Utilitarianism has been widely accused of inadequately treating the problem of human rights. One main criticism has been, that it could not account for acceptable institutions of legal punishment. Though the utilitarian position seems to be untenable it contains some sound points - above all its consequentialist metaethics. The central weakness of “rightbased” justifications of the criminal sanction on the other hand seems to be that they do not give due place to the consequences of alternative institutional settings. But it (...) seems to be possible to establish a right-based and consequentialist moral theory of legal punishment leading to an acceptable practice of punishment - though not necessarily the one we are acquainted with. It is held that absolute poverty causes approximately one third of all human deaths, some 18 million annually, and blights billions of lives with hunger and disease. This book develops universalizable norms aimed at tackling absolute poverty and the complex and multilayered problems associated with it.

Classifying accounts of institutionalized social norms that rely on individual rule-following as ‘sociological’ and accounts based on individual opportunity-seeking behavior as ‘economic’, the paper rejects purely economic accounts on theoretical grounds. Explaining the realworkings of institutionalized social norms and social order exclusively in terms of self-regarding opportunityseeking individual behavior is impossible. An integrated sociological approach to the so-called Hobbesian problem of social order that incorporates opportunityseeking along with rule-following behavior is necessary. With a focus on how national identity impacts the decision-making of the European Court of Justice, Elke Cloots provides an innovative adjudication scheme that purports to assist the ECJ in its search for a proper balance between respect for national identity and European integration.

Several authors have argued that traumatic experiences are processed and remembered in a qualitatively different way from neutral events. To investigate this issue, we interviewed 121 Croatian war veterans diagnosed with posttraumatic stress disorder about amnesia, intrusions , and the sensory qualities of their most horrific war memories. Additionally, they completed a self-report scale measuring dissociative experiences. In contrast to what one would expect on the basis of theories emphasizing the special status of traumatic memories, amnesia, and high frequency intrusions (...) were not particularly typical for our sample of traumatized individuals. Moreover, traumatic memories were not qualitatively different from neutral memories with respect to their stability and sensory qualities. The severity of PTSD symptoms was not significantly correlated with dissociative experiences. Our findings do not support the existence of special memory mechanisms that are unique to experiencing traumatic events. (shrink)

I begin with an explication of "thought experiment". I then clarify the role that intuitions play in thought experiments by addressing two important issues: (1) the informativeness of thought experiments and (2) the legitimacy of the method of thought experiments in philosophy and the natural sciences. I defend a naturalistic account of intuitions that provides a plausible explanation of the informativeness of thought experiments, which, in turn, allows thought experiments to be reconstructed as arguments. I also specify criteria for distinguishing (...) bad "intuition pumps" from legitimate thought experiments. These criteria help us to avoid being seduced by the dangerous suggestive power of misleading intuitions. (shrink)

This study investigates the function of the recourse to the messianic tradition of Judaism among German-Jewish intellectuals between 1900 and 1933. Messianic figures of thought play an important role in the Jewish discourse of identity. Moreover, they are used productively in the creation of general theories in the realm of cultural studies. The messianic figures of speech include not only figures of thought but also rhetorical figures of speech or tropes that reflect various constellations of sacrality and secularity in the (...) modern era. The increasingly wide spread use of RCM, rational choice modeling, and RCT, rational choice theory, in disciplines like economics, law, ethics, psychology, sociology, political science, management facilitates interdisciplinary exchange. This is a great achievement. Yet it nurtures the hope that a unified account of rational active choice making might arise from ‘reason’ in terms of intuitively appealing axioms. Such ‘rationalist’ characterizations of rational choice neglect real human practices and empirical accounts of those practices. This is theoretically misleading and practically dangerous. (...) Was ist Wissen? Wie gelangen wir zu Wissen? Warum ist Wissen eigentlich erstrebenswert? Ist Wissen überhaupt möglich? Ausgehend von diesen traditionellen philosophischen Fragen nach der Natur, den Quellen, dem Wert sowie den Möglichkeiten und Grenzen des menschlichen Wissens, untersucht die Autorin die zentralen Positionen und aktuellen Debatten gegenwärtiger Wissenstheorien. Dabei werden wichtige epistemische Paradoxien des Wissens, der Wissensskeptizismus und die systematischen Beziehungen zwischen Wissen und Rationalität sowie zwischen Wissen und Zufall analysiert. Behandelt werden zudem Konzeptionen im Rahmen neuerer erkenntnistheoretischer Strömungen (...) (z. B. Reliabilismus, Kontextualismus, Tugenderkenntnistheorie und Soziale Erkenntnistheorie). Die Analyse zeigt, dass in einer philosophisch befriedigenden Wissenstheorie sowohl die sokratische Suche nach einer endgültigen Definition von Wissen als auch das cartesische Ideal von Wissen als Form einer absoluten Gewissheit aufgegeben werden muss. In ihrem eigenen Ansatz argumentiert Brendel für einen kontextabhängigen Wissensbegriff, der eine wahre und epistemisch nicht zufällige Überzeugung zum Ausdruck bringt. (shrink)

The greatest risks of Covid-19 are not arising from its direct effects on morbidity and mortality but from exaggerated aspirations to control such effects politically. A swift transformation from an epidemic to an endemic state of affairs may in case of a disease with comparatively low and unequally distributed mortality like covid-19 be an option, too. This needs to be laid out but it is not the task of science to plead for this or any other option.

Anthony de Jasay's work has been enormously influential, describing both a theoretical philosophical model for a stateless, liberal, free market order and offering analysis of and solutions to many of the technical economic problems associated with such a vision of society. In this book, ten significant scholars in philosophy and political economy pay tribute to the man and his work in a series of essays at once both respectful and critical.

To facilitate access for the wider international audience interested in issues of organ allocation the texts in this volume are all in English. But in view of the fact that Analyse & Kritik, though an international journal, is published in Germany it seemed appropriate to provide a German introduction and overview. This overview outlines the background of organ donation and transplantation as seems useful for the ‚uninitiated‘ reader and positions the papers of the volume on the intellectual map. Conceptualizing behavior decision theoretically as being ‘pulled’ (by an expected future) is fundamentally different from conceptualizing it as ‘pushed’ (or determined by past conditions according to causal laws). However, the fundamental distinction between teleological and non-teleological explanations not withstanding, decision-theoretic and evolutionary ‘ways of world making’ lead to strikingly similar forms of political, philosophical, and economic models. Common Hobbesian roots can account historically for the emergence of such a common ‘PPE’ outlook, while a game-theoretic framework of indirect evolution can accommodate (...) the fundamental methodological tension between teleological and non-teleological approaches or the ‘humanities’ and the ‘science’ traditions in PPE’s disciplines. This article deals with the incompatibility of Christian and Jewish stereotypes in asceticism and tries to establish new models for approaching ascetic tendencies within the latter. In the context of halachic regulations we examine different ascetic aspects within Judaism, with a special focus on medieval Spain. In this area we observe a certain interaction between Jewish and Sufi trends, esp. in the works of Bachja ibn Paquda, Abraham bar Chijja and Abraham Maimonides. In the works of these authors we find (...) tripartite models of asceticism which signify the path to the deity. In a comparison with Sufi texts such as those of Al-Gazali, the three levels of repentance/law, meditation/path and the recognition of the divine truth are shown to be intertwined in a similar way, and all describe the way of the philosopher or mystic to the highest knowledge. In a further section this tripartite schema is compared to kabbalistic texts with their ideas of ascent and union with the divine within ecstatic kabbalah. In the first example we observe how an erotic impulse may lead to an ascetic way of life and how the horizontal move out of society leads to a vertical ascent of the soul and the foundation of a new, mobile society. In the second text we also detect the three intertwined stages of our model and see how ascetic preparations lead to an erotic union of the mystic’s soul with the divine intellect. Asceticism is described in both texts as a mode of transformation and the path between two extremes, which finally leads to intimate knowledge of the deity. (shrink)

Cultural values influence how people understand illness and dying, and impact their responses to diagnosis and treatment, yet end-of-life care is rooted in white, middle class values. Faith, hope, and belief in God’s healing power are central to most African Americans, yet life-preserving care is considered “aggressive” by the healthcare system, and families are pressured to cease it.

Extending a strategy previously used by Clancy, Schacter, McNally, and Pitman , we administered a neutral and a trauma-related version of the Deese–Roediger–McDermott paradigm to a sample of women reporting recovered or repressed memories of childhood sexual abuse , women reporting having always remembered their abuse , and women reporting no history of abuse . We found that individuals reporting recovered memories of CSA are more prone than other participants to falsely recalling and recognizing neutral words that were never presented. (...) Moreover, our study is the first to show that this finding even held when trauma-related material was involved. Correlational analyses revealed that fantasy proneness, but not self-reported traumatic experiences and dissociative symptoms were related to false recall and false recognition. (shrink)

"Philosophy and Economics I," treats "Methods and Models" of "Economic Philosophy." "Philosophy and Economics II" deals with "Morals." In both cases an effort to integrate many strands of modern philosophy and economics via decision theoretic language is made. Regardless of this decision theoretic background the treatment is non-technical. The aspiration is to sketch some tools that may be used in search of what philosophers call a "wide reflective equilibrium" on foundational matters of economics as well as of philosophy. The presentation (...) will enable an advanced undergraduate or beginning graduate student from fields like, philosophy, economics, law, political science and sociology to use the tools, arguments and paradigm examples provided to search for her or his own reflective equilibrium on matters of economic philosophy. Specialists from the aforementioned fields may find the text useful, too, as an accessible account of an increasingly elaborate intellectual discourse on "philosophy, politics and economics.". It has been hypothesized that illusory agency detection is at the basis of belief in supernatural agents and paranormal beliefs. In the present study a biological motion perception task was used to study illusory agency detection in a group of skeptics and a group of paranormal believers. Participants were required to detect the presence or absence of a human agent in a point-light display. It was found that paranormal believers had a lower perceptual sensitivity than skeptics, which was due to (...) a response bias to ‘yes’ for stimuli in which no agent was present. The relation between paranormal beliefs and illusory agency detection held only for stimuli with low to intermediate ambiguity, but for stimuli with a high number of visual distractors responses of believers and skeptics were at the same level. Furthermore, it was found that illusory agency detection was unrelated to traditional religious belief and belief in witchcraft, whereas paranormal beliefs were strongly related to illusory agency detection. These findings qualify the relation between illusory pattern perception and supernatural and paranormal beliefs and suggest that paranormal beliefs are strongly related to agency detection biases. A universalist conception of immigration, assuming that all humans have a fundamental ethical right to equal consideration (Brücker), is contrasted with a particularist ethical conception that restricts equal consideration to members of a given community (Osterloh/Frey). It is argued that within the limits of Robbinsian economics only a communitarian conception is acceptable while an ethical theorist might lean towards a universalist view.

Our contemporary condition is deeply infused with scientific-technological rationales. These influence and shape our ethical reasoning on war, including the moral status of civilians and the moral choices available to us. In this article, I discuss how technology shapes and directs the moral choices available to us by setting parameters for moral deliberation. I argue that technology has moral significance for just war thinking, yet this is often overlooked in attempts to assess who is liable to harm in war and (...) to what extent. This omission produces an undue deference to technological authority, reducing combatants, civilians and scenarios to data points. If we are to develop a maximally restrictive framework for harming civilians in war, which in my view should be a goal of just war thinking, then it is imperative that the scientific-technological dimension of contemporary war is given due attention. In dem Buch werden philosophisches Denken, politische Theorien, Theorien des Ästhetischen und die Künste zusammengeführt, um danach zu fragen, wie „Mit-Sein“ überhaupt denkbar und darstellbar ist, ob Gemeinschaft gegeben ist, wie sie sich ereignet und sich zeigt.

This chapter gives an overview of important philosophical accounts of knowledge. It starts with Plato’s idea of knowledge as a certain true judgement with an account which stands as the origin of the famous tripartite analysis of knowledge as justified true belief in modern epistemology. Descartes’ concept of knowledge as clear and distinct perception is introduced and shown that it leads to a radical and universal skepticism regarding empirical knowledge of the external world. It is argued that twentieth-century philosophy of (...) cognition and philosophy of science has been more open to accepting concepts of knowledge in which epistemic justification of beliefs is fallible. Furthermore, recent trends in philosophical theories of knowledge, such as naturalistic approaches in epistemology as well as virtue epistemology and social accounts of knowledge, are described and connections to the global turn in cultural sciences are drawn. This article examines the history of Erich Auerbach’s relationship with the DVjs, in which science and politics intersect. In the early phase of his career, Auerbach attributed great importance to the DVjs and developed a special relationship with Rothacker in particular. This is evident from his letters to the journal’s editors, which are the focus of this study. When Rothacker began to take sides with National Socialism, Auerbach turned his back on the DVjs. After the Second World War, he was (...) one of the emigrated academics whose cooperation the journal sought. The effects of the political upheavals of 1933/45 on the DVjs can be exemplified by the relationship Auerbach had with it. (shrink)

Die Bedeutung des kritischen Rationalismus für die Entwicklung vornehmlich der deutschsprachigen Nachkriegswirtschaftswissenschaften wird diskutiert. Die kritisch-rationalistische These von der einheitlichen nomologischen Ausrichtung aller Realwissenschaften wird mit Reinhard Seltens „methodologischem Dualismus“ einerseits und der Rolle unrealistischer Annahmen in der mathematischen Ökonomik andrerseits konfrontiert. Ungeachtet aller Bewunderung die Seltens „mathematische Praxeologie“ als Formalwissenschaft verdient, haftet dieser doch so viel des Misesschen Apriorismus an, dass sie aus Sicht des kritischen Rationalismus als Teil der empirischen Wissenschaft ebenso zurückgewiesen werden muss wie weite Teile der (...) mathematischen „reinen“ Ökonomik. The fact that Peter Singer was prevented from lecturing in Germany as well as the fact that the discussion of his book ‘Practical Ethics’ was rendered impossible raises important questions about freedom. Surprisingly some philosophers have joined the political factions which strive to suppress free discussion. In this quite polemical article some of their views are rejected. The only way to weed out error is free discussion.

Hans Albert bin ich zum ersten Mal zu Beginn der 1970er Jahre begegnet. Werner Becker, ein früherer Adorno-Assistent, der „zum Feind der kritischen Rationalität übergelaufen“ war, nahm mich mit nach Karlsruhe zu Veranstaltungen, die von Hans Albert und Hans Lenk organisiert wurden. Dort traten „Größen“ wie Georg Henrik von Wright oder Karl Popper auf; aber für mich erwies sich Hans Albert als die eigentliche Größe. Er war die unsichtbare Hand im Hintergrund, durch deren Wirken sich mein eigener Weg in die (...) und durch die Philosophie und auch die Politische Ökonomik gestaltete. (shrink)

Mag die persönliche Chemie zwischen den beiden späteren Nobelpreisträgern auch nicht ideal gewesen sein, gemeinsam war ihnen das Interesse an der Behandlung sogenannter ›Externalitäten‹ und damit inter-individueller Auswirkungen menschlichen Verhaltens, die nicht (...) durch inter-individuelle Vereinbarungen autorisiert und in diesem Sinne vertraglich ›internalisiert‹ worden sind.
