In this paper I argue that we should look to Hobbes rather than to Locke as providing a philosophical forerunner of modern and current rights theories and further, that Hobbes’s theory has relevance to and ‘speaks to’ current philosophical and jurisprudential analysis of the foundations of rights, in a way that Locke’s theory cannot. First, I summarise the argument that Hobbes does have a substantive theory of individual rights. Second, I argue that the project undertaken by A. J. Simmons, (...) to ‘reconstruct’ Locke’s theory of rights without the theological premises, cannot succeed. Locke’s theory of natural rights is thoroughly dependent on its theological premises. Third, I argue that Hobbes’s theory of rights is not dependent on theological premises. Finally, I try to illustrate the ways in which Hobbes’s theory is still relevant and useful for current debates within rights theory. (shrink)

John Locke's political theory has been the subject of many detailed treatments by philosophers and political scientists. But The Lockean Theory of Rights is the first systematic, full-length study of Locke's theory of rights and of its potential for making genuine contributions to contemporary debates about rights and their place in political philosophy. Given that the rights of persons are the central moral concept at work in Locke's and Lockean political philosophy, such a study is long overdue.

It is puzzling, then, to find him arguing in Meditation VI that human beings have sensations in order to preserve the union of mind and body (AT VII 83). 1 This appears (...) to be just the sort of teleological explanation that he proscribes. Descartes' Anglo-American commentators have had little to say about the teleological overtones of his claims about sensation. His French commentators acknowledge these overtones, but seem largely untroubled by them. 2 It is worth pausing to be troubled, for a closer analysis reveals that Descartes' famous proscription against teleology is not as simple as it is generally thought to be. In the first half of this essay, I argue that Descartes advocates a genuinely teleological conception of the senses. My aim is not to charge Descartes with employing illicit teleology, but to argue that there is a place for teleology even in his revisionist natural philosophy. Accordingly, in the second half of this essay, I argue that Descartes' assault on teleological explanation is [End Page 49] not a sweeping assault on finality, but a more directed attack on particular uses of ends in natural philosophy. Descartes' assault leaves standing a form of teleological explanation that proves crucial to his own treatment of sensation. 1. Descartes' Rejection of Teleological Explanation at a Glance A teleological explanation is one that purports to account for something in terms of its ends or its function relative to the ends of the system of which it is a part. Aristotle's physics provides many classic examples: plants produce leaves for the protection of their fruit; spiders spin webs in order to catch food; animals grow sharp front teeth and dull back teeth in order to facilitate biting and chewing respectively; eyes are for seeing. According to Aristotle, all natural phenomena are directed toward ends and no explanation is complete without a teleological component that specifies the end for the sake of which the phenomenon occurs. Indeed ends take explanatory priorityover other causes: "Both causes [the end and the matter] must be stated by the student of nature, but especially the end; for that is the cause of the matter, not vice versa." 3 And: [T]he causes concerned in natural generation are, as we see, more than one. There is the cause for the sake of which [the end], and the cause whence the beginning of motion comes [the efficient cause]. Now we must decide which of these two causes comes first, which second. Plainly, however, that cause is the first which we call that for the sake of which. For this is the account of the thing, and the account forms the starting-point.4In other words, Aristotle argues that natural substances have the matter they do, have the parts or organs they do, are organized as they are and act as they do for the sake of their ends. To explain why things are as they are, the natural philosopher must therefore explain the ways in which they contribute to ends.Among the late scholastic Aristotelians familiar to Descartes there is considerable debate concerning the causal efficacy of ends. Genuine final causation, in which something is said to be acted on by an end, is limited to the intentional behavior of rational agents who consciously recognize their ends: only something that recognizes an end can be "moved" by one. In this paper, we reflect on the disciplinary contours of contemporary sociology, and social science more generally, in the age of ‘big and broad’ social data. Our aim is to suggest how sociology and social sciences may respond to the challenges and opportunities presented by this ‘data deluge’ in ways that are innovative yet sensitive to the social and ethical life of data and methods. We begin by reviewing relevant contemporary methodological debates and consider how they relate to the emergence (...) of big and broad social data as a product, reflexive artefact and organizational feature of emerging global digital society. We then explore the challenges and opportunities afforded to social science through the widespread adoption of a new generation of distributed, digital technologies and the gathering momentum of the open data movement, grounding our observations in the work of the Collaborative Online Social Media ObServatory project. In conclusion, we argue that these challenges and opportunities motivate a renewed interest in the programme for a ‘public sociology’, characterized by the co-production of social scientific knowledge involving a broad range of actors and publics. ‘Rights and Territories: A Reply to Nine, Miller, and Stilz’ defends the Lockean theory of states’ territorial rights (as this theory was presented in Boundaries of Authority) against the critiques of Nine, Miller, and Stilz. In response to Nine’s concern that such a Lockean theory cannot justify the right of legitimate states to exclude aliens, it is argued that a consent-based theory like the Lockean one is flexible enough to justify a wide range of possible incidents of territorial rights – (...) importantly including, though not necessarily including, the sort of right to exclude aliens that is familiar from actual political practice. Miller’s criticisms are more wide-ranging. In response, the article argues that Lockean labor-based property rights are both stronger and more enduring than Miller suggests and that nationalism’s resources for dealing with concerns about rights-supersession and trapped minorities are importantly overstated by Miller. Against Stilz’s Kantian, ‘presentist’ account of states’ authority over persons and territories, it is argued that the rectification of past (historical) wrongs remains morally crucial even in the context of otherwise-just societies and that Stilz’s Kantian/rawlsian position unconvincingly privileges the rights to autonomy of territorially concentrated groups over those of dissenting individuals or wrongfully dispersed groups. Ontological pluralism is the view that there are different fundamental ways of being. Trenton Merricks has recently raised three objections to combining pluralism with a generic way of being enjoyed by absolutely everything there is: first, that the resulting view contradicts the pluralist’s core intuition; second, that it is especially vulnerable to the charge—due to Peter van Inwagen—that it posits a difference in being where there is simply a difference in kind; and, third, that it is in tension with various (...) historically influential motivations for pluralism. This book is about one of the most baffling of all paradoxes – the famous Liar paradox. Suppose we say: 'We are lying now'. Then if we are lying, we are telling the truth; and if we are telling the truth we are lying. This paradox is more than an intriguing puzzle, since it involves the concept of truth. Thus any coherent theory of truth must deal with the Liar. Keith Simmons discusses the solutions proposed by medieval philosophers and (...) offers his own solutions and in the process assesses other attempts to solve the paradox. Unlike such attempts, Simmons' 'singularity' solution does not abandon classical semantics and does not appeal to the kind of hierarchical view found in Barwise's and Etchemendy's The Liar. Moreover, Simmons' solution resolves the vexing problem of semantic universality – the problem of whether there are semantic concepts beyond the expressive reach of a natural language such as English. In contemporary philosophy, “fictional worlds” are one solution to the problem of how there can be true and false judgments about fictional characters. Fictional-world accounts generally disregard whether facts are explicitly stated in the story or not; it is enough for them to be logically implied. And yet, as Ruth Lorand has observed, whether a fact is stated or merely implied changes the meaning of a story. Pessimism is, roughly, the view that life is not worth living. In chapter 46 of the second volume of The World as Will and Representation, Arthur Schopenhauer provides an oft-neglected argument for this view. The argument is that a life is worth living only if it does not contain any uncompensated evils; but since all our lives happen to contain such evils, none of them are worth living. The now standard interpretation of this argument (endorsed by Kuno Fischer and Christopher (...) Janaway) proceeds from the claim that the value—or rather valuelessness—of life’s goods makes compensation impossible. But this interpretation is neither philosophically attractive nor faithful to the text. In this paper, I develop and defend an alternative interpretation (suggested by Wilhelm Windelband and Mark Migotti) according to which it is instead the actual temporal arrangement of life’s goods and evils that makes compensation impossible. In this essay I will discuss the relationship between two of the most basic ideas in political and legal philosophy: the justification of the state and state legitimacy. I plainly cannot aspire here to a complete account of these matters; but I hope to be able to say enough to motivate a way of thinking about the relation between these notions that is, I believe, superior to the approach which seems to be dominant in contemporary political philosophy. Today showing that (...) a state is justified and showing that it is legitimate are typically taken to require the very same arguments. I will argue that this contemporary stance obscures the difference between two central ways in which we should morally evaluate states, and it generates confusions about other serious practical issues, such as those surrounding our moral obligations to comply with law. I begin with brief discussions of the ideas of justification and legitimacy and with an attempt to capture what ought to be most central in our concerns about these ideas. I turn then to two basic ways of thinking about the relation between justification and legitimacy that I want to distinguish: what I will call the Lockean and the Kantian approaches. Next, I argue that the minority Lockean approach to this issue captures essential features of institutional evaluation that the majority Kantian approach does not; and I add brief mention of one further complication facing any adequate account of political evaluation. Optimism and pessimism are two diametrically opposed views about the value of existence. Optimists maintain that existence is better than non-existence, while pessimists hold that it is worse. Arthur Schopenhauer put forward a variety of arguments against optimism and for pessimism. I will offer a synoptic reading of these arguments, which aims to show that while Schopenhauer’s case against optimism primarily focuses on the value or disvalue of life’s contents, his case for pessimism focuses on the ways in which life (...) as a whole is structurally defective. The book takes the form of an anthology of stories, divided into chapters, that are grouped according to a certain right; for example, the right to bodily autonomy. This format effectively guides the reader from abortion to abolition. Paynter adroitly starts the book with white feminist favorites such as bodily autonomy and not having children. Then she logically progresses to more radical ideas such as parenting in prison and the total abolition of prisons. The stories in this book are accompanied by warm, colorful illustrations by Julia Hunt. These drawings help the reader visualize the person behind the story and the very real life that was affected by reproductive law and/or social norms. Paynter holds a PhD in nursing, and it is from this background that she writes, seeking to educate nurses and other healthcare professionals alongside a broader readership garnered through her clear, approachable writing style.Chapter 1 introduces the reader to many of the book's key themes by considering the right and need to have bodily autonomy, and the multiple ways this manifests itself in ordinary (and less-ordinary) life. Paynter considers the disparate stories of five women, all fighting in some way for bodily autonomy. The stories cover events of gender-based gun violence, sexual assault, transgender rights in prison, the legalization of sex work, police violence, and institutional racism. Each story recounted by Paynter catalogs tragedies and injustices with blunt and brutal honesty—perhaps to an unnecessary extent. Every horrific fact is laid bare for the readers as they uncover the intricacies of gender-based, imperialist, and racist violence. Paynter has chosen these stories to display the multitude of ways in which people—especially Black, Indigenous, people of color (BIPOC) and minoritized genders—can be willfully wronged by the state and [End Page 209] the criminal justice system, such that the reader must begin to confront the fact that these structures don't seem to exist to benefit or protect the most marginalized in society.Chapter 2 approaches the right not to have children through a number of stories related to contraception, abortion, and family planning. Paynter sketches some of the key points in Canada's journey toward the decriminalization of abortion, from paradoxical trailblazers, such as Dr. Emily Stowe in the 1800s, to the viral memefied content of art protestor iamkarats. While the unequivocal legality of abortion in Canada suggests incredible progressiveness and support for women's rights, Paynter paints a more complex picture through her chosen narratives. Crucially, the inequitable geographical access to abortion, in particular, throughout the huge landmass of Canada suggests that the right to not have children in Canada is not universal. Moreover, Paynter suggests that access is also bounded by financial constraints, finite public funding, and the limited availability of inclusive clinics that prioritize healthcare for LGBTQ2S+ people.Chapter 3 considers the topic of having children; in particular, the right to reproductive technologies and freedom from forced sterilization. Paynter quickly makes clear that while many white feminists might see having and not having children as diametrically opposed, they are two equally essential parts of reproductive justice. Paynter draws attention to the Sexual Sterilization Act of 1928 that was only overturned in 1972. She describes it as part of the "genocidal colonial project" (84), a collection of laws and policies aimed at fulfilling eugenicist, neoimperial ideals of increasing production of the white "race" and promoting the genocide of Indigenous peoples. Furthermore, Paynter argues that evidence of forced sterilization of Indigenous peoples, and other physical violence and neglect, persists to the present day and must be stopped and reparations made for previous harms. In Simmons (Arch Math Logic 43:65–83, 2004), I described a method of producing ordinal notations ‘from below’ (for countable ordinals up to the Howard ordinal) and compared that method with the current popular ‘from above’ method which uses a collapsing function from uncountable ordinals. This ‘from below’ method employs a slight generalization of the normal function—the fruitful functions—and what seems to be a new class of functions—the helpful functions—which exist at all levels of the function space hierarchy over ordinals. (...) Unfortunately, I was rather sparing in my description of these classes of functions. In this paper I am much more generous. I describe the properties of the helpful functions on all finite levels and, in the final section, indicate how they can be used to simplify the generation of ordinal notations. The main aim of this paper is to fill in the details missing from [7]. The secondary aim is to indicate what can be done with helpful functions. Using as a framework the logical treatment of causality in the Buddhist Madhyamika, a theory of the psychology of event coherence and causal connectedness is developed, and suggestive experimental evidence is offered. The basic claim is that events are perceived as coherent and causally bound to the extent that the outcome is seen to be already contained in the ground of the event in some form and the connecting link between them is seen as the appropriate means for changing the (...) outcome-in-the-ground to the outcome-as-perceived. There are four types of such connections: the identity of the object in the ground and outcome is seen as the same ; a property is seen to be transferred from ground to outcome ; for animate beings, a cognitive representation and a state of the world are seen to match - either the representation-as-outcome coming to match the world-as-ground or the world-as-outcome coming to match the representation-as-ground ; the `essence' of a category is seen to manifest itself . The standard critique of such coherence explanations is that they are tautological. We demonstrate that `nontautological' scientific accounts become convincing coherent explanations only to he extent that the outcome is re-introduced into the ground. Explanations which are noncausal altogether, such as probability or chance, are shown to be psychologically unstable. This critique suggests some new perspectives on causal thinking both in the cognitive sciences and the folk theories of daily life. (shrink)

This book aims to provide a solution to the semantic paradoxes. It argues for a unified solution to the paradoxes generated by our concepts of denotation, predicate extension, and truth. The solution makes two main claims. The first is that our semantic expressions 'denotes', 'extension' and 'true' are context-sensitive. The second, inspired by a brief, tantalizing remark of Godel's, is that these expressions are significant everywhere except for certain singularities, in analogy with division by zero. A formal theory of singularities (...) is presented and applied to a wide variety of versions of the definability paradoxes, Russell's paradox, and the Liar paradox. Keith Simmons argues that the singularity theory satisfies the following desiderata: it recognizes that the proper setting of the semantic paradoxes is natural language, not regimented formal languages; it minimizes any revision to our semantic concepts; it respects as far as possible Tarski's intuition that natural languages are universal; it responds adequately to the threat of revenge paradoxes; and it preserves classical logic and semantics. Simmons draws out the consequences of the singularity theory for deflationary views of our semantic concepts, and concludes that if we accept the singularity theory, we must reject deflationism.
