The radical Democratic-Republican Societies that emerged during the 1790s not only challenged conventional interpretations of the civic republican tradition, they also adopted Enlightenment principles in their advocacy for universal public education. Brian W. Dotts’ The Political Education of Democratus: Negotiating Civic Virtue during the Early Republic shows that, unlike mainstream educational philosophy of the period, radical democrats supported universal political education as essential in protecting liberty and political equality.

Este artigo investiga o problema da racionalidade da jurisprudência em Habermas. Como é possível assegurar, simultaneamente, tanto a segurança jurídica quanto a correção? This article addresses the unique role performed by social foundations programs in colleges of education and in addressing broader issues facing education today, which fundamentally include the development of interpretive, normative, and critical perspectives in academia. All three perspectives serve to create a scholarly framework within which students and academicians interpret and normatively reflect upon existing educational, political, historical, religious, economic, and social institutions critically. In other words, although many departments in colleges of education tend to fulfill the functional, professional, (...) and institutional requirements essential in preparing future teachers to enter public and private schools, social foundations programs utilize interdisciplinary expertise, primarily from the social sciences and humanities, to explicate extrainstitutional critiques, interpretations, and normative analyses of existing social structures, including schools. Although social foundations programs perform a variety of academic functions, it is this unique reflexive and normatively critical capacity?what critical theorists refer to as ideology critique?that augments social foundations programs and informs present and future scholars in the field. O artigo visa abordar o meio fundamental de como o Estado deve-ser para ser a substancialidade ética, conforme o pensamento do filósofo alemão G. W. F. Hegel. A partir da análise de algumas passagens das obras hegelianas Princípios da Filosofia do Direito e Lições sobre a Filosofia da História Universal, juntamente com o auxílio de alguns comentadores, tentar-se-á primeiramente identificar a vinculação do conceito de Estado com o conceito de História, acompanhando alguns dos movimentos fundamentais e analisando, em seguida, o (...) que é, qual sua origem e o que representa o momento da Constituição apresentado na abordagem ético-política hegeliana. Devidamente compreendida, a Constituição em Hegel possui uma fundamentação ética e não abstrata. Hegel não trata da Constituição escrita, mas da Constituição que é a própria organização do Estado. A base ética que sustenta a Constituição é o “espírito do povo”, que é constituído pelo ethos, origem, história, costumes e hábitos de um povo. A constituição é a melhor expressão daquilo que é o povo, quando este se reconhece nela. Tratar da Constituição hegeliana, é tratar, portanto, do Estado, é tratar da conciliação da liberdade e da necessidade, da organização do todo diante da desorganização do Estado político histórico. O escopo deste artigo é apresentar a Doutrina do Direito de Kant, demonstrando os problemas que o formalismo gera. Será visto que o critério de justiça kantiano é a coexistência de liberdades com leis universais e que a injustiça caracteriza-se quando isso for impedido. Kant propõe princípios metafísicos ao direito, buscando assim realizar uma fundamentação moral do jurídico. Ele distingue as leis éticas das leis jurídicas e estabelece um fundamento comum para ambas: as leis morais. Assim, o direito possui uma (...) fundamentação moral. Todavia, isso é ignorado quando Kant trata do direito de necessidade e do direito de equidade. Segundo o autor, a coerção é necessária para o direito. Porém, há dois casos em que isso não ocorre: no direito de equidade e no direito de necessidade. Por que Kant não resolve o problema desses dois direitos a partir da fundamentação metafísica do direito? É possível uma teoria da justiça estritamente formal, nos moldes kantianos? O presente artigo defende que uma teoria da justiça formal é insuficiente. (shrink)

The problem of the division of competences between the constitutional court and the democratic legislator has been the subject of intense debates in the philosophy of law, especially when examined in light of Habermas' theory. This article proposes a detailed analysis of this issue, focusing on the articulation of theoretical currents that revolve around the issue of making the control of constitutionality exercised by the courts compatible with the principle of the sovereignty of the people. Our aim is to examine (...) how different theoretical approaches address this crucial problem and how their ideas relate to and contradict each other. Three points will be investigated: i) Habermas' criticism of the decision-making practice of the Constitutional Court, especially in Germany, which is based on a liberal reading of the separation of powers. This criticism highlights the expansion of the functions of justice that compete with legislation due to the evolution of the liberal rule of law to an interventionist and welfare state; ii) The debate on the indeterminacy of law focused on the jurisprudence of the values ​​of the German Constitutional Court. Here, the criticism is directed against the methodological self-understanding of this court, which equates guidance by principles with the weighing of goods; iii) The view of the Constitutional Court as protector of the democratic procedure of legislation, a perspective especially prevalent in the USA. This approach refers to the renewal of a republican understanding of the political process, emphasizing the importance of a non-instrumental political process. Habermas, therefore, is not limited to a simple dichotomy between popular democracy and judicial elitism or between tyranny of the majority and judges who guarantee rights. Instead, he offers a nuanced critique, recognizing the complexities and multiple dimensions of the judiciary's role in controlling legislation in contemporary democratic states. (shrink)

Este artigo tem como objetivo tratar da crítica de Hegel a Kant a partir da distinção entre legalidade e moralidade. Enquanto Kant permanece preso ao formalismo, Hegel aponta princípios conteudísticos, pois considera que somente a partir deles é possível estabelecer deveres particulares. Kant define o certo, o bem e o justo a partir de um procedimento que visa à universalidade. A distinção entre legalidade e moralidade é realizada a partir de seus móbeis. A razão, em Kant, não é legisladora, pois (...) não está preocupada com “o que deve ser feito”, mas “como deve ser feito”. O imperativo categórico é regulador e orientador. Já Hegel critica o formalismo da teoria kantiana. A eticidade tem como grande objetivo a libertação da indeterminação, da imediatez e do natural. Isso ocorre instaurando-se a mediação e produzindo, consequentemente, a determinação. (shrink)

Previously published as special issues of _The European Journal of the History of Economic Thought_ and _The Review of Political Economy_, this volume contains the papers devoted to the life and work of Piero Sraffa. Sraffa was a leading intellectual of the twentieth century. He was brought to Cambridge by John Maynard Keynes and had an important impact on the philosopher Ludwig Wittgenstein. He received the golden medal Söderström of the Swedish Academy of Sciences for his edition of David Ricardo's (...) _Works and Correspondence_ and he is the author of _Production of Commodities by Means of Commodities_, one of the most often cited book in economics. Using hitherto unpublished material from Sraffa's literary heritage kept at Trinity College, Cambridge, the papers throw new light on the intellectual development of the young Sraffa and correct several of the received views on him and his contribution. Themes covered concern his: objectivism rediscovery and reformulation of the classical theory of value and distribution criticism of Alfred Marshall's analysis relationship with his Cambridge colleagues and friends biography around the time when he left Italy for the UK friendship with Wittgenstein and his impact on the latter's thinking. This thought-provoking book discusses the concept of progress in economics and investigates whether any advance has been made in its different spheres of research.
