Person‐centred care, with its central focus on the patient in partnership with healthcare practitioners, is considered to be the contemporary gold standard of care. This type of care implies effective communication from and by both the patient and the healthcare practitioner. This is often problematic in the case of the paediatric population, because of the many communicative challenges that may arise due to the child's developmental level, illness and distress, linguistic competency and disabilities. The principle of universal design put forth (...) in conventions and legislation means that the design of products and services should be usable by all people, to the greatest extent possible. Augmentative and alternative communication encompasses strategies, for example pictures and apps, that are typically used with people with communication disability. In this position paper, we argue for the universal use of augmentative and alternative communication to support person‐centred communication and care for children, regardless of age or potential disability. Clinical examples are shared from three different paediatric care settings where pictorial supports were applied universally. Interviews were conducted with children and adolescents (with and without disabilities), parents and healthcare practitioners, and the principles of universal design were used as a framework to demonstrate how person‐centred communication is supported in paediatric care. This article is an attempt to explore the theme of ‘humanhood’ in the Fourth Gospel. The most important questions to be posed at the outset are the following: who is the model human presented in the gospel as per the Johannine community standards? How can a person acquire humanhood status according to the Johannine community? The divine and human interaction in the life and ministry of Jesus dynamically introduces the life ethics and mission aspects of the Johannine community. According to (...) the Johannine community standards, people can achieve ‘humanhood’ status exclusively in relation to Jesus. As the community of John emphasises humanhood in relation to Jesus, a person can overcome all sorts of human-made boundaries, including the sexual, racial and class-oriented boundaries through the mediation of Jesus. This further means that the all-inclusive mission of Jesus foregrounds a new criterion for ‘humanhood’ in the Johannine community context. The article concludes by stating that the Johannine understanding of humanhood can be considered as a paradigm in the contemporary global scenario. Contribution: This article contributes to the reader a wider hermeneutical framework and a new way forward in interpreting the gospel according to John by taking into consideration the humanhood aspects. As a theological and contextual interpretation of the Fourth Gospel, the article fits well within the scope of HTS Teologiese Studies/Theological Studies. (shrink)

My thesis is that moral ignorance does not imply a failure to care adequately about what is in fact morally significant. I offer three cases: one in which someone is ignorant of the precise nature of what she cares about; one in which someone does not reflect on the significance of what she cares about in a particular set of circumstances, and one in which someone cares deeply about two morally significant considerations while being mistaken about their relative significance. I (...) argue that these agents all clearly care at least “adequately” about everything morally significant, including the very considerations that in fact make their acts wrong. This creates theoretical room for a way of thinking about culpable moral ignorance that respects the key concerns of those in the voluntarist tradition who have held that moral ignorance is typically blameless, within an approach to thinking about moral responsibility according to which we are blameworthy for that which manifests poor quality of will; caring adequately does not require moral omniscience, but motivated moral ignorance and moral ignorance that reflects indifference to things that matter morally are still blameworthy. My thesis also suggests a fruitful change of direction for quality-of-will theorists: we should articulate the nature and structure of the standards for adequate caring, i.e. those that specify what it is to care “adequately”. I close by offering an initial proposal as to what these standards might look like and identifying four promising avenues for further research on this topic. (shrink)

This article critiques Jack Halberstam's concept of queer failure through a feminist cripistemological lens. Challenging Halberstam's interpretation of Erika Kohut in The Piano Teacher as a symbol of postcolonial angst rather than a figure of psychosocial disability, the article establishes a critical coalition between crip feminist theory and queer-of-color theory to promote a materialist politics and literal-minded reading practice designed to recognize minority subjectivities rather than exploiting them for their metaphorical resonance. In asserting that Erika Kohut is better understood as (...) a woman with borderline personality disorder , and in proposing borderline personality disorder as a critical optic through which to read both The Piano Teacher and The Queer Art of Failure , the article challenges the usual cultural undermining of epistemic authority that comes with the BPD diagnosis. It asserts instead that BPD might be a location of more, rather than less, critical acumen about the negative affects that accompany queer failures, and reflect on what we might call a borderline turn in queer theory. On a broader level, the article joins an emergent conversation in crip theory about the reluctance of queer theory to address disability in meaningful and substantive ways. (shrink)

The phenomenon whereby severely disabled persons self-report a higher than expected level of subjective well-being is called the “disability paradox.” One explanation for the paradox among brain injury survivors is “response shift,” an adjustment of one’s values, expectations, and perspective in the aftermath of a life-altering, disabling injury. The high level of subjective well-being appears paradoxical when viewed from the perspective of the non-disabled, who presume that those with severe disabilities experience a quality of life so poor that it might (...) make their lives not worth living. This presumption has profound consequences, for it may inform end-of-life choices made in advance directives, or influence decisions made by surrogates on behalf of persons who are unable to direct their own medical treatment. -/- Peterson et al propose a cautious, well-considered plan to use fMRI-based brain-computer interfaces to assess the decision making capacity of covertly aware, behaviorally non-responsive individuals who retain high levels of preserved cognition. Their plan, if it succeeds, could eventually restore autonomy and empower some severely disabled persons, allowing them to participate in clinical decision making. Peterson et al discuss possible in-principle objections to their proposal, among them the “argument from psychological health,” and the “changing sets of values” objection. These objections both presume that deviations from a pre-injury norm could indicate diminished decision making capacity. This presumption threatens the autonomy of the patient who is capable of making decisions, but whose post-injury decisions appear to diverge from pre-injury preferences or values. In light of the potential for response shift, and the disability paradox, it should not be inferred that changes in values or preferences are unreflective of the true current preferences of a brain-injured person, nor are they conclusive evidence of diminished capacity. Presuming diminished capacity on the basis of unexpected or unconventional preferences has, in the past, been used to disempower patients whose autonomy and capacity would not have been doubted had they made choices that accorded with the expectations or values of others. We must be cautious, and vigilant, to prevent similarly diminishing the autonomy of covertly aware, behaviorally non-responsive individuals on the basis of empirically and ethically questionable inferences about their decision making capacity. In this paper we develop a general theory of algorithmic fairness. Drawing on Johnson King and Babic’s work on moral encroachment, on Gary Becker’s work on labor market discrimination, and on Strawson’s idea of resentment and indignation as responses to violations of the demand for goodwill toward oneself and others, we locate attitudes to fairness in an agent’s utility function. In particular, we first argue that fairness is a matter of a decision-maker’s relative concern for the plight of people (...) from different groups, rather than of the outcomes produced for different groups. We then show how an agent’s preferences, including in particular their attitudes to error, give rise to their decision thresholds. Tying these points together, we argue that the agent’s relative degrees of concern for different groups manifest in a difference in decision thresholds applied to these groups. (shrink)

Consequence rleations over sets of "judgments" are defined by using "overdetermined" as well as "underdetermined" valuations. Some of these relations are shown to be categorical. And generalized soundness and completeness results are given for both multiple and single conclusion consequence relations.

Therefore, it emphasizes the profound meaning of a possible "change of method" that seems to lead the reflection on the body toward the clarification of its inherent mode of being, in order to explain how it can be understood as an existential. Neste artigo, desenvolveram-se as considerações heideggerianas sobre a corporalidade expostas em Zollikoner Seminare, atendendo à posição fundamental a partir da qual estas se realizam. Discute-se sobre a necessidade, por parte de Heidegger, de abordar o problema do corpo vivo à margem das considerações científicas e, consequentemente, enfatiza-se o sentido íntimo de uma eventual "mudança de método" que parece conduzir a reflexão sobre o corpo ao esclarecimento de seu modo de ser próprio, com o objetivo de esclarecer como aquele pode ser entendido como um existencial. In this book, Bonnie Lander Johnson explores early modern ideas of chastity, demonstrating how crucial early Stuart thinking on chastity was to political, medical, theological and moral debates, and that it was also a virtue that governed the construction of different literary genres. Drawing on a range of materials, from prose to theatre, theological controversy to legal trials, and court ceremonies - including royal birthing rituals - Lander Johnson unearths previously unrecognised opinions about chastity. She reveals that early (...) Stuart theatrical and court ceremonies were part of the same political debate as prose pamphlets and religious sermons. The volume also offers new readings of Milton's Comus, Shakespeare's The Winter's Tale, Henrietta Maria's queenship and John Ford's plays. It will appeal to scholars of early modern literature, theatre, political, medical and cultural history, and gender studies. (shrink)

The “beyond a reasonable doubt” standard of proof, currently used in criminal trials, is notoriously vague and undermotivated. This paper discusses two popular strategies for justifying our choice of a particular precise interpretation of the standard: the “ratio-to-standard strategy” identifies a desired ratio of trial outcomes and then argues that a certain standard is the one that we can expect to produce our desired ratio, while the “utilities-to-standard strategy” identifies utilities for trial outcomes and then argues that a certain standard (...) maximizes expected utility. I argue that both strategies fail on their own terms, by requiring us to perform calculations that we simply cannot perform. No version of either strategy can be performed by jurors or legislators in our actual epistemic position, in which, since we do not know which of the defendants in our trial system are genuinely innocent and which are genuinely guilty, we cannot determine the extent to which our trial system tends to produce evidence that misleadingly incriminates the innocent or misleadingly exonerates the guilty. But we would need to determine this in order to perform the calculations required by any possible version of the ratio-to-standard or utilities-to-standard strategies. I then suggest some empirical reasons to be pessimistic about the evidence produced by our actual trial system. The upshot is that the “beyond a reasonable doubt” standard lacks a clear interpretation and rationale, nor do we have a promising way to identify an alternative. This article presents three experiments that examine the relation between order effects and frequency learning, with the following results. First, when frequencies of occurrence are presented as sequences of real events, base rates can be learned and used with a high degree of accuracy. However, conditional probabilities for multiple sequentially presented evidence items cannot be completely learned, due to the distortion of a recency order effect for actual decisions. Second, there is also a recency order effect for belief evaluations, which (...) cannot be eliminated even if base rates are used correctly. Third, base rates learned in one environment can be transferred to another environment, but the transfer soon diminishes due to learning in the new environment. However, belief evaluations are not transferred from one environment to another The existing models of frequency learning cannot explain the order effect for actual decisions because they do not consider sequential information. The existing models of belief updating can explain both types of order effects, but they do not have any mechanisms for frequency learning. To account for the complete spectrum of frequency learning and order effects, we outline our initial effort in developing a unified model that integrates frequency learning and order effects. With most states now making sex offender registration information available to the public, journalists must balance their obligation to inform the public about potential dangers with respect for individuals' rights. This article examines the problems journalists face in truth telling and minimizing harm and offers suggestions for covering community notification. At minimum, we suggest journalists verify the accuracy of information received from police, make independent judgments about whether or not publication of sex offender registration information is warranted, and provide background (...) information on the scope and effectiveness of community notification in their areas. Some philosophers think that if someone acts wrongly while falsely believing that her act is permissible, this moral mistake cannot excuse her wrongdoing. And some think that this is because it is morally blameworthy to fail to appreciate the moral significance of non‐moral facts of which one is aware, such that mistakenly believing that one's act is permissible when it is in fact wrong is itself morally blameworthy. Here I challenge the view that it is blameworthy to fail to appreciate (...) the moral significance of non‐moral facts of which one is aware. This view seems okay if we focus on examples of people mistakenly believing that their wrongful acts are permissible. But it is not remotely plausible when we consider other varieties of moral mistake – such as believing that one's action is required when it is in fact supererogatory, believing that one's action is wrong when it is in fact permissible, and believing false things about the moral properties of others’ actions and of merely possible actions. The upshot is that those who maintain that moral mistakes cannot excuse are sent back to the drawing board; we need a new explanation of why this would be the case. (shrink)

As we move our social institutions from paper and ink based operations to the electronic medium, we invisibly create a type of surveillance society, a panopticon society. It is not the traditional surveillance society in which government officials follow citizens around because they are concerned about threats to the political order. Instead it is piecemeal surveillance by public and private organizations. Piecemeal though it is, It creates the potential for the old kind of surveillance on an even grander scale. The (...) panopticon is the prison environment described by Foucault in which prison cells are arranged in a large circle with the side facing the inside of the circle open to view. The guard tower is placed in the middle of the circle so that guards can see everything that goes on in every cell. When we contemplate all the electronic data that is now gathered about each of us as we move through our everyday lives --- intelligent highway systems, consumer transactions, traffic patterns on the internet, medical records, financial records, and so on --- there seems little doubt that we are moving into a panopticon. The social issues that arise from this are too numerous to detail here, but data retention is an important part of it. In the paper-and-ink world, documents are filed, files are boxed, boxes are put away or thrown away. The capacity for data retrieval and manipulation is, thereby, limited by the sheer difficulty and cost of storing, finding, searching, and manipulating large numbers of paper files. This inconvenience functions as a mechanism whereby the system forgets past information, not unlike the way we ourselves forget. However, the story is very different in the digital world; digital information is easy to store, easy to search and manipulate, and inexpensive to keep over extensive periods of time. Digitalized information systems tend, therefore, to collect extensive ancillary information and to retain this information indefinitely. Such lack of forgetfulness is likely to hamper the ability of individuals to shed their past, and start over with a clean slate. Concerns about data retention were expressed in the early literature on the social impact of computing, but for the most part the issue has dropped from sight. Rarely, has the social good of discarding accumulated personal data been addressed. In this paper, we want to make the case by examining diverse cases in which retention of information by either business or governmental institutions hinders the ability of individuals to start over or to act autonomously. We hope our argument for the good of forgetfulness will challenge the standard framework in which such issues have traditionally been debated. The privacy debate exemplifies the traditional framework insofar as it has been characterized as involving an inherent tension between, on the one hand, the needs of organizations and institutions for more accurate and efficient information systems so as to further their goals and, on the other hand, the desire of individuals to have information about them kept private. Regan argues against this framing of the privacy issue in favor of one that recognizes the social importance of personal privacy. We will examine the non-forgetfulness of information systems as a problem threatening not just individual interests but social good as well. Cryptography is often cited as the technology that will give us privacy and mediate against surveillance. One of the uses of cryptography, encryption, will allow us, some hope, to create confidentiality and relationships of trust that will facilitate many of the social arrangements we now have and perhaps make them even more secure than they are now. Electronic cash, for example, could be created in such a form that it would have the anonymity associated now with hard cash Others are less optimistic of the potential for cryptography to re-create relationships of trust in the new medium. One important point that already seems clear is that even if encryption technology will protect the confidentiality and integrity of electronic transactions and data, it will NOT stop the observation of traffic patterns on networks. This seems an important distinction to put on the table. Our patterns of communication will continue to be available, no matter what is encrypted, and an amazing amount of information can be gleaned from this data. In a sense, it means content integrity but no anonymity. This will indubitably impact how we interact and with whom we interact. (shrink)

Law is a critical determinant of health that public health practitioners encounter in everyday practice. Yet most do not receive any formal public health law training. This article discusses tangible opportunities for strengthening the capacity of current and future practitioners to leverage law to advance health equity priorities.

Understanding the mechanisms of early embryonic patterning and the timely allocation of specific cells to embryonic regions and fates as well as their development into tissues and organs, is a fundamental problem in Developmental Biology. The classical explanation for this process had been built around the notion of positional information. Accordingly the programmed appearance of sources of Morphogens at localized positions within a field of cells directs their differentiation. Recently, the development of organs and tissues from unpatterned and initially identical (...) stem cells (adult and embryonic) has challenged the need for positional information and even the integrity of the embryo, for pattern formation. Here we review the emerging area of organoid biology from the perspective of Developmental Biology. We argue that the events underlying the development of these systems are not purely linked to “self‐organization,” as often suggested, but rather to a process of genetically encoded self‐assembly where genetic programs encode and control the emergence of biological structures.
