Norms conferring public or private powers, i.e., the competence to issue other norms, play a very important rôle in law. But there is no agreement among legal philosophers about the nature of such norms. There are two main groups of theories, those that regard them as a kind of norms of conduct (either commands or permissions) and those that regard them as non-reducible to other types of norms. I try to show that reductionist theories are not quite acceptable; neither the (...) command-variety (Kelsen, Alf Ross inOn Law and Justice), nor the permission-variety (von Wright, Kanger, Lindahl) provide a satisfactory account of competence norms.Among the authors who maintain that competence norms are different from (and hence not reducible to) norms of conduct are Hart, Ross inDirectives and Norms, and Searle. Ross and Searle distinguish between regulative and constitutive rules as two radically different kinds of rules and classify competence norms among constitutive rules. This distinction runs parallel to von Wright's distinction between rules that are prescriptions and determinative rules. While the first regulate actions (by commanding, prohibiting, or permitting them), determinative rules define certain concepts. To view competence norms as (partial) definitions of certain legal concepts (like those of legislator, judge, etc.) seems to open interesting perspectives and to shed light on at least one aspect of these elusive norms. Emerging reprogenetic technologies may enable the enhancement of our offspring's genes. Beyond raising ethical questions, these biotechnologies may change some aspects of future morality. In the reproductive field, biotechnological innovations may transform moral views about reproductive choices regarding what we consider to be just or even of equal standing.

The trolley problem is one of the liveliest research frameworks in experimental ethics. In the last decade, social neuroscience and experimental moral psychology have gone beyond the studies with mere text-based hypothetical moral dilemmas. In this article, I present the rationale behind testing the actual behaviour in more realistic scenarios through Virtual Reality and summarize the body of evidence raised by the experiments with virtual trolley scenarios. Then, I approach the argument of Ramirez and LaBarge (2020), who claim that the (...) virtual simulation of the Footbridge version of the trolley dilemma is an unethical research practice, and I raise some objections to it. Finally, I provide some reflections about the means and ends of trolley-like scenarios and other sacrificial dilemmas in experimental ethics. (shrink)

Emerging reprogenetic technologies may radically change how humans reproduce in the not-so-distant future. One foreseeable consequence of disruptive innovations in the procreative domain is an increase in the reproductive autonomy of intended parents. Regarding the prospective parental liberty of enhancing non-health–related traits of the offspring, one controversy has particularly dominated the literature. Does parents' choice of genetically enhancing the traits of their descendants compromise children's future personal autonomy? In this article, I will analyse the main arguments which posit that reprogenetic (...) enhancement could be at odds with the child's future autonomy. I will argue that these objections are ill-founded. Moreover, I will present other arguments that show that reprogenetic technologies can enhance the autonomy of future children. Autonomy enhancement is a plausible and pro tanto desirable application of emerging reprogenetic technologies. (shrink)

The historical background of the 19th century electromagnetic theory is revisited from the standpoint of the opposition between alternative approaches in respect to the problem of interactions. The 19th century electrodynamics became the battle-field of a paramount importance to test existing conceptions of interactions. Hertz’s experiments were designed to bring a solid experimental evidence in favor of one of them. The modern scientific method applied to analyze Hertz’s experimental approach as well as the analysis of his laboratory notes, dairy and (...) private letters show that Hertz’s ‘‘crucial’’ experiments cannot be considered as conclusive at many points as it is generally implied. We found that alternative Helmholtz’s electrodynamics did not contradict any of Hertz’s experimental observations of transverse components as Maxwell’s theory predicted. Moreover, as we now know from recently published Hertz’s dairy and private notes, his first experimental results indicated clearly on infinite rate of propagation. Nevertheless, Hertz’s experiments provided no further explicit information on non-local longitudinal components which were such an essential feature of Helmholtz’s theory. Necessary and sufficient conditions for a decisive choice on the adequate account of electromagnetic interactions are discussed from the position of modern scientific method. (shrink)

Esta tesis tiene como objetivo proponer una perspectiva crítica que permita un análisis filosófico del arte que fue desarrollada a partir de una lectura de El arte como experiencia de John Dewey. Para ello, recupero en primer lugar dos conceptos centrales, arte y experiencia, para desarrollar luego tres conceptos subsidiarios, expresión, comunicación y educación de la sensibilidad.

Introduzione Nel codice della sua Bibliotheca consacrato a recensire la produzione letteraria di Temistio, il patriarca Fozio testimonia di aver letto – oltre ad alcune opere filosofiche – un corpus di trentasei discorsi politici (λόγοι πολιτιϰοιλς), tra cui alcuni indirizzati a Costanzo, a Valente e Valentiniano II, a Teodosio, non tutti pervenuti. Ora, l'opera oratoria di Temistio, quale noi moderni leggiamo, comprende trentatrè orazioni, pubbliche e private, di cui due (o forse tre) incomplete. È molto probabile che gli altri tre (...) discorsi che Fozio ugualmente leggeva siano da identificare con orazioni perdute, di cui sopravvivono talune notizie: il discorso recitato nel 357 dinanzi al senato di Costantinopoli in occasione di un'ambasceria a Roma, il panegirico indirizzato nel 363 all'imperatore Giuliano per il suo quarto consolato e l'orazione sulla tolleranza religiosa indirizzata a Valente tra gli anni 375–376. Verrebbe, in questo modo, confermata la notizia della Bibliotheca circa l'esistenza di un corpus di complessivi trentasei discorsi ed in particolare rafforzata l'ipotesi, ventilata da taluni studiosi, secondo cui la silloge temistiana in nostro possesso corrisponderebbe in buona sostanza al ‘libro’ recensito da Fozio. Scientific misconduct obstructs the advance of knowledge in science. Its impact in some disciplines is still poorly known, as is the frequency in which it is detected. Here, I examine how frequently editors of ecology and evolution journals detect scientist misconduct. On average, editors managed 0.114 allegations of misconduct per year. Editors considered 6 of 14 allegations (42.9%) to be true, but only in 2 cases were the authors declared guilty, the remaining being dropped for lack of proof. The annual (...) rate of allegations that were probably warranted was 0.053, although the rate of demonstrated misconduct was 0.018, while the rate of false or erroneous allegations was 0.024. Considering that several cases of misconduct are probably not reported, these findings suggest that editors detect less than one-third of all fraudulent papers. (shrink)

Close insight into mathematical and conceptual structure of classical field theories shows serious inconsistencies in their common basis. In other words, we claim in this work to have come across two severe mathematical blunders in the very foundations of theoretical hydrodynamics. One of the defects concerns the traditional treatment of time derivatives in Eulerian hydrodynamic description. The other one resides in the conventional demonstration of the so-called Convection Theorem. Both approaches are thought to be necessary for cross-verification of the standard (...) differential form of continuity equation. Any revision of these fundamental results might have important implications for all classical field theories. Rigorous reconsideration of time derivatives in Eulerian description shows that it evokes Minkowski metric for any flow field domain without any previous postulation. Mathematical approach is developed within the framework of congruences for general four-dimensional differentiable manifold and the final result is formulated in form of a theorem. A modified version of the Convection Theorem provides a necessary cross-verification for a reconsidered differential form of continuity equation. Although the approach is developed for one-component (scalar) flow field, it can be easily generalized to any tensor field. Some possible implications for classical electrodynamics are also explored. Ageism has unfortunately become a salient phenomenon during the COVID-19 pandemic. In particular, triage decisions based on age have been hotly discussed. In this article, I first defend that, although there are ethical reasons (founded on the principles of benefit and fairness) to consider the age of patients in triage dilemmas, using age as a categorical exclusion is an unjustifiable ageist practice. Then, I argue that ageism during the pandemic has been fueled by media narratives and unfair assumptions which have (...) led to an ethically problematic group homogenization of the older population. Finally, I conclude that an intersectional perspective can shed light on further controversies on ageism and triage in the post-pandemic future. (shrink)

Standard citation-based bibliometric tools have severe limitations when they are applied to periods in the history of science and the humanities before the advent of now-current citation practices. This paper presents an alternative method involving the extracting and analysis of mentions to map and analyze links between scholars and texts in periods that fall outside the scope of citation-based studies. Focusing on one specific discipline in one particular period and language area—Anglophone philosophy between 1890 and 1979—we describe a procedure to (...) create a mention index by identifying, extracting, and disambiguating mentions in academic publications. Our mention index includes 1,095,765 mention links, extracted from 22,977 articles published in 12 journals. We successfully link 93% of these mentions to specific philosophers, with an estimated precision of 82% to 91%. Moreover, we integrate the mention index into a database named EDHIPHY, which includes data and metadata from multiple sources and enables multidimensional mention analyses. In the final part of the paper, we present four case studies conducted by domain experts, demonstrating the use and the potential of both EDHIPHY and mention analyses more generally. (shrink)

The cumulative impact of enhancement technologies may alter the human species in the very long-term future. In this article, I will start showing how radical genetic enhancements may accelerate the conversion into a novel species. I will also clarify the concepts of ‘biological species’, ‘transhuman’ and ‘posthuman’. Then, I will summarize some ethical arguments for creating a transhuman or posthuman species with a substantially higher level of well-being than the human one. In particular, I will present what I shall call (...) the Principle of the Best Interests of Posthumanity, which states that the enhancement of the human and transhuman species must be directed towards the creation of a posthuman existence that is substantially more valuable than its predecessors. I suggest that human extinction may be considered, within that principle, as one of the best interests of posthumanity. Finally, I will develop three objections that make that principle unattractive and that show that pursuing a full-blown programme of posthuman evolution is ethically flawed. (shrink)

Biomedical innovations are making possible the enhancement of human capabilities. There are two philosophical stances on the role that medicine should play in this respect. On the one hand, naturalism rejects every medical intervention that goes beyond preventing and treating disease. On the other hand, welfarism advocates enhancements that foster subjective well-being. We will show that both positions have considerable shortcomings. Consequently, we will introduce a third characterization in which therapies and enhancements can be reconciled with the legitimate objectives of (...) medicine inasmuch as they improve the capabilities that enable the freedom to pursue personal well-being. In this work I argue that Descartes was not a trialist by showing that the main tenets of trialist interpretations of Descartes's theory of substance are either not supported by the text or are not sufficient for establishing the trialist interpretation.

Conventional quantitative methods for the measurement of organizational legitimacy consider mainly three sources that make judgments about organizations visible: news media, accreditation bodies, and surveys. Over the last decade, however, social media have enabled ordinary citizens to bypass the gatekeeping function of these institutional evaluators and autonomously make individual judgments public. This inclusion of voices beyond functional and formally organized stakeholder groups potentially pluralizes the ongoing discussions about organizations. The individual judgments in blogs, tweets, and Facebook posts give indication about (...) the broader fit between an organization’s perceived behavior and heterogeneous social norms and therefore constitute an indicator of organizational legitimacy that can be accessed and measured. We propose the use of social media data and sentiment analysis to study the affect-based responses to organizational actions by citizens. We critically discuss and compare the method with existing quantitative methods for legitimacy measurement and apply them to a recent case in the banking industry. We discuss the value of the method for studying the process of legitimacy construction as the expression and negotiation of normative judgments about organizations by various evaluators. (shrink)

Value change is a phenomenon that is gaining increasing attention in ethical analyses of technologies. However, a comprehensive study of how reprogenetic technologies and values coevolve is lacking. To remedy this gap, in this overview article, I address the relationship between reprogenetics and value change. This contribution thus argues for the importance of investigating the phenomenon of value change in relation to the technological controversies discussed in bioethics. To meet this goal, I begin by clarifying, first, how technologies shape reproductive (...) choice. I then clarify what “values” and “moral values” are, how reprogenetic technologies are value laden, and what values are often discussed in reprogenetics debates. Next, I show five types of value changes that have occurred in advance in reproductive and genetic technologies. Finally, I argue for the bioethical relevance of discussing future techno-value change, pointing out the descriptive and normative challenges of this philosophical endeavor. (shrink)

Science maps are visual representations of the structure and dynamics of scholarly knowl­edge. They aim to show how fields, disciplines, journals, scientists, publications, and scientific terms relate to each other. Science mapping is the body of methods and techniques that have been developed for generating science maps. This entry is an introduction to science maps and science mapping. It focuses on the conceptual, theoretical, and methodological issues of science mapping, rather than on the mathematical formulation of science mapping techniques. After (...) a brief history of science mapping, we describe the general procedure for building a science map, presenting the data sources and the methods to select, clean, and pre-process the data. Next, we examine in detail how the most common types of science maps, namely the citation-based and the term-based, are generated. Both are based on networks: the former on the network of publications connected by citations, the latter on the network of terms co-occurring in publications. We review the rationale behind these mapping approaches, as well as the techniques and methods to build the maps. We also present less-common types of science maps, including co-authorship networks, interlocking editorship networks, maps based on patents’ data, and geographic maps of science. Moreover, we consider how time can be represented in science maps to investigate the dynamics of science. We also discuss some epistemological and sociological topics that can help in the interpretation, contextualization, and assessment of science maps. Then, we present some possible applications of science maps in science policy. In the conclusion, we point out why science mapping may be interesting for all the branches of meta-science, from knowl­edge organization to epistemology. (shrink)

In her recent article, Prince has identified a critical challenge for those who advocate genetic enhancement to reduce social injustices. The gene–environment interaction prevents genetic enhancement from having equitable effects at the phenotypic level, even if enhancement were available to the entire population. The poor would benefit less than the rich from their improved genes because their genotypes would interact with more unfavourable socioeconomic environments. Therefore, Prince believes that genetic enhancement should not be used to combat social inequalities, since it (...) can likely aggravate them. In this article, I raise various objections to this conclusion. I argue first that genetic enhancement need not necessarily magnify social injustices. I then show that genetic enhancement can play a modest but not insignificant role in the quest for social justice in the future. Finally, I conclude by arguing for the need to consider the complex interplay between the social lottery and the natural lottery in our aspirations for justice linked to genetic technologies. The increasing application of artificial intelligence (AI) to healthcare raises both hope and ethical concerns. Some advanced machine learning methods provide accurate clinical predictions at the expense of a significant lack of explainability. Alex John London has defended that accuracy is a more important value than explainability in AI medicine. In this article, we locate the trade-off between accurate performance and explainable algorithms in the context of distributive justice. We acknowledge that accuracy is cardinal from outcome-oriented justice because it helps (...) to maximize patients’ benefits and optimizes limited resources. However, we claim that the opaqueness of the algorithmic black box and its absence of explainability threatens core commitments of procedural fairness such as accountability, avoidance of bias, and transparency. To illustrate this, we discuss liver transplantation as a case of critical medical resources in which the lack of explainability in AI-based allocation algorithms is procedurally unfair. Finally, we provide a number of ethical recommendations for when considering the use of unexplainable algorithms in the distribution of health-related resources. (shrink)

BackgroundGenetic/genomic testing (GGT) are useful tools for improving health and preventing diseases. Still, since GGT deals with sensitive personal information that could significantly impact a patient’s life or that of their family, it becomes imperative to consider Ethical, Legal and Social Implications (ELSI). Thus, ELSI studies aim to identify and address concerns raised by genomic research that could affect individuals, their family, and society. However, there are quantitative and qualitative discrepancies in the literature to describe the elements that provide content (...) to the ELSI studies and such problems may result in patient misinformation and harmful choices.MethodsWe analyzed the major international documents published by international organizations to specify the parameters that define ELSI and the recognized criteria for GGT, which may prove useful for researchers, health professionals and policymakers. First, we defined the parameters of the ethical, legal and social fields in GGT to avoid ambiguities when using the acronym ELSI. Then, we selected nine documents from 44 relevant publications by international organizations related to genomic medicine.ResultsWe identified 29 ELSI sub-criteria concerning to GGT, which were organized and grouped within 10 minimum criteria: two from the ethical field, four from the legal field and four from the social field. An additional analysis of the number of appearances of these 29 sub-criteria in the analyzed documents allowed us to order them and to determine 7 priority criteria for starting to evaluate and propose national regulations for GGT.ConclusionsWe propose that the ELSI criteria identified herein could serve as a starting point to formulate national regulation on personalized genomic medicine, ensuring consistency with international bioethical requirements. The problem is addressed of establishing the satisfiability of prenex formulas involving a single universal quantifier, in diversified axiomatic set theories. A rather general decision method for solving this problem is illustrated through the treatment of membership theories of increasing strength, ending with a subtheory of Zermelo-Fraenkel which is already complete with respect to the ∀*∀ class of sentences. NP-hardness and NP-completeness results concerning the problems under study are achieved and a technique for restricting the universal quantifier is presented.

The history of humankind is full of examples that indicate a constant desire to make human beings more moral. Nowadays, technological breakthroughs might have a significant impact on our moral character and abilities. This is the case of Virtual Reality (VR) technologies. The aim of this paper is to consider the ethical aspects of the use of VR in enhancing empathy. First, we will offer an introduction to VR, explaining its fundamental features, devices and concepts. Then, we will approach the (...) characterization of VR as an “empathy machine,” showing why this medium has aroused so much interest and why, nevertheless, we do not believe it is the ideal way to enhance empathy. As an alternative, we will consider fostering empathy-related abilities through virtual embodiment in avatars. In the conclusion, however, we will, we will examine some of the serious concerns related to the ethical relevance of empathy and will defend the philosophical case for a reason-guided empathy, also suggesting specific guidelines for possible future developments of empathy enhancement projects through VR embodied experiences. Esta nueva esfera pública virtual, en la que surge y vive la opinión de (...) las masas, ha transformado y enriquecido las maneras de relacionarse y movilizarse políticamente, pero también entraña peligros como la manipulación de la información y la extrema polarización de las ideas que se comparten en los entornos digitales.Desde la doble perspectiva del análisis del discurso y de la pragmática lingüística, este libro aborda, de manera divulgativa, el estudio de las distintas manifestaciones de la opinión pública en los nuevos entornos digitales. Se analizan textos de naturaleza muy diversa, con el fin de mostrar las estrategias discursivas y los recursos lingüísticos más utilizados por los ciudadanos para expresar sus puntos de vista y reivindicar sus propuestas en la red. Tanto el transhumanismo como el posthumanismo filosófico han prestado una atención especial a la corporalidad humana en relación al avance tecnológico. En el presente artículo, se comienza señalando cómo ambos movimientos difieren significativamente respecto a la herencia del humanismo. Posteriormente, se aborda la noción transhumanista de la ‘libertad morfológica’ de la mano de More, Sandberg y Bostrom. A continuación, se presentan casos paradigmáticos de modificaciones corporales mediante implantes cibernéticos. En último lugar, se problematizan las cuestiones de la identidad, la corporalidad (...) y el desencuentro entre ambas corrientes respecto al ‘volcado de la mente’. (shrink)

La vida en el futuro a corto plazo será revolucionada por el efecto creciente de tecnología multidisciplinaria en todas las dimensiones: social, económico, político, y personal. La revolución de disponibilidad de la información y utilidad seguirá afectando en profundidad el mundo en todas estas dimensiones. Los resultados serán asombrosos. Los efectos pueden incluir mejoras significativas de la calidad de vida, las altas tarifas de volumen de ventas industrial, la globalización continuada, la amalgamación cultural o la epidemia de aislamiento de los (...) individuos, así como el aislamiento personal en una tentativa de hacerse más abiertos mundialmente. La realización real de estas posibilidades dependerá de un número de factores, incluyendo la aceptación local de cambio tecnológico, niveles de inversiones de infraestructura y tecnología. El paso rápido de desarrollo tecnológico y brechas hace la previsión difícil, pero la revolución de la tecnología a escala mundial parece significativa y muy probable.Life in the short-term future will be revolutionized by the growing effect of multidisciplinary technology across all dimensions of life: social, economic, political, and personal. The revolution of information availability and utility will continue to profoundly affect the world in all these dimensions. The results will be astonishing. Effects may include significant improvements in human quality of life, high rates of industrial turnover, continued globalization, cultural amalgamation or invasion of individuals’ privacy, as well as personal isolation in an attempt to become more open worldwidely. The actual realization of these possibilities will depend on a number of factors, including local acceptance of technological change, levels of technology and infrastructure investments. The fast pace of technological development and breakthroughs makes foresight difficult, but the technology revolution seems globally significant and quite likely. (shrink)

In response to De Proost and Segers, we provide further reflections on how technologies induce moral change. We discuss moral changes at the societal level as distinguished from changes in bioethical principles or ethical concepts, impacts on theories of justice, and whether the transformations are negative or positive.
