A growing literature documents the existence of individuals who make a living by participating in phase I clinical trials for money. Several scholars have noted that the concerns about risks, consent, and exploitation raised by this phenomenon apply to many (other) jobs, too, and therefore proposed improving subject protections by regulating phase I trial participation as work. This article contributes to the debate over this proposal by exploring a largely neglected worry. Unlike most (other) workers, subjects are not paid to (...) produce or achieve anything but to have things done to them. I argue that this passivity is problematic for reasons of distributive justice. Specifically, it fails to enable subjects to realize what Gheaus and Herzog call “the goods of work”—a failure not offset by adequate opportunities to realize these goods outside of the research context. I also consider whether granting subjects worker-type protections would accommodate this concern. (shrink)

In a seminal book, Alvin I. Goldman outlines a theory for how to evaluate social practices with respect to their “veritistic value”, i.e., their tendency to promote the acquisition of true beliefs in society. In the same work, Goldman raises a number of serious worries for his account. Two of them concern the possibility of determining the veritistic value of a practice in a concrete case because we often don't know what beliefs are actually true, and even if we did, (...) the task of determining the veritistic value would be computationally extremely difficult. Neither problem is specific to Goldman's theory and both can be expected to arise for just about any account of veritistic value. It is argued here that the first problem does not pose a serious threat to large classes of interesting practices. The bulk of the paper is devoted to the computational problem, which, it is submitted, can be addressed in promising terms by means of computer simulation. In an attempt to add vividness to this proposal, an up-and-running simulation environment is presented and put to some preliminary tests. (shrink)

Artificial intelligence is shaping strategy, activities, interactions, and relationships in business and specifically in marketing. The drawback of the substantial opportunities AI systems and applications provide in marketing are ethical controversies. Building on the literature on AI ethics, the authors systematically scrutinize the ethical challenges of deploying AI in marketing from a multi-stakeholder perspective. By revealing interdependencies and tensions between ethical principles, the authors shed light on the applicability of a purely principled, deontological approach to AI ethics in marketing. In this paper, I explore the prospects for risk-based arguments in favour of anti-natalism, which explain the wrongness of procreation in terms of wrongful risk-imposition on the resultant child. After considering and rejecting two risk-based arguments from the existing literature - David Benatar's and Matti Häyry's - I propose a more promising version that focuses on the lack of appropriate justification for imposing the risks of existence, namely, one that refers to the essential interests of the child on whom those (...) risks are imposed. The paper proceeds in four parts. In Part 2, I set the stage for my discussion by clarifying the basic structure of risk-based arguments and identifying some of their important features. In Parts 3-5, I consider three distinct risk-based arguments for anti-natalism and argue that only the third, justificatory argument has the potential to be successful. (shrink)

In the literature on scientific explanation two types of pluralism are very common. The first concerns the distinction between explanations of singular facts and explanations of laws: there is a consensus that they have a different structure. The second concerns the distinction between causal explanations and uni.cation explanations: most people agree that both are useful and that their structure is different. In this article we argue for pluralism within the area of causal explanations: we claim that the structure of a (...) causal explanation depends on the causal structure of the relevant fragment of the world and on the interests of the explainer. A ubiquitous argument against mental-state accounts of well-being is based on the notion that mental states like happiness and satisfaction simply cannot be measured. The purpose of this paper is to articulate and to assess this “argument from measurability.” My main thesis is that the argument fails: on the most charitable interpretation, it relies on the false proposition that measurement requires the existence of an observable ordering satisfying conditions like transitivity. The failure of the argument from measurability, however, does not (...) translate into a defense of mental-state accounts as accounts of well-being or of measures of happiness and satisfaction as measures of well-being. Indeed, I argue, the ubiquity of the argument from measurability may have obscured other, very real problems associated with mental-state accounts of well-being – above all, that happiness and satisfaction fail to track well-being – and with measures of happiness and satisfaction – above all, the tendency toward reification. I conclude that the central problem associated with the measurement of, e.g., happiness as a subjectively experienced mental state is not that it is too hard to measure, but rather that it is too easy to measure. This paper argues that ‘the Anthropocene’ is a deeply depoliticizing notion. This de-politicization unfolds through the creation of a set of narratives, what we refer to as ‘AnthropoScenes’, which broadly share the effect of off-staging certain voices and forms of acting. Our notion of the Anthropo-obScene is our tactic to both attest to and undermine the depoliticizing stories of ‘the Anthropocene’. We first examine how various AnthropoScenes, while internally fractured and heterogeneous, ranging from geo-engineering and earth system science to more-than-human (...) and object-oriented ontologies, place things and beings, human and non-human, within a particular relational straitjacket that does not allow for a remainder or constitutive outside. This risks deepening an immunological biopolitical fantasy that promises adaptive and resilient terraforming, an earth system management of sorts that permits life as we know it to continue for some, while turning into a necropolitics for others. Second, we develop a post-foundational political perspective in relation to our dramatically changing socio-ecological situation. This perspective understands the political in terms of performance and, in an Arendtian manner, re-opens the political as forms of public-acting in common that subtracts from or exceeds what is gestured to hold socio-ecological constellations together. We conclude that what is off-staged and rendered obscene in ‘the AnthropoScenes’ carries precisely the possibility of a return of the political. (shrink)

This article examines the legitimacy attached to different types of multi-stakeholder data partnerships occurring in the context of sustainable development. We develop a framework to assess the democratic legitimacy of two types of data partnerships: open data partnerships and closed data partnerships. Our framework specifies criteria for assessing the legitimacy of relevant partnerships with regard to their input legitimacy as well as their output legitimacy. We demonstrate which particular characteristics of open and closed partnerships can be expected to influence an (...) analysis of their input and output legitimacy. (shrink)

Gustafsson and Espinoza have recently argued that the ‘small-improvement argument’, against completeness as a rationality requirement for preference orderings, is defective. They claim that the two main premises of the argument conflict, and hence should not both be accepted. I show that this conflict can be avoided by modifying one of the premises.

Background: Metaphors are often used within the context of ethics and healthcare but have hardly been explored in relation to moral reasoning. Objective: To describe a central set of metaphors in one case and to explore their contribution to moral reasoning. Method: Semi-structured interviews were conducted with 16 parents of a child suffering from the neurodegenerative disease CLN3. The interviews were recorded, transcribed, and metaphors were analyzed. The researchers wrote memos and discussed about their analyses until they reached consensus. Ethical (...) considerations: Participants gave oral and written consent and their confidentiality and anonymity were respected. Findings: A central set of metaphors referred to the semantic field of the hands and arms and consisted of two central metaphors that existed in a dialectical relationship: grasping versus letting go. Participants used these metaphors to describe their child’s experiences, who had to “let go” of abilities, while “clinging” to structures and the relationship with their parent(s). They also used it to describe their own experiences: participants tried to “grab” the good moments with their child and had to “let go” of their child when (s)he approached death. Participants, in addition, “held” onto caring for their child while being confronted with the necessity to “let go” of this care, leaving it to professional caregivers. Discussion: The ethical analysis of the findings shows that thinking in terms of the dialectical relationship between “grasping” and “letting go” helps professional caregivers to critically think about images of good care for children with CLN3. It also helps them to bear witness to the vulnerable, dependent, and embodied nature of the moral self of children with CLN3 and their parents. Conclusion: Metaphorical reasoning may support the inclusion of marginalized perspectives in moral reasoning. Future studies should further explore the contribution of metaphorical reasoning to moral reasoning in other cases. (shrink)

This is an extended meditation on ethics in literature across the Senecan corpus. There are two chapters on the Moral Letters, asking how one is to read philosophy or how one can write about being. Moving from the Letters to the Natural Questions and Dialogues, Professor Gunderson explores how authorship works at the level both of the work and of the world, the ethics of seeing, and the question of how one can give up on the here and now and (...) behold instead some other, better ethical sphere. Seneca's tragedies offer words of caution: desire might well subvert reason at its most profound level, or humanity's painful separation from the sublime might be part of some cruel divine plan. The book concludes by considering what, if anything, we are to make of Seneca's efforts to enlighten us. (shrink)

The ‘non-identity problem’ raises a well-known challenge to the person-affecting view, according to which an action can be wrong only if it affects someone for the worse. In a recent article, however, Thomas D. Bontly proposes a novel way to solve the non-identity problem in person-affecting terms. Bontly's argument is based on a contrastive causal account of harm. In this response, we argue that Bontly's argument fails even assuming that the contrastive causal account is correct.

Gianni Vattimo refers his weak interpretation of metaphysics to its Christian provenance. He argues that his nihilist secularization theory divulges the full and ultimate meaning of Christianity. This model understands Christianity as God who ‘returns,’ not as an eternal substance but as one who in his return reveals himself as becoming the current nihilist hermeneutic flux that is reality. Vattimo takes kenosis as the model of the destiny of ontology. God takes a distance from the eternal origin and lets go (...) of his transcendent divinity. From this, Vattimo learns that truth becomes a purely ‘wordly’ matter without any external, c.q. metaphysical or sacred reference. The Good message is: there are only messages, no facts. God’s return has to be understood epistmo-theologically. Revelation is now completely accomplished in a nihilist, endless way: Christianity means keeping thought away from petrifying into truth, fact, and reality. This is pure Christian caritas in that it does away with the violence of metaphysics and the sacred and thereby discourages all human attempts toward violence. Redeeming though this may sound, perhaps Vattimo is too naïve and too theologically shallow. (shrink)

The price of sequencing all the DNA in a person's genome is falling so fast that, according to one biotech leader, soon it won't cost much more than flushing a toilet. Getting all that genomic data at an ever‐lower cost excites the imaginations not only of biotech investors and researchers but also of the President and many members of Congress. They envision the data ushering in an age of “personalized medicine,” where medical care is tailored to persons’ genomes. The new (...) name “precision medicine” should not distract us from the fact that the genomic information it depends on is more complex, uncertain, and ambiguous than anyone had hoped, nor should it distract us from an important ethical point. Unfortunately, several developments of the last fifteen years suggest that, in our excitement about the technological capacity to gather genomic data at an ever lower cost, we are drifting away from what has long been a basic ethical commitment: to offer persons a process that enables them to provide informed consent before they or anyone else accesses their genetic information. Our understanding of the cognitive processes involved in reading has been advanced by computational models that simulate those processes. Unfortunately, most of these models have been developed to explain the reading of English and other alphabetic languages, with relatively fewer efforts to examine whether or not the assumptions of these models also explain what has been learned from other languages and, in particular, non-alphabetic writing systems like Chinese. In this article, we will review those computational models that have been developed (...) to explain the reading of Chinese, with the goal of comparing their theoretical assumptions to those of models that explain the reading of English. Our analysis indicates that there are both points of convergence and divergence between the theoretical assumptions of Chinese versus English models, suggesting that the cognitive systems supporting reading may be differentially influenced by features of the languages and/or writing systems, or that certain theoretical assumptions developed to explain the reading of one language might be adapted to explain the reading of others. Anita Silvers (1998) has criticized those who argue that members of marginalized groups are vulnerable to a special threat posed by physician-assisted suicide (PAS) and voluntary active euthanasia (VAE). She argues that paternalistic measures prohibiting PAS/VAE in order to protect these groups only serve to marginalize them further by characterizing them as belonging to a definitively weak class. I offer a new conception of vulnerability, one that demonstrates how rich, educated, white males, who are typically regarded as having their autonomy (...) enhanced by their social status, are just as, if not more, vulnerable to threats posed by PAS/VAE as a result of the harmful social messages at work just below the surface of contemporary Western culture. I use this new conception of vulnerability to reinforce arguments for continued statutory prohibitions on PAS/VAE. (shrink)

This chapter deals with an area of study sometimes called “formal value theory” or “formal axiology”. Roughly characterized, this area investigates the structural and logical properties of value properties and value relations, such as goodness, badness, and betterness. There is a long-standing controversy about whether goodness and badness can, in principle, be measured on a cardinal scale, in a way similar to the measurement of well-understood quantitative concepts like length. Sect. 28.1 investigates this issue, mainly by comparing the properties of (...) the relations “longer than” and “better than”. In Sect. 28.2, some attempts to define goodness and badness in terms of the betterness relation are discussed, and a novel suggestion is made. People often remember what they attend to in the world. Such memory can be cast as a kind of mental catalog or index of attended objects. To investigate how such an index is acquired and used, protocol data were collected from a programmer who scrolled to off‐screen objects from time to time as she worked. These protocol data were modeled using Soar, which constrains how the index is constructed. In the model, an index entry is an episodic trace encoded during (...) attention. The trace associates the attention event with a time symbol denoting the event's occurrence. Later, the model can ask itself whether it saw that object by calling to mind an image of the attention event. If this image retrieves a time symbol, then the model infers that the object exists and can reason about bringing the object back into view. Episodic indexing is a theory of these encoding and retrieval processes. It posits that information about attention events is encoded automatically, but that retrieval requires effort and knowledge. Episodic indexing is congruent with a range of results on episodic and temporal codes and recognition and recall processes. It incorporates source monitoring (Johnson, Hashtroudi, & Lindsay, 1993) and is a simple and pervasive form of long‐term working memory (Ericsson & Kintsch, 1995). (shrink)

Persons with profound intellectual and multiple disabilities cannot speak about their Quality of Life, which makes it necessary to involve others. In current approaches, these ‘others’ are seen as assessors trying to describe QoL as objectively as possible, which involves a reduction of their experiences, through which they develop knowledge on the QoL of the person with PIMD. The objective of this paper is to give caregivers’ knowledge on the QoL of a person with PIMD a theoretical basis that values (...) these experiences. We will argue that caregivers should be seen as witnesses, not assessors, and their statements on QoL as testimonies, not assessments. Audiences judge the trustworthiness of these witnesses intersubjectively, which implies a relationship characterized by trust and suspicion. Trust supports the witness to tell in her own words about the QoL of the person with PIMD; it demands receptivity, indicating that both the witness and the audience are willing to reconsider their perspective on QoL. Suspicion is necessary too, which helps the witness to critically approach her own interpretations and supports her to create more trustworthy testimonies. We conclude that the concept of witnessing helps to acknowledge caregivers’ experiential knowledge of QoL of a person with PIMD, which may also apply to other persons who cannot speak about their own QoL. We hope that our study will empower caregivers to give testimonies on QoL of a person with PIMD, which is crucial when complex decisions about the life of this person have to be made. (shrink)

We present an alternative solution to the problem of inductive generation of covers in formal topology by using a restricted form of type universes. These universes are at the same time constructive analogues of regular cardinals and sets of infinitary formulae. The technique of regular universes is also used to construct canonical positivity predicates for inductively generated covers.

International uproar followed the recent announcement of the birth of twin girls whose genomes had been edited with a breakthrough DNA editing-technology. This technology, called clustered regularly interspaced short palindrome repeats or CRISPR-Cas9, can alter any DNA, including DNA in embryos, meaning that changes can be passed to the offspring of the person that embryo becomes. Should we use gene editing technologies to change ourselves, our children, and future generations to come? The potential uses of CRISPR-Cas9 and other gene editing (...) technologies are unprecedented in human history. By using these technologies, we eradicate certain dreadful diseases. Altering human DNA, however, raises enormously difficult questions. Some of these questions are about safety: Can these technologies be deployed without posing an unreasonable risk of physical harm to current and future generations? Can all physical risks be adequately assessed, and responsibly managed? But gene editing technologies also raise other moral questions, which touch on deeply held, personal, cultural, and societal values: Might such technologies redefine what it means to be healthy, or normal, or cherished? Might they undermine relationships between parents and children, or exacerbate the gap between the haves and have-nots? The broadest form of this second kind of question is the focus of this book: What might gene editing--and related technologies--mean for human flourishing? In the new essays collected here, an interdisciplinary group of scholars asks age--old questions about the nature and well-being of humans in the context of a revolutionary new biotechnology--one that has the potential to change the genetic make-up of both existing people and future generations. Welcoming readers who study related issues and those not yet familiar with the formal study of bioethics, the authors of these essays open up a conversation about the ethics of gene editing. It is through this conversation that citizens can influence laws and the distribution of funding for science and medicine, that professional leaders can shape understanding and use of gene editing and related technologies by scientists, patients, and practitioners, and that individuals can make decisions about their own lives and the lives of their families. This paper examines the French erudite scholar Théodore Godefroy's (1580-1649) service to Cardinal Richelieu as a commercial expert. Using manuscripts that reveal his reading, connections and intellectual methods, it shows how Godefroy used his connections in the Parisian lettered circles and a politicized group within the Republic of Letters to gather commercial information, and used the techniques of juridical scholarship to organize his collection. His papers suggest that historians must look beyond a narrow canon of "mercantilist" works to understand seventeenth (...) century debates about the governance of commerce, to a broader context of debates about law, history, and sovereignty. In a just society, who should be liable for the significant costs associated with creating and raising children? Patrick Tomlin has recently argued that children themselves may be liable on the grounds that they benefit from being raised into independent adults. This view, which Tomlin calls ‘Kids Pay’, depends on the more general principle that a beneficiary can incur an obligation to share in the cost of an essential benefit that the benefactor is responsible for her requiring. I argue in (...) this paper that this principle is both generally false and particularly suspect in the kinds of cases that Tomlin needs it to be true, namely, cases in which a benefactor has created the need to be benefitted to satisfy a self-regarding interest in providing the benefit. In a nutshell, I argue that because parents electively put their children into a needy circumstance for the purpose of satisfying a self-regarding interest in meeting their children’s needs, they lack a legitimate claim against their children to share in its associated costs. William James' Radical Empiricist essays offer a unique and powerful argument for direct realism about our perceptions of objects. This theory can be completed with some observations by Kant on the intellectual preconditions for a perceptual judgment. Finally James and Kant deliver a powerful blow to the representational theory of perception and knowledge, which applies quite broadly to theories of representation generally.

An agent may abandon an initiated action plan, although he doesnot acquire new information or encounter unforeseen obstacles.Such dynamic inconsistency can be to the agent'';s guaranteeddisadvantage, and there is a debate on how it should rationallybe avoided. The main contenders are the sophisticated andthe resolute approaches. I argue that this debate is misconceived,since both approaches rely on false assumptions about theperformability of action plans. The nature and essence of democracy is a bigger issue today than it has been for a long time. With (clearly and allegedly) populist movements in Western Europe and the US, the question of what constitutes democracy has become a contentious issue, though often treated only implicitly. In this article, the nature and essence of democracy is treated with Francisco Suárez (1548-1617) as a guide. This is done on the background of his general metaphysics. It is concluded that Suárez's political (...) philosophy can be called democratic, as political power comes from and ultimately rests with “the people”, according to him. The right balance between “people”, in the plural, and “the people”, in the singular, cannot be calculated, though. On the background of the treatment of Suárez's political philosophy, some conclusions regarding how best to uphold and strengthen democracy are drawn. (shrink)

The interpretations in the secondary literature of Suárez’ position in the “classical” debate on the status of universals vary considerably. In this article, the problem is looked at from a slightly different angle: that of Suárez’ basic metaphysics of substantial forms and his views concerning understanding and knowledge. These areas of Suárez’ thought are thoroughly analysed and related to each other. Regarding the question of the status of universals it is argued that Suárez’ thought in the areas of substantial forms (...) and of understanding generally supports the reading of Suarez as a “moderate nominalist”.
