Research exists on how a corporation communicates during a crisis, the impact on its reputation, and how well it weathers that crisis. However, crisis communication research tends to view a company’s communication efforts from the standpoint of success or failure; looking at the communication critically to determine if the company’s power influences or silences potentially alternative voices and viewpoints is not currently part of the discussion. This article argues that critical discourse analysis techniques be added to the framework of crisis (...) communication theory in an effort to ensure that the corporation’s message or position of power does not unfairly marginalize or altogether silence alternative discourses. Contemporary philosophers and scientists have done much to expand our understanding of the structure and neural mechanisms of joint action. But the phenomenology of joint action has only recently become a live topic for research. One method of clarifying what is unique about the phenomenology of joint action is by considering the alternative perspective of agents subsumed in group action. By group action we mean instances of individual agents acting while embedded within a group agent, instead of with individual coordination. (...) Paradigm examples are educational bureaucracies, corporations, and nation states. There is a phenomenological difference between agents whose actions are subsumed within a group action (“the university did X”) as compared to agents who act jointly (“we did x”). Attending to this difference clarifies what is phenomenologically distinctive about joint action. Appealing to an Aristotelian account of agency and to the metaphysical concept of weak emergence, we argue that what makes paradigmatic group action distinctive is the relative inaccessibility, un-revisability, and evaluative simplicity of the group agent’s goal(s) from the perspective of individual agents. This suggests that a distinctive feature of joint agency is the maintenance of a greater sense of individual agency. Put simply, joint agency is often experienced as an enhancement of the individuals’ agency precisely because our paradigmatic agential powers are extended intersubjectively as we act together. In contrast, group agency often involves a loss of the sense of agency, precisely because it is the emergent group agent that maintains the agential powers. (shrink)

Evidence-based law seeks to make best use of evidence to assess the effectiveness of laws and regulations. The question arises as to how exactly to make best use of evidence. This paper argues that Evidential Pluralism provides an answer to this question and can thus provide philosophical foundations for evidence-based law. Evidential Pluralism is a theory of causal enquiry which maintains that one needs to scrutinise mechanistic studies alongside the experimental and observational studies that are the focus of present-day evidence-based (...) medicine and evidence-based policy. The paper develops a new approach to evidence-based law, called EBL+, based on the principles of Evidential Pluralism. Three examples show how the proposed methods work: banning hand-held mobile phone use while driving, sugar tax, and face-mask mandates for controlling Covid-19. (shrink)

The aim of this paper is to argue that Evidential Pluralism ought to be used to evaluate the impact of online fake news. To support this, I show how an application of Evidential Pluralism can overcome difficulties in assessing the impact of online fake news. The significance of this is twofold. Firstly, the application of Evidential Pluralism enables an evidence-based justification for legal interventions aimed at tackling online fake news. Secondly, the application of Evidential Pluralism to the problem of online (...) fake news provides a case study example to motivate a new methodology for evidence-based law, called EBL+. (shrink)

This is the book of abstracts of the 19th Brazilian Logic Conferences. The Brazilian Logic Conferences (EBL) is one of the most traditional logic conferences in South America. Organized by the Brazilian Logic Society (SBL), its main goal is to promote the dissemination of research in logic in a broad sense. It has been occurring since 1979, congregating logicians of different fields — mostly philosophy, mathematics and computer science — and with different backgrounds — from undergraduate students to senior researchers. The areas of logic covered in the conference spread over foundations and philosophy of science, analytic philosophy, philosophy and history of logic, mathematics, computer science, informatics, linguistics and artificial intelligence. In this paper we discuss a view of the Machine Learning technique called Explanation-Based Learning (EBL) or Explanation-Based Generalization (EBG) as a process for the interpretation of vague concepts in logic-based models of law.The open-textured nature of legal terms is a well-known open problem in the building of knowledge-based legal systems. EBG is a technique which creates generalizations of given examples on the basis of background domain knowledge. We relate these two topics by considering EBG''s domain knowledge as corresponding to (...) statute law rules, and EBG''s training example as corresponding to a precedent case. (shrink)
