AI-enabled State surveillance capabilities are likely to exert chilling effects whereby individuals modify their behavior due to a fear of the potential consequences if that behavior is observed. The risk is that chilling effects drive individuals towards the mainstream, slowly reducing the space for personal and political development. This could prove devastating for individuals’ ability to freely develop their identity and, ultimately, for the evolution and vibrancy of democratic society. As it stands, human rights law cannot effectively conceptualize this cumulative, (...) longer-term, harm, and so cannot accurately evaluate the cost/benefit of AI tools, risking irreparable harm. As chilling effects impact individuals’ ability to live a good, self-determined life, the concept of human flourishing is relevant. This article engages with Aristotelian naturalism, the life-satisfaction approach, and the capabilities approach to determine which best resonates with the concept of identity as relevant to chilling effects and human rights law. It concludes that the capabilities approach may overcome some of the problems associated with the human rights law approach and may provide a framework capable of capturing both the intricate processes of free identity development and of conceptualizing the harm linked to AI surveillance. The challenge, however, is to ‘operationalize’ this approach. (shrink)

A consumer society that has embraced global capitalism while striving to preserve all the comforts and conveniences provided by technoscience is arguably fatally ill. Much support for this gloomy diagnosis is provided by, among others, Hannah Arendt, Northrop Frye, and Friedrich Nietzsche. Their reflections on the health of a human culture point up the urgency of the need to rethink the idea of good reasoning that predominates in the West. However, they also indicate that a healthier, more life-enhancing conception of (...) good reasoning will arise only when a concern for justice and wisdom displaces the traditional ideals of pure and certain knowledge or eternal truths. To this end, Nietzsche recommends that philosophy ought now to concentrate on producing `cultural physicians' who would strive to fashion a philosophy of concern. This type of philosophical therapist requires a radically nonmodern approach to philosophy that must pivot on a vitalistic metaphysics capable of overcoming pervasive nihilistic ideologies which illustrate a globally spreading mythology of unconcern. Hence an effective and lasting cultural therapy will depend on the emergence of a general will/desire to broaden the conception of good reasoning beyond the narrow perspectives established by modern science. And this will depend in turn on the education of future educators who stress above all the importance of cultivating the mythopoeic imaginations of the young. (shrink)

While some would see the main theme of Hegel’s Subjective Spirit as the emergence of the nature-bound subjectivity to free spirituality, or the resolution of the subject-object problem and the overcoming of subjective idealism, Petry’s chief concern is Hegel’s relation to empiricism. The doctrine of Subjective Spirit is for Petry a “survey” of the “immediate constituent factors involved in our ordinary activity as conscious beings”, organized according to the “commonsense realism and empiricism of the Idea.” The Idea makes possible a (...) hierarchical order wherein the levels of “an empirically ascertained subject-matter form a progression in degree of complexity.” Hegel’s chief contribution in Subjective Spirit is to organize into levels of complexity an existing body of “professional knowledge” in anthropology, psychology, etc., and it is Petry’s main aim to point to such a body of knowledge and show how Hegel made use of it. Against those commentators who consider Kant’s explicit reference to Copernicus’s heliocentric reversal either grossly misleading or simply irrelevant to the revolution in philosophy carried out in the Critique of Pure Reason, it is argued in this paper that Kant’s transcendental idealist inversion of the familiar standpoint of realism and sound common sense fully justifies the talk of a ‘Copernican revolution,’ even if Kant himself never used the expression. It is not just the dominant ‘moving spectator’ motif (or transcendental turn) of (...) the Preface that has to do with Copernicus; both the immediately following ‘crucial experiment’ motif (on the distinction between appearances and things in themselves) and the ‘critical’ motif (regarding self-knowledge and the possibility of synthetic a priori judgments) confirm the aptness of the Copernican analogy. Still, some commentators have stretched the analogy too far; the final section of the paper attempts to determine just how far it may reasonably be said to go. (shrink)

Volume 11 brings together all of Dewey's writings for 1918 and 1919. A Modern Language Association Committee on Scholarly Editions textual edition. Dewey's dominant theme in these pages is war and its after-math. In the Introduction, Oscar and Lilian Handlin discuss his philosophy within the historical context: The First World War slowly ground to its costly conclusion; and the immensely more difficult task of making peace got painfully under way. The armi-stice that some expected would permit a return to normalcy (...) opened instead upon a period of turbulence that agitated fur-ther a society already unsettled by preparations for battle and by debilitating conflict overseas. After spending the first half of 1918-19 on sabbatical from Columbia at the University of California, Dewey traveled to Japan and China, where he lectured, toured, and assessed in his essays the relationship between the two nations. From Peking he reported the student revolt known as the May Fourth Move-ment. The forty items in this volume also include an analysis of Thomas Hobbe's philosophy; an affectionate commemorative tribute to Theodore Roosevelt, our Teddy; the syllabus for Dewey's lectures at the Imperial University in Tokyo, which were later revised and published as Reconstruction in Philosophy; an exchange with former disciple Randolph Bourne about F. Mat-thias Alexander's Man's Supreme Inheritance; and, central to Dew-ey's creed, Philosophy and Democracy. His involvement in a study of the Polish-American community in Philadelphia--resulting in an article, two memoranda, and a lengthy report--is discussed in detail in the Introduction and in the Note on the Confidential Report ofConditions among the Poles in the United States. The essential nature of legislative power is to make the laws; that of executive power is to execute those law. The difference between the two is both substantial and significant; it is the difference between the rule of arbitrary power and the rule of law. This paper will seek to trace the genesis of an independent judicial power, in both theory and practice, through an examination of sections of The Constitutions of Clarendon, The Assize of Clarendon, Hobbes’ Leviathan, Locke’s Second (...) Treatise, Montesquieu’s Spirit of the Laws, as well as The Federalist Papers. Moreover, it will seek to establish its executive nature and to explain why it is so often (at least presently) misunderstood to be akin to the legislative power. (shrink)

In languages like English, reflexivity and reciprocity are expressed by distinct proforms. However, many languages, such as Cheyenne, express reflexivity and reciprocity with a single proform. In this paper I utilize Dynamic Plural Logic (van den Berg, 1996) to a draw a semantic parallel between reflexive and reciprocal anaphors in English. I propose that they contribute overlapping but distinct requirements on the relations introduced by transitive verbs, requirements which fully specify reflexivity and reciprocity. This parallel is then extended to Cheyenne (...) by appealing to underspecification. I propose the Cheyenne affix which expresses both reflexivity and reciprocity contributes only the shared requirement of the English anaphors. It is thus underspecified, not ambiguous. This accounts for its compatibility with both singular and plural antecedents as well as its variety of construals. (shrink)

Since the end of the Cold War, the scope and study of diplomacy has expanded. In the modern diplomatic environment, novel terms such as pipeline diplomacy, coercive diplomacy, diplomacy by sanction and citizen diplomacy are common, alongside the more traditional view of diplomacy as state-to-state activity, monopolized by professional, official diplomats. With such a broad range of views, the scholar can become confused as to what actually constitutes modern diplomacy? In this article, it is argued that the disparity of views (...) in the diplomacy studies field must be classified and consolidated before the enhanced role of diplomacy in the twenty-first century can be better understood. In this article, three different classifications or schools of diplomatic thought are introduced and constructed: the Traditional School, the Nascent School, and the Innovative School. (shrink)

There is a nationwide resurgence of tuberculosis in the country’s urban centers; New York City stands at the forefront of this resurgence. The root causes are increased homelessness, drug addiction and poverty, all symbols of deteriorating social and economic conditions in the city. The inadequate level of public health resources devoted to TB has also contributed to its spread. Still, even with these factors, it is questionable whether the escalating number of TB cases in this country would have occurred without (...) the reservoir of immunosuppressed persons, who are less resistant to the disease, created by the AIDS epidemic. The fear and urgency of this public health crisis, which has been emerging since the beginning of the last decade, are fueled by the rise of TB strains resistant to the first-line drugs and by the disease’s contagiousness.
