Este artículo tiene por objetivo analizar la equidad natural como criterio de interpretación jurídica. Contadas las excepciones, es posible aseverar que no ha sido objeto de un estudio sistemático y profundo por parte de filosofía del Derecho; no existe claridad respecto a cómo funciona la equidad natural, cuál es su naturaleza, cómo se aplica, si acaso es un concepto moral, jurídico o participa de ambas categorías. Frente a este panorama en este trabajo se busca responder a (...) estas interrogantes, proponiendo un análisis de las propiedades que constituyen la idea de equidad interpretativa. Ello no para alcanzar una definición final, sino para entregar claridad conceptual a los operadores jurídicos cuando hacen uso de este elemento hermenéutico. Para lograr este objetivo se realizará un análisis crítico de la bibliografía especializada en el tema, con la finalidad de repensar ciertos lugares comunes en torno a este concepto. (shrink)

This paper relates the concept of “discourse” (in the discourse-ethics’ meaning) with the concept of “social justice.” I maintain that the social nature of reason is a condition of possibility of such justice. According to the Alexy-Habermas system, the rules for the practical discourse mean in their third level the conditions of symmetry, that is, the absence of privileges among the participants. My paper introduces the concept of discursive fairness, referred to the requirements for maintaining the discursive symmetry, even under (...) circumstances of non-discursive, but real asymmetry. Two principles of discursive fairness are offered (by analogy to Rawls’ “principles of justice”): 1. equality of rights among the participants in the practical discourse, and 2. possibility of reviewing all arguments used in the discourse, together with guarantees of benefits for the unsuccessful participants. Los sociobiólogos han defendido una posición "calvinista" que se resume en la siguiente fórmula: si la selección natural explica las actitudes morales, no hay altruismo genuino en la moral; si la moral es altruista, entonces la selección natural no puede explicarla. En este ensayo desenmascaro los presupuestos erróneos de esta posición y defiendo que el altruismo como equidad no es incompatible con la selección natural. Rechazo una concepción hobbesiana de la moral, pero sugiero su empleo en (...) la interpretación de la psicología de los primates no humanos y en un modelo de progresión evolutiva que habría llevado a la moralidad como adaptación pasando por la razón instrumental. /// Sociobiologists have endorsed a "Calvinist" position captured in the following formula: if natural selection explains moral attitudes, morality is not genuinely altruistic; if morality is altruistic, then natural selection cannot explain it. I expose the false presuppositions behind this claim and argüe that altruism as fairness is not incompatible with natural selection. I reject a Hobbesian view of morality as an instrumental endorsement of fairness norms, but suggest its use to interpret primate psychology and to model an evolutionary progression ending in moral capacities as adaptations. This article addresses some useful coordinates for the analysis of the relationship between philosophy and taxation. My argument aims to show the relevance of a philosophy of taxation and thus draw attention to civic education required to shape a democratic public reason, truthful, critical and attentive. I emphasize the character of “donation” that is the rule of law within a democratic constitutional regime, which depends on tax payments for the purposes proposed, and particularly those of a social distributive justice. I (...) distinguish between charity and justice and political obligation to maintain that by implementing an effective "rule of law" citizens “donate” ourselves mechanisms and procedures for advancing a system of justice as fairness. This grant does not pertain to the field of natural duties, charity or sacrifice of supererogatory acts, but is expressed in institutional programs whose implementation and maintenance required from us pay taxes, but always based on personal commitment. Thus, close to John Rawls I emphasize the value of freedom. (shrink)

ABSTRACT Scholars have understood Aristotle’s theory of equity in two different ways. On the one hand, some claim that equity is an extra-normative criterion, that is, it goes beyond the law and reaches a supra-legal level identified with a metaphysical order of natural justice. On the other hand, some hold that equity is intra-normative, that is, the judge rectifes legal justice without going beyond its limits. Considering this second point of view and by using a methodology that combines legal (...) philosophy and some of the main theories about emotions in ancient Greece, this paper aims to demonstrate that equitable judges should not have broad discretion according to Aristotle’s thought. To hold that claim, I will mainly address the role of emotions in the formation of judgment and the power they have to endanger the possibility of giving just and rational judicial decisions. RESUMEN Se analiza si la versión de la justicia como equidad, presentada en El liberalismo político, es genuinamente una concepción política. Se examina el problema de la razonabilidad de las doctrinas comprehensivas, y se indaga luego si el argumento en dos etapas afecta la integridad estructural del liberalismo político. Se concluye que J. Rawls fracasa en su intento de justificar un liberalismo independiente de una doctrina comprehensiva de carácter liberal. ABSTRACT The article analyzes whether the conception of justice as (...) fairness, set forth by Rawls in Political Liberalism, is a genuine political conception. It first examines the issue of reasonableness of comprehensive doctrines and then goes on to inquire whether the two-step argument affects the structural integrity of political liberalism. Partimos de que se está desarrollando un doble discurso desde el punto de vista de las sostenibilidad sobre los recursos naturales en general, y sobre la diversidad y el agua en especial. Conceptos de equidad intergeneracional, conservación del recurso, aprovechamiento sostenible, participación, y control social se utilizan por parte de las organizaciones sociales y de Ong, y de igual manera por los foros empresariales, las instituciones públicas, IFIs, Instituciones Financieras Multilaterales con muy diferente contenido.El tema de los derechos de (...) agua como derechos de los inversionistas, y los derechos de propiedad intelectual aplicados a la materia viva y a los conocimientos ancestrales son ejemplos de un tratamiento insostenible de los recursos naturales, pues privilegian el sentido comercial sobre el ambiental. RESUMO Neste artigo, são rejeitadas duas teses relativamente aceitas a respeito do projeto filosófico tardio desenvolvido por John Rawls. A primeira tese afirma que o objetivo de obras como "O Liberalismo Político" e "Justiça como Equidade: Uma Reformulação" seria o de revisar a natureza do argumento contratualista de Rawls. A segunda, por sua vez, afirma que a principal consequência dessa revisão teria sido certo recuo das implicações igualitárias de sua teoria da justiça original. Procurar-se-á rejeitar ambas as proposições mostrando que (...) "O Liberalismo Político" deve ser entendido como uma teoria acerca do uso legítimo do poder em uma sociedade democrática, e que essa teoria da legitimidade possui consequências distributivas próprias, incompatíveis com teorias liberais convencionais. ABSTRACT The article aims to reject two interrelated theses on the philosophical project carried forward by the late John Rawls. The first thesis states that there is an important change in Rawls' late works such as "Political Liberalism" and "Justice as Fairness: A Restatement" regarding the nature of his theory. Particularly, this change would had brought about a reassessment of Rawls' contractualist argument. The second thesis claims that one of the most important consequences of such reassessment is the retreat from strong egalitarian commitments, as they were present in Rawls' original theory of justice. The article rejects both theses, showing that Political Liberalism can be understood as a theory about the legitimate uses of power in a democratic society and that such new theory of legitimacy brings about distributive consequences by its own that sharply contrast with classical liberal theories. Este artigo versa sobre as relações entre natureza, homem e ciência e chama a atenção para um tema estratégico na sociedade brasileira hoje: os recursos hídricos. Ele enfatiza a necessidade de repensarmos nossas vidas em relação à apropriação de nossos recursos naturais e é baseado em minha experiência profissional com recursos hídricos, nos últimos 20 anos, na região sudeste do Brasil. Nosso país não é somente um dos países mais ricos do mundo em águas, mas tem também inúmeras experiências negativas (...) e positivas em relação a esse tema. O artigo conclui que é possível construir uma sociedade sustentável, na qual a equidade, a solidariedade e a justiça social seriam elementos comuns na vida diária. Entretanto, esse desafio somente será vencido com trabalho de décadas e contando com a participação efetiva de diferentes segmentos de nossa sociedade, e não apenas de governos. Nesse cenário, a mobilização social pelas águas desempenhará, certamente, um papel fundamental. It is based on my own experiences with water resources in South-East Brazil and intends to call attention for an strategic subject in Brazilian society nowadays: waters resources. Brazil is not only one of the richest countries in the world in terms of water resources, but also has several negative and positive experiences on this matter. It concludes that is possible to build up a sustainable society, where equity, solidarity and social justice would be ordinary elements of our daily life. However, this challenge will only be achieved after decades of a struggle for life with an effective participation of different segments of our society and not only the governments. Resumo: A inclusão no Ensino Superior é uma premissa de âmbito social, educacional e político. Muitos passos têm sido trilhados para que os discursos sobre equidade e igualdade possam ser proferidos e perspectivados, reconhecendo que o ajustamento dos estudantes com Necessidades Educativas Especiais (NEE) precede-se de inúmeros fatores, entre eles, das políticas educativas. Para possibilitar algumas reflexões, o presente estudo, de natureza qualitativa, objetivou conhecer as percepções de colaboradores (n=85) de Instituições de Ensino Superior portuguesas sobre o papel das políticas (...) educativas em prol da inclusão. Os dados, provenientes de um questionário online, foram tratados sob a técnica de análise de conteúdo, com apoio do software webQDA. Os resultados evidenciaram 60 referências na categoria de potencialidades, refletidas na garantia da efetivação do percurso acadêmico de estudantes com NEE no Ensino Superior e concretização dos seus direitos. Verificou-se que 91,7% dos participantes compreendem que as políticas educativas são importantes para o seu país, pelo que 88,2% dos colaboradores acreditam que estas políticas potenciam a inclusão e a permanência de estudantes com NEE no Ensino Superior, na qual 40,7% verificaram ações de apoio e incentivo, ao nível político, em prol da inclusão em Portugal. Educational policies and inclusion in Higher Education: perceptions about the Portuguese context Abstract: Inclusion in Higher Education is a social, educational and political premise. Many steps have been taken so that the discourses on equity and equality can be delivered and envisaged, recognizing that the adjustment of students with Special Educational Needs (SEN) is preceded by numerous factors, among them, educational policies. To enable some reflections, the present study, of a qualitative nature, aimed to know the perceptions of employees (n = 85) of Portuguese Higher Education Institutions about the role of educational policies on behalf of inclusion. The data, from an online survey, were treated using the content analysis technique, with the support of the webQDA software. The results revealed 60 references in the potentialities category, reflected in the guarantee of the effectiveness of the academic path of students with SEN in Higher Education and the realization of their rights. It was found that 91.7% of participants understand that educational policies are important for their country, so 88.2% of employees believe that these policies enhance the inclusion and permanence of students with SEN in Higher Education, in which 40.7% verified support and incentive actions, at the political level, in favor of inclusion in Portugal. Los datos, provenientes de una encuesta online, fueron tratados mediante la técnica de análisis de contenido, con el apoyo del software webQDA. Los resultados evidenciaron 60 referencias en la categoría de potencialidades, reflejadas en la garantía de la efectividad de la trayectoria académica de los estudiantes con NEE en la Educación Superior y la realización de sus derechos. In Natural Minds Thomas Polger advocates, and defends, the philosophical theory that mind equals brain -- that sensations are brain processes -- and in doing so brings the mind-brain identity theory back into the philosophical debate about consciousness. The version of identity theory that Polger advocates holds that conscious processes, events, states, or properties are type- identical to biological processes, events, states, or properties -- a "tough-minded" account that maintains that minds are necessarily indentical to brains, a position held (...) by few current identity theorists. Polger's approach to what William James called the "great blooming buzzing confusion" of consciousness begins with the idea that we need to know more about brains in order to understand consciousness fully, but recognizes that biology alone cannot provide the entire explanation. The calculus’ place in logic is so central that many philosophers think, in fact, of it when they think of logic. This book challenges the position in contemporary logic and philosophy of language of the predicate calculus claiming that it is based on mistaken assumptions. Ben-Yami shows that the predicate calculus is different from natural language in its fundamental semantic charac.

This paper examines Hobbes’s criticisms of Robert Boyle’s air-pump experiments in light of Hobbes’s account in _De Corpore_ and _De Homine_ of the relationship of natural philosophy to geometry. I argue that Hobbes’s criticisms rely upon his understanding of what counts as “true physics.” Instead of seeing Hobbes as defending natural philosophy as “a causal enterprise … [that] as such, secured total and irrevocable assent,” 1 I argue that, in his disagreement with Boyle, Hobbes relied upon his understanding (...) of natural philosophy as a mixed mathematical science. In a mixed mathematical science one can mix facts from experience with causal principles borrowed from geometry. Hobbes’s harsh criticisms of Boyle’s philosophy, especially in the _Dialogus Physicus, sive De natura aeris_, should thus be understood as Hobbes advancing his view of the proper relationship of natural philosophy to geometry in terms of mixing principles from geometry with facts from experience. Understood in this light, Hobbes need not be taken to reject or diminish the importance of experiment/experience; nor should Hobbes’s criticisms in _Dialogus Physicus_ be understood as rejecting experimenting as ignoble and not befitting a philosopher. Instead, Hobbes’s viewpoint is that experiment/experience must be understood within its proper place – it establishes the ‘that’ for a mixed mathematical science explanation. (shrink)

Both realist and anti-realist accounts of natural kinds possess prima facie virtues: realists can straightforwardly make sense of the apparent objectivity of the natural kinds, and anti-realists, their knowability. This paper formulates a properly anti-realist account designed to capture both merits. In particular, it recommends understanding natural kinds as ‘categorical bottlenecks,’ those categories that not only best serve us, with our idiosyncratic aims and cognitive capacities, but also those of a wide range of alternative agents. By endorsing (...) an ultimately subjective categorical principle, this view sidesteps epistemological difficulties facing realist views. Yet, it nevertheless identifies natural kinds that are fairly, though not completely, stance-independent or objective. (shrink)

The nature of light is a focus of Thomas Hobbes’s natural philosophical project. Hobbes’s explanation of the light of lucid bodies differs across his works, from dilation and contraction in Elements of Law to simple circular motions in De corpore. However, Hobbes consistently explains perceived light by positing that bodily resistance generates the phantasm of light. In Letters I.XIX–XX of Philosophical Letters, fellow materialist Margaret Cavendish attacks the Hobbesian understanding of both lux and lumen by claiming that Hobbes has (...) illicitly made abstractions from matter. In this paper, I argue that Cavendish’s criticisms rely on an incorrect understanding of the nature of Hobbesian geometry and the role it plays in Hobbes’s natural philosophy. Rather than understanding geometry as wholly abstract, Hobbes attempts to ground geometry in different ways of considering bodies and their motions. Furthermore, Hobbes’s own criticisms of abstraction suggest that he would share many of the worries she raises but deny that he falls prey to them. (shrink)

It has been argued in the conservation literature that giving conservation absolute priority over competing interests would best protect the environment. Attributing infinite value to the environment or claiming it is ‘priceless’ are two ways of ensuring this priority (e.g. Hargrove 1989; Bulte and van Kooten 2000; Ackerman and Heinzerling 2002; McCauley 2006; Halsing and Moore 2008). But such proposals would paralyse conservation efforts. We describe the serious problems with these proposals and what they mean for practical applications, and we (...) diagnose and resolve some conceptual confusions permeating the literature on this topic. Chapter 1 serves as an introduction to the vast topic of laws of nature. Thus, it first outlines the alleged characteristics of the laws of nature, namely truth, objectivity, contingency, necessity, universality, grounding counterfactuals and their role in science. Among these aspects, the peculiar modal status of laws of nature will be identified as the ‘holy grail’ of the debate. The second part of this chapter is concerned with the three main families of theories of laws of nature – neo-humean, (...) ADT and dispositional theories – which are introduced and evaluated in regard to the aforementioned characteristics. It will then be argued that among those theories, the dispositional ones show the greatest promise of being able to account for the natural necessity of the laws of nature. -/- Before a dispositional account of laws of nature can be given, dispositions themselves need to be understood. Consequently, Chapter 2 introduces various analyses of dispositions. As dispositions are pre-theoretically close to conditionals, a lot of analyses try to reduce dispositions to conditionals. This chapter critically assesses some chosen accounts: the simple conditional analysis, Carnap’s reduction sentences, the simple counterfactual conditional analysis, Lewis’ reformed conditional analysis, Malzkorn’s sophisticated con- ditional analysis, Choi and Gundersen’s context-dependent analysis, Manley and Wasserman’s gradable dispostion ascriptions, and Fara’s habituals. The prevention problem, which poses a threat to any account of dispositions, is depicted. It is argued that, ultimately, none of the conditionalising attempts is able to convince since they all exclude the problem cases which leads to explanation gaps and outlaw areas. -/- Chapter 3 contains the synchronic part of my preferred solution to the prevention problem. The notion of ‘component causes’ is introduced, and the ontological status of components discussed. Millikan’s oil drop experiment is depicted en detail. In a first step, making a distinction between dispositions and the resulting behaviour is advocated. Via the symmetry argument, mani- festations and masks are shown to be ontologically on a par. In a second step, a triadic account consisting of dispositions, wirkungen and resultant behaviour, is established. Finally, the ontological interpretation of the trias is given. It is in the nature of the dispositions to bring about the wirkungen. These interact via combinations rules like the functions f and fa or vector addition, which are built-in into to dispositions. -/- The diachronic part of my favourite interpretation, the triadic process picture of dispositions (TPD), is presented in chapter 4. The dynamics of dispo- sition manifestation are discussed and it is argued that fiddling with the trigger works only up to a certain point. Diachronic masking cases turn out to be no- torious. An excursus to action theory shows that the ontology needs to include processes, as understanding disposition manifestations as processes solves the diachronic prevention problem. The (TPD) can account for all counterexamples by taking the stimulus as the beginning of the manifestation process. -/- Chapter 5 applies the (TPD) to the debate about laws of nature. In order to judge its adequacy, the characteristics of laws of nature given in chapter 1 are consulted. As a first step, the criteria truth, objectivity, universality, grounding counterfactuals and their role in science are covered. It is sketched how the (TPD) can account for these. The second part of the chapter deals with the modal status of the laws of nature. The dispositional essentialist’s view that laws of nature are metaphysical necessary is depicted and then criticised. It is argued that metaphysical necessity is not the appropriate modal status of the laws of nature. Finally, the (TPD) account of the necessity of the laws of nature is presented: laws of nature are naturally necessary and metaphysically contingent. (shrink)
