corresponding negative sentence-string. Lexical vagueness was defined as equivalent to disjunction, for under conditions of the negation of a sentence-string containing such an expression, all the relevant more specific interpretations of the string had also to be negated. Yet in the case of mixed quantification sentences, the strengthened, more specific, interpretations of (...) some such positive string are not all of them necessarily implied to be false if the corresponding negative sentence-string is asserted. On the contrary, as we saw in section 6, a negative sentence-string can be used to deny one of the more specific interpretations of the corresponding positive string without also denying other weaker interpretations of that same string. One might therefore argue that the only empirical evidence availble for assessing quantified sentences suggests clearly that these sentence-strings are ambiguous. Indeed logicians, many of whom restrict their attention to propositions, MUST recognise logical ambiguity at this point. For the contextualisation of the negative sentences in section 6 showed that it was possible to assert the falsity of some proposition P expressed by the sentence S while asserting a further proposition which was compatible with the truth of S. However the corresponding conclusion that such sentence-strings are sententially ambiguous is not a necessary conclusion for the linguist: for the alternative account of postulating a single semantic representation plus a set of semantic procedures is also compatible with the negation evidence. Moreover we have seen independent reasons for thinking that if sentential ambiguity is assumed to be in one-to-one correspondence with what we should now call logical ambiguity, a considerable body of generalisations is lost. For the maximal ambiguity account, it should be recalled, is committed to assigning at least thirteen distinct propositions and hence thirteen distinct sentence outputs for every sentence-string containing no more than two quantifiers, for three out of the four interpretations originally outlined in this paper can be understood with each numeral taken either in an ’exactly’ sense or in an ’at least’ sense. Moreover there is no explanation of why just these interpretations are available-they are merely an arbitrary list, no more connected than are the two interpretations of John saw her duck, with no reason to predict that the ambiguity would carry over from language to language. If then it is granted that an ambiguity account fails to capture appropriate generalisations, only two alternative accounts of mixed quantification sentence-strings remain viable-an analysis proposing an initial co-ordinate logical form like the logical form III, which is the strongest form compatible with each of the propositional interpretations of sentence-string Two examiners marked six scripts, and the radically weak form in which only existential quantification (both over sets and over members of those sets) is invoked. Since there are strong arguments to suggest that the procedures which both analyses require are semantic, there seems no reason not to adopt the radical vagueness account, with its considerably greater simplicity. This key volume specifically completes the collection of Edmund Burke's Indian Writings and Speeches which is set within the series, and is both an exposition of Burke's views on India from his coverage of the Hastings trial, and his views on maintaining the rule of a universal justice. The texts for the items, which have appeared in previous editions of Burke's Works, have been reconstructed, largely by the use of manuscripts. Indeed many of the shorter speeches appear (...) here in print for the first time. The volume includes a key speech which introduced one of the main charges in the trial of Warren Hastings on an impeachment from 1789-1794, and an important report on the conduct of the trial. It closes with the enormously lengthy and significant speech in which Burke summed up the prosecution's case over nine days. However, this volume is not only a full exposition of Burke's views on India but contains much of great interest about other aspects of his thought. In particular, Burke saw himself in these years as being engaged in a battle against the lawless disruption of society, both in Europe and in Asia, in order to maintain the rule of a universal justice, a main theme of this volume. While claims for the return of expropriated land by Native Americans and other indigenous peoples are often evaluated using legal frameworks, such approaches fail to engage the fundamental moral questions involved. This essay outlines three justifications for Native Americans to pursue land claims: to regain properties where original ownership has not been superseded, to aid the long-term survival of their endangered cultures, and to challenge and revise the historical misremembering of mainstream American society. The third justification is most controversial. It (...) asserts that understandings of history shape perceptions of the present, and that intensively pursued land claims can provide powerful challenges to inaccurate conceptions of the past. This essay argues that Native Americans are for this reason justified in strategically pursuing land claims that are difficult to justify on other grounds, and closes with some worries about the legitimate role of strategy in political action. Both the approach taken by World Rugby to address the question of trans women participation in women’s rugby and the paper by Jon Pike that explains the ethical justification for the exclusion of trans women players from world rugby are compelling when understood within the dominant rugby/sport narrative. However, in this article, I suggest that what is absent is a radical feminist understanding that engages with the political purposes of separate sport spaces for women in producing feminist counternarratives that challenge (...) men’s power in/over sport. Decisions about the inclusion of trans women in women’s sporting competitions should be made on a sport context-by-sport context basis oriented by broader feminist political goals. (shrink)

The rationale for pursuing the development and use of Germ-Line selection and modification techniques is examined in this essay. The argument is put forth that it is the moral obligation of the medical profession to make available to the public any technology that can cure or prevent pathology leading to death and disability, in both the present and future generations. Society should pursue the development of strategies for preventing or correcting, at the Germ-Line level, genetic features that will lead to, (...) or enhance, pathological conditions. Because prenatal screening and even early embryo screening and selection can prevent only a subset of known genetic disorders, direct genetic intervention is the only way in which certain couples can exercise their rights to reproductive health. Finally, the arguments most often raised against the pursuit of and use of methods for Germ-Line intervention shall be discussed. Volume 1 of the Writings and Speeches of Edmund Burke presents Burke's early literary writings up to 1765, and before he became a key political figure. It is the first fully annotated and critical edition, with comprehensive notes and an authoritative introduction. The writings published here introduce readers to Burke's early attempts at a public voice. They demonstrate in a variety of ways how determined he was to become involved in the social and intellectual life of his (...) times. The one work of Burke's early life which has long been recognized as having prime critical significance, the Sublime and the Beautiful, is naturally found here. In addition the volume includes the first fully edited version of other works which have been neglected, notably the Vindication of Natural Society, a substantial satire on current philosophical and religious thought, the Abridgement of English History and the Hints for an Essay on the Drama. The volume also prints reliable texts of his early poems and prose `characters' as well as the first complete text of The Reformer since it was first published in 1748. This volume of The Writings and Speeches of Edmund Burke continues the story of Edmund Burke, the Rockingham party in British politics, and the American crisis. By 1774 Burke was already recognized as a master of parliamentary debate and an accomplished writer. By 1780, however, his reputation was to have risen substantially. Probably the most important single reason was his Speech on Conciliation with America, which was presented to the House of Commons in March 1775, published, and (...) circulated to a wide audience on both sides of the Atlantic. In that speech, Burke used the full force of his intellect and eloquence to set out the Rockinghams' first comprehensive plan for achieving lasting peace in the Empire. The public commendation he received helped him to gain recognition for offerings such as his second conciliation proposal in November 1775, and his Letter to the Sheriffs of Bristol in 1777. It also gave him some of the confidence he needed to announce the Whig party's historic conversion to a moderate reform programme in his celebrated speeches on economical reform in 1779 and 1780. Numerous writings and speeches in this volume are transcriptions of previously unpublished manuscripts from the collections at Sheffield and Northampton. These allow the reader new insights into the workings of Burke's mind not just in relation to the major political issues, but also to a multitude of engaging subjects such as education, capital punishment, religious dissent, and the return of the Rockingham Whigs to government power. Employing the doctrine of sortal essentialism, I defend a surprising answer last defended by Chrysippus: that Dion survives while the seemingly unscathed Theon perishes.
