This major new study of Machiavelli’s moral and political philosophy by Benner (Yale) argues that most readings of Machiavelli suffer from a failure to appreciate his debt to Greek sources, particularly the Socratic tradition of moral and political philosophy. Benner argues that when read in the light of his Greek sources, Machiavelli appears as much less the immoralist or (...) sophist he often is taken for and instead as a serious moral philosopher very much concerned with the republican ideals of justice and the rule of law. The author does not ignore Machiavelli’s more infamous dicta, but argues that a careful reading shows that they are expressions of views he ultimately rejects. Particularly noteworthy here is her careful attention to Machiavelli’s Florentine Histories.
Benner’s reading of Machiavelli is far too complex and subtle for such a brief summary. Her research is meticulous and her arguments finely honed. This important contribution to both Machiavelli studies and the history of political philosophy will be indispensable for scholars.

A key distinction in ethics is between members and nonmembers of the moral community. Over time, our notion of this community has expanded as we have moved from a rationality criterion to a sentience criterion for membership. I argue that a sentience criterion is insufficient to accommodate all members of the moral community; the true underlying criterion can be understood in terms of whether a being has interests. This may be extended to conscious, self-aware machines, as well as to any (...) autonomous intelligent machines. Such machines exhibit an ability to formulate desires for the course of their own existence; this gives them basic moral standing. While not all machines display autonomy, those which do must be treated as moral patients; to ignore their claims to moral recognition is to repeat past errors. I thus urge moral generosity with respect to the ethical claims of intelligent machines. (shrink)

Our aim in this article is to bring some clarity to the clinical ethics expertise debate by critiquing and replacing the taxonomy offered by the Core Competencies report. The orienting question for our taxonomy is: Can clinical ethicists offer justified, normative recommendations for active patient cases? Views that answer “no” are characterized as a “negative” view of clinical ethics expertise and are further differentiated based on (a) why they think ethicists cannot give justified normative recommendations and (b) what they think (...) ethicists can offer, if they cannot offer recommendations. Views that answer “yes” to the orienting question are characterized as a “positive” view of clinical ethics expertise. Positive views are distinguished according to four additional questions. First (P1), how are those recommendations generated? Second (P2), what is the nature of the recommendations? Third (P3), we ask, how are the recommendations justified? Identity criteria are powerful tools for the metaphysician. They tell us when items are identical or distinct. Some varieties of identity criteria also try to explain in virtue of what items are identical or distinct. This Element has two objectives: to discuss formulations of identity criteria and to take a closer look at one notorious criterion of object identity, Leibniz's Law. The first section concerns the form of identity criteria. The second section concerns the better-regarded half of Leibniz's Law, the (...) indiscernibility of identicals. The third section turns to the more controversial half of Leibniz's Law, the identity of indiscernibles. The decline of empathy among health professional students, highlighted in the literature on health education, is a concern for medical educators. The evidence suggests that empathy decline is likely to stem more from structural problems in the healthcare system rather than from individual deficits of empathy. In this paper, we argue that a focus on direct empathy development is not effective and possibly detrimental to justice-oriented aims. Drawing on critical and narrative theory, we propose an interpersonal approach to enhance empathic (...) capacities that is centered on constructive and transformative interactions which integrates the participatory arts and involves both patients and health professional students. We describe and evaluate a program where patients and students create collaborative, original songs. Interviews and a focus group revealed interactional processes summarized in four themes: reciprocal relationships, interactions in the community, joint goal, and varied collaboration. There was a significant enhancement of positive attitudes about care post-program amongst health professional students. The interpersonal approach may be a preliminary framework for the medical humanities to shift away from a focus on direct empathy development and further towards participatory, co-creative, and justice-oriented approaches to enhance health and thereby empathic capabilities. This article argues that while the presence and influence of “futility” as a concept in medical decision-making has declined over the past decade, medicine is seeing the rise of a new concept with similar features: suffering. Like futility, suffering may appear to have a consistent meaning, but in actuality, the concept is colloquially invoked to refer to very different experiences. Like “futility,” claims of patient “suffering” have been used (perhaps sometimes consciously, but most often unconsciously) to smuggle value judgments about (...) quality of life into decision-making. And like “futility,” it would behoove us to recognize the need for new, clearer terminology. This article will focus specifically on secondhand claims of patient suffering in pediatrics, but the conclusions could be similarly applied to medical decisions for adults being made by surrogate decision-makers. While I will argue that suffering, like futility, is not sufficient wholesale justification for making unilateral treatment decisions, I will also argue that claims of patient suffering cannot be ignored, and that they almost always deserve some kind of response. In the final section, I offer practical suggestions for how to respond to claims of patient suffering. (shrink)

Humeans and anti-Humeans agree that laws of nature should explain scientifically particular matters of fact. One objection to Humean accounts of laws contends that Humean laws cannot explain particular matters of fact because their explanations are harmfully circular. This article distinguishes between metaphysical and semantic characterizations of the circularity and argues for a new semantic version of the circularity objection. The new formulation suggests that Humean explanations are harmfully circular because the content of the sentences being explained is part of (...) the content of the sentences doing the explaining. The COVID-19 pandemic and its associated stressors have impacted the daily lives and sleeping patterns of many individuals, including university students. Dreams may provide insight into how the mind processes changing realities; dreams not only allow consolidation of new information, but may give the opportunity to creatively “play out” low-risk, hypothetical threat simulations. While there are studies that analyze dreams in high-stress situations, little is known of how the COVID-19 pandemic has impacted dreams of university students. The aim of this (...) study was to explore how the dream content of students was affected during the university COVID-19 lockdown period (March–July, 2020). Using online survey methods, we analyzed dream recall content (n= 71) using the Hall-Van de Castle dream coding system and Fisher's exact tests for sex comparisons. Preliminary results indicate that female students experienced more nightmares as compared to male students. Dream analysis found that, relative to normative American College Student (ACS) samples generated pre-COVID-19, women were more likely to experience aggressive interactions in their dream content, including increased physical aggression. Results indicate that university students did experience changes in dream content due to the pandemic lockdown period, with women disproportionally affected. These findings can aid universities in developing support programs for students by bringing forth an understanding of students' concerns and anxieties as they process the “new normal” of social distancing. Although personal attributes have gained recognition as an important area of effective corporate governance, scholarship has largely overlooked the value and implications of individual virtue in governance practice. We explore how authenticity—a personal and morally significant virtue—affects the primary monitoring and strategy functions of the board of directors as well as core processes concerning director selection, cultivation, and enactment by the board. While the predominant focus in corporate governance research has been on structural factors that influence firm financial outcomes, this (...) paper shifts attention to the role of authenticity and its relationship to individual board member qualities and collective board activities. A number of significant contributions in the last four decades show that non-normal modal logics can be fruitfully employed in several applied fields. Well-known domains are epistemic logic, deontic logic, and systems capturing different aspects of action and agency such as the modal logic of agency, concurrent propositional dynamic logic, game logic, and coalition logic. Semantics for such logics are traditionally based on neighbourhood models. However, other model-theoretic semantics can be used for this purpose. Here, we systematically study multi-relational structures, (...) whose investigation is still relatively underdeveloped. After a brief introduction to two different versions of multi-relational semantics – which we call strong and weak multi-relational semantics – we proceed to study several modal schemata. Identity and distinctness facts are ones like “The Eiffel Tower is identical to the Eiffel Tower,” and “The Eiffel Tower is distinct from the Louvre.” This paper concerns one question in the metaphysics of identity: Are identity and distinctness facts metaphysically fundamental or are they nonfundamental? I provide an overview of answers to this question.

I provide a new account of what it is for the laws of nature to govern the evolution of events. I locate the source of governance in the content of law propositions. As such, I do not appeal to primitive notions of ground, essence, or production to characterize governance. After introducing the account, I use it to outline previously unrecognized varieties of governance. I also specify that laws must govern to have two theoretical virtues: explanatory power as well as a (...) theoretical virtue I call expansiveness. This article argues humans should not be defined strictly at their physical boundaries with clear distinctions between anatomical bodies, mental states, and the rest of the world. Rather, diverse mental states, which are often diagnosed as “mental illness,” take shape within greater environmental forces and flows, including those that are constructed online. Drawing from a multi-sited ethnography of The Icarus Project, a radical mental health community, the author situates online narratives written by two of its members within posthuman emotional ecologies (...) in which the exchange of ideas online affects mental states in a profound way. These narratives can be seen as a new type of psychiatric resistance based in new technologies, one that “uncivilizes” mental illness by searching for alternative frameworks and metaphors to understand lived experiences with mental distress. This ethnographic perspective differs significantly from traditional bio-psychiatric models and interventions and can offer both patients and mental healthcare providers with an alternative language to frame mental health. This paper offers a metaphysical explanation of the identity and distinctness of concrete objects. It is tempting to try to distinguish concrete objects on the basis of their possessing different qualitative features, where qualitative features are ones that do not involve identity. Yet, this criterion for object identity faces counterexamples: distinct objects can share all of their qualitative features. This paper suggests that in order to distinguish concrete objects we need to look not only at which properties and relations objects (...) instantiate but also how they instantiate these properties and relations. I propose that objects are identical when they stand in certain qualitative relations in virtue of their existence. And concrete objects are distinct when they do not stand in the same kinds of relations to one another in virtue of their existence. (shrink)

As COVID-19 drags on and new vaccines promise widespread immunity, the world's attention has turned to predicting how the present pandemic will end. How do societies know when an epidemic is over and normal life can resume? What criteria and markers indicate such an end? Who has the insight, authority, and credibility to decipher these signs? Detailed research on past epidemics has demonstrated that they do not end suddenly; indeed, only rarely do the diseases in question actually end. This article (...) examines the ways in which scholars have identified and described the end stages of previous epidemics, pointing out that significantly less attention has been paid to these periods than to origins and climaxes. Analysis of the ends of epidemics illustrates that epidemics are as much social, political, and economic events as they are biological; the “end,” therefore, is as much a process of social and political negotiation as it is biomedical. Equally important, epidemics end at different times for different groups, both within one society and across regions. Multidisciplinary research into how epidemics end reveals how the end of an epidemic shifts according to perspective, whether temporal, geographic, or methodological. A multidisciplinary analysis of how epidemics end suggests that epidemics should therefore be framed not as linear narratives—from outbreak to intervention to termination—but within cycles of disease and with a multiplicity of endings. Classical cognitive science has been characterized by an association with the computational theory of mind. Although this association has produced highly significant results, it has also limited the scope of scientific psychology. In this paper, we analyse the limits of the specific kind of computational model represented by the Chomskian-Fodorian tradition in the study of mind and language. In our opinion, the adhesion to the principle of formality imposed by this specific computational model has motivated the exclusion of consciousness in (...) the reflection on language and, consequently, has led to the inability to account for some aspects of language functioning at the processing level of discourse. The aim of this article is to restore the role of consciousness in discourse comprehension and production processes. Specifically, we argue that the ability to produce and understand discourses is based on individuals’ capacity for navigation in space and time. We will show that the space–time orientation is guaranteed by the projection of the self, which involves a special kind of consciousness. (shrink)

(Rabinow on Foucault 1997, p. XIX) (...) I do not know whether it must be said today that the critical task still entails faith in Enlightenment; I continue to think that this task requires work on our limits, that is, a patient labor giving form to our impatience for liberty. (Foucault 1997, p. 319) IN RESPONDING TO MY PAPER, Bracken and Charland raise a number of interesting points. Through discussing Tuke's York Retreat (Charland) and Foucault's "regimes of truth" (Bracken), the character of moral treatment, the value of a Foucauldian analysis, the importance of listening (as well as its limits), and the necessity of taking action are all raised as important issues when considering the history and current status of psychiatry. In my response, I shall focus on the latter two issues, namely, the possibility of listening and the necessity of action. I will make the argument that although action can, and often should, follow listening, having action as its necessary (and immediate) goal brings with it a set of pressures and practices that can render both experiences difficult, if not impossible.First, let me share my understanding of Bracken and Charland's main theses and arguments. For Patrick Bracken, the main purpose of any critique, but particularly a critique of current psychiatric practice, is to present readers with a new way of listening and understanding. It should, to paraphrase Bracken, open things up for deeper analysis. The Foucault he is listening to, then, is a man in whose "hands history becomes philosophy". This transformation is important because as it occurs new "discursive spaces" open up, thereby presenting readers of his work with new voices (e.g., patients, less-than-famous psychiatrists, priests). This incursion of the new does not necessarily, however, invalidate the old. Bracken substantiates this by making the important point that Foucault did not simply reject Enlightenment reason (an old and highly persistent voice), but rather "challenged the idea that we have to choose to be for or against" it. Bracken further points out that listening to these voices, [End Page 189] old or new, is never a completely "clean" practice. In Bracken's words, "there is no neutral, asocial or apolitical vantage point from [which] we can judge the validity of one position over the other." This means that in listening to the "other" (as patient, friend, argument, or psychiatric practice) we must maintain a kind of double consciousness, one in which we attend to this other voice while at the same time being aware that neither of us are speaking from within a neutral, clean space (devoid of political, social, and/or cultural pressures or implications). Maintaining this kind of awareness is difficult for obvious reasons. In mental health practice and for Bracken, however, this difficulty can be worthwhile if it results in formerly silent participants having "their voice heard in debates about service development and the nature of progress."Although I doubt Louis Charland would disagree with the idea that listening is important, he does take the function of critique one step further. Specifically for Charland, critiques of psychiatric practice, past and particularly present, should result in the identification of alternative solutions. Failing to do so can indicate that the critique "borders on a lack of depth." If one extends this assertion about my analysis to Foucault's own work, we find that Charland is not alone. For example, Hoy, in his introduction to his edited Foucault: A Critical Reader (1992), states that "Foucault's continued refusal to specify either a prescription or a prognosis for social illnesses he diagnoses suggests to some readers that genealogy is as unserious and irresponsible as archeology" (p. 7). Contemporary semantic theories can be classified along two dimensions: (i) the way and time-course in which contextual factors influence sentence truth-conditions; and (ii) whether and to what extent comprehension involves sensory, motor and emotional processes. In order to explore this theoretical space, our ERP study investigates the time-course of the interaction between the lexically specified telic component of a noun (the function of the object to which the noun refers to, e.g., a funnel is generally used to pour liquids into (...) containers) and an ad-hoc affordance contextually induced by the situation described in the discourse. We found that, if preceded by a neutral discourse context, a verb incongruent with the noun’s telic component as in “She uses the funnel to hang her coat” elicited an enhanced N400 compared to a congruent verb as in “She uses the funnel to pour water into a container”. However, if the situation introduced in the preceding discourse induced a new function for the object as an ad-hoc affordance (e.g., the funnel is glued to the wall and the agent wants to hang the coat), we observed a crossing-over regarding the direction of the N400 effect: comparing the ad-hoc affordance-inducing context with the neutral context, the N400 for the incongruent verb was significantly reduced, whereas the N400 for the congruent verb was significantly enhanced. We explain these results as a consequence of the incorporation of the contextually triggered ad-hoc affordance into the meaning of the noun. Combining these results with an analysis of semantic similarity values between test sentences and contexts, we argue that one possibility is that the incorporation of an ad-hoc affordance may be explained on the basis of the mental simulation of concurrent motor information. When the human understanding of beasts in the past is studied, what are revealed is not only the foundations of our own perception of animals, but humans contemplating their own status. This book argues that what is revealed in a wide range of writing from the early modern period is a recurring attempt to separate the human from the beast. Looking at the representation of the animal in the law, religious writings, literary representation, science and political ideas, what emerges is (...) a sense of the fragility of humanity, a sense of a species which always requires an external addition--property, civilization, education--to be fully human. Many of us are all too familiar with the experience of taking pleasure in things we feel we ought not, and of finding it frustratingly hard to bring our pleasures into line with our moral judgements. As a value dualist, Kant draws a sharp contrast between the two sources of practical motivation: pleasure in the agreeable and respect for the moral law. His ethics might thus seem to be an unpromising source for help in thinking about how we can bring (...) our agreeable pleasures into line with our moral values. But I argue that a careful reading of Kant’s texts reveals a helpfully realistic view about the extent to which we can modify our agreeable pleasures. On my interpretation, Kant shows us how to hold together two seemingly incompatible ideas: on the one hand, that pleasure in the agreeable is resistant to rational direction, and on the other hand, that we can cultivate these pleasures with a view to ethical self-transformation. This essay traces out the context that allowed numerous early modern thinkers to deny that animals had faces. Using early- to mid-seventeenth-century writing by, among others, John Milton, John Bulwer and Ben Jonson, it shows that faces were understood to be sites of meaning, and were thus, like gestural language and the capacity to perform a dance, possessed by humans alone. Animals, this discourse argued, have no ability to communicate meaningfully because they have no bodily control, and as such they (...) are faceless beings without individuality and without a sense of self-consciousness. Communities play an important role in many areas of philosophy, ranging from epistemology through social and political philosophy. However, two notions of community are often conflated. The descriptive concept of community takes a community to be a collection of individuals satisfying a particular description. The relational concept of community takes a community to consist of more than a set of members satisfying a particular trait; there must also be a relation of recognition among the members or between the members and (...) the community as a whole. The descriptive concept is simpler, however, it does not provide a sufficiently robust concept of community. I argue instead that the relational notion is philosophically richer and more accurately captures the true nature of a community. (shrink)

This case analysis examines the pediatric clinical ethics issues of adolescent autonomy and parental authority in medical decision–making. The case involves a dying adolescent whose parents request that the medical team withhold diagnosis and prognosis information from the patient. The analysis engages two related ethical questions: Should Annie be given information about her medical condition? And, who is the proper decision–maker in Annie’s case? Ultimately, four practical recommendations are offered.

Neurocognitive and genetic approaches have made progress in understanding language-music interaction in the adult brain. Although there is broad agreement that learning processes affect how we represent, comprehend, and produce language and music, there is little understanding of the content and dynamics of the early language-music environment in the first years of life. A developmental-ecological approach sees learning and development as fundamentally embedded in a child’s environment, and thus requires researchers to move outside of the lab to understand what children (...) are seeing, hearing, and doing in their daily lives. In this paper, after first reviewing the limitations of traditional developmental approaches to understanding language-music interaction, we describe how a developmental-ecological approach can not only inform developmental theories of language-music learning, but also address challenges inherent to neurocognitive and genetic approaches. We then make suggestions for how researchers can best use the developmental-ecological approach to understand the similarities, differences, and co-occurrences in early music and language input. I argue that Kant's ethical framework cannot countenance a certain kind of failure to respect oneself that can occur within oppressive social contexts. Kant's assumption that any person, qua rational being, has guaranteed epistemic access to the moral law as the standard of good action and the capacity to act upon this standard makes autonomy an achievement within the individual agent's power, but this is contrary to a feminist understanding of autonomy as a relational achievement that can be thwarted by (...) the systematic attack on autonomy that occurs within oppressive social conditions. Insofar as Kant's negative duty of self-respect is unable to accommodate the ways immersion in oppressive social environments can warp an individual's understanding of what she is owed and capable of as a moral agent, it perpetuates the cruelty of unjust social systems in the guise of respecting individual autonomy. I conclude by considering Carol Hay's argument that those who are oppressed have an obligation to themselves to resist their own oppression, in order to explore how this limitation in how Kant conceives of the duty to respect the self may reach expression in contemporary ethical theory inspired by Kant. Climate change adaptation is largely a local matter, and adaptation planning can benefit from local climate change projections. Such projections are typically generated by accepting climate model outputs in a relatively uncritical way. We argue, based on the IPCC’s treatment of model outputs from the CMIP5 ensemble, that this approach is unwarranted and that subjective expert judgment should play a central role in the provision of local climate change projections intended to support decision-making.

Central to Confucian teachings in the Analects is the ideal of self-cultivation—in particular that of the junzi 君子 (“gentleman” “nobleman”) ideal. At the same time that Confucius recommends that individuals follow such an ideal, he also places limits on who actually might attain it. By examining statements involving such terms as the junzi, the “petty man” ( xiao ren 小人), and the “masses” ( min 民, or zhong 眾), or common people, this essay highlights the sociopolitical and gender restrictions informing (...) one of the most basic, yet lofty, ethical goals of the text. A new means is also offered of discussing these socially delimited discrepancies in moral cultivation by referring to leading, or self-determining agency in association with junzi on the one hand, and to conformist agency for women and common people on the other. Time has been considered a crucial factor in distinguishing between two levels of self-awareness: the “core,” or “minimal self,” and the “extended,” or “narrative self.” Herein, I focus on this last concept of the self and, in particular, on the relationship between the narrative self and language. In opposition to the claim that the narrative self is a linguistic construction, my idea is that it is created by the functioning of mental time travel, that is, the faculty of human beings (...) to project themselves mentally backwards in time to relive, or forward to anticipate, events. Moreover, I propose that narrative language itself should be considered a product of a core brain network that includes mechanisms, such as mental time travel, mindreading, and visuo-spatial systems. This article is a response to McLeod and Baylis (2007) who speculate on the dangers of requesting fresh ‘spare’ embryos from IVF patients for human embryonic stem cell (hESC) research, particularly when those embryos are good enough to be transferred back to the woman. They argue that these embryos should be frozen instead. We explore what is meant by ‘spare’ embryos. We then provide empirical evidence, from a study of embryo donation and of embryo donors' views, to substantiate some of (...) their speculations about the problems associated with requesting fresh embryos. However, we also question whether such problems are resolved by embryo freezing, since further empirical evidence suggests that this raises other social and ethical problems for patients. There is little evidence that the request for embryos for research, in itself, causes patients distress. We suggest, however, that no requests for fresh embryos should be made in the first cycle of IVF treatment. Deferring the request to a later cycle ensures that potential donors are better informed (by experience and reflection) about the possible destinations of their embryos and about the definition of ‘spare embryos’. Both this article, and that by McLeod and Baylis, emphasize the need to consider the views and experiences of embryo donors when evaluating the ethics of embryo donation for hESC research. (shrink)
