Nowadays, there is a quite considerable amount of literature on the use of analogy or more generally of inferences by parallel reasoning in contemporary legal reasoning, and particularly so within Common Law. These studies are often motivated by researches in artificial intelligence seeking to develop suitable software-support for legal reasoning. Recently; Rahman/Iqbal/Soufi (2020) developed a dialogical approach in the framework of Constructive Type Theory to what in Islamic Jurisprudence was called qiyās or correlational inferences. In their last chapter the authors (...) suggested that such an approach contributes to the study of patterns of reasoning by precedent cases within contemporary common Law. In the present paper we will further motivate the deployment within Civil and Common Law of the dialogical framework developed in Rahman/Iqbal/Soufi (2020). After a presentation of Scott Brewer's take on analogy within Common Law, that has striking structural similarities to reasoning by precedent case rooted in ratio legis (known in Islamic Jurisprudence as qiyās al-'illa or correlational inference by the occasioning factor), we will illustrate the implementation of the framework with a brief discussion of some cases of legal reasoning based in Spanish Civil Law but where the accent is put in the emerging ruling rather than in the existing of a case as in Common Law. Moreover; quite surprisingly, the case under study suggests that even cases of Law-interpretation fit the argumentation pattern of qiyās al-'illa. A caveat: in the present paper we will focus mainly in discussing the dynamics of the meaning constitution involved rather than in setting the rules of the underlying dialogical framework, the latter is the subject of a follow-up paper. That is what Hunting Hackers means: to think about what piece of information was relevant for the hacker and why that one in particular and not another. If we could preview our flaws then we would (...) be able to keep our zone safer from hackers. In order to reach this objective, we will analyse how the cryptic language known as Russian Cards operates. This study does not intend to show how the cryptic language is broken into, but to take advantage of the learning gifted in knowing the flaw itself. It is precisely in the learning of the flaw that we can find the answer to what and why we may be hacked. In proportion to the amount of flaw information at our disposal, we will be able to hunt hackers: to stop them completely or, at least, to weaken a possible hacker attack. (shrink)

Background Considering the extensive debate that is currently taking place in Spain regarding euthanasia, it is important to examine the attitude of professionals who perform most of their duties at the bedside of these patients and their families. Objectives The aim of the present study was to present an adaptation and validation of the Euthanasia Attitude Scale and to evaluate its psychometric properties among a sample of nursing students in Spain. Research design A cross-sectional study design was conducted. Participants and (...) research context Non-probabilistic sampling was used to recruit 396 Spanish nursing students. Methods A self-report questionnaire, including socio-demographic data and the Euthanasia Attitude Scale, were used for data collection. The psychometric properties of the Euthanasia Attitude Scale were assessed, including reliability and validity. Fit indices of the overall model were computed. Ethical considerations This study was approved by the Hospital Ethical Committee. Students were informed of the aims and procedures and provided written informed consent prior to data collection. Results The factorial solution comprised four domains and the scale demonstrated adequate internal consistency (Cronbach’s alpha =.878). For the exploratory factor analysis, the Kaiser–Meyer–Olkin index of sampling adequacy was.905 and the Bartlett’s Test of Sphericity was 2972.79 (p <.001). The initial factorial solution revealed four factors with eigenvalues of 6.78 for the first factor, 1.90 for the second one, 1.29 for the third, and 1.10 for the fourth factor. Moreover, there was a significant relationship between religiosity and the domains of the Euthanasia Attitude Scale. Discussion This study obtained a Cronbach’s alpha coefficient of.88 which is in consonance with the findings reported by other studies whereby none of the items were removed and the initial structure based on four domains was conserved, with a factorial solution that explains 52.79% of the total variance. The displacement of some items of the domain may be explained by certain religious and/or cultural components as, in accordance with other studies, people with firm religious beliefs are more inclined to refuse euthanasia. Conclusion According to the findings of this study, the Euthanasia Attitude Scale is a reliable and valid instrument to measure the attitudes toward euthanasia in a sample of Spanish nursing students. This Spanish adaptation will be valuable in future studies examining the attitude and implication of nurses, understanding that nurses are key figures in the euthanasia debate. (shrink)

This study analyses journalistic images of the volcanic eruption of La Palma (Canary Islands, Spain) in 2021. We prioritized the perspective of image reception to find out the audience”s feelings and level of satisfaction. We also investigated the application of ethical recommendations and the presence of new trends in journalism in the coverage of this natural disaster. We surveyed a sample of individuals who were asked about their feelings, emotions, and level of satisfaction with the journalistic images of the event. (...) The results reveal that journalism driven by spectacle and emotion prevailed over preventive, constructive and solution-oriented journalism. A noteworthy conclusion highlights the need for the ethical training of journalists and newsroom managers to promote modern, quality journalism. This necessity arises due to the increasing numbers of natural disasters affecting populations. (shrink)

_Resumen_: Analizamos el papel asignado a los dispositivos espaciales en las utopías adoptando una perspectiva teórica amplia: cultural, social e histórica. Primero documentamos la tendencia de las utopías a plasmarse en proyectos espaciales y esbozamos posibles causas de este hecho: la impronta griega, la preeminencia de la forma socio-política “ciudad” y el influjo del _ars memoriae_ basado en tipos arquitectónicos. Después interpretamos la evolución histórica de la cuestión, reconociendo un punto de inflexión en el siglo XIX con el determinismo espacialista (...) e identificando dos planteamientos que denominamos terapéutica del espacio y poética del espacio. Uno ambiciona solucionar los problemas más urgentes de las ciudades industriales mediante la organización espacial. El segundo dispone los diseños espaciales para instaurar un modelo utópico de sociedad, que gracias a la extensión de la ciencia y a la idea de progreso, se consideraba realizable, siendo uno de sus modelos más emblemáticos el Familisterio de Guisa. The confinement caused by the current COVID-19 pandemic protects physical health, but in turn, has a long-lasting and far-reaching negative psychosocial impact; anxiety, stress, fear and depressive symptoms. All of these have a particular impact on vulnerable older people, putting them at serious risk of loneliness. Women report feeling lonelier than men, affecting women to a greater extent. The present study aims to analyze the efficacy of an integrative reminiscence intervention in older women living in nursing homes to reduce the (...) effects of loneliness and depression after COVID-19. 34 older women living in nursing homes are included into study and were divided into intervention group and control group. Results showed a significant reduction in perception of loneliness, depression and better positive affects, after the intervention. The pandemic has not yet finished and the most affected group has been the people living in nursing homes. These results show the need for evidence of interventions that can help the recovery of these people who have been so affected. The effects of loneliness during confinement and its psychological effects can be mitigated through such programs. (shrink)

From this reading, and through the exploration of her work, this article aims to elucidate the role of force as a key to understand the social phenomenon and the relations among human beings. Furthermore, it pretends to grasp the meaning and value of pain and suffering (...) as constituent elements of the human, which according to this philosopher, whose life was absolutely coherent with her thinking and sensitivity, is the purer approach to the pureness of the divine. There has been much discussion of so-called teleosemantic approaches to the naturalization of content. Such discussion, though, has been largely confined to simple, innate mental states with contents such as ?There is a fly here.? Even assuming we can solve the issues that crop up at this stage, an account of the content of human mental states will not get too far without an account of productivity: the ability to entertain indefinitely many thoughts. The best-known teleosemantic theory, Millikan's biosemantics, offers (...) an account of productivity in thought. This paper raises a basic worry about this account: that the use of mapping functions in the theory is unacceptable from a naturalistic point of view. (shrink)

In the present paper we address the problem of optical isomerism embodied in the socalled “Hund’s paradox”, which points to the difficulty to account for chirality by means of quantum mechanics. In particular, we explain the answer to the problem proposed by the theory of decoherence. The purpose of this article is to challenge this answer on the basis of a conceptual analysis of the phenomenon of decoherence, that reveals the limitations of the theory of decoherence to solve the difficulties (...) posed by optical isomerism and, in general, by quantum measurement. Business Ethics: A European Review, EarlyView.

Research on grammatical gender processing has generally assumed that grammatical gender can be treated as a uniform construct, resulting in a body of literature in which different gender classes are collapsed into single analyses. The present work reviews linguistic, psycholinguistic, and neurolinguistic research on grammatical gender from different methodologies and across different profiles of Spanish speakers. Specifically, we examine distributional asymmetries between masculine and feminine grammatical gender, the resulting biases in gender assignment, and the consequences of these assignment strategies on (...) gender expectancy and processing. We discuss the implications of the findings for the design of future gender processing studies and, more broadly, for our understanding of the potential differences in the processing reflexes of grammatical gender classes within and across languages. When we speak of language we usually use the concept of a particular language. In this sense the concept denoted with the word language may vary from one language to another. Real language (=the language spoken) on the contrary is the reality lived by speakers thus encompassing complex and multifarious activities. Depending on the language spoken, the modes of thinking, modes of being in the conception of things, and systems of beliefs transmitted by means of particular languages, denote the living (...) reality of language with different grammatical categories. The concept “language” is expressed sometimes with a noun, thus denoting something existing in it; sometimes with a verb, thus denoting an action or an activity; and sometimes with an adverb, thus denoting the mode of an activity. The reality or degree of reality implicit in these grammatical categories involves a particular mode of thinking, prompted with a particular mode of being in the conception of things. Because of this it is necessary to distinguish the concept of language as something different from the reality of language. But first of all it is necessary to determine the reality or degree of reality of both the reality lived by speakers and the thing usually conceived of as language or a language. (shrink)

Defendemos que el corpus paulino trasciende el esquema clásico del protagonista y el antagonista para formar una teoría relacional del cuerpo agonista en que cuerpo (...) y alma espejan el modelo relacional de las personas divinas. The objective of this text is to expose the conception of ethics in psychoanalysis. Freud’s work is characterized by elaborating an ethic of the subject, but of the subject understood not in a traditional sense, as a given and complete subject, but on the contrary, as a divided, unfinished and contingent subject. It is an ethic that privileges the principles of singularity, difference and subjective irreducibility in practical action, over any kind of subordination of this to group ideals, external prescriptive (...) duties or universal obligations. This article raises the thought of Heidegger as an alternative to the modern conceptualizations of learning that consider it as mere acquisition or construction of truth by knowledge or integration in truth through the Development of a higher level of consciousness. With Heidegger is going to be able to talk about learning how to inhabit the truth and to be inhabited by it, which implies the acquisition, the construction, the integration, but also "being-in-the-world" (Dasein) like a self before the other. This implies a living idea of learning, because it is not a "representation" that is acquired or built, nor a simple "presentation" of a unitary whole in what one integrates with learning, but understands how living reality that is present and is represented Esenta, projecting itself creatively and shared in the "Being-with" (Mitsein) with tendency to the full unconcealment of the essence of Being with what to inhabit in the fullness of its meaning. Desde que las Leyes de Educación, en los países de la Unión Europea, se sustentan sobre los trabajos de la Comisión, como sucede en nuestro país, los docentes experimentamos en los textos nacionales variadas y distintas sorpresas.

El presente trabajo se propone profundizar en las raíces orientales de la filosofía y práctica de la Atención Plena o Mindfulness con el objetivo de comprender su repercusión y extensión en Occidente, así como su plena integración en el marco de la filosofía perenne. Para ello, nos ocuparemos de determinar los orígenes de Mindfulness en la tradición budista utilizando como fuente principal aquellos autores que han bebido directamente del Canon Pali, y en concreto, examinaremos el sermón denominado Satipatthana Sutta o (...) Sutra de los Fundamentos de la Atención, considerado el corazón y el eje central de la Doctrina de la Mente de Buda. Este análisis, nos permitirá comprender mejor la importante repercusión de estas antiguas enseñanzas en la práctica y filosofía de Mindfulness tal y como está siendo propagado y extendido por Occidente. The introduction of mindfulness in the West was carried out through theories and research methods based on the effects that mindfulness practices produce in the brain (information processing and neurobiological activity). Nevertheless, these approaches elude any reference to the core feature of mindfulness, that is, its subjective and intersubjective conscious nature. With the aim of providing a viable scientific proposal to fill this gap, we present the enactive approach as a naturally well-suited explanatory framework to study mindfulness in its full (...) experiential richness, both in its physical and phenomenological attributes. This chapter is organized as follows. First, we argue that the scientific approach to mindfulness has not explained its phenomenological nature, and consider how mainstream cognitive science understands attention and awareness in non-experiential functional terms. In the following section, we dwell with more detail on the meaning and nature of mindfulness and argue for its essentially phenomenological nature. Furthermore, we contend that it comprises not only a subjective dimension but also a relational intersubjective domain. Finally, we present the enactive approach and the neurophenomenological method as a scientific framework to investigate mindfulness as an experiential relational phenomenon constituted by both physical and phenomenological attributes. Esta ponencia presenta un avance parcial de la investigación sobre la democracia en los municipios colombianos desde la adopción de la elección popular de los alcaldes. A partir de una conceptualización básica y operacional de la democracia se determinan sus principales dimensiones y se presentan los resultados obtenidos para algunas variables significativas que se han procesado, aplicando técnicas de análisis multivariado. El objetivo final (aún en elaboración) es generar un índice de calidad democrática que permita comparar y explicar los avances (...) y retrocesos de la democracia en los muy diversos municipios colombianos. Este artículo propone un acercamiento a la obra autobiográfica de la escritora brasilera Nélida Piñon, específicamente a los trabajos Coração andarilho y Livro das horas, desde la noción de identidad narrativa de Paul Ricoeur. El objetivo es demostrar el modo en que la autora emplea el recurso de la memoria para narrar el proceso de interpretación de sí que implica la escritura autobiográfica. El uso de la memoria le permite asignar una condición de tránsito al yo autobiográfico en la medida (...) en que este se constituye durante el movimiento entre aquello que Ricoeur llama la dimensión de la mismidad del ser y la ipseidad o anhelo de ser. En la filosofía política aristotélica, la definición biológica del hombre como “animal político” funciona como justificación para la creación de la polis. Aristóteles clasifica al hombre como un animal caracterizado por su habilidad racional y comunicativa, capacidades que lo determinan a formar comunidades con miras a la “vida buena”. Esta definición de la naturaleza humana supone la creación de la polis; el único espacio donde el hombre puede desarrollar sus virtudes y vivir una vida plena y feliz. Dentro de esta (...) polis, Aristóteles le otorga participación política solo a los individuos que cum-plen con esta descripción. A partir de esto surge la pregunta: ¿Quiénes quedan al margen de la polis? Fuera de este espacio político quedan todos los que hacen posible la vida en la polis: las mujeres, los trabajadores y los esclavos. Más allá de estas redes económicas y sociales queda el propósito de este artículo, la “bestia”: los seres humanos caracterizados por su carencia de disposición política tanto en instancias desarrolladas como la polis y las más primitivas como la aldea o el hogar. De esta manera, los hombres bestiales son inútiles para la vida en comunidad ya que no cumplen con su función como animales políticos y sus acciones no están guiadas por un bien común. Se argumentará que a partir de esto que la bestia padece una triple exclusión: la política, al negársele la posibilidad de ciudadanía; la social, al prohibirle la partici-pación en la comunidad que sustenta económicamente a la polis y, por último, la biológica al ser excluido del conjunto conceptual de los hombres. Artificial intelligence is a useful predictive tool for a wide variety of fields of knowledge. Despite this, the educational field is still an environment that lacks a variety of studies that use this type of predictive tools. In parallel, it is postulated that the levels of self-esteem in the university environment may be related to the strategies implemented to solve problems. For these reasons, the aim of this study was to analyze the levels of self-esteem presented by teaching staff and (...) students at university and to design an algorithm capable of predicting these levels on the basis of their coping strategies, resilience, and sociodemographic variables. For this purpose, the Rosenberg Self-Esteem Scale, the Perceived Stress Scale, and the Brief Resilience Scale were administered. The results showed a relevant role of resilience and stress perceived in predicting participants’ self-esteem levels. The findings highlight the usefulness of artificial neural networks for predicting psychological variables in education. (shrink)
