According to a recent wave of work by legal anti-positivists, legal norms are a subset of moral norms. This striking “one-system” view of law has rapidly become the dominant form of anti-positivism, but its implications have so far been little tested. This article argues that the one-system view leads systematically to untenable conclusions about what legal rights and obligations we have. For many clear legal norms, the view lacks the resources to explain the existence of corresponding moral norms. And its (...) criteria for distinguishing legal norms within morality imply an under- or over-inclusive set of legal norms. I stress the special difficulties that apply beyond obligations, in the case of privileges and powers, and I show that the view's problems do not only—or mainly—concern egregiously unjust law, or indeed morally defective law at all. In Justification without Awareness (2006), Michael Bergmann presents a dilemma for internalism from which he claims there is “no escape”: The awareness allegedly required for justification is either strong awareness, which involves conceiving of some justification-contributor as relevant to the truth of a belief, or weak awareness, which does not. Bergmann argues that the former leads to an infinite regress of justifiers, while the latter conflicts with the “clearest and most compelling” motivation for endorsing internalism, namely, that for a belief (...) to be justified its truth must not be an accident from the subject’s perspective. Bergmann’s dilemma might initially seem to have the force of a knock-down argument against the classical foundationalist accounts he considers, if not against all forms of internalism. I argue, however, that the weak-awareness horn of Bergmann’s dilemma is unsuccessful. Classical foundationalists can hold on to the main motivation for internalism and avoid a vicious regress of justifiers. (shrink)

Although there are fundamental differences between Ahl al-Sunnah and Shī‘a on the issue of Mahdī, one of the controversial issues among Islamic sects, Shī‘a has attached much greater importance to the issue. In this study, after the information about Mahdiship in the primary sources of Islam is conveyed, the opinions of the Ahl al-Sunnah and Shī‘a will be given and an evaluation will be made about the evidence and opinions put forward by the two sects. The Shiites, who formed the (...) principles of belief based on the theory of imamate, explained the issue of Mahdism in the axis of imamate and gave it a religious dimension, but the Shi‘ī sects disagreed on the subject of Mahdī. Shi‘ī sources tried to show that the claim of Mahdiship is an important issue, which has preoccupied Muslims, by dating the claim of Mahdiship back to Ali ibn Abi Talib's son, Muhammad ibn Hanafiyah. In a very early period, it was claimed that Muhammad ibn Hanafiyya did not die but was still living on a mountain called Razva in Madinah, and he was the anticipated (muntaẓar) Mahdī. Most of the Zaydiyya did not consider the issue of Mahdiship an important fundamental basis of belief. Ismailiyya maintain that Muhammad ibn Ismail did not die and will come and amend the world one day. Imāmiyya believe that Hasan, whom they accept as the last imam, will reappear as the Mahdī in the latest days of the world, and in line with this belief, they have made great efforts to find proof from the Qur’ānic verses and hadiths and interpreted them. In this way, they attached more importance to the understanding of Mahdiship on the axis of imamate than the other Shi‘ī sects. According to Imāmiyya, since the world cannot be left without a prophet, an open, or a secret imam, Muhammad b. Hasan will remain hidden as long as he wants and appear as the Mahdī near the Doomsday. Based on the clear statement of the Messenger of Allah (pbuh) that twelve caliphs would come after him, the Imāmiyya restricted the number of Imams from Ahl al-Bayt to twelve and claimed that the twelfth imam would come again as Mahdī. Although the Imāmiyya believe that the Mahdī will be from the Ahl al-Bayt, just like the other imams, they have not been able to provide valid evidence for the belief that the twelfth imam will be hidden and appear near Judgment Day. Although Imāmiya tried/have been trying to prove that it is possible for a person to live for centuries (more than a thousand years), which is called al-Ghaybat al-Kubrā by Imamiyya, it cannot be said that they have succeeded in doing so. The coercive authority of the Kantian state is rationally grounded in the ideal of equal external freedom, which is realized when each individual can choose and act without being constrained by another's will. This ideal does not seem like it can justify state-mandated economic redistribution. For if one is externally free just as long as one can choose and act without being constrained by another, then only direct slavery, serfdom, or other systems of overt control seem to threaten external freedom. (...) Yet Kant endows the freedom-based state with considerable powers of economic redistribution. I argue that recent commentary has misunderstood both Kant's account of why poverty is a form of freedom-threatening dependence and the extent of the Kantian state's powers for remedying poverty. Criticizing Arthur Ripstein and the Kantianism of the “Toronto-School,” I argue that the most salient notion of dependence at issue within the Kantian framework is not the direct control of the choice-making capacities of another but asymmetrical influence in a power relationship. After the death of the Prophet, Muslims continued to apply the rulings deduced from the Qur'an and the Sunnah, and in matters they did not know, they turned to those who were more knowledgeable than themselves. As sects spread in the following period, some people saw this situation as taqlid and ignored the existence of sects. In the discussions that have continued until today, there are those who argue that the door of ijtihad is closed, as well as those who (...) want to expand the boundaries of ijtihad, especially during the periods of decline of Islamic countries. In the discussions that have continued until today, it has been stated that in order to achieve the bliss of this world and the hereafter, taqlid should be abandoned and the Prophetic teaching, which is universal, should be addressed one-to-one. Albānī (d. 1999), who lived in the last century, also put forward some views on the idea of ijtihad and taqlid. Although he opposed taqlid in general, he stated that scholars are tools guiding the Qur'an and Sunnah. Thus, he did not completely condemn taqlid, but criticised adherence to sects by stating that scholars should not be taken as a goal. According to Albānī, what is required for Muslims who cannot reach the level of ijtihad is not taqlīd but ittibā'. Therefore, to live and convey Islam, it should be communicated to both Muslims and non-Muslims not through sectarian perspectives, but by adhering to the SunnahAl-Albānī stated that the imams of the sects were not guilty of any offence in this matter and urged the jurists and mujtahids to act without adhering to a sect. However, the scholars affiliated to the sect thought that the ijtihad was hadith-centred and accepted following the sayings of the ulema of the past period within the sect as ittibā, not taqlid. However, al-Albānī acted consistently in his objections and criticisms and drew a moderate path for the reform of the ummah. Although some of his views portrayed him as an extreme scholar, he spent his life in the way of determining and understanding hadith and sunnah. (shrink)

The role of state in the contemporary global system is greatly shaped by its inner or domestic strength that include economic resilience, socio-political harmony and a stable constitutional political order. These attributes cannot be achieved by a state unless it assigns the highest priority to human and societal development and promotion of egalitarian socio-economic arrangements that provide equal opportunities to all citizens irrespective of ethnicity, language, religion, caste, region or gender. The focus is on transforming human resources into human capital (...) through education, learning of technology and skills, and health care. There is now a greater emphasis on good governance and a fair and transparent political management and delivery of basic services to the society. This covers policy making and implementation regarding a host of key issues. It is also important to ensure that the fruits of economic growth are fairly distributed in the society. The state must work towards removing socio-economic inequities and disparities among people and regions. This paper examines the major factors responsible for the growing emphasis in state policy on human and social development as well as the historical evolution of this change. It is argued that the political developments in the 1990s and later contributed most in creating a global awareness about human and societal developments. These include, inter alia, the end of the Cold War, the collapse of some states, the rise of religious and cultural extremism and terrorism and the efforts of the various organs and agencies of the United Nations to promote human development and social stability. The paper also identifies the major obstacles in the developing countries, especially in Pakistan, to socio-economic development and distributive justice. (shrink)

What is domination? According to a leading strand of republican political philosophy, a person is dominated when under the unconstrained power of another. Call this the dyadic conception of domination, because it involves a two‐person relation. I argue that domination is better understood structurally. Structural domination is domination by institutions. Rather than a master dominating a slave and a boss dominating a worker (as in dyadic domination), structural domination holds that the institution of slavery dominates the slave and labor law (...) dominates the worker. Without the structural conception, I contend, one misdescribes the power dynamics of paradigm cases of domination. (shrink)

In “Compassionate Phenomenal Conservatism” (2007), “Phenomenal Conservatism and the Internalist Intuition” (2006), and Skepticism and the Veil of Perception (2001), Michael Huemer endorses the principle of phenomenal conservatism, according to which appearances or seemings constitute a fundamental source of (defeasible) justification for belief. He claims that those who deny phenomenal conservatism, including classical foundationalists, are in a self-defeating position, for their views cannot be both true and justified; that classical foundationalists have difficulty accommodating false introspective beliefs; and that phenomenal conservatism (...) is most faithful to the central internalist intuition. I argue that Huemer’s self-defeat argument fails, that classical foundationalism is able to accommodate fallible introspective beliefs, and that classical foundationalism captures a relatively clear internalist intuition. I also show that the motivation for phenomenal conservatism is less than clear. (shrink)

In this paper, we distinguish between different sorts of assessments of algorithmic systems, describe our process of assessing such systems for ethical risk, and share some key challenges and lessons for future algorithm assessments and audits. Given the distinctive nature and function of a third-party audit, and the uncertain and shifting regulatory landscape, we suggest that second-party assessments are currently the primary mechanisms for analyzing the social impacts of systems that incorporate artificial intelligence. We then discuss two kinds of as-sessments: (...) an ethical risk assessment and a narrower, technical algo-rithmic bias assessment. We explain how the two assessments depend on each other, highlight the importance of situating the algorithm within its particular socio-technical context, and discuss a number of lessons and challenges for algorithm assessments and, potentially, for algorithm audits. The discussion builds on our team’s experience of advising and conducting ethical risk assessments for clients across dif-ferent industries in the last four years. Our main goal is to reflect on the key factors that are potentially ethically relevant in the use of algo-rithms, and draw lessons for the nascent algorithm assessment and audit industry, in the hope of helping all parties minimize the risk of harm from their use. A central project of traditional epistemology is to address skeptical questions and concerns regarding the rationality or epistemic justification of our empirical beliefs, especially beliefs regarding the external world, with the aim of understanding what makes it possible for such beliefs to have or lack justification, and of determining how much justification we have. A prominent anti-skeptical view in the history of epistemology, a view I shall call classical foundationalism, can be distinguished from other more contemporary versions of foundationalism in (...) part on the basis of two central commitments: (i) the traditional methodological commitment to carry out the project of addressing skepticism “from the armchair,” i.e., on the basis of what can be determined by a posteriori deliverances of introspection and a priori use of reason and reflection, without relying on empirical or scientific research that presupposes the existence of any external world of material objects (including armchairs); and (ii) a substantive commitment to the doctrine of the given, understood roughly as the view that empirical beliefs ultimately depend for their justification on a direct or immediate awareness of reasons to think these beliefs true, reasons simply “given” to us in conscious experience. -/- There has been a recent resurgence of interest in classical or “old-fashioned” varieties of foundationalism, and the debate seems, in some ways, to be repeating itself. Critics object that these attempted resurrections of classical foundationalism are just attempts to square the same old circles.”They argue that there are decisive or clearly sufficient reasons to deny that such a view can be right, let alone that an adequate theory can be developed that is defensible in all its essential details. I think that these critics are either missing the point of the traditional project, misunderstanding classical foundationalism, or exaggerating the severity of the problems they raise. -/- I will show that a number of common arguments against classical foundationalism are not nearly as worrisome as their proponents think. In Chapter 2, I defend classical foundationalism against the Sellarsian dilemma, and provide prima facie support from examples for the availability of foundational empirical beliefs. I then discuss some recent classical foundationalist accounts of the justification of foundational beliefs, argue that these accounts are less than satisfactory, and develop an account of my own. In Chapter 3 I defend classical foundationalism, as a version of internalism, against Bergmann’s recent dilemma for internalism. Finally, in Chapter 4, I take up the issue of skepticism about the external world, and, in closing, the related issue of whether any beliefs about the external world can themselves be empirically foundational. Rehabilitation for disabled children requires long-term programmeswhich are expensive to the family. This study aimed to estimate the costincurred by caregivers’ children with disabilities from Pahang, Terengganu andKelantan participating in Community-Based Rehabilitation and cost of seeking alternative rehabilitation. Costanalysis using the Activity-Based Costing method was used to estimatetwelve-months’ expenditure in 2014 institutional year on 297 caregivers ofchildren with disability, aged 0 to 18 years who attended CBR. Data werecollected using a self-administered costing questionnaire and presentedin median. Results showed that the (...) median direct and indirect costs,excluding medications and alternative care were nearly four times as highin Home-Based compared to Centre-Based vs. RM608. Both groups of caregivers spent a significant amount ofresources on alternative rehabilitation. The high costs incurred for alternativerehabilitation is a major economic burden to the family. Madani surahs generally describe the process in which various rules related to the regulation of the moral dimension of religion are determined. Some of the divine declarations made in this framework consist of rules and principles in the nature of command and prohibition. These statements, which have a normative character, also contain some evaluations about the attitudes of the interlocutors in relation to the events that took place in the period of descent. The warnings against the words and actions of (...) believers, which cannot coincide with faith, are among the most striking subjects of the Madani surahs. It is striking that these warnings, which sometimes increase in severity, generally focus on the economic concerns, demands and expectations of the believers. The increase in the welfare level with the Hijra, the inability of the new converts to fully comprehend the teachings of the religion, and the negative effect of the Jahiliyya tradition are among the main reasons for warnings against believers. On the other hand, these warnings and criticisms, which point to the weakness of speech and action, aim to prompt the believers to question their attitudes and stances by determining the ideal style of behavior compatible with faith, rather than merely condemning. In this respect, the article aims to examine the relationship of believers with worldly possibilities and material blessings in the axis of this differing dimension of Madani surahs. (shrink)

This study treats firm productivity as an accumulation of productive intangibles and posits that stakeholder engagement associated with better corporate social performance helps develop such intangibles. We hypothesize that because shareholders factor improved productive efficiency into stock price, productivity mediates the relationship between corporate social and financial performance. Furthermore, we argue that key stakeholders’ social considerations are more valuable for firms with higher levels of discretionary cash and income stream uncertainty. Therefore, we hypothesize that those two contingencies moderate the mediated (...) process of corporate social performance with financial performance. Our analysis, based on a comprehensive longitudinal dataset of the U.S. manufacturing firms from 1992 to 2009, lends strong support for these hypotheses. In short, this paper uncovers a productivity-based, context-dependent mechanism underlying the relationship between corporate social performance and financial performance. (shrink)

I argue that, given the way that AI models work and the way that ordinary human rationality works, it is very likely that people are anthropomorphizing AI, with potentially serious consequences. There are good reasons to doubt that LLMs have anything like human understanding, and even if they have representations or meaningful contents in some sense, these are unlikely to correspond to our ordinary understanding of natural language. However, there are natural, and in some ways quite rational, pressures to anthropomorphize (...) or personify LLMs and other AI systems in biased ways. This includes not only the classical or obvious ways of personifying AI — taking them to be sentient or have consciousness and understanding — but also taking AI to simulate or function like understanding, track the meaning of our language and our reasoning or logic, or have a model of the world our language is about. These more subtle or unobvious forms of anthropomorphism or personification can contribute to automation bias, AI Hype, and all their attendant risks, and encourage stronger anthropomorphisms as multi-modal AI assistants are developed further. This article seeks to determine whether PT Freeport Indonesia, an operating subsidiary of Freeport-McMoRan Copper and Gold Inc., has acted in environmentally and socially responsible ways in the context of its operations in Papua, Indonesia, and how well it has responded to the legacy left by its less responsible operations from 1973 until the mid-1990s. This objective is achieved by examining the company's impact on the resources and assets with which it comes into contact as part of its operations, as (...) well as through a historical review of the province of Papua and its incorporation into Indonesia, Freeport's entry into Papua, and the company's engagement with international and Indonesian politics. In this article, I criticize Rawls’s well-ordered society for failing to secure a right to meaningful work. I critically discuss five technical Rawlsian ideas: self-respect, social union, the difference principle, the powers and prerogatives of office, and fair equality of opportunity. I then claim that radical restructuring of the workplace conflicts with Rawls’s individualistic understanding of freedom. Briefly drawing on Hegel, an under-recognized historical influence on Rawls, I then correct Rawls by arguing for a conception of freedom that is internally (...) related to broader solidaristic values associated with meaningful work. This paper presents a new boosting algorithm called NormalBoost which is capable of classifying a multi-dimensional binary class dataset. It adaptively combines several weak classifiers to form a strong classifier. Unlike many boosting algorithms which have high computation and memory complexities, NormalBoost is capable of classification with low complexity. Since NormalBoost assumes the dataset to be continuous, it is also noise resistant because it only deals with the means and standard deviations of each dimension. Experiments conducted to evaluate its performance (...) shows that NormalBoost performs almost the same as AdaBoost in the classification rate. However, NormalBoost performs 189 times faster than AdaBoost and employs a very little amount of memory when a dataset of 2 million samples with 50 dimensions is invoked. (shrink)
