The U.S. Food and Drug Administration's rationale for supporting the development and approval of BiDil for heart failure specifically in black patients was based on under-powered, post hoc subgroup analyses of two relatively old trials , which were further complicated by substantial covariate imbalances between racial groups. Indeed, the only statistically significant difference observed between black and white patients was found without any adjustment for potential confounders in samples that were unlikely to have been adequately randomized. Meanwhile, because the accepted (...) baseline therapy for heart failure has substantially improved since these trials took place, their results cannot be combined with data from the more recent trial amongst black patients alone. There is therefore little scientific evidence to support the approval of BiDil only for use in black patients, and the FDA's rationale fails to consider the ethical consequences of recognizing racial categories as valid markers of innate biological difference, and permitting the development of group-specific therapies that are subject to commercial incentives rather than scientific evidence or therapeutic imperatives. This paper reviews the limitations in the scientific evidence used to support the approval of BiDil only for use in black patients; calls for further analysis of the V-HeFT I and II data which might clarify whether responses to H-I vary by race; and evaluates the consequences of commercial incentives to develop racialized medicines. We recommend that the FDA revise the procedures they use to examine applications for race-based therapies to ensure that these are based on robust scientific claims and do not undermine the aims of the 1992 Revitalization Act. In this strikingly original work, Paul W. Kahn rethinks the meaning of political theology. In a text innovative in both form and substance, he describes an American political theology as a secular inquiry into ultimate meanings sustaining our faith in the popular sovereign. Kahn works out his view through an engagement with Carl Schmitt's 1922 classic, _Political Theology: Four Chapters on the Concept of Sovereignty_. He forces an engagement with Schmitt's four chapters, offering a new version of each (...) that is responsive to the American political imaginary. The result is a contemporary political theology. As in Schmitt's work, sovereignty remains central, yet Kahn shows how popular sovereignty creates an ethos of sacrifice in the modern state. Turning to law, Kahn demonstrates how the line between exception and judicial decision is not as sharp as Schmitt led us to believe. He reminds readers that American political life begins with the revolutionary willingness to sacrifice and that both sacrifice and law continue to ground the American political imagination. Kahn offers a political theology that has at its center the practice of freedom realized in political decisions, legal judgments, and finally in philosophical inquiry itself. (shrink)

Plato's late dialogues have often been neglected because they lack the literary charm of his earlier masterpieces. Charles Kahn proposes a unified view of these diverse and difficult works, from the Parmenides and Theaetetus to the Sophist and Timaeus, showing how they gradually develop the framework for Plato's late metaphysics and cosmology. The Parmenides, with its attack on the theory of Forms and its baffling series of antinomies, has generally been treated apart from the rest of Plato's late work. (...) Beyond Consent examines the concept of justice, and its application to human subject research, through the different lenses of various research populations: children, the vulnerable sick, captive and convenient populations, women, people of colour, and subjects in international settings. Separate chapters address the evolution of research policies, implications of the concept of justice for the future of human subject research, and the ramifications of this concept throughout the research enterprise.

Ever since Hegel famously objected to Kant’s universalization formulations of the Categorical Imperative on the grounds that they are nothing but an empty formalism, there has been continual debate about whether he was right. In this paper I argue that Hegel got things at least half-right: I argue that even if negative duties (duties to omit actions or not to adopt maxims) can be derived from the universalization formulations, positive duties (duties to commit actions or to adopt maxims) cannot. The (...) paper is divided into three main sections. In the first, I set out the procedures generally accepted among Kantians for deriving positive duties from the universalization formulations. In the second, I set out the arguments from section 1 in more detail and explain why they do not work. In the third, I examine a strategy that might be used to supplement the arguments from section 2 and I argue that it also does not work. (shrink)

Through criticism and analysis of ancient traditions, Kahn reconstructs the pattern of Anaximander’s thought using historical methods akin to the reconstructive techniques of comparative linguists.

This study takes up Paul Gilroy’s recent call to take seriously the political problem of fascism in the contemporary conjuncture as an educational problem. Specifically, the study will begin with analytic work to identify a set of guideposts that delineate the political logics of fascism. It will then examine the still under-developed theoretical work examining the political problem of contemporary fascism as an educational problem. And, it will attempt to advance this necessary work by tracing the outline of an antifascist (...) educational project. It will be argued that an anti-fascist educational project must, in the short-term, develop polemical strategies that articulate a new set of political logics to challenge the increasingly cemented fascist logics at work today and, in the long-term, advance structural changes to educational institutions organized around normative aims of humane and humanizing education, morality and responsibility, and sociological knowledge. From classical, Fraïissé-homogeneous, ($\leq \omega$)-categorical theories over finite relational languages, we construct intuitionistic theories that are complete, prove negations of classical tautologies, and admit quantifier elimination. We also determine the intuitionistic universal fragments of these theories.

By doing so, he contests for authorship of "autistic identity" decades before the neurodiversity movement began.

The probability of lineal extinction is sensitive to all the moments of the reproductive success probability distribution. In particular, high variance in reproductive success is associated with high probability of lineal extinction. Where male variance in reproductive success exceeds female variance, strictly patrilineal lines of descent will become extinct more rapidly than strictly matrilineal lines of descent. Patrilineal genealogies will be expected to be shallower and broader than matrilineal genealogies under such conditions. Potential implications of this genealogical asymmetry for human (...) descent systems include the greater information content of patrilineal kinship reckoning compared with any other unilineal system and the greater effectiveness of patrilineal kinship as a vehicle for corporate action. It is perhaps fitting that E.P.Thompson has used the concept of 'moral economy' to describe a popular consensus embedded in patterns of deeply rooted assumptions, belief and conduct among the urban poor in eighteenth-century England. Food riots, rooted in a belief in the customary practice of sale of food (...) at fair prices even when production was low, were a response to prices designed to achieve the greatest profit the market allowed. The poem of Parmenides is the earliest philosophic text which is preserved with sufficient completeness and continuity to permit us to follow a sustained line of argument. It is surely one of the most interesting arguments in the history of philosophy, and we are lucky to have this early text, perhaps a whole century older than the first dialogues of Plato. But the price we must pay for our good fortune is to face up to a vipers' nest of problems, (...) concerning details of the text and the archaic language but also concerning major questions of philosophic interpretation. These problems are so fundamental that, unless we solve them correctly, we cannot even be clear as to what Parmenides is arguing for, or why. And they are so knotted that we can scarcely unravel a single problem without finding the whole nest on our hands. (shrink)

This article offers a semiotic perspective on the debate over critical race theory (CRT) bans in the United States. It presents the debate as unfolding in three stages. In the first stage, CRT is created by an opportunistic journalist as a catchall category for white grievances, and the bans themselves are seen as consistent with freedom of speech, and Martin Luther King Jr.’s vision of a colorblind society. A semiotic rupture, occasioned by Timothy Snyder’s 2021, _New York Times Magazine_ article (...) “The War on History is a War on Democracy,” ushered in a second stage. By comparing CRT bans to Vladimir Putin’s use of law to deny Soviet past crimes (especially regarding Ukraine), Snyder exposed the CRT bans as willful acts of forgetting past crimes, while indirectly highlighting Putin’s own anti-woke initiatives. This led to the third stage, in which some CRT ban supporters began to view critical race theory as form of communism. Sometimes this use was tactical; in other instances, it reflected a belief that a conspiracy theory, one consistent with white nationalism, according to which cultural Marxists were destroying American society from within. The following seems to be a truism in modern day philosophy: No agent can have had other parents (IDENTITY). IDENTITY shows up in discussions of moral luck, parenting, gene editing, and population ethics. In this paper, I challenge IDENTITY. I do so by showing that the most plausible arguments that can be made in favor of IDENTITY do not withstand critical scrutiny. The paper is divided into four sections. In the first, I document the prevalence of IDENTITY. In the second, (...) I examine a defense of IDENTITY on the basis of genetic considerations. Education, Crisis, and the Discipline of the Conjuncture constructs a history of the present through conjunctural analysis and builds on this inquiry to construct a model for critical educational scholarship and pedagogical practice that can contribute to the urgent political demands of this historical moment.

Focusing on the new theories of human motivation that emerged during the transition from feudalism to the modern period, this is the first book of new essays on the relationship between politics and the passions from Machiavelli to Bentham. Contributors address the crisis of moral and philosophical discourse in the early modern period; the necessity of inventing a new way of describing the relation between reflection and action, and private and public selves; the disciplinary regulation of the body; and the (...) ideological constitution of identity. The collection as a whole asks whether a discourse of the passions might provide a critical perspective on the politics of subjectivity. Whatever their specific approach to the question of ideology, all the essays reconsider the legacy of the passions in modern political theory and the importance of the history of politics and the passions for modern political debates. In 1878, Friedrich Engels famously wrote that on the road to realizing the communist utopia, “the state is not abolished, it withers away.” In a similar manner, biomedical researchers telling us that come the promised land of individualized genomic medicine, the need for using race will also “wither away” in the face of scientific progress. Such millennial hopes are, no doubt, sincere, but they enable the continued casual proliferation of racial categories throughout biomedical research, product development, marketing, and clinical practice. My contrasting quotation to frame this article is drawn from the 20th century pioneer of rock and roll, Buddy Holly whose 1957 hit “Not Fade Away” begins with the line, “I’m gonna tell you how it's gonna be” — the point being that far from withering away, race is persisting even as genomic milestones are being reached and passed. On the standard reading of Kant’s ethics, agents are responsible only for their acts of willing, not the consequences of their willing, much less the acts or consequences of other agents’ willing (vicarious responsibility). It is therefore somewhat puzzling to find Kant discussing vicarious responsibility, and with apparent approbation, in the treatment of a case that has come to typify his ethics, the murderer at the door. Nonetheless, he does so, and in his lesser known works, Kant even sets out (...) a rudimentary framework for handling such cases. My goal in this chapter is to draw attention to this neglected aspect of Kant’s ethics. I want to show that Kant accepted vicarious responsibility openly and explicitly, both in his ethical and in his legal theory. In so doing, I hope to reveal how much the current understanding of Kant’s theory of responsibility, accepted by Kantians and non-Kantians alike, has failed to capture fairly basic parts of his thought. Kant’s Formula of Humanity can be analyzed into two parts. One is an injunction to treat humanity always as an end. The other is a prohibition on using humanity as a mere means. The second is often referred to as the FH prohibition or the mere means prohibition. It has become popular to interpret this prohibition in terms of consent. The idea is that, if X uses Y's humanity as a means and Y does not consent to it, then X (...) uses Y's humanity as a mere means. There is then debate about the kind of consent that is relevant: possible, actual, or rational. In this paper, I argue against this interpretation. Section one sets up the consent account. Section two attacks possible and actual consent accounts on doctrinal grounds. Section three extends this doctrinal attack to rational consent accounts. Section four circles back to the original motivation for the consent interpretation. I argue that the consent account rests on a misinterpretation, and I conclude with a quick sketch of an alternative interpretation of the FH prohibition. (shrink)

What is new in Ch. H. Kahn reinterpretation of Plato's "Cratylus" is the way he considers its main problem: the question of correctness of names. In traditional approach there are two opposite theses: 1) names are conventional; 2) names are regarded as natural. Kahn, however, maintains that Plato is in fact concerned with a quite different pair of questions. The first one is the sign relation of the language and its role in the communication. The other is the (...) sense and the role of the study of names as a means for investigating the nature of things. (shrink)
