The paper, written for a research handbook, critically surveys some fundamental philosophical, historical, and doctrinal issues in the crime of aggression. The two introductory sections set the theoretical issues in the context of Russia’s invasion of Ukraine, and explain the origins of criminalizing aggression under the heading of “crimes against peace.” Section 3 explores an ambiguity between aggression as first use of force and aggression as unprovoked use of force, while section 4 discusses the doctrinal distinction between acts of aggression (...) and wars of aggression. Sections 5 and 6 turn to the theory of aggression. Section 5 examines modern versus early modern just war theorists’ views of just cause. Section 6 explores various theories of what exactly makes aggressive war so evil that it belongs in the pantheon of core crimes, side by side with genocide, crimes against humanity, and other war crimes. The basic question is whether aggression is fundamentally a crime against states, a crime against human rights, or a crime against peace itself. I reject the first, statist, version, and endorse the human rights version. I examine three versions of the view that aggressive war is fundamentally about its human costs: that aggressive wars lead to atrocities (Trainin); that aggressive wars lead more generally to unjustified killings (Dannenbaum); and that aggressive wars lead to both unjustified killings by the aggressor, and to unnecessary killings that include the justified killings of aggressors’ troops by defenders (Mégret). As for crimes against peace, I argue that this theory of aggression’s evils comes in two “flavors,” one of which has justly been criticized by postcolonial writers, and one of which I think is legitimate. The former originates in Judge Pal’s famous dissenting opinion in the IMTFE, and argues that criminalizing aggression is a move by colonial powers to freeze the oppressive status quo. The more legitimate version is that in an age of catastrophically destructive weapons, the risks of escalation in armed conflict –the threat that conflicts will spiral into world wars–are simply too great in human terms. Thus, the legitimate version of “crimes against peace” is part and parcel of the human rights analysis. The final sections break new ground. Section 7 considers whether aggression is solely a leadership crime. Everyone agrees that it would be wrong to punish ordinary soldiers for the crime of aggression launched by their leaders. The questions is why, and it is not easy to answer. Examining it brings us to a contemporary dispute over which leaders can be prosecuted: only those who control or direct the aggressive policies (as per the ICC’s Rome Statute), or others as well, who “shape or influence” the policy without necessarily directing it (as the customary rule used to be formulated). I argue against any narrowing of the leadership clause. Section 8 explores the “paradox of immunity”: Under the legal principle of sovereign immunity, apex leaders are immune from prosecution in the courts of another state. But under the narrow leadership clause, only apex leaders can be prosecuted. Here I argue for a surprising conclusion: that in fact there never was a customary rule of immunity for the crime of aggression. If so, the paradox of immunity disappears. This resolution also helps cut the Gordian knot of a current debate about whether a relatively small subset of states (the EU, perhaps) can form an aggression tribunal and call it “international.”. While scholarship on Livy’s political thought has concentrated on the 1st decade, this article takes up the 3rd decade to argue that Livy makes the case for Republican Rome at the time of the 2nd Punic War as the best form of government. The excellence of Republican Rome is seen in its superiority to the imaginary cities of Greek political theory, and in its mixed constitution, which provides remedies for the pitfalls of the simple forms of democracy and (...) aristocracy. Livy makes the latter case through allusions to Thucydides, whose implications I draw forth to show that Livy is contrasting Republican Rome with Athens and Sparta, and comparing Scipio Africanus with Alcibiades. Livy’s claim that wisdom is to be found in the study of the past, and his preference for the concrete as a means of investigating politics, suggest that his history is a form of political philosophy. ‘Everyone who now reads and writes in the West, of whatever racial background, sex or ideological camp, is still a son or daughter of Homer.’ While the extent to which this claim is accurate has been disputed, it is not wrong in our own day to grant the highest honours for ongoing influence to the author of theIliad. All the more so in Late Antiquity, a period frequently viewed as hermetically isolated from the classical world, but which resolutely viewed itself (...) as part of that unbroken cultural and literary continuum. One of those who made repeated use of Homer's epic was the Emperor Julian, one of the most prolific writers among Rome's emperors. In the fourth centurya.d., Homer's influence was still predominant, not only being Julian's favourite and most frequently cited author but also forming for Libanius of Antioch ‘one of the pillars of rhetorical teaching’. Despite Glen Bowersock's statement that Julian's many writings offer unique insight into his character and disposition, Julian is still a historical character who is not easy to ‘know’. Julian's life was shaped by the murder of his father, brothers and uncles by a cabal involving, if not orchestrated by, his cousin Constantius II. This was followed by the removal of his trusted confidant Salutius, again by Constantius. These experiences exhibit an unusual phenomenon, in that, when Julian referred to them, they were prefaced by a spate of Homeric allusions. Julian's wrath at people taken from him was both genuine and politically useful, but the expression of it was dangerous enough that he expressed it obliquely in the language of Homer. These citations and allusions, drawn primarily from theIliad, were far more than Julian's flaunting of his education, but were rather a tool for subtly conveying his desired message, a message with strong political tones. I will treat these passages in the order in which Julian wrote them, although that places the events reminisced about in the reverse order. (shrink)

The fundamentals of Kahn's architectural philosophy begin with his personal history: his inherent talent; his family background and childhood experiences; his education, from elementary school through architectural school; the influences of Paul Philippe Cret and Beaux Arts architecture; and his travels, especially those to study the antique monuments of Egypt, Greece, and Rome. Because the causal aspects of these experiences were absorbed by him, rather than being the products of Kahn's own thinking, he rarely acknowledged them. His conclusions led (...) to a philosophy that echoed some of the thoughts of earlier philosophers, like Spinoza and Heidegger, but were arrived at independently.1 Kahn expressed his philosophy in lectures, seminars, writings, interviews, conversation, and often through sketches. However, he habitually expressed himself elliptically-his phrasing poetic, his metaphors original and apt. Therefore, his meaning was often felt rather than understood. Extensive studies of Louis Kahn's architecture exist, but few focus on his fully developed architectural philosophy.2 This text addresses that subject, incorporating his own words (in italics) and relating them where relevant to his final work, the Yale Center of British Art (hereafter, "the Center"). Kahn died during the construction of the building, the last material expression of his architectural philosophy. I was the first director of the Center, a participant in the selection of the architect and throughout the building's planning and creation. Coincidental with the early years of Kahn's planning for the Center, two young architectural historians-John Cook and Heinrich Klotz-interviewed several leading architects, including Kahn. Working with a verbatim transcript of the Kahn interviews, made by Karen Denavit, I produced an edited version of the interviews in book format. Louis I. Kahn in Conversation: Interviews with John W. Cook and Heinrich Klotz (hereafter, "Kahn in Conversation") is the source for many of the Kahn quotations included here. We discuss presupposition, the phenomenon whereby speakers mark linguistically the information that is presupposed or taken for granted, rather than being part of the main propositional content of a speech act. Expressions and constructions carrying presuppositions are called “presupposition triggers”, forming a large class including definites and factive verbs. The article first introduces the range of triggers, the basic properties of presuppositions such as projection and cancellability, and the diagnostic tests used to identify them. The reader is then introducedto major (...) models of presupposition from the last 50 years, separated into three classes: Frege-Strawson derived semantic models, pragmaticmodels such as that offered by Stalnaker, and dynamic models. Finallywe discuss some of the main current issues in presupposition theory. These involve accommodation, which occurs when a hearer's knowledge state is adjusted to meet the speaker's presuppositions; presupposition failure, which occurs when a presupposition is false; the interaction between presuppositions and attitudes; and the triggering problem, i.e., the problem of explaining why presuppositions occur in the first place. Expression of transgenes in mice, when examined with assays that can distinguish individual cells, is often found to be heterocellular, or variegated. Line‐to‐line variations in expression of a transgene may be due largely to differences in the proportion of cells in which it is expressed. Variegated silencing by centromeric heterochromatin is well described, but other factors may also affect transgene silencing in mice. Tandem arrays of transgenes themselves form heterochromatin, and some cell lineages may tend to silence transgenes because of (...) extensive facultative heterochromatin in their nuclei. The cis‐acting transcriptional control elements within a transgene inhibit silencing, and strainspecific differences in chromatin proteins may strongly influence the extent of variegation. The accessibility of multiple differentiated cell lineages in mice suggests that they may provide a tool for dissecting the role of chromatin‐mediated silencing in cell differentiation and tissue‐specific gene expression. The extremely high level of simulated violence in certain recent video games has made some people uneasy. There is a concern that something is wrong with these violent games, but, since the violence is virtual rather than real, it is difficult to specify the nature of the wrongness. Since there is no proven causal connection between video-game violence and real violence, philosophical analysis can be particularly helpful in locating potential sources of wrongness in ultra-violent video games. To this end, this (...) paper analyzes video game violence through the lens of utilitarian, Kantian, and post-modern perspectives. Through these analyses, several explanations of the wrongness in violent video games emerge. (shrink)

Scholars agree that Hegel had an important influence on John Dewey's early work.1 Unfortunately, the precise nature of this influence is not always easy to discern; in his early works, Dewey mentions Hegel only rarely, and seldom refers to him. However, in his letters and in his later works, Dewey concedes that Hegel had a strong influence on his philosophy. For example, in a 1930 essay, "From Absolutism to Experimentalism," Dewey acknowledges the influence of Hegel, noting that "acquaintance with Hegel (...) has left a permanent deposit in my thinking."2This paper is dedicated to the investigation of an important but not particularly well known, connection between the work of Hegel and Dewey's early educational ideas.3 .. In 1926, C. E. Ayres, a young assistant editor of The New Republic, had completed a draft of his first book, Science: The False Messiah. His publishers, Bobbs-Merrill, were enthusiastic but also somewhat worried—the book, which was a blistering critique of the public understanding of science, was engagingly written and eminently readable, but it was also provocative. Bobbs-Merrill were concerned that Ayres’ “very saucy” approach might damage sales, especially given that he was a complete unknown as far as the general (...) public was concerned; and in order to boost Ayres’ credibility and, hence, future sales of the book, they felt that he needed an endorsement.1 Ayres thus dutifully set about writing to his friendly .. Army Officers face increased moral pressure in modern warfare, where character judgement and ethical judgement are vital. This article reports the results of a study of 242 junior British Army officers using the Army Intermediate Concept Measure, comprising a series of professionally oriented moral dilemmas developed for the UK context. Results are suggestive of appropriate application of Army values to the dilemmas and of ethical reasoning aligning with Army excellence. The sample does slightly less well, however, for justification than for (...) action reasoning, and there are differences following initial training for infantry and artillery officers versus other branches of service. Dilemmas involving anti-torture methods and not covering up soldiers' failings generated best results compared to those requiring balance between compassion and mission, and negotiating personal relationships with military needs. Gender differences favouring women were less than those observed for other professional groups using similar measures. This research further develops a much-needed measure of ethical reasoning among junior Army officers, with potential for use among other ranks.
