Hip fractures are common and serious injuries in the geriatric population. Obtaining informed consent for surgery in geriatric patients can be difficult due to the high prevalence of comorbid cognitive impairment. Given that virtually all patients with hip fractures eventually undergo surgery, and given that delays in surgery are associated with increased mortality, we argue that there are select instances in which it may be ethically permissible, and indeed clinically preferable, to initiate surgical treatment in cognitively impaired patients under the (...) doctrine of presumed consent. In this paper, we examine the boundaries of the license granted by presumed consent and use the example of geriatric hip fracture to build an ethical framework for understanding the doctrine of presumed consent. The license to act under presumed consent requires three factors: patient incapacity, clinical urgency and clarity on the correct course of action. All three can apply to geriatric hip fracture. The typical patient frequently lacks capacity. Delays in initiating surgical treatment are associated with markedly increased mortality rates. Last, there appears to be consensus that surgery is the preferred treatment. Nonetheless, because there is a window of safe delay during which treating physicians can stabilize the patient, address reversible causes of cognitive impairment and identify surrogate decision makers, presumed consent should be invoked only as a method of last resort. A medical situation need not be characterized by risk of imminent and certain death for presumed consent to be relevant. Rather, there are two distinct windows that must be considered: the time interval in which action may be delayed without danger, and the time interval needed to obtain a better form of consent. It is nowadays taken for granted that the core radical sceptical arguments all pivot upon the principle that the epistemic operator in question is 'closed' under known entailments. Accordingly, the standard anti-sceptical project now involves either denying closure or retaining closure by amending how one understands other elements of the sceptical argument. However, there are epistemic principles available to the sceptic which are logically weaker than closure but achieve the same result. Epistemic anti-individualism is the view that positive epistemic statuses fail to supervene on internal, physical or mental, properties of individuals. Intellectual humility is a central intellectual virtue in the pursuit of such statuses. After some introductory remarks, this paper provides an argument for epistemic anti-individualism with respect to a virtue-theoretic account of testimonial knowledge. An outline of a dual-aspect account of intellectual humility is then offered. The paper proceeds to argue that insofar as testimonial knowledge is concerned, this stripe of (...) epistemic anti-individualism leads to a particular account of intellectual humility. (shrink)

Some philosophers claim that propositions are simple—i.e., lack parts. In this paper, I argue that this claim is mistaken. I start with the widely accepted claim that propositions are the objects of beliefs. Then I argue that the objects of beliefs have parts. Thus, I conclude that propositions are not simple. My argument for the claim that the objects of beliefs have parts derives from the fact that beliefs are productive and systematic. This fact lurks in the background of debates (...) about the metaphysics of propositions. But its import for these debates has yet to be fully appreciated. So here I bring the point to the fore, and thus make manifest a powerful argument against simple propositions. (shrink)

Most people believe that consciousness is real. But illusionists say it isn’t—they say consciousness is an illusion. One common illusionist strategy for defending their view involves a debunking argument. They explain why people _believe_ that consciousness exists in a way that doesn’t imply that it _does_ exist; and, in so doing, they aim to show that that belief is unjustified. In this paper I argue that we can know consciousness exists even if these debunking arguments are sound. To do this, (...) I draw on the claim that some knowledge is constituted, not by beliefs in propositions, but by awareness of properties and objects. Then I argue that accepting this claim allows us to evade illusionists’ debunking arguments by allowing us to hold that our knowledge of consciousness does not depend solely on potentially debunked _beliefs_ in consciousness. Finally, while considering potential illusionist responses, I suggest that my strategy also yields a plausible account of our most basic knowledge of consciousness and an explanation for why so few people accept illusionism even when they have (or had) no decisive reply to illusionists’ arguments. Over the past twenty-five years, or so, considerable advances have been made in understanding how learning occurs in the brain, though much of this research is still to make its way into education. One contribution it should be making is to furnish the philosophical critique of past and current theory with supporting empirical evidence. For example, motivation theory and its cognate expectancy-value theory continue to be taught in teacher education, even though their rational cognitivist foundations are philosophically shaky, and their (...) shared representational notion of the mind is incompatible with what is now known about the learning brain. Furthermore, the central claim of motivation theory that children need to be motivated in order to learn is educationally problematic, not least because it incorporates a deficit model of the child as learner. This paper provides a philosophical and educational critique of motivation and expectancy-value theories and begins to sketch out an alternative dynamic systems approach, which argues that value is deeply embedded in the learning process, not only in the value students may or may not attach to their learning, but also neurobiologically. In opposition to motivation and its notion of the learner this paper argues that every student is equipped with a brain that is value-orientated towards learning and will learn, when nested in suitably affordant learning environments. In place of expectancy-value, we argue for value-embedded learning, which provides a non-reductive and biologically plausible account of how value and emotional salience are dynamically interwoven in the learning process. Vuyani Vellem was an outstanding Black Theologian of Liberation (BTL), who was approaching the zenith of his career when he died at the age of 50 years in 2019. This paper begins with a personal memoir to Prof. Vellem and a recognition that there is a lacuna in BTL relative to human sexuality issues. The contemporary global context of the human sexuality debate is discussed before the task of BTL in Vellem’s thinking is outlined. This is followed by an examination (...) of the situation in Africa and South Africa. Following this, the article proceeds to introduce the issue of human sexuality as a potential field of research in BTL and argues that the subject of human sexuality in the black community is a valid and appropriate topic for study and research by BTL. Contribution: This article raises pertinent issues regarding the development of a Black Theology of Liberation (BTL) which includes a proposal for the inclusion of LGBTI+ issues. It seeks to expand the understanding of the oppressed to include those who are oppressed as the result of gender issues. (shrink)

This article explores “pragmatic arguments” for theistic belief – that is, arguments for believing in God that appeal, not to evidence in favor of God’s existence, but rather to alleged practical benefits that come from belief in God. Central to this exploration is a consideration of Jeff Jordan’s recent defense of “the Jamesian wager,” which portrays itself as building on the case for belief presented in William James’s essay “The Will to Believe.” According to Jordan, religious belief creates significant gains (...) in this‐worldly happiness , and provided the individual does not have decisive evidence against God’s existence, these gains give the individual sufficient reason to strive to believe in God. In its exploration of this argument, the article presents an overview of recent social scientific work on the this‐worldly effects of religious belief. It canvases several challenges to pragmatic arguments, namely, a challenge according to which happiness rooted in false belief is worth less than that rooted in truth, a perfectionistic challenge alleging that one should strive for personal excellence rather than happiness, and a challenge alleging that any happiness gains of religious belief are outweighed by the potential harms brought about by religious belief. Over the past two decades, two heavily funded initiatives of the Federal government of Australia have been founded on two very different and seemingly conflicting (if not antithetical) visions of education. The first, the Australian Values Education Program (AVEP, 2003–2010) enshrines what may be called an ‘embedded values’ vision of education; the second, the National Assessments Program-Literacy and Numeracy (NAPLAN, 2008-present) enshrines a ‘performative’ vision. The purpose of this article is to unpack these two seemingly conflicting visions and to argue (...) instead for their possible consilience, bringing together apparently incompatible phenomena to coalesce into a single, more expansive vision of schooling. Against the historical context that gave rise to AVEP and NAPLAN in Australia, the article argues that the visions of education rendered in these abrupt policy shifts are vestiges of a history of dichotomous and dualistic thinking in western educational philosophy. Underpinning this dualism is a fundamental schism between cognition and emotion and a Cartesian separation of mind from body that can no longer be sustained. Our increased understanding of the neural substrates of cognition, the ‘intertwined’ nature of cognition and emotion, combined with a philosophy of mind that does not dissociate propositional knowledge from the disposition of the learner, points to an alternative vision of education. A vision that is thoroughly values embedded, concerned with the educational wellbeing of each child, while also giving value to and prioritising educational performance and achievement, and the intellectual liberation these can offer each and every child. To a large extent, this has been sparked by some exciting new proposals, such as the contextualist theories advanced by Stewart Cohen, Keith DeRose, David Lewis and Michael Williams, the modal conceptions of knowledge offered by Fred Dretske and Robert Nozick, and the virtue epistemologies put forward by John Greco, Ernest Sosa (...) and Linda Zagzebski, to name but three currently popular views. Increasingly, however, this rebirth in epistemological theorising has been driven less by the production of new theories and more by the application of the latest batch of novel proposals to other areas of philosophy. A good illustration of this from the selection of books under review here is the contemporary debate regarding the vexed relationship between content externalism and self-knowledge that is the 2 focus of the volume of essays edited by Susana Nuccetelli. Here we have a controversy that has blended some of the most innovative aspects of recent epistemological theorising with issues in the philosophy of mind and language, with the emphasis being on the so-called ‘McKinsey paradox’ concerning the putative incompatibility of content externalism and privileged self-knowledge. Whilst early responses to this supposed paradox concentrated on the formulation of the content externalist thesis whilst treating the epistemic concepts at issue as, essentially, primitives, more recent work in this area has drawn-out some of the epistemological implications of this debate and looked at how these implications fit in with recent movements in epistemology. Many of the articles collected in this volume are instances of this ‘second phase’ of the debate. In particular, it is tremendously useful to have the new articles by Martin Davies and Crispin Wright which revisit a previous exchange between the pair where some of the epistemological morals of the McKinsey debate were first extracted.. In this essay I explore some of the basic elements of consciousness from a substance dualist point of view, incorporating some elements of Kant's Transcendental Analytic into an overall account of the constitution of consciousness.

Most of the literature on the ethics of psychopharmacology has focused on the question of whether altering our emotions by using drugs is somehow inauthentic. In this essay I argue that this focus on authenticity is misplaced and that the more important question concerns the nature of the emotions themselves. I show that what one takes the emotions to be is possibly the most important factor in deciding whether or not psychopharmacology is morally problematic and, if so, why. I illustrate (...) how theories of the emotions determine the ethics of psychopharmacology, but deliberately take no stance on what the correct theory of the emotions is. My aim here is not to reach firm conclusions about the issues anti-depressants and similar drugs raise, but to set the terms for a more fruitful debate about these issues. (shrink)

This essay discusses recent attempts to show that Kant's philosophy is coherent and consistent on its own terms. This paper was read at the annual POH Symposium in Lake Wenatchee, WA in May, 2013.

Christian thought on the resolution of conflicts rests on a strong predisposition against violence and a determination to discourage outbreaks of violence, limit the means used, and bring the conflict to as speedy an end as possible. Less attention has been given to the psychological and social roots of violence, the moments of transition from violence to diplomacy and reconciliation, and alternative ways of conflict resolution. These three areas are explored with special reference to the use of sanctions, the WCC’s (...) Programme to Overcome Violence, the Truth and Reconciliation Commission in South Africa, Gandhian Satyagraha, and the Northern Ireland Peace Process. Such measures should be judged against the same criteria as are used in relation to violence and war. (shrink)
