Although much legal scholarship discusses the meaning of the religion clauses of the U.S. Constitution, very few articles analyze the ways in which state regulation affects actors' incentives to engage in religious behavior. Yet the question of how a law influences religious behavior is important for determining whether various laws are desirable, and whether they violate constitutional constraints. This article draws on recent economic models of religious organization to analyze the ways in which laws affect the behavior of religious groups. (...) Religious groups produce collective goods for their members, and the effect of laws can be analyzed by examining how they modify the payoffs members receive for cooperating or free riding. The article examines the use of laws to establish religious groups, to subsidize them with cash or tax benefits, to provide accommodations for them, to provide symbolic support for them, to provide secular substitutes for the collective goods they produce, and to regulate disputes between members. The article also briefly discusses the constitutional implications of the analysis. (shrink)

This paper aims to refute a common line of argument that it is immoral for physicians to engage in medical assistance in death (MAiD), i.e., the practices of euthanasia and physician-assisted suicide. The argument in question is based on the notion that participating in MAiD is contrary to the professional-role obligations of physicians, due to MAiD’s putative inconsistency with the ends of medicine. The paper describes several major flaws from which that argument suffers.

Don Marquis’s “future-like-ours” argument against the moral permissibility of abortion is widely considered the strongest anti-abortion argument in the philosophical literature. In this paper, I address the issue of whether the argument relies upon controversial metaphysical premises. It is widely thought that future-like-ours argument indeed relies upon controversial metaphysics, in that it must reject the psychological theory of personal identity. I argue that that thought is mistaken—the future-like-ours argument does not depend upon the rejection of such a theory. I suggest, (...) however, that given a widely-accepted view about contraception and abstinence, the argument is committed to contentious metaphysics after all, as it relies upon a highly controversial assumption about mereology. This commitment is not only relevant for those who are inclined to endorse the argument but reject the mereological view in question, but in addition entails dialectical and epistemological liabilities for the argument, which on some views will be fatal to the argument’s overall success. Ce livre presente les films de Lynch en montrant que ce qui deja apparait dans Eraserhead trouve son prolongement et sa cle dans Inland Empire (en passant bien sur par les autres oeuvres et tout particulierement Lost Highway et Mulholland Drive). A savoir que, comme dans le premier chapitre de Matiere et memoire de Bergson, le monde est image, de sorte que la matiere se resout dans son image et que ce sont les images qui, par leur agencement, creent le (...) monde dans sa solidite et sa fixite. Avec cette difference toutefois: les films de Lynch fonctionnent sur un desenchainement des images qui, d'abord, donne une matiere a l'image, et, ensuite, a pour consequence que ces images entrent sans cesse dans de nouvelles series. Ces series produisent non seulement des mondes possibles qui annulent le privilege d'un monde reel (parce que celui-ci devient un monde possible au meme titre que les autres), mais elles entremelent aussi differentes temporalites ou la linearite passe-present-futur disparait. In continuation of [JOH04, OH07], we prove that existentially closed CSA-groups have the independence property. This is done by showing that there exist words having the independence property relative to the class of torsion-free hyperbolic groups.

Is history at present in a position to sustain the dialogue of our times? Is it not rather, like an album of faded pictures, a curiously anachronistic story for a century infatuated with progress, speed, and productivity?

There is, naturally, no more ambiguous factor in all human knowledge than the possible bearing of what we do not know on what we do know.

We describe the results and implications of a literature review that identifies the number of normative and empirical articles, respectively, that have appeared in Nursing Ethics in each year from 1994 to 2017. The results of our analysis suggest a powerful trend away from normative scholarship and toward empirical investigation within the field of nursing ethics, both overall and comparatively. We argue that there are several important negative consequences of this trend, and we propose some potential solutions to address them.

Uncertainty and affect are fundamental and interrelated aspects of the human condition. Uncertainty is often associated with negative affect, but in some circumstances it is associated with positive affect. In this paper, we review different explanations for the varying relationship between uncertainty and affect. We identify “mental simulation” as a key process that links uncertainty to affective states. We suggest that people have a propensity to simulate negative outcomes, which results in a propensity towards negative affective responses to uncertainty. We (...) also propose the existence of several important moderators of this process, including context and individual differences such as uncertainty tolerance, as well as emotion regulation strategies. Finally, we highlight important knowledge gaps and promising areas for future research, both empirical and conceptual, to further elucidate the relationship between uncertainty and affect. (shrink)

It is well known that Max Scheler framed his ethics in opposition to Kant’s “formalistic” ethical framework. However, it is a lesser-known fact that Scheler offered a critique of the ancient Greek moral vision. Although this critique was less developed than the one of Kant, the critique of the ancients was no less significant. First explicated in 1912 in Ressentiment, its central theme is reprised in nearly all of Scheler’s main texts even up until his death. Scheler’s contention is with (...) what he calls the “love of goodness,” which he also happens to think Aristotle’s ethics represents. This paper will primarily examine the love of goodness, first, as one side of the “categorial form” of "Pharisaism"—that is, as it represents a “moral illusion”—then as the other side—namely, as it corresponds to “epistemological error." Finally, I consider the specific moral context in light of where it naturally leads Scheler: to the principle of solidarity. (shrink)

The law of desire has been proposed in several forms, but its essential claim is that agents always act on their strongest proximal action motivation. This law has threatening consequences for human freedom, insofar as it greatly limits agents’ ability to do otherwise given their motivational state. It has proven difficult to formulate a version that escapes counterexamples and some categorically deny its truth. Noticeable by its absence in the literature is any attempt to provide an argument for the law (...) of desire – I propose such an argument here. It is noted that Sripada's “divided mind” theory of willpower provides a counterexample to the version of the law of desire my argument defends, but I note that a reformulated version of the law of desire survives this critique. I conclude that there is a serious case for the law of desire, and note the broader implications of this. (shrink)

In 1960, in "The Problem of Method," which serves as the introduction not only to Critique of Dialectical Reason but to all of his recent work, Sartre enrolls himself solemnly under the banner of Marxism, which he considers the unsurpassable philosophy of our era. Today, a dozen years later, the Sartrean position has become open to challenge, it is true, because its deconstruction is underway, but it has not yet been dismissed as absurd. Existentialism, by immolating itself on the altar (...) of praxis, has taken with it phenomenology and the Existenzphilosophie that emerged from it. In this paper I compare the roles that the explicit and implicit educational theories of John Dewey and John Rawls play in their political works to show that Rawls’s approach is skeletal and inappropriate for defenders of democracy. I also uphold Dewey’s belief that education is valuable in itself, not only derivatively, contra Rawls. Next, I address worries for any educational theory concerning problems of distributive justice. Finally, I defend Dewey’s commitment to democracy as a consequence of the demands of (...) productive public inquiry and education. (shrink)

Sellars and McDowell, among others, attribute a prominent role to the Myth of the Given. In this paper, I suggest that they have in mind two different versions of the Myth of the Given and I argue that Kant is not the target of one version and, though explicitly under attack from the other, has resources sufficient to mount a satisfactory response. What is essential to this response is a proper understanding of (empirical) concepts as involving unifying functions that can (...) take sensations as input and deliver normative representations as outputs. By understanding concepts in this way, one need not, as the second version of the Myth of the Given maintains, take sensations to be both natural and normative. Instead, they can be understood as the natural effects of external objects on us, but natural effects that can nonetheless play a role in a normative process because the concepts that are responsible for the normativity of the results can require that such natural effects be present as inputs into the process. Die Rezeption, die die Arbeit von Hans Jonas in Frankreich erlebt hat, wurde hauptsächlich durch die Zeitachse der Übersetzungen seiner Bücher bestimmt. Das Prinzip Verantwortung wurde 1990 von Jean Greisch unter dem Titel Le principe responsabilité veröffentlicht und diese Übersetzung hat zweifellos das Interesse der französischen Intellektuellen für Jonas geweckt. Es ist allerdings zum Teil heftig kritisiert worden – insbesondere wegen seines kantischen Charakters gab es Diskussionen.

A frequentist confidence interval can be constructed by inverting a hypothesis test, such that the interval contains only parameter values that would not have been rejected by the test. We show how a similar definition can be employed to construct a Bayesian support interval. Consistent with Carnap’s theory of corroboration, the support interval contains only parameter values that receive at least some minimum amount of support from the data. The support interval is not subject to Lindley’s paradox and provides an (...) evidence-based perspective on inference that differs from the belief-based perspective that forms the basis of the standard Bayesian credible interval. We argue that extreme endurance sport can be valuable for some nonhuman animals. To make the case, we focus specifically on dogsled racing. We argue that, given certain views about the nature of self-affirmation, perceptual agency, and affordances, sled dogs are capable of realizing significant value through extreme endurance running. Because our focus is on the axiological question of the nature of the value of the sport for its participants, we do not claim that extreme dogsledding is ethical; indeed, we (...) acknowledge the morally objectionable aspects of the practice in its current form. Still, we offer our argument as a critical step in providing an adequate moral justification for a reformed model of dogsled racing. If it is permissible, that is likely because it offers some significant benefits to sled dogs. Given some assumptions about sled dogs’ capacity to be guided by both internal and external affordances, those benefits include self-affirmation. (shrink)

In The Expanse, Naomi Nagata, the Roci's XO and engineering marvel, is a person caught between worlds, someone torn in multiple directions by the social situations she finds herself immersed in. Throughout the series, she embodies multiplicitous subjectivity. In Nemesis Games Naomi Nagata experiences the kind of inner conflict of the self that can occur in moving between worlds. Internal conflict illuminates the multiple worlds Naomi inhabits. Just as one can travel between Earth and Mars, “one can ‘travel’ between these (...) [social] ‘worlds.’” Unlike places such as Earth and Mars, with worlds in the social sense, “one can inhabit more than one of these ‘worlds’ at the very same time.” In framing spaces of meaning, the establishment of borders between worlds creates borderlands. As algorithms pervade numerous facets of daily life, they are incorporated into systems for increasingly diverse purposes. These systems’ results are often interpreted differently by the designers who created them than by the lay persons who interact with them. This paper offers a proposal for human-centered algorithm design, which incorporates human and social interpretations into the design process for algorithmically based systems. It articulates three specific strategies for doing so: theoretical, participatory, and speculative. Drawing on the author’s work designing and (...) deploying multiple related systems, the paper provides a detailed example of using a theoretical approach. It also discusses findings pertinent to participatory and speculative design approaches. The paper addresses both strengths and challenges for each strategy in helping to center the process of designing algorithmically based systems around humans. (shrink)

A recent thought‐provoking theory argues that complex organisms using epigenetic information for their normal development and functioning must irreversibly age as a result of epigenetic signal loss. Importantly, the scope of this theory could be considerably expanded, with scientific benefits, by analyzing epigenetic ageing beyond the borders of the Tree of Life. Viruses that use epigenetic signals for their normal functioning may also age, that is, present an increasing risk of failing to complete their individual life cycle and to disappear (...) with time. As viruses are ancient, abundant, and infect a considerable diversity of hosts, the ageing virus hypothesis, if verified, would have important consequences for many fields of the Life sciences. Uncovering ageing viruses would integrate the most abundant and biologically central entities on Earth into theories of ageing, enhance virology, gerontology, evolutionary biology, molecular ecology, genomics, and possibly medicine through the development of new therapies manipulating viral ageing.
